They took a photo of me, I paid $150 and it was expunged from my record. I remember I signed a statement saying I would never go to Rite Aid again. Now, it's 11 years later. I live in the same state but on the opposite side 7 hours away, would never even think about stealing anything. I have no criminal record aside from the stupid expunged eyeliner incident. I just moved to this area and the only pharmacies nearby are Rite Aid. He was arrested and the state is charging him with aggravated assault. The trial has been going on for the past week and a pretty strong case was presented by the prosecution and I saw very little reason (as a laymen) that the kid wouldn't be found guilty. The trial was maybe a day or two away from ending when we find out that the prosecutor was mysteriously let go from the case and the judge decided to dismiss it. Meaning the kid walks free. I live with my mom and so I park in our driveway. In the middle of the party my dad calls me and asks me to pick up food for him and drop it off at his place. I leave the party for about an hour, and when I return my parking spot is taken so I just park a little further up the street. When the game ends, the person who was parked in the driveway where I normally park was moving their vehicle. I go outside to move my truck back in our driveway. Just as I am walking to my car I pass in front of my neighbors house and work van and my neighbors pull into their driveway. I get into my truck, pull into my parking spot and go back inside my house. This all took place around 9ish and at midnight the police knock on the door. My mom answers the door and the police explain to her what had been reported and they describe me perfectly. I go to the door and speak to the police, give them my side of the story and gave them my ID and cellphone number. They said that my story matched with my neighbor's outside of the attempted car theft. Also apparently "multiple people" claim they saw me try to break into the work van. Since the cat would be living in our shared apartment, I asked my roommate if she'd be okay with a pet. She said she would love to have a cat in the house and came along with me to purchase the cat. The person to sell me the cat was a friend who is a breeder. I'll refer to the cat as Red; my roommate as Tina (who starts her last year of law school this fall); and the breeder as Kev. Trina told me that she did not want to commit to the ownership of a cat saying "They can live for 20 years and I don't know what my life will look like in 5, let alone 20". Kev was happy that he'd be selling the cat to me, as I was with longtime friend and he was only acquainted with Tina through me. The cat I purchased for $50, Red, was a breeder. She had already had a few liters and was spayed. Kev will attest to the fact he sold the cat to me, and only me, but it was a cash sale and there was no paperwork. I have a written letter from him describing these facts. I ended up moving out last month due to Tina habitually disrespecting me. Her on-again off-again boyfriend moved in and did not contribute to rent or household chores. She claims we jointly purchased it, and I only handed Kev the $50 because she did not have cash on her. This is the opposite of what she said at the time, and Kev will vouch for me. It seems straightforward but a couple things have me scared. *She has more legal experience than I do and her complaint is very well written. *She has petitioned her friends, some of them I've never even met, to write statements saying I was a neglectful co-owner. *The lack of paperwork for the original sale. She saw the screen and essentially ran away. Today, I was called by my supervisor who asked if I was watching videos of girls' butts on work computers and if I sexually harassed my colleague. My dad has a degenerative neurological disease called progressive supranuclear palsy which is in its final stage. It is definitely fatal. My mother is his power of attorney (is that the right term? She can make decisions if he cannot). As part of the disease progression, my dad has lost much ability to chew and swallow. We have been sticking to giving him high calorie liquids and shakes but even those have some difficulty. Tomorrow we are having an important doctor's appointment for him which will discuss the issue of a feeding tube. His ability to communicate is severely compromised but not totally absent. I have not seen my dad's advanced medical directive personally, but I think it says colloquially 'no extraordinary measures.' I'm not sure if it explicitly mentions a feeding tube or not. Here's the issue: my mom told me in the last few days that she had a conversation with my dad when he seemed to be in a condition to hear / understand it. She said she reminded him of his advanced directive, and asked if he would now want a feeding tube if it could help keep him alive. He said yes, he did. She said "sometimes it seems like you're ready to be done," (meaning to die) and he said no, he wasn't. However, in spite of this, my mom is going to push to have no feeding tube. She has all but told me as much. She is going use her power of attorney to force the decision. She has a long track record of making decisions on my dad's behalf that are not for his benefit, but for her own convenience / ease. She does not handle stressful situations calmly or rationally, instead feeling automatically overwhelmed and seeking to end them however possible. She does not make decisions without her own agenda being a major driving factor. I believe her choice now about the feeding tube comes from fundamentally the same place. SHE wants it over with regardless of his wishes, and she most highly prioritizes her own desires. My understanding is that an advanced directive / power of attorney only applies when someone is no longer able to make informed decisions, but the conversation as my mom relayed it to me clearly sounds like an informed decision in which he expressed his wishes. Shouldn't that be the final word? Is there a legal criterion that determines whether or not a person is able to make informed decisions for themselves? What recourse do I have to advocate for and defend my dad's decision? Please help. Please, please help me. EDIT: I have a copy of his will now from 2015. At that time we had received a diagnosis of Parkinson's (what it turned out actually to be, PSP, is much more severe and much less treatable). He had some cognitive issues already at that time but not nearly as bad as things are currently. He initialed the option that says "artificial