Can I sue for emotional damages? Posted: 31 Jan 2018 06:32 AM PST [Ohio] I'm guessing this is a big resounding no but I figure it can't hurt to ask. A few months ago a 13-year-old boy broke into our house at night, snuck up to my 11-year-old daughter's room, took off his clothes, and proceeded to attack her. He had a knife with him. Thankfully, my daughter had enough courage to scream at the top of her lungs as soon as she was woken up by him. He freaked out, we woke up, and ran after him out of the house as fast as we could. Yes, he literally ran out of the house naked in 10° weather. Anyway, the police found him a couple of hours later and he's been in jail since then. Yesterday was his sentencing. If he exhibits good behavior, he'll be out in nine months (one year total from the incident). The rest of the details aren't really important to my question here. This whole thing has turned our lives upside down more than I would have imagined possible in such a situation. All of my kids are terrified to be at home even three months later. My daughter that was attacked has been sleeping in our bedroom every night. She can't be left alone for even five seconds. I'm talking she won't go into the kitchen alone to get something from the fridge even if we are sitting in the living room next to the kitchen. She reports that she thought he was trying to kill her and thought her life was over. Extremely traumatic for an 11-year-old. Yes, for those interested, she is in trauma therapy. Last night we "hypothetically" asked her what she would think if this boy got out of jail sooner than we had originally thought and she instantly crumbled, bawling hysterically. It broke our hearts. The boy's family lives two blocks from us. Rest assured I will not have my daughters sleep a single night in our home if he is released from jail and his family has not moved away by then. Since no property damage took place, and even the trauma therapy is covered by a government grant, I'm wondering if there is a possibility for suing for emotional damages? I am not the type to jump at suing someone or trying to solve my problems with money, but talking with my wife this morning about the possibility that we may have to move, sell our house, etc., even though we are the victims and that's entirely unfair to us, it might be a real possibility/necessity. Hence the question: do we have a case? [link] [comments] |
Posted: 31 Jan 2018 08:48 AM PST Hello LA! We have a baby monitor set up in our bedroom, were our 2 month old son's bassinet is. It's only a monitor and does not record audio or video, though it does connect to wifi and we can access it pretty much anywhere. We used an agency to hire our nanny (we pay the agency, the agency pays the nanny). So about 3 weeks ago I was checking in on the camera, and I noticed... uh, sounds. Unmistakable in nature. Thankfully I work in a job that I can leave if I need to, so I went home to check it out. When I got home I found our nanny sitting on the couch with her boyfriend. (We have a strict no friends / boyfriends over rule), so already a violation of our agreement. I reported her to the agency, saying what I heard on the monitor and what I saw when I got home. They fired her because of it. Now we received a letter detailing how we slandered her. She's demanding we pay back lost wages. She's also alleging that we have an illegal nanny cam because it records audio and video. We do not have a nanny cam, we have a baby monitor in our bedroom that transmits to the wifi. There is no recording. She's giving us 15 days to pay her before she files in small claims court. I know if she files to answer the claim, but I'm worried about this since there isn't any "proof" of what happened. [link] [comments] |
Employer selling employee data, requiring us to waive HIPAA rights to third party (Oregon) Posted: 31 Jan 2018 09:03 AM PST I work for a major hospital system in the Pacific NW. Each year our employer gives us a $700-$1400 to help pay for our diminishing health care benefits. In the past, we've had to do things like get bloodwork done, watch online videos, etc. This year, our hospital network decided to use a third party company to earn our incentive. The third party program makes you waive your HIPAA rights to both the third party program and our employer. It is also impossible to earn the incentive without further signing your rights away by filling out a form for both you and your provider to fill out. The form grants the third party company and our employer access to our medical records. Also, you much purchase a tracking device such as a Fit Bit otherwise you won't earn enough points to earn the incentive. If you manually enter your steps in, you won't earn as many points as having a device that tracks your every move. The third party program will collect all data from said tracking device. If an employee does not receive insurance/benefits from the employer, they usually do not qualify for or get the incentive. However, the third party company already has these employees' information without getting their cosent. In fact, they have every single employees' information without prior consent and there's no way to opt out of this. They also have information on spouses and dependants of employees if they were receiving insurance benefits. The program also discriminates against those with disabilities who will not be able to earn points because they can't walk at least 7000 steps a day. It also is impossible for someone to earn the incentive if they are too poor to purchase a smart phone or fitness tracker. Is there anything that can be done about this? Even if employees forgo getting the $700 benefit, their information was sold to this company with no prior knowledge or agreement. [link] [comments] |
