    Edit: Thanks for all your responses. I read every single one of them and yeah, I forgot the key thing that I live in Spain.

    I guess this is an expensive life lesson. Law stuff here is very slow (probably like everywhere all around the world) so I believe It's not worth the money and time to get some euros back.

    For those interested, my car is a 2007 Opel Astra H with 'apparently' 120.000 km. It costed me nearly 4000€. I purchased it on a car workshop which funnily enough has recent negative ratings in Google sites, all related to cases like mine. I've checked Carfax and official state vehicle revision history (ITV as known in spain) and I've had no luck finding an evidence.

    Again, thank you all for the responses and I hope this post works for somebody out there since it has reached a lot of upvotes.

    [HAPPY UPDATE][Fl] Landlord is limiting number of parking spaces to 2 per unit, have 3 adults in the apartment. Solution offered was to rent a garage at $100 a month.

    Hi guys! Happy update to this!

    I went to the front office and talked to the manager and was very disappointed. More or less got brushed off, but I still made it clear that I was very frustrated that they were handling the lease in the manner that they were. I informed them due to how strictly they were holding to the letter of the lease, I'd like to do the same and noticed that the lease said all residents would be provided a remote control to access to the gates explicitly. This was a problem, as our gates to our complex only allowed card access, and didn't have the ability to open with remotes. The manager asked me for a screenshot, which I provided.

    I was frustrated, but figured if they were going to utilize their ability to change the lease at will, I'd hold them 100% to what we were provided.

    Today, I got an email from the manager saying that the lease says 1 car per leased resident, and that's what they're holding to. So all three of us in our apartment get the spots we were promised. I learned my lesson though- next time, get anything promised EXPLICITLY in writing and be careful of vague "may change policies at any time" language.

    So we just got back from the court house. My father decided (in all his wisdom) to send me an email threatening to "spank my ass until it turns red" after being served with the court summons, as well as not show up to court. So the motion was passed and I most likely wont be hearing from him anytime soon.

    Employer asks me to do electrical work. I'm an IT guy.

    In the great state of Illinois, in Kane County if it matters, I have been asked by my employer to take ballasts out of 277v fluorescent fixtures so that we can use non-ballast LED tubes.

    I am an IT guy. I have zero education in electrical work, and in fact I am mostly afraid of electricity due to some unpleasant experiences that I have had in the past.

    I am willing to do what they are asking, since the work is pretty simple: make sure the light is off, Cut those wires, screw a wirenut onto those other wires, put it all back together.

    I have however, due to a lack of familiarity and not being in practice with that job skill set, cut through a hot 277v line (no injury, just a now worthless set of wire cutters) and plugged "ballast required" bulbs into a non-ballasted fixture. (No injury there either, but that typically results in shattered bulbs and with my face right up in it, could have resulted in lost vision).

    Despite those occurrences, I finished the first office of four. My wife is insistent that I cease immediately, that not only is my health in jeopardy, but that we would be personally liable for any accidents that happen as a result of my work whether to me or someone else after the fact as I am doing work for which I am neither licensed nor trained. And the company's insurance almost certainly does not cover this situation. Though I am willing, I do also feel coerced, because I need this IT job and I can envision this falling under "other duties as assigned"

    Despite being an IT guy, I regularly find myself in the role of facilities maintenance, but it is usually benign things like replace this toilet tank stopper, or fix that hinge.

    HR is aware I have no skill in this regard, and has observed me taking apart the lights in her office, so nothing is immediately coming to her, or if it is, it's not moving her to action.

    I guess my question is "what is my liability here?" If I am continue this work, what do I need to secure from my employer? Can my employer even protect me from other people who might decide to sue me since I was the last person to touch those lights?

