Sued my biological father, awarded a large sum. Attempt to collect or sell the judgement? He ran away to Texas where it appears to be impossible to collect.

    Posted: 10 Dec 2017 08:56 AM PST

The short story is that my cousin and I went through a trial jury and I specifically was awarded a rather large sum of money. Cousin was awarded a rather small sum of money. She has since received her share. After appealing and losing, and attempting to bankrupt the judgement and losing, my biological father disappeared. He divorced his third wife and years later we discover he's in Texas. At this point the judgement owed to me has swelled with interest up to almost a million. The judgement is extended every 7 years until it is paid in full.

We attempted to garnish his wages to no avail due to Texas collection law. My attorney in my home state has been unable to find an attorney in Texas willing to take it on, again due to Texas collection laws. At this point we are faced with a few options. I can pay to have an asset search done and see if he has been dumb/comfortable enough to keep assets in his name we might be able to take. I doubt it. The man is incredibly intelligent and manipulative. We can attempt to sell the judgement, or we can keep renewing the judgement until he crawls out of his hole.

I've tried to research this as best as I can but I'm having difficulty finding information on how my case would fit into the laws of Texas. I'm trying to determine a few things. If he passes away, would we be able to take any assets (vehicle, life insurance, retirement) from my estranged sister who is undoubtedly his beneficiary? He's a 58 year old lifelong alcoholic and off and on drug user so I don't imagine he will outlive me. If we were to sell the judgement, would we get anything for it, given that because of his current state of residence it could be considered uncollectable? It can't be bankrupted, but that seems to be my only advantage if I went that route. And is my understanding correct that if we did find anything in the asset search, he would essentially need to have two of everything for us to take anything?

Sorry for the long read, but any guidance or resources would be greatly appreciated.

Parents want to add clause to will stating that I cannot sell home [NYC]

    Posted: 10 Dec 2017 06:56 AM PST

    Hi /r/legaladvice,

I was having a conversation with my parents recently and want to include a clause in their will blocking me from selling the home upon their passing. They'd like me to rent the home out until a time that I move into the home (which I'm not sure that I'd ever like to do).

While renting the home and monetizing it over time is ideal, and I have no intentions to sell the home in the years ahead, sometimes the unexpected happens and I would like to be agile in a rapidly changing housing market.

My question is - to what degree is a clause like this legal and enforceable? I can't imagine that if I'm unable to continue to pay taxes, maintenance etc on the home that I'll simply be unable to anything but keep it.

    Thanks in advance!

[Update] I [27/M] was raped in San Francisco this summer and didn't report it. I regret that now. I was there as a tourist from Europe. How do I go about reporting it now?

    Posted: 09 Dec 2017 02:23 PM PST

    https://www.reddit.com/r/legaladvice/comments/7btzy4/i_27m_was_raped_in_san_francisco_this_summer_and

I called the SF police, they set up a Skype interview with a detective. Making the report took well over two hours. It was tough. But doing it at all felt like a personal victory.

A few weeks later the detective emailed me to say that, unfortunately, the club's cameras were not helpful. They did catch something on a nearby apartment complex's front door camera though. The footage is too grainy to make much use of, but they were able to see his approximate height and build. If someone is caught doing something similar nearby with a similar build, they might be able to get him to confess to it.

Not very high hopes, but it's something. At least I can say that I tried.

Thanks for all your advice. I was lost and you helped me find the way. It's much appreciated.

Pulled over while touring with a band, cop claims I need a CDL because we make money. $2600 in tickets.

    Posted: 10 Dec 2017 09:31 AM PST

    [Pennsylvania]

I have a 28ft school bus converted into a motor home. It's registered as an RV. A few months ago I was pulled over in Pensilvania while on tour with my band. We are a six piece that plays primarily backyards, and houses, with the occasional show at a bar. We make maybe $0-100 a show we play and that's split six ways. The cop claimed that because we make money that made my vehicle a "commercial vehicle " and proceeded to give me $2600 in tickets and towed my bus. He then said we couldn't get it off the property without someone with a commercial driver's license driving it.

I'm confused as to how he was able to do this? If I was driving a mini van would he have towed it under the same rule? If we had cancelled tour, why would I need a CDL to drive it off the property?

My apartment building was sold and two parties claim I owe them rent (IL)

    Posted: 10 Dec 2017 09:59 AM PST

I have a lease from the 15th to the 15th of each month. My apartment building was sold on December 4th. Both the old landlord and the new landlord claim my rent due December 15th goes to them.

