Washington State. Urologist performed a vasectomy on me 8 months ago. Wife is pregnant. Can I sue the doctor?

    Posted: 30 May 2018 05:22 AM PDT

My wife and I decided to stop having kids after number 5. 8 months ago I had a vasectomy. I guess the doctor screwed up because my wife started having all the symptoms of pregnancy. A drug store pregnancy test this morning confirmed it.

Can we sue the doctor for malpractice? Is he at all liable for this? My insurance company paid for the procedure, can we sue them?

A friends sister was raped by th

    Posted: 30 May 2018 06:04 AM PDT

    Location : Arkansas

A friend of mine told me her sister was returning to work after being raped by one of her bar patrons. When she reported the rape, the investigation revealed he was the perpetrator of a violent rape last year resulting in a man hunt. The woman attacked was kidnapped, and beat for several hours. Due to the severity of his crime, the county created an award for information leading to his arrest.

Her sister doesn't have health insurance. She's returning to work because she can't afford her medical bills. Her family asked if she could be gifted the reward for getting him caught. She was told "victims don't get rewards."

Is there something I can tell my friend about any monetary compensation to help with her trauma?

Washington State: Caught turd neighbor stealing packages off my porch.

    Posted: 30 May 2018 07:28 AM PDT

Earlier this month while I was at work my girlfriend had a package delivered to our home. Once we both are home she asked me where I put her package? There was no package. I checked our cameras and I caught the neighbors boyfriend stealing the package! It's 9PM by the time we're both home so we both very calmly go over to confront them. Of course they know nothing about it and they are trying to blame it on someone else.

This is the best part right here. They call there daughter down to ask her and she is wearing the shit that was stolen of my porch! She claims she got it earlier that week as a gift, we show them the receipt and they do absolutely nothing.

We called the police that night and they didn't show up until 2AM. The best they could do is give us a case number and we are going to have until the case is assigned.

I have also tried numerous times to contact our HOA and I haven't had any luck with them.

What choices do I have now? The value of the package was right around $200.

    Any help is appreciated.

    EDIT:

Thank you all so much for your replies. I forgot to mention this in the beginning, we filed a claim with the original vendor and they sent us our items again.

Also the night it happened I showed them the video and they tried to say it wasn't him, he came downstairs later in the same exact clothes he had in the video.

The only thing I am going after now is for them to penalized for their actions and for not doing a damn thing about it. They act like nothing happened. I still see the boyfriend that stole my package from time to time too.

I am hoping that our HOA can help us, as far as I know they are only renting the house.

Also still waiting for the police to assign the case.

(Michigan) I coached a player who got injured, now I'm named in a lawsuit

    Posted: 30 May 2018 09:52 AM PDT

    This is my situation:

I was hired to be Head Coach by a high school hockey team in the Spring of 2016. Our season officially started in the fall of 2016 and the incident occurred in late 2016.

In this game, about half way through, our player and another player collided. Our player remained on the ice and the trainer headed out to assess the injury. According to the trainer it was his head. My first question I asked was, "does he have a concussion." The trainer replied no, and that he was cleared to stay in the game. However, if at any point the player didn't feel right, to remove himself. This was my indication that the player was OK to continue to play; the trainer said so. I did not go on the ice to assess the player/ We are instructed to stay off the ice and allow the trainer time to assess whatever the injury may be.

The game continued and about 10 minutes later, another collision happened with the same player. He stayed down again briefly, but made it up to his feet. The referees were sorting out penalties and our player started to skate to our bench, our indication that something was wrong.

I followed up with the trainer and he told me he believed our player had a concussion. He told me our player showed no signs of concussion after the first collision, however there were clear symptoms of a concussion after the second collision.

In the week following, I checked in on our player but never made contact with the family. I called and texted his father multiple times and didn't hear back. One week after the incident, a mass e-mail was sent out from the father to all parents/coaches on the team with a status update on the player; he was concussed and his return was indefinite. In the e-mail, it was insinuated that the injury was my fault for not removing the player from the game. A month later, the parents demanded a sit-down with myself, my staff and the AD to get to the bottom of the incident. They asked many questions and plainly laid it at my feet. They also demanded I resign.

