I live in NC, more specifically the Triad. My daughter came home from her dads yesterday evening with some comments and physical things that make me believe someone at her father's house has touched her inappropriately(not her father, he would never, but i was given a name by my kid). I plan to take her to a doctor this morning as soon as she wakes up, but my question is should I take her to her primary care doctor or the hospital? I'd hate to use unnecessary resources by going to the hospital, but I don't know the proper route here. The hospital may have better resources, as a children's hospital, to set any investigation that needs to happen in motion. Edit: thank you all for the fast responses. We have spent the day at the large, local children's hospital, who informed us this was the correct local resource, and have been seen by people who specialize in this. I never received any bills for it, when I called them they seemed apologetic and told me the bill was sent to some governmental entity (I forget which one) and they didn't respond to the bill, but told me to call victim advocates. The victim advocate told me they don't deal with this and to call the hospital. It's been a week of calling various numbers and meanwhile I'm getting calls from collections for money. Basically what are my rights here and how should I get the hospital to remedy the situation? I thought it was illegal to have a rape victim pay for their own rape kit? Half way through their lease they decided they wanted to move. Of couse because they are apart of the government they feel they should be able to just break lease with no penalties. My dad and the company he works for disagree. In discussions where my dad was insisting that they pay the penalty outlined in the contract they basically came back with "well we sincerely hope you have your own finances in order." Guess what came in the mail yesterday, the notice informing him he will be audited. This can't be okay, right? I called Moneygram for this replacement and it has an option for the person who received it and lost it. Landlord and I both have proof that they received the deposit. So why should I have to be the one to fix their mistakes? Landlord says that if I don't replace it then I won't get my deposit back. Is this legal? I also am suspicious that she's keeping the money order that she 'lost' and will try to cash it for herself when we least expect it. Update of out of state pedophile step father Posted: 08 May 2018 04:18 AM PDT Again, sorry about the title I'm terrible at them. After reading several people's advice I made some calls and found out that the investigation was dropped because "one of the victims refused to work with the investigation" and that they felt if both victims (me and my little brother) were willing to help then we would have a stronger case. This strikes me as incredibly odd because both me and my brother were very willing to do whatever it took to help put him away. The only thing I can think of is maybe in the recordings they took of us crying was counted as not willing to face him in court or something. Next I found out that all of the child porn and whatnot that we saw on his computers wasn't useable because they couldn't unlock the computers. They did say that he threw a tablet in a lake and that because he was hiding things like that, we had a stronger case. I asked if they still had them and we provided passwords if they could try to use them and the DA guy I talked to said they could. So I've compiled a list that me and my brother remembered him using and plan to give that to them. I know who reviewed the case and who was investigating everything. I've called both people and the guy who reviewed it said that I could reopen it if I spoke with the investigator. I've called the investigator twice but he wasn't in the office. Where should I go from here? I definitely don't want everything just swept under the rug and forgotten. He HAS to pay for what he did. But I honestly have no idea what I'm doing here. 2nd grader tried to kill a kindergardner Posted: 07 May 2018 10:55 PM PDT My nephew was assulted on the bus to school. He has been bullied by this student for a while. The bully (2nd grader) gets on the bus before my nephew (kindergarten) and walkes up to him and punches him in the stomach on occasion. And today he came up to him and said "I'm going to suffocate you" and proceeded to wrap a sweater and his backback around his face. And then pulled on his ears and tried to strangle him with his backpack and sweater. The school said they can't do anything because he didn't report it to the bus driver. He still has scratches on his face. And Everyone on the bus says that's how it happened. I told my sister in-law she needs to call the police and file a report. The school wants to have a meeting with my nephew and his parents. What's the next course of action? A student shouldn't be afraid for his life trying to go to school. Condo Building Drew our Parking Lines Wonky