    No heat in our rented home, landlord says nothing can be done (OH)

    So I live in a house at a college town in Ohio with 3 other roommates. A few months ago a worker from our gas provider came out to turn on the gas for our water heater, and while he was here saw that our furnace for upstairs, where most of us sleep, is located in my bedroom, and is flush with the walls and ceiling in a closet-which apparently is not allowed. So he turned off the gas for the furnace and contacted our landlord about fixing it. We heard nothing for a couple months so I called our landlord and told him we don't have heat and it's starting to get cold. They send out their maintenance guy who takes a look at the furnace and tells us that nothing can be done about it unless got a new furnace to fix the issue. That was a month ago.

    Our thermostat is now reading 65 degrees and it's only getting colder. I've called multiple times to our landlord's office and every time they tell me they're "looking into it". Is there any possibility to get rent abatement? I can't find any specific housing laws in regards to minimum temperature in Ohio. Do public universities ever have any legal resources we could utilize? Any help is appreciated.

    [CT] Packages are being stolen from my building's mailroom constantly. Can I put a GPS tracking device in a fake package and find out who the thief is?

    We live in a large building where there's a mailroom on the bottom floor (couriers & owners need a passcode to enter the building from all sides). I've seen a few packages opened up and it looked like someone rummaged through them. Today was the final straw when my package worth over $500 was stolen. FedEx tracking said it was delivered. I called and filed a claim with FedEx and then filed a police report with my local PD. The mailroom does NOT have cameras but apparently the police officer said he's already had a few theft reports filed from this building for packages being stolen. Many of my neighbors have also said their packages have been stolen.

    I've called my association and left a message but I will also be e-mailing them with the police report attached to document my proof and demand cameras.

    There are cleaning people that also have access to the building that are always here in the mornings (around the time packages are delivered and only a few people in the units are here).

    My legal advice question is: Can I plant a fake package addressed to myself and leave it in the mailroom with a small GPS tracking device (like one of those pet tags/keychains you can get on Amazon) and would it be legal? My goal is to track the bait to the thief and follow their track (if it's someone in the building vs. getting a license plate with someone leaving with the package and reporting them to the police).

    edit: My association called me back and said that they would not be able to put in real cameras or fake ones because they would be liable and that it would cost money to have a security system in place. She then told me to go to a board meeting to bring up the issue but it's been brought up many times that she doesn't guarantee I'd get this issue resolved (weird, because the board is made up of unit owners like myself). I also asked her how long the cleaning crew has been there and she said it's the same company for many years. (Which makes them and the unit owners the only people that have constant access to the mailroom) - she got very irate and almost offended that I even asked the question and she said how I could "make such a baseless accusation without any proof" (seems like a red flag).

    Asking this question for my boss/founder of the company I work for.

    Basically, we are an agency that finds and arranges home stays for Chinese students.

    I attached parts of a contract this student's family would have signed that I thought were relevant. The mosaiced out parts all list my company's name. https://imgur.com/a/ww8tV

    Student told us he has HIV. Fine. In the US, it's actually ok to have HIV and still get a visa. Under the contract, he's technically not allowed to be having sex, so he's not going to spread it. Then he gets real sick and goes to the hospital. He has a more serious STD. One you're not supposed to be able to enter the US with. We tell the school and the host family and decide to kick him out due to breach of contract. He thinks we should find him another home stay, but obviously that would be very hard and we believe irresponsible to do, due to the disease he did not tell us he had.

    His family is now suing, I'm guessing because they feel like we should still be able to provide him with a homestay.

    From what you can gather, do they have grounds to sue?

    Please help! I've won a small claims case against my landlord for $1200, and he refuses to pay. He has also told me he will file for bankruptcy.

    (US) (California) On March 28th 2017, I signed a lease and paid a man named Kenny 1250 dollars to rent a room in his house. 600 was the security deposit, the other 650 was for a month of rent. He told me that the room would be available on April 1st. Come April first, and he tells me that the previous tenant is still in the home and that room will be available April 3rd. I slept in my car for two days until then. Come April 3rd and he tells me that the room will have to wait until April 5th. I recognize this as a breach of contract and immediately demanded my money back. He refused, so I took him to small claims court. I won the case, and the judgement declares that he owes me the $1200.

