UPS Store gave my $3600 package to the wrong person. What now? Posted: 07 Jul 2018 10:10 AM PDT A couple of weeks ago I ordered a brand new MacBook Pro from Apple but I had it sent to the UPS store because I knew i'd be at work and wouldn't be able to sign for it. Yesterday it arrived so I went in at 9am to pick it up. I got there and they couldn't find my package, but they had proof that it was there. They realized that one of their customers must have accidentally taken it when he took his pile of packages because it was on the counter next to his boxes. They contacted him and he said he would return it right away. It's now been over 26 hours and he still hasn't returned it. I'm making this post because i'm not really sure what kind of steps I need to make if he doesn't return it. My package was never marked as picked off because he never signed for it or got it scanned, it was just picked up and taken out. I'm not sure if the person that took it is liable, The UPS Store, or UPS? Edit: I am located in Provo, UT Update: I got in touch with apple support and they are going to investigate and send a replacement. I also got the UPS Store to send me an email admitting they accidentally gave my package to somebody else. Apparently they got in touch with the guy that took the package and he is camping? Posted: 07 Jul 2018 10:44 AM PDT I have spoken to management about the issue at the apartment. They were not aware of the baby or the boyfriend that is living in my apartment. I reminded them of the note in my file as well as the reason. The company was apologetic and has stated that they will be speaking to the roommate in question as well as sending over maintenance to install a temporary lock to prevent them from accessing my bathroom. I only hope that they are able to force both child and boyfriend out as it turns out neither is on the lease. Some may say I am being heartless but I'm a graduate student in a top veterinary school nationwide and a young child will be detrimental to my academic life. Furthermore, the strange boyfriend impedes my recovery as I was raped by a stranger. I don't mind men that I know such as family, friends, and professors, but upon finding out that he is not on the lease, it is apparent that he has not been background checked which only makes me edgier. Thank you for your help, I will update again later. [link] [comments] |
Posted: 07 Jul 2018 08:22 AM PDT So long story short I lost my phone on Fourth of July on a river. I bought a new phone because I need one for work constantly but I could track the old one for a while and I saw someone had found it. It's in lost mode so you can't do anything with it if you don't know the password to my Apple ID, but today my dad got a call because I had his number on the lock screen case someone found it and the guy said he found it but he wants $40 for the phone to be returned to me. I know it's not a lot of money but can he do this? I just spent $600 to get a new phone so I really don't wanna spend anymore money to get it back. Can I just have the police come with me and make them give me my phone back for free? I couldn't find anything online about this and didn't know where else to go for help. [link] [comments] |
Posted: 07 Jul 2018 12:20 PM PDT Link to the main post: https://www.reddit.com/r/legaladvice/comments/6t0rb5/ghana_west_africa_my_university_wants_students_to/ First update: https://www.reddit.com/r/legaladvice/comments/6t8ri5/update_ghana_west_africa_my_university_wants/ So it's been about ten months since this issue. Although I wasn't able to make any legal impact on the situation, there have been some changes that I thought warranted an update. The situation really didn't sit well with me so I wrote several complaint letters to the head of the hostel, the dean of my school, and the provost of my college. They were largely ignored or I was given non-committal answers about why that happened to us. I think I wore them down eventually, because they all agreed to meet with me. Honestly it was very intimidating, having to meet all the heads of my school. There was a lot of pressure on me to back down, because it is unheard of to question superiors like that, especially as a woman. A senior lecturer even advised me personally to do so, or else my career would be over before it started. I nearly did, but I swallowed my fear and went through with it. The meeting was in late May, before we ended that academic year. I had been gathering anonymous, handwritten opinions about the situation from my classmates and presented them to the panel. I stressed a lot on how I personally struggled with accommodation on such short notice and how the general maintenance of the rooms is the responsibility of the university, as outlines in their rule book. They told me that painting rooms is only supposed to happen after five years, that the rooms weren't even that dirty to begin with. I had some pictures of some rooms before they were painted (they were originally white but at that point mostly brown with patches of grey, several rooms also had stains from where water had leaked into the room from the roof). Amazingly, after about two hours of discussion, they decided to stop making students paint rooms by themselves, and are currently amending their policy to paint every year instead of twice a decade. However, they refuse to refund the money we spent painting the rooms, claiming that the painters weren't hired by the university and we the students weren't given receipts so they cannot trust any price we quote. While I'm not happy about loosing 80 cedis, I'm proud that I've made an impact and stood up. Maybe someone else will have more success. Thank you for all your help. [link] [comments] |
