Legal Advice My ex is pregnant with my child

My ex is pregnant with my child

    Posted: 21 Nov 2021 04:21 AM PST

We split a month after we found out she was pregnant. It was a bad break up but I told her even though I didn't want to be with her anymore I still wanted to be there for my child, that I would support them through anything… now she's saying she want me to have nothing to do with the baby. She doesn't want me at the birth and she says she won't let me sign to be on the birth certificate.

I can't have my child not knowing who I am. Or feel that I just abandoned them.

We live in texas. Any advice on what to do?

Someone broke and wrecked my apartment claiming he's autistic

    Posted: 21 Nov 2021 07:18 AM PST

My neighbour said that someone was screaming and breaking things in my apartment. He called me and because I wasn't available he called the police and when they arrived the guy inside was screaming and he said that he can't open the door. The police just left and in the morning I went to my apartement with friend to check if everything is okay. When I walked in everything was broken. Every window, all of the drawers pulled out, TV broken... When I walked in to the bathroom a guy was sitting on a toilet naked with a towel around his personal area. I didn't know him. He was shaking and crying and we asked him what the f*** did he took. He said that he couldn't remember anything because he was so drunk. He was at a party 2 terraces (balconies) away. The apartement is on the highest floor and each terrace is enclosed with a fence so he must have climbed over it or he climbed on the rooftop. If he was really drunk like he said he would have probably fall because you have to be really careful to not die while climbing that fence. He also threw another neighbour's metal ladder from the 6th floor of this apartment building. When the police came they took the photos and everything but they said that they couldn't do drug test because of the law. When his family came to pick him up he said that he is autistic. Should I believe this bs? Ofc we will take things to court but now if I want to live here i'll have to pay for everything from my pocket until they solve the case on court. If he was really autistic, why have they let him without any supervision or anything. I'm just fu***ng mad that he damaged my property and now I have problems with that. My question is: Does autistic people really behave like that when drunk? Or was this some kind of drug? And are the consequences any different if he proves that he is autistic? What to do in this kind of a situation?

td;lr : a random kid broke into my apartment, broke everything that he could and claimed that he was autistic.

Long term guest won’t leave. What do I do now?

    Posted: 21 Nov 2021 11:20 AM PST

    NH-US

Back in January, one of my friends (let's call him Sam) lost his job and needed a place to stay for awhile. I invited him to stay over at my place with me and my girlfriend. We rent an apartment. Sam isn't on the lease, but my girlfriend and myself are. As time has gone on, it's become increasingly obvious that Sam has no intention of looking for a job. We have never charged him rent because he doesn't have money. It's been almost a year now, so we asked him to find a new place to stay. He bluntly said no and told us that his uncle is a lawyer and he said that because he's lived there so long, we can't make him leave. That was last month, and he has still it made any effort to leave. It's causing frequent arguments because he sleeps on our couch and watches TV all day and gets upset when my gf and I want to use the TV. Him being there is causing a huge strain on my relationship with my girlfriend. Is he right that we can't just tell him he has to leave? If so, what do we do? Again, he is not on the lease and he doesn't pay rent.

Can my mom sue her dentist for leaving a drill bit lodged in her gums?

    Posted: 21 Nov 2021 10:31 AM PST

My mom has been complaining about having tooth pain and turns out a couple weeks ago her while going in for a root canal, her dentist accidentally lodged a drill bit in her mouth and said that she needs to go to a specialist to get it fixed because it's unlikely it will be able to be removed. The dentist isn't willing to pay for the specialist and I told my mom she should try and sue them for at least the cost of the removal procedure, and that's if it even can be removed. She says it's too much effort, but I really want her to get retribution. Any advice on where to go from here?

Contractor threatening to file a lien over an estimate that was provided, but no work done

    Posted: 21 Nov 2021 01:23 PM PST

Hello, we had an electrical contractor come out to provide an estimate for electrical work. The person that came out was here for about 15 minutes, provided a quick handwritten estimate on a work authorization form (that we did not sign) and told us no rush, just let them know if we had any questions. Life happened and then a few weeks later, we received an email saying that unless we intend to proceed with the work, he was going to have to bill us for the time it took it come out and provide the estimate. He never said anything about a charge for an estimate prior to this. We had no idea and I would not have had him come out if that was the case because he is a commercial contractor that was offering residential services during a slow time so I had no idea what his fees would be. I didn't like the attitude in the email and certainly wasn't going to just write him a check. Now, he is threatening to file a lien over this estimate and saying that I will be responsible for all court costs/late fees/etc. The invoice is for $150. What are my options? I'm in Colorado. I was told that since there was no "work" done, there is no basis for a mechanic's lien, but then someone else said that any contractor in CO can file a lien for really no reason. I know I could easily just pay the invoice, but I really hate people doing crap like this and want to push back. If you want to charge a fee to come out and give an estimate, then just tell me upfront, not after the fact.

