    Throwaway Account for obvious reasons

Quick background: I work in IT Security, but have a few side jobs that I do for fun/extra money. One of those side jobs is repairing laptop computers, tablets, cell phones, etc. I also do custom PC builds for people as well.

So, the way I network is through word of mouth, and business cards. Long story short, a guy at my kickboxing academy approached me and asked if I could fix his laptop. He told me he was having performance issues, and complained that his PC freezes and blue screens with no warning.

I go through the normal routine, and have him sign a contract agreeing to pay me for my services, as well as granting me full control over the device while I carry out repairs, etc.

He agreed, and asked that if the computer can't be fixed, at least recover his files to the best of my ability and place them on an external drive for safe keeping.

Now, I have a big disclaimer that I have the person sign off on that literally reads as follows: "I will respect the privacy of your data, however I will look into any area that the problems you're having may lead me to. That being said is there anything on the computer that you would not want me to see?" if the user says yes, I tell them to clean up the computer and bring it back when its safe for me to look at. I'm not interested in looking at naked pictures of the guy or his wife, for example. This guy said no, and signed off on the disclaimer.

long story short, the laptop was an older model but I was able to get everything up and running again. However, this is where the story gets messed up.

After running a quick virus scan on the machine, I notice over 100 malicious items being found. 80ish of which were located in ONE FOLDER. So, I crack open the folder to take a look, as a lot of people download malicious software without really knowing what they're getting into.

Well, I found an entire series of photos and videos on the computer. I clicked one (stupidly) and saw a young girl (pre-adolescent) engaged in sexual activity with an adult. The others had similar file names, and were clearly pornographic videos and photos from what little I could see in the thumbnail. Honestly, I've never felt more sick to my stomach than I did last night when I saw that picture.

My mind is a mess right now. I couldn't sleep last night and I'm not really sure what to do. I took screen shots of the file system to prove that they were last modified/viewed BEFORE I received the computer as to not implicate myself in any way.

How in the Hell am I supposed to report this?

    PS: I live in Indiana

[UPDATE] Filed worker misclassifcation against my former employer

    Posted: 03 May 2018 12:53 AM PDT

I posted here 9 months ago asking for advice on this topic and I wanted to provide a requested update.

I was unable to bring any legal action against the company for unlawful termination because I live in Texas and it is a Right to Work state. Essentially every lawyer I talked to explained that as an employee I have no recourse due to the fact that I could be terminated at any time for any reason and that includes pointing out that the company was misclassifying it's employees.

However I did file an 8919 and SS-8 against them and the IRS sided with me, which forced them to reclassify all of their contractors as employees and provide amended W2s for the duration of their misclassification.

Now all of the people that work at the company are employees with all of the rights that come along with that.

I do business as "first name+last name photography." Someone else trademarked my legal name as their business. Am I in any trouble? (California)

    Posted: 03 May 2018 06:13 AM PDT

It's recently come to my attention that a photographer on the east coast trademarked my legal name in his business as "(first name) (last name) Photography." I've used this same moniker for my photo business through social media and my website for 5+ years. He has not contacted me, but I'm afraid of legal repercussions in the future.

I was, perhaps incorrectly, under the assumption that using my legal name was the simplest and easiest way to avoid this sort of thing and that I would be legally safe.

    I appreciate any insight.

    Thanks!

UPDATE-[GA] Do I Owe an Early Termination Fee On My Lease?

    Posted: 03 May 2018 06:09 AM PDT

    Link to the original post

My post didn't get much attention, but I thought I'd update anyway. The details are in the link above, but the TL;DR is that my roommate and I are breaking our lease early. We were told by the apartment leasing agent there was no early termination fee, but later the property manager told me by email there is. The lease is sort of ambiguous.

I ended up asking my friend who is a prosecutor for a favor and had him take a look. He hasn't done any property law, but from what he remembered from school, he said they're probably scamming us and to tell them to fuck off. He helped me write the following email:

"Thanks Manager, I appreciate your help. I dropped off my rent check for May today.