[FL] My mom is trying to become a tenant in my home. How can I legally get her out? Posted: 07 Jul 2018 06:41 AM PDT I'm going to sum this up as best as possible, if you want the full detailed story go read my post on r/justnomil. But basically my mom didn't renew her lease and didn't find a new place to live. She made it out that she had a new job and new place lined up and just needed to stay with me for a couple of days until she could get moved in to the new place. Now, it's been a week and I have found out that there is no new job, no new place of residence, and, on top of that, she quit the job she did have. Also, I found out yesterday she forwarded her mail to my address. I do not want her living here and I do not want her to get tenant rights. If it's been 7 days since she started staying here, is she already a tenant? Do I need to go through a formal eviction or is she still considered a guest at this point? This is in Florida. [MO]Wife fired today for work not done over maternity leave. Posted: 06 Jul 2018 03:51 PM PDT Wife has been back at work for less than 2 months. While she was out no one did any of the file casework for her job. They were audited and she was let go. The reason being her files were to bare during the time she was out. She couldn't have filled out the information needed as she was not there during the time. Just curious if legal recourse could be an option. [link] [comments] |
Accidentally double paid my rent Posted: 07 Jul 2018 03:48 AM PDT [Maryland, US]. Typically when I hit submit on my online rent payment, the page refreshes and my balance is automatically set to $0.00. However a couple days ago after I paid, the balance remained the same. I thought that perhaps it didn't go through, so I did it again and now I'm being charged twice for the same month. The thing is this is the last month on my lease. I called the apartment office and the lady essentially told me that they will hold on to it and take out "damages" at the end of the month when I leave. I got angry, because this was an accidental payment towards rent not towards some made up charges that they're notorious for making I then called my bank and tried disputing one of the payments. I used a debit card so already I know I'm not in the best situation here. The thing is, since this is an error on my part, am I likely to win this case? I've looked online and most dispute cases are typically the fault of the merchant not the customer. Edit: Thanks everyone. I reached out to my bank this afternoon, and was told that since I reached out so early, they were able to stop the payment. They didn't need to contact the management office of the apartment. I've been asked to wait 3-5 days to see it back in my account (guaranteed). [link] [comments] |
Landlord trapped raccoons in wall and allowed them to die there Posted: 06 Jul 2018 08:41 PM PDT We've had raccoons in our walls twice since moving in last December. The previous time was dealt with by old management. This time, when we complained, the office told us maintenance had sealed the entrance they were getting through. That's all good and all, but the raccoons were still in our walls. We complained again and were met with the same response. They never tried to solve the issue of the raccoons now being trapped in our complex walls. We know they were still there because you can hear them chattering and roaming about. Well, I think the raccoons have now died, most likely of dehydration in the hot Texas summer, and we now have dead raccoons trapped in our walls. This has caused not only a horrendous smell but a fly infestation. Are the landlords responsible for dealing with the removal as well as this new pest problem? Is there anyway to make them follow through with a real solution this time? [link] [comments] |
Posted: 07 Jul 2018 05:54 AM PDT (OH). I've been working at this warehouse for 7.5 years, and I keep having issues with a fellow employee who has harrassed me continually. A month ago he pushed me so far that I reacted violently. I didn't strike him but I knocked food out of his hands. We we're both taken out of service and brought back, without pay for time missed. Fast forward a month and he is harassing me again, this time using my sexual orientation (bisexual) as an insult. He is telling other coworkers im a faggot and I want to suck his dick. I read in the equality act of 2010 that discrimination because of orientation is illegal, but this only stated it was illegal for employers to discriminate. Is there anything I can do? I've been telling managent about these issues as long as they've existed, but the sexual harrassment is new. Honestly I've never experienced it before. In the past situations management has tried to sweep it under the rug, but this is too much to ignore right? Edit: This is a unionized warehouse. (Teamsters) [link] [comments] |