Can seller remove items 8 months after sale?

    Posted: 21 Nov 2021 01:08 PM PST

The sellers from a property I purchased 8 months ago want to come and dig up a large piece of landscaping from the garden. They told me today that they are planning to do it later today and claim that we are contractually obligated to let them do so. When I asked them why they would want to do such a thing they replied "it's in the contract, look it up".

I believe the clause they are referring to is this:

    1. FIXTURES AND PERSONAL PROPERTY. All built-in appliances, floor coverings, windows and door screens, storm doors and windows, plumbing, heating, cooling and ventilation fixtures and equipment, light fixtures and bulbs, awnings, television dishes/antennae, planted trees, shrubs and plants, and all fixtures are part of the Property and shall be left on the Property by Seller. Driftwood and grasses that can be separated and removed without destroying the plant are specifically excluded from the description of the Property

I can't believe how petty they are being, but is there any way this applies 8 months after the sale? The driftwood and grasses clause was added by them because they wanted to take some of the landscaping with them. We allowed it at the time because they are family friends but I can't believe that this applies in perpetuity. My understanding is that after the sale closes, the property and everything on it is ours.

I already told them to fuck off, just want to make sure I'm in the right here. This is in Oregon.

Neighbors keep flushing toilet hundreds of times at night?

    Posted: 21 Nov 2021 12:01 PM PST

It's an apt building and we have a manager on site. Water is free, I get that, but not sure what's with flushing toilet that many times, like every minute or even less for hours. They stop right before 9 am, and managing office hours start at 9 am. I told them once if they needed help or had any plumbing problem, they said no. They keep me awake all night long. How do I solve a problem like that? Like I said during the day I hardly hear anything, so the manager wouldn't know.

My family cat has passed away. He was required to only eat canned prescription wet food that was expensive. Can I legally give this to someone for free as a gift that has a cat that requires the same food?

I went to a job interview and the owner told me she won’t hire me specifically because I’m a guy.

    Posted: 21 Nov 2021 01:54 PM PST

The employees said the owner has never hired a guy but I would make a great fit if they just hired me.

I could use helpful advice on how to hand this. I feel like this falls under employee discrimination.

Need help, do i have any legal grounds to go after my house's builder?

    Posted: 21 Nov 2021 01:42 PM PST

So lets jump right into it and ill try to explain myself as best as i can. I bought a house (yay) which has a large front yard and a large fenced in backyard. My girlfriend and i toured the house we loved it and lucky us we got it. Now about 2-3 weeks of being moved in we get a letter taped to our door from the city claiming our fence doesn't have a permit. i think to myself damn previous owners but oh well ill have to deal with this. So i call the city and she goes "ooooohhh that house, yeah this is a weird circumstance" to which i think to myself what the fuck? So essentially she tells me that there is a paper street that runs straight through my front and backyard essentially cutting them in half and that all that land is not mine. so i get the Original Survey from 2015 which clearly shows the paper street they are talking about which now makes my house a corner lot. so the city tells me i need to get my fenced moved, and the best part is i cant keep the fence i have because it is 6ft tall and 100% privacy. they said in order to keep that fence on my property line once i move my fence back i have to do an appeal which was $600 and got rejected. so now i have to move my fence AND get a new 4ft fence with 50% viability. My question in all of this is can i come for the builder who knowingly built far past the land he owned and sold it off as if it was? i want the money back i spent on the appeal and however much its going to cost me to move the fence and get a new fence for the side that faces the paper street. if anyone can please give any advice or needs more information please let me know thank you!

I sold my home, then the water well was declared dry the day after closing. Am I liable? (Oregon)

    Posted: 20 Nov 2021 11:28 PM PST

Disclosures were fine, water flow test was fine, and the discovery period ended.

