I am among the most lenient of moderators here. If you're breaking a rule, you should hope I'm the one who catches it, because seriously, I'm lenient to the point of being TOO lenient. That being said, one of the few things that will earn you an instant ban is being a douche to the moderation team. It's a thing that's been happening more and more often lately, and I'm tired of seeing it. Effective right now, treating the mod team like trash is going to result in a permanent ban. We spend far too much of our personal time doing what we can here to be treated the way I've seen some of this team treated lately, and I am flat out done being nice about it. If you have an issue with moderation, take it to modmail and we can talk about it. We're reasonable people. We understand that folks have bad days and that people don't always understand why a post was removed or was inappropriate. Instead of calling us nazis or other genital based pejoratives, take a few breaths, send us a modmail and let's talk about it. The HOA's bylaws say it's a single family area. The definition of the single family in the bylaws includes a wide range of relationships (parent, child, sibling, grandparents, aunts and uncles, cousins, etc) and "married husband and wife" rather than "married couple." Figure to comply gives the HOA the right to impose a $100 fine per day per non-family member living at the property. Our realtor says this is nothing to worry about since it was probably written this way years ago, but this a rather new HOA (less than 5 years old). Can they enforce this law and evict/fine us if we end up buying this house? I'm inclined to not risk it but wanted to know the legality of such a restriction. [link] [comments] |
(Arkansas) Hardware store keeps accusing me of theft Posted: 06 Dec 2017 10:33 AM PST My employer has a charge account with a my local Ace Hardware store so I am required to buy supplies there every once and a while. Every single time I've been there, I have been stopped at the door, accused of theft because "my pockets are suspiciously full" and every time they find only my wallet, keys, and cell phone in my pockets. I have never seen anyone else stopped at the door. I believe this is because I have dark skin (Mexican descent, but was born here). Our small southern town is definitely not known for their friendliness towards "others" if you know what I mean. My boss is understanding and sends someone else to the store when possible, but sometimes it's just me that can go. They are the only hardware store in town :( What can I do? Tl;Dr Was in pain after a single auto car accident and was arrested on suspicion of DUI, was taken to hospital and told they wanted to give me CT scans. Having had them in the past I tried to refuse as they wouldn't show the issues I was having and are expensive. Officer told me since I was under arrest the police department would be required to pay and that I would need to comply with the tests as it was a liability for the department if I did not. This was a few weeks ago and I recieved a bill from the hospital a few days ago which leads me to believe 1 or 2 more will follow. What can I do about this? I did not want the scans, I have had chronic back pain/ issues for the last few years and the accident exacerbated them. I went to the hospital to try and recieve help for the pain and knew the only test that would show the problems would be an MRI. I attend a public university in Texas. I am also a Texas resident. In September, I met a girl on Tinder who also attends my university. I know Tinder is shady, please don't judge me. This was my first time using it. We met for a date, which was just a couple of beers at a bar near campus, and then ended up at my apartment. You know what happened next. Afterwards, as we were getting dressed, she said kind of jokingly, you know I could say you raped me if I wanted to, because this was the first time we met. That kind of scared me, so I thought I better get some evidence that she consented. I discreetly opened voice recorder on my phone. I recorded everything that was said from that point on. Just to clarify, it was only audio, no pictures. You can hear her saying things like "I'm so sad I have to put my bra back on" and "that was a great f***". She also said "we should meet again, but next time we can skip the drinks and get right to it". I kept the recorder on until she left, so there is a lot of empty space as well. Then the week after she messaged me again asking to meet up. I was kind of creeped out about her comment where she said she could say I raped her, so I unmatched her. She then found me on Facebook and started messaging me, and replied a couple of times saying no but then finally I blocked her. Then, mid-November, I got a letter from the dean of students saying they need to meet with me. I go in and they are investigating me for rape. I figured I have evidence it was consensual so I should be okay. I fully cooperated with the investigator at the hearing, and mentioned that I have a recording which will show that it was consensual. She said that will be very helpful, and I will be hearing back after she meets with "other parties" which I assume means the girl. Now go to earlier today. I got this very disturbing e-mail. I don't know how to describe it so I will just copy and paste. "It has come to our attention that you created an unauthorized recording of the above referenced