nourishment shall not be continued when it is the only procedure being provided." when it is the only procedure being provided - what does that mean? A few other relevant phrases stood out to me. In the statement of intent: "In the absence of my ability to give directions regarding the use of life-sustaining procedures ..." and more explicitly "My agent's authority becomes effective when my supervising health care provider determines that I lack the capacity to make my own health care decisions." I will be at the appointment tomorrow. I will do my best to get a clear answer from the doctor about her determination of his capacity. If she says she thinks he can, then I will do my best to revisit the feeding tube question with him (like, on the spot, at the appointment) and see if he's able to communicate his wishes. If that doesn't sound like a good way to go about things, let me know. There's a social worker who we've worked with in the past that I can approach if needed based on the outcome of the appointment. Purchased a home only to find a squatter inside. What are my options? Posted: 04 Feb 2018 09:37 PM PST Back in December I started the process to close on a home in the rural patch of nothing between Quinlan and Royce City Texas. Place is in a recently incorporated large patch of land called Union Valley. Anyone familiar with the area will know that its the kind of area with no one out there at all. You can go 2 miles and see 1 home. But I digress. Well there were complications in the loan which took over 2 months to resolve. We finally closed on the home and discovered a surprise. Someone moved in in the last two months illegally and is refusing to leave. According to neighbors he has been there since before christmas and has been a nuisance. We called the police and got a visit from the sheriffs, who literally call themselves homeland security by the way, and we are being told that since he has been there longer than 30 days we will have to go about evicting him. We called the county courthouse who told us that we have to serve him a 30 day eviction notice. We got that process started, but I am finding it troubling that I have no remedies that would force him out earlier. Obviously I can not just go in and claim he is an intruder. I have delayed getting the power hooked up to the home though. The water is not running in that place either. He has zero utilities. He is sleeping on the floor in a sleeping bag and has no items to himself that I can speak of outside of the sleeping bag. My question is can we just start moving in and slowly inch him out of the house? Try to get him to leave before the 30 days? IE we move our furniture in, but leave enough space for his sleeping bag without running afoul of the law? Also sometimes he takes his sleeping bag with him when he leaves, can I legally state that this was him voluntarily leaving the premises? By the way this is not me trying to be clever or cute. I am legitimately asking if it is a legally defensible position to claim he vacated the premises when he takes his sleeping bag? His only possession. Any advice would be appreciated. Based on Netherlands nationality law, I would have lost my citizenship as well due to article 16.1.d. However, 16.2.e states that minors who were born in the country of their other nationality do not lose citizenship. I have had one lawyer say that this is only applicable with regards to naturalisation, but article 16, unlike 15, does not say "under a", and rather says "in the first subsection". Under Canadian law, I did not obtain Canadian citizenship voluntarily, this was done automatically, and it is illegal for minors and those resident in Canada to renounce Canadian citizenship. Additionally, Article 16 of the European Convention on Nationality states that "A State Party shall not make the renunciation or loss of another nationality a condition for the acquisition or retention of its nationality where such renunciation or loss is not possible or cannot reasonably be required." and Article 2.2 of the Convention on the Reduction of Cases of Multiple Nationality and on Military Obligations in Cases of Multiple Nationality states that "Consent may likewise not be withheld by the Contracting Party in the case of minors who fulfil the conditions stipulated in the preceding paragraph, provided that their national law allows them to give up their nationality by means of a simple declaration and provided also that they have been duly empowered or represented". He owns a property in China (Zhongshan). He lived together with his "spouse" there, however his spouse (let's call her Sally) was technically still married to another man for the last several years. Sally did not help pay for the house in any way, however she helped purchase furnishings for the house. Sally also owned her own house in Macau (China) but they basically always lived at my grandfather's place. My grandfather had intended to sell his property in order to pay for his funeral and also leave as an inheritance for his eldest son. When he was first diagnosed, Sally essentially wheeled him (he couldn't really walk due to his illness) over to some sort of office where she got him to sign over the property to her in her name alone. It is worth noting that several weeks later when we questioned my grandfather on why he did that, he claimed that he was not exactly lucid at the time of signing the papers and could barely walk due to his sudden illness. Even after it was all done, instead of demanding that Sally sign over the house back to him, my grandfather insisted that she sell the property, and give him back $150,000 (which he had used to pay for the house originally several years ago) and she could keep the rest of the profits (which actually would've been a lot more than the $150,000 that she was supposed to give back). She agreed to pay $150,000 back to my grandfather under the condition that she instead would sell her own property to get the money and would keep their formerly shared property because she liked that one better. It was a verbal agreement, however multiple witnesses including my grandfather's brother and sons were present. Now that my grandfather has passed away, she has gone back on her word and has made it clear that she has no intention of paying back what she promised to my grandfather. We have no written agreements and my grandfather's property has been signed over to her (whether he was completely lucid at the time or not). She is flying back to China in half a week and I'd like to know what (if any) options exist for me.