I'm inclined to believe the new landlord, but the estoppel certificate doesn't actually specify one way or the other.

What's the best way to deal with this so that nothing comes back and bites me in the hindquarters later?

[CANADA-ONTARIO] Relocated across the country for a job, only to be a told the job is no longer available a few days before i start. They are neither willing to pay the relocation fees nor my signing bonus.

    Posted: 10 Dec 2017 02:43 AM PST

I recently relocated for a job as a software developer with a financial company. I accepted the job, and signed my letter of offer around a month ago (which they acknowledged they received).

However last Wednesday evening i received an email from HR more or less stating that:

    • The position i was hired for is no longer available
    • I will not be receiving ether my relocation reimbursement, nor my signing bonus

After reading through the ~50 pages of my letter of offer, i cannot find anything aside them stating i will receive up to X amount for relocation expenses, and i will receive Y amount for my signing bonus that will be paid on my first pay period. Is the fact that i am not going to get a first pay period a valid reasoning for this? (i may just be completely grasping at straws here).

HR has not responded to ether of my follow up emails with regards to my relocation expenses, and my signing bonus. People in /r/cscareerquestions suggested i post this here. So i am wondering do i have any sort of case?

[VA] Friend is storing stuff in my garage but won't remove it

    Posted: 10 Dec 2017 07:53 AM PST

A few months ago, a family friend was moving places and need a temporary place to store some of his things. I had some open space in my garage downstairs, so I agreed to let him store his stuff. Now I'm set to move on January 1st and I need to get his stuff out of here, but he hasn't come to get it, even after multiple requests to do so. Friday was my deadline for him to come get it. Would there be any legal trouble or repercussions to me either throwing it out or selling it?

[GER] Someone uploaded my free indie game on another site and acts like its his, anything I can do about it?

    Posted: 10 Dec 2017 09:52 AM PST

    My game: https://yeswecamp.itch.io/pixel-heist

    "His" game: https://gamejolt.com/games/pixelheist/302391

He copied everything, the description, the title, he didnt even made his own screenshots. He just downloaded it from my site and re-uploaded it, so it's easy for me to prove that I am the true owner since I am the only one with access to the sourcefiles.

He also copied my username (which isnt illegal I guess) and acts like he created the game in the comments, for example: "I really like your game" - "Thanks, really appreciated!", which is pretty frustrating for me since I put a lot of work into it and he just literally copied it.

I already emailed the support/contact of the site he published it too, but I got no answer and me and some other players of my game reported it with the report function on the site, but its still up.

I commented under it, asked him if we could talk about it and that I am the real owner of it, but he just deleted my comment and several others that stated it wasnt his game and linked the original link.

What options would you suggest to me in this situation?

Edit: I am from Germany, I dont know where he is from.

Is a permit needed to collect mountain goat wool in Washington state?

    Posted: 10 Dec 2017 12:31 PM PST

My wife and I spin, and I've recently started doing wool preparation. I've heard that mountain goats shed heavily in early summer, and that the wool is rather nice if you collect it from bushes where it snags.

What I haven't been able to figure out is whether a permit is needed to collect shed wool. I've been through a number of state websites, and I've worked out how to get a permit to hunt mountain goats, but I don't want to kill them, just collect their wool.

Does anyone know whether this is ok to do in forest service or national park land?

Can private nightclub security staff force you to move off a public sidewalk? [CA, USA]

    Posted: 10 Dec 2017 10:38 AM PST

For context, I was waiting for an Uber on the sidewalk. The nightclub's security informed us that we needed to move 100ft from the venue, and continued to yell and scream until we would move.

I told them this was a public sidewalk, and that i was waiting for an Uber driver to pick me up, so I didn't need to move anywhere. They said they were happy to get the police to rectify the situation, but we ended up moving a dozen or more so feet along the sidewalk, which put us outside of their '100ft from the nightclub' perimeter.

They claimed they had an agreement with the city, but I really found the claim dubious. Is it possible for a private venue to kick you off public property -- specifically the portion of the sidewalk that is right outside the establishment?

Also, for additional context, this was around 2am, which is basically closing time for the bars and night clubs. They didn't seem to mind people standing there prior to 2am rolling around.

We will fill out paperwork stating I won't have any responsibility. I like to think my man juice is of a high quality and don't see any issues handing it over.

Does anyone have any negative experiences doing something like this? Is there anything I should be thinking about before jumping into this head first and then never thinking about it again?