After the season, in early 2017, the family filed a lawsuit against our team/school for the injury. At that time, the only individual named was the trainer from the opposing school. However, this process has been slow-moving, but I was recently informed today by the case manager defending our school that the lawsuit has been amended and I'm now named. The wrench in all this is that I resigned from my position a month and a half ago, and this case has nothing to do with that. My questions are: what kind of liability do I have? Should I seek my own representation? Is there any chance the school can decline to "cover" me since I resigned?

TL;DR I coached a player who got injured; now I'm named in their lawsuit. I resigned recently and I'm worried I won't be covered under the school

Update 4 - Washington State: Neighbor is currently video recording me and has a camera directly pointed at my bedroom window. What can I do? [FINAL UPDATE]

    Posted: 29 May 2018 05:54 PM PDT

    Original Update 1 Update 2 Update 3

So it's all over. The prosecutor called me and said of course, they aren't wanting to plead guilty to all the charges and instead of jail time, his attorney wants 30 days of house arrest. Which is what he does already, just sits in his house and never leaves.

The trial was pushed to July and we are moving out of state around that time. I told the prosecutor that we wouldn't be here to be witnesses. I have no soul left or fight in me.

Thanks for all your help, everyone. The justice system has failed us.

    Wait... I'm 1099?

    Posted: 30 May 2018 08:39 AM PDT

Hello, I had an awkward conversation over the phone with my boss today. I jokingly asked if I would get holiday pay for filling in for someone over memorial day, he responded with "well you're not w2 so don't expect it.", I responded with a "what", he followed up explaining the contract I signed was a "1099". I did my research and found that I totally do not qualify as a "Independent contractor"

The thing is I am hired though a staffing company, the staffing services (Ill call them Staff) were hired by a bigger company (Biggs Co.). Biggs Co. has been dictating all of what is mentioned above. I did sign a contract with the Staff.

I work in the medical field as a IT trainer. I teach classes and I go support them in hospitals owned by Biggs Co..

I have a detailed schedule of where to be and when. I get specific instructions and a script to "read." I have a dress code. I get paid hourly. I have three bosses (Two in Biggs Co, one in Staff). There are "full time staff" that are W-2 but are hired directly by Biggs Co..

How screwed am I? I know to set beside at least 30%, and doing this currently. I know I should have filed something in April with estimated wages.

I did some research on the IRS SS-8 from, can this be done after my contract ends? Will I get the money I put into Taxes back?

I get paid a pretty good wage for someone of my age so I am hesitant about raising a hand. I started this job in January, but my contract ends tomorrow so I am almost ready to burn bridges.

Only problem is it's a 50/50 if Staff will be hired again for a project in January which I would really like to be on and I know if I pursue the SS-8 they will not hire me again.

Edit: got the final word. I am hired on as a 1099 by the Staffing company They have no withholdings on my paychecks

UPDATE: Real estate lawyer neighbor trying adverse possession on half our backyard? (WA)

    Posted: 29 May 2018 08:06 PM PDT

We sent an email that contained many of the suggestions from all of you (thank you!) We got an immediate written response from neighbor, and were able to sort it out on good terms.

As a bonus, we discovered that he had recently claimed, and won, adverse possession along another side of his property against developers. So it seems like it wasn't entirely out of the realm of possibility... but thanks again for the advice!

As a Manager am I bound under HIPAA?

    Posted: 30 May 2018 10:56 AM PDT

Arkansas, United States: So my HR person is accusing me of violating HIPAA for an employee of mine. I am an in-office manager (administrator) of about 15 field employees in a small state agency. One of my first tier underlings (supervisor) informed me that his employee working away from him at the time got bitten by a dog, so I heard it second-hand up the chain. I'm not terribly familiar with our worker's comp procedures so I go ask our HR person to give injured employee a call and advise her of procedures. About an hour later, I had to leave for the day and let our receptionist know what had happened, so she could direct any calls if problems came up. An employee of another office was standing there and overheard and said something about it to our HR person. Now she is accusing me of violating HIPAA...and I think she is full of it. Did I violate an employee's rights? Thanks!

We’ve been paying my husband’s therapist in full for each session, but the therapist has also been collecting payments from our insurance carrier. He owes us a refund but claims to have no knowledge of the situation. He yelled at me and hung up on me when I called him about it today. [MN]

    Posted: 29 May 2018 10:37 PM PDT

    Location is Minnesota.

My husband's therapist is nice enough but he's absolute shit with billing. He's lost five of my husband's payments and we've had to find the receipts and credit card statements proving that we've paid. That should be his job, not ours. But he is helpful and my husband liked him well enough so he kept going.

