She was lying. She was protecting her new "boyfriend" who is 24. She said so to her friend who told me then I told her parents. She then confessed to them. She was having sex with the guy when we were fooling around. I've blocked her number and the guy has been arrested.

Thank you for giving me good advice.

UPDATE: Kid in school playground across the street threw a rock through my window. Is the school liable? (Illinois)

    Posted: 29 May 2018 10:09 AM PDT

As an update to this thread for anyone interested or who finds themselves in a similar situation, the school ended up paying for all repairs to my vehicle. According to my insurance agent, the magic words are "custody, care, and control;" the school was acting as guardian of the boy, therefore it was fully liable for the damage he caused.

My daughters school kicked her out because they violated privacy protocol. How should we proceed

    Posted: 29 May 2018 06:59 AM PDT

Backstory - A few weeks ago my ex wife got into a minor bump up in the school parking lot. The woman claimed that her parked car rolled into her car. About a week later, the woman started harassing her, claiming that she was going to send a police officer into my daughters preschool classroom, she knew my daughters name, and she knew when she was leaving the school for the summer. We later found out that the front desk employee at the school provided this lady with all of that information about my child.

Since then, my ex called the school multiple times to find out what happened, which they ignored. Eventually she got a response after emailing the head of the academy who said that the employee was "talked to", but they don't believe she violated any protocols and that the family in question are good people and this was unlike them.

We had some concerns about they were handling it and asked what steps they were taking to ensure privacy as she will be going into their elementary school this year. They basically said they felt it was a closed manner and offered nothing else.

Today, we got an email refunding out enrollment fee and essentially kicking my daughter out of school for the upcoming year.

So now it's almost June and we have to find a new school for her at the last minute when other schools are full, all while knowing that private information about my child was given to a random person.

Do we have any footing here? The cost of getting her into a new school is going to be hard to come up with and the odds of getting her into one we would like her to go to is even more slim..

Personal property confiscated by employer - Wisconsin

    Posted: 29 May 2018 09:18 AM PDT

My mother works in a cube farm for an employer who is tight on security in that no writing utensils, paper, or phones are allowed at her desk. She suffers from several medical conditions, including severe, chronic asthma so she does carry an emergency inhaler and one of her pill prescriptions with her at all times. Today law enforcement is in her office to investigate as there appears that one of her coworkers had been stealing credit card info from customers, so her managers really cracked down and took away beverages, etc from people's desk. As part of this, they also took away my mother's medications and are refusing to give her access to them. She is terrified about not having access to her rescue medications as she has been hospitalized numerous times due to her asthma and has previously had 911 called for some of her attacks. Does this seem like a situation where she has any legal recourse?

[NH] Crazy neighbor's dog attacked and I had to kill him. Less worried about legal repercussions and more worried about neighbor killing ME. How illegal is it if I never tell him and he finds out?

    Posted: 29 May 2018 07:22 AM PDT

I live in a somewhat rural area, not a neighborhood. My neighbor has a tendency to let his pit/bully mix get out of control and the dog has tried to attack my collie on several occasions, so I always check to make sure he's not running loose outside before I take my dog on a walk. I have called the police and animal control on this dog before and their response has been less than satisfactory. Small town and all.

This time I guess I didn't check enough. Towards the end of our walk the dog comes barreling out of the woods at the edge of my property, between my line and where the government owns some land. I used my bear spray and it didn't even slow him down. He slammed into my dog and started tearing into him. I kicked and punched him but he was not letting go and my dog was getting killed, so I had no choice but to shoot him, it was clean, he didn't suffer. I felt horrible as it's not the dog's fault his owner is irresponsible, but there was nothing else I could do. I rushed my dog to the vet (he's going to be OK) and at the last minute lied and said he got in a tangle with coyotes so they wouldn't tie the attack to my neighbor's dog.

I buried the other dog, but I don't know what to do at this point. My neighbor is completely crazy, like "gun stockpile and shooting at people walking on the road by his property crazy," which is why he couldn't be reasoned with in the past when I've asked him to control his dog. I really don't want him to know what happened and am hoping he assumes a wild animal got him, but is it some kind of major crime if I don't say anything? I'm moving in a few months anyway, I want to send him a letter then to tell him for his own peace of mind but I don't know that he really cares.

