I had a car stolen (see my other submission for this) from in front of my house and the insurance company didn't pay out for nearly 9 months, and still haven't. I sued them, and now they put everyone on it, and are extremely apologetic. I met with them today and they told me that they want me to give them a Waiver of Defense so they can look at the claim. To date is has been 266 days that they have not paid out my claim, they now have 3 days until my civil claim against them goes to a default judgement. Do I give them the waiver? or make them do everything in the next three days? I don't see how giving them this waiver would benefit me at all [link] [comments] |
Posted: 29 May 2018 01:54 AM PDT I was involved in a car accident that occurred early last year in 2017. Long story short, I was turning left, waiting for oncoming traffic to clear. Light turns red, but the other driver ran a red and hit me as I was turning left. It was concluded that I was not at fault so nothing was done there. The other driver was a uber that was carrying a few passengers. Just by visually looking at the driver and the passengers, they were not seriously hurt, just bit shook up. We exchanged information. Submitted a police report immediately when the crash happened. Fast forward to now, and I get a letter from a law firm claiming that those passengers are now suing me and that other uber driver for close to a million dollars. Obviously, I know my next steps are to contact my insurance because I'm sure I have 3rd party liability coverage. I'm just wondering if anyone has had the same experience because a million dollars seems like a lot of money for people who look completely fine after the car crash (yes, I have heard of individuals who develop long term injuries and blah blah blah, but there's not way 1 million for a few passengers is reasonable). I kind of know the way I'm going to approach this, but any tips in dealing with an issue like this? Thanks [link] [comments] |
In a minor accident with no damage - next steps Posted: 29 May 2018 12:09 AM PDT I was recently in a very minor fender bender where i was merging into a lane in a city street and another car that was speeding barely clipped my bumper as i was merging. Neither of the cars have any damage, although he insists that there is some minor scuffing and paint swapped, even though it's not visible in a picture and looks like the faintest of smudges when viewed up close, and it could have been there before the incident. He said he doesn't have to go through insurance but now he has to get his car buffed, because he just got the car this week and it has to be my fault that there is a tiny paint smudge on his bumper. We got each other's insurance info just in case, but we agreed no need to get insurance companies involved, he would let me know how much buffing would cost and we'd take it from there (I never agreed to pay though). However, when I went home I looked this guy up and he was lying about his car - he's had it for a year, and he posts videos of himself drag racing. Since he lied to me and I'm worried this guy is going to pull some BS, I called my insurance just to let them know it happened, there was no damage, I don't want to file a claim, and just give them information in case this guy makes up some nonsense story. The insurance guy took all the info and said an adjuster would contact me in the morning. However, I'm worried about my rates going up, I also don't want them to call up the other guy since he might view that as aggressive and then get his insurance involved. Basically, I want (and hope) that this guy will wake up, realize that this isn't worth anybody's time, and everybody will just move on and forget about it, the insurance just files it away in a drawer somewhere and that's the end of that. I just contacted my insurance as CYA in case the other guy tries to pull some BS, start some lawsuit or something, idk. What should my next steps be when the adjuster calls tomorrow? Rear Ended Someone What to do about Insurance? Posted: 29 May 2018 12:05 AM PDT So I was the one at fault and rear ended a van. I was not intoxicated or anything like that. I had my eyes in the mirror for a little too long and he must have stopped suddenly and I rear ended him at a slow speed. He had zero damage and my front end got pushed in and its grill is broke. He got my information but he only gave me his ID and phone number. He couldn't find his insurance card and I was running late to an important appointment. He told me he would contact me if he was going to file. He never did. So there's a lot more damage than just a simple scratch or dent so I would if possible like to turn it into my insurance. Can't get any response from the insurance agent, what should I do? Posted: 28 May 2018 09:19 PM PDT Hi reddit, I've been rear ended by someone who is insured by Geico. I'm on Progressive. I called Progressive in order to start a claim and they said, I should be doing it through Geico but they'll help me to do that. And an agent started the process. After a couple of weeks I got a call from Geico and they told me that they can't reach to the other party. I said that's fine please let me know what to do next and they said alright. That was the last time I heard from both companies. I