A brothel I visited has underage girls Posted: 31 Jan 2018 10:38 AM PST Once in a while I visit illegal brothels in NYC city. Usually you call them before, or text, set an appointment, go there, pay the fee, hook up with one with their girls, do the deed and then leave. There are different brothels i visit. Last week i went to new one "accidentally". This was different from the rest, they ask you in the street whether you want to have fun time, you say ye or maybes then they bring you to the house. To cut it short, i was doing some job on that area when I stumbled in one of these guys who asked do you want to meet pretty girls. I figured what it is and said yeah. So we went to the brothel, which is a regular three floor rented house. Went in, saw like 5 girls there, all late 20s, early 30s. Then the main guy for some reason strangely says to me we have some special girls if you're interested. I said like what, then he opened the door to another room and I saw two girls there in the chairs. The girls looked scared and didnt want to be there. Clearly those were underage girls, like really underage, so young, probaly 13-14y, latin looking, i was shocked. Never happened smth like that, and I've been visiting brothel for a long time (10 years) but never saw any underage girls in that business. I said no. Wanted to leave completely, but since the guy was looking me strange I said I'll go with the other girls, and picked on the other girls, 30 smth, left there. I've been very disturbed pas few days about what I saw, those girls were so young. Don't know what to do. My question is this how can i hint/tip the police about what i saw? I don't want to be involved at all. Either keep my mouth shut or I tip the cops. But the view disturbed me, and I'm not a person who gets easily disturbes. Thnx for info. Ps. this is in Queens , NYC. I;m not a good person for going to brothels, i cant help myself. and wonder why the guy showed me underage girls. [link] [comments] |
Posted: 31 Jan 2018 09:29 AM PST I was hit by a drunk driver last spring. I had the green light. She ran a red light and t-boned me. there were no witnesses. When the police came, she was too drunk to speak. her friend in the car was covered in vomit. This was in Kansas City, Missouri, about a half mile from Westport, a major entertainment area. It was on a Sunday afternoon around 5:00 pm I went to a chiropractor and saw a physician. I had bruises and small cuts and some aches. I did not go to the hospital. I got a lawyer. The lawyer just called and said he heard from her attorney. He says they had a trial, didn't notify us and determined she was not at fault. the police report says I turned left. I was in the middle lane of a three lane one way going north. She was at a stop light going west. She floored it and barreled through the light, coming toward me from my right. I turned to the left to avoid her. The police report said I was turning when she hit me. Now they say they're not at fault and are offering $6,000. They already paid to replace my car, $2,500 less than the actual replacement value. What is happening??? How can this be? [link] [comments] |
Posted: 31 Jan 2018 07:33 AM PST I never thought I was an idiot, but now I feel like one. 8 months ago my husband got a teaching job in Oklahoma in a small county. A few weeks ago I came home and there was a guy on the roof of our rent house taking photos. I asked him what he was doing. He totally ignored me, got down off of his ladder, and went into my garage. I asked him again, and he said, "I'm the tax assessor for this county. You have to grant me access and I don't owe you any information until I mail you your assessment.". I called our landlord. They didn't know wtf was going on. A few days ago I received a "personal property tax assessment" saying our personal property is worth 70 grand. We pay 600 a month in rent, both drive 20 year old cars, and all of our furniture is used. We are right at the poverty line. Everything we own is maybe worth 5 grand, not 70. If we don't pay the tax they said they'll put our names in the paper and issue warrants. I feel completely violated and outraged. I never knew you could be taxed on what the assessor thinks you have, whether you own property or not. We already pay taxes on everything. I went to the county tax assessor and said their estimate is criminally inaccurate, and can we at least get an explanation, or is there someone who makes sure the assessor isn't screwing poor people over-was told they use a formula, and we don't have to live here if we don't like it. Can someone tell me what is going on? I was raised in Texas, my husband here in Oklahoma-neither of us have ever heard of this...at all. Please advise, any insight is appreciated. We make 22k a year and they said we owe 11 percent of the 70k estimate. I can't believe it! [link] [comments] |
