However, there are periods near the end of the evening when we have no students and are simply marking student's work. We talk quietly back and forth as we mark, however recently my boss has told us she doesn't want us talking to one another as it looks "unprofessional" to the parents (the classroom space has windows in the lobby that allows the parents to observe the classroom space). Posted: 07 May 2018 08:13 AM PDT Property management company in Arkansas, large complex. I've butted heads with them since I moved in because the apartment they showed me wasn't in the same condition as the one I signed the lease for. 6 months into tenancy. Lease says property inspections are ok and that the landlord is allowed to look around. Lease says apartment must be kept reasonably clean. No problem here. I am a pretty clean person. I cleaned my apartment before the inspection too. I took pictures because every time I would go down there to pay rent, she would remind me my apartment had to be cleaned and she has kicked people out for it. The apartment is obviously lived in but I've no children and no pets and everything is off the floor and organized. By all definitions it is cleaned. I left a one star review of the apartment complex when I moved in and the property manager has repeatedly asked me to take it down, even threatening me with eviction if I refused. Everything I wrote was honest. They had an inspection a few days ago and I came home to my drawers pulled out and stuff knocked over in my closets. My couched was pulled back, personal items were moved and opened. It was obvious someone had riffled through my things. I took pictures and sent an email to the office. She acknowledge she looked and said the inspection clause in the lease allowed her to do that but I couldn't find anything other than "Safety and health inspection". She even took all the medicaitons out of my medicine cabinet and laid them out. She said she took pictures of them to see if I was a drug abuser. None of them are drugs you would typically abuse. I have antifungal medication, some steroid cream, left over antibiotics from a bout with strep that I have not thrown out yet (doctor switched me since the first set wasn't working), birth control, and some antihistamines and over the counter medication. It is pretty clear what they are. I am also missing about $65 I had stashed in my kitchen. The container was opened and left on the counter and it is missing. I have pictures of this all. She is also claiming I made damages to things I actually noted on my move in sheet that were already damaged. the ceiling has spots on it, the screen door is loose, air conditioner leaks, paint on the floor, a hole in the wall in the utility closet. It is all noted on the sheet that she and I signed which I submitted to their office 24 hours after move in per her instructions. I included pictures. I have copies of all of this. The property manager served me notice to cure or quit for damages and cleanliness. What are my rights here? She is claiming I would need to fix the damages she noted in cure and clean the apartment. The apartment is clean though. If I just allow her to follow through with the quit then she is will keep my deposit. How can I cure something like this? Talking to her has proved useless. She won't listen, she won't answer to my copies of the documents sent to her about previous damages or pictures of how clean the apartment was before she entered. Lease was signed, deposit and rent paid, everything appeared on the up & up. The property manager mentioned there was another app at the time we applied, but they declined it and accepted our least as our credit was better. I woke up this morning the a moving truck outside my house, with someone else's stuff in it, they were trying to move into our house! They claimed to also have a lease for the property. I told them that we were in possession of the property, gave them my name and phone number, and told them if they did not leave the property I would have to call the police. I also left a message with the property manager. They parked the truck down the street, I locked the house up tight, then unfortunately had to go to work. I'm hoping it's just a misunderstanding, but want to prepare for the worst. Any advice on what my rights are if they do in fact also have a lease? Does the property go to the first one to inhabit it? He came home drunk and being generally loud/aggressive to the rest of my family. He threatened to 'Beat everybody in the house up.' Including: 5 year old sister, 13 year old sister and 8 year old brother. I went out to make sure he couldn't do anything. Didn't say anything and he picked up a T.V to throw it at me and then tried to him me. I managed to restrain him but he bit, scratched and pulled my hair. Ended with us getting him out of the house where he slammed on the windows trying to break them, kicked the front door (Damaging it.) Screaming he was going to kill me and my dogs and then proceeded to scream abuse at my mum/step-dad. He has a history of violence (Hitting, threatening with knives) but none of has been reported. The police officer that took him advices me not to press charges because he's a minor and it would look bad on my part. Is this true or was the officer just trying to get it over with because he was really uninterested in the