Posted: 08 May 2018 06:24 AM PDT Hey All, So my girlfriend and I are in the home stretch of purchasing a 1-bedroom condo from a new building development in East Boston (re: Boston). Every condo in this building comes with a personal off-street parking spot - which we will wholly own with the purchase of the condo. It was written in our purchase and sale that our parking spot was assigned as some number - out of the ~30 so available. Last Thursday, we conducted our final walkthrough and decided to check out our assigned parking spot. Low and behold the lines were drawn at a ridiculous angle, and our spot (which lies in-between 2 others) is distinctly skinnier than many of the others. I did not go out and measure this spot, and did not observe every other spot, but it was clear that only a compact car could fit into ours. We brought this up to the building agent, who said that these lines were literally drawn the day before. I am currently going back and forth with my real estate agent and the building developer to get them redrawn, as a full-size car would not be able to fit into this spot. The developer measured the width at 8ft 2in - while other spots range in width between 8ft - 9ft I am wondering what legal standing I have to rely on, and if there are guidelines in Boston or Massachusetts that stipulate a minimum size of parking spot. The exact language in our purchase and sale was : "The SELLER hereby agrees to sell, and the BUYER hereby agrees to buy Condominium Unit No. "X" (which includes Parking Space No. "Y").... Edit: I would add that off street parking in Boston is HIGHLY sought after, and this spot represents a significant amount of value (potentially $30,000 - $50,000 in additional value). Posted: 08 May 2018 11:02 AM PDT In CA. I purchased a used convertible which came with a hard top. This model of convertible is known for having tops stolen, since they're easy to remove and sell. These hard tops can be obtained new for $800-2000, depending on options. Yesterday, I got a note on my car saying someone had messed with it and to contact the writer of the note. I texted and they called. On the call they claimed the hard top was stolen and they were the previous owner. They're currently obtaining a police report, but all identifying info they have provided could be seen from outside the car. I purchased the car for a reasonable price, so I don't believe this is red flag receiving stolen property. I'm looking into getting a lawyer on general principal because this feels scammy. How do I protect myself here? What does the alleged previous owner need to provide to prove ownership? Lanlords are going back on everything they said (VA) Posted: 08 May 2018 08:45 AM PDT Hey there Legal Advice! Here's the story as it stands with some money details fudged to keep anonymity. We were renting a house a three years. Around nine months before we were due to re-sign we were given notice the homeowners were coming back. Then a few months later, just kidding, they weren't. Finally, at the start of this year, they hammered it out and decided they were coming back. We went into overdrive trying to buy a house (as was our intention to all along but figured we'd give it one more year); the lease was set end April 30. Unfortunately, the house contract fell through and we were left about mid-March to find a new place to live and start moving. Around this time, the property management company started reaching out to see if we would move out early as the homeowners really wanted back in. Like, really wanted back in. The PMC and the HO (home owners) were relentless in this pursuit. One of the HO reached out via Messenger (after stalking us online) and told us not to worry about the carpets, painting, cleaning, anything; just get out. They said they would release the deposit, give us the back rent, everything, just get out as fast as we can. The PMC was reaching out via e-mail, phone call, and text, trying to pressure us out as they were getting the same on their on from the HOs. Now I should stress that I am a one man show in this as my better half is Stage IV with bone cancer and cannot do much to help and the kids are sub-teenager and are more under-foot than anything else. Some family and friends stopped by on occasion to help out but, there was a lot do for one person. So from about mid-March until mid-April, it was getting to the point where I was calling in to work just to get more move time in. This was costing me a lot of money. Multitudes of trips to the dump as we literally were halving our living space. I should have slowed down. I should have told them to bugger off, and that we had to the 30th to move. But, I didn't. I was being harassed, guilt-ed, promised, etc... Then it hit the fan. All of a sudden, I get a text from PMC saying HO will be at the house that morning to do a walk-through. I tell him no, as we are not out yet. PMC said sorry and that they were insisting and there was nothing he could do about it. So while we are trying to