[FL] My boyfriend is being sued for sexual assault Posted: 31 Jan 2018 05:15 AM PST My boyfriend is a massage therapist and he had a client about 6 months ago that claims he touched her under her underwear for 3 seconds. He got papers regarding the lawsuit against him and the owners of the spa. We've been trying to find a lawyer to help us through this but all the ones we contact say they can't help. We've tried calling the Florida bar and they're no help either. His insurance doesn't cover sexual assault allegations. If anyone has any advice that would be greatly appreciated. [link] [comments] |
Posted: 31 Jan 2018 06:30 AM PST I initially posted this on r/personalfinance, but this would indeed be the better place to post it. Back in November, I booked via booking.com a condo in Miami for a weekend for my girlfriend's birthday. I paid for the first night, $250. The remainder was to be paid upon check in. So we get there this past weekend, and the condo is not at all what 1) pictures reflected 2) rating score/reviews of the place showed. The place was disgusting, old, smelled like mold and old cigarettes, was completely disgusting and I was certainly not going to stay there. We argued that we were not going to pay the balance as the product was not what we were shown, of course they weren't happy, but it is what it is. We booked somewhere else and had an amazing weekend, although it was costlier obviously. I've reached out to booking.com, and there's nothing they can do on their end unfortunately, and I get that. And of course, the condo people do not want to give me my $250 back. So what are my options here? Am I fucked? Should I contact Visa and have the charge cancelled since I was being fucked over, or I just have to live with this isolated incident and hope it doesn't happen in the future? Thanks for any advice! I owe my roommates money. They sold my personal belongings. (VA) Posted: 31 Jan 2018 04:23 AM PST I posted something earlier, but I wanted to clarify, and give more details. Back in August of 2017 I had a falling out with my roommates. It's difficult for me to communicate when something bad happens in my life. I have depression, anxiety, and am on the ASD spectrum. So when something difficult comes up, I just shut down. I lost my job, but didn't tell my roommates. I would go out looking for jobs during the time I should of been working. Eventually they found out. They were mad, and rightful so. When they found out, while I was out of the house. they packed a suitcase with my clothing of mine and toiletries. They confronted me, took my keys, and made me leave the house. My name is on the lease. So they can't really make me leave. During the time I was out of the house I stayed at a hotel for two nights. Eventually I contacted one of my roommates and apologized for my actions. I asked to come back to the house. They allowed me to do so, but under a agreement that we made via email titled, "Living arrangement prototype". Before I get into the agreement we made. I just wanted to inform you that I owed them money for a debt that they helped me out. It was a verbal agreement. I was making payments to them, to pay off that debt at the time. The agreement was that all of my belongings were to be held by them except clothing and toiletries. None of my belongings were to be used by my roommates. A 20% interest was to be added to my already outstanding debt at the first of the month. I had to pay rent of course. 1 months rent after moving. I had to pay a back cost of 25% of utilities since May and until present. I wasn't being forced to pay any utilities. I was working a minimum paying job while they way higher paying jobs. We had a mutual agreement about the utilities. If I failed to pay anything on time, I had to pay a 10% "good faith" weekly interest. I had to live in the unfurnished basement. I was not allowed to be anywhere upstairs unless approved. I had to notify them if I was going out or using the bathroom. A old refrigerator and microwave were supplied to me for my own separate food. I had to be out of the house 4-8 hours a day. They eventually made it 6 hours. I had to clean the house 2 hours a day. This was changed to 3 hours a day. I spent two months in that basement. I was having a hard time finding another job. The unemployment I was receiving wasn't covering my expenses. I was living on one meal a day, eating basically Ramen. I had to deal with my roommates verbal abuse. My mental health was at a all time low. I eventually contacted my mother to let her know that I may be coming to Maryland to stay with her. I wasn't sure when. During that time, my phone got shut off. My mom got worried because she had not heard from me in a couple of days. Eventually she contacted my roommates. They were furious that I was going to leave. Thinking that I would not pay my debts. They took my car keys from me. Told me that I couldn't get my car back unless I paid them $500.00. I also had to get out of the house. I was forced to sign my car title under the seller part. I felt threatened, even if it wasn't implied. For the final week I was there. They added a lock so I couldn't go upstairs unless I was approved. There was a basement door to the outside. I left the house in early