The bank had him create a checking account with them, and they put the money in there and set it up to take the monthly payments out of that account. Well, of course he stopped making payments and closed the account. To preserve my credit, I paid off the loan myself. It's done and over with, and I've learned my lesson the hard way. But I'm now out that money that I was forced to pay on his behalf. My questions are these: Can I take him to small claims court to recoup that money? If so, what documentation do I need? His parents are extremely emotionally abusing and absolutely insane. They do stuff just to gain power, like grounding him for 2 weeks for coming home at 12:03 instead of noon, despite construction traffic. His mom called him a "little pathetic piece of shit" today because he stared crying. He grabbed some things and left, despite them yelling at him to not leave. He's moving in at our friends, and we need his car to get to college in the morning. So here's some things about the car: He saved up all the money for it and bought it himself He had payed for all the repairs The car is registered under him The insurance is signed under him We were going to come back and get his car, however, the mom blocked his car with her car so he couldn't leave. So we were going to go in the morning once they were gone, and get the car, and he still has the keys. However, we've just been informed that his stepdad pulled out all the spark plugs and is taking time off of work so his car can block my boyfriend's. He is so emotionally drained and very upset. He just wants his car so he can leave. What are the logistics? What can we do? How can we get he car back? Was it legal for his step dad to take parts out of the car so we couldn't drive it? Posted: 04 Feb 2018 02:18 PM PST Dekalb county, Atlanta, GA Our kitten has been through hell and 5000 vets these last three weeks. He had exploratory surgery yesterday and they still have no answers for us. After his surgery, they said he was having a bad reaction to the pain medications and bit a tech who then had to go to the hospital. We were supposed to pick him up today, but they never called us so when we called them they told us he has to be held with them until animal control can give a verdict on whether he needs to be quarantined there or at home for 10 days. We immediately drove over there to see him and he was acting completely fine, in fact he was acting much nicer and more cuddly than usual. The moment his cage opened, he jumped into my arms and was purring so loudly. It was hard to get him off of me and it broke my heart even more than it already is. The vet or tech who was talking to us while we visited said that the girl who got bitten was just being really dumb putting the litter box into his cage and she ignored all signs from him that he was not in a good mood/very cloudy from the anesthesia. The bite was four semi-puncture wounds and a couple scratches. She didn't need stitches. They're charging us boarding and probably emergency boarding for keeping him another night against our will and they said that if he bites again they're going to put him down. He's a 10 month old kitten who had his rabies shot 5 months ago. He's never bitten or been vicious with anyone and can't even hunt a bug. How is this allowed and how can we fight them? Edit: I understand the quarantine laws and have no issue with that. I get that rabies is a very dangerous thing and am 100% willing to comply with that, however the language being used is alarming and being forced to pay for their incompetent tech is ridiculous on top of threats to euthanize him for being a drugged, scared, and provoked cat. Update: This morning's update is that he's still doing fine - he's eating and pooping without medicine which is already a super huge improvement. The emergency overnight vet was saying different things, but positive. She said they shouldn't be charging us for last night's boarding and will be looking into it. I asked why they're threatening to euthanize him when he has his rabies shot and was provoked. She said that because he has his vaccinations, they should be honoring that and aren't supposed to jump the gun on euthanasia so quickly for that. They're going to call back with the board of health or whoever's verdict later on what the quarantine will be. She also said that the bite in general took them all by surprise because he was so nice and cooperative the entire stay, but he is now showing some hostility and that's probably due to being cut open and stuck in a confined space with strangers. It's still protocol. Update #2: We called animal control directly and the officer said that they didn't report the bite until today, which means them holding him in general wasn't legal and/or necessary. She was mad about what they were doing and gave us her direct number. She called them herself and told them to give him back. A guy came to check out our apartment and said that they told him it was a vicious dog and not a kitten. He laughed and agreed the whole thing was a ridiculous waste of time. I'm a happily married woman so I didn't care for it. I made a Facebook post calling him out. It blew up, tons of comments from almost every girl on my friends list who had either received a photo themselves recently or seen another post about him messaging him a 16 year old some not so nice things. Some of the family members even messaged me, most disowning him because he either tried to sleep with them or sell them drugs. The grandmother messaged me saying her grandson needed help and she was going to sue for slander. He commented on the post himself saying he was going to sue me for slander but he basically admitted that he was going to lie and say his phone was hacked and he threatened my husband by sending him photos of himself with a gun? I don't know, I'm not too worried, I know I should just take the post down but do they