whole thing. He came in took names and birthdays and then left more or less. How would I go about it if I can and what would the repercussions for him be? Edit: Thanks everybody for the advice, it's been really helpful. I wanted to make sure he was charged for this from the beginning, but with the officer advising against it I assumed there was more to it. I'm going to ring the station and see what they say. Posted: 07 May 2018 07:49 AM PDT I have a product that I'd like to repair myself; the fix is super easy, but I can't get it disassembled because the manufacturer uses a highly specialized screw head in order to prevent exactly this. The manufacturer is refusing to make a screwdriver available to me because they say that only they are authorized to service the product. What's the legal standing here? Does the new law affect this kind of behavior? Am I SOL and have no choice but to ship the product to the manufacturer for service? It's not about the cost of shipping as much as it is about the hassle. I can fix the unit in about 1 hour, whereas they manufacturer will take about 2 weeks. Here's the details; He was walking his dog around the block, and he was stopped by a family who wanted to pet his 9 week old puppy. The child reached down and pulled on the dogs hair, which the dog reacted to by biting the childs hand. The kid needed stitches to the webbing between his thumb and index finger. The father is a lawyer, and he wants to sue for emotional distress, disfigurement, legal fees, and medical bills. Or, he wants to be there to watch the dog be put down. Basically it all resolved itself pretty quickly (sorry for no juicy drama!). On Tuesday afternoon (1 day after posting here) I called the main contact number for customer issues on their website. I spoke with a receptionist, who I briefly told my story to, and she transferred me to someone in customer service ("Steve"). Steve first and foremost was suuuuper apologetic. He was actually so apologetic because he already knew about the issue. Turns out that someone else at the store reported had already the incident! All he said was that it was another employee, but wouldn't tell me who. I'm guessing it was probably the cashier who handled my transaction, firstly because she was in the Facebook screenshot too (even if it was just the back of her head), and because she's friends with the shop manager ("Eric") on Facebook so she had to have seen the post. I don't know for sure though. Steve told me that they had already terminated Eric effective immediately. He said it was the only time something like this had ever happened at any of their stores. He also offered me a $200 gift card. The call ended there after a total of no more than 5-10 mins and honestly I felt pretty good. The reason I waited to post an update is because I was hoping to capture a screenshot of Eric's Facebook employment update. Previously it was "SexGod at $franchaiseName" and I was hoping for something equally arrogant but alas he simply deleted his employment info. Neither of this is true. In fact, both of these are for the apartment complex I'm currently living in.I went to management of my current apartment complex this weekend to ask and they showed me on their computer that I owed NOTHING and she even verified that I'm not evicted, well, since I'm still living there. Also, the only reason I know it's for the current complex I'm living in is because the background check specifies. I'm at a complete loss as to what to do to get rid of this. To make this short, I don't know if he's trying to get me to break up with him, or if he is telling me the truth, because this sounds ridiculous. His ex-wife apparently had a better lawyer than him, so he has to give his house and half his company(he is the owner) to her. The company will be given to her as a shareholder(50%). To get her off as a shareholder of his company, he is planning to give himself a wage(as he took money from the funds of the company), and declare the company bankrupt, as he can't afford to pay himself the wage he stated(?). After doing so, he will change the company name, and get a new number listed(?), and she will be taken off as a shareholder as his previous business will be worthless. I literally don't know anything about businesses, as I am in a completely different field. Sorry for the dumb question. TL;DR Boyfriend wants to remove ex-wife from company as a shareholder by declaring his company bankrupt and changing the name/number of his business to a new one. Is this legal/allowed? This situation is just developing, so I apologize if I don't have all the info. I just got off the phone with a lawyers office that said they have been trying to collect debt from 2008 for Wells Fargo. They gave me an ultimatum: pay the $800+ now, or fight it in court. I don't recall ever banking with Wells Fargo, but I want to make sure. They said if I tried to fight it, and loose, I can pay up to triple the amount plus various other fees. I can't afford to pay it off, let alone a lawyer. What are my options? I don't even know how I'd verify if I ever had an account with them. Someone has used my identity to file taxes in the past, so this could be fradulent. Edit 2: I'm thinking more and more this a scam. I called them asked for their business name and address for dispute. They claimed to be ADR (Advanced Debt