Regarding the termination fee, no termination fee was ever specified when we signed the lease and that portion of the lease was left blank. Your leasing agent specifically told us there would be no termination fee when we discussed the option to terminate with him in February, so we factored that into our decision to terminate when we did. We provided 60 days notice of our intent to terminate the lease, which is twice as much time as Georgia law requires. Furthermore, I have checked online and our unit is not listed as available meaning that either your office has found another tenant or you are not actively seeking to find one. As such, there is no basis for the early termination fee, and we dispute that charge in it's entirety.

We've enjoyed living here and wish you the best. Please let me know if you have any questions."

I actually grew to hate living there, so that was actually a lie, but my friend said to say some nice things and have some tact before playing hardball. There was actually a police drug raid yesterday.

Anyway, we got the following response:

"Upon reviewing your lease, there is no termination fee listed, so we are unable to charge it. A 60-day notice will suffice. There will be not additional fees to your account outside of apartment damages (if any)."

So we got some good news! We got to move out early with no penalty. We've already moved to the new apartment building across the street. They offered two free months rent so we're making out like bandits. The few comments I got on the original post sounded like I was SOL. I'm glad I didn't listen to them.

    Thanks for reading!

UPDATE: Okay, I reported my CP creating and distributing ex to the cops.

    Posted: 03 May 2018 11:51 AM PDT

    Original MI

Took the day of school and went to the police station to report my terrible ex. Our station has 8 investigators so I asked to speak with one who specializes in sex crimes and they directed me to him. I bought my phone with me and my mom also brought hers. She wiped the conversation where my ex sent her the video but she brought it in case. I told the investigator about how we broke up recently and in anger, she sent a private video to my mom and possibly more people. I told him that prior to this, I was not aware at all of this video being made.

Investigator was pretty cool about it. He said he would investigate what happened and would try to get a warrant to search through her devices. The detective also requested me to send a picture of the conversation of her admitting to the crime and I did (did not send anything explicit though).

So now, I guess I wait for things to happen. Seems like its out of my hands no, haha. Hopefully she gets put on the sex offenders list for life and loses her phone.

[FL] Due Diligence searches have law enforcement showing up at my door on a regular basis.

    Posted: 03 May 2018 05:38 AM PDT

I moved into my apartment in July of 2017. I work for social service investigations for the state of Florida. I was given a case in December that ended up going to court. During the case I noticed that one of the clients children used to reside in my very same apartment. I brought it up to my supervisors who advised it was not a problem and kept me on the case. Long story short, the client fled the county and now is being searched for by Law Enforcment. The client placed my address as her home on all legal documents. I get her IRS diligent search, her creditors diligent search and Law enforcement diligent search. I went to the post office to inform them the client no longer lives at the address and the mail stopped however Law Enforcement has not stopped coming around looking for her. Two questions?

Am I in legal hot water for taking the case to courtbeing that I reside in the same apartment she sends her mail to? To my knowledge the client has no idea I live here.

Is there a way to inform law enforcement that the mother no longer lives here to stop them from coming here?

Florida. My mother gave my brother a 3 day notice for an eviction, dated two days ago, that stated he needs to come up with the money by today.

    Posted: 03 May 2018 09:00 AM PDT

My brother woke up to a "3 day notice" from my mother today, May 3rd. She just gave it to him today, however it's dated May 1st.

He called the court house and they told him too bad and he needs to talk to her.

Can she legally hold onto a 3 day notice demanding payment until the "due date"?

That seems a bit unfair and the court house isn't being helpful.

Edit: He's already paid his portion of rent. We have no idea where she's getting $55 from.

UPDATE: Positive drug test im hospital (PA)

    Posted: 02 May 2018 05:46 PM PDT

    Link to original: https://www.reddit.com/r/legaladvice/comments/8ez9k1/positive_drug_test_in_hospital_pa

I received some helpful and kind responses to my post so I just wanted to give a quick update. After being told repeatedly that even with a negative cord blood test, the baby would have to stay an extra 2 days in the hospital for monitoring for withdrawal symptoms, on Friday the hospital staff and pediatrician came to my room to give me the news that the cord test came back negative for EVERYTHING. The pediatrician happily told me that she was making the call that the baby and I could go home later that day, and that she was calling off the additional days.

