However, I don't have any legal training, and since many thousands of dollars are on the line, I figured taking 10 minutes to post this on Reddit couldn't hurt. On May 1, my wife and I purchased and moved into a new home. A few weeks in, our cat killed a bat in the middle of the night. Less than a week later, she caught and killed a second one. In the dining room, there is a weird sag in the ceiling, and the ceiling tile is cracked in a few places. A few nights after we found the second bat, we heard chittering noises coming from the area around the cracks in the ceiling. We researched bats online and found that, if left unchecked, bat droppings will accumulate over time and eventually cause structural damage of the sort that we're seeing. A bat removal expert told us that A) we have a bat colony, and B) there's no way the previous occupants could have possibly not known about it. The house's owners were renting it out before they sold it to us, so they probably decided to sell the house rather than dealing with the bat problem. When we did our home inspection and asked the inspector about the sag in the ceiling, he didn't seem worried about it and said that it could be a variety of things but probably nothing serious. It's a very frustrating situation. We're looking at probably over 20 grand to do the whole process of bat removal and ceiling replacement. Our home insurance doesn't cover it, our home warranty doesn't cover it, and I can't think of any way to put the home inspector or (more critically) the seller on the hook. A few days ago I had an AC guy out to do a quote on installing an AC unit. He was exploring my attic and found a room that I didn't know existed. In the room was a massive porn stash. Just boxes and boxes of late 90s porn magazines, thousands of pages erotica, a lot of printed out cartoon porn, and file folders with printed out porn and ripped out pages from porn magazines in them. In one of those folders I found some legit child porn. I want to report this to the police but was wondering if I could get in any trouble for it. Is this criminal or civil? Where do I start to get this money back? It's spread across several loans, all handled online, using usernames and passwords they stole from me. Also, how enforceable are oral contracts in RI? I also found out that my parents are no longer paying for my college after they told me they'd pay all the way through grad school (multiple witnesses including a social worker have heard them promise this and state it was unconditional). If it weren't for the fraud I would just accept that I'm responsible for myself at this point and cut them out, but honestly after the fraud (and a case of animal abuse- separate issue) I really want to take them for everything they've got. This brings a lot of unwanted guests to my building. I have at least a dozen bike handle bar scratches on my car from kids, there noisy, and honestly annoying. I'm a college student working in California for the summer that needed a place to stay. After looking around a bit I found a place to sub-lease, emailed them, and started the ball rolling on the whole paperwork train. After signing the contract I started the journey to CA since it would take me several days. The housing contract would start the day I arrived with the keys being mailed to the last hotel I would stay at before arriving. The landlord emailed me the information for their bank, I sent a wire transfer so it would arrive quickly, all was well. Then things went a little bit sideways. My landlord asked for a confirmation that the money had arrived on. Thinking they wanted a receipt from my end I sent them that. Turns out they wanted a receipt of it arriving in their account. Now, because they only reply to their emails once a day, this has taken two days for this correspondence to happen. It is now Friday, the day before I am supposed to move in and I have no way of getting keys in time to move in. I ask if I can simply pick up the keys at the apartment when I arrive, knowing they won't make it in time through the mail, and make the final leg to the last hotel. Then things go more sideways when they don't respond to my emails. I'm going a bit nuts at this point. I'm searching for contact info through the person I'm sub-leasing it from, trying people searches and Facebook to get contact information, calling the real estate council their email is through. Nothing. I know I'm not getting into the apartment so I break down and get a hotel room so I don't have to sleep in my car. I email them that I'm stuck in a hotel since they haven't sent me the keys. Next day, more emails, more searching. Nothing. I finish the drive to the city I'm working in. It is the day after my lease starts and all I can do is look at the outside of the building, which I do while searching for an entrance to a non-existent office my landlord might be in. Another hotel, another night of losing money. This morning. My first day of work. The second day of my lease I don't have keys for. I