How to stop someone who is intentionally spreading HIV

    Posted: 23 Feb 2018 03:58 AM PST

I'm a FTM guy who sometimes hooks up with guys I meet on CL. I have two rules: one that I always use condoms and two that I don't let a guy have penetrative sex with me without seeing his test results. I met a guy who said he was "hiv negative and clean." I get to his place and things are going good but a few things put me off to him. I asked him if he had condoms prior to getting to his place and when I asked him for a condom before oral he couldn't "find one." I always come prepared and so I just used the condom I brought. He then tried to pressure me into penetrative sex. I kept telling him "not without seeing his test results." He kept saying "only the tip and only for a second" but I kept declining. He then suggests that I sleep over to which I say no. I felt uncomfortable having him suggest that because I felt like he could do whatever he wanted while I slept and I didn't want to feel vulnerable. Anyways, after leaving we text back and forth for the next few days and he keeps saying that he wants to have penetrative sex with me to which i repeat my rule. After a few days of this back and forth, he finally admits that he is hiv positive and undetectable. I push him for more answers and it turns out he isn't on any ARV medication and using "natural" medication. I am livid. I am so upset and i tell him that he is a douche for lying to me about 1. Being hiv negative and 2. Being undetectable when he isn't on any medication. I tell him that he can not say he is undetectable if he isn't on ARV and that if he does he is purposely lying and trying to spread hiv to people who may not ask him all the questions I did.

Anyways, I made a CL ad today and this dude responded to me not knowing it was me. I replied back and asked him if he is willing to have "raw sex" and if he is "drug and disease free" an he said yes to both of those questions. I know he is hiv positive and not being treated for it. I am so upset right now because I think he is lying and spreading hiv to unsuspecting FTM guys. ( i know its the same guy because he used the same email handle for both CL ads and listed his # in both ads.)

(Btw I am on Prep and I kept every text message he sent admitting to being positive. I also informed him about saying he is undetectable because my gut told me that he knowing lies and says he's undetectable and i wanted documentation.)

What do I do? I'm in California

Tldr; i know a guy is hiv positive and not on treatment and tonight he responded to a post to have condomless sex with "me" and said he is hiv negative. I believe he is intentionally spreading hiv and I don't know how to stop him.

UPDATE: After reading through all the advice and weighing my own person belief that I do not want to stigmatize HIV positive people, I decided to call my local health department. After being transferred 3 times, I finally got the help I needed.

I spoke with an HIV counselor who seconded what a lot of people said here, that it is no longer "illegal" in California for someone to knowingly spread HIV. What she told me is that she can call this guy in a few weeks, to buffer the fact that he disclosed his status to me recently and I don't want him thinking I had anything to do with this, and try to get him linked to ARV. She was really nice and said that there are a lot of guys like him and that sadly there is no way to stop them. She said that it was good that I am on PrEp and that I should continue asking for test results because the health department in California can provide it.

This was a major lesson learned for me. It sucks that this guy is knowingly lying about his status and treatment of HIV, but it reaffirmed my belief that you can't trust anyone. Your health is your responsibility. I hope that my story encourages people to be proactive about their sexual health.

Update #2; I believe that this specific guy is an abuser. I listened to my gut and it potentially saved my life. There were many reasons why I believe he is knowingly trying to spread: his difficulty "finding" any condoms despite being positive and not on treatment (when i asked him which natural treatments he is on he ignored the question multiple times. That dude is not on any natural treatments, it was one of MANY lies), when I asked him why he wasn't on PrEp and he said he's too busy but will think about it (why lie and say you will think about PrEp when you know you positive. He knows that HIV positive people can not take PrEp), he kept trying to have PS with me and suggested that I shouldn't worry since we are using a condom and he is clean, and lastly his numerous suggestions that I spend the night. (I don't do sleepover because people can do things to you without your consent and record you without your consent.)

If it wasn't clear in my post, I assume every guy I sleep with is positive which is why I am on PrEp and I use condoms EVERY time. What shook me about this situation is that this was the first time ever that I KNOW i had sexual contact with a positive person and I couldn't help feeling violated because he lied to me numerous times. I can't help thinking about everyone else and if they just believe him when he says he's clean because this dude was a charmer who said all the right things.

Anyways, it's better to be safe than sorry. I'm glad I didn't sleep over and even glader that I'm on PrEp and only performed oral sex with a condom.

Can a school suspend a person for being a 'social outcast'?