incident. This is a violation of the privacy rights of another [university name] student. You are instructed to immediately delete this recording, including any and all back up copies, and reply to this e-mail within 24 hours confirming that you have done so. If you fail to comply, you will be in violation of university policies concerning student privacy, and may be suspended or expelled from campus regardless of the outcome of the rape allegation." I am now in a catch 22. If I keep the recording I get suspended for violating privacy, and if I delete it then I probably get found guilty of rape. I know I should talk to a lawyer (although they aren't allowed at the hearings) but there is a 24 hour deadline on this so I need to know what to do right away. Should I at least keep the recording until I can see a lawyer? My idea was to tell them I've deleted it, but keep it anyway, maybe "forget" that I had a backup made. So the people that work at the gym decided to call a private ambulance instead of the regular schools aid and the ambulance billed me $1500 for such shitty service and they even injected the needle in the wrong part of my arm. But anyway, the debt collector keeps calling me and I never picked up or talked because I thought it was a scam. Then around October he called my mom and she told me the debt collector is right, so I decided to get rid of my debt by giving him my card and making payments to get this debt off. The time the debt collector gave me was a month and in that month I tried to talk to my insurance and getting a new bill but I didn't because I'm a student trying to focus and my head is all over the place and now I get the rest of the money taken out my account. Posted: 06 Dec 2017 08:15 AM PST Atlanta, Georgia I was referred to use a contractor to replace a shower pan that was leaking. To do so required them to remove the tile shower floor, replace the pan, and retile. This cost $3,500. The owner (English speaking) who I consulted with onsite was not present when his two crew members (Spanish speaking) completed the job. As I am not fluent in Spanish, there was an expected language barrier. After their completion and each time I took a shower, about 2-3 inches of water would build up. I tried to plunge the drain and force what I thought was a clog out, but it would only temporarily ease the issue. I was unable to remove the drain grate because their crew also filled the screw heads with grout, making it impossible to unscrew the grate. Needless to say, I waded through water up until now to avoid paying someone else to fix the issue that wasn't truly urgent. Finally, I got sick of it. I hired a plumber to come check it out and, after attempting to snake the drain, they realized there was something more than hair clogging the drain. Turns out it was grout or concrete, which explains why plunging it would not resolve the issue. Needless to say, it required them to remove a small section of the pipe for $225.00. The problem is fixed but I'm wondering if I can request the previous company to foot the most recent bill. Afterall, they created a new problem that required fixing. I have the section they removed with visible grout/concrete and a detailed report about what they saw. I sent the renewal paper work in by myself because we were no longer in family therapy and I had no one to help me. I missed a signature somewhere. This has lead to a unhappy chain of events. I was called by the PA county office that handles Medicaid and told I had "messed up badly". The woman was rude and yelled almost non stop at me and demanded that I not only resubmit the paperwork, but now she wanted to see our financials. Ok fine, I have nothing to hide and I have submitted them many times before. I complied but we were denied Medicaid shortly after due to us lying. See my father in law owns the place that my husband and I work at. We are salaried employees, thats it, we dont even own stock in this place. But the woman had googled our place of work and saw our last name matched the owners. She decided we actually owned the place and were trying to scam the state. This has lead to a 6 week on going battle. I had to get a case worker assigned to me. She is helping me out, but the woman at the county office keeps sticking to her guns saying we are lying no matter how much paper work we submit to prove otherwise. My main question is how do I report this woman to a higher up for harassment? I tried to call the county office and I jumped through every menu to be lead to a voice mail box that declared it wasnt set up. I literally cannot reach a human being. Even my case worker said it was true, that only people like her had direct lines. Its clear this county office isnt doing their duty, as they also handle things like food stamps (according to the phone menu). Is this right? How do people dispute things if they cant leave a message or talk to someone? This woman is really harassing us, and my sons have been missing therapy because of her bizarre vendetta on our family. (Update) Neighbor killed my daughter's service dog. Posted: 05 Dec 2017 04:21 PM PST This will be the best update. So my neighbor got arrested!! He was arrested Sunday for damaging our property and fence and more fireworks. It looks like on the video he was also looking in our windows late at night!! Thankfully the kids are all upstairs so he couldn't see them. I honestly don't have any idea what