finally get a reply. "We haven't confirmed your payment." At this point, I'm going to have to either live out of hotels until they get their stuff figured out or find a new place to lease. So, the questions part of this post: -Who can I be mad at for me not having the keys? Me for going through this process so late or the landlord for not sending them? -Can I get reimbursed by my landlord for the two hotels (and maybe a few more) that I've had to pay for because I wasn't provided keys? -Am I being scammed and a giant moron for falling for it? [TX] 24-hour notice to vacate for late rent? Posted: 04 Jun 2018 09:36 AM PDT Hi LA, I'm a Texan in need of some advice on the legality of a notice we received. I have gotten some conflicting information from Google. Rent is due on the 1st, with a grace period til the 3rd to avoid a late fee. We would have been able to pay today, but not with the $104 late fee posted this morning and they won't accept rent without it. I get it. But I just got a notice to vacate, dated today, stating that they are terminating our lease (up in Sept), and that if we aren't out by midnight they're calling the cops to remove us. It says, "notice to vacate is unconditional, but we can discuss possible reinstatement of your right to continue living in the dwelling." Can you really just throw someone out like that, in less than a day of giving notice? We planned to pay tomorrow when I'm paid. We are short like $60, it's so frustrating. This is our first late payment. This place has done some questionable stuff and has terrible turnover (read: office staff is a bit clueless), so I'm a bit jumpy that even if it is illegal, they might still try something. Posted: 04 Jun 2018 06:35 AM PDT For a bit of background: I received a Baltimore City Circuit Court summons and was selected for a trial, which I am currently serving on the jury for. In the midst of that, I received a federal grand jury summons for July (if only my luck swung the other way I'd've won the lottery by now). I dropped the summons off in my boss' inbox over the weekend (because I'm still working whatever shifts don't fall on court days) and I got an email this morning firstly disbelieving the situation, then asking if I requested an exemption. She wants me to meet with her this week and bring my paperwork so we can find an exemption. The thing is, I already checked and I didn't see any exemptions I qualify for. Besides, I don't want to claim an exemption. I don't mind serving and the federal service is only for one day a week anyway. I have a few questions about all of this:

In Ohio your employer does not have to compensate your time away, and it is an acceptable excuse on the summons form that I can have my employer submit a letter stating that they will not compensate me and I can be excused under the basis of undue financial hardship (which it will be). However - my employer will not give me a letter. My official statement from them was: " [COMPANY] encourages its employees to fulfill their civic responsibilities to serve jury duty or be in attendance as a witness when required in a court action. It is not our standard practice to participate in any interference of our employees performing their civic duty. " While I understand that this is an important civic duty - I cannot afford to go potentially two weeks without a paycheck. And it seems like my county is understanding of that, but with employer verification. Any advice? Or do I just have to figure out my finances on my own? [link] [comments] |
There may be another person living secretly in my house? Posted: 04 Jun 2018 12:44 AM PDT So I don't know how to preface this so let's jump into it. I moved back into my parents house. Every time I head to bed (around 11) I always hear my house making creaking noises. We have walls but nothing too thick so it sounds like it's the house breathing/settling but I just noticed it always happens after lights go out. I want to rule this out as the outside temperature changing from hot to cool making my house settle/creak. But this is what gets me the most. Sometimes i'll have trouble sleeping maybe up until 2. At that time the house is dead silent and you can hear your own breathing. But I noticed I'm hearing somebody else's breathing. It's irregular to mine and sounds very high pitched. I want to rule this out as my parents breathing, they sleep with the door open, but we are separated by a bathroom and like a 10ft hallway. So hearing them sounds plausible but not impossible. What doesn't make sense is is that I would be hearing my mom and dad's breathing. Our house has a crawlspace to get to our pipes. We have no attic and the only way you can access under the roof is through a vent inside the house. For the past few months my dad has given away around $4,000 & an older car (worth probably about $4-6k) to a 20-something guy. This has all been hidden from mother and she is just now finding out. The guy receiving the money is, as far as I know, a former drug addict who my dad met through