This is something we ask church members to do, so I didn't think anything of asking the staff to participate as well. Now, I am learning that the leadership above me are checking every month to see if we are meeting the 10% requirement, and, if we fail to do that enough times, we will be let go. My question isn't about the practice of giving 10% to the church, but about the legality of requiring it at the risk of losing my job. EDITS: This is in Virginia, USA. About 20 minutes later a Sergeant called me and said one could interpret this as extortion, but he wouldn't feel comfortable charging for it without a detective's involvement. He told me he would call and have a friendly social conversation with the store and let them know I filed a report and what could result from it. About an hour later a person at the police department calls me and tells me my wallet is at the station for pickup, after being turned in as "lost property." It's water under the bridge at this point. I'm just upset I wasted time and effort canceling my cards. Life goes on. My husband briefly worked for a tire shop after we moved to NC. He's related to the owners. During that time, he worked with AMEX and got the tire shop a business credit card. I just discovered that the business credit card is showing up on his credit report with outstanding charges of $65,000 (shop hasn't been paying it and it looks to be in collections). He owns no part of the business and only worked there for a few months (i.e. charges to the card occurred while he wasn't employed by the company). He doesn't understand how this happened, and tried to explain the situation to AMEX. They said since he signed the contract for the card, that he's responsible for the charges. Is this legal? Assuming my husband did misunderstand the situation and has signed something, how can he be personally responsible for a business card? Is this lawyer time? What type? My elementary school age kids played little league football for Team A last year. It was not a good experience. My younger son's coach turned out to be an unpredictable and unstable convicted felon who had no business coaching and should never have been allowed on the field since they are supposed to background check everyone. My younger son didn't want to play again this year after the negative experience he had last year. I dont blame him. My older son still wanted to play, however, so we signed up to play for Team B even though it's a bit longer drive for us. We are not the only family who left Team A for Team B. In fact, most of Team A's players chose not to return and they went from having 30 kids on a team last year to under 10 this year. Apparently the league president noticed this and decided to make an issue of it. First he required us to get the director of Team A to officially release all the kids to play for Team B. The director of Team A agreed to do so promptly and we thought the issue was settled. The league president has now (yesterday) denied the releases. He says all the kids who left Team A for Team B HAVE to go back to Team A or they cannot play at all this year. This is nowhere in the rules. He made it up on the fly. It also apparently does not apply to cheerleaders, since he approved all of those releases. I would go over this guy's head, but there isnt anyone above him (local league). I've been waiting for this day for MONTHS. Today is the mediation hearing for the small claims case of me and my landlord. Despite thinking I have everything I need to make my point, I want to make sure I have everything perfect before going in. Some highlights of this last year with my landlord...
So this is just the important stuff, I also have testimonies from previous tenants that he walked in on while they (20 Y.O. girl) were showering. I asked about him to previous tenants and every single one started by saying "DO NOT SIGN THE LEASE." He gives a fake address, never fixed anything I wanted fixed saying "it works fine," and charged people a $100 non refundable application fee which is also illegal in WI (must be refunded if you don't get to move in.) Is this enough for my case? I am going to small claims with the intent to get $5225 (rent from when I begged him to let me leave and he said "you're stuck here" basically. security deposit, and also the $500 "dog on premise" fee when I never had a dog here.) I am a little crazy about it, but it's my baby. To protect my car/myself, I bought a dashcam. This dashcam happens to also record audio. So I used the valet service at a restaurant I went to, and when I left the restaurant, my car smelled weird and all of my things were moved around, including a towel I had in my backseat from a cooler I was moving a few days before. So when I got home, I watched the dash cam footage and found some pretty disturbing things. You hear a loud zipper when the car gets parked, hear a lot of noise, sounds like a person shuffling things around. This is where it gets bad.....He starts making...moaning noises, deep breaths and what sounds like talking about his "cock." All the while he is taking pictures constantly, probably took about 20 pictures while in my car, which he sat in for 8 minutes. So unfortunately I have an idea of what he was doing, which I am praying is not true. He even gets a phone call from his friend, which he immediately replied, "I can't talk now I'm at work" which he obviously is not as he