I did to him to deserve any of this. I am respectful and always try and make sure the kids are too. I guess I failed somewhere. We got a temporary restraining order on him and will need to go to court next week to see about a more permant one. The kids are a bit scared but I kept a bunch from them so that helps. I couldn't hide the property damage or fireworks. Thank you to everyone who has commented and said such kind things. My daughter may be able to testify to the abuse if we can keep her in the right track so there is hope that he can still be charged with that. While she is still staying home from school and begging for her dog to come home. She still doesn't understand but she is self harming a bit less these days. Apartment manager evicting me and taking me to court. Posted: 06 Dec 2017 06:23 AM PST (KY) At the beginning of November I received an eviction notice because of my cats and to vacate on the 30th. I spoke with her about it, apologized, found the cats a home and she told me no big deal to disregard my eviction notice. Everything was fine! On the 28th she comes to me and says I need to have my car moved off of the property because it had a flat tire. I apologized and explained to her that I was trying I just didn't have the extra money for a tire but I would try to find somebody to help me. 2 hours later I looked out my window and it was being towed. I was so upset. I live in income based housing, I have three small children plus Christmas is right here. She knows I have nothing. I just lost it. We got into an argument. I asked her why she was so worried about the way the outside looked when she allows the inside of the apartments to fall apart. My bathroom floor is rotting and sinking in. Mold. The trim wasn't replaced so there are tiny little rusty nails along the base boards just sticking out. Electrical issues. Several things. I keep a very clean house and try to fix small things on my own but most of the problems need actual fixing and not just a band aid. I don't complain because i would be homeless if it wasn't for this place. I don't pay full rent so I make due with what I have. I shouldnt have back lashed at her but I did. She told me now my eviction stands. This was the 28th. The eviction notice she told me to throw away says to be out on the 30th. I had 2 days to get out!!!. It was impossible for me. Now she is taking me to court. I dont know what to expect. I've never been in this situation. I dont know what to say or do when I even get to court. I just need advice. I'm really really hoping it will be after Christmas but I'm not sure. I am expecting to be notified any day. I still haven't been able to get my car back so that also just keeps adding up. I stumbled upon a text message where she is asking a lawyer acquaintance if he knows of any nasty divorce lawyers. I've been up for 36 hours now because of the implication that brings: several months if not years of bullshit where she drags my name through the mud, uses custody as financial leverage, etc.. I live in WA where I have some adequate legal protection: it's a no fault state with equitable and just asset division. I also have decided on a lawyer, but he doesn't know anything coming from her side yet. I still don't know how everything works, but I'm looking for ways to help her back down from this. Part of the problem is that she is getting advice from her parents and her brother (law school grad that couldn't ever pass the bar). And she has lied to them about our situation such that they think I'm a terrible person: that I've cheated on her, I'm an unfit parent, etc. Those accusations are bullshit and she knows it, and she knows I can adequately defend myself from those accusations if it went to court, but I'm assuming she does it because her parents wouldn't financially support her if they knew even half of the truth. Or perhaps just because she habitually lies to save face. Despite the fact that her family doesn't know the real situation at all, apparently she doesn't think that biases their opinion on how she should go about the divorce. Perhaps I shouldn't trust my lawyer on this too much, but I feel my legal position is strong. It was an eight year marriage, she has a degree, but has willingly (and against my wishes) refused to get a job for several of those years up until we separated. Her parents are even willing to send her money regularly. My lawyer tells me this is not an economic hardship, and that a court would not be inclined to split more than 50/50, not award spousal support. She could possibly use custody disputes as leverage (an idea her family has likely floated to her), despite the fact that she doesn't really want 100% custody, and this is where things can go really sour: she's entirely capable of some serious bullshit, and while I can throw legitimate shit her way very easily, I really do not want it to get to that point. But because her rich deluded parents are in on this, I'm assuming they're seeking out some $500/hr shark that always takes it to court even when it's not in the client's best interest. What are my options for calming this shitstorm down? Do I have my lawyer talk to whatever shark she ends up hiring? Does the strength of a legal position typically work itself out between lawyers or mediation before it goes to court? Should I personally tell her lawyer the other half of the story that she would never admit to, and hope her lawyer can