Announcement: Harvard Law School’s Access to Justice Lab AMA - Wednesday 5/2

    Posted: 27 Apr 2018 10:15 AM PDT

As a part of our ongoing mission as a subreddit to broaden access to justice, we'd like to welcome Harvard Law School's Access to Justice (A2J) lab, which aims to create evidence-based guidance to help our justice system broaden its ability to help those who are unable to afford lawyers. They will be hosting an AMA on Wednesday 5/2, with questions opening at 11 AM EST (8 AM PST), and answers starting around 2-3 PM EST (11 AM - noon PST).

The A2J Lab's vision statement: "By providing decision-makers with credible evidence about what works in access to justice, we can make the system work better for individuals and families who are unable to afford lawyers. This kind of information—the kind that comes from randomized control trials and rigorous qualitative evidence—will allow people with the power to make change to implement solutions that really make a difference."

    [Update] Delinquent Child Support Case

    Posted: 27 Apr 2018 10:34 AM PDT

The TL;DR is my father is a truck driver, moved around a lot, and switched jobs whenever child support caught up with him. He saw my brother and I about two days a year, much less than the two days per week the child support was based on. He ended up owing $90,000 + interest for delinquent payments, which ended up at around $450,000. He was set to inherit a lot of money from my grandmother, paid $2,000 monthly so he wouldn't blow it.

    https://www.reddit.com/r/legaladvice/comments/84i2i4/ca_delinquent_child_support_case/

Court dropped the initial amount owed due to a court filing error during the divorce, which made my parents legally married for about a year and a half after they had submitted divorce paperwork (CA courts say 'oops!') Final agreed upon amount was ~$390,000. My father disputed this amount, but never submitted any evidence (because there was none) so that amount was final.

2nd court case today for the inheritance money, where my mother was made a plaintiff. Father tried to claim he worked for my grandfather, and my grandfather paid the child support for him (neither of those are true) but I guess he forgot (lol) to mention that during the Child Support case, and the judge didn't want to hear it. Also claimed he has a great relationship with both of his sons (I stopped talking to him when I was 13, which is more than half my life ago, and my brother doesn't really know him so well since he was gone basically my brother's entire life.)

Judge ruled totally in favor of my mother, so the $190,000 my father was set to inherit is being given directly to my mother. Judge also ruled my father has to continue paying $700 a month, which is what the previous Child Support hearing had determined due to the $2,000 monthly payments he was originally supposed to receive in inheritance money.

The best part is my father tried to settle out of court for $25,000.

My mother is elated. My father has been mocking her for years over this, telling her she would never get her money. My mother never spent any money on herself, and instead tried to make sure my brother and I didn't miss out on anything because we had just one parent around. She has almost nothing for retirement now, since she had to take out of her 401k a lot and since she got laid off 6 months before she was eligible for retirement.

This is pretty much the best thing that has happened to my family in quite some time. I don't live by my mom, but will be sending my brother some money to buy a nice bottle of champagne.

(MO) Dad is trying to get custody of my siblings but if he gets it responsibility for my handicapped sister would become solely mine.

    Posted: 27 Apr 2018 03:51 AM PDT

My parents got divorced 3 years ago, I am 19 going to college and working and my mom currently has majority custody. My 2 siblings go to my dads every other weekend but I rarely go because his girlfriend doesn't like me.

My youngest sister is on the autism spectrum and will sometimes at school have outbursts at school where she strips completely naked and throws things. When this happens the school calls my mom, my mom has to take off work and go pick her up. This happens anywhere from once a month to three times a week, last week my mom was called 4 times.

My mom has a job where the boss understands the situation very well and allows my mom to work from home on days she has to leave for these, go to IEP meetings, go to therapy appointments.

My dads job is union factory work where he can't really take off in the middle of a shift, and is unreachable while he is at work, he also would have to use sick days/ PTO for her appointments so he wouldn't be able to go to those.