a rehab program at his church. I understand him wanting to help this guy get back on his feet, but my parents are not and all in the place to be giving away money. My dad has been notified that he will soon loose his factory job and they do not have enough in savings to last too long. All of this had been hidden from my mother as he knows she would not approve. Their relationship has not been in a good place for a long time and it feels to me like divorce is imminent. When she confronted my dad about this today he said something like this is all his money to begin with so he will do what he wants with it. What avenues does my mother have to protect the little money they have left? This is in Upstate NY. So to start, I have a lot of medical problems. I'm not a hypochondriac my body is just falling apart around me. The week before last on Wednesday a problem I had been trying to deal with came up, I left work after a couple of hours to go to the ER. They drugged me up and sent me home for that day and the next. Last Tuesday I come in and the same thing happens. Go to the ER, they drug me up and so some more testing, prescribe some meds, and sign me out that day and the next. The meds worked for maybe two days but now I'm in excruciating pain again. This morning, one of the owners of the company kept mentioning how we need to cut back on "avoidable absences" all while staring at me. This was in the morning meeting in front of everyone, I'm the only one who has been out lately, so it was embarrassing. That and I found out today they asked an old employee that used to have my job if he would come out. They've been printing out information on disability and medical leave and having a ton of closed door meetings. My question is, is it legal for them to fire me for being in the emergency room and having proof of it? I also had asked for disability accommodations almost two months ago now and they haven't done anything. It's a small company, 15 employees including the owners. Where do I go from here? Posted: 04 Jun 2018 10:38 AM PDT I called CPS on my mom Saturday night because she was beating my 9 year old brother and possibly ruptured a hernia he'd previously had surgery for. The woman working our case met with my six younger siblings (I'm 22) yesterday afternoon and said she'd come back to speak with my parents. My 19 year old sister was going to take him to the ER yesterday but my parents freaked out, terrified my siblings, and kicked my 19 year old sister & 15 year old brother out of the house. My 12 year old sister called the cops who showed up and my parents (who were both drunk) said everything was just a misunderstanding so the cops left. Meanwhile this morning my mom finds out about CPS, takes my siblings phones, unplugs the landline, and essentially holds them hostage in her room. I had the cops do a wellness check and the officer said he met with her as she was leaving the house with them. She again said everything was fine, but now I can't get in touch with her or my dad because they're not at home. They've both snapped and I'm worried about the safety of my siblings, especially since my dad has guns and my brother is still hurt. There's an officer now working the case, but is evading CPS a crime? And is this some type of kidnapping? My Childhood Home is Abandoned Posted: 04 Jun 2018 04:09 AM PDT I'll keep it as short and simple as possible: I was riding around my old neighborhood (South Carolina, USA) and saw my childhood home abandoned, notices in doors/windows and all, so I pulled in and looked. The property has no real estate signs and is not listed as foreclosed anywhere - the signs on the doors/windows say that the property has been found abandoned. (It's from a company, not sure if I'm allowed to post their name even if I could remember it.) I looked through public tax records and found that a man bought the house in 2007 and the bank is listed as buying it back in 2017 for about $20k less than the man purchased it in '07. I guess it was repossessed? I'm not sure how to read the records exactly... THEN: Secretary of Housing & Development is listed as buying the property for $10 after the bank does in 2017 (ten days later), but then the bank turns around and buys the property again for $1 nine months later. The property has outstanding taxes and is listed under ownership of the bank. My guess is that it will go to auction, but: Is there any way for me to look into getting this home before auction? Could I contact the city and offer to pay the taxes in exchange for the deed? What legal options do I have for taking ownership of an abandoned house? Posted: 04 Jun 2018 08:46 AM PDT We bought an older house, but only after the sellers agreed to take care of a number of things, including: grounding the house, replacing the fuse panel with a new circuit breaker, and grounding all outlets. They agreed and signed the repair amendment. All of the work was "completed" by two days prior to closing. We had a final walkthrough the next day, one day before