Women threatening me for trespassing when I wasn't even tresspassing

    Posted: 29 May 2018 06:52 AM PDT

So my friends and I (17 M) usually hang out at a playground in my friends neighborhood. We do this a lot and have never had a problem with anybody there. One day we were hanging out at the playground and we find one of those pop sockets that go on phones. As there was no one else at the playground we assumed someone forgot about it so my friend put it on his phone (I'll explain where this comes into play later). 30 minutes later a women and her 5 year old daughter show up and ask if we had seen a pop socket resembling the one we found. We explain to her that my friend already put it on his phone and they are almost impossible to remove (you need like nail polish and glue remover and some other things of that source). We offered to pay her back for the cost of it or buy her a new one since we felt bad that we had taken this 5 year old girls toy. Instead of the mother accepting the offer, she goes to our cars that we have parked next to the playground (legally parked, I made sure of it), and gets on the phone with someone and starts reading off our license plate numbers to that person. I ask her why she is taking my license plate number and she tells me that I am trespassing, that she is on the neighborhood board and that it is private neighborhood. She ignores me as I tell her that I am the guest of a friend who lives in the neighborhood and continues to take the license plate numbers of my friends car.

Just to clear up some things this neighborhood is not a gated community, nor are there any signs stating that in some way that the land we were on was private property. Also, my friends and I do not do anything illegal (drugs and such) in this park or anywhere.

My father is a lawyer but not one who has experience in this sort of thing which is why I came here for advice. I dont know what to do if charges do come my way and if I'll be able to continue hanging out there with my friends.

Yesterday a 50 year old guy threatened to punch me in my face for no reason. I called the cops and they did nothing. Today he found me at the bus stop and began harassing me. I called the cops and they blamed me. Help?

    Posted: 29 May 2018 12:58 AM PDT

    Hi.

Im extremely hysterical right no so please bear with me.

I'm a 21 year old female. I'm not strong. I'm short and dainty. I try to keep to myself at all times.

I have autism and look weird so I get harassed a lot. But yesterday was terrible.

I was going about my day, and decided to hop on the bus and go to Walmart.

I got on the bus, and after like 3 or 4 stops this guy gets on.

He sits next to me and gives me a really dirty look.

    Whatever. I'm use to it.

Then he tried to talk to me.

    I ignored him.

He kept trying to talk to me.

    I kept ignoring him.

He kept trying and eventually I started laughing. Why is someone that gave me a dirty look trying to make small talk?

Then he looked at me straight in my eyes and yelled "hey! Do you want to get popped in the face"

I was shocked and scared. So i pulled out my phone and video taped him. The tape only went on for 11 seconds before I ran out of memory

The bus driver contacted police and eventually me and the guy got off together and waited for cops to show up.

Now here's the kicker. This gentleman is threatening to sue me for harassment. He was calling the cops telling them that I'm crazy and he never threatened me.

Eventually he left the bus stop , so there i was, crying hysterically, waiting for cops to show up.

5 hrs later, no cops show up. Eventually I went back to my apartment.

I called the cops again and they finally told me they're on their way.

Cops show up, they hear my story, i tell them I'm afraid for my safety... aaaand basically tell me there's nothing they can do and walk off.

    Fast forward to today.

I'm was trying to move on from this event and just live life.. So I went to the supermarket to pick up some stuff. On my way back to the bus stop, low and behold there he was

He was making his way towards me with a video camera, yelling things at me , telling me how he's suing me and stuff and I'm "dead".

So I freaked out. Called the cops. They finally showed up.

Basically the cops didn't care at all. I told them my story and what happened the day prior and they kept asking me questions like "why did I video record him" "what was i doing at the super market" "why did I ignore him on the bus?" "Why did I laugh??" Like tryin to find me at fault for anything they could...

After they talked to me they talked to him. He lied. Said he never threatened me. Said he was mentally ill and paranoid.

They came back over to me and told me that he was mentally ill. I said "I don't care, he threatened me".