Recovery) located at 1001 Texas Ave, 77002. First, no Google results for that business name. Second, that address is street, not an avenue, and there's no suite number. I also called Wells Fargo Debt Collections and they have no record of any debt to my name. I tried confronting these schmucks with this and they said I called the wrong department. Also googling the phone number brings one hit for 'not safe'. Be weary guys, I'm 32 years old and thought I was good at sniffing out a scam. These guys are American and had a semi-canned response for every dispute I had about their info. Do you're own research! Last week I was replacing a fence on the far side that almost no one ever goes to and I found a 2016 Hyundai sedan under a tarp and on 2x4's without any wheels or seats. That night I called the sheriffs to report it and soon after two deputies came to check the car out, they said the car had been stolen from a rental place since November but since the location of the car is so remote and hard to get to a tow truck would not be able to get the car out and they left after that. My main question is now what...? I dont want this car on my property but I dont have the means to recover it and give it back to the rightful owner, I am not even sure how to find out who the car is registered to [link] [comments] |
Neighbor replaced a fence on my land and won't communicate. What can I do? Posted: 07 May 2018 01:00 PM PDT California I have an L-shaped lot, with an unfriendly neighbor in the nook in front of me. I've been here for about 10 years, and the neighbor about 2 years. It's a rural and ranch-like area, and we used to have a split rail fence along the two sides of our adjoining lots. The neighbor, not long after moving in, replaced the split rail fencing with tall privacy fencing, without communicating with me at all. At the time, I was unclear where the actual property lines were in relation to the fences, but was reasonably sure the fences, now replaced, were on my lot. I wrote a letter to them, telling them of my suspicion that it was my fence, and asking for them to provide whatever records they had to prove the fence was theirs, else remove the fencing they installed there and restore my split rail. The letter was ignored, so I followed up with a certified letter. Still got ignored. Since that time, I had a survey done, which proves that the fences are on my lot. Along one edge the fence (neighbor's side of fence, not the center line) is on my side by about two inches. Along the other edge, it's two FEET and, as I'm now aware, my gas line is buried on their side of the fence. They did go and talk to the neighbor, and learned that they believe the fences are theirs. A few other notes: There should be no adverse possession claim, as the neighbor hasn't been there long enough to meet the statute. My locality does not require permits for fences. I'm now about to put my property up for sale, and really should get this taken care of so there's no encumbrance on my title. Thus, I'm considering just going ahead and having the privacy fence removed and building a new split rail in it place to put everything back the way it was, then going to small claims to recover the costs. Who legally owns this fence that the neighbor erected on my land? The fence is a "fixture" on real property which I own, so from that angle, it's mine. But it was the neighbor's labor and materials, so is it mine anyway? If I can remove it, must I return the fence materials? There's a lot of reusable wood there. Can I get in trouble if I remove the privacy fence without a court order? Maybe they'll try to sue me. But I have a survey supporting me, and a long documented history of my efforts requesting them to undo their mistake. Reasonable fair warning, I think. What are your thoughts? What can I do? Never bit anyone but barks at strangers and other dogs to the point where we really don't let strangers sniff her or come around her. So here's the story, Me (m26) and my wife (f28) just got done with a move. We were unpacking all the boxes and I posted them on offer up for free. This lady, older >40, came to pick them up. Again, our dog has never bit anyone, she sometimes jumps on people when she's excited but we stop her and tell her no when she does this. As we were moving boxes from inside the house to outside, our dog was barking at this lady because, obviously, she kept coming in front of the door to get boxes. My wife was setting some boxes outside on the floor while holding the dog back and the woman bent down to grab a pile of boxes over our "welcome" mat when our dog got out and nipped her face. I say nipped because, although it broke skin, it was a pimple sized blood spot. My wife apologized profusely and offered her napkins, bandaids, alcohol swabs. She told her that her rabies shot were up to date and if she would like a copy. The woman refused. The woman asked my wife if the dog has bitten anyone before to which my wife said "no, never. " After we finished loading the boxes into her car she told me I shouldn't let the dog around children. I told her we don't to which she said "Oh so you know there is a problem with her" And I replied "no, we just don't trust kids around our dog" which is the honest truth She then said that we might be hearing from her and that she was not happy about this. We love in Washington