Landlord showed house and stuff was stolen. What can I do? Posted: 09 Mar 2018 07:18 AM PST I recently returned from spring break to discover that my landlord did a house showing of my house. My door to my room was locked with a deadbolt and has no evidence of tampering. So I'm ruling out a break in. I am now missing 2 watches and a necklace I had bought for my girlfriend. Valuing at around 3k total. They were sitting on my desk so I'm assuming that my land Lord was not watching whoever he was showing the house when he opened my room up. What can I do? I was given no 24 hour notice prior to showing and none of my roommates were home. I am located in mn. [link] [comments] |
Posted: 09 Mar 2018 02:24 AM PST Just like the title suggests, I signed a sublease with a former tenant at an upstate NY residence. After 4 hours of meeting the current tenants/roommates, and really friendly interactions with them both, they told me I needed to leave. One of them wanted to give me a week, the other wanted me to leave immediately. They said it was because they weren't comfortable with my payment method - a public assistance grant through the Department of Social Services. They never would have had to worry about me paying my rent, as it's an automatic payment to the landlord. The landlord agreed to accept this form of payment, and the previous tenant I signed the sublease with agreed to this also. Both current roommates agreed to this as well. I did not violate any terms of the lease. One of the roommates let it slip that "well, people who use public assistance don't like to pay their bills" and "I just get 'bad vibes' from this whole situation." After hearing all of this, I went outside to decompress with a cigarette. Halfway through it, I hear the front swing open and see one of the girls toss my things, a duffle bag and my toiletries bag out on the front porch, then locked the door behind her. (She also giggled and just said "byeeeeeee!" while she did that. Not incredibly relevant, but still weird as hell) I obviously didn't stay, so as a result of this, I'm homeless. A lot of time and money was wasted to make this lease happen. This seems discriminatory, and it doesn't seem legal. I'm also concerned about being liable for any future rent since I already signed the sublease. Can they legally be held accountable for this? Edit: some spacing so it's not just a giant wall of text EDIT 2.5: Added some important info Edit 3: Made contact with roommates, told them I need a signed written statement terminating the sublease agreement. Otherwise I show up for my key back with the police. They're writing the statement now [link] [comments] |
[NY] Can family court judges refuse to let you present your side? Posted: 09 Mar 2018 06:56 AM PST Judge is trying to close my case. It's really complicated, but I haven't even been allowed to present any witnesses or evidence. Besides appealing, what can I do? [link] [comments] |
Daughter being harassed by 3 boys (15 year olds) Posted: 08 Mar 2018 10:30 PM PST So, my daughter is being harassed by three boys every day when she gets off the school bus in the bay area California. In the city of Pleasanton. I found out today that she has been asking them to stop consistently. More than 10 times and they don't. Basically, they stand on the sidewalk, wait for her to walk over and the three of them say things like, he likes you, he's infatuated by you, he wants your number. It's more repetitive than sinister. This has gone on for 10+ weeks and I'm worried that it may start affecting her. I asked her honestly if she wanted it to stop and she said yes and yet can't do anything to stop them. I want to understand what is acceptable from a father's perspective. Here are options that I can think of. 1) I can stand at the bus stop, introduce myself and ask them to stop harassing her otherwise I will notify the police and the school. 2) I can go with a couple of my friends to do exactly what I planned in number 1) but have some assurance that I won't be beaten up. 3) I can go to the school tomorrow and let them know about the problem. 4) I can call the police and ask them for help. If they were willing to wait at the bus stop, that would be amazing. At this point, I'm favouring number 2) because it seems to be the fastest solution, but, it is also the one that seems most likely to get me and any of my friends into trouble with the police. I wanted to ask the community what they suggest as the best way to deal with this problem. The harassment only happens after my daughter gets off the bus. It's non physical address far as I know but it's continuous and it's always coming from a pair or three boys. [link] [comments] |
Can an employer force you to create a LGBT ERG? Posted: 09 Mar 2018 08:59 AM PST I am one of two openly LGBT employees at the company I work for. As in my team know but I don't go around talking about it. I work in production compliance and don't do anything with HR, PR, etc. My company decided they wanted to be more LGBT friendly and are now forcing myself and the other LGBT employee to create an employee resource group (think gay-straight alliance or a LGBT focused employee gathering). My direct manager and the head of HR have both sat me down and stressed the importance of this. They have now started threatening my bonus if I don't make the group. Can an employer force LGBT employee to make a very public LGBT group? Edit: Location; New York, United States of America. [link] [comments] |
Help! Wedding vendor is threatening to charge me for items I’m positive we’re returned Posted: 09 Mar 2018 01:41 AM PST