    Posted: 23 Feb 2018 08:00 AM PST

First off, me and my friend live in the state of Louisiana in the country of the USA.

In light of the Florida school shooting, a friend of mine was called into his high school's principal's office. His mom and the principal were there along with a police officer outside.

He informed me that his principal had asked him questions concerning his social group within the school. (I should mention that me and him do not go to the same high school)

The principal had told him that students expressed concern about him and had asked my friend why he didn't have any school friends. She then asked him if he had ever had a girlfriend, which he has not. Finally, she asked him if he was angry about any of this, in which he responded no.

His mom proceeded to interrupt the principal and asked what were the meaning of these questions. Since the florida school shooter was isolated from his peers, the principal "felt it was her duty" to question other socially isolated teens.

After bickering between his mom and the principal, the principal stated that he was suspended from school until he was evaluated by a psychologist who is appointed by the school board.

His mother stated that she would be talking to her lawyer which brings me to my question.

"Can a school suspend a person for being a 'social outcast'?"

Also if it means anything, later that night a person threw a brick through his window.

Update: I think we just stole a forklift? Minnesota

    Posted: 23 Feb 2018 11:54 AM PST

I'm on mobile so not sure how to link the original, sorry!

I read the replies and decided to look the lift over and discovered a company name and number. Called them and told them where their equipment is. Turns out they rented it to a company doing work on the building here, and this morning two angry workers came in looking for their lift. They have it now and our employee that took it acted like a good Samaritan until they left, then he was upset his scheme didn't work.

Not related, but I am leaving this company and actually turned in my notice on Monday. This is not the first questionable incident and I doubt it will be the last.

Thank you all so much for your help. I was very worried and now I'm just happy the real owner has his machine back.

[va] HOA obstructing access to property, threatening disposal of property.

    Posted: 23 Feb 2018 04:04 AM PST

Yesterday, a water main broke pouring 15" of Muddy water into our condo's basement. The basement is divided out by chain link fence into storage areas assigned (deeded) to each unit. To clarify, the condos here are owned and not rented.

This afternoon I receive an email saying that all units' property must be removed by Feb 27 so they can bleach and clean the basement.

ANY AND ALL PROPERTY REMAINING AFTER 7 AM ON THE 27TH WILL BE DISPOSED OF.

I'm moving out of this condo early next month anyway, so I'll just leave the things I wanted to throw away for them to dispose of, fine.

I attempted this evening to try and enter the basement, when I took the elevator down, the doorway to the storage units was padlocked shut, no response from property manager.

    My questions are;

    1) can they throw away our property in our deeded storage unit if not removed with only 5 days notice?

2)can they lock out the storage unit and obstruct my access to my property stored in a storage unit that is deeded to me?

Update: Employer continually denying me time off for appointments: got new job, gave 2 weeks notice, reported her to store manager

    Posted: 23 Feb 2018 04:37 AM PST

    Original

So I went to the job fair for the other job and they hired me on the spot. It's full time nights and above minimum wage so I would have taken it either way, but the 10 days I get off a year wouldn't have been enough since I already used 3 at the start of January when I hurt my back. It is a temporary position but they want to keep as many people as possible for a similar position after it's done.

I decided to report my department manager to the store manager instead of the Labour board in case she didn't know about the new law. She did. But he said they're going to talk to her about what she can and can't do and apologized that I was having this problem. He also said he wants to revamp how our department does time off requests because it's just a dollar store notebook we write them in.

Thanks for the advice with everything! Especially u/Harleystyles

Edit: I forgot to mention, since 2 of the 10 days off are supposed to be paid he's going to have payroll add on for 2 of the days I missed when I hurt my back.

[KY] My dad cashed in my education fund to pay for his business-related expenses, but now I’m expected to pay taxes on it.

    Posted: 23 Feb 2018 10:50 AM PST

Pertinent background info: My dad went ten years without paying taxes, and is now in an uphill battle with the IRS. His house is in foreclosure, and he's selling off personal assets left and right to try to stay afloat.

About ten years ago, my dad opened up an education account for me. I was completely unaware of this until about a year ago. He said he was going to cash it out, and I didn't really think anything of it because I wasn't particularly financially savvy. He used this money to buy a car, pay for machines for his cleaning business, and to try to pay off some petty debts. I was frustrated about it, but didn't really do anything about it because I knew he was in a hard spot.

Yesterday, when I was at his house, I was going through my mail and saw an opened envelope addressed to me. It was the tax document showing that I had received this money. I asked my dad about it, and he didn't have any answers for me.