Then today I notice something odd on the claims page on my insurance company's website. We've paid for several sessions in full this year but we haven't made any progress toward meeting our deductible. Strange. I get on the phone with insurance and they say that they have a record of all the therapy appointments and have been issuing the cost of the therapy session minus our copay (so $120 minus $35, which is $85) to the therapist. I ask why we've been paying for the sessions in full if the therapist is also collecting money from our insurance carrier. Insurance person says that with every payment they've released, they've notified the therapist that he owes us a refund. They assumed therapist has been issuing that refund.

So I realize this has been happening: We pay the therapist the full cost of $120 for the session at the time of service. Therapist files a claim with our insurance company and receives $85, since our copay is $35 (and $120 minus $85 is $35). Insurance believes that therapist is turning around and giving us a refund of $85. Therapist doesn't give a refund and instead pockets $120 from us plus $85 from insurance (so $205). So we're overpaying for the sessions AND nothing we pay is being counted toward our deductible, since copayments don't count toward the deductible and the insurance company has told the therapist to reimburse us the $85.

Realizing we had not been getting reimbursed from the therapist, the insurance person says that we need to call him and relay the information. She adds that in the future, we should insist on only paying our copay of $35 and to have the therapist file a claim for the rest. Therapist's policy is that you must pay in full at the time of service, so I'm already not feeling good about this. I'm not sure if the therapist is intentionally keeping the extra money, but I'm definitely not accusing him of fraud or anything here. I just want to get this sorted out.

I called the therapist to tell him what the insurance company said about them owing us a refund. I left a voicemail in which I was terse (since they not only owe us a big refund right now but also have lost several of our payments and I'm still frustrated about that). The therapist calls back and says he has no idea what I'm talking about but that insurance companies make mistakes all the time and he's sure that they've given me incorrect information.

I ask him why he's been collecting the full cost of the session from us AND filing a claim to collect the $85 from insurance. At this point I'm quite angry. He tries to tell me that our insurance agent is wrong. And then I lose it. I tell him I have the copies of the claims proving he received $85 from insurance and receipts showing he collected $120 from us. I'm basically yelling at this point. I told him that I need to know when and how he plans on refunding us for over-payment. He starts yelling back at me. At this point I can't even remember who said what but I'm beyond irate.

He finally says he will look into it and then he hangs up on me.

I know I shouldn't have yelled, but I did and there's nothing I can do to change that. I also know that I should have caught this earlier but I naively assumed the $120 for each session was simply counting toward our deductible and that was that.

What should I do now? If we don't get the refund from the therapist, is there anything I can do? I have no idea what to do next. Any advice would be appreciated.

Edit: It's come up in the comments a few times so I just want to add that the therapist isn't super amazing or anything. He's fine. It wouldn't be the worst thing to ditch him and find a new one. The problem is that my husband is in a therapy program where the schedule is weekly group and twice monthly individual sessions. He loves group. He looks forward to it every week and it's made a world of difference in his life. The guy who runs it is awesome (and also only collects copays and bills correctly). I'm worried that if he gets a new therapist he will be kicked out of group. That's the only real attachment he has to this specific therapist.

Edit 2: Also since it's come up, the provider is indeed in-network.

Apartment rented to us is infested with roaches, Virginia

    Posted: 30 May 2018 08:08 AM PDT

I don't know where to go from here. We are killing upwards of 100 a day (I wish this was an exaggeration), we cannot use our kitchen because of the pests and feces they leave, we are afraid to sleep in our own apartment. The infestation is truly bad. These things are coming out in the middle of the day! The management company has sent an exterminator out once, but it simply isn't enough. We were offered $150 off of our rent; however, the property manager mishandled a $150 money order and it got sent back to her, so we are out that money. She is claiming we still owe it, we shouldn't because we paid cash for the money order, she wrote on it making it invalid, and the order was returned to her desk (it took her a week to inform us of this). We have not been provided with a sanitary environment (as is their responsibility per a clause in the lease), and we want out of here. They agreed to terminate the lease and give back the security deposit, but I do not believe we should have to pay rent for an apartment that is unlivable (we moved in May 18). I do not want money out of this- all I want is for them to make this right. We are out a ton of money by having to move again, take time off of work, pay new deposits, rent a uhaul. I threatened with calling the health department and going to the news. I have hundreds of photos of these vermin, as well as recordings of my conversations with the property manager. What else can I do? Norfolk, Virginia.