keep emailing the agent from progressive but he doesn't even respond to me. Now my insurance claim page says that they'll reach out to me if they need more info. What should I do next? Someone rear ended me and he doesn't even respond to the insurance company. Wifes parked car got hit by another driver and the other drivers insurance wont give her a rental Posted: 28 May 2018 10:06 AM PDT (Georgia) My wifes parked car got hit by a driver who went into a diabetic shock, lost control, swerved off the road and hit three cars(all three have reported to Geico). The police report stated that the driver swerved off the road and lost control(not a parking lot incident). The driver was driving her fiances car. My wife called up their insurance, Geico, and they told us until they report the claim to them they wont give her a rental. It has been 5 days, the person(the fiance) has not reported the accident yet and Geico is unable to get in touch with them. It is infuriating that we might have to pay out of pocket a non-refundable 20% to get a rental from our insurance company, even though it was not our fault. Should I file a claim in Georgia? Posted: 28 May 2018 07:50 PM PDT Hello again, I recently got into a small collision out of state and have not filed a claim yet. I was at a red light whenever a commercial vehicle rear ended me causing me to rear end the vehicle in front of me. Minor damages to my vehicle, however my question is should I file a claim tomorrow or wait? The reason is I'm moving to Washington State next week and my vehicle is being shipped across the country towards the middle of this week without me. If it helps, the accident occurred in North Carolina, I'm in Georgia, and the car is being shipped to Washington State. The other drivers involved are from Georgia and Florida. I am insured by USAA. Incompetent Provider - Need Help Posted: 28 May 2018 03:13 PM PDT TL;DR - I was in an accident several months ago where I was rear ended. There was a surprising amount of incompetence from my insurer and ultimately it appears as though it was agreed between the two insurance companies that fault would be shared 50-50. Originally, they credited me as the party at fault and only changed that after I spent a lot of time complaining. I definitely feel like a competent insurance company would have ensured the other driver was at fault, but thanks to a completely insane amount of incompetence, this is where we are. I am trying to find a way to protect myself now, and in the future. For those who want to know more: The Basics I am from Alberta, Canada. I have been driving for over 24 years without a single at-fault accident. I consider myself a very good driver, and my record supports that. I have been with the same insurance company for over 20 years and have never made a single claim. I insure two vehicles and two properties with them. The Accident On my way to work I was approaching a 4 way intersection. There was 2 lanes in all directions at this intersection. It was early in the morning and there were no other cars in sight aside from me and the other car. The other car was ahead of me approaching the intersection. The light was green as we approached and we were both signalling to turn right at the intersection to go the same way. The other driver stopped in the intersection, blocking the right lane which we were both turning from. After several seconds I gave a brief honk. At that point the passenger door opened and the passenger turned to put their legs out of the car but remained seated. After several more seconds and no other movement from the passenger to get out. I switched into the left lane which was intended to go straight or turn left and went around the car. As I passed the car, the woman driver flipped me the bird. I tend to ignore stupidity, so I ignored it and continued driving. I went directly into the left lane after passing her still stationary car. After passing her I switched back into the right lane which I would have been in if I turned from the correct lane to begin with. I then proceeded for what I have since determined to be about 250 meters in the right lane before feeling an impact. Since the other car was not moving when I passed, I was not looking and did not notice them approaching me. The road is a 50km/h speed limit road and I was doing around that speed. Immediately after the impact, both myself and the other driver stopped our vehicles. I took a moment to grab my phone and papers before getting out. The other driver got out immediately and was yelling swears and insults as I got out. I attempted to calm the situation and asked her if she was alright. She ignored me and continued swearing. At that point I felt that I was getting nowhere so I snapped a photo of her license plate and got back into my truck to phone the police. Since there were no serious injuries and both vehicles were still drive-able, they suggested we go to the nearest station to write a statement. I told the other driver, who took a brief pause from swearing to agree to meet me there. I went to the station and filled out a statement. After nearly an hour of being there the other driver showed up with her husband. The officer took both statements and then did a vehicle walk-around with each of us independently. I