Location: New Zealand Hi Guys, Could really do with some advice here! To complete my table settings for my wedding, I rented a collection of vases to use as centrepieces. My quote says that I paid for 25 vases in total. My vendor has now come back and said that they gave me 27 vases and only 21 were returned. I'm absolutely sure I counted 25 upon return. I have a written statement saying I paid for 25. She's now threatening to charge me for six missing vases. At this point it's her word against mine and I just don't know how to proceed. I'd normally just pay for the damn things, but she's saying that the vases are vintage and will cost over $100 each to replace. I should've counted the amount the moment I received them but I just trusted that I was given what I paid for, which was my mistake. This is just the biggest regret for me so far. So now we're at a bit of a stalemate where she wants to invoice me for the items, but I don't feel like it's fair when I know I returned all items that I was given undamaged. I'm afraid if I don't pay she'll send some debt recovery agency on me. I had such an amazing magical day and I feel like dealing with this vendor has just put a dampener on the whole experience. Would really appreciate it if anyone has any advice for me on how I could proceed. [link] [comments] |
Is what the body shop doing legal? Posted: 09 Mar 2018 06:20 AM PST Rhode Island I crashed my car and the body shop agreed to do the job. My insurance covered it but they wanted to total it because it was so close to the maximum payout. So, it was close but the shop agreed to do it. So my deductible is $1,000 and the work was all done. I was told I owed $1,000. So yesterday they tell me that when they were giving it a test drive they noticed that the windshield wiper motor was busted and it was pulling to the left and needed a new tie rod. So they want my deductible plus another $400. I said they insurance should have covered that and they say that with that it would have been totaled. He's the shop owner and also tried to pressure me into paying cash and when I insisted on a check he wants it in his name not the company name. Help. [link] [comments] |
Gun pointed to my head in the workplace [Illinois] Posted: 08 Mar 2018 07:06 PM PST I work in an environment where others frequently clean their guns during down time (absolutely ridiculous but I need money) today a co-worker who has a history of mental health issues (suspended from school for shooting threat, firearm taken and put on desk duty when they worked for customs) was cleaning his gun in the room where our workstations are. We were the only two in the room and he pointed the gun at my head and turned on his light on and said, "Light Works." Then went back to messing with his pistol like he didn't just violate basic gun safety. I kept my cool but was freaking out internally and I tried to just forget about it. Two minutes later he did it AGAIN. This coworker has severe anger problems and I didn't want a confrontation while he had a weapon, loaded or otherwise. There were no other witnesses but I feel like there must have been some laws or OSHA rules at the very least broken. I shouldn't feel like I'm on a co-worker's hit-list simply for being in the same room as him. What options to I have? [link] [comments] |
Car accident my dad caused that brother is being charged for after selling the car to sister Posted: 09 Mar 2018 04:04 AM PST So a month or so back my dad took out my sisters car that had not neen registered yet or had insurance. This car my brother sold to to my sister. The reason the car had no insurance or title on her name is because she was working on getting her drivers license. In texas you need that before you can get insurance and before you can register the car under your name. So my dad decided to take the car out and gets into a wreck. He rear ends the person and cops show up. The person gets my dad's info (not knowing how he is going to pay for any of this out of pocket). A few weeks later my brother who sold the car gets a letter from the person who wAs hit insurance company saying he will be charged. We told our father and he said he got an attorny to settle out that it was him and he should be charged. Later on down the road about a month later my brother gets another letter from the same company saying that he has to pay over 2000 within 30 days or it will go to debt collectors. We told our father about this thinking he already sorted it out. He said the court day isnt until june 6 this year. But being that my brother has 30 days is this still going to be charged to him? Our dad keeps saying they are trying to scare him to get him to pay money, and that him having an attorney will fix it. The problem is we are having a hard time trusting him because of the fact we got the letter, and this isn't the first time he bs'd his way out of paying for something in the house. He works crappy contractor jobs and barely has wnough for house bills. This feels just like something he would throw onto us so he wouldn't have to pay for anything. Can i please get some advice. Should my brother contact the insurance company, and let them know who was involved in the accident? That charges should go to my father? Edit: I want to thank everyone for your help. It really did clear up a lot. Ultimately my dad/sister are going to have to pay my brother the amount owed to the insurance to prevent having having his credit ruined. That is something they will settle out. There was a lot of carelessness between my brother/sister when it came to getting paperwork done, and my sister allowing my father to use the car when nothing was completed. Something I found out. This whole situation is just messy and upsetting. Thanks again everyone for your help! [link] [comments] |