act in her best interest, calming her jets and telling her parents to fuck off? To clarify my own goals, I just want to split the assets 50:50 and custody 50:50, and get it over with as soon as possible. I'm willing to give up some temporary spousal support to get her on her feet in her new career her way and as a bargaining chip. And I'm willing to shoulder a majority of the child care burden as well. I can't, however, tolerate her taking much more than half of my life savings. EDIT: wow, didn't realize talking to her lawyer was that big of a deal, but it seems to be universally agreed to be a very bad idea, so there goes that. I guess the real dilemma I have is that she likely has not or will not tell anybody, including her own lawyer, anything close to the whole truth. And I feel like any competent lawyer would prefer a more mediated approach if they knew the whole truth, and would likely be instrumental in calming her down about the issue. So, if at all possible, I would like to be able to clarify to that lawyer anything that she has misrepresented. Does this solely happen between lawyers? Or is it common for it to never happen at all? She is diagnosed bipolar with anger issues, and is seeing a therapist. Long story short, I used to have an addiction to Opiates over a year ago. I've been clean and sober ever since, and ever since she found out she has been using my past drug problem as a way to attack me. Today, we got into an argument over the phone about past relationship issues and she threatened to call my workplace and tell them that I'm a drug addict out of spite. Her main purpose is to attempt to get me fired, although her accusations are completely false and I have been sober for well over a year. She just angrily left me a message that she spoke to my HR department, feeding them that lie in attempts to get my fired. Currently living in Pennsylvania, Is there any legal or police action that I can take to combat this other than filing a pfa? Then, at the end of the week, the business owner modifies the timesheets, clocking her out for half an hour at a random time throughout the day, thereby cutting her overtime hours that she puts in. I think this is pretty much wage theft and I keep telling her the state should be able to do something about this. Can they do this - change the times that she definitely was at work and say she wasn't? If so, what kind of evidence does she need to reclaim her lost wages? She has taken screencaps of her time sheets before and after edits to prove it happens, but she hasn't got record of every single change. Can she only reclaim wages that she can prove? I'm a 25 y/o female in central Indiana, USA I was injured recently in an auto accident (about 3 months ago) and I am in need of some unbiased advice. Sorry for the long post, and the sketchy grammar skills! (TLDR is at the end). So here are the details: The Accident- This happened in mid September while driving my boyfriends kids to school. The vehicle in front of me stopped for a child in the crosswalk, and I was at a complete stop behind them. The vehicle behind me did not stop, and rear-ended me into the car in front of me. The air bag was deployed also. My vehicle (a 2007 Nissan Versa) was totaled and the other two vehicles (large, newer SUVs) were able to drive off. Injuries- My boyfriends daughter (8 years old) came away without any serious injuries, just a sore ankle. However, she has been affected mentally and has high anxiety while in a car now. I spent about an entire week unable to move around very well with back and neck pain. After many doctors appointments and scans, I have two bulging discs in my neck but they aren't bad enough to warrant immediate surgery. I have decreased strength in my shoulder and right hand, dizziness almost every time I stand up, numbness and a pinching pain through my elbow to my pinky/ring finger, as well as intermittent strong headaches originating from my neck. I have gone through 4 weeks of physical therapy for lower back pain, and have four more ordered. I'm seeing someone in a local spine center for PT on my neck and to set up injections for the pain and numbness. There is still a possibility of surgery if this does not fix it. Work/Life- At the time of the accident I was working as a delivery driver for a pizza place, just working about 30 hours per week. I was earning about 14-17$ an hour while there. I returned to work the day after the accident (trying to keep my job) with a rental car that my insurance provided while they determined fault for the accident. After my insurance company determined the vehicle was totaled and I was NOT at fault, they made me return the rental and go after the other insurance company. I have had no job for this entire period of time, and no vehicle to look for another job. Thankfully I am interviewing for a work at home position right now, but that is almost the only type of work I can get without a job/car/money to pay for an Uber. Lawyer- The insurance company of the "at fault" driver only offered me about $4000 total for my injuries. I immediately pursued a highly rated personal injury lawyer to handle this (and I'm glad I did), but they won't do anything or draft a demand letter until I'm completely healed (which could be more than a year) :/ Is there anything I should be doing in the meantime? Should someone be covering a rental vehicle for me? Or do I just have to sit and wait to "fully heal" in a year or so? My lawyer seems to be very competent, but I'm getting frustrated with my situation and being brushed off until I'm done with treatment. TLDR; My car was totaled in an accident (other insurance is accepting full liability), lost my job due to no transportation, currently have two injured discs in my neck, and no end in sight for my settlement. It was served to an address I haven't lived at for some time, and there was no court date, just a hearing set for March of next year. The bank account frozen due to this is still keeping a freeze on my money, which is not much at all. Then I received news from my employer that they had paperwork from the courts as well from the same man trying to garnish my wages. I don't make enough under my state's statute's to be garnished like that, I am frankly barely holding everything together financially as is. Also found out that he has upped what he wants from me, adding on another two thousand dollars, with another hearing in April 2018. This man is a narcissist, and when I told him I wouldn't sleep with him to erase this debt he thinks I owe him this is what he did. Because of this one paycheck being frozen in my bank account, I am running the risk of losing my home. What can I do? Do I show my apartment office the paperwork I received as proof of hardship? Nov 28th: Tenant emails me written notice saying he feels a musty odor of mold/mildew in apartment and asks how to resolve. Nov 29th: I reply saying OK I'll come take a look and try to confirm this before I order inspection Nov 30th: I go to apartment, do not find any signs/smell of mold. Nevertheless, I tell him I will get a mold inspection done. I search for inspectors and manage to get someone on 5th December (earliest I can find). Dec 1st: Rent is due but he does not pay. [North Carolina] So a stranger is landing their plane on my neighbor's land. Posted: 06 Dec 2017 12:58 PM PST I live in a fairly rural area, and the land bordering me holds a grass runway and a what decades ago was a hangar for somebody's private plane. Nowadays, it's used to house a man's boat and assorted other machinery. The man who owns the property lets me use the runway to walk my dogs, and he himself only comes by once a week or less. So a few months ago, I noticed a plane that seemed like it was weirdly close to the ground near my house. It's definitely a private plane, maybe a bi-plane? I don't quite know. Then I watched next time it came by and saw that it definitely used my neighbor's runway to touch down and come back up. I didn't say anything at first, because it wasn't really hurting anything and the guy is kinda cooky about his property; the only reason I'm allowed to use it is that he's known me since I was a baby. But then I noticed the plane more. Probably once a month or so, and I'm sure it's come by multiple times when I'm not home. I never did anything because I didn't want to stress out my already neurotic neighbor, but earlier today I was walking the dogs and the plane actually landed on the runway as I was walking them. I got out of the way (it wasn't at risk of hitting me or anything, but seriously wtf?), but the thing that really pissed me off was that one of my dogs got so scared he started trying to twist out of his harness. I grabbed him, but I was scared he would get away from me and run into the path of the plane. Again, the plane touched down, stopped a few seconds, and took off. I tried to wave my arms and shout for them to stop, but they just went on their way. I didn't see any serial number or anything and I don't know if private planes even have markings like that. I know for a fact my neighbor hasn't given permission to this guy to do this. Like I said, he's kinda cooky about his property, and I actually have a written list with vehicle descriptions of anyone who's allowed on the runway or in the hangar. He would've told me if he's letting a fracking plane land there. So I realized after this morning that I definitely need to tell him, but I'm not quite sure how we would proceed beyond that. I assume it's illegal to land a plane on somebody's property without their permission? Also, do I file a police report? Is there any way to find the owner if I don't have info on the plane? Is the fact that they landed while me and my dogs were there endangerment or something? I assume they would've been able to see us before they landed. [link] [comments] |
Posted: 06 Dec 2017 11:18 AM PST The Story I (Canadian) edited a video for a girl I met through /r/forhire. She claimed the video was for a class presentation on catfishing (ironic no?). After a month of working, I finished the video. She said it was better than expected and agreed to pay. Since I knew she was a student I dropped the price and offered her the chance to pay it off in monthly installments. But after months of "promises" she still hasn't paid. Finally, after missing yet again another payment deadline I sent one final email informing her that if I do not receive the first installment of what I am owed by this Monday I will be contacting her school. Her response was less than professional.
In our previous emails this was not her tune. As upsetting as it is I understand I will more than likely not be receiving any compensation for my month of work. However, I would still like to send an email to the faculty at the University of Georgia and the staff of their psychology department.

