My aunt filed a complaint with local police and they filed a warrant for his arrest. We learned that there has been a case being built against him for similar crimes. The cops even referred to him as, "dirtbag." We also found out that between my original post and this, two more checks cleared, bringing the grand total to slightly less than $16000. Posted: 05 Jun 2018 08:44 AM PDT My girlfriend works at a subway in Missouri, in this small town we have two subways that are both owned by the same person, but she has one of them under a different LLC, so employees are required to fill out 2 W-2s when they get hired. Whenever an employee starts to reach 40 hours she sends them to the other store to work to avoid paying any overtime. My SO is working her butt off for this lady but is getting screwed on overtime. This seems like a really dirty loophole. Is there anything we can do about it? Any place to report her to? Or has she found a perfectly legal loophole that screws over her employees? Thank you for any answers that can help. Update: First update, I called the Department of labor and the lady refused to let me file a complaint. She said that if the owner has two different tax IDs, one for each business, OR if the company makes less than $500k a year then she's within her legal right to pay separately like she does. Not long after the original post I ended up sending an email to my landlord with a copy of the letter from the HOA and explained my situation. The next day I received a phone call from my landlord and she said not to worry about it. According to her despite my lease stating that the "Tenant agrees to abide by any applicable owners association regulations as they now exist or may be amended." this was a rather unreasonable demand by the HOA and isn't something that should be held against me or any other tenants she has in the neighborhood. She said she would take care of the situation with the HOA and offered to pay any fines that resulted in the meantime. As of today I have received another letter from the HOA that said until further notice they will not be enforcing the rule regarding parking of vehicles older than 10 years old. I haven't received any violations from the HOA up to this point and have yet to hear anything else from my landlord. I'll update again when I know more and the situation has been resolved. I need all of my employees full time from January-May so she wasn't even considered. My office isn't huge, we're only a few people so I can't afford to hire someone then have them on leave for months not doing anything. This is kinda out of the blue too since she dropped the resume off at the end of November and I simply told her I'd put it with the others and never called her back. I didn't ask about the pregnancy or due date. She just wouldn't stop talking from the moment we met to when she left and I barely got a word in edgewise beyond telling her we'd call if we wanted to interview her further. I don't even know when she had the kid or anything like that, but she contacted me by email saying she was discriminated against and she'd be coming after me. What she's coming after me for I'm not sure, her email was very vague but it seems she wants financial compensation for something. Should I just ignore her or is this actually an issue? Just to be clear I do not get paid commission I am hourly my boss told me he likes to keep labor down but requires employees to be at work at a certain time. One day I was cheated out of 45 minutes that I theoretically should have been clocked in. Is this legal? He also said during the winter time when work is slow you need to be flexible. He explained to me he means that during the winter time somebody could come in at 10 o'clock and not have any work to do until noon but they wouldn't be paid for those two hours. I live in Michigan. He is in a lot of debt from pay-day loan companies, both physical ones in our town and online loan services. I have pulled him out of tens of thousands of dollars of debt numerous times, and every single time, he refused to seek help for his addiction and racked the debt right back up again. About a year ago, I told him that I would be willing to help him find and pay for help for his addiction, but that I would no longer be able to help him financially. He continues to gamble and take out loans. My sister has been helping him out with money from time to time. Legal advice issue: A couple of months ago, my dad told me that the he was severely behind on payments for a storage unit that he rented. He owed close to $800, or they were going to auction off his unit. I told him that I wouldn't be able to help him. They eventually sold/auctioned off his unit because he did not pay his overdue bill. I got a call from my sister, "C" yesterday. Apparently, C had been storing some stuff in the unit, as well. My dad didn't tell C anything about losing the storage unit, and she only found out about it when she went to get some of her stuff out of it last week. C was extremely upset with me. She told me that she was making an itemized list of all the stuff she had in the storage unit in order to prepare for a lawsuit against me because she lost her property when I refused to pay my father's bill. That's not something you can file and win a lawsuit over, right? I'm 99.9% sure this isn't going to turn into anything, but is there anything I should do to be prepared in case it does? TL;DR: I refused to help father with his overdue storage unit bill. The rental was in his name. The storage unit was sold/auctioned off. The city grandfathered in these homes and set zoning to Single Family Residential for any future homes bought and sold. A house around the corner was bought and sold under the buyer's personal name and signed the title agreement as it was going to be used as a single family residence (with no disclosure of actual plans during the buying and selling process. I believe she paid