November. They threatened to sell all of my personal belongings, if I didn't pay them 10% by December 1st. Which was apparently almost $5,000. My dad paid them $500 so I could get my car in mid December. I have been unable to make a trip down there because of money. I would have to take a train. My parents refused to help me go down to Virginia. I have been informed by my ex roommates that the majority of my personal belongings have been sold. A TV, furniture, misc books / DVDs have not been sold. As well as clothing I had to leave behind. What can I do at this point? I have caused a lot of this myself, because I don't stand up for myself. Neighbor installed gates across my driveway (easement) Posted: 30 Jan 2018 11:12 PM PST We own about 12 acres in rural Colorado, and our only access to our property is a 1300 foot easement with a dirt road that we maintain from the county road. The easement is recorded on our title and is recorded as an "access Easement" that is 50' wide. Recently, our neighbor installed two gates on the road, one at the main county road, and the other on the property line between our two properties. When we contacted the neighbor, he stated it was for "protecting his property and livestock". However, his driveway is not gated, and there is free and open access to his whole property from his driveway. The only livestock on his property is two miniature horses in their own fenced in area with a barn. What are my legal option here? [link] [comments] |
Possession of controlled substance and DUI - am I screwed? Posted: 31 Jan 2018 10:10 AM PST I was pulled over the other day in Georgia, the state in which I live and am charged. I had a pill bottle keychain like this: https://imgur.com/gallery/uMFdI. Inside, I had 2 of my 2mg Ativan (schedule 4 controlled substance). I am legally prescribed this medication and have all of the paperwork as well as the original bottle at home. I take it for anxiety and, due to it being an addictive controlled substance, I feared that if I had the entire bottle with me, it may get stolen. I know that what I did was illegal (by having the pills out of the original bottle), but the circumstances I was arrested in really piss me off. I was pulled over for speeding (50 in a 45). When i Officer came up to my window, he said he smelled marijuana (never smoked or had weed in my life, no one else drives or even rides in my car). He explained he had probably cause to search my car so he began the search. He found the pills in the keychain bottle and immediately made me do a field sobriety test (which I passed). He apparently still wanted to nab me for DUI so he got a drug recognition officer to the scene and he claimed that I was intoxicated. I was arrested for DUI and possession of controlled substance. I was given a chemical test and it came back negative for ANYTHING (I take the Ativan rarely, only when I really need it as i know it is addictive). The DA has not dropped the charges for DUI and I don't even know if I can get them to drop the charges for possession even if I prove I was prescribed the Ativan. Any advice is appreciated. [KY, USA] - Can I put speed bumps on an easement? Posted: 31 Jan 2018 09:35 AM PST I live on a dead-end gravel road outside city limits. The road belongs to me, and my neighbors have an easement on it. In addition to coming out there with a tractor to widen the road while I am at work, they fly down it at excessive speeds. Not only is this annoying, but it destroys the gravel that I alone pay for. They refuse to contribute to graveling the road, and when I let it go too long between graveling, they complain that I am not keeping up the easement because it's muddy and hard to drive through. Can I install speed bumps across this easement to slow them down? Do they have the right to come on my property and widen the road with heavy equipment? I'm pretty new to home ownership period, but this easement has me so confused. [link] [comments] |
Apartment won't accept intent to vacate Posted: 31 Jan 2018 07:36 AM PST Hello, I recently wrote a letter to vacate 60 days prior to my lease end date as per my lease agreement cited. Once the office received the letter, they informed me that they will not accept my letter as my intent to vacate because they have their own intent to vacate paperwork, which was not sent to me at any point in time. Is this legal? I live in Colorado. Fast Update - Thank you for the quick replies! There is no stipulation of intent to vacate forms or paperwork cited in the lease. I copy and pasted the section of the lease that makes mention of vacating the property and quoted it in an e-mail to the office. I copied not only the manager, but the corporate office escalations inbox asking them if there is a section I am missing on the lease where it states I must sign their forms to give intent to vacate. I received the following response back within minutes of sending that e-mail - "We put your notice in effective today. If you could please come when possible to sign the paperwork that would be greatly appreciated." Thank you reddit for the fast replies :) [link] [comments] |