went last, and the officer told me that the damage on her vehicle doesn't match the story she told. The Claim Immediately after leaving the police station, I pulled into the nearby parking lot and called my insurance provider. They took my personal information and checked if there were injuries. My back was pretty sore by this point, so they suggested I speak to a doctor as soon as possible. They then told me that once an adjuster was assigned to my claim, that they would call me to get further information about the actual accident. As I found out later, there were three adjusters involved from my provider. One for vehicle damages, one for my injuries, and one for the other parties injuries. I will separate the details of each to try to avoid as much confusion as possible. Vehicle Damage Adjuster - Jon / Janet / Mary Jon originally contacted me via email 7 days after the accident and introduced himself and gave me his contact info. He also told me to go ahead with repairs on my truck. I booked an appointment that day. 21 days after the accident I had still only heard from Jon that one time. I decided to reach out for an update and see if there was anything I could help him with since I still had not gave him my statement. Jon told me he was a bit behind and not to worry. He said he would let me know as soon as he was ready to get more information from me. 2 months after the accident happened I received an email from Jon. The email came in just before 5pm on a Friday. The email said the following: "Due to statements and damages, we have determined that you have made an unsafe lane change and this will be considered an at fault accident on your policy." To put it nicely, the spelling and grammatical errors were so horrible that I thought it was a joke. Maybe one of his co-workers was messing with him. It just didn't make any sense to me, so I tried calling him immediately. No response. I called repeatedly, daily, and got no response. I decided to call the switchboard and see if they could help. I was put through to a different adjuster who briefly reviewed my claim. They were unable to understand why I was given at fault, so they put a stop to the "at fault" decision so that it wouldn't be paid and closed. Her reasoning was that it was a lot harder to appeal a decision after everything went through. This person also told me that my adjuster was gone on vacation for a month. They said there was a delegate adjuster covering for them and gave me their information. The new adjuster, Janet, contacted me to discuss this claim and my complaint about it. After reviewing the file she also wasn't able to understand why I was given at fault. When I asked her what to do if no one understands why I was considered at fault, she disappeared. No further responses at all. Once again, I contacted the switchboard and was passed off to a nice adjuster who was very helpful. He reviewed the file and asked me several questions. After our discussion he said he completely agrees that I should not have been given fault in this and escalated it to the manager of the adjusters who worked on my file. This is now around 3 months after the accident. I get a call from Mary, the manager. She was clearly calling me to defend her employee's decision. She was combative and argumentative right from the start. I had several questions at this point so I did my best to brush her lack of professionalism aside in order to get answers. My questions were:
This is where Mary tells me that they only have the other drivers statement, and a single photo of the damage. I asked for her to text me the image so I can see what they are looking at. It is a zoomed in image showing only the one headlight on the other drivers car. I was shocked that this is all they had when they made that decision. This is really seeming like "I am going on vacation and need to clear my plate as quick as possible". I told Mary that I had several more photos showing the entire front of the car. I texted on showing where the hitch receiver on my truck hit nearly dead center of her car. It was off-center by about 3"-4". Mary tells me that would be impossible to happen if we were both driving in the same lane. According to Mary (keep in mind this is a manager at a large insurance company who is supposed to be representing me) traffic lanes are NOT wider than vehicles. Yes, you read that right. She argued that a traffic lane is just as wide as a vehicle and for her to have hit me 3-4" off center means one of us was not in our lane. Clearly they decided I was the person not in my lane. I was dumbfounded and pretty much decided that Mary is a completely incompetent twit who was not worth wasting any more of my time arguing with. I removed myself from the argument. A few hours later Mary calls me back. This time she went through the claim in full and like everyone was confused why I was given fault. She apologized for saying that lanes are only as wide as the vehicles, and said she would do her best to remove my liability. She also mentioned that she would speak to Jon and get a better understanding of why he made that decision, and based on that she would consider the need for retraining him. A month after that conversation and I still had not heard anything. I once again called the