[BC,CAN] Police damaged property for no reason during search Posted: 06 Dec 2017 06:07 AM PST I left my roofbox in my old place after moving out with the landlord's permission and planned to pick it up a few days later. Before I could do that, the police searched that house because one of the tenants committed a serious crime and was arrested. During the search, they tried to open the box (my assumption based on the damages). Not sure whether they succeeded or not, but they did bend the rim (tried to pry it open?), drill the lock, and manage to leave a dozen long scratches here and there. I called the detective on the case, and he admitted that his officer did that, but also said they did it "legally", so the chance I could get a compensation would be slim. However, the method they used to open the box was destructive. They could've used a locksmith, but chose unnecessary and excessive force instead. I've submitted a claim at the city hall and hope for the best. If they reject my claim, do I have any ground to bring them to small claim court? Not really for money, of course. Thanks in advance! Posted: 06 Dec 2017 10:11 AM PST My MIL did not plan well, collects about $12,000 SS annually as her total income. I converted my garage to a studio apartment, for which she pays $200 monthly because "she wants to pay something." I cover all utilities, taxes, etc. We include her (or bring her a plate) when we make dinner at home, otherwise she buys all her own food. She covers her insurance, co-pays, deductibles, Part B & D and car expenses. I do not cover or wish to accept liability for her medical expenses in any way. Benefits for SNAP (Florida state managed) and the Senior Friendship Center (local non-profit) ask for "household income" on their applications. Inclusion of my income would disqualify her from all benefits with SNAP, and potentially with the non-profit. I do not consider her part of my household for financial purposes, and do not claim her as a dependent. I can't locate documentation, laws or regulations that address this situation. We don't want to commit fraud, but we do want her to be benefit eligible. What defines a household? Would having a lease with rent closer to fair market value legally create that distinction? "Weapon" at school. | Sparks Nevada, USA. Posted: 06 Dec 2017 01:12 PM PST Well, this isn't too long from my last post, I don't know why shit keeps happening, but this didn't happen to me, it happened to my little brother (He's 14 just about to go into Freshman year) So he's been working with building things for a long time, and he's been in and out of my shop for the past two weeks, now he made these really cool bracelets that are studded with rivets or grommets or something along those lines. Anyway he wore them to school and the cop on site (Our school cops don't play around in NV, they carry a handgun, two canisters of MACE or OC, Tazer, and a Stun-Gun due to all the school shootings recently in the states) saw his bracelets and immediately detained him and brought him to something called the "White Out Rooms" where there's a door and inside is just a fully white room with a single chair in it. He snuck his phone in there to text me and he was freaking out because the cop repeatedly kept telling him that his bracelets could be used as "Full guard knuckledusters" which are illegal in Nevada. Now I make knives for a living, and his bracelets don't come near to classifying as a full guard weapon yet he was issued a citation and sent home under the pretense that he had the intent to harm someone. My little brother has a clean record, unlike me so I would understand it if I were in his situation, but they suspended him for a month and are making him go to mandatory anger management classes. This suspension is going to make him ineligible for the Millenium Scholarship and most likely leave a blemish on his overall school records, is there anything I can do for him to fight this myself since the citation was already issued? (Must be paid by January 3) Or should I get him a lawyer and be present at when he decides to fight this? A little background about my brother: First, he doesn't fight. He is the BIGGEST pacifist I've ever seen in my life. Second, he literally spends his time playing video games and building really cool shit, and none of which are weapons. Being taken to Claim Court by Roommate Posted: 06 Dec 2017 10:00 AM PST So while I was unemployed I was told if I looked for a job I wouldn't have to pay for rent. I was unemployed for ~4months and then I got a job and started paying for rent. I left the apartment about 1week ago and was thrown against a wall several times (not the first time my roommate has gotten violent against me). I left the apartment and was able to collect almost all of my stuff. Be my roommate wanted to pawn off my laptop and valuable art equipment. So I had to call a police officer to get my things back. In the process of getting my things back my roommate was yelling, swearing, and shouting homophobic slurs at me along with disturbing the peace (9pm quiet time for apartments). I was able to get all my things back. But since I had to use police intervention instead of having my things pawned off my roommate wants to me give him 2,738 USD by the end of the week or he will take me to Claim Court and get more money out of me.
