[TX] An agent sold me "homeowner's insurance." It was actually fire/lightning. Then Harvey hit. [X-Post r/legaladvice]

    Cross-post /r/legaladvice

In February of this year, I was sold "homeowner's insurance" by an independent insurance agent. When Hurricane Harvey hit, my home suffered wind and storm damage (no flooding, luckily). But there was damage on the roof, ceiling leaks, and so forth. Yard was a wreck.

The same day as Harvey, I filed an insurance claim. The insurance company came back to me a few days later, saying that my coverage was only for fire and lightning. I was shocked. I have an email exchange between the insurance agent and me, where she says the insurance includes hurricane and hailstorm. When I looked over the policy, it finally dawned on me that there was a premium amount paid for fire and lightning, but for the other perils like hurricane, hailstorm, explosion, etc, the amount next to those perils were blank, or 0.00.

After I received the rejection letter, I applied for FEMA which gave me a small but appreciated amount.

Shortly after Harvey, I got a mail from the insurance agent saying that her agency had closed up shop and that if I were to look for insurance, to contact her friend. The mail included the friend's business card. I am not sure if this was a coincidence or not.

Do I have any legal resource in this? What am I supposed to do?

Employer gave 1 day to fill out next years medical insurance paperwork

    Posted: 08 Dec 2017 04:25 AM PST

My employer had their annual insurance meeting for all employees where they gave us information on any plan changes or increases. The meeting was held yesterday afternoon and they expect everyone to make all decisions and have the paperwork turned in by the end of business today.

Why would they need the information back that quickly?

[Chicago, IL] UPDATE: still no resolution from car insurance companies after 3mths

    Posted: 08 Dec 2017 12:51 AM PST

Car accidents happened ~Sept 9th. We got rearended both times within ~week. Took our car in to two places on the same day within a week of most recent accident, one each for State Farm and Geico from their approved lists, to get estimates on the damage. The two estimates given were very similar to each other ~$2000.

It's now been almost 3 months. When we call either State Farm or Geico, they blame the delay on the other company. We're policy owners with Geico, but the rearenders are State Farm and Geico. There seems like no end in site. When we call, we've been told several times that they'll call us back on a certain day, but most of the time they don't follow through.

Does anyone have recommendations on what we can do? I feel like we waited a good amount more than we imagined worst case scenario, definitely more than what the insurance companies led us to believe. The damage is where we can't open the trunk. Really would like to get this fixed. Ty

Had a minor run in with a parked car. No dents only minor scratches. Made the claim, my fault. Will something this minor cause premiums to increase?

I don't have a bad driving history other than a speeding ticket a year ago.

Wanting to get a tattoo, is it a bad idea while working in insurance?

    Posted: 07 Dec 2017 08:26 PM PST

Been wanting a tattoo for a long time. Thinking of getting a tattoo as a "graduation award. " If I do, Im looking to get it on my forearm. Just got a job in an insurance company. Later on , I'm looking to get into underwriting. I know many companies now In days have tattoo policies. I don't mind covering it all the time for job purposes. I feel like having a tattoo isn't looked down upon as it used to, or is it? Aside from covering it in the interview process, will getting a tattoo affect my goal of getting into underwriting or perhaps a supervising position since I know having a tattoo cant be hidden forever from the employer.

can I settle for less to avoid a total loss?

    Posted: 07 Dec 2017 07:58 PM PST

somebody ran into my parked car, there's enough dents and dinks to the bumper and side door that somehow, my very new low mileage car was declared a loss by this other persons insurance.

The amount they want to give me either for a sale (which I refuse) and for the compensation is much higher than the estimates I got on my own for the repairs(about 2k more)

is it possible to cut a deal with them to get enough for my repairs without calling it a total loss and having to get salvage insurance? It's just the last thing I need right now and there is absolutely no serious damage to my car.

edit: it should also be stated, that my end goal is to delay or not even get the repairs since it's relatively minor cosmetic damage and I have bigger needs than paying a lot just to fix the back of my car. if they salvage my car I have to get the repairs else I can't drive it which would suck

Inter-hospice coverage refused; sent to collections. Options for contact?

    Posted: 07 Dec 2017 01:50 PM PST

I am really frustrated and hoping someone can give me a good lead. I live in Oregon and was conservator for my aunt until her death in May, and am Personal Rep for my aunt's estate.

She was on hospice in late April, back off of it in early May, and then back on hospice until her death in late May.

She had Humana insurance. I understand that events during hospice are not covered by the insurance, but during that early May period when she was not on hospice (was in-between rounds), she had an ER visit. This should have been covered.

Humana denied it based on her being on hospice... but she wasn't! I filed a grievance, they sent a letter of denial; I sent a response and they gave me 90 days to reply. I have replied by mail 30 days before the end of that period.

Today I found out they have sent it to collections, with never a follow-up on my response. I have spent hours on the phone with various reps throughout this period, and I cannot get anywhere. I tell them that she wasn't on hospice, and it is falling on deaf ears as far as results are concerned.