switchboard and was told that the accident was classified as 50-50. That is where it stands today. My Injury Adjuster - Sara After speaking to the doctor, then taking that recommendation to my chiropractor, they had given me an assessment of 21 visits. The maximum allowable. Before those treatment visits could begin, they needed a form completed by my insurance company. I signed a waiver to allow my chiropractor to deal with my insurance to get it. A full month after the accident they still did not have the forms they needed. I decided to call the insurance company to see what was going on. That's when I found out that they did not open an injury portion of the claim. Understandably they didn't know there was an injury component because no one had spoken to me at this point. That's when I get an email from Sara introducing herself as my adjuster for the injury. She told me that she sent the forms needed and I could begin treatment right away. This was over 30 days after the accident when I have to complete treatment within 90 days. I went through treatment and at the 90 day mark I got a call from Sara. She asks me how I feel. I say that if I had the extra month of treatment that their mistake cost me, I would probably be fine because I felt the treatment is working. Sara tells me that their coverage of my treatment has ended and if I need more to use my medical coverage from work. To me that seemed unfair, but I fortunately have good coverage from work and continued getting treatments as necessary. Sara had also mentioned that the other insurance company would contact me about this. After another month without hearing from anyone, I called Sara back. She said she doesn't understand why they hadn't contacted me yet and suggested I call them and start a claim. I made the call and got them to open a claim. A few days later the adjuster from the other drivers insurance called me and asked why I opened the claim instead of my insurance company. She said she has never seen that before. She was very professional and polite. She did tell me that my insurance company was being very difficult to work with. She asked me for my help in getting them to be responsive. Other Parties Injury Adjuster from My Insurer - Brad I thought everything was done, but at the 3 month mark I received a phone call from Brad. To say it politely, English was not Brad's primary language or even one he was reasonably proficient with. Our first call was very difficult with a lot of repetitive questions. Basically Brad told me that the other party was claiming an injury and he was helping her deal with that so that she didn't sue me or them. Brad was thorough in his questions, and even explained what no one else was able to. He told me that the other driver claimed I had hit her while switching lanes. Because of that, the onus of proof was now on us to prove we didn't hit them while switching lanes. During this initial call Brad mentioned lawsuit no less than 5 times. So I finally asked him if I should be worried and if I should get a lawyer. He quickly said "no, you don't need a lawyer". I felt his answer was a bit panicked, which in turn worried me. I told Brad if I can help with anything to let me know. A month later (4 months after the accident) Brad called me again and this time asked if I would be willing to allow a forensic engineer to check the black box in my truck. I didn't even know such a thing existed in vehicles. He said it would be able to tell them the steering, braking, and speeds at the time of impact and several seconds leading up to it. Then he said that this would clear me of any wrong doing from her claim that I slammed on my brakes while ahead of her. I wanted to make sure I heard him correctly. I asked him again what she was claiming. He said she was claiming that I slammed on my brakes ahead of her causing her to rear end me. I repeated my question several times to make sure there was no misunderstanding, and for the fact that my work phone is recorded due to the nature of my job. I don't know if I would be able to access it, but at least it's there if I can. With this new revelation, I said now that she is claiming I stopped too quickly in front of her, then the onus of proof is on her to show that I did that and she was a safe distance behind me. Brad's story changed again. Making it once again inconsistent. He said "no the onus is still on us from changing lanes", but when asked why that is since her claim has now changed, he couldn't answer. I agreed to the forensic engineer to review the black box. Brad made sure to tell me that if I didn't agree to it, that my insurance company would not cover me for anything. Seems like a violation of my rights, but I had nothing to hide so I agreed. As expected, there was nothing recorded at the time of impact. The impact was pretty minor so that makes sense. Nearly 6 months after the accident Brad calls me to give me an update. He tells me that the other driver is still receiving treatment, and once that is done he will close the case. I asked him about this because unbeknownst to them, as soon as this is dealt with I am not staying with them as my provider. I can't continue paying a company who has not once had my best interests in mind. I asked how the other driver was still