[UPDATE] I did not get the job I wanted because owners thought I was gay, but they did offer me a different position. Is this legal?

    Original Post

I read your guys' comments about sending an email, so I wrote to the owners that I was disappointed I didn't get the FDM position because they had assumed I liked women. I inquired if the position was still open and asked them to reconsider me if it was. I also mentioned that I could wear a wig if that was better for business.

The husband responded: I am so sorry but we have already hired someone for the Front Desk Manager position. Apologies for the mix-up on our end. The offer for the Housekeeping Supervisor position is still on the table. Please give me a call if you want this job, my number is XXX-XXX-XXXX.

I called the husband and spoke with him. I explained that even though I wasn't gay, they were still discriminating against a protected class. He seemed shocked, like he genuinely did not know that he and his wife were discriminating. He said they had no problems with gay people and were merely looking at this from a business standpoint. He apologized profusely and told me he felt really bad about the whole thing. He said he wanted to talk things over with his wife, because they both did like me but unfortunately the FDM position was no longer available. He called me back and asked if I would like to take the Housekeeping Supervisor position if they raised the hourly rate to what I would be making as the FDM. This was acceptable to me, I really do need the job and I don't think the owners were trying to be malicious.

Big THANK YOU for the input and advice, guys!!! =)

[FL] Paid for a retreat to Mexico. Had a falling out with the retreat organizer. They wont refund me any of my money and are trying to block me from going.

    Posted: 06 Feb 2018 04:26 AM PST

    Hi,

About a month ago I had a falling out with a friend of mine who is one of the two organizers for a retreat to Mexico that I paid in full ($2300.00) for.

They are now saying they would prefer it if I did not go, due to tension between us. They are also refusing to give me a refund due to the following.

    1) It's past the point where they can give refunds, Sub 45 days till the retreat starts.

    2) If they gave a refund now they would have to pay the resort for my room.

    3) They couldn't find someone to take my spot.

On top of that, because I paid through organizers and not directly to the resort, the resort will not give me a credit as per their standard refund policy. I feel like, because of the falling out that this falls outside of the usual realm of why we cannot refund you. It is not like I am canceling the trip for some random reason. One of them just does not want me there.

So my question is can they legally keep me from going to something that I paid for? It feels like I am being robbed.

    Thanks!

My ex husband wants dog support. Florida.

    Posted: 06 Feb 2018 07:37 AM PST

Divorced in Florida. We have two kids.He was ordered to pay child support. He bought a dog about 2 years ago while we were still married but just about to separate. He didn't ask for it in the initial divorce but recently sent me a (not from a lawyer) letter about opening a case for "petimony". I didn't want the dog. I didn't agree to the dog. He just brought the dog home and was like "look kids, a dog". He is currently unemployed and is "finding it hard to keep up with child support payment and caring for the needs of a pet".

I googled it and apparently it is a real thing but it looks like more for people who have established and long relationships with pets and not just when one person unilaterally decides to bring home a really big fucking dog one day so the kids will forget that he often forgets to pick them up from school on time. Most people would just buy them an xbox or whatever but fine.

Could it a REAL thing in this case?

The dog lives with him. The kids don't really like the dog because they are small and it is very large. It makes one of them cry so it never comes to this house. The littlest one won't even stay the night over at his dad's because he dislikes the dog. The other one is kind of "meh" about the dog. He would have rather had an xbox. I have never supported the dog. I have never bought anything for the dog. His name is on the adoption papers from the pound. Not mine. I wouldn't let it in the house while he still lived there. After that it went to a friends for a while and just recently settled into his house again in the last 7 months.

As an aside, I've been struggle with the youngest one not wanting to go to his dad's because of that big, untrained dog. He genuinely seems frightened of the dog and hasn't been to his dad's in about 6 months. If I have to go to court over this, could I bring that up at all or that a completely separate issue?

(yes, I asked him to get rid of the dog. He won't. Says it is "an angel".)

