If I consent to PROTECTED sex only with a man and without my knowledge he pulls the condom off and ejaculates inside of me on purpose is that illegal and can I press charges? This is urgent and I really need answers.. Oh yeah, not to mention he is trolling on my phone laughing and basically taunting me about it. I have all the messages saved. I am only 22 yrs old and nowhere near ready for a child plus I don't really know this man like that at all (obviously not enough to have unprotected sex with him) so there is no telling how many other partners he's had & done this to so he's also playing with my health at this point. I'm just really scared, and super angry about the whole situation & I'm begging for answers! 🙏🏻 I stay in the state of Mississippi if that's any help. Any advice or answers would be highly appreciated.

A medical professional used my girlfriend's medical records to send her a dozen roses on her birthday [Colorado]

    Posted: 10 Dec 2021 12:52 PM PST

So my girlfriend of over two and a half years recently saw a chiropractor a few times to help with her back pain. Last week he asked her out for dinner for today in celebration of her birthday which is tomorrow. She rejected him and I don't really have much concern with trusting my girlfriend. Today she received a dozen roses from a unknown person that was not me. Turns out the chiropractor sent her the flowers. She did not give him her address which means the only way he was able to obtain her address was through her medical records.

This is kind of messed up and I want to know if this guy broke any laws by using her medical records in the way that he did.

Update: I just found out that my girlfriend has money already paid for an additional appointment that she is not scheduled yet. Any chance she could get her money back?

Also, to speak on someone else's point made below, it is assumed that he used the billing information to obtain her address. It is certainly possible that he obtained it through other means. If that is the case then perhaps it isn't a HIPAA violation but still is a code of conduct ethics issue in my opinion.

My work is shaving off 15 minute increments regardless of when you clock in/out. They round up or down your timecard only when it benefits them. Even if rounding up/down would make no sense.

    Posted: 11 Dec 2021 01:14 AM PST

For example, If I clock in at 5:30 they round it up to 5:45 to save themselves money. What should I do?

University adviser screwed up and I'm paying heavily for it. Do I have any option?

    Posted: 10 Dec 2021 01:46 AM PST

I met with my adviser about my upcoming graduation at the start of this year. We fleshed the courses I need and when, and confirmed my degree plan to graduate this Spring.

Last week, when confirming my graduation with my Dean, she tells me that I need to take this certain class that isn't offered till later next year to graduate. I meet with my adviser, and he admits he was mistaken, confused with COVID affecting classes and I did not receive the credit. I asked him specifically about this class earlier this year because of COVID shutting down classes to see if it counted, and he assured me it was credited.

I had a phone call with my dean earlier this week discussing the matter, and she told me there is nothing she can do, as I need the class as part of the program requirements and can't substitute it for another class. I've been planning my entire life around graduating this coming semester all year, I am attending here from out of the country, and now I have to stay until the end of next year to graduate and pay for housing, plane tickets, etc.

Do I have any option here or am I just at their mercy? I am in a public university in New York state, if that's relevant.

How much evidence is required for a child pornography case?

    Posted: 10 Dec 2021 11:48 PM PST

Between the ages of 7 and 16 my father periodically took up skirt photos of me as well as a one time nude "boudoir" photoshoot. No sex acts are being depicted in the photographs but the up skirt photos are obviously of my covered genitals. Are these pictures legally child pornography? I know he still has the hard drives that contain the photos as he is a hoarder.

After the success of the Duggar case I am debating reporting my father as it has been an awful burden to bear, however my father is a dangerous man and has been known to lash out when confronted. For example, he once sprayed bear mace on someones door handle because their dog was too loud. As shitty as it sounds, I'd rather keep the knowledge of the photos to myself if it means keeping my family safe if he is not convicted.

My neighbor that I don’t get along with is my mailman. My mail has been going missing.