going through treatment when it was well beyond the 90 days that I was told was the end of the treatment. As it turns out the 90 days was not the end of coverage. It was just the end of the direct coverage. After that my medical plan and insurance would work together to cover whatever is remaining. Sara didn't tell me that, so I have been going straight through my company and eating up my plan limits. Conclusions I feel that I was treated very unfairly and am still not satisfied with a 50/50 decision. I was rear ended and the other drivers story has changed, damage shows pretty clearly that this was a rear end accident and not a side impact as we were switching lanes. I do have accident forgiveness, but I don't think it's fair to have to use it on an accident that was not even close to being my fault. I have tried arguing and appealing and everything I can think of to remedy this. At this point I have asked my insurer to remove the liability from my record since it was their incompetence that caused it to be there in the first place. I just feel helpless and like the company I have been paying $400/month has proven that they absolutely do not care about their customers. I am not going to identify them because I feel it would make this seem more like a hit piece than one where I am asking for advice. That being said, what can or should I do? I have been considering a lawyer, but they can be very expensive for a principle based argument. I don't expect to gain anything financially. I am a 21 year old boy from New York, who just got his license two months ago (I'm from NYC, not everyone drives) and now my dad gave me a car, but won't put me on his insurance because its business insurance or something, so I went on progressive and they gave me a quote of around 250 dollars a month, which is doable for me and my new job. But here are some issues. 1. I am starting a new job in Rhode Island in a couple of weeks. The insurance guy said that I should just register and get insurance in NY, and then worry about switching over later after a month of living in RI. 2. My mom told me a horror story of a progressive auto policy that quoted her at 200, then charged her 500 one month for no reason. Can insurances really just jack up the price like that without you having an accident? I asked the progressive guy over the phone to send me a full contract to read before I signed (I used to work for a housing co so I know how to read leases, figured insurances would be similar) and the guy told me that you sign first, then they send you a policy, at which point you have an option to cancel, it all sounded shady AF and I really would appreciate clarity on what I should do! The problem is the original contractor that provided the quote will have a long lead time. I found a contractor with a cheaper quote and quicker lead time. Will I get in trouble for spending the cash money I was provided on a cheaper contractor? Any help or experience in this matter will help. I am still pretty new to insurance and how it works. Boat Insurance cover a cracked block? Posted: 28 May 2018 03:50 PM PDT We have a 2007 mastercraft csx 220 with a closed cooling system, was winterized with antifreeze, covered, stored all winter in covered storage. We're in Montana, so it freezes, but it was not a super cold winter. We pulled it out of storage and immediately noticed a large puddle of green coolant under the boat. Was winterized with pink antifreeze. We're now terrified we're looking at needing a new engine due to a cracked block. We have very good progressive insurance for $50,000 but it seems like they would be unlikely to cover his. There is minor damage, but not marge dents or paint damage. Its also an older make and model. I've waited 24hrs for the other driver to call me to exchange more information but the driver has not called me yet. I'm 99% car free, but once in a while (as in, maybe 2-3 times a month, tops) I borrow my roommate's car to go hiking or to the mall. I want to make sure that should I get in an accident, I wouldn't expose her to liability or higher premiums on her insurance. Is there a cheap way to do this? Posted: 27 May 2018 10:37 PM PDT TLDR: Currently a named insured on roommate's auto policy; will be taken off; should I buy my own policy despite having no car, in case I want to buy a car in the future? Hello reddit! So currently I live with a roommate who bought a car in 2016, and neither he nor I have owned a car before. He dutifully added me as a Named Insured on his policy (I don't know why I am not being listed as Driver, but well). Now he's moving out and will take me off the policy, and I am worried that if one day I want to get a car for myself, the gap between policy would cause my rate to skyrocket. So my question is: - does being a Named Insured on someone else's policy count towards my time of being insured? - if so, will being taken off it negatively affect my future rates because of the lapse? - if my rate will increase, will it be higher than had I not been listed under his policy at all? - should I buy non-owner auto insurance, ask if my roommate could leave me on his policy, or just don't worry about it? As for the utility I get from insurance, I rent a car occasionally - probably three or four times a year.