Edit: I want to add that he did use joint funds from our joint bank account to buy initial things for the dog and to pay the adoption and vet fees. He didn't tell me about it until after.

[mississippi] Have been renting to own a home for 9 out of the 12 agreed years and am now being told I have to move out so the owners son can move in

    Posted: 06 Feb 2018 06:01 AM PST

The owner wrote a letter agreeing on a 12 year term that I signed. Now she is saying that they need the home back for her son. When I questioned what we agreed on, her daughter got on the phone. She told me that it would not hold up in court because they had already done this with their father and got away with it because he had dementia. Now her mother does too, or so she says. My question is basically do I have a leg to stand on or should I start packing?

[Ny] School doesn't want us to report the neglect/abuse of a disabled child.

    Posted: 06 Feb 2018 07:48 AM PST

This middle school aged child is wheel chair bound and cannot walk and has pretty server mental and very server physical disabilities. The child goes home in a clean fresh diaper at the end of the day. The next morning the child comes to school with the same diaper totally full (we marked it with a marker as a test). The child has been to the doctors four or 5 times their entire life (and not in the last several years). They also occasionally come in with bruising. The school doesn't want us reporting this nor will they report anything, I feel horrible for the child and I have to do something but fear repercussion... Being a mandated reporter what should I do?

Edit: let me rephrase the question Being a mandated reporter where should I go? Who do I report to how can I protect myself legally? Can the school come after me legally?

[Netherlands] Neighbor wants to build an extra floor, but an exhaust is in the way, when I say "if you pay for moving it it's fine and we'll take the nuisance" she replies "you know it's illegal right?"

    Posted: 06 Feb 2018 03:07 AM PST

Ten years ago I bought a house, and I'm 99% sure that it already had an exhaust pipe on the side for the boiler on the top floor (edit: I'm now 100% sure there was already an exhaust pipe there for at least 60 years, but that one was replaced somewhere in the last 15 years, I'm pretty sure that the previous owners replaced it but it could have been people working for me) . I ran into my neighbor today and she says they're building an extra floor. Fine with me, they're connected to us on the north, so it won't stop any sunlight. She says there's an exhaust pipe on the side of my building, which will have to be replaced when they build a new floor.

It's directly to the side of the boiler, and you can replace it by just putting it directly above the boiler. It would (my estimation) take about 500-1000 euros and a day or two of work, during which we would have no heat and some annoyance, but fine. If she takes the cost I'm okay with it. But when I mention that she immediately says that "you know that it is illegal for you to have a part of your house over my property?" I didn't reply directly because I don't want to turn it into a fight, but it felt like she has no intention of paying anything for something that would just benefit her and fuck me and my renters over.

I have no idea what to look for to see if her claim is even true, but just the idea that she can just decide to build an extra floor and remove an exhaust, creating a potentially unsafe situation, without informing me seems so weird.

I'm 99% sure the exhaust was there before I bought the building (meaning 10+ years ago), can she just demand I remove it and pay for it?

Car towed after the fact (NJ)

    Posted: 06 Feb 2018 07:44 AM PST

This past Sunday, I was on my way to pick up wings and pizzas for a Superbowl party I was attending. When I got to the pizza place, all of the parking spots were taken.

Next door, there is a dry cleaner which was closed on Sunday. There was a sign up saying parking for dry cleaners customers only, all others will be towed. There was one other car in the parking lot, and figuring I wouldn't be long, I parked there and ran inside.

When I came out, the other car had moved and was now blocking the entrance. Don't have MS Paint on my phone, but I'll try to create a visual picture. On the left is the pizza place. There are five spots in front of it each accessible directly from the road, about fifteen feet back, with no barrier. To the right is the dry cleaners. There are five spots there, accessible from a single entrance with a raised curb on either side. Running between the pizza place and the dry cleaners is a peaked pavement split by a telephone pole. To the right of the dry cleaners is a deli with similar parking, peaked pavement separating, and a small driveway on the side of the deli running behind the building for deliveries.

I put my pizza in my car, and walked over to the driver of the car asking him to move. He replied, "It's no parking here. Are you a cleaners customer?"