My father is currently going to court to get primary custody of my sisters because while my parents were married my mom was an alcoholic and he doesn't believe she has changed. (She has, stress makes you drink Isnt that funny.)

I asked him about my little sisters care and his job and he said that I would just have to step up and do it and be a good big sister. I'm in Pharmacy school and also work at a restaurant to help pay for it and I would not be able to leave Either of those multiple times a week when she is having outbursts.

My sisters are being represented by a guardian ad litum, but since I am not a part of this custody battle she only personally spoke with my sister who is not challenged. And I only spoke with her during her group talk with both of my parents and both of my siblings when she was first hired. So she is representing them in court to the judge.

I sent her an email about my concerns and the only reply I got was that since I wasn't one of her clients it wasn't appropriate for me to talk to her about the case. Where would I go to tell that I wouldn't be able to take on these responsibilities?

Whenever I am free I will pickup her for my mom or drive her to school from a therapy appointment but with my dads job they would be calling me at all times of the day to get her, and with summer coming it would only be worse because she does not last in daycare for long and we have to change daycares all the time.

I am afraid that my dad will get custody because his girlfriend is a lawyer and they have a bigger house and their kids go to a better (public) school than my sisters do.

My sister is my whole world but I can't put my future on hold for her because I know that when my parents pass I will need to be making enough to support her anyways.

    EDIT

Also during their marriage my mother is the one who worked the whole 16 years while my dad only had a job for like 3 years out of it. my mom was making about 90k before she started having to take off so much time and be a single parent and change jobs.

Now she still makes a good wage (we are stable and can afford very good care for my disabled sister she has a psychiatrist and a therapist and a physical therapist and goes to really good autism things) and he makes substantially less.

Just saying so no one thinks she is one of those moms who only has custody because she is a woman and not because she was the one who provided for us.

    EDIT 2

Question: is it legal if the school calls one parent (who's parenting time it is) and they do not respond for the other parent to be called and pick them up?

With custody how would that work? Like would he have a case for her overstepping her time boundaries to pick up my sister when it was my dads day with her?

[MO/CA] My dad wants to try to get my sister arrested for marijuana use.

    Posted: 27 Apr 2018 05:58 AM PDT

I'll try to keep this brief:

My dad and my older sister are severely estranged. He is very sexist, and believes a woman's place is in the home - she left home at 18 and has a good career in California.

In CA, my sister has started using marijuana to help control her anxiety. She is a whole different person, and a lot happier, with it, so I don't have a problem.

My dad recently found out because our great grandmother (who is terminally ill) was talking to my sis about bringing some out for her since it's supposed to help w/ pain management.

My dad heard, and has been desperately trying to find out when my sister will be in state so he can call the police on her.

I warned my sister, and she reassured me she's not so stupid as to bring marijuana into MO, but my dad insists that they'll test her, and she'll test positive, and she'll be arrested anyway.

Is this true? Should I try to get her to cancel her trip to come see the rest of the family, to prevent her from being arrested? Or will they not arrest her in MO for drug use that occurred in CA?

Just got served with a lawsuit seeking $15,000 in damages for leaving a 1 star review

    Posted: 27 Apr 2018 07:05 AM PDT

I gave 1 star to my old employer on their Facebook page and on Google. Today I was served with a lawsuit seeking damages up to $15,000. I didn't write anything, I just gave 1 star. They claim my review is false because I was a former employee and have never utilized their services. Multiple members of my family have. They suck. Am I really not entitled to a review? What could happen here?

My Neighbour added all these beehives to our property access when he found out my other neighbour was selling her house to care for her ill father.

    Posted: 27 Apr 2018 05:45 AM PDT

    Hi Folks.

This is quite a difficult one. But the long and short of it is. I live in house that has a shared access. Each house owns part of the land in front of their house over which the access path crosses. So to walk to my house, I have to walk along a path that passes through some land that is technically my neighbours but the deeds state we all have right to pass unhindered via the public access.