    Posted: 10 Dec 2021 03:56 PM PST

I have lived next door to him and his family for the past 10 years and we've never had an issue until recently. He has also been our mailman for the last 2 years when his route changed to include our street. During covid him and his wife filed for a divorce and it turned messy. Since neither of them could afford to move out, she would often come over to my house to take a break from the tension. Her and I were friends and would hang out before the divorce but I didn't want to "pick sides" because I still had to live next door to him too. I even politely refused when she asked me to be a character witness for her because I didn't want things to be awkward.

Well, about 6 months ago he confronted me outside my house saying that I'm a horrible neighbor and I'm helping his wife screw him out of money. I brushed it off to him being angry about the divorce in general and the fact that we were still friends. Over the next couple of months he would regularly yell at me about little things that he didn't have an issue with before like a tree branch hanging in his yard or my dogs barking. Then I started realizing that some of my important mail from the IRS or the state was not being delivered. This has happened 6-7 times in the last 4 months. I will request another document to be sent since I never received it and I won't get that one either. Im getting all other types of mail expect the important ones.

I have never had an issue with mail not being delivered/ going missing before this so it just seems suspicious that it's happening now. I don't know how to prove it but I know it was him. During the divorce his wife tried to block him from being able to deliver her mail because she also said she was missing mail but apparently the post office dismissed her.

What can I do legally and how do I prove this? I do not want him handling my mail if he hates me.

GAL wanting hair follicle test. Missouri.

    Posted: 10 Dec 2021 11:45 AM PST

So, my children were appointed a guardian ad litem. Hes a nice guy. However, he told me in order to get my children back i need to do a hair follicle test. I agreed.

I went to the place he asked me to go to and found out its $300, due upon service. I dont have that. So I emailed him back and told him that and asked what I could do because I live paycheck to paycheck currently and I dont have that kind of money readily available to me.

He told me it wasn't court ordered but he would not recommend for me to get my children back until i take this test.

Now, this is what bothers me. #1, I DO have a history of drug use but nothing recent at all. Not even within the past year. #2 their father, who's family has money for a lawyer for him, does actively use drugs. However, the GAL told me that he does not need to take one. #3 I told him i would do it, but I just currently do not have the funds for it and until I do can we do something else instead such as urine tests or anything which is cheaper for the time being. I have no issues with this. He told me I'd have to take it up with the court. My last issue is last time we went to court, the judge wouldnt even allow me to speak because I didnt have a lawyer because I couldnt afford one. I was unable to explain my situation, my side of anything, etc. And when I did try to speak politely, I was told that I needed to get a lawyer or attorney.

I am at a loss. My children are my everything. I was their primary caretaker from the day they were born until their father pulled this crap and I dont know what to do anymore.

Worker docked pay for defending herself

    Posted: 10 Dec 2021 06:53 PM PST

I work in a Wyoming hospital which has aggressive and/or violent patients at times. Last weekend a coworker was literally cornered by a man twice her height and weight. She didn't have a phone to call for help, and said she felt she was on the verge of being raped. So she kneed him to get him to back off so she could escape.

Apparently this had her called in by the CEO, her manager, and a police officer. She was told she was losing $3 an hour for four months, and being put on probation. Apparently she was told she wasn't supposed to defend herself and should let it happen and report it after the fact. I already told her she should talk to a lawyer but this is something that could affect me too so I wanted to ask here.

Can medical workers defend themselves, and can hospitals dock pay for doing it?

My employer is stealing my tips. What are my options?

    Posted: 10 Dec 2021 09:50 PM PST

I'll try to keep this vague since I don't know if my management team has Reddit.

I've been working at a dog boarding/daycare facility in California for close to a year now. We also offer grooming services (my main role.) While not required, owners have the option to leave tips for the individual who groom their pet.

    Here's the issue I'm facing.

To my knowledge, the way the tips are received is through the POS system for the facility, regardless of cash or card. I have overheard and witnessed owners leaving tips for groomed dogs, several of which I had personally done, but have not seen one cent of that money. Our paystubs also do not show or reflect any of these additional earnings.