is sitting in my car. He then talks about stealing money from me at the end, saying "You're lucky I didn't steal this money from your punk ass." Yes I can hear that he was in your vehicle for ~8 min, he took pics and answered a call. The videos do not substantiate your claim that you think he was masturbating. There is a very popular clinic near my house where people go for cosmetic procedures like vein treatments, Botox, etc. I go there for laser tattoo removal. I went to my appointment yesterday and after signing out, I stepped back into the waiting room to make my way back to my car. There was Pool Nazi in the waiting room. She looked confused at first and then smiled. A nurse behind me called her name so I moved out of the doorway and that's when I noticed the man she was with was my old choir teacher. She walked past me and didn't say anything. That piece of shit walked past me, touched my shoulder, and said "Excuse me, dear." To anyone who witnessed the interaction, it looked like a perfectly pleasant/normal exchange. I literally threw up bile into my mouth. I immediately went out to my car to look him up on white pages. I was so upset that I forgot when my next appointment was and I couldn't find the card, so I called the clinic back today and asked. The receptionist said that my grandmother had called and said I needed to cancel my appointment. I'm 30 years old, both of my grandmothers are dead, and I wouldn't need someone else to cancel my appointment for me anyway. This place schedules people out months in advance. I had my appointment scheduled for 12 weeks away and because I lost that appointment, I now have to wait 14 weeks. Who else would have done something so petty it if it wasn't Pool Nazi? A lot of people on r/TIFU suggested suing Pool Nazi, but I didn't get to respond to anyone because the next time I checked Reddit, my post had been locked. I didn't want to sue her but now I'm so fucking pissed I can barely stand it. I was so polite to her and put up with her shit for so long and she's his mom? I feel violated. I'm pretty sure she knew who I was the entire time and that's why she was trying her hardest to get me kicked out of the gym. What can I do to her, legally? She's living in a hotel on a short term voucher that does not have much time left. She says it's in a bad neighborhood and didn't want the kids to be in that environment. I'm glad she had the sense to figure that out. She has left her two daughters (14 and 15) with us for a week. They were going to do a few things around the house (nothing more than basic chore kinda things) to earn some money for school clothes. We figured it would be a good thing to get them into some stability and they could learn the value of a dollar by earning the money for school clothes. So now she tells us that she wants to go to some hippy commune to recover and regroup and such. I'm all for people doing what's best for them... but when you have kids... they come first. She's pretty dead-set on this commune thing. She wants the kids to go and stay with their step grandparents. These step grandparents are great people... but they are in their 80's with health problems. They are ill equipped to deal with two teenage girls. So now comes the question. If we end up taking them in for an undetermined amount of time, what do we need to do? I've found temporary guardianship options with the county court, but that seems time consuming and expensive. I'm fairly certain the sister-in-law would sign over some sort of power of attorney kind of document... but I'm just not sure what kind of document and what it would need to include. I am really trying to stay away from spending thousands on an attorney. If needed we could afford it, but we are not wealthy, just comfortable. They need to get registered for school like yesterday. I went to our HR head and outlined what had been happening, had a meeting with her and another manager nearly a year ago. They said they would speak to the man who had been harassing me and make sure that it was "taken care of." For a while, it seemed like things were getting better, but as time went on, my harasser changed tactics and tried to make me so unhappy in my job that I would quit, by telling my coworkers that I was a drama queen, parking himself in front of my desk having long, joking conversations with people, making remarks loudly to other people that were poorly veiled jibes at me, etc. Again, I reported these issues to HR, but nothing was done. I have been a nervous wreck and dread every moment I have to be in that office. Recently, there was an issue with one of the company executives that was being investigated by a committee of higher ups from our parent company. In the course of questioning by one of the committee members, I revealed what had been going on with my situation, and she found that HR had made no record of my complaints or any actions they had taken. Because of the situation with the company executive, the committee has arranged a company-wide 8-hour mediation session, I have been told that I am expected to relate in detail the instances of harassment that happened to me in front of everyone, including my harasser. This seems crazy to me. Is mediation at all appropriate in this case? I thought it was for when people disagreed on something, not for a victim and her attacker? Part of the hangar is finished (living room, bedroom, kitchen, bathroom, etc.), it's