Anywho. My next door neighbour decided she needed to sell her house to be able to move to live together with her father who had become quite ill. As soon as this happened my next door neighbour on the other side started adding lots of beehives to our access path.

Not only does this make access difficult but everybody who comes to view my neighbours house, immediately sees the beehives and whilst they comment that they really like the house, they would never think about buying it because of the problem with the neighbour, the access and the bees!

My question is this. Is there anything in law, that states one person cannot do things to make it more difficult for another person to sell a property. Should this be proved it's their intention.

Secondly are there any laws in regards to beehives being place on or very close by public access paths.

Thirdly, are there any laws as to the minimum amount of access one must be provided with?

    Pics provided below.

PA: Adult Protective Services lost my uncle

    Posted: 27 Apr 2018 07:07 AM PDT

My mother's brother has significant mental and physical deficits (schizophrenia and brain damage from an accident,) is fully disabled, and all decision making was the responsibility of his mother (aka my grandmother.). Recently my grandmother went into the hospital and died. When my mother found out that her mother was hospitalized, she immediately called APS, as she could not physically make it out there right away, and he is unable to carry out normal activities, such as preparing food and taking his medications on schedule. APS did visit. The house was in a state of squalor, hadn't been cleaned in years, and was infested with bedbugs. But he was allowed to remain in place, pending a psychiatric evaluation for capacity, because he said he did not want to leave. Shortly thereafter when my mother arrived, she could not find her brother, and he has been gone for more than a week. This is in a rural area. Hospitals and shelters have not seen him, and he has no money to travel anywhere or purchase any food. My mother is understandably seething at the case worker for leaving a vulnerable adult without food, medicine, or any other means of caring for himself. Are there any legal remedies for such a case? At this point we are thinking he is probably dead from hypothermia.

I am cleaning out my elderly grandfathers house and have stumbled upon thousands of rounds of live ammunition. I need to dispose of this properly and don't know where to begin. Am I legally allowed to sell the ammunition? San Luis Obispo County, CA

    Posted: 27 Apr 2018 09:32 AM PDT

My 95 year old Grandfather recently acquiesced and realized he could no longer live alone. He is currently on the road to New Hampshire to my mother's house where he will live. I have been sent to his house in California to clean it out and get it ready for the realtor. My Grandfather has collected guns his entire life, and we hired an auctioneer that specializes in firearms to get rid of his collection. However, I am still left with thousands of rounds of live ammunition, reloading supplies - including bags of gun-powder, and other firearm related supplies. Am I legally allowed to sell ammunition without conducting a background check? Could I sell it to a gun store or anyone with an FFL? Any and all advice is appreciated.

UPDATE: Thanks for the help. She got the abortion.

    Posted: 26 Apr 2018 06:32 PM PDT

    Original

Thanks so much for the help. We contacted Planned Parenthood. I told her that I had to stay out of it but I would help her through with costs and finding the resources as well, technically I am a rapist under the law. She called Planned Parenthood, told them about her situation. Someone suggested I make sure the call is not recorded so we requested for that and they assured her it was not recorded. They did tell her that she needed to notify her a trusted adult but she decided to try and opt for a judicial bypass. They also asked her about the father of the child but before hand, we agreed to a story where she does not know the father at all. I had the money, but I was not sure if I had enough for a lawyer so I referred her to Illinois Judicial Bypass Coodination Project and she was able to get a free lawyer and the judge granted her the judicial bypass right after the hearing, thankfully. In some cases, they can wait up to 48 hours but the judge was awesome and granted her the bypass immediately after the hearing. She was able to get the abortion the next day and I gave her the money she needed.

Thanks so much for the help. The process was fast and easy. I was able to avoid potential charges and she was able to get the abortion.

I re-signed a lease with an apartment and received $300 bonus, they were bought out three months later and now want their bonus back?