I did still have to do the follow-up drug test and home visit with CYS, which was a little humiliating because the test was done at a halfway house and I had to have a lady watch me pee into a cup, but it came up negative as expected and even the social worker called the entire thing an unfortunate fluke. The best part was that there was no further mention of testing my husband, which was really my only concern since I knew I hadn't taken anything and don't use drugs, but that he smoked pot a couple weeks ago.

The baby is thriving and home with us, and is a week old as of yesterday :-) I saved the closing drug test confirmation for his baby book... it will be a funny story someday. Just not quite yet! :-)

Update on the daughter's abortion and divorce decree requiring ex-wife's consent. We didn't need it.

    Posted: 03 May 2018 12:27 PM PDT

    Here's the old post.

I spoke with a lawyer and it turns out the way the decree was worded, we didn't end up needing my ex-wife's consent at all. The decree says I couldn't sign any medical consent form without my ex-wife's consent. So taking my daughter to get an abortion where my signature isn't necessary wouldn't violate the decree.

She's got the abortion, it's over and hopefully ex-wife will never know.

NC: Cows from (LEASED) neighboring property continue to trespass on our land, tearing up road banks, destroying culverts and... possibly killing a dog.

    Posted: 02 May 2018 08:14 PM PDT

Sorry, long post. But the narrative is sort of necessary.

So we own approximately 40-some acres in north-eastern North Carolina, we've owned it for over 33 years. For the last... 5 or so years, the property has been dormant and our presence has been limited to us checking in on it every 6 months or so.

But prior to our 5-year break, and for the last year, my family has slowly been engineering a road up to the top of the property: plotting paths along topographical maps for roads, blasting rock, filling in dips and coves, establishing banks, laying down culverts and establishing/graveling a road. We refer to it as the Garden of Eden, and it truly is. And we've spent a LOT of money on this road.

Our focus returned to the property last spring and we have resumed plans to complete the final 100 yards or so to the tip top of the property, so that we can start building homes/cabins for each owner (myself, my father, my sister). My father resumed living there full time.

When he resumed residence, he found that the cows from a neighboring 400-acre parcel were regularly trespassing onto our land. Our best estimation is that the last time fencing was established between our boundaries was in the 1920's. It's safe to say that the barbed wire strand separating our parcels has long since eroded (we've walked almost all it). He has regularly chased herds of cattle off our land that cross over looking for greener grass. They frequently establish paths up the banks of the roads that we worked so hard to build, blocking culverts and washing away gravel, destroying random property on our land and also knocking the side mirror off one of our cars.

My father spent a significant (majority) amount of his time last summer chasing cattle off our land, calling the local Sheriff, and eventually attempting to push them down the road so that the DOT and/or neighboring properties would also have to deal with it. No one really seems to bothered by this other than us.

The turning point was when his constant companion, best friend, a German Shepherd, and ultimate "heckin goodest boy " died suddenly. "Heckin Good Boy" had watched my Dad chase cows off the property and took it upon himself to help after a time. We can't confirm what happened while we couldn't see him, he was otherwise healthy, but the night he died, he was half covered in cow poo and threw up blood; he was probably kicked. "Goodest boy" was promptly buried up by our special spot, a spring bubbling out between 2 old trees that was located WELL into the middle of our acreage (that was ironically full of cow shit at the time). We already know that the cause of his death is conjecture at best and we don't plan on pursuing anything related to THAT.

BUT the property next to us is owned by one party, but LEASED to another for grazing their cattle. I've spent a lot of time researching fencing laws in North Carolina and it looks like it's in our favor, but my knowledge of legalese is somewhat limited. My father is talking about spending $10-20,000 to fence off OUR property now that he has a new puppy and doesn't want it to also die, but I don't feel like it's OUR responsibility to keep grazing herds off OUR property.

Sorry for the long post, but can anyone share their knowledge?