[NJ] packages continually stolen off stoop. Posted: 31 Jan 2018 08:21 AM PST I know what the smart thing to do is. Have packages delivered to work, ask for signatures, etc... and I will do one of these things. What I am curious about is my rights/legal liabilities I face apprehending this person. I have the option to work remotely some days with my job. I would really like to set a dummy package by my door and wait for this person to come and then confront them. Ideally I would really like to detain (don't know if that's the right word) them there, physically if need be, until the cops come. Again, I understand that this is dangerous and there are other better solutions. I am just asking to know more about the legal issues of this option. Just looking for facts. At what point does it constitute theft? Will anything be done or will the police let the person go? If it gets physical do I open myself up to liabilities ? Am I even allowed to restrain a person until the police come ? Any answers are much appreciated, thank you [link] [comments] |
[FL] No contact stepdad put name on title without consent Posted: 31 Jan 2018 05:11 AM PST I confronted my stepdad recently about his abuse growing up (physical and mental, but now just mental because I no longer live at home) and am now in no contact, a sentiment he seems to also want unless I apologize despite continuing to write me nasty emails. I am trying to untangle as much as possible and noticed when I paid my car insurance recently that his name is in the title. Before I went no contact, I purchased a car from the dealership he works at as general manager. He never told me that he would be putting his name on the title of the car and I would never had consented to it. I talked to my sister and appearantly he has done the same with her. The only part where it may get funky is that as part of my mom 'accidentally' spending thousands from my account and agreeing to pay for half of the repairs for a lemon of a car he had sold me prior, but failing to follow through, they paid for $3k of this car. I have this in writing. Any suggestions for the car and advice on how to move on from the abuse (legally or financially) would be appreciated. Thank you [link] [comments] |
Local frame shop made copies of my artwork and is now selling it in their shop. Posted: 30 Jan 2018 02:15 PM PST I need help and don't know what to do about this. My husband and I went and spent a month in Italy. While there, I took an art class, it was an all day event and the instructor was fantastic (like the Italian version of Bob Ross) and I ended up painting this really gorgeous oil painting. It was pretty big too, about 2 1/2 feet by 4 feet. When we got back home my husband suggested I get it framed. I took it to a local frame shop (arizona). They told me it was going to take three weeks to frame and that was fine. At the 2 1/2 week mark they called me and said they were going to need an additional week. Unusual, but not the end of the world. Finally, after a month I was able to pick up the piece. It looked good and I was happy so the delay wasn't too big of a deal. We hung it in our dining room and it looks fantastic. This was about 2 months ago. Now, this frame shop sells a lot of prints by local artists as well, and they're not cheap. Yesterday I went back into the frame shop to get a small, unrelated piece framed. What was the first thing I see when I walk in? My art! And I am 100% certain it is my art because it has my signature on it! The frame shop literally took my art and made copies of it without my permission and are now selling it in their store. They're selling the large prints for $150! What do I do/ how do I go about dealing with this? I'm mad that they stole my art without my permission, and I'm even angrier that they are selling it! It's not about the money, its not like I'm hurting for some spare change. I just want them to not be selling them. Like seriously, what the hell. Do I approach the owners of the shop? Should I just get a lawyer? I bet I'm not the only one they've done this to. I've never had an unprofessional experience in this shop until now. I went through my recipts for the piece and there is nowhere on there saying that they may make copies and sell it. tl:dr: Local frame shop selling copies of a piece of art I did without permission for an extremely high price. Worried they might be doing it to others and want them to stop selling my piece. [link] [comments] |
US, SC employee took documents and deleted files on her last day Posted: 31 Jan 2018 03:19 AM PST I recently bought the medical practice that I've been working in for several years. The old owner had several friends working there, two of which are sisters. I had to fire one sister, we just didn't work well together. She was an IC. Her sister came into work and decided to quit without notice. Her job was insurance verification and authorization. She took all of the written information about each plan, contact info for specific people, codes required for coverage etc. She also deleted the files on my server that pertained to insurance. Thhere's literally hundreds of plans for dozens of carriers and regaining this info will take a long time and its useful information to train the next employee that I don't have. What is my possible recourse? I just had to do payroll and I did pay her wages owed. I think I have to. How do I get my valuable info back? Do I have to sue her? [link] [comments] |