cash with assistance from donated funds). She has now applied for a special land use permit for a heroin/opioid recovery home for this property. There is obviously some debate/heated opinions between supporters of the home and those in the neighborhood. I was curious about how/if the Fair Housing Act applies in this situation as the house was bought in her personal name (rather than her non-profit's) for cash as a single family residence. Edit: she has held "galas" and events in order to raise cash and donations for this home. These are for heroin and opioid addicts who are in a "3-5 day non-medical (subacute or social) detox program" prior to being placed in this residential treatment/recovery center according to her application with the city. Typically, they define anything with a detachable magazine as such, which still casts a huge net. Moreover, the city requires a certificate is required to show "proof of possession", basically they're sugarcoating a firearms registry. Like I mentioned in the title, my state has a preemption law, meaning cities and other municipalities cannot place further restrictions on gun rights, than what's in place at the state level. Part of the leasing agreement regarding pets states that pets cannot be left unattended outside (including balconies) and owners cannot allow their pets to use balconies for bathroom needs. My downstairs neighbor locks his dogs outside regularly and let's piles of poop accumulate before he cleans up after them. I've spoken to office staff in my building 3 times now as well as my neighbor and there's been no improvement. As it's considered a luxury apartment, it's not a cheap place to live and I feel helpless. I cannot sit on my balcony without smelling dog feces and at it's worst, the smell has permeated the inside of my apartment. I plan on speaking to office staff again today. Is there anything I can say or do that would push them to resolve the issue. Or do I just need to keep making complaints until they do something? Do I have a right to request compensation (i.e. temporary price reduction in rent or anything like that)? Is my landlord in breach of contract for not resolving the issue after multiple complaints? I'm being told that my contract says I have to use the same contractor, even though the person I signed the contract with is the big company, not the subcontractor that actually did the job. My contract says I will allow the company to hire the contractor, but it doesn't have the name of the contractor listed. It just says "an installer." Not THIS installer. Neighbors dog killed my dog in my yard, what can I legally do? Posted: 05 Jun 2018 10:07 AM PDT My neighbor has always had pit bulls and all of them have been extremely violent. They are terrible pet owners and terrible people in general. Yesterday their youngest one (around 1) got loose and attacked my dog in my yard, it charged straight from their house in my yard and just thrashed it to death. Thank God my grandma got my 2 kids in the house after the pit knocked her over but my mom tried to get him and seen it all. I personally had to separate that dog while it was attacking my dog once, held it to the ground and eventually I pried my hands in its mouth enough to free my dog (that incident was my fault, our dog slipped by us at the door and he went in their yard). The first time it attacked my dog happened while I was waiting for my kids in the driveway to get off the bus. I was walking my dog on a leash, their dog was on their porch with no leash or chain on and came straight over in my yard. I got between them and just picked the pit up by the throat and handed it back to the owner. No one was hurt so I didn't call the cops about the attack, hind site makes me wish I did now so there was more on record about that dog. The police was called, animal control has taken the dog because of protocol, and reports have been filed. But I want to make sure that dog is put down and from what the animal control officer has told me there isn't a whole lot that I can do to make sure that violent dog is euthanized. In 10 days it will be released from quarantine but the officer did mention that if the owner releases the dog to the county they will euthanize it, no guarantees that is going to happen. I talked to one of the people who live there and told them about animal control telling me that and asked them to make sure that happens. The owner told them if it was released it wouldn't be brought back here, for the life of me I don't know what i'd do if I seen it back next door. I was instructed by the officer to take the police report and the animal control report to the magistrate and go from there, but what else could I effectively do? I'm guessing the magistrate will advise me on the next moves, but should I go ahead and speak to a lawyer? These people would never be able to pay any kind of restitution (honestly i'm not after money from them that wont replace our dog) because none of them work. But I just can't stand idly by and take this without fighting for his memory and the immeasurable pain its caused my family. Specifically my wife and daughter have been emotionally damaged the most. I'm torn up really bad but they're just devastated beyond comfort at this point, my son is 6 and is grasping hes gone but also dealing with the realization and consequences of death. When carrier arrives Europe and goes to Poland for repairs, a survey report including some pictures was done to car, showing sooted outside, and slightly inside, but car was driven to another deck. No marine insurance has been selected. RORO company now claims that they can scrap whatever they want, and pay me scrap money, or I can decide to pick up the car in Poland? Is this correct? How can I file a claim here? The minimum what I want is for the car to get transported to its final destination, Norway. I would also of course prefer to not pay the shipping fees, and/or to have