move, the HOs show up. Staring at us. I am a gun owner for recreation. This is the first time in my left I felt like I should open carry, that's how hard and how menacing they were staring at us. They were pissed. Here's why... We had a pet in the house. Yes, it was a no pet lease. I am aware I broke that part of the lease. It was a emotional support pet for my better half (which I know isn't protected in VA) and I'd do it again if I had to. They were also pissed we put a fence in. We put one length of non-permanent fence in and it was removed before we left. Had they not physically seen on one of their trips to the house to spy on us (yes, multiple times they showed up under the guise of "seeing friends" and just happened to wonder around to the yard), they would have never have known about it. Now, back to it. As we were moving stuff out, the PMC and HO did a walk-through and the HO approached me and said they were taking possession of the house and we were to not come back. Thankfully, that was it for us anyway. We left the keys on the counter and waited for our check. Keep at the front of your brain that we were explicitly told NOT to clean the carpets, the floors, paint, deep clean etc... I have this all in writing from the HO and PMC. That night, what do I see on Facebook, from this persons public profile? Trash talking, pictures, more trash talking, things that didn't make any sense. I screen shot everything. The vile nature of these two sets of posts and what them and their friends were saying were just terrible. Then, a few days later we received an e-mail from the PMC saying they are releasing the deposit to the HO and laid out a bunch of bullet points. Things that made NO SENSE. Like how we removed a tree from their yard. A fully matured version of this tree (which is what they said we removed) would have costs thousands of dollars as where it supposedly was would have required a specialized team or crane to remove. Yeah. No. They tried to say we did a whole bunch of damage to the roof and outside structure to the house. Yeah. No. That was from the rotted oak tree that fell that was reported and dealt with by the HO and PMC - I have pictures to prove. The list goes on and on and on... So I sit down with the PMC and they tell me that the HO told them they weren't worried about anything as they were tearing the house down to the studs and putting a whole new second story in and that the were going to renovate the house as soon as we vacated. They have plenty in writing about how they just wanted us out and that they didn't care about the condition. Suddenly, after this meeting, they person I normally deal with has be reassigned and I have to deal with a new person. This new person doesn't care about anything other than giving the HO the deposit. I dispute everything. Now, today, I get a letter in the mail demanding almost $7000 in damages and they are taking my pro-rated rent, deposit, and demand the rest in cash. I'm thinking at this point should go ahead and get lawyered up and sort this out. Do you all have any advice? I'll provide more details if anyone needs them. Posted: 08 May 2018 07:13 AM PDT What's up guys/girls So little back story ,one of my neighbors went behind our back without coming to us first whilst staying anonymous and told our landlord that we are running a VW workshop in our garage illegally, which was a complete lie as my brother and I both own beetles and are fixing them up to be road worthy (as we have no money for mechanics and body repairs). This individual then sneakily took pictures of me inside my car working whilst I wasn't looking as well as everything inside my garage (whilst on my property without consent) and then took a picture of my brothers car which is parked in our "designated" parking space and stated that it's being used as some kind of customer parking for our "illegal workshop". We are now being threatened with eviction for breaking some "body corporate rules"and these cowards are moving house today so we can't even explain the real situation to them as they are hiding from us. So basicaly does anyone knoe if there is anything I can do legally to address this issue because this is completely fabricated and our land Lord doesn't want to hear "our stories" Thanks in advance. My mom has had a broken arm for about 7 months now. Posted: 08 May 2018 12:41 PM PDT So back in November my mom was looking to buy a car. On the way out of the dealership, after signing the papers on a car that she liked, she tripped and fell and broke her arm. The people at the dealership called an ambulance. At the hospital they confirmed that she broke her arm and put on a cast. The person attending her told her it was a temporary cast that should serve her just fine until she got a proper cast but that she needed a more permanent cast done. They set up an appointment a few days later, that's the earliest they could schedule her, with a specialist who was supposed to look at the break and put in a proper cast. So the