[KY] - Bathroom Contractor suddenly abandoned job, left with materials that we purchased

    Posted: 03 May 2018 07:16 AM PDT

I hired a guy to completely remodel a bathroom in my house. He continually assured me that we were on course to meet our deadline of last weekend (I had AirBNB guests staying for the weekend, so it needed to be done). He worked on it for about 4 weeks, and I gradually became more and more concerned that the project wouldn't get done. We had worked with him before on smaller projects around the house, and have never had issues with him.

So 2 days ago he came to work on the bathroom while my wife and I were at work - as he had done many days before. When I got home, all of his tools and plastic covering to protect the carpet were gone, and he had removed all of his tool and materials from our garage as well. Furthermore, he had also taken our vanity, vanity sink, all of our faucets and fixtures, our vanity mirror, our new toilet and all of the tile left to finish the job. All gone, all paid for by myself and my wife. I tried to call and text him but he screened all of our calls and messages, and we haven't heard from him since. We had already paid him more about 75% of our total agreed upon price. Our Airbnb guests had to cancel, as they were counting on having that bathroom to use during their stay, so that income was also affected.

The trickiest/sneakiest thing he did, was he also took our only copy of the estimate and contract for the job. It was tucked in a planner/calendar book that was laying on our kitchen counter, and he searched through the book and pulled out all of the information we had for the job and all of the receipts for the stuff that we purchased. He didn't take any of our other belongings, just the stuff related to the bathroom remodel. Interestingly, he left behind a shower door ( I think he didn't have room for it in his truck) and the light fixture that we were planning to use (the only item that he didn't have the receipt for).

We filed a police report and are waiting to hear back from a detective about it, but we have lost a lot in this process and don't really know where else to go from here. I am concerned that since he took the contract (I know, I should have made copies) that we will have little to no tangible evidence to prove that all of those items belong to us, and that he didn't complete his end of the agreement even though he has already been paid for the job. I do have texts of us talking about the job, and pictures and video of him working in my house. I also have witnesses who can attest to him working there over the past few weeks.

Sorry for the long winded post. If anyone can provide any advice on what we should do, I would truly and deeply appreciate it. Feeling pretty lost right now, it's a huge setback. Thank you

How to file Adverse Possession in MO

    Posted: 03 May 2018 08:24 AM PDT

    Sorry for long.

So in 2008 I lost my job lost my apartment and quickly lost my savings. After a couple months living in my car I decided the summer heat was too much and started sleeping/hanging out in one of the many many abandoned houses in my city. I've been here since and while I always heard others talk about squatters rights I never looked into it until recently and found out in MO that it only takes 10 years. I hit that mark in about 2 months assuming the cops don't kick me out before then and was wondering about how to file a claim for the title, as I've come to view this place as home. Plus its saved me a lot of money living here that I've been able to pay off all my collections, medical bills and other loans which I never thought I could do. I tried googling laws, but I can barely understand half the words they use on Nolo and Findlaw etc.

Would I qualify for adverse possession? The law says 10 years "open possession". The first 6-9 months I stayed stealth, only went in and out the back door, parked my car down the street, never had any light sources at night etc. But since then I've acted like it was mine. I mow the lawn, replaced appliances and stuff inside, built a new staircase to the front door, go to neighborhood barbecues and park in the driveway. I never hooked up utilities as I didn't want to flag the possible owners or authorities, but otherwise it should be obvious someone is living there.

How do I prove how long I've been there? I have photos of myself and friends hanging out in the yard or in the house from years ago, is that proof enough?

Am I opening myself up to criminal charges? I've changed locks, torn out old broken appliances, forged documents so I could get mail there etc. I don't want to risk getting arrested and losing my job and having to start over again.

How expensive or lengthy of a process would it actually be? The house was probably only worth 10k or 20k when I moved in and even with the work I've done can't be worth more than 40k now based on looking at Zillow. Would the corporation that owns it bother fighting for such a cheap piece of property?

    Thanks all.

I'm an Apprentice Dev being sold as a Senior Dev by my company.

    Posted: 03 May 2018 09:45 AM PDT

Hi guys, I just wanted more information on this because I can't really seem to find anything on google because it keeps coming up with Job ads every time I try to search for something relevant.

I work as an Apprentice Software Tester in the UK and my company essentially sells me out to other companies to do their work under the title Senior Tester. I'm definitely not qualified for this position but that is besides the point.