    It has been more than a month since the judgement, so he cannot file an appeal. I texted him, and he says that he still will not pay, that he hasn't had a job in 5 years and that he will soon file for bankruptcy. However, when I fist met him he and another gentleman were hanging out together, the man drove an van for some local air conditioning company, and they were both wearing the same uniform, so I assume he is lying.

    I called the small claims advisor. They told me I can set up a wage or bank garnishment, but I do not know where he works or what bank he uses. They also told me I can request a special hearing in which Kenny will be forced to tell myself and the court where he works and what bank he uses, but I was also told that most people refuse to show up to this hearing, dragging out the process.

    All I want is my money back. The money which I worked really hard for and was stolen from me by some lowlife. Money which the court of law declared is legally mine. Yet this man is doing everything in his power not to pay me. Please tell me what options I have.

    TL/DR ---- I paid a man 1250 dollars to rent a room. He never made room available, so I sued in small claims court and won. He is doing everything he can to not pay me.

    (Edit 1) I would also like to know if he is breaking any laws or doing anything which could result in him being fined.

    Quite a few members of the community know about my medical details which were only known to her. I only figured out why recently after finding out this doctor loves to gossip.

    She did not use my name explicitly, but used a clear enough description that it was easy to figure out who I was. Is there anything I can do about this?

    Help! My car was hit by a minor on a bicycle while I was stopped and the car suffered damages (no physical damages to me or minor). Parents are not taking responsibility and threatened to countersue if I take action.

    Hi everyone. About a week ago, I was involved in a minor car accident involving a motorized bicycle. Here's what happened from my point of view:

    I had just been at the post office and had pulled out onto the driveway entrance ramp to wait for a safe time to make a left turn. I had been sitting there for roughly 3-5 seconds when suddenly I hear a loud bang and a young man rolls over my hood. Terrified that he had been hurt, I quickly got out of the car and asked if he was ok and if he needed me to call anyone. Luckily, the boy, who turned out to be 17 years old, got up and was fine. Honestly, he was more worried about his motorized bike than anything else (again, it was a motorized bicycle, not sure if that makes any difference). He called his mother to tell her what had happened. Meanwhile, I went around to the side that he had hit and there was very clear damage to my car on the bumper, side panel and the hood. I can post pictures if that would help. To be clear, he had been riding on the sidewalk with no helmet, against traffic and apparently had not seen me blocking his path, which I had been for about 3-5 seconds, enough time for him to see me and stop, I would think. I'm not sure of the laws, but I do not think you are allowed to ride a bike on a sidewalk in my city (Pasadena, CA), let alone one with a motor. I spoke with his mother and she told me that they would take care of it, but requested that I contact her after the holiday (this was the day before Thanksgiving). Unfortunately, out of naiveté, I took her for her word and did not call the police or pursue any witnesses. Big mistake on my part, I know.

    I got the estimate a few days later and was quoted about $2500 for parts and labor. As the mother requested I waited until after the holiday to contact her. I sent her a polite text, telling her where I had gone for the estimate, the amount and that if she had another shop she would like me to go to, I would gladly go there for an estimate. I also sent her a picture of the estimate and the damage on my car. After three days of no reply, I finally received a text from the mother saying I would be contacted by the father soon. Sure enough, a few hours later, the father sent me a long text message. Turns out he's a lawyer (of course), which he made very obvious to me in the text, almost threateningly so. He basically stated that his son is not at fault and any damages to my car are to be paid by myself and that if I pursue the matter further, he will countersue. I wasn't sure if I should include the full text here, wasn't sure if that is a legal issue or could be used against me in any manner. If it's not, I can add the text later.

    Anyways, I'm really at a loss as of where to go from here. I would really appreciate any help you all could give. I can give more details if needed. Thank you in advance.

    How much time does my company have for letting me know I have to move?