I said, "It's closed today, I was just getting pizza. Can you please move?"

He shook his head, "Nope! You gotta wait for the tow truck. Shouldn't have parked here!"

"I'm leaving right now!" I protested, "Just move your car and I'll go!"

"You parked here illegally," he shouted, "and now you can pay impound fees!"

At this point I know I should have called the police, but I really wasn't thinking clearly. So I jumped in my car, backed up and drove to the right. I went over the peaked pavement (I'm sure I'll pay for that later), went down the driveway, pulled behind the buildings, and went out delivery zone entrance.

I forgot all about it, went to work on Monday, and all was good. I came out to the parking lot and my car was gone. I called the police, filed a report, and was understandably upset, wondering how someone would just come into my work parking lot and steal my car. I work for XYZ company, and have a parking decal on my car for XYZ company.

Got a call this morning from the police that my car was towed by ABC towing company for illegally parking in the dry cleaners lot. I went down there, and the paperwork says my car was picked up from the dry cleaners on Sunday, and in addition to the tow, I am being charged 2 days of impound storage. One of which my car wasn't even there!

When I insisted my car was taken from my work lot, they said that the paperwork says differently and that's what they go by.

The police say it's a civil matter and they're not getting involved. The tow company is demanding $678 to get my car out, and that's growing every day.

Apparently that guy was the owner of the dry cleaners and had nothing better to do than sit in the parking lot when they were closed to try to catch people.

When I go into work today I'm going to see if they caught my car being towed on the security camera yesterday or even me just pulling in. What can I do next? If I can prove that I had my car up until yesterday, does it then become criminal?

I'm not disputing that I did wrong by parking there, but I feel that this is crossing several lines, and has to be illegal.

[Update] Three friends, a mortgage for two, and a home.

    Posted: 06 Feb 2018 04:46 AM PST

    Original post here:

    https://www.reddit.com/r/legaladvice/comments/7vgv53/three_friends_a_mortgage_for_two_and_a_home/

Our friend came over as planned yesterday so we could begin to discuss options. I advised her of my concerns, which already mirrored many of the concerns voiced here in this sub. She was very confused by this, and then we understood the confusion:

She never wanted to own 1/3rd of the house. She just felt she should be paying 1/3 of all the monthly costs rather than rent. In effect, she was offering to pay 1/3rd of the mortgage, 1/3 of repairs, etc.

We're still figuring out the financial end of things, but ultimately she isn't requesting what we thought she was requesting. We are still considering some options we thought up based on your info, such as a very long lease so she feels the home is really hers.

Someone might just ruin my career over something I didn't do.

    Posted: 06 Feb 2018 06:22 AM PST

I got a new job at a vet clinic and posted it on Facebook and this chick who I've never met or spoken to said she was going to have fun contacting my employers and telling them what a nasty person I am and that I cyberbully people I don't know. I thought it was just a spam thing because I've never before cyberbullied anyone. I haven't even bullied anyone in real life, my comments on Facebook consist of politely correcting someone or agreeing with someone, but I don't swear and I don't call people names, so I brushed it off as nothing. Well she wrote a one star review on my clinics page saying I was a cyberbully and that she wouldn't let me near her pets. I only know her name, so I'm wondering if she does ruin my career as a tech if I can do anything about it or if I just have to bite the bullet and take what she gave me.

    Edit: I'm from Ontario.

Employer wouldn't add baby to insurance, who do I complain to.

    Posted: 06 Feb 2018 09:13 AM PST

I'm going to try to make a very long story as concise as I can. In early November my baby was born. Two days after her birth I called the Employee service centre for my then employer to have her added to my insurance. I called three times and spoke to a few different people, but finally got someone who said that they would add her for us.

At the end of December I got a letter from the hospital saying that the $80,000.00 NICU claim had been denied because she wasn't listed on my insurance. So I called the service centre again and was told they didn't have any record of me calling to add her and that I would have to fax in an appeal.

