More money, better hours, better work/life balance. I was stoked. They even offered me the job before walking me off school property after the interview, they seemed really excited to have me on board. Passed the background check, drug test, got my ID and parking pass, shadowed classes this week to get a feel for things as a visitor to campus before starting officially on the 29th. The lead instructor and I shook hands on Thursday while he told me how excited he was to have me. Got a call from the principal yesterday (Friday) morning that they're taking the job offer back, with no explanation. I asked if he could tell me his reasoning, and he said, "legally, I can't tell you why." Shocked and devastated, I hung up the phone. I live in Florida, an at Will employment state, meaning legally, he doesn't have to tell me squat, but the lack of ethics behind that move blew me out of the water. The only thing I can think might be the case (and it's already happened once when I worked for Chick-fil-A or I wouldn't think it would be this) is that it's discriminatory. I'm a trans man and didn't say anything about it in the interview because it's none of their business. However I had to give my dead name during the background check to verify employment with previous employers. Anyways, now I'm jobless, and since I left my last job voluntarily and didn't get fired from this one as it hadn't actually started/still in the process of signing all of my contracts, I don't think I qualify for unemployment. My mom thinks it's worthwhile to seek legal council and chase down whatever the heck caused this because it really put a dent in my career progression. While I was in incarcerated the money was in my bank account she was having someone go to the bank drive thru and withdrawal the money out using improper Id. They was using my old work Id not a proper state Id or a driver license. They drained my account and left me with 5.00$ in it. Is it possible I will be able to get my money back ? I filed a dispute on all the withdrawals from my account and filed a police report. They in general are quite high strung, one parent in particular is emotionally volatile; it is a stressful environment to work in. They tend to not ask if I am comfortable in certain work situations, but simply tell me to do things, with no space for me to say no. It has put me in compromising positions many times, as the work involves children and I can not simply abandon the work place. That or they "request" for me to do things that are not in my job description, and I feel like saying no would result in emotional or verbal consequences or the loss of my job. Over all I would not recommend this job to anyone. I feel horrible for the kids because it seems like the parents don't like taking care of them for long periods of time. My current problem: I am on salary and in my contract I am entitled to 10 paid vacation days. I have taken 3 vacation days so far. Over the summer they informed me (last minute) that they were going to go on a family vacation for two weeks and I was to make up the paid hours by working overtime in the rest of the summer. They did not ask me if I was okay with this, I was just simply told this is how it was going to be. I'm not sure if that is normal, in a salary job, to make up hours like that. I've never worked a nanny job that was on salary before. Most other nannies I have talked to think they arrangement is "off". Regardless if it is right or not, to be forced to go on vacation and then forced to make up the hours later, that is what I agreed to. So I worked almost that whole summer an extra 2-4 hours every day, making up for the vacation they decided to take. Now that it is coming up to the holidays I gave them the days I planned to take off. They responded 24hrs later saying that no, I already used up my vacation days over the summer when they went on vacation. I will not be approved my 7 vacation days. They are going to be "generous" and give me a few days off around Christmas, but the rest of the time I do not get. I think they are in the wrong. I worked over time (normally I get paid for that) the whole summer, doing work that is not the job of a nanny, all because they said I had to make up for the pay I was going to recieve during their vacation. I feel like this manipulation of our agreement is because the idea of having to take care of the kids for a long period of time is daunting to them (even though one of them isn't working atm). Am I crazy? Or are they trying to screw me out of my vacation time. tldr: Being denied entitled paid vacation time, due to days off in the summer. Separately, I purchased an item through Company A that needed to be delivered to me. Company A employed Company X to deliver the item I bought through Company A. So Company X was already delivering something to me. I asked A if X could do the delivery for me and I was told yes and put in touch with X. X seemed to run an informal business. I placed lots of calls and texts with noncommittal answers. I kept asking if X could do the job for me and if so, could I have a quote. At the same time, I was collecting quotes from other companies. A told me that X had the best rates around. X tells me that they think they can get the job done on certain days next week, and I say, that's great, please send me a quote. I hear nothing and then get a call the next week saying X is on route to pick up the item for which I requested delivery. They need the address ASAP. I have no quote. Put on the spot, and following much delay from these folks, and knowing they were already on the way with an item I purchased from Company A, I emailed and texted them the addresses for pickup. I received no scope of work or contract and I did not sign anything. In short, they got the job done, without damaging the items they delivered, but with much inconvenience and poor communication. 