specialist looks at the break, takes X-rays and says that the current cast is fine. He makes an appointment for a few weeks later to come back again and check the progress. She goes back some weeks later and he says it looks good. My mom complains that her arm still hurts and it's not easy to open and close her hand. Doctor says that's normal a couple more visits later and the doctor puts her on physical therapy. She starts doing physical therapy at a facility. While doing the therapy she is in pain and can actually hear some grinding. The physical therapist tells her that's normal. So this continues for weeks. In one of those physical therapy appointments she gets a different physical therapist because the previous guy is out, the new guy upon hearing the grinding sound says that it's not normal and that it sounds like her arm is still broken and she should not be doing physical therapy. They send her to another specialist and he confirms that the arm is still broken it never healed. At this point he says that it's an old break and it can't heal on its own anymore. So after a few more X-rays and tests it's concluded that she will need surgery. So she has now just had the surgery. They basically cut off the some bone off of the old break points and cut off a piece of bone from her hip that is now placed in between the old breaks and held together by a rod hoping the hip bone will promote bone healing. My mother is in Texas and I'm in California so I wasn't there for any of this and am just going by what I've been hearing from my mother. But from what I've heard it just feels like the first specialist didn't do a proper job and only made matters worse by referring her to a physical therapist when her arm was still broken. She did keep saying that he really didn't seem to pay too much attention most of the time, he very easily dismissed her complaints of pain. The first physical therapist also looks like didn't really pay attention to her complaints. Does this sound like she would have any recourse to sue for malpractice? As for the dealership where she fell, what she tells me also sounds a bit weird. So immediately after she fell they were very concerned about her falling and even offered to pay the ambulance bill. They offered to defer the first two months payments on the car and asked her to come in and sign some paperwork. She went in and signed some papers but she's not sure what she signed because there were a lot of documents and she just went by what they told her they were for. Prior to the signing of the documents they would call her almost daily to see how she was doing, immediately after signing the calls stopped. I'm worried they might have had her sign some paper saying they're not liable. When I asked her what she tripped on she said there was nothing there. The floor was not slippery. She just says she tripped on the floor but doesn't know why. On the second visit when they went to sign the papers, apparently it had just rained and my dad noticed that the spot where my mom fell had a puddle of water. No other place had a puddle just that spot. Meaning that the floor is not even and there's a slight dip in the exact spot she tripped. So I've been hearing bits and pieces but from what I've been hearing I feel like there's a lot of things that went wrong. He's always been odd and antisocial. Her and her other friends have had him in their social network because they all worked together. This man we will call "Pog" (for piece of garbage). Pog is unnatrative, overweight, doesn't have girlfriends. He always buys my girlfriend and other girls in group nice unnexpected gifts. He's the guy that gets people things and they go "why"? Because of this I've always had a weird feeling about him. Never the less he's been considered a good friend in the group. The other day while she was hanging out with Pog at his house she used his bathroom. In the midst of taking off her pants she noticed a particularly placed external phone charger sitting on top of the toilet with its face perfectly pointing down the bathroom. Because of conversations she has had and the terror of the internet, she is aware of hidden cameras. She had an odd feeling about the particularly placed charger. She examined it, faced it the opposite direction, then went about her business. At this point she did not know it was a hidden camera. The next day "Pog" is acting very strange, texting her, saying he needs to talk to her in private. She gets a weird feeling once again and decides to meet him at a Starbucks. He goes on about some nonsense that she isn't paying enough attention to him and they aren't friends like they used to. But in a weird out of the element way, he mentions that he's been so upset about their friendship that he's been doing stupid things like "leaving the phone charger in the bathroom". He trails off on other things but this one sticks with my girlfriend. That night she proceeds to go on the internet and look up hidden cameras. She finds the exact