I am in school, and I could technically show that the money that was taken out of this account went to school-related things to avoid paying the tax on it, but I would have to list the money I took out of my account I actually use to cover my schooling as income, which would absolutely devastate my finances.

My questions are: 1.) Is this in fact fraud? 2.) What would I need to do if I wanted to go about reporting this if it is fraud?

Service Dog in New York City Building

    Posted: 23 Feb 2018 08:58 AM PST

Hi - I work for a company in NYC. A coworker has a service dog and the building manager (who manages the building we work out of) says her dog is not allowed in side. It's a service dog - not an emotional support animal. Our companies legal team won't help because they said the building is private property so they don't have to abide by the ADA requirements for service dogs if they don't want to.

McDonald's Owners Forcing Employees To Write Fake Reviews [CA]

    Posted: 23 Feb 2018 09:04 AM PST

Basically, myself and all my coworkers are being "asked" to reprint random receipts from the registers, and to go to the survey website at the top and fill out the reviews.

This has been going on for quite some time, and after discussing the immoral-ness of it with a manager, I was told that it was a common practice. I understand this is a petty thing, But eventually the managers asking us to do this would request specifically mentioning their name over and over with 5 stars. I realized at the end of the month managers receive rewards based on the reviews and who's name was mentioned most. From my understanding, it also affects their vacation days or something else as well? Point being, they are trying to benefit personally from these dumb surveys with money/gift cards (the rewards) and whatever else.

At first I believed this was just a manager thing, and they were trying to underhand the owners to make them think business was always running well. Until I was speaking with the owner myself and she asked "Can you do me a big big favor? Can you get some of your friends to help you fill me out 5 surveys? You promise?" To give context, everyone, I'm 18 years old. I do appear very young physically, but I am not immature by any means. I do not lack common sense. I was being talked to as if I didn't know any better and was being manipulated lol. Coworkers are also asked to do this while on the clock, and to spend their breaks doing this. Once I even witnessed a manager tell an employee to use ANOTHER employees phone (on the Line Where U Make Food people) to fill out a fake survey. Like come on lol

So I'm sure the owners benefit as well from this in the end, in competition with other stores or whatever. I find this interesting because my store owners have been working with McDonald's for like... 3 generations. They have multiple stores open in our county. I'm guessing they believe they have hacked the system, but isn't this illegal? Am I overreacting and is this just normal shady business work? I get that it's McDonald's, and it isn't some hugely reputable professional well managed business. I just don't wanna feel uncomfortable being asked to fill out illegitimate reviews full of bs anymore.

Florida: Father didn't tell my brother and I he was adding our names to the house deed.

    Posted: 23 Feb 2018 07:46 AM PST

My dad is the breadwinner in my family and got a new house. My brother doesn't make much and is trying to go back to school and I'm currently in my last year of college, so we are largely dependent on him. Our dad wanted us to meet this morning for 'important business'. I was so confused I asked a bunch of questions like why are we doing this? Isn't this stupid in the long run? Basically his explanation was that having BOTH (not just one) of our names on the deed as owners he would avoid having to pay some type of taxes (hes has a LLC? Don't know if this is relevant) and that I need to stop asking questions because it was a 'gift' because if something happens to him the house goes to us. But I told him that's what a will is for, but my mother and him still both believe that 'omg those lawyers are gonna just take everything!'. So we basically started fighting in line, he had all the forms ready but I was not about to have this so I just left. Now everyone thinks I'm a complete psycho and I'm extremely ungrateful for not accepting 'this gift'. Can someone just explain on how many levels why this is such a bad idea? And what better alternatives can be taken in this situation? Also what exactly does this mean for my brother?

Back story on brother, he might be getting married soon, his wife has constantly battled cancer and it has a good chance of it coming back (in general she doesn't have a good chance to live), so how does her growing medical bills affect this? And she has a kid. (Shes a good person but now everything just seems a bit too risky and I'm concerned what could happen to my brother with this new issue of being on the deed of this expensive new house with my dad).

Did work for a company and now they are suing for "unprofessional-ism" - Kansas

    Posted: 23 Feb 2018 08:41 AM PST

I'm going to make a long story short.

I live in Kansas, Last week a client came in with a long piece of wallpaper art to be scanned to file for them to reproduce.

I scanned the image to their specs and gave it to them in PDF format. They paid and left thanking me.