Father commits suicide, wife won't tell his children anything, seems just to want money and to box kids out.

    Posted: 30 May 2018 04:10 AM PDT

My Father committed suicide last week. His wife won't tell me anything. I drove from Maine to Virginia to try and get information. I have spoken with the sgt on his case to get information and I have to call the funeral home to get any information on that. His wife seems more concerned about money than us losing our father. I was never concerned about money or things but ...she had everything planned before she even told me what happened and she almost forgot to call me in the first place. She didn't want me to even come to Virginia. Just 2 days after it happened she said my father had some things he wanted my brother and I to have...I don't know how she knew that...the sgt said there was not a will as far as he knows and I didn't want anything until she started acting this way, downright cold and evasive. I don't know what else I can do but it just seems fishy to me the way she is acting. She sent a really insincere text to me when she knew I would be gone from Virginia and it just seems like she's trying to make sure she gets everything. The last time I spoke to my father he said he wanted a divorce and I don't know if he did go to a lawyer or not and I have no money to fight with her...she has done this to another dead husband's kids and I just can't wrap my head around the whole situation. I know my father wouldn't want her to take everything. In the case of suicide without a will does everything automatically just go to the wife or is there something that also helps their kids out (not that I want anything from this horrible situation...just so angry at how she's treated us)

My identity got stolen and luckily they were dumb enough to let us know by billing my dad with a ambulance and hospital charge.

    Posted: 30 May 2018 11:00 AM PDT

    Previous post here.

[Alabama] Well, my identity got stolen. We contacted the hospital and ambulance service and they're going to open an investigation. The person knows my full name, social security, address, and (kind of) my birthday. They got the month wrong which is good for us, I guess. They also put my mom's phone number down as "mine," which really creeped me out.

I'm bewildered at this. My social security has been in a lockbox my entire life; I've held it maybe four times. The only times I've used it was to get my license and get a credit card with my dad.

The person who stole my identity also lives an hour away and went to a hospital I've never been to. I don't know if she has a fake ID with my name and information and that's why the hospital let it happen or if they just let her write the information down on a form and let her go.

I'm scared this person is opening up credit cards in my name and ruining my credit score. I'm only 19.

Does anyone know how this is possible? How did they get this information? I've never shared my social with anybody and don't even have it memorized.

Also, are we taking the right steps? With letting the hospital and ambulance company start an investigation before contacting the police?

    Any recourse against dog owners?

    Posted: 30 May 2018 12:08 PM PDT

Asking for a friend in North Carolina. His kid's bike was stolen. Another kid in the neighborhood is commonly known to take whatever he wants. The wife went to his house and knocked on the door. The kid came to the door, opened it and his dog came running out and attacked her and her young daughter. Left puncture wounds and significant bruising. Her position is the kid opened the door wide and watched the dog run out and attack them. She went to the ER and got care. That came out to about $1400. It was filed against her insurance.

Animal control says the wounds are not sever enough to take the dog even for a short while. Does she have any recourse against the owners of the dog?

My (m32) Spanish girlfriend (f27) might not have won the visa lottery and is pressuring me to get married sans prenup.

    Posted: 30 May 2018 11:09 AM PDT

I'm American in California and we've been together for just over a year. She graduated last August with her masters and has been here on OPT expiring on Aug 31st. She found a job after college that was willing to sponsor her H-1B but has yet to receive any formal notice of acceptance or rejection. She is also having difficulty getting the big, corporate company to see if any check was cashed that might indicate something.

So, now she's in a full blown panic and putting major pressure on me to get married so she can stay. (She had the same meltdown last December when she wasn't sure the company would sponsor and we almost broke up because I was definitely not ready after only being together less than a year.) During this time, I eventually said FINE, I'll do it as long as we secure a prenup to protect the business that I started and that is growing. Her work ended up sponsoring her, so it fizzled.

The problem now is that her current OPT visa expires on Aug 31st, so even if we got married right now there would be a short period of time that she couldn't work. The longer we wait to get confirmation from the H-1B, the longer she will be unable to work. So now marriage is back on the table and I'm back to agreeing so long as there is a prenup. She had agreed back in December and her parents even recently said they would cover the cost, but now that it is coming up again she is saying they don't have the money because of some "sudden financial setback" and she doesn't have the $4000 for a prenup PLUS the $4000 it costs for filing with the government.