about the size of a two-bedroom apartment inside. The HOA requires that all properties have a "primary residence" built before any secondary structures such as a hangar can be built. However, this hanagar was built by the previous owners before they built the house (which never got built). The current hangar is built as originally permitted; that is, with a finished living space. Moreover, I have never agreed to any timeline or otherwise committed to building a house. The one caveat is that I don't have to build a house if I am not living at the property full time. I'm definitely planning on building a house on the property, but would like to do it with cash so I'm saving until that point. In the meantime, I'm curious now that I have the HOA board starting to ask me questions about when I'm buidling: do they have the legal authority to force me to build a house? Posted: 30 Jul 2018 06:18 PM PDT This is easily the sixth time in the last year that I've answered an urgent knocking on my door to be greeted by 1-3 cops who are checking out 911 calls to my address. I live completely alone. It is absolutely my address they're being sent to, but I have no idea who's making the calls. At first I was totally bewildered, thinking maybe a neighbor had seen something sketchy outside (I live in a city so that's a possibility) but now I don't think it's a coincidence. Today was the final straw, I'm getting paranoid, and hate having to let police officers go through my house at random times making sure I'm the only person in the house. I told the officer today I've been having issues with this and he told me the person on the phone had called and said she was being raped, and that he had been by earlier in the day as well (!!) but I had been at work. There is an assisted living facility nearby and the officer told me the caller had called after that and changed her location to the facility, but then called back later with my address again. I mention the assisted living facility because the one time I actually called 911 myself was when I had a prowler in my yard at 3 AM who ended up being a disoriented older lady who had left the facility unattended and was inebriated. I don't think it's a malicious prank, I very much think someone living in the facility may be confused, or used to live here or something, but I really want these random checks to stop. Any advice? Swimming pool problems - Contractor did a bad job Posted: 31 Jul 2018 05:52 AM PDT Tennessee, USA. I need some advice concerning if the contractor who installed our in-ground liner pool is liable for the poor work we suspect they did. Our pool was installed in 2014. Took about 5 months for them to do it. It was a real struggle with these guys and I was glad when they finally finished. Overall, pretty poor job of customer support. Anyway, I went to open the pool this summer and found the water level to be 3 feet low. After quick inspection, I found the liner was separated at the bottom of the stairs. It appears that the contractor tried to cover up a poor job with caulk. Evidently, it has had a slow leak since installation. I've had two other pool installation companies come and tell me that there is no reason to use caulk. Additionally, there are some other areas that could turn into issues, but I'm not sure the proper terminology to describe them. I tried contacting original contractor and got the run around since March 14th. Never got to speak directly to the owner, only the front desk girl. I've been lied to many times regarding call backs, promised visits for review, etc. I never claimed to him that it was his fault, I just wanted clarification of what needs to be done to fix it....including getting an estimation for repair. Nothing. I've gotten nowhere with this guy and I am just angry about it. I understand the liner warranty is only for the seams of it. So, this is not a seam area. My understanding is that the area in question is a hand modified area to fit the stairs into. Therefore, my thinking is that they did a poor job (Cut too much) and tried to cover it up. I also found that the same year that another customer belonging to them had a very similar claim, and made it public to the BBB. However, they also just gave up and used another company. She is unreasonable and yells at us for ridiculous reasons (leaving coat on the coat rack, leaving shoes on our shoe mats, accidentally forgetting a spoon on the counter). She gives us zero notice to enter our rooms, told me I cannot go month by month and will have to leave if I don't sign another lease (without 60 days notice), and makes incredibly racist comments about my roommate. My most recent problem with her is that she will NOT allow us to touch the thermostat. Meaning if she's not home and I'm sweating balls in my room and can't fall asleep because it's 30 degrees, she will get upset if I turn the AC on. If I bring this problem up to her she says that I'm under boarding occupancy and not tenant law since it's her principle residence so I have no control over anything. (even though my rent is "utilities all included") Is she right?? Do I have zero rights over anything?? He is from Wisconsin but was recieving treatment in Minnesota. The hospital has discontinued all treatment and is searching for a nursing home or care facility back home in Wisconsin for him to finish out his last few months. However, because he