Restraining Orders used to harass Posted: 31 Jan 2018 08:58 AM PST Question: Can you help me find a examples of court cases where someone was punished for using the court system to harass someone? (Filing false restraining orders & unnecessary legal motions). Location: DC An ex filed several restraining orders/civil protection orders against me in multiple jurisdictions. Every single one was denied. So far, I am out fifty thousand dollars due to his shenanigans. I have an attorney but don't want to increase my legal fees by asking him. I've search through cases all over the US and couldn't find an example. I've found a way to get him to stop. After a several attempts, I wrote to the attorney general and asked them to review his petitions. However, only works after he's done it a few times in each jurisdiction and it doesn't help recover my costs. [link] [comments] |
Posted: 31 Jan 2018 11:52 AM PST My brother was getting arrested for shoplifting, he has warrants so he tried to give the cops fake names. I guess he didn't have ID or anything on him. After a few fake ones, he gave them MY name and MY birth date. Even though we look nothing alike and he tried to give them two fake names- they believed it. He called my mom and said he was me. She went to bail him out, after he left the building she said "that's not the right son, that's the other one". But by then he was gone. (I have links to the news reports if you don't believe that they could be this incompetent) I had to go in and file a police report and sign paperwork saying that I didn't give him permission to use my name. The officer told me that that was all I had to do and said sorry for the trouble. I heard nothing else about the matter since then. This morning I got a text from a number from that area code, saying that I had court at 8:30am. It was 8:15 by then and I work and live in another town. I tried calling the number back but it just beeps. Googleing the number brings up no results. So I called the county clerk and they were able to give me a court number at one of the 4 courts after giving them the name of all the people involved. I then called the court and they said that the case is going on right now. But she can't give me any more information than that. She said I should contact the DA for the county. So I called the DA. And the response to any question that I asked was "I can't discuss the case". They wouldn't even answer if I was supposed to be there. They did assure me that they didn't send the text by saying that they don't send texts. So I don't know what to do. I'm in Houston Texas. But the court is in Conroe Texas. [link] [comments] |
[MD] fake HOA president keeps sending us letters even after we asked her to stop Posted: 31 Jan 2018 09:54 AM PST My husband and I own property in PG county. We do not have an HOA. There are 2 civics organizations in the development. One we belong too, and the members are nice and reasonable. The other one we do not belong to and they are insane. Around a year ago we received a "pamphlet" from them. It is kind of like a newspaper where they "shame" people about their properties. I found this extremely inappropriate and borderline abusive. During the summer they went online to the county record to get my husband and my names (I know this because the property record lists my maiden name and now I go by my married name). They then proceed to send us a threatening letter about our lawn (which we took care of previously, we had a little of debris on one side and we cleared it). I got really angry about this. I sent them a letter asking to cease and desist communication with us. I also advised if they had any issue with the property go and place a complaint with the county and to leave us alone. They sent a reply to this letter, which we returned unopened. Yesterday we got a third mailing, with another pamphlet shaming people about their property. Can we make this people stop? I am really annoyed by all this. To deliver any pamphlets they trespassed into our property after we placed NO Trespassing signs. [link] [comments] |
Posted: 30 Jan 2018 09:54 PM PST Can my estranged, narcissistic mother legally withhold my money that I inherited from my father's will unless I meet up with her? I do to want to meet her, but sent me a long text explaining that she won't give me the money unless I meet up with her. [link] [comments] |
[OH] Landlord breaking lease because daughter needs to move in Posted: 30 Jan 2018 06:08 PM PST Lease started Sept 2017. Signed contract for 12 months. This evening landlord comes over and states we need to move out (end of feb) because family needs to move in to our side of the home. This is explained by a bad relationship/unsafe situation the family member is in. We're not going to bring in lawyers nor do we want to be d*cks but what could we do to ease our stress of finding somewhere else to live? First post, need advice, kind of also just venting bc if this crappy situation. Edit 1: THANK YOU ALL! No early termination clause in lease. clearly states it is for one year and goes month to month after one year. No "owner move in eviction" and my city name law. Asking for request to terminate lease early in writing and reason why to help with next residence search. Edit 2: AGAIN, THANK YOU ALL! Texted LL "would greatly appreciate your request for early lease termination in writing..to help with new place" Received "yes no problem" text. requested following in "Change to Tenancy Agreement" document which i'll present tonight