She has explicitly said that she would not view this as a traditional marriage and it would strictly be for the sake of being able to stay even though she is "certain she wants to spend our life together." Like any relationship, things haven't been perfect but she has been a major supporter of me through financial struggle, emotional support etc.. I want so badly to help her and I think she deserves to be here... but I'm just not sure of the right thing to do.

Should we wait to see if the H-1B gets approved? The way she puts it, everyone who has been approved has already found out.

Is she immediately entitled to half of my company if we get married?

    What would you do?

TL;DR - my girlfriend of 1 year probably didn't get approved for the H-1B and wants to get married but I'm unsure of moving forward without any prenuptial agreement.

[NE] Our apartment complex recently installed community internet, but we're not required to switch until lease renewal. Now, we were automatically switched over, but they will not give us the new router password. Can we break our lease? What are our options regarding our ISP?

    Posted: 30 May 2018 10:28 AM PDT

    Full story:

We only just moved here and signed our lease in March of this year. We were told we could use any internet service provider that we wanted. This was important to us and we made that very clear at lease signing, so naturally we used our own modem and router with Spectrum internet and we were happy.

Now two months into our 15-month lease, they decide to install routers into the walls of each unit inside of a locked box. When I called the property manager, she said that the complex is switching to a community internet and TV package for all residents at a discounted price through Spectrum (our current ISP). She said that we can keep our current services for now, but upon lease renewal, we will be required to switch over. She also said if we wanted to switch, it would be a lease addendum, and thus we would not be able to switch back. I told her not to sign us up and that we were not interested. She said she understood and thanked me for calling.

Welp, now I have an email from Spectrum saying "Thank you for switching services", and this morning our router/modem can't connect to the internet. We called Spectrum and explained that we never wanted this service change, but they said to contact our apartment complex. They also said that the apartment complex will have the password for our newly activated community router that we can use in the meantime. We called our complex twice and left messages but they won't answer the phone.

At this point, I'm wondering if this kind of thing qualifies us for breaking our lease and moving. While it would suck because we literally just moved here less than three months ago, I am really not comfortable with our complex going above my head and changing our internet plans, our ISP just going along with everything, and honestly we are not comfortable with the idea of community internet in general. And also: what are our options regarding Spectrum? Not that I'm looking to sue them, I just want to know my options.

    Thanks in advance

[IL] Please help me figure out how I can pay a traffic ticket that I cannot read and the county clerk has no record of.

    Posted: 30 May 2018 08:06 AM PDT

    http://imgur.com/B2NRxEP

I'm in cook county IL. This is my first traffic ticket and it was given to me by the railroad police of Illinois. I posted here previously and was told to contact the county clerk. I have called or tried to use the online ticket search atleast once a day for the last month. I'm terrified this ticket price will double or my license will be suspended. I cannot read the ticket and I'm almost positive the police did not give me all the documents necessary (on the back it says to return the blue copy by mail to pay and I have no blue copy because I was not given one) who can I contact? How do I find out more about this ticket?

Thank you. If it makes a difference the ticket was for having my phone in hand.

Pit bull attacked FedEx driver, left open wounds on hands and testis requiring stitches.

    Posted: 30 May 2018 11:56 AM PDT

My husband was transported to the hospital via ambulance after a pit bull attacked him while delivering a package. He rang on the doorbell and as the woman opened the door, the dog ran out and mauled him. The dog took a bite out of his hand and genitals, leaving open wounds which require stitches. The house had no "Beware of Dog" signs anywhere. The woman didn't even bother to offer any aid or call 911 and she just ran back inside after she was able to get the dog off my husband. My husband was left bleeding in his truck while he waited for the ambulance and police to come and take him to the hospital. My husband has been a courier for 9 years and has dealt with pretty wild dogs in his routes, however, this is the first time that he has been attacked and this is no small bite. I have photos of the wounds for reference.

My question is, can he sue the woman for the attack?

    EDIT: This happened in FLORIDA

2nd Edit: Animal services/health department just called to inform us that the dog hasn't had his rabies shots or other necessary vaccines updated in over a year.

Shady tenants make weird changes to parent's property and are now threatening to sue them

    Posted: 29 May 2018 09:30 PM PDT

These tenants occupied the property for the house for 5-6 months and were going to purchase it after a 6 month lease. They also agreed to a contract basically stating that if my parents change their minds at any time about selling their house, the tenants will move out.