    Hi guys! I will try to be quick. I am a spanish young guy, working for a spanish company. However, a little more than one year ago I was told that "next week you're going to Paris for a year or more" (Literally).
    And so I did. And I have been here (Paris) for a year now. I am a consultant, so I work as a external consultant for the french company.
    The thing is... My contract with the french client ends in december 31. One month ago I contacted my spanish boss (With whom I have never worked, he's just an intermediary between me and my spanish company). He told me that I had been renewed by the client and that I would be in Paris another year. The client seems happy with me, I'm really happy with the client. Happy ending!
    So I start the process of renewing my apartment in Paris one week ago. I receive a "threatening" e-mail from my spanish boss requesting me to stop the process of the renewal, as the negotiations between my spanish company and my client are "ongoing". My collegues confirmed me that, normally, negotations take place at least 2 months before the end of the contract.
    So... As of today, less than 24 days until the end of my contract, I don't have any news. And I am going back to Spain for Christmas on the 22th of December.
    What are my options? If I'm not renewed, I won't have time to move out =/ Is this...legal? am I supposed to have, I don't know, like a one month notice? What can I do if finally they tell me to go back to Spain with less than a week?

    I know that legal advice out of EEUU is scarce and hard to get, but I'm feeling really lost here. Any help you may provide is really appreciated.

    False allegation of stalking by university - How do I prove my innocence?

    [Texas] I am a 19 year old sophomore at my university. Two months ago, I met up with a girl through Tinder, who is an 17 year old freshman at the same university. We went to a party / hooked up afterwards, and I thought this would be the last I heard from her. However, we began to message and snap each other for about a week, and then agreed to start a relationship. This relationship would last four days, in which at the end I broke it up due to a notice of odd behavior. One of which she seemed paranoid about people following her.

    1) She told a story about a supposed high school stalker, who would show up at places around school when she didn't ask him to.

    2) We were walking to a football game at one point with a few of her friends. Later that night, she talked about a group of guys that were following her and her friends, and were trying to check them out. I was with them and never recalled seeing these people.

    3) We once agreed to meet up for breakfast. There, she talked about all the parties she went to the night before, but claimed that a couple of guys that she claimed intentionally followed her and her friends from one party to the next, and would leave to the next one the same time they did.

    However, this is behavior I mostly overlooked, mainly due to at the time, I didn't believe girls would lie about that kind of stuff. After breaking up, we continued to remain as friends and continued to talk through electronic means. About a week after we broke up, I by chance ran into her at the Student Union on the way to buy a late dinner. She was with a friend, and I made normal conversation with them. We had a petty disagreement in which I left, telling her that I no longer wished to keep in touch.

    Later that night police showed up at my apartment, claiming that they wanted me to come in to ask a few questions. I comply. From their report, she accused me of sending her a death threat, throwing a chair at her at the Union conversation, and chased her back to her dorm hall, while yelling insults at her. None of this actually happened, so I denied these claims, and police claimed as long as there is no evidence for this, I would not be further investigated. However, the university opened an investigation.

    We were both issued no-contact orders by the univ, in which we were not allowed to have any contact in person, written, or electronic with each other. We were also not to use mediaries to contact each other. The union incident would be the last time I spoke to her for a month, however, in that time period, she repeatedly broke no-contact (I have proof/witnesses for this) by attempting to contact me through friends, acquaintances, in which she would repeat the same bogus story, and then tell the person to apologize / confront me. She also called the cops two additional times, with more false claims that I had followed her again.

    I filed two reports with the DoS office. The first was informing them about her repeated violation of the no-contact order. I also filed a report against her for furnishing false information in her own report. They were assigned to the same person investigating the original report against me. Neither were ever looked at.

    I've been meeting with the Dean of Students investigator regularly. I informed him that looking at the video tapes would instantly clear my name. However, he informed me that video tapes would not be used in the conduct process, however, he would see if he could make an exception. This was a month ago. The last time we met in person, I asked why my reports have not been investigated yet. He told me that he has "no reason to believe [my] word over hers", and that "girls almost never lie about stalking incidents." He also suggested that I am either insane or lying, even though he still had not looked at the video tapes yet.