My mom have been arrested 6+ times and incarcerated wrongfully.

    Posted: 10 Dec 2017 11:32 AM PST

    Maryland, USA

About 9 years ago, my mom was wrongfully arrested for a case of either first or 2nd degree assault that occurred several years prior to her arrest. She was locked up for over a month and was finally found not guilty and released.

Months to a year later, she was arrested AGAIN for the same reason and was locked up for about 2 weeks and was released again by the court.

The court finally advised her to change her name so her name isn't identical to the assailant who actually committed the crime and gave her a document to carry with her stating that she is not the person that the police are looking for if she was ever arrested again.

For the next 8 years, she was pulled over, arrested, and detained several times, but were always released after a few hours because she had that court document.

Few days ago, the police came to the small business that she started not long ago to arrest her again. She showed the document given by the court, but the police refused to acknowledge it. They claim that they are arresting her for something else. When I asked what they are arresting her for, they said "2nd degree assault", which is the same charge from previous arrests. My mom tried to explain to them how many times she had been arrested and that she needs to be at her business since they only have 3 people total, and the business cannot run even with 1 person missing. When the police officers demanded her to get in the police car, she did not immediately obey them because that business is what feeds her and pays her bill, and she kept trying to explain that to them with her poor English. At the end, she asked if she can give the car key to us before the cops take her, and they refused. Then, she tried to get my and my stepfather's attention by yelling our names in our language (we were inside the store taking customers at that time). Then she was immediately pinned down onto the ground and handcuffed. Shes still in jail right now and its been 4 days. The original assault crime that she was wrongfully charged for isn't whats keeping her in jail. The fact that she tried to yell our name in our language and slightly resisted the cops from taking her is the reason. She got charged for disorderly conduct and resist arrest just for that. Now we have to hire lawyer from our empty savings account to get her out and her business haven't been able to run properly and probably lost customers.

We should we do about this? We have been letting this go because of her lack of English and our incompetency in Laws. We can't have this go on for the rest of her life and have her get arrested and sit in jail every few months and have to spend a large sum of legal fees to just get her out.. After she gets out this time, what should be my steps to prevent this from ever happening again? I was thinking about hiring a civil lawyer..

Would landlord be liable for this damage or is it entirely on me?

    Posted: 10 Dec 2017 06:39 AM PST

I am currently leasing a commercial space in a small section of a larger warehouse for my business. It has come to my attention as of a few days ago that the insulation in my ceiling is taking on water.

Upon noticing the damage, I immediately notified the landlord and they sent a roofing contractor over to assess the damage. I showed the contractor the damage inside and he went on the metal roof to search for leaks.

He didn't find any leaks whatsoever in the roof and he helped me drain roughly 20 gallons of water out of the insulation inside my unit. He emailed both me and the landlord afterward stating that there is no vent in the roof on my side of the building for the condensation to escape and that would be his plan to fix it.

He told me privately that all of the insulation will need to be replaced immediately as it is useless when wet and may also harbor mold if left unattended.

I have asked landlord to speak with me so we can manage a plan to remedy this situation and will be speaking with him early this week. He has emailed me since to state that he doesn't feel as though he is responsible and that I need to check with my insurance to see if I am covered in the event that any further damage comes to his building as a result of this water damage.

I don't believe that this damage was a result of my business operations or anything I have done and it appears that it was a lack of structural planning as to why this damage has been caused, as stated in the email from the contractor recommending adding a ridge vent to allow condensation to escape.

I plan on getting another opinion from an insulation related contractor as I want to take the necessary steps to fix this damage. I don't plan on moving out as it would be more costly and damaging to my business to do so. But, as a tenant, I don't feel as though I should be responsible for the related costs to fix this damage.

Thank you for taking the time to read about my situation. My question is should I speak with a lawyer or any other type of professional for assistance with this matter? Or should I suck it up and pay to fix the damage caused and move forward with my business? Any and all advice is appreciated. Thank you

Edit; btw this is a commercial lease in Maine. I attempted to edit this into the title but having a difficult time on mobile.

[MA] I [25/F] was hit by a car. Can anyone give me an idea as to how this is going to play out?

    Posted: 10 Dec 2017 07:12 AM PST

I was hit by a car going fairly fast, ended up chipping my spine slightly and hopefully that's it. Given the conditions I think I got super lucky.

I think it was both of our faults, we both should have been more careful. But I don't know for sure and don't know of a way to actually check. Am I allowed to look at the police report and if so, how?