Fast forward to Monday, they come in and say that they sent the image to a graphics company who told them that the image wasn't at 400 DPI like he requested and that the PDF was so bad he had to delete the only copy and I must rescan it again. He also told them that I needed to scan the image at 8 different brightness levels because it's impossible to change the brightness on a scan.

I took the image and rescanned it as requested without question and then went to my work station to work on it. My scan software allows me to adjust the brightness and resave the image over and over again at different levels to save me from having to rerun the original over and over again.

The person waiting asked why I wasn't rescanning the original multiple times like she asked, I told her that my software would allow me to change the brightness without having to rescan. She got mad at me and told me her expert told her it was impossible to do with his software, of which I only replied back that my scan software allows me to do it and he possibly doesn't have assess to the same thing I do.

I then gave her a free flashdrive with the rescan on it at no charge and told her if they needed anything else done to let me know. I didn't charge them for the rescan either when for the size of the paper, it would have been $150 dollars. I basically gave a 200 dollar job and an hour of my time for free to do her request.

Now come to today, her company lawyer came in with a legal suit stating I was unprofessional in telling her that my software could do something that her graphics person couldn't do and I was being sued for slander because I told her it was possible for me to do something she knew was impossible.

I have one other employee that was in the office with me that heard exactly what I told her, plus we have cameras with audio that recorded the conversation while she was inside. I never once talked negatively about the graphics person they used, the only thing I said was that it was possible for me to do with my software.

What legal defense do I have here and what exactly am I going to have to do to handle this? Any advice will help, I haven't as of yet gotten a lawyer.

EDIT: Thank you everyone for the advice. I will await an actual court document. I have also spoken to our own and already gotten agreement that none of our locations will be doing work for them anymore.

(Update) (SC) My new employer has a creative way of doing payroll that just doesn’t seem...legal

    Posted: 22 Feb 2018 04:53 PM PST

Hello all. Thank you to everyone who looked up laws and gave helpful info. It really helped.

Firstly, I wanted to say I looked into what was going on with the new hire documentation. Specifically, the document the owner is required to provide detailing what my pay rate is, hours expected, etc.

The answer is....no one knows. The manager and assistant manager both have no idea where the paperwork is because the owner handles it. I was told not to hold my breath, because people who've been there longer still don't have one.

Even more worrisome, the kitchen manager walked out and I found out that his paperwork was never done and that when he walked out the owner did some DIY CYA and forged the kitchen managers signature on documents saying he only got $8/hr. And by "found out" I mean the owner said all this to myself and others during a leadership meeting like it was no big deal.

    But on to my stuff.

I got my first paycheck and sure enough it's a bunch of f*ckery.

My pay rate is set at $8/hr, just like everyone said it would be.

Under "Earnings" there is a column titled "Misc Pay" with no hourly rate and a pay of $218.38. This is where my so called bonus to bridge the gap between the $8 and my correct pay is, I guess.

Another issue I've discovered is overtime pay. I clocked 19.77 hours of overtime in my first pay period. With my pay rate at $8/hr, I'm getting screwed out of the correct amount of overtime pay.

I'm job hunting to the extreme now. On my way out, I'll be calling the labor board and the IRS.

If anyone works in or around Easley, SC - don't work for the Jesus-y chicken place. It's crooked to the core.

Divorcing in IL- I think what ex is suggesting is illegal

    Posted: 23 Feb 2018 07:37 AM PST

My ex last night mentioned that his family had given him advice that he should simply claim all of my credit card debt AND his and file bankruptcy, while I allow him to keep his entire 401k which we already agreed in mediation to split (literally our only asset but he's blowing up about having to split it). Clearly, this cannot be legal or even doable considering that my CC debt is ONLY in my name- am I correct? I do have a lawyer (I just hired today- we were previously just doing mediation+pro se filing until I realized we needed a QDRO) but have not met with him yet. This just seems so off the wall that I want a quick opinion from the internets? He claims his parents did this during their divorce.

Ramifications of placing a bunch of fake Hollywood money inside my wall during a remodel?

    Posted: 23 Feb 2018 05:28 AM PST

I have a few of these Hollywood $100 bills that are used for movies and TV shows. They don't look real next to an actual $100 bill, but they look pretty good when the cameras are rolling.

We are remodeling our kitchen. I thought it might be fun to stick a few hundred thousand in the walls when we put in the Sheetrock as a practical joke for a future homeowner.

Are there legal issues for me if the finder doesn't realize it's fake and attempts to spend it?