one that was sitting on the toilet. That hidden camera/phone charger is EXCLUSIVELY only a hidden camera/phone charger. There is no possibility it could have been a model that was just only a phone charger. With help from Pog's roommate/our friend we get him to send us an up close picture of this charger up close while Pog is not home. My girlfriend buys the hidden camera/charger JUST IN CASE to compare it to the images of pogs charger. It's an exact match. We know we don't have evidence of actual video footage and we have talked to a police officer who said we can do nothing (the guy was a total asshole about it too. Suggested to my girlfriend to not have guy friends and that was it). At this point we want to take matters into our own hands. We want to take her hidden camera and switch it with his while he's not home. We want to see what's on it. At this point I'm wondering though, if we do find something on his camera that is terrible, will he be able to take legal action against us for switching (stealing) his hidden camera? Finance dept is now saying that the two awards should be combined to equal only the amount stated on the National Letter of Intent so they reduced the athletic scholarship to add only a few thousand on top of merit scholarship. Posted: 08 May 2018 08:27 AM PDT Okay, so this is going to be rough to explain because I feel it needs some backstory but I NEED help, I don't know what to do and I'm just a mess. Before anything happened I was left a trust from my fathers mother when she passed in 2005 I believe and it was to be put in stock by someone to let it grow. Keep in mind the trust was made so I can't take control of it myself until I am 35. My grandfather is the trustee but my mother has POA of my grandfather since he started having bad health last year. We moved back up north around where we were originally. Now, it is more expensive up north so we had to sell both my grandfathers house and the house he bought for my mom to afford a house up north and that's what we did. However my mother said, "we are going to take $40,000 out of your trust to cover expenses when we move." I was not comfortable with this at all and I expressed that because my plan for that trust was use it for emergency medical and retirement, other than that I never wanted to touch it. So they end up taking the $40,000 and now we are caught up to current day. We are in the new house now and my grandfather is still in bad health. The house is under my mothers name she's POA if him and he's the trustee of my trust. SO we were told this past Friday that he has 2 months approximately. Obviously everyone in the family is just broken about it. Whenever he does pass, and I wish it to be far after 2 months, my mom doesn't think she is going to be able to afford the house taxes ESPECIALLY when she retires. So I would like to discuss with her what we are going to do... when the time comes. But I know she's going to get pissed to hell and start telling me she doesn't want me in this house. That's just how she is, she's not straight in the head and she refuses to see someone about it. I need to know how can I take that trust out of my grandfathers and mothers power. I am a social worker at a mental health clinic. They put the man (Let's call him B) on a 24 hour hold in jail and I asked to press charges. The jail released B the next day, and then a week later he was arrested again, for trying to break and enter a cop's house (This is the same cop who arrested him on MY CASE!!). They charged him with stalking, and had him in jail for awhile. 30 days, exactly. While he was in jail, I filed for a protection order, out of fear of retaliation since he was so bold with the cop. It was approved by the judge. This protection order states that he cannot come to my workplace and within 200 feet of me. This morning, I went downstairs to the front desk of the health clinic at work on the first floor(I work in the second floor), and there he was, checking in for an appointment. He then sat down to a chair very close to me and stared at me and did not break eye contact. What do I do now? He was there to see a doctor, but he might have had an alternative motive too. J-1 bait-and-switch internship Posted: 08 May 2018 07:34 AM PDT I've been promised a certain type of training for this internship I got in America from abroad. When I arrived it was revealed that most of it were lies that they had no intention of realizing anything that I we had agreed upon. My sponsor is unwilling to protect my side and sides with the company, probably for financial reasons. I feel like I've been scammed and wanna explore my legal options for moving companies to somewhere serious. The J-1 visa is designed to be held by the company alone, with no freedom of movement on my part. What can I do to legally relocate to a professional company? [link] [comments] |