    Few days ago, I felt like I had enough. I sent brief, cease and desist letters, both to the university and the girl, expressing the impact this situation has had on me, and if the harassment over something provably false continues, I will be taking legal action. This prompted the Dean of Students to immediately suspend me for one year. The questions I have are, 1) What can I do to extensively prove a claim of stalking to be untrue? 2) What legal ramifications do I have in this situation?

    TL; DR: Was falsely accused of stalking three times by ex, university automatically sided with her and refused to look at evidence, got suspended for threatening to take legal action

    Please help! Unsafe levels of Radon in our apartment -- and landlord wasn't responsive. What can be done?

    Hello, legaladvice!

    My husband and I found out about unsafe conditions at our apartment in the form of high radon levels and our landlord did not respond to our requests to verify the hazard or deal with it. She told us we could move out (with a month's notice and full rent during that time) as the issue would "take a while to fix" (see below for details on this claim). Thanks to her refusal to let us know any information, we had no choice, in our eyes, but to leave immediately. We ended up giving our 30 days notice but moved out ASAP (as we were trying to conceive and didn't want to be exposed to radiation) after telling her we were only moving because she hadn't dealt with the issue. Can we get some of the last month's rent back -- it seems horrible to me that she can say we have to pay for another month of living in a space when the reason we are breaking the lease is because she's left it in uninhabitable condition? Can we get any relief in the form of payment of our moving costs since we had to move on short notice?

    Also, she clearly just wanted us gone and to not deal with the issue. Our friend and other tenant says she hasn't fixed it, but she has our old apartment for rent and it pains me to think she's letting some other folks live in a hazardous environment. Would suing her for the issues above (rent relief, etc.) result in a judge forcing her to fix the issue so no one else has to be exposed to radon?

    The more detailed timeline:

    In Mid-October we discovered through a test that was Government-provided (MO DHSS) that our apartment had unsafe levels of radon (note that there are no laws about radon in MO, but it is listed in a variety of building code documents that radon is "hazardous").

    I emailed our landlord to let her know and provided her the results. We asked that she either conduct further testing (we realized that the levels should be measured again to confirm, but we weren't going to pay for another test ourselves) or for her to have someone out to put in the kind of abatement structure that needs to be added.

    I called her to confirm her receipt of the email -- she said she would look into it. I documented this call. A week went by and I hadn't heard from her. I spoke to a lawyer who said to communicate with her again, give her 24 hours to respond. I did so.

    She responded to my request for information (I asked specifically that she provide me her plan for how she intends to deal with it and the timeline) with "I will have my attorney follow-up with you. This issue will take some time to fix. I'll let you break the lease if you want to move out. Let me know if you're giving your 30 days notice."

    I responded that we got her email but that we were still waiting to hear how she intended to fix it and how long it would take. At this point, we had no desire to move and really just want a safe place to live.

    In the interim, my husband called a radon abatement company to ask how long it would take to get an appointment for testing and then, if they found it was still high, how long until they could fix it. They said basically two weeks from the time we called the space could be fixed. We documented this call and its content.

    We never received follow up from her attorney or information on how she intended to address the issue. Since her offer to let us break the lease required we give her 30 days notice and we were concerned that if we were still waiting to hear from her and never did, we'd end up stuck there another month, we contacted her the last day of the month and explained, in writing, that we would vacate the apartment as soon as we could, that we would break the lease, but that we were only doing so because her lack of communication made it impossible to assume anything other than if we stayed the full month -- or continued the lease -- the issue would not be dealt with in an appropriately timely manner.

    We ended up moving out as soon as it was possible -- well before the end of the 30 day notice. Of note, we had to bear substantial moving costs to be able to leave on short notice.

    Cell phone repair - Audio Jack broke off in phone (no physical or internal damage to phone) After repair, everything is broken.