I'm def not looking to sue the driver, but I'm confused about what happens from here. I've been told that his insurance will try to get me to sign a settlement early and have been told not to sign, but I don't really get what happens if I don't sign.

[MO, USA] My girlfriend and I share an apartment lease and recently broke up. She wants me to stay until the end of the lease, or pay all termination fees on my own.

    Posted: 10 Dec 2017 10:15 AM PST

Hi all, here are some more relevant details:

    • We share an apartment for which the monthly rent is $890. The termination fee is $1350 + an additional two months of rent. Total termination cost would be $3130 (but we would continue to live here for 2 months)

    • Lease ends in July (7 months from now)

    • For personal reasons, I am not willing to continue living with her until the end of the lease and would like to move out ASAP. This is not a negotiable point for me. What is negotiable is me giving her some time to figure out what her options are, but that's about as far as I am willing to go.

    • For a number of reasons (summed up to her own convenience), she wants us both to cohabitate until the lease is up. She says that if I were to terminate then I should have to pay all the fees, because "it would be my idea to terminate."

    • I would like for us to split the costs 50/50 and go our separate ways - I would even be willing to pay 50% of the month or two that I'm not living here, which I think is already more than generous.

    • Both our names are on the lease which means we're both legally responsible for the apartment, but currently the bill pay is set up in my name (she just writes me a check for half the amount each month).

    • I know for a fact that she can easily afford her half of that fee. While I can also (barely) afford paying 100% of the fee, I don't think this is fair and would like to avoid that if at all possible.

Do I have any leverage here from a legal standpoint? Does she have an obligation to contribute half? Can she legally force me to pay rent for the remainder of the lease if she doesn't want to terminate? Obviously I would like to avoid getting into a legal battle, but I think that if I can point out that her argument of "I should pay all of it" doesn't hold water, that'll go a long way towards making a peaceful negotiation.

Thanks for any input or resources, guys.

They're trying to raise the money/borrow money to get it out, but I would think with a stolen car the impound fees would be waived or am I wrong? This is occurring in Davis, California.

My [19M] brother's [16M] was broken during a locker search

    Posted: 10 Dec 2017 12:12 PM PST

    This happened in MI.

So the short story is that while they were doing a routine locker search (gym lockers, locker room) the person looking through stuff broke his phone. He wrapped his phone up in his regular clothes when he changed into gym clothes and put it in his locker. The person checking it must have pulled them out and the phone slammed into the ground. The screen is all cracked and broken but the phone still works.

He talked to the teacher and the teacher had an attitude of "there's not a way you can prove it" so they didn't do anything. His phone was definitely not broken before the search.

What are my mother's options regarding getting compensation from the school for the screen?

Question about shared mortgage after divorce if one party dies.

    Posted: 10 Dec 2017 07:24 AM PST

My husband is previously divorced and shares a mortgage with his ex. There was a quit claim deed executed after the divorce per the divorce terms releasing him from the title. The ex has financial responsibility for the property per the divorce but has not taken any steps to refi or sell the property so the joint mortgage remains.

I have questions about two possible scenarios -

If my husband were to pass, does the ex become solely responsible for the mortgage or does the debt go against my husband's estate (i.e., our home, cars, any other property he and I own)?

If she passes, we are not sure who is set to inherit the home from her since he has not claim to title. How does that work since there is a mortgage and he would become responsible for it?

The ex and home are in Oklahoma. We reside in Florida.

(NSW, Australia) King hit at a bar for standing up for marriage equality.

    Posted: 10 Dec 2017 04:08 AM PST

On Friday night I had my staff Christmas party at a local hotel. It was a family friendly venue with a playground and restaurant so children could come along. After dinner a few of us went out to have a smoke and a press on the pokies. There was an old guy and two of his mates out there and they were talking excessively loud (ranting) about the marriage equality laws being passed and how it will turn kids gay and kids will be exposed to everything gay at school nowdays, turning them gay etc. Typical bogan with only one front tooth.

I was sitting in my chair playing the pokies and I turned around and went to say something to him, I got three words out of my mouth (ok mate look)", and bam. He stood up and threw a hay-maker at me hitting me in the side of the head. I kept my cool as best I could and didn't hit him back or even touch him but Í stood up from my chair and a few angry words were exchanged (to put it lightly). He didn't throw another punch after he realised his king hit didn't knock me over but I'm more upset about what he was trying to do.