Posted: 08 May 2018 04:53 AM PDT I live in South Carolina. Last week I took my car to a mechanic to get some work done. The shop is part of a national chain. I left the car with them Wednesday afternoon. I was told they had to order a part and it would arrive Friday. They called Friday and said the work was complete. I was working in another county 3 1/2 hour away and I asked if I could pick up the car Saturday morning. When I arrived Saturday I was informed that the car was missing along with the key. The police were called and a report was filed. I called their customer service and filed a claim. I was told that if the car wasn't found after a week they would pay me the Kelley blue book value of the car. It was a 2009 pt cruiser and the value isn't very high. I'll probably get back enough for a down payment for another car and stuck with a monthly car payment. Is that the best I can hope for or is there a way for me to get a better deal since they were negligent? [link] [comments] |
Posted: 08 May 2018 12:14 AM PDT Hey everyone, my name is Alex and all this is taking place in Los Angeles California, or specifically Infiniti of Van Nuys. After the accident I contacted my insurance and they only fixed the cosmetic damage since they said the issue which caused the car to stall and not start is a manufacturer defect. Mechanics at auto body shop informed me it was a failed ecm. Had the car towed to the dealership and was told I would have a rental and diagnosis fee would be $150. Upon getting there they said there would be no rental for 2 weeks and that it's $450. After 3 days, I was told that there was some sludge in the engine and that the ecm had failed, but since there's sludge (which is irrelevant to the problem at hand) my warranty is voided. I said I have documentation of every oil change but was told that since none of them were done at Infiniti and cosmetic work was done else where it voids my warranty. I began to challenge him on that statement asking him if a brake change would void my warranty and with that logic they would in a sense have a monopoly forcing people to pay high prices to keep their warranty. He was so pissed off after that that he swore he would do everything in his power to get my warranty voided, that he would no longer work on my car, that I owe $900 dollars and if I don't pick It up by tomorrow I will be charged a storage fee every day. He's managed to follow through with his threats and I feel that they are being jerks and something needs to be done. I know this isn't a lemon law issue but every lawyer I talk to tells me that I definitely have something just nothing they specialize in and can't really direct me after that. I'm familiar with the Magnuson Moss Warranty Act and feel that they are in violation of these FTC guidelines. Please let me know what options I have both with and without a lawyer. They told me no amount of evidence or any laws will overturn their decision based on their policy and I know that can't be right. [link] [comments] |
Posted: 08 May 2018 08:10 AM PDT Hey ya'll. I think I got myself into a mess and need to know what's right and wrong. My car broke down about 47 days ago. I let it set for a couple days before I had it towed to a mechanic that I had been to before. He had me pay for labor right up front. He said he knew it was a computer and wiring problem and he could get it done in a few days. I was ok with this. After a week I call to check up on the car and he says he almost done and he was hoping to have it ready that evening or the following day. I call him the following day and he says he needs more time. Ok... I call him a couple days later he says it's almost done I'm hoping to have it done today. I call the following day he needs more time. All the while he is not being specific with me at all about what he needs "more time" for. These kind of conversations have been going on for over a month now and I got tired of this so I said I need to pick up my car and take it somewhere else. He said whatever you want and told me he had to put my car back together and I could come get it. This was a week ago now and he is saying he needs "MORE TIME TO PUT IT TOGETHER" after he told me it would take less than a day. Am I getting the run around here and what can I do?! Posted: 08 May 2018 09:06 AM PDT I walked into school yesterday and spilled some coffee in two classes (once I knocked it over with my foot, next a kid bumped into a desk) and today when I came in the principal yelled me out and threatened to report me to the police for ""vandalism"" unless I went and cleaned the entire school. I don't have a HUGE issue with it but I really don't have extra time at the end of the day to replace their janitor and I see this entire issue as ridiculous and taken entirely out of proportion. This has nothing to do with this particular event , but on numerous occasions teachers have rubbed their religious and political beliefs in our faces instead of teaching. They allow students to possess drugs and alcohol and don't do anything about it, and use profanity throughout the day. So I have two questions- is this even legal?