I faxed in a letter appealing this FIVE TIMES and kept getting told they hadn't received it. (Even though I had fax confirmations saying they had.) Finally someone at the employee service centre gave me his direct fax number. I faxed it to him and he personally handed it off to the benefits team. Who then denied my claim.

I spoke to a family member who is an attorney and also to my local Department of Labour in Idaho. Both said to appeal again and go from there.

I appealed again, providing a screenshot of my phone showing the three calls I made right after my daughter was born, the fax confirmation sheets etc. They denied it again saying that their systems showed no evidence of me attempting to add her on that first call and therefore I was outwith the 30 day period to add her.

Since then I have filed a claim online with the department of Labour in Idaho. The first department said it wasn't something they covered and had me contact a different department (Wage and Hours.) That department said it's not something that they cover and that I need to talk to the insurance department. Who I called and they told me that they only deal with unemployment insurance claims and that I need to contact Wage and Hours.

I don't know what to do anymore and I have no idea who is the appropriate party to contact for a claim of some kind.

Should I contact the department of labour in the company's home state? (Massachusetts.) Should I lawyer up? Should I complain about the company on Twitter?

I just want to get this taken care of do that my poor wife isn't having an anxiety fit about the idea of us having to find $80,000.00

Psycho stoner roommate trying to evict me.

    Posted: 06 Feb 2018 05:30 AM PST

Some background, just moved over from the UK and started as a prof at a pretty good MA, USA college. Been looking for a place for weeks now, found a semi-decent dig with this girl who is leasing the apartment from a local landlord. She's at law school and tells me that her previous tenants ran away and she doesn't know why, she kept their deposits. So I agree to sublease the apartment from her and give her $1000 security deposit and $1100 rent (she tells me she's going through difficult times so I was like I'd paid her 10% extra temporarily, especially since I'm gonna be using her utensils and such.

The contract she drew up explicitly states the rent will be $1000. Like the stupid shit that I am, I paid the rent and security deposit directly into her bank account by cash (I'm new to the USA, BoA wouldn't allow me to do a bank transfer). She told me she would give me a receipt that night for the rent and security deposit I paid her- she never does. I told her we should sign the contract soon - she never does. I have a billion things to do so I get on with my week and that's when I notice she fills the apartment with marijuana smoke every day - the contract she drew up explicitly says "no smoking permitted". She becomes increasingly hostile towards me and begins sending harassing messages over whatsapp. I tell her I'm no longer interested in staying at the apartment, she presents me with 2 "ultimatums":

    1) I leave the apartment ASAP and forfeit my rent and my security deposit or she will call the polce. 2) I agree to a new updated contract where the rent is officially $1100 and I will have to stay until June.

The messages she sends are putrid, I feel sick and just want to go back to the UK. She smokes weed every damn day, and when I confronted her that it violates the sublease agreement (which I didn't even sign), she goes apeshit and tells me its medicinal so its ok? Is there any way to get my deposit back and get out of here? Is she legally allowed to evict me? I appreciate any advice I could get

[WA] Husband's Mistress has threatened to release intimate photos of me. Who do I contact?

    Posted: 06 Feb 2018 10:21 AM PST

I am somehow involved in big steamy pile of poo thanks to my husband. Last week I found out my husband was having an on-line affair. He sent photos and videos of us together to this woman. Now that he has ended it, she believes I am going to retaliate and has threatened "game-on" if I do. I have never spoken to this woman or contacted her. I am nervous her paranoia will result in her interpreting unknown phone calls, email sign ups, etc as me retaliating. I frankly don't want to waste my time. However, I do want to make sure that I can't be harmed and embarrassed by my husband's stupidity. The reasons I want to make this legal is because of her actions in the past.

His mistress has admitted to flying out to our city against his wishes and driving by our home. She has admitted to spoofing phone calls to mess with others. Hacking her employer's computer. My husband has documented her "joking" reminders that she has kept all the dirt on him so he needs to be careful.