I have until feb 4th to pay February rent, so I'm hoping this Change in Tenancy Agreement is agreed upon before then so the full rent amount is not paid [link] [comments] |
Posted: 30 Jan 2018 06:14 PM PST Okay, this is gonna be a very long, very confusing post. I apologize, but I really need advice here. Thanks to anyone that takes the time to read this. So 3 years ago, my Honda Accord was stolen. The previous night, I had it towed back to my apartment because the CV axel had snapped, and it was not drivable. On the tow home, the tow truck driver kept asking me if I would take $600 for it cause he wanted to fix it up and sell it. I kept telling him no because I was planning to get it fixed, and he kept asling until we got to my apartment, and I kept saying no. He dropped it off and went on his way. The next morning, I go out to check on it, but it's not there anymore. I figured it was towed because it was parked on the street and wasn't drivable. So I called the police to see if a tow was reported, they said no. I called back a few days later to see if a tow had been reported yet. Nothing. So I filed a stolen vehicle report. A few months later, someone contacted me and said that their stolen truck was recovered, and that a bunch of stuff with my name on it was found in the back of it. I went to pick the stuff up, and it's a stuff that was in my car. This furthered my suspicion that my car was stolen; not legally towed. At this point, I was thinking the tow truck driver came back and stole it in the middle of the night. Because it couldn't have been moved without a tow truck, he wanted it, and he knew where it was. The only problem; this was a few months later and I couldn't remember the name of the tow truck company. Fast forward to now... I haven't heard anything about the car for 3 years. I gave up on finding it a long time ago. Yesterday however, my fiancé received a Notice of Lien Sale for the vehicle, stating that if the fees aren't paid by the 26th of next month, the car will be sold in a lien sale. The weird part; the registered owner was listed as someone else I've never heard of. The even weirder part; my fiancés name, who I had just met at the time the car was stolen and had nothing at all to do with the car, was listed under the release of liability, which is why she got a notice. All of my paperwork for the car was IN the car because I had just moved in with my fiancé. This makes me think the tow company could have messed with the title or something, maybe they found my fiancés name on another piece of paper and decided to use her name on the release of liability? I honestly don't know. Anyways, the tow company that sent the notice is called A1 Towing. I can't say for sure that it was the company that towed my car 3 years ago, but it sounds extremely familiar. I called, and asked that even though I'm not the registered owner, if they would release the vehicle to me if I brought in a copy of the stolen vehicle report. The guy said no, he would only release the vehicle to the registered owner, and only after the towing and storage fees are paid. The whole time I was on the phone with him, I was asking him questions like why my fiancés name was under the release of liability, and a few other questions. He put me on hold 4 times (the first time was immediately after I said he was holding a vehicle that was stolen from me in 2015), he seemed dodgy, he was rude, etc. I thought the way he was acting and explaining things was sketchy, so I looked the company up on Google and Yelp. NOTHING but bad reviews. People complaining about how their cars were daged during towing and the company was denying it, people complaining about valuable things being stolen out of their car while being towed, etc. One lady even said that she couldn't afford the storage fees, so the owner told her she could sign the car over to him so she wouldn't have to worry about paying any fees, then he tried to sue her 3 YEARS LATER for $3000 in storage fees. Every review talked about how untrustworthy and heartless this company is. The only good review was from A1 Towing talking about how good and cheap they are. I talked to California Highway Patrol (CHP) who couldn't find my stolen vehicle report, but did find out that the plates that are currently on the car were reported stolen by someone else in 2015 (when the car was stolen). They also found out that the DMV has no record of me ever being the registered owner on the car (probably because it's the incorrect plate number) and that my fiancé (somehow) is indeed listed under the release of liability. They also told me that this makes my fiancé the legal owner of the car. And that we can legally go pay the fees and have the vehicle released to her. I'm just worried that A1 Towing won't release the vehicle to us, and I feel like it's gonna be such a hastle. Does ANYONE have any advice on what steps to take here? It would be a blessing if I could get the car back, because I've been without a car for a few months now and have been missing out on work because of it. Thanks in advance. [link] [comments] |