    Just curious in California, thanks.

Maryland-Adult brother's landlord is stealing some of his Social Security disability money.

    Posted: 23 Feb 2018 07:25 AM PST

My brother recently made me his "payee" for his social security checks. He is disabled after a couple of mental illness diagnoses, and he is currently physically disabled from an ongoing illness he is being treated for. He has a history of drug and alcohol abuse and living in various faith-based shelters and "sober" halfway houses. He met a guy whose father owns sober houses. Because we (his family) live a 1.5 hour drive away, he made this guy his payee.

He is not allowed to receive his disability money directly. The payee is supposed to receive his checks and delve them out to him or spend it on his care. Anything not related to his care or not authorized by him is obviously not allowed.

My brother had to go through a process to get approved for disability, and he was eligible for a substantial amount of back disabilty, followed by ongoing monthly payments. My brother noticed discrepancies, questioned his payee, then canceled him as his payee when he explained that he would be taking a "10% payee fee." This is not a real thing, and my brother did not agree to it. Then after canceling, the payee received a check for over 10k in back pay, then claimed he sent it back to SS. When we went to the SS office, they said the check was cashed and showed us a scanned copy of the endorsed check. The story then changed, and they (the payee and his father who is my brother's landlord) agreed to give my brother his money back minus some deductions (the bogus "payee fee," and rent for half of February and all of March). My brother literally moved in a few days ago after another brief stint of homelessness.

My brother obviously wants these people out of his life, but he needs to line up a new place to stay first. He never signed a lease, and paying March in advance was not discussed. Obviously security deposits are usually required, but it's obvious to us now that this guy let my brother in without any money up front, because he was sitting on over 10 grand of my brother's benefits at the time.

Once my brother can get the heck out of this "Sober house" and into a new place, what recourse do we have to get some of this money back and report these people. My brother met the son in an alcohol and drug treatment program, and he thinks he's doing this to other people he's met who are eligible for public benefits. He's making himself their payee in exchange for getting them housing, then skimming off of the amount without prior agreement.

We want to report these people, but we're wondering what is the likelihood of recovering any of the stolen funds, and what will likely happen to them if they are caught? Is this a combination of a criminal and civil matter, where they will face some sort of repercussions for stealing, but we'll have to sue to get the stolen funds? Can this person apply a requirement for advanced rent now that my brother wants out of this situation, and never signed a lease?

Sorry if this wasn't concise, and I hope someone can help. Thanks.

City keeps flooding us, can we sue them? *shitty paint drawing included*

    Posted: 23 Feb 2018 06:47 AM PST

    https://imgur.com/gallery/WycYy

    Location MI

Hello LA, I have an unusual situation I need advice on and I included a shitty paint drawing to go with it just for your pleasure. Honestly, I don't know if legal action can actually be pursued in this case so if you think this is ridiculous, ludicrous, insane, or whatever tell me to pound sand and I will.

I live in a city surrounded by a river system which empties in a big lake. Some may call it a great lake, a very great freshwater lake if you know what I mean. Plenty of room for water in this lake. Anyway, in my lovely city we have three drawbridges (bridge #1, #2, and #3 on diagram). Bridge #4 is stationary. I live in the area above the wavy line.

Every year we have a spring thaw which raises the water levels and can cause some minor flooding. On the diagram you'll see a tight bend in the river I labeled ice fuckery, because this is the spot every year where the ice gets jammed. It's obvious to anyone the ice will get jammed here with the way the river bends and narrows at this point. Some years it gets pretty bad. So the city will hire an ice breaker to go up the river and break up the jam to get the water flowing again. The water has plenty of room to flow out thanks to my bigly lake, it just needs to have the ice broken up to get it going.

In 2009, my neighborhood had significant flooding during spring thaw. Basements had a foot or two of water, sandbags did nothing, docks, hoists, and boathouses were washed away. It caused some pretty serious damage and everyone was shocked because they had never seen it so bad. We were told it was "the kind of event that happens every 50 years." So it was bad but it shouldn't happen again for awhile right?

This year, only 9 years later, we had another significant flood. My dock is half in my backyard, my neighbor's hoist is trashed, and once again we're watching everyone's patios and docks float down the river. What the hell?! This wasn't supposed to happen again!