The cops didn't like this. One cop even started BERATING me for not empathizing for this poor man.

And i get it. I feel bad for him. But my safety is on the line. Mentally ill or not he threatened to harm me and now is stalking me. I wanted something done before this guy harms Me.

But the cops are blaming me , this crazy guy is lying and threatening to sue me and I have no help at all.

    What do I do?

Wife received a subpoena to be a witness in trespassing case and she has no idea who the person is.

    Posted: 29 May 2018 06:10 AM PDT

    This is in Detroit, Michigan.

My wife received a subpoena to be a witness and she doesn't know the person on trial. This is for a trespassing case.

She has called the courthouse and they said she was named in the police report.

She also called the prosecuting attorney, but it has been almost a week and no returned call.

She received the subpoena last week and the date is set for this Thursday.

Is it common to be subpoenaed even though you have nothing to do with a case?

Is it possible they put in the wrong name in the records?

    What should she do?

Edit: Thanks everyone for the help. We are going to the courthouse and hopefully we will be there for only a short time.

Michigan Secretary of State Selling Driver/Vehicle Information to Third Parties

    Posted: 29 May 2018 09:13 AM PDT

    Hi /r/legaladvice,

As the title says, I'm inquiring on the legality of the Michigan Secretary of State selling bulk Driver/Vehicle Information to Third Party Companies. Primarily this is in regards to an opt out clause which doesn't seem to be available. More on this in a minute.

Background: I work in car sales, and recently purchased a vehicle of my own. I started receive mail (Presorted Standard, Never first class) indicated that my "warranty was about to expire" and that I'd be liable for "Tens of thousands of dollars in repairs" should something go wrong. Well, being that I work in car sales and I know what I'm doing, I purchased and extended warranty on my pre-owned vehicle that will last me another 6 years/75000 miles after the factory warranty which still is active. The mail is obviously spam and to those less informed, it seems legitimate unless you really look into it. It seems they're just trying to scare you into buying a warranty from their company or whatever.

The reason I'm seeking information on this is that several of my previous customers have come to me asking about it, thinking that the dealer is at fault here, but my dealership doesn't give out or sell information about our customers. That leads me to believe it's the secretary of state based on several conversations about it with other staff members.

I'm concerned that what they're doing is a violation of privacy, selling information to Third Party companies that are using this information to solicit business. I'm also concerned that there's no method available to my knowledge to opt out of this, and as such my personal information has been sold without my consent, and it's obviously happened to others. While I'm not the most private person, I absolutely do not consent to companies that I don't do business with having my personal information. Frankly, this just seems wrong what the SOS is doing.

So with that in mind, I have a couple questions:

    • If it is the secretary of state, is what they're doing legal?

    • Is there a method to opt out of having my information sold to other companies, and if there isn't, should there legally be one?

    • Is a class-action lawsuit a reasonable thought here on the grounds that many people have had their privacy violated without their knowledge/consent? (If so, who should I speak to, is there something already ongoing, etc)

Thanks in advance for your advice! Feel free to ask me any questions you need for more details about this. I'm at work today so I'll try to respond as quickly as I can.

Im 99% sure my Neighbor killed a tree in my yard, He claims lightning struck it.

    Posted: 29 May 2018 09:00 AM PDT

For starters, I live in Forida.

Ill keep this as short as possible.

So there is a rather large oak tree in my backyard near my fence, and it is slightly leaning towards my neighbors yard, And a small portion of it overhangs into my neighbors yard and over his shed.

About 2 months ago a nasty storm hit my area and a rather large tree branch broke off the tree and damaged part of his sheds roof. With me and said neighbor having a normal friendly relationship like all neighbors should, I appologised profusely and offered to completely rebuild the roof of his shed any time he wants, out of my pocket.

He agreed and i rebuilt it with supplies i paid for out of my pocket (Roughly $400) and when the job was done he inspected it and we both came to an agreement that i did a satisfactory job and that was settled.

Fast forward a few days, He stops by and tells me hes worried that with rainy season coming up (Lots of storms where i live in FL) that he would like if i got the tree branches overhanging into his yard trimmed/cut down.