closing, to make sure everything was finished. Everything appeared to be completed, a new panel was installed, all of the 2 prong outlets had been replaced with 3 prong outlets. Well, now we've signed for this house, and I'm plugging my surge protectors in only to find that there is no ground! I bought an outlet tester from the shop to confirm. Obviously, I should have tested this before closing on the house. But what can be done at this point? I'm told that the seller is not obligated to make any further repairs now that we've closed, but the work was not completed and the work that was completed was not up to code: they updated the 2 prong outlets to 3 prong outlets, but they neither grounded or labeled the outlets as non-grounded, leading us to believe that the outlets were grounded as requested, which is a major safety threat that, had I not eventually tested them, may have endangered my family. So there's this guy at school who is widely known as a bit of a dick. Like, spoiled Star Wars for everyone, makes racist jokes, draws swastikas everywhere, huge homophobe- that type of guy. I've always just kind of ignored him, but as of late, his dick-ish behavior has suddenly gotten really, really bad. He's started harassing me. (Only me- he doesn't do this to anyone else I know of, at least not as badly.) Here are just some of the things he's done in the past few months:
I initially ignored this, but it's only been getting worse and worse. He's in practically all of my classes, and it sucks walking into school every day and being followed, catcalled, or harassed. I hate playing gym because he's a total creep and if he's not saying something obnoxious about my gym clothes, he's saying something obnoxious about sex (or looking for an excuse to touch me.) I'm tired of being told to smile by him, getting called slurs, and having rumors spread about me because he tells all his friends about nonexistent sexual exploits. I've told some people at the school about this before, but he's a well-known athletic star and his father is a coach IIRC, so nothing has ever gotten done about it. (Other girls have said he's a creep as well, and again, nothing has been done.) Now that it's June and we'll be out of school in a week, I feel like it's too late to bother with that. However, I'm starting to get worried about next year. What should I do if he keeps this up? He received papers in the mail on Friday with only two options: start the rollover process into another account, or withdraw all the money. He wants to leave it where it is and only withdraw a small amount to cover bills while he finds a new job, is there anything we can do? Posted: 03 Jun 2018 11:43 PM PDT During the week of 5-28-18 I was asked by a fellow employee that my supervisor wished to see me. My supervisor initially asked me to close the door and to have a seat. I was asked if there was anything I wanted to confess to my supervisor. My initial reaction was to deny there were any current problems with anything at the moment or at least none I could think of. What followed can only be described as an intentional awkward silence in which he looked at me and raised his eyebrows. I didn't respond and could only shake my head at what could possibly be the issue. It was then that my boss mentioned a meeting I had with Human Resources a day or two earlier. Apparently the head of HR had an issue with my movements described by him: "You're acting kind of twitchy." He then accused me directly of "being on meth" and pressing me to say whether I was on some sort of substance that would have caused these actions. He said that I did "good work" but this would be an issue if I was on drugs. He specifically said not to "make him look stupid" and to tell him right then what drug I was on. I denied any use of substances and told him I had a medical condition that would explain this behavior. He said "for my own protection I should give them a copy of my records." Luckily I keep a copy of this diagnosis on hand specifically for college tests in order to get an academic exemption for my handwriting. I went home on lunch and gave a copy to him and he said he would send a copy to HR. I took the next day off of work partly because of how humiliated I feel. I don't know how to move forward and I feel like giving him that much was a mistake. I know my supervisor is personal friends with my coworkers and feel it is a matter of time until he tells someone. I know I messed up already by willingly giving him a copy of my records but I didn't know what else to do. I had hoped my condition wouldn't be an issue but now it seems like my supervisor and fellow employees have felt me to be a user of drugs even to the point of the HR Administrator having a conversation with my supervisor. I can't describe how embarassing of a situation this is I felt pressured to the point of turning over my medical records to my employer. These records have what I felt to be embarassing information that my 16 year old self thought would just be shared with