My ex-wife is threatening to kill me. What can I do? Posted: 09 Mar 2018 09:39 AM PST About a year ago my wife and I got divorced because of her infidelity. The divorce was just awful. It really hurt both of us and our kids [15F and 16M] went through a lot of emotional pain. We live in the same city and have 50/50 custody. Lately, my ex has been threatening to kill me. After our divorce, I told my kids about her infidelity (with proof) and they decided to cut off their mother. They don't speak with her and hate having to spend time with her. My ex was obviously angry at this. She is saying things like "I ruined her life" and says she will kill me for it. I've documented all evidence. I will try to get a restraining order this weekend but in the mean time, is it possible to request for police protection or maybe have some cops monitor her? [link] [comments] |
Repeated Car Door Dings From Apartment Garage Neighbor Posted: 09 Mar 2018 05:32 AM PST EDIT: State of residence - AZ Hey everyone, For the past few months, my garage neighbor in my apartment complex has repeatedly dinged the side of my car with their doors and I was wondering what, if anything, can be done. The garage itself is somewhat cramped on my side (my driver's side door is against the wall, and I have to wiggle to get out if I want to leave enough space on the passenger side), but my neighbor has plenty of space to park. They consistently park on, or within an inch or two of, the line. I've left notes on their car to please park evenly between the lines, but haven't been able to meet face-to-face as we seem to run on different schedules (I leave for work early in the morning, and their car isn't there when I get home in the afternoon). I've taken several photos to show this, and the apartment management is aware. Since I'm not sure if management could do anything, what recourse do I have? Thanks! [link] [comments] |
[update] Extreme Door-to-door Solicitation Posted: 09 Mar 2018 01:30 PM PST First, thank you Legal Advice for helping with my little problem. Once again, the collective minds here are invaluable. For those of y'all that commented and I didn't reply, I apologize. For reasons beyond my understanding I didn't receive notifications of comments after a while and I assumed my post had been buried. I'm sure I did something to make that happen, but what, I don't know. My Original Post wasn't a hugely fun or exciting post, but I want to provide an update for those interested. The first order of business was whipping up a cease and desist to the company in question and made sure that they understood, in no uncertain terms, that I would no longer tolerate their trespass or harassment. I sent this certified mail with signature confirmation the day of my post. Next, I visited the police station in person and after having been asked to sit and wait and after being passed from person to person for over three hours, I was finally heard and assured that the next time I called my complaint would be handled appropriately. I also left him a copy of the cease and desist I had sent along with a flash drive containing surveillance footage from my home showing the harassment and whatnot. I'm a bit of a digital packrat and just happened to have almost every encounter with these reps filed away. I also gave him a copy of my log that I began keeping about a year ago which included encounters with the reps, the company calls Amanda discussion notes, as well as the dates and times I have called the non-emergency police line, officer names, and the "solutions" they suggested each time. The day after I received confirmation that the company having received my cease and desist, I had two representatives at my door. I did not open the door, I spoke through them front door camera telling them that I had called the police for trespassing and that they were not welcome. One kicked my door, calling me a c*nt and tried (unsuccessfully) to rip my camera down. They left before the police arrived, but I was able to provide them with a copy of the footage in short order. An investigation is now open and because of the behavior I was advised to dial 911 instead of the non-emergency if they show up again. So, I now have an official paper trail and hopefully I've seen the last of these people. Thanks again for the quick and helpful advice! [link] [comments] |
Posted: 09 Mar 2018 10:11 AM PST In 2017, about 40 people paid a person with a reputable (or so we thought) consulting company to do some work for us. He collected our money, but before delivering the final product, we received a notice indicating that his corporation has declared bankruptcy. We were paying for his time and effort, so his overhead would have been very low and the bankruptcy really surprised us. The trustee has unofficially acknowledged that the major reason for the bankruptcy was that the consultant took our money and bought into Bitconnect, then declared bankruptcy after it went bust. The company has no assets. However, the consultant has several other companies that are thriving. The first meeting of the creditors is coming up in about a week where the trustee will officially deliver the report (from what I understand). The trustee seems to be implying (unofficially until the report is released) that there isn't necessarily any wrongdoing as the funds were received by the company and 'invested' into Bitconnect by the same company. None of the creditors were aware that our money was being used to gamble on cryto currencies. Do we have any recourse here? As I said, our money is gone and the company didn't have any assets. It just seems highly inappropriate to use our funds for something like crypto currency when that wasn't at all related to what we were paying him for. It also seems unfair that he was able to maintain financial health by gambling with our money and not his. We took all of the risk and he would have realized all of the gains. [link] [comments] |