I had had suspicions that I was not receiving these tips, but only recently had them confirmed by a coworker. They had told me the owner of two dogs I had groomed had left a generous tip, and when they asked if I had received it and I replied I hadn't, they stated how they would grab it for me. As you might have guessed however, that never happened and the coworker left before I realized how much time has passed. I am now convinced that not only me but other coworkers are being screwed out of tips they earned, but I'm not sure what to do now. I have mixed feelings of how HR would respond given other issues I've had with them in the past, plus the management team is very tight knit and will cover each other. What should I do?

[NY/NJ] Ex-wife contacted my employer telling them I abused her than admitted it in her contempt hearing…employer told her info making her believe she got me fired.

    Posted: 11 Dec 2021 02:40 AM PST

I work seasonally for a company in NJ, my term is up after the first week in January. I'm at the tail end of a very contentious divorce in NY, my ex has violated about 20 court orders and refuses to comply with the terms of our settlement we had a contempt hearing yesterday which will continue next Friday (the judge basically said to her attorney if she doesn't settle with me by then she will most likely be headed to jail).

My ex was being questioned by my attorney which was filled with many of outburst. In one of them she looked at me and said "oh by the way I spoke to [HR persons name] at [company], you're being fired on January 8th". I should also mention my ex has some very serious mental health issues, while undiagnosed, most likely a mood disorder of some kind. She tries to tell people I abused and injured her despite no record of this beyond a restraining order being dismissed for lack of evidence.

I really don't know what to do here, obviously my lawyer is going to talk to the judge about gagging her from doing this again. However, I'm also upset with the company I work for for divulging ANYTHING about me and she seemed to know a bit. While perhaps unbeknownst to them, they basically gave a mental ill woman reason to think she can have me fired at her whim. This is someone I've been trying to get away from for years and will soon have a $50k money judgement against. Now I fear if and when I try to collect she'll just contact the next people I work for. Do I have any recourse against my employer? I really just want to finish out my term and be on my way but they really left me with a lot of grief and I'm almost afraid to speak with the HR person because I don't want to be cut loose before our term is up. I'm not sure if it makes a difference but I've been illegally classified as a 1099 employee despite working 40 hours 5 days a week. It's always just been the way it was there and I never minded because it's great money. But now I'm not sure if it muddies things.

5 Year Old Concussion at School

    Posted: 10 Dec 2021 08:15 AM PST

On Wednesday, 12/8, my son slipped and fell face first onto the ground as he was walking to class in the morning. It did snow a very tiny bit that morning, but he did kick the snow off his boots before going inside, and it happened in a hallway inside the building. He makes it sound like the floors were just wet and slippery everywhere.

This was literally as soon as school started, and the school nurse called me within 15 minutes of it happening. When she called, they said that he fell down and then puked, but that he was "concussion clear" and they think he was feeling sick before he fell. I knew he wasn't sick before, because school had literally just opened and he wasn't sick all morning. When we picked him up, we told them we were taking him to the emergency room as his pediatrician advised, and their response was, "Did you tell him he was sick before he fell?!"

The drive to the ER was about 30 minutes away. His eyes were rolling around, he wouldn't talk much or hold eye contact very long, and he kept trying to go to sleep. My husband had to keep all the windows down, yelling, and shaking his legs to keep him from going to sleep. He threw up two more times before getting there, and couldn't walk properly. He had to be pushed in a wheelchair. Once we were there, they took him back within 5 mins even though there were several people there already. When they noticed his hands were cold, they immediately rushed him to a trauma bay filled with at least 16 doctors, nurses, etc. He had to get an ekg, ct scan, blood draws, an IV and neck brace all day, and several X-rays. He did throw up again while in the hospital.

For at least 5 hours, he didn't say much or hold eye contact. He probably said less than 30 words the entire time, including times he would reply to me with a one word answer. All of his tests came back normal (nothing in his blood, so brain bleeding or swelling), apart from the ct scan showing surface swelling on his face. The doctors at Children's Hospital did say it was a traumatic brain injury / "bad" concussion. He eventually started acting normal again, and we were able to leave the same day - about 7 hours after the accident. Follow up with concussion specialists today also confirmed it was a concussion.