my doctor. I feel like going to work and closing my door and hoping that I never hear about this or my condition again. I'm afraid that's not going to happen. What can I do to ensure that my condition or records don't become watercooler conversation despite my symptoms being noticeable? I'm especially concerned now that apparently two employees (my supervisor and HR administrator) have had a converstation about my symptoms. I'd hope that there's some way to say now that I have provided these records that this no longer be a topic of conversation but I don't know where my rights start and their rights end sort of thing. It's long too I'm sorry. We've been dealing with our duplex neighbors for over a year. Ever since our youngest could start walking they've been banging on our walls every time they go down the hallway. Sometimes a few times a day and it's angry loud long banging. One of them is terminally ill and home constantly. Property manager kept putting notes telling them to stop and they finally did, but now they're escalating things. A week before last Halloween we were outside hanging up Halloween decorations with 8 of us since my parents and siblings were over. An hour after we were done the police showed up saying someone called and said our 6(he was 3) year old was outside alone. That's absolutely 100% never happened I have to fight hard to not be a helicopter parent. It was terrifying even though the police were very kind and seemed to believe us. I told them about our neighbors hating us and they wrote that down. I started logging all the banging on our walls after this in case I needed it. Citing the date, time and what my boys are doing when they banged. In January we got an official noise complaint on our door. I called the property manager to tell them I'm doing everything I can and let them know what's been going on with our neighbors. The day after that cps came to our door. When they came I was already in bed crying because my dad was having a quadruple bypass right at that moment. The house was a mess because my dad almost died and I was taking a break. It wasn't dangerous, just messy. My cousins and aunt were also over for support and staying the night so their stuff was everywhere. The allegations were that I yell and hit my children. They're always dirty and never wearing shoes. My oldest is autistic and I don't bring him to the doctors. Cps said that everything looked good, but the house was way too messy and it smelled bad because my cat had just peed on a pillow that was sitting on the washing machine still. Oh and our dryer was broken so there was laundry everywhere. My grandma and aunt came and helped me clean the house completely and bought us a new dryer and cps came by and officially closed the case and said the house looked great. She also told me it was my neighbors that called. After this I brought my harassment log to our leasing office to show proof of the harassment. They told the neighbors to stop banging on our walls, but they still did st this point. At least 4ish times a week. I also called the police to see if there was anything we could do and she said to just keep logging everything. We've gotten a few more noise complaints on our door and I've kept in contact with the leasing office and they're not upset with us, but legally have to put the notes on our door. The neighbors have also stopped banging. A couple days ago while I was out picking up my husband from work two police officers came over. My sister was over and answered the door and they said our neighbors are filing an official complaint that we've been on their property and they want to take us to court. I grabbed my husband and we went to the police station. Our neighbors are saying we tried to fight a man that was laying cables on their roof and that we were yelling at him. They are also saying that we go on their patio and bang on their kitchen window yelling "smile you're on camera" since they have those signs everywhere. I've literally never talked to them or gone near their house. The police 100% seemed to believe us. They were really reassuring and said we didn't need to be scared and that we're not in trouble and cps isn't going to come and just take our kids. They said they would talk to our neighbors. I'm terrified. These lies are scary. My husband is working 70 hour weeks so we can move out and I'm babysitting like crazy, but we're not there yet. I don't know what to do. I'm always panicking that cps is going to come again on a bad day and that the kids will get taken away. What if we get evicted. What if they attack us. She's ex military and strong. Almost daily when I get home I'm panicking thinking cps or the police will be here. Realistically I know it won't happen, but I already have anxiety and have a hard time feeling safe in my own home because of something in my past. My property manager said they'll move us so that's an option. I have an appointment with them on Tuesday. The police said to just keep logging everything. Is that ok?