[PA] Being threatened with a police report over a phone number spoofing spammer Posted: 09 Mar 2018 08:13 AM PST A woman left me a voicemail saying that she's going to the state police and filing for harassment, as well as suing me, for a student loan spammer that's been calling her while spoofing my number (she and I have similar numbers). After I texted her to try to explain that i have never called her and that she should block the number because it's a common telemarketing tactic, she stated that she's going through with filing today. This happened in my Sideline number. Will they be able to find my name? Do I have to hire a lawyer? What's my best course of action? Edit: I'm a Florida resident and this phone number is my second line in Pennsylvania [link] [comments] |
[California] Neighbor is about to tear down my fence. What can I do? Posted: 09 Mar 2018 10:34 AM PST My backyard is enclosed by a fence that was here when I bought my property several years back. My newest neighbor sent me a letter a while ago saying that a section of this fence is on his property, demanding it be removed. I figured he was bluffing and just didn't like the style or condition of the fence, so I ignored the letter. This week he had the property line surveyed, and it turns out he was right, but just barely. That leg of my fence sits on his property, clearing the lot line by a whopping inch. Just this morning I had a verbal exchange with him. He said he's going to take the fence down starting tomorrow, and sue me for the cost of the contractor and the survey. Can he do that, legally, without my consent? The fence has been there for years. I have dogs that use my yard. Am I SOL? [link] [comments] |
Tattoo shop owners asking my sister for money. Posted: 08 Mar 2018 10:56 PM PST I hope this is the right sub to post this. My sister is a tattoo artist, and until recently she was working in a shop in town that has 3 or 4 artists working from it. The shop provides the location, seats and a few basics, and takes a cut of every tattoo payment. Over the last month, some of my sister's work has been fading. She has years of experience and this is problem has only just arose. The owner of the shop paid another artist to rectify the faded tattoos, and is now demanding $1000 from my sister. I said to her I thought the owner should have contacted my sister and given her the chance to repair the work herself. My sister is supposed to be picking up her work tools from the store this weekend, and she is worried the store owner is going to demand the money. I would appreciate any thoughts or suggestions. Thanks! Edit: located in New Zealand [link] [comments] |
Issued subpeona for apartment I was legally removed from multiple years ago Posted: 09 Mar 2018 06:45 AM PST So back in 2015 I moved out of my first apartment because my best friend who was part of the lease decided to become a methhead and though i should pay his rent and assaulted me. Shortly after i signed the legal release forms to get off the lease but never received a copy. Fast forward to about a year ago I heard they got evicted because they refused to keep the place clean, didnt think much because I wasn't responsible for the apartment anymore (note i was not head of the household at the time). Back to now, my step dad recieved a subpeona issued to me and opened my mail without my permission (mailing address is his address because things got hectic after my mom divorced him) apparently another law firm picked up the residual debt of $7,000 in damages or something and since I was on the original lease they decided to try to pin it on me. I've already contacted the apartment leasing office for a copy of my lease release forms but they said it would take about a week because all the backlogs were in the garage, I also have a copy of the assault charges to back up my claim as to why i left, im trying to get a copy of the eviction notice with the attendants names to prove i wasnt on it but the office reffered me to the county police department of which i havent had time to go to yet because of work. I live in colorado what else should i do about this? [link] [comments] |
Grandfathers house may be condemned, how can I take ownership Posted: 09 Mar 2018 06:39 AM PST Hello, I grew up in my grandfathers house. He died in 2012 and his home hasn't had its taxes paid since. The title of the house is under him and his father who is obviously dead. The house is in very bad condition and in a few years I am sure it will be condemned. My grandfathers only child is my father who is a dead-beat. Is there anyway I can take ownership of the home if I pay the taxes? The property is in Texas btw. [link] [comments] |