I happily agreed and told him that i would try to get someone out here to trim it by the end of the month. When i told him that, He seemed slightly agitated but he said that would be fine. He called me several days after that and asked if was going to get someone out here to trim it soon, i assured him and told him that i would as soon as possible and that the only reason i couldnt at the time was because i couldn't afford to.

Fast forward about 2 weeks, I notice that all the leaves on the tree are brown and dying, and some of the grass around it is dead. The tree is clearly dying. I confronted my neighbor about this and he immediately denied it and says that lightning likely struck it and thats why its dying. It was very obvious he was lying about it.

Thing is, i dont see any signs of lightning striking it and there wasnt any bad storms since then. Not only that, its just verrrrryy coincidental that the tree starts dying out of nowhere after this whole situation.

I know its just a tree but i'm very upset and don't even know where to start. This tree has been here forever and just knowing that my neighbor is likely behind this and would even do something like that makes me uncomftorable. I don't even understand where all this is coming from i thought me and him had a good relationship but apparently not.

    Any advice?

    Cops Came To My Door

    Posted: 29 May 2018 09:08 AM PDT

Michigan. I am Mom to an 18 year old male. I live in county A, state trooper is from county D, which is two counties away. I came home from work and found a card from cop, asking kid to call him. Kid is out west with friends for the summer. Kid calls cop. Cop says they must speak in person, but it's fine to wait until August.

I tell kid not to talk to cop under any circumstances.

I talk to a lawyer, and quotes me a price I can't afford. My questions are - at this point do we need a lawyer, or should kid just refuse to speak with cop and see what happens?

Also, is there any way to search court documents, police reports and such to try to determine what department Officer Friendly is with and what type of crime he investigates?

Employer is taking money from my checks without my consent for a mistake I didn't make alone. [PA].

    Posted: 29 May 2018 06:27 AM PDT

I work at a place that sells higher end prescription sunglasses . A few weeks ago I sent out a order to an address our store had on file. A few days later the customer calls asking if we ever shipped his order and i tell him that they were shipped to x address he explains how he moved and that isn't his address. So my boss orders a replacement and we ship them out to the other (secondary address on file). My boss is extremely passive aggressive and has started taking money out of my checks without my consent. I dont know what to do about this but it feels wrong.

Kansas. My sons father hasn’t seen him or communicated with me for 12 years. Now says he wants to be in his life.

    Posted: 29 May 2018 04:28 AM PDT

It's about that simple. We dated when I was in college. I got pregnant he had no interest in being a dad while I had no interest in an abortion. We went out separate ways. He married and had a life. I had my kids to myself.

In the last few years I've been in communication with his mother and aunt. They live in anoystate but will come to our area and I'll bring my son to meet them. Usually at a park or lake. The last time this happened she told me that my sons father wants to be in his life and I gave her permission to give him my contact information.

So. I've got this 13 year old who may or may not be meeting his biological dad soon. How do I protect us legally ? I don't want to prevent them having a relationship but I feel like I need to make sure things can't go sideways.

Someone with my same name and birth date is ruining my life

    Posted: 29 May 2018 08:03 AM PDT

A little back story... I live in Northern Florida and have a very common name (with no middle name). Back in 2011 I tried to get my drivers license once I became of age, but was turned down by the DMV since "I've been pulled over and received a ticket for driving without my license". I was shocked because, i had my permit and drove with my parents.. Never pulled over at all. I later found out this ticket was given in Miami, FL. A place I've never been to.... Someone with my same name and birth date, who didn't have a license ended up being tagged as me. I ended up getting it resolved after fingerprinting, months of calls to the DMV, etc... But now it is coming back again. I went to renew my registration on my tag and found out my license has been suspended since February because i "failed to appear to a court date in Miami"!! I guess this same guy is still causing trouble. I never even received a letter from the DMV about this! I'm unable to drive, and I keep getting the run around. I may even lose my job over this because I'm unable to make it to work and Uber is crazy expensive for a 2 hour combined commute daily. Someone please help me!!!

Friend sent me a Cease and Desist for an app.