lost his job once he was diagnosed with brain cancer he only has state insurance and no facility will take him. It has been over a month and I am hurt and angry that my family, including his daughter, are losing out on the remaining time we have left with him due to a 5 hour drive required to see him. Unnecessary medical testing/Misinformation from specialist what do I do? Posted: 31 Jul 2018 11:01 AM PDT I'm sorry about the wall of text and possible spelling errors. This is long. This is in Nevada. My one year old daughter had some testing done with her pediatrician that showed possible anemia. He put her on iron supplements and referred her to a hemotologist so we can have a conclusive answer on blood levels and why. I had an initial appt with the hemo last month and had in office blood work done and a follow up yesterday. Well yesterday after another in office blood draw he said her levels have dropped significantly and that he was sending us to the ER to get more blood testing and a possible blood transfusion. He was saying she could possibly have a bone disease and some form of parvo that is a symptom of it. We were completely devastated and by all accounts she is a perfectly healthy active one year old. She wasn't showing any symptoms or signs other than "being pale". Well we get to the ER they put in an IV that took two sticks and a lot of fishing around for a vein. It was traumatic for both my husband and I and our daughter who handles shots and pokes like a champ normally but was hysterical and screaming rightfully so when this happened. Well the tests come back and her levels are perfectly normal. Everyone is baffled as to how she got the previous results and why she was sent over to the ER. I try and reach the hemo to understand how the heck the tests have such a large discrepancy. Finally he calls me via the hospitals nurses station. And this is where I'm furious and confused and need advise. He tells me in such a blasé way that "Ohh yeah, sometimes our machine is a little glitchy and we don't always have the most accurate results in office that why we send out to the hospital to get the most accurate testing done." "So let's set up an appt in two weeks do another blood draw and see where we're at ok?" Ummmmm what?! This ER visit cost me $3000! How can a hemotologist office not have correct testing equipment? I feel like if the test had such a discrepancy why they didn't just test again in office? What the hell do I even do here?! When I get there and open the box, lo and behold, the original item has been removed and replaced by gallons of water. I am currently at customer service waiting to see what they will tell me, but they are waiting on a call from the store in the other town to check cameras. I got married back in September 2017 of last year, signed the contract with our wedding photographer, who owns the LLC in question, back in February 2017. We paid in full because she waived the credit card fee if we did. We had some pre-wedding shoots and deliverables that we had no issues with. Same with the day of the wedding, some drama but nothing we were not able to fix. Quick rundown on what is owed the day after the wedding (not including items and services already rendered): Note: Quotes are verbiage from contract
7 days after - Never recieved the photobooth prints. We emailed the photographer and she said she would take care of it. 2 1/2 months after - Receive our wedding photos a couple weeks late. Emails about the photobooth prints, no reply. We also asked about the teaser video as the purpose of it was the recieve it early. 3 month mark - Every week from now on!!! An email, voicemail, and text was left asking about the missing photobooth prints, and the teaser video. Zero replies 6 (end of) month mark - Video almost 2 months overdue. Very half ass email received telling us they had a data loss. Okay, but why not answer any of our communication? We still attempt phone, email, and text but no answer. See facebook post of her doing a photoshoot so we know she is alive. I do some PI google work and find a personal blog of one of her employees. So in desperation I call her employee and have a quick conversation. 5 minutes later my photographer calls me. Tells me I will get everything in 1 week. No apology or attempt to make things right. 7 month mark - Receive photobooth prints and blowups but no videos 7 months 1 week - Recieve video and it is NOTHING as advertised. About 1/6 of the video is looking into the trees. Completely no lighting editing was done, cannot see anything in a lot of scenes. The chosen songs are stolen from YouTube music videos (one of the songs has cars in the video version and you can hear honking). Plus many other obvious flaws that you can see, even not as a professional videographer. Holding my sour thoughts, I email her telling her that she still owes us the teaser video. She said one more week. While doing my google work I found a news article and case records that she did this to 15 other people some years ago and she was sued and lost. The judge just gave her 8 years probation. So after all that she started a new LLC and hides her name from it, that is mainly why we didnt catch this in our initial research into her. Now (Almost 11 months later) - Still have not received teaser video and she has made zero attempt at contacted us. We found out that the week that she promised us the teaser video