I earn £750 a month whereas my boss keeps bragging about how people charge £300 a day for me. At one point I was pretending to be two testers on 1 project and the customer was being charged £550 a day for 2 resources.

Just a little note that my contract also implies that my role is "Software Developer Apprentice", not a tester.

Is this not at all illegal? I mean sure it might be smart business practice but I just want more information.

Edit 1: Forgot to add thanks for reading! If you have any questions I'll respond as accurately as I can without giving too much identifiable info.

[TN] Woman wants a refund on a sectional sold on the Facebook marketplace

    Posted: 03 May 2018 06:43 AM PDT

I recently sold a sectional on the Facebook marketplace. In the description I wrote, "Bernhardt sectional in excellent condition and comes with two matching pillows. Cash only." After texting back and forth, she asked if I would drop the price from $400 to $300 because it was for a family in need. I agreed and then proceeded.

She asked how old the sectional was and I said approximately 10 years old, which I was basing off of how long we had owned it. On the day of selling she decided not to come in person to pay, but to have her delivery guy (an acquaintance of hers) bring the money. About an hour later, she texted me demanding a refund claiming the sofa was not in "excellent" condition, as there was cat hair and a strange odor. Plus she claimed it was not from a smoke free and pet free environment. At no point did I say it was either, but it was smoke free. We do have a cat, which she is claiming fur is embedded in the couch.

Now she is threatening to take me to small claims court. Does she have a legitimate case? This was purchased sight unseen, and I consider it to be in excellent condition.

    Apartment has no water

    Posted: 03 May 2018 06:20 AM PDT

California. Some time ago, our large, "professionally" managed apartment complex was without water service for multiple days consecutively. The property manager at the time handled the situation incredibly poorly, was literally screaming at everyone (both residents and repair people) and would not give any information as to when the repairs would be complete. We eventually had to go stay in a hotel, at our own expense, because an apartment with no running water is uninhabitable (as a practical matter, if not a legal one) for reasons I would hope would be obvious. And we had no idea how long it would last. When it was finally over we just got a letter from the property manager with an apology and nothing else.

Now we again have no running water. Our lease is up soon anyway so my concern isn't about getting out of it. It's more about the expense I will incur again if this goes on for multiple days. On top of paying rent as normal (I have already paid for this month). It doesn't seem fair. What are my rights?

[Connecticut] Asshole neighbor is complaining about the fire pit in my backyard

    Posted: 03 May 2018 12:19 AM PDT

He's an asshole for a multitude of different reasons but I'll stick to this one. Yesterday morning at 3 am I lit a small fire in my backyard inside of my fire pit. I used twigs, not branches but twigs as kindling to unwind from a long day, and the flames were no higher than 8 inches. I would consider it a small fire. 10 minutes later my neighbor comes down my driveway into my backyard absolutely belligerent about it being 3 in the morning and I'm lighting a fire in my backyard and the smoke is blowing into his windows. He told me he would be contacting the fire department and the owner of my house (sober living situation), and stormed off back down my driveway cursing me out. I was nothing but respectful throughout the whole interaction and immediately put out the fire after he left, and went inside. My question is, can I light fires in the fire pit whenever I want, seeing as it is technically my property?

(MA) Health insurance company refusing to process claim because I have supplemental insurance

    Posted: 03 May 2018 05:34 AM PDT

My husband's employer (a hospital) gives him fully paid health insurance for which I am a dependent. I use that one as my primary insurance because I can go to his hospital for all my care and have no copays.

My employer also covers all health insurance premiums (so I'm the subscriber) and I use that only when I need to see a doctor outside my husband's hospital, i.e. just for specialists and for my daughter's pediatrician. It has high copays and a deductible so I don't like using it.

My husband's insurer is now refusing to pay claims on my visits to his hospital because it says that my visits need to be processed through the insurance on which I am the subscriber. When we initially signed up, we were told that this would not be an issue and I could just use my insurance as a supplemental.

The insurance company could not cite a written policy on which they were relying and would only tell me that it was based on federal law. They could not point me to a specific statute or regulation. They said that because they were a self-funded plan, they had to comply with this (unknown) law.