2 weeks later, I get an invoice for a price that was greater than competitors' quotes. X explained that my service was more expensive than it otherwise would have been because they had to make the delivery in 2 trips, over 2 days, putting their delivery people up at a hotel, because their truck was too full with other people's items to fit all my items. That isn't my problem and isn't something I would have had to deal with if I had gone with another company. I am not trying to get out of paying X. They did perform a service for me. I don't remember a lot from the incident but I do remember being interviewed by a judge and being too nervous to talk much. The man was never prosecuted. In my mid thirties I went back to the county and pulled transcripts in a journey to gain understanding and closure because even if the incident wasn't hugely impact full in my life, the fallout and years of child therapy were. I found that the judge was unaware of a recent (at that time) law change that said a child's testimony can be taken without a cooperating witness at the time of the act. He said that because it was my word against a grown up and "kids are imaginative" that I could have created the story. They (the prosecutor, judge and defense lawyer) all also discussed my recent severe facial laceration (dog bite) and stated it would unfairly sway a jury's sympathy. On the brake, they have fabricated a metal piece that we can put our phones on to watch Netflix or whatever (doesn't seem safe) I was distracted and clamped my fingers in the machine for nearly a second before I clicked the emergency pedal and pulled my hand out. I immediately went to the owner who had me put my hand in ice water and took me to emergency care. X-rays were taken and I have a hairline fracture on 1 finger and the rest are purple and basically immobile. Can I sue for a gross misdiagnosis? Posted: 20 Nov 2021 05:48 AM PST Im in TN, I took my husband to an Urgent Care clinic yesterday with constant vomiting, bloated stomach, and abdominal pain. The doctor he saw (who was an MD) literally said "oh he's at the tail end of food poisoning and he just needs to have one really big fart." He did a CBC blood panel, the phlebotomist noted that he appeared dehydrated and the doctor told me to get him some electrolyte drinks. He then sent him home with orders for him to get some gas x. Anyway, we get home husband starts deteriorating, and I take him to the ER. Turns out it's not just that he needs to fart. He had a ruptured appendix and his abdomen was full on septic. He was lifeflighted from the emergency room hospital to a more critical care hospital. Now I know urgent care can't treat this but I feel like it's gross negligence that the doctor didn't notice there was something worse than just needing to fart. Now all of my father's belongings are being held hostage by his brother and sister. They won't let me get anything From the house. I tried to be cordial with them. we used to have a Great relationship while my dad was alive and now everything has turned to complete shit. I hate it. I wish things were how they used to be. I've been sick to my stomach over it I'm stressing like crazy Losing sleep hair etc. I talked to the police about they said we have to go to small credit claims court One lawyer we spoke to I said just to run (wtf)and the other Only sent them a letter saying they have stolen property they never responded to. Someone had filed an anonymous tip to the police, claiming to be a classmate of mine. They claimed that I told them I would bring a bomb into school. Police came to my home and searched my home. My parents were informed that I threatened to bomb the school (I didn't, but someone made this claim). I was taken to the police station and interrogated. They found no credible bomb threat. I wasn't charged or arrested (yet), but I did get expelled from school. I've heard of people posting stuff on social media, and getting in trouble. But this was an anonymous tip claiming that I said I would bomb the school. There is no evidence that I said any of that (nor is there any that I DIDN'T say it either). I still don't know who filed that tip. I know that they lied, but nobody else knows that. My parents don't believe me when I say that I didn't do it. CPS agent accused me of lying, how do I move forward? Posted: 19 Nov 2021 09:32 PM PST For context I am 25F, my dad is 50m and my dad's baby momma is 26F. I am also a mandated reporter due to my job. I filed a report this week after my father told me that his 3YO son made physical abuse allegations towards baby momma's boyfriend. Two weeks ago 3YO ended up in the ER with a sprained arm, the mother claimed he fell. My dad told me that 3YO said verbatim that BM's boyfriend "twisted it because he got angry at him". BM also has two small children that