Here's where my shitty picture comes in. In 2009, the city closed bridge #2 in January for repairs which meant that it was permanently down and could not be raised up to allow boats to go through. Therefore, the ice breaker couldn't go upstream past bridge #2 to get to the ice fuckery hence the flooding. At the time we were frustrated but shrugged it off to a fluke, bad timing, and a heavy ice layer on the river. Hey, that's the risk you take living on the water right?

For the next 9 years, no flooding issues... and no drawbridge construction. This brings us to 2018, bridge #3 is permanently shut down for construction in January and once again, the ice breaker cannot make it up the river to the ice fuckery and we get a major flood. The city has stated that going past bridge #3 with the ice breaker would not have made a difference but we all disagree obviously. The city also reported to the local paper that the water was flowing and flooding was minimal, even though neighbors by the ice fuckery reported an ice jam just before the flooding began. And flooding was not minimal, I had water come 10 feet into my backyard and 36 hours later it still hasn't receded all the way. A friend contacted the city manager on Facebook expressing concerns for how the spring thaw was handled by the city and was blocked by the city manager. I feel like our situation is being downplayed and covered up by the city officials in the hopes they can pass the blame off on Mother Nature being a bitch and nothing more.

So my question is: do my neighbors and I have any legal recourse in this matter? Yes, Mother Nature can be a bitch but the city is also to blame for not managing the ice jam appropriately. It's obvious now to us the drawbridge closures are related to the amount of flooding and we feel the city has been negligent in closing the bridges right before spring thaw knowing an ice breaker can't get past. And reaching out to city officials with our concerns has gotten nowhere, or in my friend's case blocked by the city manager. We plan on heading to the next city council meeting to complain and I wouldn't mind also letting them know we are looking at a lawsuit against the city but I don't know if this is actually a legal matter or not.

You all rock, I love this sub, if this is ridiculous please let me know and I hope you enjoy my painting.

Employer (AL) forcing employees to take longer lunch breaks to offset overtime.

My employer is forcing hourly employees to take longer lunch breaks (instead of leaving early) to offset any overtime they accumulated the previous day. Are they allowed to do this?

(VA) Just started a new job but now may be terminated over a security clearance issue.

    Posted: 23 Feb 2018 03:14 AM PST

I was hired by a federal contractor for a position which requires a top secret clearance. Going into the position, the company knew I didn't have a TS and that they would provide it. However, now the agency they are supporting is telling them anyone working this position has to come in with the TS. They are still working on getting me the clearance, but I'm concerned that it will take too long. I am on the payroll while the decision is being made.

The job posting I applied to did not mention anything about needing a clearance. Neither did the job offer I received. The job offer does not state that the offer is contingent on a clearance. The offer does state I'm an at-will employee.

I left a very good job for this one and even turned down another one the week before I started. Is there going to be any recourse if I'm terminated, or am I out of luck because I'm at-will?

[VA] Old Apartmet complex put some kind of 'writ' on our bank account and froze all our access to it

    Posted: 23 Feb 2018 11:30 AM PST

When my partner (soon-to-be-husband) and I moved out of our apartment complex, we received a bill for cleaning/damages that the complex assessed. In addition to taking our security deposit, they wanted some five hundred dollars more. We reviewed the bill and found several faulty assessments and inaccuracies contained therein and contacted the agency to correct them. They refused to budge and we went to court. In total we went to court three times (and I was never once actually able to present my case, for which I have documented evidence that their assessment is inaccurate), resulting in the company ultimately dropping the case when their witness didn't show up. We did our research and saw they had six months to refile the case.

The six month mark came and went, and we never received any kind of letter, summons, or phone call. We thought the company chose not to reopen the case, and that that would be the end of it.

Last night while doing our grocery shopping we found my partner's bank account had been completely emptied. Both his checking and savings accounts were cleared out and are currently over-drafted and incurring overdraft fees as bills he had in processing continue to hit the account. After much running around, we found out this morning that the company apparently did refile the case and a judgement was passed against us in our absence. The lawyer then filed some kind of 'writ'-- not a garnishment of wages-- that allowed them to see our accounts and basically take what they wanted. They never made any effort to contact us or collect the debt.

We filed some forms today-- one for an exemption hearing to have the holds on our accounts removed, and another to void the original judgement that was passed in out absence and reopen the case.

    I have a couple questions/advice requests.