    Posted: 27 Apr 2018 11:07 AM PDT

    This is in Texas:

I live in an individual lease town-home where the tenants pay by bedroom. I resigned the lease in December and I received a $300 bonus for resigning and a promise that they will not increase my rent. In March, they announced that the complex was bought out by a different company and therefor all the re-signed leases has been revoked. They were going to increase the rent and rent out each unit instead of the bedroom. So I sent them a email, letting them know that I will be moving out in July when my original lease will be up. Just today, the old manager/company announced that everyone who received the bonus from resigning must return the money to them. Isn't the bonus supposed to be a gift? How should I have known that the apartment was going to be bought out by a different company? Are they allowed to ask for a bonus back?

UPDATE: 4:03 PM - My friend called the manager about the issue and they put him on hold. He is going to the office right now to show them our contracts. I will update later tonight on what management and corporate office says to him about our contracts and the bonus we received.

My 8-year-old's teacher told her to "commit suicide" to solve earache.

    Posted: 26 Apr 2018 05:45 PM PDT

My 8 year old daughter goes to a private Montessori school in South Carolina (US).

She told her Spanish teacher that her ear was hurting, to which he replied, "Commit suicide. Then it won't hurt."

My daughter was uncomfortable about this and told me as soon as she got in the car. I called other parents in class to have them talk with their kids about hearing anything "strange" that day. Three kids have corroborated the statement directing my daughter to "commit suicide" to solve an earache.

Is this illegal for a teacher to do (South Carolina private school), and what should I do (if anything?) I've already reported it to administration. Administration interviewed all kids. They said they will sit down with the teacher Monday.

I don't even know what to do with this.

My boss told me I have to clean out recycling bins by driving them to a wastewater treatment plant to clean them........

    Posted: 27 Apr 2018 12:16 PM PDT

I work at a convent(place where nuns live) in Wisconsin USA. I am a floor care technician. I clean floors all day long. Another job my department has is taking out trash and recycling bins. Sometimes I help with this and once a week we clean recycling bins. There is a boiler house across the street with a wash bay in it. The guy in charge of said building decided he didn't want us using the wash bay anymore. The COO of the convent them ordered us to use a room at the wastewater treatment facility owned and operated by the convent. I was given a key and directed toward a maybe 12'x14' room with a drain and hose. Also in this room is an auger funneling human waste into a five gallon bucket. Also electrical panels and grates on the floor leading to the slurry that I was suppose to open up and hose the water and filth into. This seems a health and safety hazard. It smell's horrible and was making me feel sick. Is this legal?

Court clerk didn't let me change my last name after marriage

    Posted: 27 Apr 2018 03:43 AM PDT

Yesterday my fiance and I went to get our marriage license. Because my husband has his last name as his mother's last name and father's (example: Michael Brian Jones Anderson) the clerk told us if I was to take his last name after marriage, it would be both of them and not just his father's (or the one he goes by, Jones) because his foreign passport has both. His other three brothers whom were married in another town/city never had this issue, and taking his last name was very important to us. She told us to take it or leave it. She was already very unpleasant to us. I figured if I'm paying for this license, shouldn't I choose to take my future husband's last name? She said we can go to court in the future to get that fixed once he gets a new passport with just "Jones" on it. We are getting married in Staten Island and drove hours for this, so future husband suggested I just signed the No New Surname license because he didn't want to argue with her, and I left upset. I don't think I should pay $200 in the future and court costs to get this fixed when I could do the name change easily with the marriage license. What should I do? I'm thinking of speaking to someone else in that court house.

I'm being sued for a car my father bought for my mother.

    Posted: 27 Apr 2018 07:27 AM PDT

I am a bit panicked and confused, I am sorry ahead of time time if this post is spastic. This is the first time this has happened to me and haven't slept much from nervousness..

I live in Las Vegas. Just came back from vacation and find stapled documents in the mail saying I'm being sued. From what I am reading I am being summoned to court Tuesday May 1st.