We asked the school for an incident report and/or video footage, and they've not provided either. Unfortunately, this isn't the first issue we've had with the school, despite him only being in Kindergarten. He was also put at a table alone in the back of his classroom for 6+ weeks because of "disrupting class" and we weren't told until he told us. Another time, he was "accidentally" left alone in his classroom crying until someone found him and took him to the lunchroom. The school cannot tell me how long he was left alone, but that it was a "misunderstanding" between my 5 year old son and his teacher.

He had his follow up visit with the concussion specialist today and was cleared to return to school. As of now, he seems completely normal again, but I don't know if we should be worried about long term side effects showing up later.

Not sure what our medical bills are going to be, but we have a very expensive HMO health insurance plan where we only pay the copays. With the ER visit and 2 specialist visits, I'm hoping/estimating it's only about $200.

My coworkers husband is a personal injury lawyer and they think we should see what our options are, but I wanted to see what all of you thought! I don't want to sue the school just for the sake of doing it, but also don't want to find out two years from now that my son is having long term issues as a result of this concussion.

My mom's trying to pull me out of school for just enough days to lose credit for my classes

I have evidence a rival medical group in my area is violating Medicare rules and paying kickbacks to referrers and don’t know what to do.

    Posted: 11 Dec 2021 06:11 AM PST

Using my alternate account for obvious reasons.

I'm an ophthalmologist who saw a patient a few years ago for a second opinion cataract evaluation who brought me papers from the first doctor they saw outlining their out-of-pocket fees for different levels of cataract surgery. What I noticed in particular on their fee schedule were two things:

    1. They were charging patients cash to undergo femtosecond laser assisted cataract surgery WITHOUT any astigmatism correction, which I've been told from my beginnings in the profession is absolutely not permitted.

    2. They had an additional fee patients would be charged, which increased based on the out-of-pocket cost of whatever was being done, that was a "referral fee" to be paid to the referring optometrist.

My boss and our practice administrator have told me repeatedly to not report this out of extreme fear of retaliation by local optometrists and other ophthalmology practices in our area. They're concerned we will lose referrals and that accusations could be thrown our way as well. We know any accusations against us would be found to be baseless because we pride ourselves on staying 100% above board at all times. But they fear we'd suddenly be thrust under the radar for audits and other time- and resource-consuming activities.

    Seeking advice and guidance.

Is my ex attempting to scam me out of $15,000?

    Posted: 10 Dec 2021 08:16 PM PST

I have been divorced for over 5 years from my abusive ex husband. We had a very volatile relationship and have been estranged for the last 6 years. Recently department of child support services collected about 5k in arrears from my ex. My ex is claiming that DCSS allegedly took 20k from him and is demanding that I return the money. He even offered to let me keep the initial 5k so long as I return the remaining 15k to him.

HOWEVER today I confirmed with department of child support services that in fact only the initial 5k were garnished from him and the story of this supposed 20k is completely fabricated. Does this attempt to defraud me out of 15 thousand dollars count as fraud? I have been fighting for a restraining order for years and want to know if thos could possibly help my case?

Physically assaulted , filed police report, guy that hit me wants to settle

    Posted: 10 Dec 2021 11:35 PM PST

Edit: I am in Texas ,Also, there is a possibility he may not be in the US legally. So this happened early this year(Feb), it was very traumatic such that I wanted to forget about it. The guy was drunk and fought with his girlfriend and took it out on me. Knocked out 3 of my front teeth with a huge liquor bottle and I had a gash over top of my head and a defensive wound on my arm because of that attack.I immediately filed a report with the police and he has a warrant out for his arrest(he ran away). He left the state then returned and is in contact with a mutual friend saying he wants to setttle. My medical injuries cost me around 13000 dollars total , I am still paying for and still undergoing treatment to replace the teeth. I was adviced to seek help in civil court for my costs , but every single lawyer I have contacted in my area is a criminla lawyer??? I think which i think defends criminals in cases. One even advised me not to talk to him as this could be considered extortion. I have kept queit , but since he reached to my friend a few days ago(about settlement), I would like to know the best path foward. What is the best thinbg I can do and what type of lawyer can I get ? also again, I called like 10 laywers in one day and none picked up my case why??. Sorry just frustrated, that I am struigling to pay the 13k to fix my teeth.