What type of lawyer do I contact to send her a letter that if she shares these photos/videos or conversations with anyone to harm my family (don't care much about my husband, more our kids and me and any fall out her attacking him would have on them), I will take legal action. I would rather this come from an authority not just me sending a form letter I found on the internet.

    Any advice, ideas?

[NY] Employee fell in July, fought for disability and loss. Now they have fallen at home and are saying it's due to the first fall

    Posted: 06 Feb 2018 03:41 AM PST

A little more detail here. Own a business in the Bronx. The employee fell off company property last summer walking to their car in July and suffered a wrist injury. She claimed for disability (yet never stop working). Long story short it went to court where the court ruled in the companies favor.

Flash forward to present day and 2 weeks ago they fall in their own home and injure their leg. Now they are out of work for 3-4 more weeks, but showed me a doctors note that they fell due to an injury suffered at work this past summer (the wrist injury). I don't know how any doctor could say the two are correlated but my concern is that the note says due to the injury suffered at work. Mainly because this issue was resolved already and we were proven to not be at fault.

I feel like they are gearing up for another lawsuit now. And I'm getting stressed/frustrated at this whole situation. Is there anything I can do to assure there isn't another lawsuit now?

[MI] Pregnant wife was given lifting restrictions for work. Employer removed her from schedule for nearly a week and now gave her a different position and cut her pay.

    Posted: 06 Feb 2018 11:42 AM PST

My wife is a caregiver so lifting people at 7/8 months pregnant isn't exactly easy or safe. So during our regular doctor's visit, she mentioned her difficulties to the doctor. The doctor then provided a written notice for lifting restrictions and saying she needs a couple 15 minute breaks during her shift. My wife gave this letter to her HR people and they removed her from the caregiver schedule for almost a week until they "talked to the doctor".

Today, she was provided with a new position in housekeeping but they cut her hourly wage by almost $2/hour. Something about this doesn't seem right to me. Did her employer break the law? Isn't that pregnant work discrimination or something?

I'm obviously unsure since I'm posting here but any help y'all can provide would be greatly appreciated. Not trying to get super litigious, just want to make sure she's getting a fair deal after a reasonable request.

Employer treating me like a volunteer.

    Posted: 06 Feb 2018 07:52 AM PST

Chatham County, Georgia I've been working at a daycare for two weeks. The job was advertised online as Assistant Teacher at a $9/hr rate. In actuality I am the only teacher in the classroom, yet I received no training (I dont have experience even for assistant teaching), and since I started there has been no mention of pay whatsoever. I announced to my employer after a week that this job wasn't going to work out for me, and she asked that I stay a couple more days while she finds a replacement. I agreed but it has been over a couple days and still no mention of compensation despite working more and longer than I signed up for, and she asks that I continue coming back. All things seem to indicate the boss has no intention of paying me for my work, which is infuriating. I posted on another sub about this and the advice was to handle every conversation in writing from here on out, and make clear the compensation due. Would really appreciate any advice from you guys on how to handle the situation, what to say in email, and how to get the money I worked hard for. Thanks!

    Superbowl party went south, fast.

    Posted: 05 Feb 2018 07:37 PM PST

Know I'm military, living off of the base and in Alaska, but all my friends are pretty much military, too. Well I had Superbowl party at my house and one of my guests got very drunk, very belligerent and had a half baked moment (Fuck you, fuck you, fuck you, you're cool, fuck you I'm outta here). This guest recently separated from the military but is still in the area with her live in (still Active Duty) boyfriend.

Anyways, after her tirade she went out to their car to wait for him. He had the keys and stayed back to apologize for her actions. As we helped him carry some stuff out their car was gone. We then realized she had a second set of keys...she ended up wrapping the Jeep around a tree at a T-intersection and walked away on foot.

She was found at her boyfriend's house, where the cops eventually tracked her to after running the plates I assume. She was arrested on DUI charges and fleeing the scene of an accident. Is there anything I should be concerned about? Could this come back to me since the party and event was at my house?

My boss says she sent my paycheck, so it’s not her fault if it wasn’t delivered.