really have a case for slander? Nothing more specific, no neighborhood, street name, I just said the name of the town she lives in. She feels I have violated her safety. She said that she will talk to her lawyer. She took screenshots of what I said as evidence. Her parents have a hobby of suing people, are quite rich, and they also hate me, so I fear they will try to sue me. (3) However, as an employer, you must not direct a recollection for an employee because a test has been cancelled, except in the situations cited in paragraph (a)(2) of this section or other provisions of this part that require another test to be conducted (e.g., §§ 40.159(a)(5) and 40.187(b)(2), (c)(1), and (e). (b) A cancelled test does not count toward compliance with DOT requirements (e.g., being applied toward the number of tests needed to meet the employer's minimum random testing rate). Three friends, a mortgage for two, and a home. Posted: 05 Feb 2018 10:39 AM PST Hey all, We are three friends who are moving in together. This in Massachusetts, about 30 minutes north of Boston. Two of us are married to one another and have secured a mortgage for the loan. We move in April. The third is in a position to buy a home but is not on the mortgage. I'm one of the two married people, we are all looking for advice. The home is an expensive property. My wife and I are leveraging $140,000 in cash for the down payment and $555,000 is tied into our mortgage, for a total of $695,000. There will of course be some other fees, as we are paying the closing costs, potential tax payments, etc. Because of the large sum of money we WILL be all going to a lawyer to discuss options. What we are hoping to gain here is just an outline of potential options to investigate. We were also looking at putting on solar panels, which may cost as much as $97,000 for a 30kw system (it's a large home 5 bedroom / 5 bathroom with a LOT of energy needs). With that in mind, a third of the house is currently going to cost about $231,666, plus whatever the closing costs and taxes add. 1/3rd the solar panel cost could add as much as $32,333. So right now, a third of the home is potentially $263,999, give or take. The home is on three lots. Two lots are occupied by the home, and a third lot is empty space on the property. So it's possible to split the property into thirds and sell our friend one of the lots. However, the mortgage we've secured is for all three lots, so I doubt the mortgage company will let us sell one lot so soon after buying the property. What options might we investigate, and what risks come with them? We had originally planned to just rent to our friend, but she has been working to buy a home and now she'd like to have ownership in this place too. [MA] Teacher Girlfriend got laid off due to budget issues. Posted: 05 Feb 2018 08:34 AM PST Hi everybody, I hope this is the right sub for this question. If not could somebody direct me to a better place to post? My girlfriend is a first year high school art teacher in Massachusetts. Her school somehow overshot its budget for the year by a pretty huge margin and is laying off somewhere between 50 to 70 teachers. She was in the first round. I have been lead to believe that teachers can take their salaries in a way such that they either take less per pay check and continue to be paid throughout the Summer, or not, and that the GF opted for the former option. If I'm right this means that the school owes her about 1 month of pay for the half a year that she's worked so far. She told me that the school isn't going to give her the money because they can't afford it, but this seems illegal to me. If anybody has some insight that would be great. [link] [comments] |
Posted: 04 Feb 2018 07:54 PM PST Relevant information before I get to my situation: My 5 year old has cancer and has suffered major hair loss from the chemo treatment. To help her cope with this, I (26/F) have shaved my hair since Day 1 of her treatment and will continue to keep shaving it until my daughter is able to grow her hair back. Now my situation. I recently interviewed for a position as the front desk manager at a hotel. It is owned and operated by a husband and wife. I thought the interview went very well, and they seemed to really like me and the fact that I had prior experience working the front desk. They said they needed to talk it over as well as interview other candidates before making a decision. I waited a couple days before calling to follow up. I spoke with the husband who let me know that they really liked me and would have liked to hire me for the FDM position, but they strongly felt that many hotel guests would not take well to an employee with my chosen lifestyle and thought it would affect business. I asked him what he meant by that, and he blatantly said, "We thought you liked women...?" I was taken aback by this and clarified with him that I was straight (I did not share the reason why I shave my head). The husband said he needed to talk this over with his wife and would call me shortly. He did end up calling back and offering me the position of housekeeping supervisor, as they had been looking to fill this role as well. The pay is $2/hr less than what the FDM makes. I told him this was not what I had applied for and was not sure if my skill set was a fit for the position. He told me to give it a couple days thought and call him back on Monday (tomorrow) if I wanted the job. I have a couple questions: 1) Was there anything illegal done here? While I did not get the FDM job because they thought I was gay, they did offer me a different position. 2) I am not a sue-happy person but at the same time, I am a little upset that they turned me down for the FDM role because they made assumptions about my sexual orientation based on the way I look. She reufues to help in any way and states that if I take my duaghter to the hospital that I will pay the bill point blank.