Can anyone offer insight about this? I will cancel my employer's health insurance plan if I have to (though they said they would have to go back and adjust all my past claims) but I'm about to have a baby and would have to pay thousands if it gets processed through my employer's insurance. Help!

Contracted Hep-C from hospital nurse while In care

    Posted: 02 May 2018 04:38 PM PDT

About 8 months ago my lung collapsed and I was sent to my local hospital.

About a week ago I get a letter in the mail saying how I might have contracted Hep-C from a nurse who was using patients needles to shoot up medication in the bathrooms. She was working during the time I was in care for my lung.

Yesterday I got my blood tested to see if I contracted it and my results were positive.

I left a lot of details out because I feel this post might not get seen due to Hep-C being treatable. But I'm still really concerned about this just "going under the bridge" it's scary to me that I can go to a hospital for something and leave with a virus. Like what if it was HIV?

[CA] Ex fiancee kept engagement ring and is ignoring me

    Posted: 03 May 2018 07:27 AM PDT

My ex fiancee and I split up almost a year ago, and she's since been holding onto the engagement ring. Now if I didn't spend so much damn money on it, I would have just let it go by now, but I was foolish and spend half of my savings on it. That, plus the cost of rent that I now pay alone since she left puts me in a not ideal place financially. What can I do? If I contact a local attorney how do I present the issue, and an I entitled to getting the ring back? Sorry, I'm young ish and never taken any kind of legal action and I'm lost. She's totally ignoring me and recently began to block contact with me in various ways.

If it matters, our relationship ended basically because we had a lot of changes going on to try and resolve relationship issues towards the end and she gave me an ultimatum, to cut off contact with a person completely or we're done. I chose to keep contact and told my ex fiancee I would remain distant friends with the person. She didn't accept this and so she left that day then eventually took all of her things and moved out a couple weeks after.

    Edit:

Maybe this is a stupid idea, but I have her parents' contact info. I could try reaching out to them before an attorney, or should I just go directly to an attorney?

    Original post: https://www.reddit.com/r/legaladvice/comments/8bp7o9/judge_gives_time_to_pay_after_eviction_is_filed/

So as mentioned, the judge made a decision on our case and we have been making the payments according to the schedule. We had our mail forwarded to a P.O. box in preparation for moving the first time, and checked the mail today to find another eviction notice issued from Thursday, April 26th, giving us until May 4th (tomorrow) before the marshals come to evict us. We called and found out we are scheduled for eviction tomorrow.

The dates of payments to be made were two days after the original court date (April 10th, so April 12th) and one week or so afterwards, which were both paid. The third payment, May's regular rent, was to be paid by May 9th. That means the landlord filed for eviction again before the third payment was even scheduled to be made, and after we fulfilled our agreements to pay the first and second time.

Do we have to worry about being evicted if we are holding up our end of the bargain?

Edit 1: NYC Edit 2: In court now. Will update.

Edit 3: OK they gave us a court date for May 21st. Told us they would contact the Marshal's office and we were to send a letter to them as well. So, no eviction for now.

My question from my first post remains: why did they file for another eviction when we were complying with the agreement? How can we be sure they won't continue to try to evict us?

VA- proof of littering out of car.

    Posted: 03 May 2018 06:21 AM PDT

Yesterday I was driving in a 25mph zone behind a car with four probably teenage girls inside. As I was going I noticed the girl in the back passenger seat throwing trash out of their car window.

After she attempted to throw it through the open window of a car that was parked on the side of the road, and threw it at a car that was stopped perpendicular to the road waiting at a stop sign to turn onto the same road as us I started to film her doing it and she threw a few more things out of the window while I was filming.

I hate people who litter with a passion and throwing shit at or into others cars is just disrespectful and idiotic. I'm sure it's a longshot but my question is, can I do anything with the footage to get the owner of the car fined for littering?

TL;DR- I have footage of a person littering out of their car, can I do anything to get said person fined?

[TX] University I did not attend says I did not drop 5 classes. Fs are a part of my academic record, and GPA is affected.