1.) The court clerk basically said that they [the lawyer/plaintiff] did everything they had to do to contact us. In the whole back and forth of the original case, at one point their lawyer didn't show up for court and when the judge was told the lawyer was mailed a summons, he responded, "That's not enough, we need to make a greater effort to contact him," and continued the case for a later date. I plan to argue that we should be offered the same treatment, but my partner fears it's a pointless debate. Is it common for a judge to treat a lawyer like this? Should we not expect the same treatment? We absolutely never received a summons. They have all our proper information on file, so I can only assume it was lost in the mail, or some error resulted in it being sent elsewhere. What do you do when the courts insist you have something you've never laid eyes on?

2.) In filing out our exemption hearing paper work, it specified that 'having trouble paying your bills' is not a reason for an exemption-- we have about twenty dollars to our name at the moment and can't feed ourselves, our pets, or pay for my medication because of what this lawyer has done. We should be ok for the weekend, and our court case is on Monday, but I'm not sure what we're going to do if the judge doesn't allow this exemption. They even cleared out the couple hundred dollars we had set aside for our honeymoon (Planning for a June wedding and dealing with a civil suit at the same time = literally the most fun I've ever had in my life.) Had he contacted us sooner, we would have made every effort to pay the debt, if the courts deemed it valid. Any advice about the best way to present this information would be helpful. I know sometimes the justice system isn't fair, but it seems so bizarre to me that someone can legally clear out our bank account without trying to collect the debt some other way first and that we're just expected to, idk, not starve.

3.) Multiple people have suggested I sue the apartment complex. My partner and I have had to take off work a total of five times EACH in order to deal with this. The way they went about collecting the debt has already incurred several over draft fees (and more to come) and any payments we've already made may incur more fees when there's no money to cover them. I'm furious and ready to fight, but my partner thinks we should just try to pay them and be done. We can't afford a lawyer, which is exactly why this complex is doing this in the first place (They are VERY seedy. I could go into so many details about the squalor we lived in for three years in this place. That's part of why we were so adamant about not paying to begin with.) What would you do? Would you sue/counter-sue (assuming the case is reopened, I suppose)?

I tried to be as concise as possible, but there are a lot of moving parts here (and some stuff I've left out) and I don't know any lawyers irl, or have the means to find one. Any advice or comments would be incredibly appreciated. Thank you!

[PA]Landlord refusing to remove bird from bedroom wall

    Posted: 23 Feb 2018 01:33 PM PST

I have rented my house for two years; my landlord is a retired woman and this is her only rental property. There is an unpatched hole in the roof over my bedroom. I only noticed this this morning since a bird has fallen through the hole and is now ostensibly trapped between the interior wall of my bedroom and the exterior wall of my house.

There is no way the bird can escape. Its cries are incredibly loud and it is, at this point, doomed to a slow death. There is no way I can sleep or accomplish anything in my bedroom.

I texted and proceeded to call my landlord to complain about the bird and the hole and was met with resistance. She stated that she would prefer to wait "a few days" to see if "the animal can free itself" before calling someone to solve the problem. She stated it would be an issue finding someone "with a ladder that tall".

I called my local wildlife control and they said they would first be able to send someone out tomorrow afternoon to potentially retrieve the bird, dead or alive, and it would cost $175 (more if he has to go into the wall).

My landlord is responsible for the bird removal due the damaged roof, right? Is there anything I can do to allow for faster service? Is this something that she has to handle herself? She is notoriously slow at these matters and I do not wait to wait around for a week while a bird dies, terrified, in my wall.

Manager at work leaves her phone to record people’s conversations while she is at lunch

    Posted: 23 Feb 2018 08:23 AM PST

I live in Louisiana. Based on searching the internet, as long as one person is aware, you can record a conversation. Although you are not allowed to overhear or tape a private conversation.

Where I work, a Manager came up to Employee A and Employee B and asked them a very specific question that sparked some concern for the 2 employees. It triggered that "how did she know that" part of their brain.

Through the course of the conversation the manager repeatedly used the term "another employee told me....this, that, and the other" The thing is, there's no one in the office when these two employees have theses conversations. While the conversation progresses the two employees ask the manager what exactly did they say, and the manager repeats their words verbatim.

The manager continues to rehash old conversations from weeks ago, again with verbatim conversation. While the manager is rehashing week old conversation she gets emotional and blindly admits that she had been secretly recording them for weeks when she went to lunch. Then threatened to fire both employees if they continued to talk about her behind her back.

Now I'm pretty sure that secret recording a private conversation is illegal in Louisiana but what I'm not sure about is how the law applies to the workplace. See, Louisiana is an "at will" state so anyone can be fired for any reason as long as it's not illegal.