    Posted: 29 May 2018 01:09 AM PDT

A friend of mine recently sent me a Cease & Decist letter claiming that I stole his app idea. He claims that he told me about this idea, but I don't have any recollection of it. He also expects me to pay for damages done. On speaking to him, he said it's fine if I do it for educational purposes. He does not currently have an app and I'm on the verge of publishing. I don't know how to respond to this. I have worked for days on this app and have not found any patents of it. Please help as to what steps I should take.

Edit :- The app was made in Seattle where I am a student.

Upstairs neighbor poured bleach water over her balcony, onto our grill and it splashed me in the face.

    Posted: 29 May 2018 12:38 PM PDT

Yesterday, we were setting up to do a BBQ with our neighbors and I had lit our grill, which is at the edge of our patio. We live in an apartment complex and have previously complained to management about our upstairs neighbor dumping cleaning solutions over the balcony (a bucket full, maybe after they had mopped?). It had previously landed all over our plants (i.e. herbs we would've eaten) and we had filed a complaint. The office said they would contact the neighbor to let them know they could not do that. Yesterday, 2 other couples we were going to bbq with were over - I went to check on the coals and another bucket full of water - this time with bleach - came pouring down directly into the grill and splashed up on my face & into my left eye. I immediately flushed my eye thoroughly. I then told my wife I was calling the leasing office to let them know I'd be calling the police. They made a record of the incident and called the upstairs neighbor as well. I then called the police, who suggested EMT's should come as well to check me out. Ambulance got there first, did all the basics checking me out, asking questions etc. Eventually asked if I wanted to go to the hospital, to which I replied I'd rather not (I could see fine and my eye / skin was only slightly irritated). I think I was sort of in shock at the whole situation. So I had to sign a refusal to treat. They specifically said this doesn't mean that if anything changes you can't call back etc. Then I spoke to the police, who took my statement, spoke with the neighbor and left after feeling there was no criminal intent. She had said to the police that there were ants on the patio and she was simply trying to kill them, which is a blatant lie- 3 neighbors actually saw her dump the whole bucket over the ledge. I have the incident # from the police.

Today, my eye is now really bothering me and I will be getting it checked out. But my question is, do I pursue this civilly? I've never been in a position where I felt I needed to pursue legal action before. I just feel the whole thing is insane and there should be some recourse.

Boss informed me she would be dropping my pay $2.50 because another manager didn't drop it $1 when I gave back my key a couple months ago.

    Posted: 29 May 2018 08:35 AM PDT

I work in San Diego county of California. I was a keyholder for retail at $15.50 and I needed more hours so I got a full time job elsewhere. I tried to give the key back and get a demotion because I couldn't fulfill my duties working so few hours but my GM said no so I put in my two weeks. She said please don't quit we need you. Whatever, I didn't quit and kept the key. She goes on vacation and we get another temp GM. He said I've been treated unfairly for a long time and so he requested a key removal/pay decrease for me of $1 so I can get demoted. I loved this. So I gave him back the key.

Yesterday my boss called me while she was home and while I was working at the retail store to inform me that she would be dropping my pay $2.50 because the other GM never submitted my $1 pay decrease when I gave back my key. I said I wasn't okay with $13 because that's not what I had been told and I would be going to HR about it because its not my fault (plus I don't yet know the law about that yet). She immediately said "okay I'll cancel the pay decrease request and I'll talk to my boss (district manager) and HR about it Tuesday." She also said that the temp GM is no longer with the company.

I guess my question is what should I do? Should I call HR today? Should I research the laws in California regarding the pay decrease? I just don't want to get fired over something that isn't my fault. Plus I dont work that many hours anymore bc I have a 40 hr job and the retail job is my side income.

Does a car dealership have to tell you if your car is a flood car?

    Posted: 29 May 2018 09:14 AM PDT

My niece bought a car from a dealership nearby (in North Carolina) and within two weeks of buying the rotors messed up. They took it to a mechanic and he fixed the rotors. He also found that they stuffed insulation in holes and spray painted it to cover it up. Went back to the dealership and they won't let me speak to the owner. They say he isn't there but they waited and watched and saw him sneak out the back door. They want to take them to small claims court but they need to know if dealerships are required to tell you if a car is a flood car.