The morning before signing to close, my neighbor on the shared well said his water was bubbly with air (mine was too). I called a pump company, they said to shut it off to regenerate for a day. I informed my realtor, the buyer asked for money to be held in escrow, I refused.

The next day we signed to close. 2 days later, the property transferred and funds were deposited.

The next day, the pump company guy showed up and said he was wrong. The well is dry and a new well is required ($17-30,000). I was required to move out at 5pm.

The buyer is asking for money.

Started a new job that pays well, but found some big red flags

    Posted: 21 Nov 2021 08:44 AM PST

I'm a nurse and I quit my job in the ICU in September due to burnout and generalized unhappiness. I found a job with a huge hospital that is widely known for ground-breaking innovation and technology in medicine. The hours are during the day (I came from working nights), it's in a walk-in clinic setting, and the pay is fantastic. The job itself is fine and the patients I see are wonderful. However, I feel like sold my soul to the devil.

Aside from the team I work with to not be cohesive or friendly, I found out right away that the nurses don't get lunch breaks. It is expected that we are to take one on our own time between patients and sometimes it just isn't possible. Most nurses eat at their desks, but my manager went around and told us not to do that a couple weeks ago because a patient complained. My first day I didn't eat at all since breakfast and went home at 530pm starving. Every so often, I can sneak away to scarf down my food in 10 minutes, but this is honestly few and far between. It seems like everyone that works there and knows it is not fair, but seems complacent and has a "that's just the way it is" attitude.

I should mention this job is a union job. I was told that the union is "working on it" but I cannot see any differences in strides toward getting the nurses legal lunch breaks. I spoke with another coworker about their opinion on it and she mentioned that the unit director's view on the matter is that it is "poor time management" if we are unable to squeeze a lunch break in. A lot of people understand this is illegal, but nothing seems to be pushing anyone toward legal action, especially since they dock 30 mins off my paycheck for a lunch that is assumed to be taken.

I signed nothing to waive my right to a lunch. I do not know what the stipulations are with union because this is my first job with a nursing union. I know it is illegal, but I know I also couldn't afford a lawyer to match up with this large and highly funded hospital system. I'm not staying with the job at all, I'm looking for something else and will be more than happy to get out of this place.

Does anyone have any experience similar to this or recommend anything?

Is it illegal to get refund for items you didnt pay for?

    Posted: 21 Nov 2021 02:34 PM PST

So I purchased two of the same expensive sweaters from a popular chain store... they were $200 each. I went to return one at the store. I was told id be refunded $400. When i saw thag $400 was going back on my card I told the employee at the store it looked like he was refunding me for two. He kept insisting this and after telling him 3x that this was an error, I just said thank you and left. A few days later I checked my account and sure enough I was refunded for two sweaters despite having one in my Posession. Did i do anything wrong/illegal here? I tried my best to explain to bim i was getting refunded for two items but he clearly didnt get it or didnt care.

[NJ] Found out the summons for my case was "unserved", what should I do now?

    Posted: 21 Nov 2021 09:55 AM PST

I am suing my former landlord in special civil court in NJ (harassment, breaching covenant of quiet enjoyment, etc). I submitted the complaint to my county's court in late October and received notice a week later of the summons being mailed to the landlord. I got an email yesterday from the court system saying the summons was "unserved". From what I understand, this means either she wasn't home or she's just ignoring it - I wouldn't be surprised if it's the latter

To be clear, I've already paid the court fee to have the landlord served by certified mail. If I'm understanding correctly, she can't simply say "Oh I haven't been home" or "Oh I never heard the door" and avoid the summons, especially since it originally went out the first week of this month

What steps do I need to take to take now? Or is it a matter of waiting for the case to default (December 9th)?

My family friend is being stalked, but her workplace won't let her report him because he's a customer. What can she do about it other than just quit?

    Posted: 21 Nov 2021 12:06 PM PST

As the title states, my family friend, who is currently working at a bank, is being stalked. The stalker comes by everyday where she works to deposit and withdraw $10 just to see her, harass her, and threaten her. She wants to report him to the police, but her boss prevented her from doing so as the stalker is a customer. She's been told that if she reports him, she will be fired. She's a widow with nobody else to rely on, what can she do to get out of this situation other than just quit and move?