    So my G/f took her Iphone SE to a repair shop, they replaced her full lower assembly to fix the problem (couldn't get broken audio jack piece out of device)

    Once we got home we realized the camera was broke, the store admitted to accidentally nicking it and giving it back without checking, alright don;t know why you would do that but OK. So she takes it back and he replaced the camera, now the phone is overheating and won't turn on/charge. A less then 1 year old phone had a very minor problem and now her phone is seemingly fried.

    How much legal obligation is the phone repair store under to return our product to working order? I just honestly want to say you messed up we want a new phone from apple because clearly the parts your giving us or what you're doing to it isn't legitimate or correct. I assume its similar laws to a car repair shop or the like but I'm not really sure.

    Can we take him to small claims? he's also about 30 minutes from our house so we're kind of sick of traveling to him as this will be our 3rd trip there to resolve this issue.

    Arizona: Wife is attending trial regarding custody of her daughter. Judge says my wife is not likely to get her daughter because we are a military family and liable to move locations every 3 years. Is this okay?

    Sorry for the legal ignorance, guys. Medical professional, not a legal one.

    My main question: is it legal to deny someone custody as a result of employment in the military?

    I imagine the military as a whole might get offended by a decision like this, as the government spends millions every year trying to make moves easier on families and service members. Sounds like a pretty good way to get a lot of good Soldiers to quit the job.

    Of note: my wife's ex is a felon who recently finished prison time for his second DUI. My wife's ex and his current wife live in a 2 bedroom apartment with 5+ kids.

    So just as the title says, my mom's crazy ex is posting pictures of her on Facebook as if they are still together. She has record of all the calls, emails, and texts and he's harassing the crap out of her for months.

    Is there any law in Florida that we could reference to have these photos removed? I really appreciate any advice - this is stressing us both out.

    Can my boss charge a fee for having to correct my time card? In FL

    I know that time worked must be payed. But we're a small business, without much structure, and often short staffed. The owner is tired of having to adjust people's clock in and out times. We use a crappy online time clock that isn't consistent and frustratingly slow to load. It's not that we avoid it, but sometimes you'll clock in, it'll load, we'll walk away and it will need to be clocked again.

    We don't have structured or scheduled breaks, it's different every day based on work load. The biggest issue is clocking back in from break because some of us don't leave and are often still helping on our break. Our break spot is in a common area of the store where customers walk by and ask for help. We help, then get sidetracked and continue the day.

    And clocking out at the end of the day. It's not always the same time. We have a closing time, but often work passed it, and in a rush to finish and go home, forget to clock out. Most of us wouldn't worry about collecting those extra few minutes after closing, but the boss is threatening to charge us an hour's pay per correction.

    Maybe we should find a new clock, but assuming he won't adjust what's the legality here?

    Does anyone know what the legal approach to keeping a dog that I have been ‘watching’ for an extended amount of time?

    Guy will acknowledge I have his dog. Has made no attempt to retrieve it or visit it in two weeks. I would rather keep it than to go back to him because he leaves it in his car for 11+ hours while he is at work 7 days a week. Location: Tennessee

    Child support question, New York State

    Situation: couple aren't together, not married

    Mother is pregnant, makes 200k a year Father is a student, makes less than 40k a year

    Father wants 50/50 custody

    How is child support established and calculated with split custody but mother has residential rights. Will the father be allowed to have partial custody? Will my age and low income (being younger) hurt me in court?

    Anything I'm missing?

    Help please someone is blackmailing my sister and I fear on her life

    Hi a small background we're American from Florida born here but originally from the middles east my family is religious but Im not so lately I've been noticing my sister always zoned out she's 35 years old I'm 32 And in past 2 days she looked like a dead person anymore and I couldn't take it anymore so I had to get the truth out of her , she told me that she used to talk to a guy and he had pictures and conversation of her in a sexual way and he want to send them to my family in the Middle East which is a guaranteed death to her but she's also afraid she's going to lose everyone over this he made her send money and even her brand new iPhone and he threaten her that if she erase anything on the iPhone he will tell everyone so she did send it the way it is and now he's asking for 10000 dollars I don't have that and she don't have anything I don't know what to do or how can I help her The guy is from Jordan and I thought about selling everything I have and go to Jordan as my last option Please any advice would be helpful or anything I'm losing my mind and can't take it anymore I can't see her like this please help me