(WI) Employees who are minors spray painted penises and swastikas on our property. Can we ask them to clean the area up on their own time or should we allow them to clock in?

    Posted: 29 May 2018 11:48 AM PDT

So my dad owns a small restaurant and we don't have an HR department or anything so we're kind on our own for (small) legal stuff. During work, a few high school kids spray painted some things on our basement walls. We agreed not to terminate them but asked if they could try clean it up. One of their parents called and asked if we are paying them for their work and if it's even allowed that we ask them to clean it up. Eta: I talked to my dad and were going to the police to press charges and work with them to sort this out. The kids will most likely be terminated as well.

    Not allowed to speak Spanish

    Posted: 29 May 2018 10:49 AM PDT

VA- posting for my mom since she doesn't have Reddit. She works at a retail store where one of the employees speaks little English. She was speaking to the employee in Spanish to tell her what to do since her English is not good and sometimes it difficult for her to understand. An employee got offended by this and told management. Management told her not to speak Spanish anymore and told the other employee (who speaks little English) not to speak Spanish as well. My mom asked management if it was okay to speak Spanish to her customers since some of them don't speak English and she was told as long as there is not employees around. What are the ramifications of her continuing to speak Spanish? And what should she do if she gets fired for speaking Spanish?

I went to New Jersey and left my now ex-boyfriend with my car to get my windshield fixed because he had thrown his phone at the windshield and broke it.

While I was gone, he drove to his friend's house and picked him up to go to the bar (without my permission). On the way there they crashed into a telephone pole. His friends kicked out the front windshield and ran away, he was left in the car. The police came and he blew 0.22 in a breathalyzer, so he was arrested that night.

My car was towed to the local Police Station, completely totaled, and all of my pottery inside it was shattered (at least $100 dollars worth). While at the station, my car racked up impound fees. I mailed a letter to my dad giving him ownership of my car (expedited shipping for letter was $45), and good ole dad negotiated that the station could keep the car and we only had to pay $500 in impound fees. Meanwhile, DTE comes after me for $10K for the electric pole my ex crashed into.

My insurance takes care of DTE, but is now too expensive for me to afford another car. So the total damages is $4500(what I payed for car) + $100(pottery) + $45(letter) + $500(impound fees) + escalating insurance = $5145+ Ex boyfriend refuses to pay anything in damages. What options do I have to get him to help with the costs?

Tl;Dr: Now ex-boyfriend used my car while I was out of state to pick up his friend and go to a bar (without permission), drove drunk, crashed into a telephone pole, his friend kicked out my windshield, the car is totaled, and it all ended up costing of 15k in damages, none of which the ex will help with.

The landlord to my business died, and now two separate people are saying if i don’t pay our rent to them we will be evicted.

I own a small yoga studio in North Carolina. I signed a lease with an LLC listed as my landlord, I've always dealt with a husband and wife when i needed anything. I paid them by dropping my check off to their other business monthly. The wife died a few weeks ago. A different man has shown up with a letter from his lawyer saying that he has rights to the LLC and that I will be "held responsible" if he does not receive my rent checks to this new address. The husband (which is who I've always called and dealt with, even more so than the wife) called and said that if i don't continue to pay him, I will be "held responsible". They both used the word evicted as well. This puts me in a really tricky spot, as I have no idea who I should be paying, and rent is due this week. The new guy claims the husband has no claim to the LLC and that he and the wife had formed it without the husband. The husband claims this man is crazy and nothing to do with anything. I looked up the LLC on the North Carolina Secretary of State, and only the wife is listed. My gut tells me to contact a lawyer before handing a check to anyone, but I'm not even sure what kind of lawyer to call, and i don't already have one. I did ask why it mattered who i gave the check to, as long as i wrote it to the LLC, (which is what i always do) that way, only someone who has been given the ability to cash checks with the LLC can cash it. They both claim the other is "shady" and will figure out how to cash it anyways, and it will fall back on me. Please help me figure out what my next steps should be, as i don't want my business to be caught in the middle of this mess.

Thank you for your help! I haven't posted here before, so i apologize if i left out anything.