The Attorney for this company (Ally Financial) suing me is saying my father has not paid car payments in over 6 months, and '' upon information and belief, you the daughter is in current possession of the Vehicle''.. and that is all they wrote about me.

My father bought this car for my mother, I never drove it. I guess my mistake was buying a new battery for it 6 months ago for my mother, she never told me he had stopped paying for it though. This is the last time I saw the car. I had moved out living with my boyfriend and barely had contact with my family because I was always being asked for money.

My father apparently took the car to Alaska, according to my mother, where he lives and works. Neither I or my mother can get in contact with him.

I left a message on the attorney office machine (they had closed already) saying verbatim '' Hi please contact me as to why I'm being sued for a car I don't own nor has my name on it? '' and left my number, I probably should have not done that but I wasn't sure what to do, I am still not sure what to do...

Thanks again for the help, I could really use it right now. I don't want to go to court over something I don't own or have..

[Colorado] debt collector going after me for my deceased wifes medical bill.

    Posted: 27 Apr 2018 10:32 AM PDT

My wife passed a little over 9 months ago after some ER visits and time in ICU, so she had quite a lot of medical bills. After her passing, when I sent out copies of her death certificates all her medical bills but the anesthesia bill were dropped. That bill went to collections and when I got a collections notice in her name I sent a death certificate, shortly after that I get a collections notice in my name for the exact same account. I called and the person I talked to wouldn't even explain why I'd be responsible and just said now I'm liable for her debt.

I'm waiting on a contact to get me their lawyers info to have a consult, but wanted to ask here to try to be as informed as possible.

As far as I can tell debt collectors can try to use the Family Purpose Doctrine to force spouses to pay their deceased partners medical bills, but in my personal research I haven't found anything that makes me feel like it's concrete.

Am I liable for her debt?

If so, will paying this make other debts that have been dropped come back?

[Update][PA] Neighbor kid got bit by stray cat that hangs out in our backyard and had to get rabies shots. Parents want us to pay.

    Posted: 27 Apr 2018 02:03 PM PDT

    Link to original post

So, the mom brought over a hospital bill the next week, like they said they would. I refused to take it based on the advice I got here. She wasn't happy about it, but she took it better than I expected, and I thought maybe that would be the end of it.

Then, two days ago, we got a letter from a lawyer's office saying we have to pay the neighbors $2200 and some change or they'll sue us. I googled the name on the letterhead and they're a real law firm, but they're located in a town almost an hour away from Philly, which to me seems weird because there's tons of law offices more local.

Also weird is that the letter says the kid was bitten by a dog rather than a cat (we don't have a dog either). At first we thought they had hired the most inattentive lawyer of all time and it was just a mistake, but then I started thinking about how people on the first thread were saying that cat bites usually don't require rabies shots, and animal control would have come to quarantine the cat until they were sure it didn't have rabies if they were concerned about it. Now I'm starting to wonder if maybe they really are trying to run some type of scam.

Luckily, my dad has a friend/regular customer who's a lawyer, and he said he would help us write a response letter. He said that based on what my dad told him, it doesn't sound like they have much of a case, but we're going to meet him for dinner at my parents' house Sunday and explain the whole story to him then.

Thank you everyone for all the excellent advice! If anything else noteworthy happens, I'll provide another update.

Roommate leaves mid lease with 5 days notice, forcing us to come up $700. Is this legal? And if not what can I do?

    Posted: 27 Apr 2018 03:34 AM PDT

Tldr: roommate was unhappy and went behind our backs to work out new living arrangements with landlord, but only decided to tell us 5 days before rent was due.

Our shared rent is $829, just today our roommate dropped the fact that she will be moving out by the 1st of May, but both of us signed the same 7 month lease. Is there any possible way that she was able to get out of her lease and leave us with the remaining 3 months of rent, her half totalling to $1258.50 + $300, a brand new deposit since she was the one who put down the deposit in the first place. I know my first step is to go to the land lord and get a copy of the lease agreement, after that, I am uncertain how to go forward. I am more than glad to be rid of a bad roommate, but this is a heavy financial burden that literally takes food out of my mouth. I need advice on how I can proceed, feel free to ask for any additional, non-identifying, information.