    I messed up and lost company files (all of them) California

    I stupidly had unencrypted files (back up of all of the company's files, every conceivable info, from competitors, to ip, to investors) on a flash drive, which I lost. I am definitely fired, and am confessing to my mistake. The flashdrive fell off of my car keys, and literaly can be anywhere. I am willing to accept any sort of punishment. What sorts of legal action could I expect from my employers, as well as investors? I was told to be careful with this information, and fully understood the importance of keeping the drive safe. If I cannot pay any damages, could my parents be forced to pay? edit: i was in charge of the device encyption, I neglected it

    Day spa demands $12 minimum tip for any service - including one they advertised as $40.

    There's a day spa near me that provides massage therapy. I was going to go there but I read some reviews that people aren't given their change back because of the sign that '$12 tip is minimum' even though they only had the $40 massage (the one I want to get).

    This seems super shady. I'm worried if I go and have a less-than-expected time, I'll be harassed for that $12. Is it legal to demand a tip like that? Can I say no if I feel like it wasn't a good service? Obviously will tip either way but... This is in Massachusetts.

    Friend needs helpnwith psycho ex husband

    I'm posting this to see if I can get any help for a friend whose in a bad situation. Minnesota

    So she was in an abusive relationship with this guy, had a kid with him but she finally got out of it about 2 and a half years ago. She just got her divorce finalized earlier this year and he's supposed to have no contact with her. Yet he's been calling and threatening to kill her and her loved ones. He's not in the same state but he's rich enough where he could probably buy his way out of most anything.

    Is there a way that she can get rid of him in her life once and for all?

    [Boston, MA] I was assaulted at work a year ago by a patient and have to have neck surgery, they’ll only cover 60% while I’m out, what do I do?

    I work for state and I was assaulted a year ago by a patient, they severely injured my neck. The next day I went to my PCC and she ordered an X-RAY for me which she said was negative. She then quit the practice. I got a new PCP and told her how excruciating my neck pain and new headaches were, she sent me to a spinal doctor in Boston who rightfully ordered an MRI for me which showed extreme disc bulge and multiple crushed discs, he verbally told me the injuries were like a bad car accident.

    I then began neck injections and some (non narcotic) pain medication which has done almost nothing. I have been in and out of the ER the past few months for passing/dizziness and aspiration in what is believed relation to the weakening of my muscles due to the injury. I was recommended for surgery but the state will only cover 60% while I am out and I will loose my home if that is the case.

    I got an attorney after my workman's comp claim got denied due to a pre existing condition (scoliosis) even though previous medical reports nothing wrong with my neck at all before the assault. My attorney said I would only get 60% while I am out and only up to 2 months but my recovery time is 6months plus. My attorney said I would have to go for surgery AND THEN file another workman's comp claim once my surgery is approved than I will be reimbursed for my past medical bills in relation to this.

    I am having an extremely difficult time having my spinal doctor or PCP writing that my neck injury is 100% related to the assault at work since I had a different PCP (even though it's the same office so they should have the information?) and my spinal doctor cannot 100% say it's related since I didn't see him RIGHT after the assault. I am at a loss.

    I have been paying out of picked after health insurance thousands of dollars and can not afford Christmas gifts this year due to my outstanding medical bills. It is also affecting my credit since I wanted to refinance my home I am not able to do that at the current time. It is a very depressing an unfortunate time for me.

    What are my options to get my full pay while I am out? Can I apply for disability on top of what I get from the state if they approve it?

    It's so difficult to function each and everyday as I have extreme sciatica from the injury and fall to the floor and drop important objects frequently, never mind passing out and waking up in the ER and aspirating on food constantly.