which I guess has a Washington stature law or something that says it's always the owner's fault. I'm not denying this part. I just want to know if I should follow up with anything like get legal advice or anything with the dog like behavior classes that Would that help the situation I have already spoken to my insurance and am waiting for them to call me tomorrow morning. In his will he names her as the one who inherits everything, he also disinherits his children from a previous marriage. The problem is yesterday we looked at an envelope in which we had life insurance policies and realized he had forgotten to take his ex-wife off of the policy. My uncle unknowingly to the rest of siblings took my grandma to amend her will to exclude 2 siblings. Downstairs neighbor terrorizing us. Posted: 06 May 2018 11:07 PM PDT I live in an apartment (Ohio), upstairs unit. For awhile I've been able to ignore my neighbor (couple slammed doors, yelling at night etc), but after tonight I had to call the cops. Tonight he was slamming things, yelling, and fighting with his son near midnight. I felt like with what I was hearing that his son might be in danger, they fight a lot, usually minor but tonight sounded physical, so I finally called the cops. He hid completely, wouldn't answer the door. After the cops left he started to really yell at his son, could hear punching, asking him why he would call the cops. His son was bawling. I was so furious, called the cops again. Now the son is gone and safe, but the neighbor is demanding to know who called, threatening the anonymous caller. Now he won't stop randomly banging on my ceiling and screaming. He's threatened me, but hasn't came upstairs (yet). I had to call a third time and now it's quiet, but it's 2 am, everything started around 11 pm. I'm worried this will go on, we have always had an issue with this neighbor, but never bad enough to bring it up. I'm so sick of hearing him hurt his son, I really want him to have a good home, he is such a sweet kid. I have left a voicemail for the LL, but I doubt it would get very far. He's been living here for over a decade vs my 8 months. I do not know if anyone else has much to say, as everyone here is usually quiet and keeps to themselves (which is what I love). She will still get paid her normal salary. All 4 of the choices are christian-centered charities. We are not christian, and are wondering what our hypothetical options are. I know that FL is an At-Will state, so she could be terminated for not participating, but would that be considered religious discrimination since we are not christian? Would donating our time to a religion that we are not a part of be something we could use to get HR to consider other charity options due to legal problems? [VA] New contractor cutting pay by up to 30%, local newspaper wants to talk Posted: 07 May 2018 06:48 AM PDT So my contract at work is ending on May 31st, and three new companies were awarded the new contract. The government awarded the contract to the second lowest bidder. My job falls under the third, smallest company - the subcontractor. My coworkers, whose jobs fall under the largest company, are seeing pay cuts of up to 30% while my pay cut is only about 12%. When the new contract was awarded, the new companies posted jobs for incumbent employees to apply to, but they essentially falsely advertised the jobs. My friends work as Office Managers, Budget Analysts, and Administrative Assistants. The new companies said they would pay us "fair market value". However, that company posted the wrong titles: Secretary I, II, and III, as well as a Sr. Admin Assistant position. What essentially happened was, a joint venture came in and underbid the current contract (by a lot). In an attempt to save money, they listed lower-paying jobs and are now expecting the employees to continue their workloads for a pay rate **that is lower than what we all started at.** On top of that, the new contract is giving higher rates to newer employees and lower rates to people that do more and have been here longer. Additionally, none of these companies have prepared benefits packages for incumbent employees yet even though the contract was awarded back in March. The task orders and job descriptions for these positions are also hugely different from the work they're doing now. The responsibilities listed for the job I was offered are also different from my current role. Since the offer letters started going out last week, there's been a drop in productivity and word has spread like wildfire. The staff on this contract are pissed and ready to quit - in fact, some already have. Back in March, a local paper wrote a story about the contract award. I emailed the reporter asking if she'd be interested in a story about what's going on with the contract now, because it's the opposite of what she wrote about back in March. So, a few questions: - Is it against the law to discuss the contract with the media? This information, including pay rates, is all public record. - Virginia is an at-will employment state, but what are my legal options if I - or my coworkers - go on record detailing how screwed up this transition has been and how these companies are treating the employees? - Is this something that counts as whistleblowing? "The Virginia Fraud and Abuse and Whistleblower Protection Act protects