Ex lied to Child Support Agency

    Posted: 10 Dec 2021 10:22 AM PST

    Trying to keep this brief.

Child's father hid how much money he was making from the state I live in with our child, and was making around 80,000 more a year than they said.

When I didn't have a lawyer at court, his lawyer and he were told to write the parenting plan. They were told to finish it in three months. It had been around 10 months by the time an Administrative Order was put in by his state, as it had been two years since I had applied for child support. He was relatively honest about his pay to them, but after that hearing, they finally took it upon themselves to file the parenting plan.

Then, a month later, his lawyer and he send in an amended parenting plan to my state, saying he made 30,000 less a year then what he said at court and to his own states administrative hearing. I was not consulted.

Where his state awarded me almost 1000 a month, the amended plan that he and his lawyer changed it to made it go to 300.

1000 is a freaking lot, and 300 helped but I knew I was being screwed. Especially after two years of no help.

Due to that, as well as several inaccuracies and other unfair things that the judge apparently didn't bother to read, I saved up enough to get a lawyer.

A year and a half later, and we finally had mediation. Most of the errors have been amended, but we found out he has apparently been making 80,000 more a year than what they put in the parenting plan; 50,000 more than even I realized he's been making.

His state has known how much he's been making, but they put the changes directly through the parenting plan and had it hastily signed in my local court system instead of going through my states child support.

When they report this to child support, will anything happen to him? I didn't ask for retro, but honestly, this guy has put me through a special series of hells, and I'd like to know.

[USA - Oregon] New employer needs to verify my work history, but old employer isn't cooperating. Is there any way to force a response?

    Posted: 10 Dec 2021 08:26 AM PST

Should have stated initially - These are both commercial driving jobs.

I am in the process of being hired to work for Company A. I used to work for Company X. Both are based in Oregon. Company A needs to verify the months I was working for Company X, but the owner of Company X is not responding to them. I've waited and contacted him multiple times. First in a friendly way, then a more formal and assertive way, over the course of about a week. He has not responded since the first message, wherein he offered to employ me again.

I have his address, email, and phone number. Is there a way to request a response he's legally obligated to answer to? Or another way that's less forceful? I don't want to be mean but it's been weeks now and I really want to start my new job. Thanks for reading, any help is appreciated.

driving on suspended license. am i going to serve time?

    Posted: 11 Dec 2021 03:40 AM PST

hi all. i have been caught driving on a suspended license, also with no tag and my vehicle was unregistered, twice. i was on my way to work both times. i do have a lawyer and it is possible to get my license back and reinstated, at a high price of course. at an october court date, the judge said i had been charged with a crime that can have me incarcerated for 30 days to 3 years. what are my options here? i'm having my first baby in may and i'm really trying to get my license back to look good in my favor to the judge that i am trying. i have never been in any other kind of trouble aside from driving on a dead tag (which was due to having a vehicle that wouldn't pass inspection, and i didn't have the money at the time to fix the problem.) i don't want to go to jail, and i'm working towards getting the money to pay for all the legal fees i owe. it's just taking time.

north carolina is my state, by the way.

[San Francisco, CA] Is what my landlord doing illegal?

    Posted: 10 Dec 2021 06:17 PM PST

Last week, I accidentally left the door next to the garage/storage space where we store our trash bins, unlocked and opened. I had to go back and forth to take these bins out by myself resulting in me forgetting to close and lock the door behind me. The next morning, the landlord's daughter (who lives in the in-law unit next to the garage) discovered the opened door next to the garage and demanded to know which one of us roommates left it open.