What can I do?? Is there something like an ombudsman or someone I can contact? Any other options? Thank you!

Two long term health care insurance policies question

    Posted: 07 Dec 2017 03:43 PM PST

Hello. Any help would be greatly appreciated! My mother in law has 2 long term health care policies in Pennsylvania with the same company. She is currently in (paid for by medicare) hospice and has satisfied her elimination period for all other expenses. For ease of explanation, let's say the remaining expenses going forward are 10k a month until she passes. Are we supposed to claim the entire 10k twice (once for each policy) or 10k divided among the two policies? Forgive me if this is a dumb question, both policies say they will cover the total amount of care after the elimination period, but it's unclear if I'm supposed to divide those costs between the two, or claim the full amount on both. Thank you for your time!

SO was the victim of a hit and run

    Posted: 07 Dec 2017 04:16 PM PST

Her car was parked in my driveway, and some guy who was running from another accident came flying into my driveway thinking it was an alley or something. He smashed my gf's car and veered into my yard. I was working in the yard and started running up to him, so he put it in reverse and ran away. She came out after hearing the noise, and we had the plates so we called the cops and got a police report, but they haven't found the guy. Her car was totaled, so she's getting a new one, but progressive is telling her that they're holding the hit and run against her. He said, "in the insurance world it doesn't matter," and that any incident will make her insurance go up. Is there anything we can do? She's looking at other insurance providers, but they're all more expensive with this claim now.

[CA] Totaled car, no comp/coll, other insured might not have enough PD coverage, what are my options?

    Posted: 07 Dec 2017 09:27 AM PST

Car accident in CA, not at fault. Car is likely totaled. Am being told the other driver may not have enough prop. damage coverage, and there might be a "limits issue." However, I have not received an offer or ACV. Just being told we will likely be over. I did not have collision/comprehensive on the car nor un/underinsured motorist coverage. If the total damage + my out of pocket > the insured's property damage limits, do I have any options as far as being made whole? The body shop that tore down/inspected the car will also need to be paid, so that further reduces the amount I would be due, I'm assuming? Thanks for your help.

Question on Proof of Repairs + Recoverable Depreciation on a Fence Repair

    Posted: 07 Dec 2017 01:56 PM PST

A few nights ago some strong winds damaged the property fence that surrounds my house. Two sides were damaged, one is shared with a neighbor and the other is solely owned by me. I called the insurance company and they provided me an amount for a check. My original damaged fenced included a lattice top and I don't think I want to keep the lattice for the new one.

The original reimbursement amount provided by the insurance company did not include lattice and they provided a revised quote with lattice in mind.

As part of the letter with the reimbursement amount there was this stated:

Once the repairs have been completed, you will need to provide us with a final invoice that shows the total cost of repairs along with two to three photos of the completed work. We will review and release any depreciation that was incurred.

We will pay the smaller of: the amount actually incurred for repairs or replacement above the actual cash value or the recoverable depreciation. The recoverable depreciation cannot exceed policy limits. For more detailed information, please see your policy.

My assumption from that means only 1 of 3 things can happen.

    1. The repairs cost more than Actual Cash Value (ACV) - Deductible: This means that they will unlock part or all of the recoverable depreciation and cut me another check.
    2. My repair ends up being less then the ACV: This means I owe money back to the insurance company
    3. By some stroke of luck, the repair cost is equal to the ACV and the entire claim is balanced out and settled.

Did I miss anything there? If I don't want to add lattice to the fence, am I still owed the amount from the revised quote since that was what was damaged?

Also, if my neighbor somehow decides that they don't want to repair the fence, how does this affect my insurance claim?

Legality of Auto Insurance Rate Increases with No Claim History?

    Posted: 07 Dec 2017 01:42 PM PST

I'll admit that I'm not well-versed in auto insurance. I am a very reasonably safe driver with no accident history (I'm almost 30, and got my license right at 16), and I use dash cams in the front and rear of my vehicle for added "insurance". I've always lived in/around Raleigh, NC, if this is pertinent to the below discussion.

Recently, my auto insurer posted a 12% rate increase (>$50) per 6 month term on my one-car auto policy. I'm used to rates being flat, slightly lower, or sometimes slightly higher, which I always assumed was because of state rate increases, but nothing like 12%. I checked the NC Dept of Insurance website, and the only thing I found about state-wide rate increases is a 2.2% state-wide rate increase for all auto-insurers, which went into effect this past October. The agreement is to raise rates 2.2% starting in October and then to not have any rate increases for two full calendar years. See the media story from the NCDOI website here: http://www.ncdoi.com/media/news2/year/2017/061517b.asp

For someone who has not had a claim, how legal is it for the insurance company to just raise your rates 12% or $50+ per 6 months? Of course, it seems like capitalism at its finest, where they're free to charge whatever they want, and I can freely choose another company/policy if I so choose to. But is there a limit to how much they can raise rates? Could they tell me again in 6 months that I'm going to be paying $1000 more per 6 months, even if I still have a clean accident/claim history, or is there something preventing insurance companies from doing this? Can they raise rates within that 2-year period if my record remains clean? My over-arching question is: what are the legal obligations that involve rate increases when someone is a safe driver with no history of claims or accidents?