state employees who report instances of wrongdoing or abuse by state agencies or contractors. An instance of abuse could include substantial misuse, destruction, waste, or loss of funds. Employers may not threaten, retaliate, discharge, or discriminate against whistleblowers." - Would a pay cut of 30% count as "loss of funds" and would the misadvertisement of jobs and positions count as wrongdoing? Myself and two other roommates had a lease that ran from July 1, 2017 to July 1, 2018. Around halfway through the lease, we had upstairs neighbors move in that made the apartment difficult to live in (ridiculously loud parties until 5 am on weeknights, sketchy people constantly knocking on our door looking for them, packages getting stolen from our door, etc). After several complaints to our property manager, management said that while they were not willing to deal with the eviction process for the upstairs neighbors, they would allow us to move out early when they found suitable tenants. This was in February of this year. At the beginning of April, they gave us four days notice that they had someone taking over our lease. We scrambled to sign another lease and move out in that time period. The property manager told us that we only needed to pay rent for the first week of April. After we completed the move out, we received the following email from our property manager: "I have corrected the balance on your account. Your balance is now zero. Please make sure the apartment is clean. You will need to bring all the keys to the office. Provided there are no damages in the apartment the deposit will be completely refunded. The check will be listed in everyone's name and mailed to whatever address you provide so you will need all roommates to sign to cash." We turned in the keys and assumed that was the end of that. However, two weeks later, the property manager emailed us and said that the tenants who were going to move in fell through, and we were now responsible for the rest of April rent. He said that if we paid April and forfeited our security deposit, we could "forget this whole thing" and not have any more responsibilities. When we responded saying that he gave us permission to move out, he then said that that did not absolve us of our responsibilities and we would be responsible for the remainder of the lease (until July). Do we really need to pay rent for the remainder of the lease? While I know that the lease was until July, we would have never moved out had we not been told to! We have all signed other leases and are worried about being responsible for two rents. We also do not want to have an eviction on our records, since we know that they are a red flag for getting a future apartment. Question about a car in my mother's will Posted: 07 May 2018 05:54 AM PDT Hi all. Glad this sub exists, really need some info here. So my mom who lived in Massachusetts passed away in January. In her will, my father was made executor but he rejected it since they haven't spoken in over ten years. In the will, she states she leaves 100% of her possessions, car, house, etc etc to me. She didn't own any property but she did have a car and money in the bank. However, from what I have been told, she was several thousand dollars in credit card debt. It's been about 5 months and we haven't heard anything from debt collectors. My stepfather says I should just take the money/car, but my father is saying I'd have to go to probate court and pay a bunch of money or something. I'm just really confused as to what to do. Financial company leaked my SSN and other PII through sheer incompetence Posted: 07 May 2018 06:49 AM PDT [South Carolina] Hello all, My grandfather was getting his will adjusted and was adding myself and my siblings to one of his investment accounts (IRA I believe) for disbursement upon his death. Unbeknownst to me or my siblings, the financial company that he is doing this through had our Social Security Numbers (which I've learned is not even a requirement for this process). I did not give them this information or even know that this was going on. This company sent our SSNs via plan text unencrypted email, which alone is a horrifying disregard for basic information security. But to make it worse, they mistyped the address and sent it to the wrong email! What type of legal recourse do I have here? My SSN was leaked without my knowledge of any of the proceedings through incompetence and a blatant disregard for basic encryption and security. Nobody involved has power of attorney for me. How long does a judge have to file a judgment in a civil suit? Austin, Texas Travis County Posted: 07 May 2018 11:53 AM PDT Filed a civil suit against previous landlord for failure to return our deposit within 30 days. Original hearing was on 2/6 of 18. Austin Texas, Travis County JP 1. Been scouring the code and I'm not 100% sure that I have a legit answer on how long it takes a judge to give us their judgment but I believe it to be 90 days but that was yesterday, so today would be the final day. I can imagine, putting pressure on a judge to make a judgment is not exactly going to help us win favor with the judge however, I'm hoping to get some answers in case this goes on for another few months. Thanks in advance EDIT: Wife just pointed out February is a short month so we may be behind the supposed 90 day window.