The bouncers removed all parties involved (myself included) as they told me this was their policy to remove both parties. I objected as all I did was get king hit to the side of the head while sitting down, but went along with their instructions. I filed a police report and left it there for the night. Went to a staff mates house for kick ons and enjoyed the rest of my night having an optimistic outlook with a funny story for work on Monday.

Today I called the police to check up on the report, and they said the officer in charge of that case was off until Wednesday 13th (she finished her shift that night) and there would be nothing happening until that date when she returned. I asked if she had viewed the footage that night and the officer on the phone told me no. I asked if there was any way I could view the footage and he informed me to call the venue and ask, however it was most likely not going to happen as they have the right to refuse. He told me it was worth a shot if I felt like it though. So I phoned the venue and asked about it. I was told that the boss was the only one that could allow that and if I want to find out I have to talk to him, and was informed he started in 20 mins so come ask him myself.

I drive down to the venue and walk in, the boss is there waiting for me. He asks "are you the guy from last night?" I reply yeah, can I view the footage. He immediately starts going off at me, saying fuck off and go fuck myself you're not the police so fuck you. He then tells me he viewed the footage and I started it, I ask how did I start this by getting king hit whilst sitting down. He proceeds to lose it yelling fuck off fuck you don''t ever come back etc.

I leave and call the police to add this to my statement. Leave it at there for now.

Tonight I go out with a mate for a few drinks at a different venue in town and run into one of the bouncers from the altercation that night. He comes up to me and apologises for everything(he didn't see the altercation only rocked up after it all went down), saying he and another bouncer watched the security footage this morning and agreed I had done nothing wrong and he shouldn't have removed me but it was just policy nothing personal. I told him its all good and I don't hold anything against him and then we went our separate ways.

I've written down everything that occurred and jotted down the times, is there anything else I should be doing from here on out? As it will be Monday tomorrow, I intend to contact as many people as I can to report this as I am very upset with the owner of the venue. It seems he would rather this all be swept under the rug so to speak. I would have done it today but everything was closed till Monday. I will be contacting the local paper, local liquor accord, council and everyone else I can think of. I know they have the security footage that will back me up as both the owner and bouncer said they have watched it.

Will that get me into any trouble and or disrupt the investigation ( which won't resume until Wednesday 13th) and are there any other regulatory agencies I can take this up with? Oh I almost forgot, I took a photo that night showing the bump on my head from the punch. I haven't been in this situation before so any other advice for things that I should be doing or people to contact would be appreciated. If anyone wants any situation further explained don't hesitate to ask.

[GA] Neighbor interfering with use of public lands

    Posted: 10 Dec 2017 09:50 AM PST

My neighbor is purchasing a vacant lot that will block off my neighbors and my access to public land near a lake. I believe she is doing this out of spite, to the tune of $200k+. She came out as i walked my dog at 7:30AM and yelled this at me from a distance, and that she will be building a fence. To this i replied "Congratulations, have a nice day."

On a nearly daily basis I walk my dog on a 0.6 mile loop through some woods belonging to the Army Corp of Engineers, bordering a lake in Georgia. The trail begins in my backyard, goes down by the water and then toward the cul de sac at the end of my street. I cross a friendly neighbor's (FN) property to get back to the street to get home (with whom i have permission to cross to access the woods).

FN's neighbor, Crazy Lady (CL), has been unpleasant in the past about walking my dog (I now ALWAYS use a leash and avoid her property, but i've always cleaned up poop), and she has also accused me via facebook (messaged, not friends) of putting garbage in her mailbox and trespassing. My understanding is since she has now told me she doesn't want me there, any further infraction after i've been warned is trespassing, so i have not tested her, staying strictly on FN's property. CL has confronted FN about my use and has been told I have his permission to cross his property.

She has recently butted heads with New Neighbors (NN) over their removal of trees adjacent to the shared property line. NN and their kids really like my dog, but their layout is such that my crossing would jeopardize their privacy more than crossing FN.

CL said this morning that she is purchasing the vacant lot shown in this map, which will cut off access from FN's property. This will also block access to a trail that has always been used by residents on the other street to the east.

The land has a creek running through it so a perimeter fence is impractical.

Do my neighbors and I have any right to access to these landlocked public lands? How can i verify she indeed has bought the lot?

Harassed more than once by K9 + sheriff and I'm sick of it.