the car fully cleaned, or other economic benefits. How to proceed? Dont they have any responsibility at all here? Both are slight variations on Jamaican backbeat (one drop) but I played it myself, on my own drum set. And this beat has been in about 1.5 billion songs. I know that if I play the melody of "Hey Jude" on the keyboard yeah, I'm violating the copyright on that song. But can someone really copyright a beat? That I play on the drums? She has sent me baby books with pages ripped out of them in the mail, letters shes not responsible for any and all debts and that I woefully want no contact from her, and most recently has been calling my phone number after getting it from my actual grandparents who were ignorant to what was going on, and leaving messages speaking in tongues and screaming. While I have tried for these many years to report the issues she was causing, since it was cyber and mail rather than voicemails, Police in my area told me I could not file a report. Most recently, as I have had her blocked on my LinkedIn, my biological mother made a different linkedin, and looked at my page. 12 hours later she came to my place of work, which is a blood donation center, and brought a business card to be delivered to me. I am not actually sure if it was my biological mother, or someone claiming to be her, as she would have driven 2 hours out of her way just to find me. I do believe it was her, as it made sense for her work schedule. This coworker, within the presence of another and the manager of the time, confirmed that I work there and my position, and that she will get the business card with her email to me in my mailbox. Now I am extremely nervous to go to work. While I'm in new places every day due to my job, she can look up a schedule and guess which location I'm at or travel to all of them to find me. Additionally, I couldn't report this as I cannot confirm it was my mother, so the police in the area saw it as just suspicious activity. To my knowledge, I'm not so sure my workplace can confirm my employment to someone that just walks in. Lately my coursework has increased, and I need to stay up later to complete it, but because I'm forced to take it when they go to bed, I end up passing out at my desk before I can finish my work. They refuse to allow me to take it later because that would require them to stay up later to give it to me because they won't let me access it on my own. She traded her car in for just enough for them to pay it off with her down payment, and she bought a pre-owned car with loan terms we had to fight to get. Payment was due about two months later, so she called the bank after a couple weeks to ask about when her loan book should arrive and to schedule a payment. The bank said that there was no loan in her name through that bank, so she called the car lot and they said they needed to verify her address to complete the loan. A simple piece of mail later and we thought we were all good. Called the bank back a couple weeks later, closer to the payment date, still no loan! Called and left voice mail with the finance guy from the lot, he eventually calls and says it will be taken care of. Even after the due date, still no loan, and the bank then said it's been too long, loan terms are no longer valid and there would have to be a new loan initiated. We bought a house shortly after the car so our credit profile is different now, so that means loan terms are potentially different... Car lot runs her and her mom's (co-signer) credit again without permission, so my girlfriend calls and tries to get ahold of the finance guy yet again. He eventually calls back swearing at her and being very rude and irate, blaming my girlfriend for all of this, threatens to repo the car. I called and talked to the sales guy that sold us the car, he apologizes after I explained what happened with the finance guy, tells me he will talk to the manager. The car lots manager calls today and apologizes to my girlfriend, says he has a loan ready with all of the original terms, and says he talked to the finance guy and told him he won't move up in the company if he can't handle stressful situations.. (?!?) Doesn't seem like telling a guy he won't get promoted if he keeps cursing at customers is an appropriate response. How should we proceed? We are pissed they ran their credit twice several months apart, once without permission, pissed they talked to my girlfriend like that, and just dumbfounded at this chain of events that could and should have been easily avoided. Posted: 04 Jun 2018 03:19 PM PDT I'm sorry, I do not know all of the specific details of the situation, this is the information I've been able to suss out from talking to my sister and parents. So basically what happened was my 22 year old sister found out she was pregnant in March. She wanted an abortion. My parents got very upset and tried to talk her out of it to no avail. Being the good Baptists that they are, they then decided to have my sister forced into treatment via something called the Baker Act. This was really low because my sister is mentally ill, she has schizoaffective disorder, and has been Baker Acted before in our small town, so the cops didn't doubt it all when my parents called them claiming she was threatening to kill herself. So she gets taken to the hospital and what should have been only 72 hours gets dragged out to a week and the attending psychiatrist petitioned the court for a commitment hearing. I was not present during the hearing, or even aware what was going on at the time because I was busy with college and no one tells me anything, but apparently what happened is that the this kangaroo court ruled in favor of the psychiatrist and also had my sister ruled incompetent, assigning my father to be her guardian. So my sister gets committed to a state hospital. Not Chattahoochee, there's one near Pensacola. From my understanding, she can be held here involuntarily for