FL- Teacher unable to pump milk

    Posted: 27 Apr 2018 11:46 AM PDT

Florida - I am teacher and I have a newborn who is exclusively breastfed. I need to pump 3 times a day minimum while at work. As a teacher I am unable to just leave my students, so prior to coming back to work I set up a schedule and informed administration of my needs to pump and times - just to make it easier for everyone. This week either no one has come to watch my class, leaving me unable to pump and VERY uncomfortable, or they send someone in the last 10 minutes of class which is not enough time for me to even get to where I need to go and set up. All they say is "oh sorry", but this is getting ridiculous. Is there anything I can do? (not sure which flair to use for this one, sorry)

Edit: This is also a throwaway account.

(Thailand) I bailed an Australian tourist who was accused of theft. He now wants to return home without fighting the case. Is this legal?

    Posted: 27 Apr 2018 07:30 AM PDT

Hello. I am not very familiar with legal procedures, so sorry if this sounds obviously illegal. I really do not know.

An acquaintance was accused of theft at a night club in Pattaya. He was sent to jail last week. A few days ago, I bailed him out for 100,000 THB. He now wants to go back to Australia.

He said that he understood that he won't be able to get out of Thailand (since Border control would know that he is arrested) but he was rather convinced that if he drove to Cambodia, then flew home to Australia, he would be safe and his arrest would not apply there.

My questions. 1) Is this legal? Would this work? Would he not be denied entrance at the Australian border and sent back to jail in Thailand?

    2) If he does indeed escape, and therefore does not show up at court, what would happen to me, the person who bailed him out?

    Thank you for any advice.

Ex-Wife is sending my girlfriend explicit pictures of me

    Posted: 27 Apr 2018 05:15 AM PDT

My Ex-Wife is sending my current girlfriend pictures (nude) that I sent here while we were still married. They were intended to "spice things up" when things were going downhill before we decided to get a divorce. I live in South Carolina, and have told her multiple times that I did not want her sharing any photos, emails, text etc. that I have shared with her during our marriage to anyone ever. Her goal is to ruin any relationship that I have even though we are divorced. Any legal advice would be greatly appreciated. I need to find out what I can do about her sending the pictures of me to anyone without my permission. I believe there are states that call this revenge porn? Thanks for everyone's help!

Neighbors from Hell, how to proceed.

    Posted: 27 Apr 2018 12:24 PM PDT

Ok so we recently had some new neighbors move in and they are the absolute worst, theyve accused us of treating our animals poorly. Called animal services and when they showed up he just said we were fine, they called code enforcement on us because we had a bunch of wooden slats in our yard to repair our fence which their dog is breaking. Now ive taken a firm stance of ignoring them no matter how shitty they act, there has been verbal alterations before where the male on that side of the fence tries to goad me into stepping off my property so he can attempt to assault me, its gotten to the point where nobody can venture outside, especially my kid, without fear of one of them starting a ridiculous argument over the fences. I know this is all petty shit and frankly i dont know how to deal with it anymore, the landlord could give 2 fucks and has been out here during one of the altercations. Id like to know what steps can I take to initiate some sort of harassment suit or something because it is almost everyday one of the members of the household is subjected to berating comments and accusations of attempted murder and racism and its just gpttem ridiculous, i dont feel safe in my own yard, i dont let my kid play outside anymore. Any kind of help would be deeply appreciated.

    Edit: location is Texas

Edit 2: cops have been called out 3 times. I have been recording neighbors behavior, as instructed by the cops. The cops have refused to issue us restraining orders, and this spurs from the female who lives next door, after she had attempted to assault my pregnant sister in law, while she had a kid in her hand, they've threatened with weapons in hand, but cops say nobody has proof of who did what so they couldn't do anything. They are extremely aggressive and the have even made up lies about how I tried to run them off the road one day, but for some reason never called the cops about that incident. We dont wanna have to keep calling the cops out for stupid stuff like this, they have more important jobs to do then dealing with crybaby neighbors. I just want some kinda advice, i thought it had calmed down for a bit but I really dont see an end to the constant shit talking thru fences.