I'm honestly just genuinely curious about this topic and want to learn more.

    Is my insurance too much?

    Posted: 07 Dec 2017 01:30 PM PST

I pay 410 dollars on progressive every month. And how can I make it cheaper and why is it so expensive. I am 19 years old. I've had my license since I was like 16. I got in a car accident when I was 17. I had minor night blindness and hit a family members car but no serious damage. I backed in.
I got in a car accident at 16 And the insurance settled 50/50 fault. We both came out of our parking spaces at the same time. And I got in two car accidents this year, both not at fault. Someone hit me drunk driving and fled. And then someone hit me from the side. But otherwise, I was young when I had my car accidents at fault. I have a clean driving record otherwise. I've have never had a ticket or warning. And my recent accidents weren't my fault.

I (kind of) made someone phone fall. He is a friend of me so I would call in my insurance for him, however I don't really think I'm responsible

    Posted: 07 Dec 2017 01:22 PM PST

So when I was walking down the hall with a few friends, we we're nearly at the room we needed to be, so I turned right to enter. However, my friend was walking behind/to my left side from me and my backpack ended up hitting is phone and it fell. The screen is now broken, but I don't really think I could ask my insurance company to pay the cost as I don't really know if it is entirely my fault. after all, if you're walking with a phone in your hand the chance is high that you are looking at it and not paying attention.

Do you qualify for cobra if covered by another insurance?

    Posted: 07 Dec 2017 01:10 PM PST

My wife quit her job as we are about to have our first baby (in the next week!). Her coverage ended 12/1. She is covered also under my insurance with a high deductible. Our plan was to Cobra, however it seems that there may be a rule that you cannot apply for cobra if you have another insurance. Is that correct?

We are able to apply for obamacare but it would not be active until Jan 1 (after the birth of the baby and all of the costs associated with same) so there's not really a huge point to that.

    Anyone with experience here?

[VA] Got hit by a car riding my bike. Is insurance offer fair?

    Posted: 07 Dec 2017 09:05 AM PST

Got hit by a car riding my bike. I stopped my bike at a stop sign intersection because of an oncoming car. Car stopped. I proceeded through intersection. Car then started moving to make a right turn and hit me in the cross walk.

Police report filed. Driver at fault.

Didn't go to the hospital, but went to urgent care 2 days later on a weekend and got xrays. Nothing broken, but was prescribed medicine for back spasms. Back still sore, but currently out of town on business. Going to go to my doc when I got back next week for a followup.

The driver's insurance is accepting liability for my bike and for my injuries.

They are paying for bike repair after I give them an estimate. Insurance is offering me 1000 for my time / inconvenience.

They will pay for my urgent care appointment.

They will set aside 1500 for any future care within the next 45 days.

Is this offer fair? I am not trying to take advantage or get rich. It was a low speed accident, but I am just concerned if there is any long term damage. I've never been in an accident before and I am feeling pressured to accept their offer.

Losing Health Insurance from my parents... Unsure which option to Take?

    Posted: 07 Dec 2017 08:15 AM PST

I'm a 21 year old student at the University of South Carolina.

My school offers health insurance that it seems they add to the tuition and I also qualify for Obamacare.

How do I choose between these two options when there's mounds of paperwork to look through?

I don't have any major health problems and only visit the doctor 3-4 times a year with minor illness.

Is there anything specific I should be looking out for? Health insurance is so complicated so any assistance would be appreciated.

First At Fault Car Accident - Some Questions

    Posted: 07 Dec 2017 07:12 AM PST

I'll make this as short as possible. Basically at fault for rear ending three cars, One car is considered total and two others need repairs (10k (total loss car), 6.7k, and 2.1k respectively).

I unfortunately was stupid enough to have 10/20/10 (State minimum). Obviously the amount of property damage exceeds my policy limits.

I learned my lesson and first thing after the accident I changed my policy to 100/300/100. Besides that, I'm assuming my insurance will pay out the 10k and I suppose the insurance companies will come after me for the remaining 8.8k through subrogation. Are insurance companies willing to work out a settlement/payment plan? I don't have 8k laying around to pay them, but I am more than happy to be a responsible citizen and pay my dues.

Also the car that is considered a total loss has the same insurance company as I do. Does that somehow work in my favor by any chance?

Am I overpaying for auto insurance?

    Posted: 07 Dec 2017 05:26 AM PST

I am a 24 year old male, have been driving for 5 years with no tickets/accidents. I've been with State Farm this entire time.

My auto insurance through State Farm (North Carolina) for my 2014 Toyota Tacoma is $161/month. I just got a quote from Geico for $59/month for full coverage..

I called my State Farm agent and expressed my concerns but he said he could only lower it by a tiny bit vastly increasing my deductibles.

I don't have my exact State Farm coverage benefits to give you guys at the moment, unfortunately.

Should I switch to a new insurance company?