My Mother was Murdered, her killer arrested. Life insurance won't/can't pay...? Posted: 07 Jul 2018 11:08 AM PDT On June 19th my Mother was murdered. The police have arrested a man for the crime. Her death certificate, under cause of death says: "Pending Investigation". Because of this fact, neither her life insurance policy, nor the policy she has with her long time employer will pay her policies. The life insurance policy, which she has been paying since 1995, after my father's untimely death from a heart attack, is for $100,000. They will not tell me what her policy from work is for. Less, I assume. Not only is it madness to live through having a loved one murdered, but the normal cost of dying, that is usually covered by insurance is becoming a burden. Will we just have to wait until after the trial? (God knows when that'll be, and how long it'll take). What if the man is found not guilty? Can the insurance companies be made to pay her policies before the trial? She paid into them for 23 years. It was her money, and she wanted me to have it. It is not a tremendous amount of money either, so would paying a lawyer to fight to get it, leave it worth having? So many questions, in such a difficult, crazy, crazy time. So, has anyone been through something like this before here? Are there life insurance lawyers here who can offer advice? Anyway, any advice or experience shared is greatly appreciated. -Alexander [link] [comments] |
New roommate recently moved in-with her baby and boyfriend Posted: 06 Jul 2018 06:36 PM PDT Hi Reddit! I'm in a kind of awkward situation over here in California. I'm a vet student who has an off campus apartment that rents by the bedroom. It's four bedrooms, two bathrooms. The bathrooms are Jack and Jill style. I'm currently the only one living there. I've been out of state on a veterinary internship and while out, received notification I had a new roommate. That's cool, I don't mind, I expected it. I try to text and email the new roommate for the next two weeks, nothing. I got home late morning to an interesting situation. My new roommate is indeed there but so is her boyfriend and a noisy three month old baby. They trade off working days, one works, the other babysits for the day because according to them they can't afford daycare. This makes me feel uncomfortable. I am not uncomfortable with the female but with the male, I am a rape survivor and generally feel uncomfortable with men, something I indicated on my file, no male roommates. Therefore, there are days where he is to be in the apartment the entire day, making me feel unsafe. Furthermore, they share the bathroom connected to my room, thus he can have full access to my bedroom by going through the bathroom, even if I lock the bedroom door. I kind of have a theory that perhaps they can't afford much. By moving into a student apartment building, they only have to pay by the room, leading to a much cheaper rent. My main concern is that I am worried a young child will be detrimental to my academic life and the presence of a male in my living space detrimental to my mental health. If I go to management and they know that he is living there and is supposed to be living there, is there any way to break my lease or force apartment management to let me move? [link] [comments] |
Moved into new house. Previous owner hid HORRENDOUS cat urine problem Posted: 06 Jul 2018 09:07 PM PDT Hi, My wife, newborn baby and I just moved into a house that we closed on at the end of May in Portland Oregon. As we were moving in, we noticed a cat urine smell that we hadn't noticed during our prior visits. After we got all the boxes in, I began crawling around and found two 8-10' patches of carpet literally soaked in urine. I rented a carpet shampooer and that didn't work so I had a carpet cleaner come out, and he confirmed the carpet is a goner and that some of the sub floor was rotting/molding. The main issue is the living room and hallway, about 410 square feet of flooring in total. I took tons of pictures. I immediately got a flooring guy out who ripped everything up and we found that the two long patches of urine soaked areas had recent patches to the subfloor, previous owner is a contractor, so it's clear the he knew how bad the problem was and tried to rather poorly fix it or hide it while the house was for sale. Additionally, when we moved in there were three air fresheners plugged in. All signs pointing to a problem that they knew about. It's going to be about $3,500 all in with carpet cleaner rental, pro carpet cleaner, repair work and new flooring. There is a chance we will have to do a flood cut to some of the drywall where urine is on the walls. To me, this 100% qualifies as something that they should have declared as a "meterial defect affecting the value of the property." Should I even bother talking to the previous owner or should I go straight to small claims court? Issue is he moved out of state and I don't have his new address, so I'm not sure how I can serve him. Can I sue for damages beyond the cost to repair in small claims court? This is a major inconvenience. I'm on my last few days of paternity leave and have spent most of it shampooing carpets, getting bids, etc instead of actually moving into my house and enjoying time with my wife and new baby. Additionally, had we known about the issue, we would have adjusted our rescinded our offer. I'm not one looking for a hand out but we were duped here. Thanks for any insight you have. My roommate is moving people into the house without my consent, do i have legal grounds? (TX) Posted: 07 Jul 2018 08:11 AM PDT My roommate and I are on the lease for the house we are living in right now. He tells me yesterday that he's going to be randomly getting married to someone from Kentucky and is moving in with her two kids. Do I have an legal grounds being on the lease to say I'm not okay with this? He'd be putting seven people in a small house into a lot of discomfort. And I'm not okay with my space being invaded either, he didn't even ask before making this choice. Help please? [link] [comments] |