For 5-6 months, my parents steadily received on time payments of the rent. However, they ultimately did decide not to sell the house, and upon inspection of the state of the property after the tenants moved out, all sorts of weird things were changed. The walls of the inside were painted really messily in a shade of brown that was similar to the shade the house originally had but not exactly. The paint job wasn't complete either. The carpet on both floors became extremely dirty with red blotches and weird red powder everywhere. Holes were randomly drilled into the ceilings of bathrooms and on the walls of the living room and master bedroom. In the master bedroom too, a panel of sound proof glass was cracked. There were also really strange wires wired everywhere along the edges of walls. They had also left the lawn to grow for months untrimmed. The lawn in both the front yard and backyard ultimately became very messy, long, brown, and full of weeds. My parents were not notified nor did they give permission for these damages, renovations, and changes.

My parents were a bit horrified at seeing the house in this state, and they immediately contacted the tenants. They didn't really provide an explanation for these changes and just asked my parents for a quote for the damages, and it came out to around $19k-$25k (some things need to be added). When my parents informed them, they sent a series of really rash e-mails threatening lawsuit. They also accused my parents of being dishonest as a landlord or trying to set them up in some sort of scam.

Prior to the tenants moving in, they reported to my parents that the AC was not working. However, my parents informed them that the tenants prior to these guys repaired the AC for both the 1st floor and 2nd floor, and that the AC was working fine for them. The shady tenants did not bring up the issue again for the rest of the 5-6 months. Instead, they went on to replace the AC compressors themselves (they did inform my parents about this). However, the AC actually still doesn't work when my parents inspected the house after they moved out.

This is the basis upon which they are threatening to sue my parents. They are saying that they were not adequately provided with a functional AC and that my parents ignored them when they e-mailed them about the broken AC compressor (which they didn't). They also say that my parents should pay them back for the $15000 they spent for their new AC compressors and will sue if they don't.

Their e-mails are extremely focused on this AC issue and make themselves out to seem like victims of my parents as landlords, while they never provided an explanation for their damages all around inside and out of the property. It's also very scary to imagine what they could have been doing, as they also purposefully hung up bars across windows and put dark heavy curtains down so nobody could look inward. An example would be these 2 doors that open up to the front yard, it opens outward but the bar was hammered onto the doors themselves, not the surrounding wall. It's kind of indicative that they never planned to open the door.

Do they have a case here? They are also unwilling to pay the $19-$25k in repairs to restore the house to its original state.

    edit: more details

I am being harassed and just want it to stop. Local PD has been informed but what else can I do?

    Posted: 30 May 2018 09:35 AM PDT

    I am located in California.

I've been receiving semi threatening text messages from a family member for a few months. Today I told my family member that I did not want to have any contact from them again and that anything after this would be considered harassment.

The family member laughed (via text emoji) and said that since they weren't blocked they could contact me whenever they wanted.

I have not blocked this person yet because I want to be able to go to my local PD and show them that this person has continued to contact me even after I told them I did not any further contact.

I have already contacted my local PD and told them about this, the woman at dispatch said that an officer would call me back.

Is there anything else I can do? Anything else I should be doing? Thank you.

Can the FBI tell people I’ve informed!

    Posted: 30 May 2018 12:08 PM PDT

    Location: FLORIDA

I informed on a possible school shooter that I was working with a couple of months ago. The FBI Agent called me a couple times and I provided all the information I could, identified photos and social media.

Since three days ago, Ive approached by various employees on the security team at my job and told this gentleman was arrested on our property by the FBI.

My current employer, a former police officer just told me he was never picked up at all and he story is a lie.

So I called the FBI Agent to confirm my worst fear. He called the security supervisor of the location we both work and told him I informed.

The FBI used my name to tell a citizen that I made a report. That citizen told all his coworkers, who all approached me with the fake story because they know it was me.

Did the FBI put my job and life in danger?

[VA] Former Landlord Taking $500 Of My Deposit For Cleaner <1000 sq ft.