she was on vacation out of country living it up on our dime. But a nice new review on her site said that she "worked through her vacation to get things done". Questions: I am at a loss here. The lack of communication was unprofessional and just plain disrespectful. The fact that it took me getting in contact with one of her employees to help me get HER JOB DONE absolutely unacceptable. The quality of the video was so bad so we asked her for the raw video (contract said 8 hours nonstop recording) just so we could get it retouched by a true professional and she referenced the contract and told me no. I no longer want the teaser video, it no longer serves its purpose and the actual video looks like it was made by some highschooler with a poor phone camera. Her videographer did not even capture our last dances which actually has a special moment for us. Do I have a valid case to take her to small claims court? Is there a way to get in contact with her probation officer? Should I ask for a refund and threaten legal action if we do not get one? Where do I go from here? State Not Protecting Victim's Rights (TN) Posted: 31 Jul 2018 07:15 AM PDT Good morning, My children and I are victims of a violent crime, perpetrated by their mother, who is pending trial for Aggravated Assault, Child Endangerment, Domestic Assault, and Harassment. In addition, the state is indicting on at least two counts of false reporting, which is a class E felony in Tennessee. Here's the issue - although I have an order of protection and she has bond conditions disallowing contact, harassment, threats, etc. both from her or from a third party, I have now reported no fewer than 33 (THIRTY THREE) instances of harassing, threatening calls, intrusion to our property, false reports to child services, the list continues. Throughout all of this, the State refuses to revoke her bond conditions. She even had our first trial date reset because she faked a mental hospitalization, then magically showed up the next day. The judge had of course dismissed the jury, but somehow still didn't revoke her bond for obstruction. Most recently, we had a new date set yesterday, and she was arrested on another warrant, which pushed it back out. Even though she was arrested, the state STILL DID NOT REVOKE her bond. What does a victim have to do in Tennessee to be taken seriously? I honestly feel that if I were the perpetrator, it'd be a completely different story - they'd put me under the jail - and it seems that it's because I'm a male victim. I have spoken with the Assistant DA, the Victim Witness Coordinator, emailed the judge's office, etc. I'm at my wits end. Could someone please give me some advice on what to do next, before the next time a family member of hers rolls into my driveway or she starts threatening our children again? Posted: 31 Jul 2018 01:13 PM PDT Short version: Our infant daughter somehow (possibly maliciously) had her leg broken in two places while being cared for by an uninsured, under-the-table babysitter. What options for legal recourse do we have? A few weeks ago when I picked up my 8 month old daughter from the babysitter's house she had a broken femur and a fractured tibia, though I did not find out she was injured until 24 hours later. We had worked with this babysitter for about 6 months without any serious concerns for our daughter's well-being. Since our daughter was constipated and we didn't know she was injured, I feel horrible that we caused her extra pain by moving her legs around to help her poop. That's when we started to figure out something was wrong. Once we got X-rays the doctors said our daughter had a severely broken femur at the top where the ball goes into the hip socket, as well as a fractured tibia. As if that was not horrible enough, they added that the injuries were consistent with injuries caused by child abuse and that they were classified as "non-accidental trauma." From what we have been able to gather the injuries are likely to have been caused by a yanking or twisting motion, or an impact such as a fall with all the force absorbed through a straightened leg. I called the babysitter to try to get more information about what had happened, and she would only reiterate the same story she gave before, that she saw our daughter sleeping in an odd position with her leg bent up behind her, and that she woke up crying a few minutes later. When we relayed that story to the doctors they all said that rolling over while sleeping was very unlikely to be the cause of the injuries. At that point we believed that not only did the babysitter either injure our daughter or allow her to be injured by someone else, but she also failed to make us aware of the injury when it happened and lied to us about the cause of injury. Because of that we had no idea how severely our daughter was hurt and did not get her treatment nearly as quickly as we would have if we had known. The evening we arrived at the emergency room we had individual interviews with a person from the department of human services as well as filed police reports. Our daughter was scheduled for surgery in the morning to have hardware put in to fix her femur and put her in a giant cast that covers both her legs down to the ankles and goes up to just below her armpits. We were in the hospital for a total of 4 days. On day 3 we had to go give additional longer interviews to a police detective and a social