Of course I took full responsibility for forgetting to close it and was profusely apologetic. I had a rough week at work and outside of work, thus my mind was a bit foggy and wasn't fully present. Honestly, I feel terrible for putting her in that situation. Anyway, I've been extremely apologetic in my mistake and handling this professionally while the landlord's daughter has blown this out of proportion, harassing me by continually sending me intimidating emails and texts demanding that I return the key to the space to her immediately because I put her in danger (since her kitchen window is in the garage) and she can't trust me to be responsible enough to close and lock the door after me. I've lived here for 6 months and this is the first offense. To me, this is pretty unforgiving. She even went as far as saying if she finds out anyone makes me a copy of the key, everyone will have their keys taken away from them as well.

I understand her fear that there will be a repeat offense but I have been extremely responsible otherwise - paying ALL of my rent and bills on time and complying whenever the landlord asks us to do something. I promised it wouldn't happen. I'm normally very responsible and on top of things. To be clear, she won't let me access the garage space where we keep our Recology bins (my roommates and I pay for the bins and services DIRECTLY to Recology) and said if I need to go in there to bring out the trash, one of my roommates can accompany me which is completely unreasonable especially if I'm the only one who is home. Am I supposed to let the trash accumulate in my home because I can't access the bins on my own?

I let her know it was unreasonable and that I won't return the key because I need access to the bins that I PAY for. She threatened me and said if I didn't comply, she would take all of the keys away from my roommates as well and we could 1) chain the bins to the tree on the sidewalk in front of the house (already looked this up - this isn't legal in SF) or 2) bring the bins to our backyard space (which would require us to drag these large bins up two flights of stairs into our unit and then down 3 flights of stairs in our backyard since we can't access the backyard from the front of the house. This honestly sounds discriminatory especially if we have disabilities preventing us to lift heavy items in and out of the house.

She has been using intimidation tactics and I have the texts and emails to show for as evidence. This is not the first time these scumbags have done illegal things - not fixing our broken refrigerator for 3 weeks and all of our food was tossed. Showing up in our unit without 24 hours notice and entering our unit when no one was home. Heat was broken in our home and it was not addressed immediately.

I'm not trying to be difficult but don't want to set the precedent that my roommates and I are okay with them using their power to get their way. Do I have any chance taking them to court?

Say I purchase a handgun. You need a CCW permit to carry it concealed in your car. If we do not have a CCW, how do we transport the weapon from the gun store to home, or to the gun range, or even to the CCW class? Do we need to 'not concealed' in the vehicle? as in putting it in plain view?

    California Labor Lawsuit Question

    Posted: 11 Dec 2021 06:57 AM PST

So as stated in the title I live in California US. This is the situation that I'm finding myself in here:

I used to work for a large mattress chain company delivering and later on supervised the guys who deliver. I worked their from 2014-2018. Apparently one of my old coworkers filed a lawsuit against the company late 2020 and saw retribution in the form of payouts to all employees who worked in that area in early 2021 with the amount varying on how long you worked at the company. Now I didn't hear about this until just recently from another coworker who just got in touch with me and happened to mention the lawsuit.

I was never notified and I'm entirely sure it's because the notifications they were sending via mail were sent to the house I was living at during the time I was working there. I have since moved houses multiple times. So with that being the case, I never received a notification or a check of any kind.

My question is this: is there any way that I can now collect the money and if so, how would I go about doing that? Or, is this just a case of too little, too late? (Also just for clarification, I did work at said company during the time that I would have received compensation for the lawsuit. That I am also sure of.)

    Thank you I'm advance!!!