up to 6 months and then at the time she must be reevaluated and if she no longer meets the criteria of being a danger to herself or others, she can be discharged. There was not a bed available at this facility until late last month, making my sister over 3 months pregnant. I don't know far along she was initially when she found out, so by the time she will be up for discharge, her baby would have already been born. This is so fucked up to me! How can they possibly force my sister to give birth? I spoke to her last week and she sounds completely fine to me, just upset because she doesn't want the baby and doesn't want to give birth. She said this is 100% our parent's doing and understandably, is very angry over the whole situation. She is being medicated against her will. Because she is "incompetent", the psychiatrist goes over her head to our father to consent to what meds she takes and she is unable to refuse. She is on an extremely high dose of Haldol and experiencing complications from it, but if she refuses to take it, they will hold her down and give her shots in her ass anyway. I already had two children from my first marriage, A & B. I worked a lot, and traveled for work often, but my wife was far and away their primary caregiver. A few years later, we had a child together, C. As A & B aged, they drew further and further away from me. I tried to reach out, but they never answered the phone, and I gave my wife letters to mail them. I am getting on in years, and have a cancer that requires an organ transplant. The doctors told me that a family member is most likely to be a match, so I asked C, the only child I see regularly, to get tested. She was found to not be a match. Wife claimed that she reached out to A & B to see if they would get tested, and said they refused. C became angry, and found the oldest, A, on Facebook. Only to learn from A that she'd never heard anything about it, but of course she would get tested. She also asked C to give me her phone number, so she could, apparently, find out what she did that made me disown her. C came to me, alone, and showed me the chat logs. I called A, and learned that not long after she had moved out, my wife had told her that I was disowning her, and telling her it was because she reminded me too much of her mother. A came to visit a week later, and brought a folder full of proof - rejected letters she'd sent, receipts of confirmation of certified letters all signed by wife, phone records showing she had attempted to reach out numerous times over the years. Soon after, B arrived, and his story was much the same as A's. They were both tested and found not to be matches either. I am on the transplant list, but my doctor has made it clear that the chances of someone in my condition living long enough to get the transplant are dicey. I have an appointment with my estate attorney next week, and I'd like to ensure my wife gets nothing, but I do not have the energy to go through a protracted divorce. Can this be done? Should I attempt to get a divorce or legal separation anyway? My wife doesn't know I know anything yet. Apparently caring for me was "too stressful" so she's been visiting her family across the country for the last 2 months, and is expected back in July. A has offered to let me move in with her family (I have grandchildren I never knew about!) If I need to, but I'm afraid if I leave the marital home I'll lose it. She asked a fellow neighbor to watch the puppy yesterday. Fellow neighbor found fleas all over the puppy and went to yet ANOTHER neighbor asking advice. Long story sho0rt, when she arrived home she was led to the other neighbor's apartment. He refused to give her the puppy. Said he would feed it,take it to the vet etc. He told her to get rid of the fleas in her apartment and only then would she get her puppy back. Now I completely agree with the whole 'getting rid of fleas' part. I am just concerned for her, if he takes the puppy to the vet etc, will he be able to claim ownership? Again, she just bought this 7 week old dog on Sunday and he won't let her have him until she takes the steps for flea removal (again, agree with that) The money was paid in cash for the dog with no invoice. I'm just here for the summer and one of the things my boss has asked me to do is type up an entire manual on Word. This manual is copyrighted by the organization that published it. I voiced my concerns but she said it'd just be used for training purposes. She wants it typed in a word doc instead of just scanned so it can be edited. Is simply retyping the doc considered copyright infringement? I'm a little concerned because I'm studying accounting and want to be a CPA and I know how reputation and ethics are in that field. Could I also be held responsible if the document is used outside of its allowed purposes? Also any advice on how to talk this over with my boss would be appreciated. Thank you! [GA] General Contractor left unpaid bills and now contractors coming to me for the unpaid balance. Posted: 05 Jun 2018 08:05 AM PDT [Georgia] I hired a General Contractor Sept 2017 to build out a store front for a business I planned to open Jan. 2018. On April 2018 with 90% of the project finished and about 100k over budget the General Contractor was fired and we parted ways somewhat acrimoniously. Fast forward to June; a contractor responsible for the flooring came to my business claiming the General Contractor owed him 6k and since the General Contractor had gone dark and not responded to any communication his only option now was to sue me. My gut feeling is the contractor is telling the truth, in any case my brief research tells me that I'm likely on the hook for the remaining balance. What are my options? I'm thinking the easiest solution seems to be to come to some sort of deal with the contractor and then try to sue my General Contractor or is the law different in Georgia where I'm not liable for the GC's fuckups?