Posted: 07 Jul 2018 08:27 AM PDT Hi everyone. I am in NYC, and I obtained a judgement of $5100 against someone in Chicago (I traveled there twice and won by default since he did not appear). Soon after, he left the country. He is now back in the U.S. I am getting a lot of conflicting information regarding how to collect on the judgement and what to do now. So, I turn to you: can anyone point me in the right direction? TL:DR - Won judgement against someone in another state. He fled the country. Now he's back. How can I collect? [link] [comments] |
35, inherited $30,000. Never got to see the trust, unsure if I got what I was entitled to. Posted: 07 Jul 2018 12:21 PM PDT I'm in California. Grandmother passed away and left a trust for her 4 children (3 aunts, and my father). My father passed away in '97. When my aunt called, she told me I was getting his share of my grandmother's money. She told me that the trust was made in the 80's and was structured in some way that all of the siblings had to be there to sign off on things. She used a copy of my dad's death certificate to advance things. I gather that my other aunts signed over some kind of authority to her so that she could disperse the trust without hassle. I never saw any paperwork, nor was I invited to any meeting, so I know nothing about this. My Aunt later called me and told me that I would need to come see her to receive a cashier's check. I arrived, and she told me that after my dad had died, my grandmother had rewritten/restructured (can't remember exact words) the trust so that I would receive 1/8th of the trust, this being almost $30,000. When I asked about taxes, my aunt told me that this was a gift, whether from my grandmother or from my aunts running the trust, I don't really know what she meant. She gave me the EIN number for the trust, and I copied the trust number when she had a folder open, but I have no idea who processed this trust or how to go about finding information. I want to see the trust, but I don't want to destroy family relationships, and I don't have the money to hire an attorney. I definitely don't want to through away my inheritance gambling on having a bigger amount, only to find that everything is correct. Advice? [link] [comments] |
Ex-girlfriend's mother called my employer and got me fired... Posted: 06 Jul 2018 06:36 PM PDT I live in CA, which is an "at will" state (meaning you can be fired/let go/you can quit without notice or explanation). I just scored this great new job and I was working there for about two weeks, maybe a total of 15 shifts that were training or real work. Had some ridiculous immature shit happen with my ex- girlfriend and her mother harassing my current girlfriend. The mother (we'll call her W) threatened my employment and my girlfriend's, saying things like "you won't work there long if I have anything to say about it". The following day, W actually went into my current girls work place and harassed and insulted her in front of employees and customers- to which my girl responded by calling the police and filing civil stay-away orders. Day after, I went into my regularly scheduled shift and as I was about to clock in my boss approached me and said that they "weren't going to continue with this", and I asked what he meant and he said "well we are an at-will company". And that's about it. I guess I don't have actual proof that this psychotic woman is rwspo, but it seems pretty suspicious to me. Is there any legal recourse to this?! [link] [comments] |
Housemates (married) I'm renting from both killed in traffic accident, I have no family contacts Posted: 07 Jul 2018 01:50 PM PDT I've been renting a floor in a house from two good friends for the last 5 years. No lease or paperwork. Friends were a married couple. Both of my friends were killed in a head-on collision. There are no children or siblings. Both have living parents whom I've met a few times, but all are out of state and I have no contact information for them and my deceased housemates aren't on social media. I'm trying very hard to find someone who can at least put me in touch with a parent. So far, no success. My friends were very private people and somewhat estranged from other family members and I have yet to find someone in our network of friends who has any connection with either family. I don't know what to do at this point. I'm setting aside my monthly rent for whomever it should go to as successor eventually. Is there anything I can legally do to take over utility payments like power/water/gas so service doesn't get cut off for non-payment… or should I just move out (while preserving my set-aside rent for eventual payment to whomever is entitled to it)? I want to do the right thing here. I absolutely want to pay my monthly rent to my friend's successors, and I'd also like to cover the utility bills until I've found a new place to live or until their successors and I reach an arrangement to continue living in the house as a renter. I also, to whatever extent is possible, would like to ensure my housemates' property is cared for. [That's the legal stuff… and I deliberately put it at the top of my post to separate it from the emotional stuff. Emotionally, I'm fucking devastated. Two of my closest friends for the last 20+ years wiped out by a drunk driver.] [link] [comments] |