    Posted: 06 Feb 2018 06:43 AM PST

As the title says, my boss says she sent out paychecks on time but I didn't receive one. I called about the problem, only to have her (CFO) tell me that it's up to the usps to deliver it to me or back to her. Only then, when the check is delivered somewhere, will they cancel and reissue a replacement. It was supposed to be delivered almost two weeks ago, and still nothing. This is in NY, USA if that's needed info. I'm late on rent, and this paycheck covers much more than I owe. I can't wait any longer and she's not responding to my emails about earlier reissues. Thanks for taking the time to read this, I'm pretty stuck and broke and have no way to get money for rent anytime soon unless she reissues this check.

Company refuses to stop pestering mine

    Posted: 06 Feb 2018 09:00 AM PST

So about 9 months ago a company called "generalyellowpages" called me at work(hotel front desk) they asked me a couple questions about my company and untill they asked if i wanted to be in their phone book, i said sure, and was just in the "i want this phone call to end" mode so i was just saying "sure, yeah, whatever" but then they asked for payment, and thats when i told them to forget it i had thought it was free, and i know my manager wont pay for this. Hung up. Fast forward about a week and they are calling us looking for payment for the ad we took out. I told them the situation but they were so fucking persistent that i hung up. They have been continuously sending us faxes, emails, phone calls asking for me, for the past 9 MOTHERFUCKING months. The amount increases with each coming months to the point when i now "owe" them over a thousand bucks for a fucking ad i told them not to run. How do i get them to leave me alone. I mean for fucks sakes who in the name of god uses a fucking phonebook anymore.

I also checked the Better business bureau website for the company reviews, and every single one of them described a situation exactly like mine. so it is literally their marketing strategy to scam people.

    Edit: i live in VA

Can an employer prohibit employees from talking about pay with each other? At will state, but would it be wrongful termination to fire for this reason? (Indiana, large company)

Can an employer prohibit employees from talking about pay with each other for any reason? At will state, but would it be wrongful termination to fire for this reason? (Indiana, large company) What current Indiana and federal laws and cases rule on this? (a corporate company, not a government one). My manager claimed that talking about pay with other employees is a fire-able offense.

[TX] Parents’ neighbor keeps calling police about their dogs. Police say they don’t hear any barking. Police have now referred the case to mediation.

    Posted: 06 Feb 2018 11:25 AM PST

Background: My parents have lived in the same house for the last 15 years. They have always kept dogs and those dogs have always barked occasionally. No neighbors have ever complained or called the police before. Their current dogs have lived in the house for 2 and 5 years each.

Current situation: This year, the very nice man next door died and his house was purchased by a much younger man. He is single and works nights. Because he sleeps during the day, he says the dogs are barking and waking him up. The police have been called at least twice now, and both times did not hear any barking. One time my mom went outside when the dogs were barking to find the neighbor standing at the end of their driveway. He then complained to her about the barking. (Of course they were, there's a stranger lurking in the driveway.) Now my mom has received a notice that the police have referred the case for mediation. She is understandably upset and is not sure how to handle this. They have purchased bark collars, noise-emitting birdhouses that sense barking, and even removed a couple trees that had squirrels living in them to try to fix this. Admittedly, the dogs bark much less now, but it has never seemed to be unreasonable before.

On a potentially unrelated note: Is it illegal to rent your room temporarily to people for 1-2 days at a time? He does this and I think it may be the real reason he is so persistent. Perhaps he is afraid his renters will stop paying if there is noise.

    City ordinance:

It shall be unlawful for any person to willfully or knowingly harbor or keep on his premises or elsewhere any animal of any kind that makes or creates an unreasonable disturbance of the peace of the neighbors or occupants of adjacent premises or people living in the vicinity thereof or suffer or permit such animal to make or create unusual noises by howling, barking, bawling or otherwise.