Apartments trying to charge me for unclogging of toilet

    Posted: 10 Dec 2021 12:35 PM PST

My toilet has been clogging a lot over the last few months and they have had to come unclog it 6-7 times. Now today they have sent me a text, from a number I don't know, saying I owe close to $1000 for plumbing services rendered and that it will be added to next months rent. It has clogged further back in the past as well and they never charged me. They did not even tell me that I was going to be charged, until after the fact. I use the toilet like a normal human being. I do not abuse it, do not have massive bowel movements and I only use two wads of TP before flushing.

Can they legally do this? They are saying it does not fall under maintenance and that I am culpable. Is there anything I can do? I apologize if this is the wrong sub.

How do I go about filing a lawsuit against a state for damages?

    Posted: 11 Dec 2021 06:49 AM PST

A sexist judge has been tormenting my wife for years in her unconstitutional kangaroo court.

The appeal got dismissed on a technicality because they said our attorney paid the wrong office at the courthouse. Nevermind the judge literally denied my wife the opportunity to get legal representation (her lawyer had withdrawn from the case only two weeks prior to trial).

Everyone says you can't sue a judge. But now she is forcing my wife to pay the attorney fees for her ex. My wife doesn't work and this whole thing is causing huge deprivation on several levels to our entire family.

I'm done with this court taking everything from my family as a way to punish my wife.

[Indiana] Landlords had a pop-up shed "installed". Bad weather.

    Posted: 11 Dec 2021 06:46 AM PST

A few months ago, the landlords had a pop-up shed "installed" (aka people came and dropped it off in our backyard, no set-up required, we were not informed if there was anything we needed to do, it was not tethered to any ground, literally just slapped it on the grass and called it a day). We had some strong winds, it got knocked over, but we readjusted it.

Yeah, we're having strong winds again, and that thing has... Blown over. Almost rammed into the neighbor's fence.

Two things; if it hits the neighbors fence or lands in their yard, are we, the tenants, liable for damages? And are we responsible for the damage that has occurred to the landlord's poorly-installed shed?

[South Australia] I have owned a .com for 7+ years, a new company who has only been around for <2 years registered the .net 2 years ago and now threaten for me to handover my .com or they will sue

    Posted: 11 Dec 2021 06:43 AM PST

I have received a cease and desist letter from a law firm via email.

They claim as they client registered a trademark two years ago for the name, I must handover my .com domain to them for free, otherwise they will sue me.

For them not to sue me, because they have now registered trademark (even though I had the .com domain and was using it 7+ years before them)

They state from their solicitor that I must do all the following (long letter they sent me but here is the title/headings):

    1. Cessation of Use of the Mark.
    2. Abandonment of Rights
    3. Future Trademark Applications
    4. Transfer of Domain Names
    5. Acknowledgement of Ownership and No Challenge
    6. Mutual Release.
    7. Covenant Not to Sue
    8. No Outstanding or Known Future Claims/Causes of Action
    9. Acknowledgment of Settlement
    10. Confidentiality of Agreement
    11. Non-Disparagement
    12. Agreement is Legally Binding
    13. Entire Agreement
    14. New or Different Facts: No Effect
    15. Interpretation
    16. Governing Law and Submission to Jurisdiction
    17. Equitable Relief
    18. Reliance on Own Counsel
    19. Counterparts
    20. Authority to Execute Agreement

They sent this just email today, but state that I must do all of this within 3 days.

"[Company Name] further demands that you provide, by no later than the close of business Pacific Standard Time on December 15, 2021, written confirmation that you will comply with these demands. You are specifically advised that any failure or delay in complying with these demands will likely compound the damages for which you may be liable. If [Company Name] does not receive a satisfactory and timely response, [Company Name] is prepared to take all steps necessary to protect [Company Name]'s valuable intellectual property rights, without further notice to you.

The above is not an exhaustive statement of all the relevant facts and law.

[Company Name] expressly reserves all of its legal and equitable rights and remedies, including the right to seek injunctive relief and recover monetary damages."

Is this correct? Sounds ridiculous to me.

If anything I would have thought they should be the ones changing their name, as I was using the name 7+ years before them with a similar product