Posted: 06 Jul 2018 04:45 PM PDT I was speaking with my mother tonight on the phone. I made an off handed joking comment about "football man won't stand" and she went absolutely berserk. Apparently (and I genuinely didn't know this) she is a very, very hardcore Trump supporter and unleashed on me. I know she voted for Trump, but I didn't realize she was this involved. At the end of our conversation, she made mention of the fact that I have been struggling to find a job post-degree. A few months ago, she offered to get me in touch with the HR manager at her workplace for a job in IT. This guy never responded to my (5+) e-mails, and never interviewed me for a job. At the end of our call, she said she intends to call the police and say that I am threatening to murder him for not responding to my e-mails. This did not happen. I do have firearms in my home. What can I do to protect myself now and in the future? Disclaimer: I'm not gonna lie, I'm pretty drunk at the moment. My father suggested fleeing, but I don't think drunk driving is a charge I want to add. Edit: I know this sounds like a troll post. Haha, millenaial liberal is bullied by Trump supporter. I swear to god that this happened and I'm happy to provide any proof necessary that is possible for me to provide. [link] [comments] |
The PT clinic I work at re-uses E-Stim Pads on all Patients - Is this legal? (Re-post) Posted: 07 Jul 2018 01:21 AM PDT (Repost from r/physicaltherapy) I work at an outpatient clinic in CA. I'm only an aide, however, as I work to put patients on modalities, I am disgusted by the fact that our clinic shares our TENS units stim electrodes between all patients and we are only instructed to change them 2-3 times a week max in an effort to cut costs. We are trained to apply some ethanol to the area that we will apply the electrodes to, however, this does not 100% solve the issue of: hair, dead skin cells, residue, bacteria, and it's especially un-hygienic and can potentially spread disease as we obviously have patients with open wounds, stitches, and sutures. I've applied e-stim electrodes in the groin region to one patient, and 20-30 minutes later, apply it to another patients neck and shoulder. I feel like this is a lawsuit waiting to happen. Every other clinic I have worked in and volunteered/observed at, ALL patients have their own e-stim electrodes. It even clearly states on the paper/packaging of the electrodes that it is for single patient use only, do not share electrodes. Are there no laws to this? EDIT: Does anybody know specifically where these laws are stated? I've spent the last 1.5 hours searching the FDA website and other pages with no luck as to clear laws against multi-patient use electrodes. They only talk about things regarding manufacturers of the TENS machines. EDIT2: My intention is to let my manager know about this, and hope she forwards this information to our CEO/Main PT. Posted: 07 Jul 2018 11:44 AM PDT Please don't lock this for being an update; I'm asking for further advice. Original post: https://www.reddit.com/r/legaladvice/comments/8woufc/us_fl_mother_just_threatened_to_call_in_a_false/ First off, thank you for your advice and not just assuming I was a troll. I know the situation sounds almost comical given the current political climate, so I'm glad (most) posters took me seriously. So again, thank you so much. It definitely helped me calm down. That said, the situation has developed further. After the phone call with her, I called my brother to explain the situation. He and I are the only two people in our extended family that willingly speak with my mother; everyone else has cut her out of their lives, which says a lot. He said that he would speak to her. About an hour later I get a call back, and he explains that he talked her out of it and also warned me away from any political discussion with her because apparently she's gotten absolutely vile to him about it as well. I told him I don't plan to speak to her verbally anymore, period, and he agreed that's probably a good idea. But of course, it doesn't end there. She isn't happy that I told my brother what she did. She then called my father (they are 15 years divorced, I live with him still) and informed him that she is going to wait until Tuesday and then call in the threat (which again, I never made). My hopes are that even if she does call it in, the police are not dumb enough to fall for what is obviously a fake report. If it was a real threat why did she wait five days, warn me she would call them in the future, and attempt to call my immediate family before reporting it? She is 100% trying to stir up drama in my life as revenge for making a political comment she didn't like. She knows I have severe clinical anxiety that hasn't responded to medication (yet, I'm trying new dosages soon), and is trying to make me miserable. So, I guess my questions are:

Posted: 07 Jul 2018 07:06 AM PDT Hey, I am 17 and I was recently assaulted by 4 dudes, looked like teens , where I live, they were looking to rob me but I had nothing on me beside a gopro that was thankfully recording, attached to my head. Can I just go the police and give them the recording? I have never been to the police station to file a report and how do I sue them? My parents aren't from here, so they don't really understand all the laws and how they work or how to sue.. I am from New York City. [link] [comments] |