    Advice requested:

    1. What amount of barking is "unreasonable?"

    2. Is mediation mandatory in Tarrant County? What if she refuses to go? What if she does go?

    3. Is the neighbor required to take any action on his own part?

    4. Would supporting statements from neighbors be helpful?

    5. Can I go with her to the mediation?

    6. Are yard workers exempt from noise requirements? He has never complained about them before, but they are much louder and more persistent.

Thank you very much for any help you can provide. We all feel a little unprepared for this situation. If there are any questions I should have asked but haven't, I appreciate any info you can provide.

Ohio- Husband's grandfather holding his credit hostage and no one knows what to do

    Posted: 06 Feb 2018 01:39 AM PST

This is in Ohio and I've called lawyers, police, and corporate offices and no one can tell me what to do here.

My husband (DH) was being primed to take over his grandfathers small business so he could retire. His grandfather put him on the business bank accounts so DH could write checks and pay bills. It's a small one man shop, no other employees. There was no formal contract other than letting DH run the shop for a year or two while grandpa was in Florida, and eventually buy the business from him if he wanted it.

We wanted it, but grandpa wanted double it's value and won't budge, he's got this idea it's worth as much as when he bought it in the 70s but he let it fall apart and the neighborhood is really bad now. We had it appraised for 79k and he wants 168k with him 'holding the note' with no early payoff and a requirement to pay his health insurance and life insurance until he dies. The deal fell through obviously and it was really ugly. DH has separated himself from the business with the exception of this bank account. The bank will NOT remove him without them both being present. They will make an exception for a notarized letter but grandpa is being vindictive. He is going to overdraft the accounts and tank both of their credit on purpose unless we agree to his horrible terms and buy his building. He doesn't care about his credit because of his age, he wants to destroy my husband's credit as revenge. We need that credit to buy another building! He has us by the balls right now.

*We went to 2 branches and talked to the managers at both, they won't budge. They say grandpa has to be there

*We called the bank's corporate office and warned them of his plan and begged them to take us off, they won't budge

*I called 2 lawyers who keep telling me they aren't sure and they will get back to me and never did

*I called the police to see if I could file an identity theft report or something and they said there was no theft

There HAS to be something we can do to get us disconnected from this horrible man. It seems illegal that they could refuse to remove him from an account like this!!! Please please help!!!!! Thanks so much.

Edited a word because my math is bad ha

[NY] Employer Requires Me to Lie to People on the Phone -- will this come back to haunt me?

    Posted: 06 Feb 2018 12:55 PM PST

    Hello.

I've been at this job for about a month now and while I enjoy the flexibility of the schedule it provides, I'm not comfortable with the aspect of lying to people on the phone. I work in collections and while we're disallowed to say that we're debt collectors, we say that we're process servers instead and are going to be serving these people a court summons for a civil complaint that was filed against them. We also go by aliases as well, since we cannot use our real names. So, we give them a phone number and a case number to call back with and go on to the next one. That's basically my day in a nutshell. Then, in two days, we call the people who we called previously two days ago, etc etc -- rinse, repeat.

We have four people who work as the "plaintiffs" by collecting debts from consumers and we get commission/bonus pay for making a certain number of payments within a month. We can also get a raise for meeting or exceeding a number of payments within that month, too.

What I'm wondering is if we, the employees who work the phones to tell the people that we're going to be coming to their house/place of employment, are going to be held legally responsible for this if it gets found out, or will the owner of the company be held legally responsible?

Thank you for any help offered regarding this. I am looking for a new job as we speak, though, because I'm not ethically comfortable with lying every day to people over the phone.

[CA] An AirBnB review I left may have been edited, do I have recourse under California Civil Code Sec. 1670.8 ("Yelp Law")?

    Posted: 06 Feb 2018 11:40 AM PST

I recently stayed at a listing through AirBnB where A guest tried to enter my room in the middle of the night. I included this in my review, but when I looked today, that section was removed mid-sentence. I can't imagine how or why I would have even accidentally removed a section right in the middle of my review. I read that there's a law in California (where AirBnB is based) that disallows the suppression of reviews. Does this situation fall under that violation?