I bought a Lemon, and I don’t know what to do.

    Posted: 27 Apr 2018 04:58 AM PDT

Mid February, I drove from my house in MA and bought a 2006 RAV-4 in Connecticut, private sale. It had 131100 miles at the time. I bought it for $6500. The other day I checked the oil to be safe and - empty. Completely empty. I was lucky the car didn't blow up. Turns out it's a problem with the piston rings, and it's $3500 to fix - half the cost of the car. I'm a 17 year old high school senior and I spent my entire life's savings on that car. I don't have nearly the amount of money to fix it. It is driveable, I just have to pour $40 worth of oil into the car every 1k miles. My question is- since I'm from MA but the sale occurred in CT, which lemon law is this sale under? And does this even qualify? I've put about 1500 miles on the car. Thanks so much.

UPDATE: I spoke with an attorney yesterday. I think I should get paternity established and things are looking good!

    Posted: 27 Apr 2018 10:17 AM PDT

    MI Last Post.

First and foremost, I'd like to apologize to any and all lawyers on here if you were offended when I called all lawyers "greedy bloodsuckers". That's not true. You guys are just doing your job and have stressful lives. Sorry for that.

I contacted a Family Law attorney in my county. The mother and I live in the same county so I did not have to look for attorneys in other counties. I scheduled an appointment with him and we met and discussed my situation on Thursday.

Prior to the appointment, I decided to reach out to my potential Baby Momma, maybe establish a paper trail. She slipped up big time. I once again asked her if her daughter was also mine and she said "maybe". Immediately after that, she said "No" and told me that I cant get a test no matter what and told me to stop contacting her. There was more stuff but that was the gist of it and I screenshotted everything she sent me.

I talked to my lawyer about it and we will be seeking a court ordered paternity test and will file for a Paternity Case. Hopefully it doesn't take too long.

I also talked to him about the future and if she really is my daughter. I told him about my alcohol use, my drug use, and my prior anger management issues. I think, regarding alcohol and drugs, I should be fine. I drink maybe once a week and I do drugs like once a month and its just Marijuana. I also told him about some of my prior instances where I lost control. I did not leave any marks on her but it MAY be possible that she will claim domestic violence and try to get me declared an unfit parent and possibly press charges. Fortunately, it's been a year since an incident like that with anyone and I have been seeing a therapist for the past few months.

I'm pretty confident she's my kid. Now that I think about it, everything makes so much sense. Ever since she got pregnant, she has been a lot closer with me. We see each other almost every week, sometimes more than once a week, and she has no problem bringing her daughter with her, letting me play with her, and things like that (until now). Some people might say, oh she's trying to use you for money!, but that's not true. Not once did she ask for me to pay for anything yet she was still extremely comfortable letting her 2 year old daughter around me. Even when I used to get a little violent with her, she still remained in contact with me and continued to see me. She has also not had a long term boyfriend since pregnancy. I cant believe this completely flew over my head. I think she is afraid of giving me custody because she is afraid of me maybe losing control and hurting her or something like that, and that's a totally valid concern. I never left marks on her but well... I did slam her into a wall in a fit of anger... I can see why someone would be scared of letting a person like me get custody of a small child. As I have said though, I've gotten a lot better and it has been at least a year since an incident like that. I also have a therapist and that helps a TON!

If she is my daughter, I plan on only seeking supervised visitation (or maybe normal visitation if possible) until some of my more personal issues are sorted out and she is a bit older, hopefully she realizes I just want legal paternity established, some closure/peace of mind, and some visitation for now. I'm not trying to steal her child.