Now here's the kicker.....Employee A recorded the conversation between the 3 of them. All three peoples names were used and the Manager flat out said "I've been recording you two for weeks now"

What avenues can the two employees take should they feel the need to?

[CA] My girlfriend left her car parked in front of my house for me to keep safe while she went to study abroad. Within the first week of her being gone, she cheated on me, broke up with me, and started dating the guy she cheated on me with. Now I want the car gone.

    Posted: 22 Feb 2018 01:07 PM PST

Hey r/legaladvice! So here's what happened:

My girlfriend and I had been together for about 7 months and everything seemed to be going great. A short while before we met she had committed to go study abroad in another country for almost 5 months. She had decided before she left that she wanted to move out of her old house away from roommates that she hated and found a new house to move into for when she got back. Because of the timing on her lease at her old place, she had nowhere to stay for two weeks before she left so I offered to let her stay at my place for that time. I also agreed that she could keep her car parked in front of my house and I would watch it for her while she was gone. Then she left.

When she got there, she sent me a few texts and then essentially ghosted me for 5 days. Finally, last Saturday, she called me and broke up with me. Her reason was that she really wanted to be on her own and couldn't be in a relationship while she was studying abroad. That she was growing and changing really quickly and that I was holding her back. The next day I started getting messages from some guy through Facebook messenger. Miraculously, my ex was still logged into it on my phone from a few weeks earlier. It turns out that not only did she know that she was going to break up with me for weeks, but she had also been cheating on me since the first night she got there with some guy she just met.

I'm so unbelievably livid. I can't believe that she would do this. I just want to be done with her and move on but unfortunately her car is still in front of my house. I'm very tempted to just tow it and not tell her anything but I know that may not be the smartest idea.

Now, during our last conversation I told her that she would need to find another place for her car as soon as possible and that I would give her a little time. But I didn't give her a specific amount of time or a certain date it needed to be gone by. Do I need to give her an official notice of how much time she has to find somewhere else for it? If so, what is the minimum amount of time that I'm legally allowed to give her? If she asks me to take it somewhere for her am I legally obligated to do it? I really don't want to do anything more for her.

What do you all think? If there's anything else you need to know feel free to ask. Thanks in advance.

A company did work that I did NOT ask for, and they are trying to force me to pay.

    Posted: 22 Feb 2018 08:38 PM PST

I hired a well known lawn care company in my area ( Richmond, VA) to do some basic maintenance. The first and only thing I wanted them to do was cut my grass, over seed and lime it, that was done with no problem and paid for with no problem. Fast forward 3 weeks later and I have a bill on my door step for $200 because they came over to do lawn clean up and other various things.

I never signed any sort of contract, I never asked them to continue to come by and check on my lawn, I was never told that they would be coming back after the first appointment. Just out of the blue they show up, do some work and leave me a bill without calling me first, emailing me, or any other way of communication.

Now they are threatening me with collection agencies if I do not pay. I have told them numerous times I am not paying for something that I did not ask for or want, but they don't care they just want the money. Any ideas on what I should do would be greatly appreciated, thank you.

Fighting with ex-roommate over a security deposit that he did not pay! (CA)

    Posted: 23 Feb 2018 07:35 AM PST

    Hi everyone,

I recently moved out of a house that I was renting and am now running into an issue with my ex-roommate over the security deposit. When I initially moved into the house several years ago, I had to pay a $4000 security deposit. After a few years of living there, I decided to get a roommate. This guy signed the lease, paid a $400 security deposit, and moved in and lived there for a couple of years.

We both moved out of the house last month and the rental company recently released the $4000 security deposit. HOWEVER, because this guy signed the lease, the rental company is saying that he is legally entitled to 50% of that security deposit. AND on top of that, he is wanting his original $400 security deposit, so in total he is expecting to get $2400, despite only paying $400.

My issue is that this guy had absolutely nothing to do with the original $4000 I put down. He contributed nothing to that money, but yet he and the rental company are saying he is entitled to it.

I contacted the rental company and expressed my frustration and they said the only thing I can do would be to take him to small claims court.

The security deposit check has both of our names on it, so I'm supposed to meet him at the bank today to cash the check and give him his portion.

I have tried talking to my ex-roommate about the situation, but he is adamant about getting the full $2400 and said he will take me to court if he does not receive it.

Does this make sense to you guys? Is he actually entitled to the full $2400, despite only paying $400? Would he have any ground if we actually did go to small claims court over this?