This job posting seems... Illegal. Is it or is it skirting laws? [TX] Posted: 09 Mar 2018 08:11 AM PST Firstly, I'm not applying here, have no interest in applying here, etc. I just saw it posted in a jobs group and there is a lot of argument on whether or not these are illegal practices. As far as I understand, requiring knowledge of the Bible would fly if you're creating content, etc, but the rest seems sketch. Thanks in advance and I'm not sure how to tag this as employment law on mobile, sorry. [link] [comments] |
Posted: 09 Mar 2018 11:50 AM PST Myself and my ex are currently on the same side of a custody dispute against the father of her child. I have known and raised this child since before he was one, and I consider him my own even if he is not biologically. In an effort to make this as concise as possible, there will no doubt be things that need clarification. I am happy to clarify anything, but I am heading to work shortly so they likely won't happen for the next 8-10 hours. My son's biological father has been declared a vexatious litigant. This is due to many, many years of him abusing the legal system. He has ignored orders, sued judges and lawyers, been found in contempt and even thrown in jail overnight for his behaviour in family court. He is forbidden from bringing applications by three separate orders. He cannot obtain a lawyer, and as one of the orders bars him from appearing on his own behalf, it is very difficult for us to actually get anything done. For years, we have been pressing for his visitation to be fully suspended. Currently, he can only see his son under extremely strict conditions, and he has been unable to meet those conditions for two years. In years past when he did have a lawyer, that lawyer convinced our judge that our son needed a lawyer, so our son has a lawyer as well. Son's lawyer has decided that bio should have access to him, but only under these extreme conditions, which is why they exist. Our judge will not even hear arguments on suspending visitation fully, because he doesn't want to bias a trial judge when it goes to trial. Recently, bio dad harrased our son's lawyer enough that lawyer brought us back to court to change the visitation order. For whatever reason, he, our lawyer, and the judge decided that the correct course of action was to make a change to the order that made the visitation conditions even stricter. Infuriated, we stood up and actually spoke directly to the judge. We explained that we didn't know why we were dragged into court, simply to impose stricter conditions on the man. We advised the judge that it made no sense, and if we were spending a day in court there were better issues we could talk about, like bio continuing to violate no contact orders. The judge heard us out, and then ignored us. He is normally a competent guy but he's fed up, in supernumerary status, and I don't think grasped the actual reason we were in court that day. So now, 2 months later, it turns out that the new conditions are not technically possible, and kid's lawyer is asking us to "consider alternatives." At the same time, bio dad is asking for leave to appeal this order. I don't know why, since the previous order isn't any better. Our lawyer told us we should consider alternatives. In response we told him to discontinue all communication with all parties except where legally required. We told him that if the order the lawyers came up with, that we warned against, was no longer viable, then they could appear before the judge and explain that. We advised our lawyer we would no longer consider any negotiations or compromises. At this point we are beyond our wit's end. How is it possible that a man who has never paid child support, who has over $100,000 in legal fees owing to my ex, who has been declared a vexatious litigant, who has been found guilty of criminial harrasment, is still given the benefit of the doubt? How is it that we continued to be denied trial or hearing for the issues, because it would "unfairly bias a trial judge." We are told to wait until bio can retain a lawyer, but he cannot do that. Lawyers wont even take him on anymore. What can we do? And how the hell can we do it without incurring another 100,000 in legal fees that we shouldn't have to pay for, but will. [link] [comments] |
"Legal" CBD flower shipped in mail seized. Narcotics officer left a voicemail. Posted: 09 Mar 2018 12:47 PM PST I ordered 1 oz of "legal" CBD cannabis flower from tweedlefarms.com. This flower is advertised as having less than 0.3% THC which is supposed to be legal in all 50 states under the 2014 hemp bill. The package comes with this notice https://imgur.com/a/pjbY6 . I did not receive the package and got a voicemail from a local Narcotics Agent this morning. He said he wanted to speak to me and to call him back. I called him back and he was on lunch break. I said I would try him back later. Please help. I have no idea what to do. I thought this was supposed to be legal. I do not have a lawyer and have no idea how to go about getting one. Do I call the detective back? I am in IL [link] [comments] |
Being charged $25 to pay my rent for convenience. Posted: 09 Mar 2018 12:35 PM PST (Iowa) My apartment complex sent out a notice that they are going paperless. They no long accept any form of payment besides there online system. It charges $25 every time you use it!? So that means the complex is making an extra $11,000 per month. The letter says "no more walking to the office to pay your rent!". Which Is stupid considering it's right next to our mailboxes. Questions 1. Is this even legal? 2. Who do I contact if it isn't? 3. Why does it cost so much to do an online transaction? [link] [comments] |