worker. We both agreed to schedule polygraph tests with the police detective and allowed him to download our phones so he has the text messages with the babysitter as evidence. The social worker also came to our house for a home visit. As the home visit was concluding she said we don't have anything to worry about as parents and her part of the investigation into us as parents would be coming to a close. About a week after we got home from the hospital my wife saw new posts online from the babysitter looking for more kids to be employed taking care of. We forwarded the posts to the detective but did not receive a response about that. He did send an update later on to let us know he is still working to schedule the polygraph tests with us and that the babysitter has refused to speak with him and requested to have an attorney. That was about two weeks ago. As far as we know the babysitter is not licensed or insured. She works or has worked under the table with 4 or 5 other families besides ours. However we believe that the babysitter's own daughter was the only other child present the day the injuries happened. We didn't have any formal contract with the babysitter, just a verbal agreement and some text messages discussing rates and payments. We have not received a final total of the medical bills yet, but I expect it to be at least several thousand dollars. On top of that, my wife and I have both had to take several days of unpaid leave in order to care for our daughter while she is recovering. The weeks we have been able to work we have each only been able to work and be paid for about 30 hours, instead of our usual 40. Questions: Our first question is, what can we do to keep the police investigation moving? We don't want anything like this to happen to any other kids, and we would like to know exactly what happened if it's possible to find out. It has been almost two weeks now since our last contact with the detective. Second, what hope do we have of receiving at least some money to cover our medical expenses and lost wages? The babysitter was not insured as a childcare provider as far as we know, and she and her husband were renting their house so we don't think homeowner's insurance would be on the table. They had also asked for advance payment the week before this happened, so we don't think they have much in the bank. Third, do you have any advice for finding and hiring a lawyer? We don't have much of a budget to pay a lawyer with, but I got the idea that some lawyers will work in exchange for a percentage of whatever settlement is reached. Is that correct? Is a personal injury lawyer the type of lawyer we should be looking for, or some other specialty of lawyer? As mentioned in the post title we are in Colorado. What constitutes fraud in a legal sense? I’m trying to gather info to help a friend. Posted: 31 Jul 2018 07:29 AM PDT A friend of mine had his mother pass away earlier this year. In the immediate aftermath, somebody set up a GoFundMe campaign to raise money for the family's funeral expenses. From what I understand, the person who set up the campaign somewhat knew the mother. Now, nearly 6 months later, the family still has not received any of the funds that were raised. My friend contacted GoFundMe, and the website confirmed that a check was sent after the campaign wrapped up. Since the page was set up by this person who knew the mom, the money was sent to them. That person has not forwarded any of it to the family. They have also changed the settings for the campaign page so that it is no longer public and can only be viewed by them. My friend is trying to work with GoFundMe to get some sort of resolution to this whole ordeal. Should that not prove successful, does his family have any reasonable legal recourse? Since this person got people to donate money under the pretense of it going to a funeral expense fund but then kept all the money, would that constitute fraud? He and his family live in Illinois, but I'm not certain where the other person is from. They'd either be also from Illinois or possibly Iowa. If anyone can provide some info from a legal standpoint, I'd be super appreciative. Posted: 30 Jul 2018 05:20 PM PDT Location: North Carolina Today my leasing agency sent me a "warning citation" from the HOA of the community where I rent a condo... for letting my dog pee on the grass. Apparently I'm supposed to walk my dog off property for it to pee. My lease does NOT mention an HOA and certainly never mentioned or gave me any rules. In their email today they attached the (absolutely ridiculous) HOA rules and said they didn't have them before today. But they also said that we would be held responsible for any further infractions and fees to the HOA. My lease never indicated that there was an HOA or any HOA rules. I literally never got a copy of these bullshit rules until today. I'm obviously furious, because half the reason I chose to rent this condo was that there was plenty of space to let my dog out. They knew this when I signed the lease. What happens from here? If they try to get money from me and I don't pay it, do they have the right to put it on my credit score? I really don't want to move. I'm in a college town and school starts in two weeks. Some of the rules include: - Don't run your dishwasher when you're not home. - No more than two plants on your front deck. - Dogs must be walked off property to pee.