    Posted: 02 May 2018 10:14 PM PDT

After being accepted to the University of Texas at Dallas for the Fall 2017 semester, I attended transfer orientation in April 2017. I registered for classes that day and continued to tinker with my schedule for a couple of weeks after that. I didn't feel great about my major. Ultimately, I decided that UTD was not the school for me, simply because I wanted to pursue a degree program they did not have. I dropped all of my classes online via their student portal (Galaxy/Orion).

I thought that was the end of my relationship with UTD. For the Fall 2017 semester, I attended Texas A&M-Commerce, until I left the university on November 5, 2017 due to a personal issue (my father had passed away the previous February, and though my grades were fine, my mental health and family were not). I accepted federal Title IV funds at Texas A&M-Commerce and did not have to return any funds, because I attended classes over 60.1% of the time.

By January 2018, I was applying to different institutions in Texas. Most of them started requesting a transcript from UTD, and after I requested a letter of non-enrollment from them, I discovered there was no record of my classes being dropped. Instead, I had five F letter grades on a transcript that is now a part of my academic record.

I've almost exhausted all of my options with UTD. I've appealed to them formally twice. They told my I must have "proof: i.e. a screenshot showing you dropped the classes" or "anything that proves your story". I provided them with proof I was at another university, accepted financial aid there, and gave them a previous transcript that consisted of 70+ hours of course work with a great academic record in hopes that it would be a testament to my character and commitment to academics. They denied both appeals. I spoke to the associate dean who reviewed my case, but all he said was that I could appeal to the dean, but my chances were not good.

This has started to have consequences on my life. I had to pay UTD $3,000 in tuition for classes I did not attend so they would release my transcript to other institutions, and I am now realizing I likely won't get my money back. My overall GPA has been lowered from about a 3.89 to a 3.33, which means I do not qualify for transfer scholarships any longer, which I relied on. Since my father has died, my academic record and getting scholarships is even more important. I'm thinking about skipping school next semester, because quite frankly, I can't afford it at the moment.

TL;DR: University claims I did not drop classes, though I did. Instead I enrolled full-time at another university. As a result, my GPA has dropped from a 3.89 to 3.33 because the university claims I did not drop my classes and I can no longer obtain necessary scholarships.

Does anyone have any advice? I'd greatly appreciate any information or any ideas you might have! Thank-you!

Made a good faith disclosure regarding ethics violations in animal research. What does retaliation look like for my position? (TX)

    Posted: 03 May 2018 09:58 AM PDT

    Hi y'all!

I'm a research technician at a respected institution in Texas.

Because my direct supervisor is currently on medical leave, I emailed her a description of extreme animal culling that made me uncomfortable. She forwarded this directly to our Principal Investigator, who was also out of town.

In their stead our lab manager sat down with me. She referred to me as a whistle blower and instructed me that, per our PI's instructions, I was to have no part in animal research research from that day forward. In addition to being told to enter the facility under no circumstances, I was told in writing to hand over all samples already collected from mice as I was not even permitted to perform bench work with those.

When my PI returned a few days ago he also sat down with me and did not address the ethical side of the issue at all. He told me I had been dismissed from animal research for having "an emotional reaction" and asked more than once whether animal work was in my job description. I told him that I didn't know, which is the truth.

Since my colony was so overgrown it took up ~50% of my time and energy in the lab. Because I have been given nothing in the way of an alternative assignment, I am now struggling to keep myself busy throughout the day and feel like I am under a microscope in terms of productivity.

For instance, even though I cannot see where packages are delivered from my bench/desk in the lab I am in the habit of checking a few times a day. Yesterday the lab manager, who has her own office and does not work in the lab itself, reprimanded me for not having received some packages when they know how I usually handle deliveries and have never complained before.

I hope I'm being paranoid, but it feels like they've removed my duties and are getting ready to fire me under the guise of being unproductive. It probably bears mentioning that I am off to grad school in the fall and only have something like sixty working days left in this lab.

Were they in the right to remove me from animal work in the first place? Would this constitute retaliation if they do discipline me for an ostensibly "different" reason like lack of productivity?