    Posted: 30 May 2018 07:42 AM PDT

    Hi all,

First post, unfortunately it's for legal advice. I've rented the in-law suite in my landlords house in Fairfax VA. In March my gf and I found a townhouse to buy. We were informed by our realtor that in VA there were no reprocussions for breaking the lease for a residential. I told my landlords that we would be moving out April 18th. They said they understood and asked if we could pay for May (though we would not be staying there) too help them out whie looking for a new tenant. We really liked this couple and though we did not have to we did pay may's rent ($1,250.00). When moving things out they asked if we would paint all the walls. Again, we liked them and obliged. $200+ for paint and cleaning products later, we do a walkthrough and are told to clean bathroom and kitchen as well as clean the glue off from between the floorboards they installed before we moved in. ....Surely....Another day of cleaning and we finish. They thank us for the effort and tell us they will get the deposit to us within a week.

5:45 AM this morning. "We had to get a cleaning service to clean everything and they charged us 600 since it was last minute and Memoril Day Weekend, but we are only going to take 500 from you."

I ask about what we damaged that was worth 500. He replys "just the toilet seat and cleaning". So in all im out about $2,000 for the extra rent, cleaning and paint supplies, and 500 from my deposit.

To get a regular cleaning for a WHOLE house costs around 100-150 around here. How could my place,<1000 sq ft, cost so much?

If it was last minute shouldn't I have been aware they were going to pay top dollar and charge me for it?

If they were going to hire cleaners why did they have me buy cleaning supplies?

I gave them a months rent when I didnt live there so the wife "wouldnt have to go back to working full time while looking for a tenant". Can I recoup any of that?

Are we screwed for trying to be good tenants?

    Any help would be appreciated.

[Michigan] I will be unable to work soon due to surgeries, employer suddenly claiming I don’t have disability insurance

    Posted: 29 May 2018 08:54 PM PDT

The company I work for has about 500 employees in our location. I have been there threeish years.

I need multiple major surgeries which are going to put me out of commission for months. I will not be able to work. One of the benefits my company offers is disability insurance, which has both short-term and long-term coverage. I just spoke to the benefits people about applying for FMLA, and how to go about starting the disability paperwork, and they looked at their system and said, "Oh, you don't have that."

I absolutley, 100% signed up for it. Each year, when they have us select benefits through ADP, they tell us to take screenshots in case anything goes wrong. I took screenshots. I showed them screenshots where I clearly have selected the disability insurance. I showed them screenshots of the confirmation screen, showing that I was signed up for the disability insurance. Their response is, "You don't have that." They are now claiming they didn't take the money out of my paycheck. I don't know if that's true, because my check stub says things like, "Frm. Ins, AC2016-B, $62.38" and "Dscvben dismem ppa addtl, $122.50." Those aren't exact quotes, but you get what I mean.

Am I out of luck, here? They say take screenshots. I took screenshots. They say show them the screenshots. I show them the screenshots. They say, "You don't have disability coverage."

[California] Woman in my apartment accused me of harassment when I complained about her using my parking spot. Landlord is now trying to evict me. Part 2

    Posted: 29 May 2018 07:27 PM PDT

I posted part 1 a few weeks ago at https://old.reddit.com/r/legaladvice/comments/8aueq1/california_woman_in_my_apartment_accused_me_of/

There have been further developments and I need further advice.

As many of you suggested, I called a tow truck company when I saw the boyfriend's car parked in my spot. They arrived within 15 minutes but unfortunately he got there right as they were starting to work, and so by state law they had to release the car. He moved it to the guest parking and left.

About an hour later the police came to my door wanting to ask me about the situation. I explained that I called the tow truck because the vehicle was parked in my spot and the management didn't do anything. After hearing all this, they told me that she had filed a claim of harassment against me, which sounded exactly like what she told the manager. At that point I told them that I didn't want to answer any further questions. They threatened to arrest me for noncompliance if I didn't answer their questions, but in the end they left without doing anything.

Then two days later I got a call asking me to come back to the office. The manager was once again not interested in hearing my side. He said that they can't have people like me going around harassing women and calling the cops (I didn't call the cops, she did) and making tenants uncomfortable. I was given two options, either terminate my lease and move out, or face a formal eviction. He also warned me that if I am evicted for harassment, it will be public record and I won't be able to rent an apartment again.

So I need further advice on how to handle this. I tried calling a couple lawyers but after giving them a brief rundown on the phone, they said it would be $500 or more for an initial evaluation. I got the impression that they weren't really interested.

As I mentioned in my last post, I have lived here for 8 years without any problems and can't afford to move right now because comparable apartments in my area are around $400 more a month for new leases. It's not rent controlled but the rent hasn't been raised in 5 years or so.