    Posted: 10 Dec 2017 10:14 AM PST

I live in the state of Wisconsin. About a year ago I started selling Marijuana, and finally the police caught on and I got caught. Not for distribution, but for possession and paraphernalia. Since I got caught, I stopped selling for obvious reasons. They want to catch me. They have no doubt and they are trying to accuse and capture me with something I don't have relations to anymore. Sometime in some location in some city in this state the story starts: I was on my way to my friends house, and I saw a police officer. As I turned onto the stretch to get to his house, and the officer speeds up from his stopped location and tails me. I pull into the Local McDonalds hoping he wouldn't follow. As he followed, I drove into the drive through and he went into the parking lot and waited for me. I knew I was getting pulled over. I grabbed my water from the drive through, went out the back hopefully that the cop wouldn't follow me because it's late at night and I just wanted to get to my friends house. I pull into his Apartment driveway and I see the cop behind me tailing me again. He drives past the driveway and I pull into my parking spot and park. I get out, lock my car, and am about to go into my friends house when I see the cop pull down the drive and turn on his lights. I stop and look at the officer curious what the situation will be. He gets out and asks if it's my car and I respond honestly, "yes sir." He said something around, "Your license plate display light is out, please step back into the car so I can talk to you." I unlock my car, step in, and my friend who was with me was also told to get into MY car that we were being questioned. While in the car, the K9 unit was called, and 3 other squads showed up for a "routine stop and search." I was asked to step out once the K9 got there and I clearly said that I didn't accept my car being searched, just the outside. This is because last time I got searched and caught, they tore up my car. But since i had nothing in my car, I consented to them going around the car to smell anything. The dog went around, and not once did it get snagged by the K9. They came around and I got talked to by the sherrif, being held against my will, for nothing but "an out license plate display light". The story then changed.... I was told that many people report me for drug dealing and that they have suspicion on my car, even though the K9 didn't find anything. I got talked to and they insisted the reason the K9 didn't find anything in my car was because it was cold, late, and the dog wasn't smelling correctly. I stated, "There's only one reason, and that's because there is nothing in my car." I got asked to step into the squad (I'm still not cuffed, and never was this night, nor arrested or fined.) As soon as I'm in the locked car, I see them going into my car tearing it up and looking for any evidence. Many times was the door opened and was I questioned if I was high, if I had smoked, if I had weed, if I sell weed....Many different things.
If a dog with like 30x smell as humans, didn't smell anything, how could they piece together enough to search my car, though? After I got searched, harassed, and never once detained or arrested or even fined...My car is left a mess, my emotions are a mess, I legit have PTSD from them harassing and having everything in that car tore up and thinking they'd find something but never once found anything.

My question is, is there anything illegal that I can sue them for? This is the 4th time I've been pulled over, 2nd time I've been searched, 3rd time I've been harassed, and about the 8th time I've been tailed. Can they remove me from private property like that? Can they search me legally? Can they legally go through my car like that if the dog didn't even hit on my car? What do I do to make it stop? What do I do to prove them wrong.

Also some extras: I got asked why I was slurring my words - it was 20 degrees out and I was outside freezing. The Sheriff thought I was on drugs.

Private property, outside of car, no k9 hit, no problem right?

They broke some things in my car and car was scratched from the dog hopping on the car (dogs sit when they find something not jump).

Kept me against my will for over an hour to find nothing.

Edit: When I got caught over 3 months ago, I got caught with about a quarter of Marijuana and a piece. My fines got dropped because I got searched Illegally.

I served 25 hours community service.

    On call hospice nurse

    Posted: 10 Dec 2017 06:52 AM PST

Hello all, I am an on call hospice nurse in Illinois. I am on call for 99 hours in one week, but am paid a salary for working 80 hours in that one week and off the next week. I am required to attend meetings (2 to 3 hours monthly) and stay past my on call hours if I get a late call.

In this position I typically have anywhere from 1 to 3 patient visits at various locations scheduled. Drive time alone can be 1.5 to 3 hours each day, but miles compensated. Visit times can range from 30 minutes to 3 or 6 hours per visit. On top of these scheduled visits I have the actual on call requirements I was hired for which can look similar to the scheduled visits. All together I can work close to 65 hours if we include time on phone, email, drive time, visit time and charting time. Keep in mind this is chopped up throughout the day and you get very little rest for this one week.

Also during my time off I receive emails to correct charting or with questions. The on call laws seem to be left a bit up to interpretation so I am trying to figure out if my employer is just taking advantage of the situation or if this is perfectly legal.