She unfortunately doesn't have much info on him, but she is seriously fearing for her life. If he can figure out where she works, how long until he figures out where she lives where he isn't vulnerable to the public eye?

Employer deducting minimum wage from commission. California

    Posted: 21 Nov 2021 01:23 PM PST

    Hi,

I work for a company where I do sales then provide service based on those sales(think personal trainer). It has come to my attention that my employer is deducting our wages from our commission when we service our clients(commission is only paid when we provide the service). Which feels gross and illegal. Turns out they used to try and pay a penny wage in California which isn't a thing here so now they just straight up deduct the wage from our commission.

They seem to be trying to get around the minimum wage laws in California by paying us then deducting it from our commission which then seems like it would be a breach of contract if they are saying I will be getting x% commission but then deducting minimum wage from it, not giving us our real commission.

I plan on going to HR and going over my hiring paper work to make sure I did not sign something stating x% commission - hourly wage, but I have a feeling they may try to prevent me from looking at my original paper work.

So my questions are, on the surface how legal in California is this even if there is a contract saying x% commission minus wage.

What are my rights regarding looking at my hiring paperwork and what are theirs?

If I find they have been acting contrary to the contract, what should my immediate course of action be?

    thank you

Supervisor is being predatory to girls at work. What step should I take next?

    Posted: 21 Nov 2021 03:25 PM PST

So I recently got wind that a supervisor at our federal government contractor job site has been harassing girl repeatedly and nothing has been done.. one of our workers told the head honcho and she got shutdown by him saying, "she's causing drama in the work place!" …

All the girls he has harassed (over 10) are too scared to come forward. He also told an employee below his title that it doesn't matter how any complaints are filed against him. He will still continue to work.

What is the best course of action to take against this predatory piece of shit?? Straight to law firm?

    Ended an engagement, need advice

    Posted: 21 Nov 2021 09:02 AM PST

Posting on behalf of a friend, who is located in Ohio. She broke off an engagement with a guy. He is very upset with her and intends to sue her in small claims court. The first item he intends to sue for is a somewhat expensive item (~$2000). My friend purchased the item on a payment plan and made several payments. He paid off the slight majority of the total. He claims it was a conditional gift on them getting married, but she has text messages of him offering to pay it off that does not mention any conditions. The second is the engagement ring. She has returned it, and he says he will sue for the difference between what he paid and what he gets back. Does he have a case on either item? So far, I've told her to screenshot the text messages and send them to someone else for record, and to write memos of her interactions with him. Any other advice is appreciated.

    Incorrect Welcome Letter

    Posted: 21 Nov 2021 02:33 PM PST

So my Gf and I are about to move in to this place in DT SD. They tell us we are going to need to add an extra months deposit because of my gfs shitty credit but the welcome letter which is an overview of the lease and deposit term comes in a month ago with it not included. We sign they sign and we pay instantly after telling my GF face to face that was it in person. Now they send us another welcome letter with the additional deposit included. They admit on the phone it was their mistake. Are they still in the wrong?

Friend told police about her ex engaging in online sexual behavior with underage girls (13+). They said it won’t go far, any advice?

    Posted: 21 Nov 2021 02:32 PM PST

My friend found out her ex was talking to a ton of girls online that were underage. Like 13+

Sexually of course, and I think nudes were exchanged

My friend went to the police with screenshots of everything, but they told her that it won't go anywhere because there's no way to prove the girls were actually underage.

Since the screenshots were from Snapchat, you cant get their real names , and the ex deleted his entire online presence.

In his messages he'd literally write about how the fact that they're 13 turns him on

Is it basically just over? I guess I had this idea that the police would try to contact Snapchat and get messages, or investigate a little further (again he deleted his entire online presence not just Snapchat. He probably was talking to girls on every platform)

Is there anything she can do to try and get justice / help the girls he's been talking to / prevent him from seeking out new victims?

I believe I was wrongfully terminated

    Posted: 21 Nov 2021 02:26 PM PST

    State: Georgia

I was called in and let go by HR for "defamation of management". When I asked about what I said specifically I was told that information could not be released. Two of my upper managers played a part in the decision.

One of said upper managers has expressed to others before that I am "immature and unreliable" (I'm 22 and the only woman on the management team). I know for a fact that others on said team have committed fireable offenses (even in front of said two managers) and kept their jobs. Could this be a "pretext firing"? Do I have any options here ? What can I do?