she lost custody of for reasons I do not know. She moved away and my dad only sees him once a month and claims he wants to be a "part time parent" because he "didn't want the kid in the first place". It was during his monthly visit that the child made the claims. My dad- that I know of had no issue with the boyfriend up until this point. After my dad told me about the arm incident- I immediately reported it to CPS. The local intake agent from CPS called me the next day and told me the case is closed because he talked to my father and he told them I was lying and that I have mental problems. When I was a teenager I was hospitalized for suicide attempts due to the PTSD from the abuse I suffered as a child at the hands of my parents. My adult siblings have been in and out of prison and rehab. Luckily I was able to seek therapy before I got to that point. Agent told me that because of my mental health issues I have "no credibility". The intake agent couldn't understand why my dad wouldn't call CPS himself, which is why he was suspicious. I explained that my dad wants nothing to do with the child and does not want custody of him at any capacity. Intake agent also accused me of lying and told me I had no basis for my claims and that losing custody of one's children doesn't make them a "bad parent". This might be of relevance- BM's boyfriend is a cop and they live in a very small town, I live in a large city so I don't know if it's true that everyone knows everyone? I told the agent that I found articles online of the boyfriend being put on admin. leave for a wrongful death suit, he killed a homeless man while on duty and the family took him to civil court. The article also detailed how he had several infractions at that department including having a personal relationship with a gang member's girlfriend. Yes I'm not kidding the article details all of that information. The intake agent defended the boyfriend calling him a "good cop" and told me that I was exaggerating the article. I don't understand why the agent was so confrontational and when I asked for his ID number he refused to give it to me. The report was made in good faith, but at this point I have lost faith in the system and I am afraid of possible legal repercussions. Could they actually take me to court or file some sort of charge? What else can I do for this child? I'm completely sick over it. Update- After doing some digging I found out that the intake agent is a former police officer. Update #2- I did some research and the agent is a former police officer who still does police work for the same county the boyfriend works for. Because of this he violated the CPS code of ethics. It's possible my brother's case will be able to be reopened and not mishandled by a police officer who based on what he said- more than likely knows the alleged abuser personally. Sadly the mother and the boyfriend have already been notified meaning they could have time to hide evidence and coach my brother. But at least there's a chance it will be looked into again. Citibank has stolen $48,000 from me! Posted: 19 Nov 2021 06:37 PM PST Guys, I can't believe this is happening to me. I will start from the very beginning: My dad passed away last April (2021). His life insurance policy paid him out $140,000. My mom was the beneficiary. My mom gave me $70,000, as a gift. I put $40,000 into the citibank savings account. I then added $8,000 from my personal checking with TCF. Then I added $5,000 from the same account. Well, when I added the $5,000 from TCF, that was the week they changed over to Huntington bank. So account numbers changed. The deposit was denied. Okay fine, no biggie. A few weeks later, they send me a letter in the mail saying that my account is being closed to due fraudulent activity with the mention of the $5,000 deposit that was denied. That was the only thing mentioned. My account has been blocked for about 10 days and I have no access to that money. I have spent hours and hours on hold with citi bank, and transferred around with different people because nobody has any idea what they are talking about. They are literally reading from a script. Nobody could tell me why my account was flagged for "fraudulent activity". I finally got to talk to someone today who gave me some information. He didn't tell me the reason it was being flagged, but he did tell me this. THIS IS WHERE IT GETS CRAZY. My money has been transferred to the federal government because it has been determined by the fraud department at Citibank that the money is not mine. My money isn't even with citibank anymore, it is with the federal government. Nobody has contacted me to get more information, or proof that it is my money. Nobody has investigated. They just decided "ope, that's not her money". And gave it to the mother f*cking government. I spoke to my financial advisor and he told me to file a police report. Any other advice? A team of us create content as independent contractors. Recently, I separated from the blog. The owner took all of my articles and put their own name on all of my work. It's a very photo heavy blog as well and as a team we would often share photos for each other, so my personal photos I took are also in use elsewhere on the blog. I wouldn't say I left on the greatest terms. I had asked the owner to deal with a bullying problem and their manner of dealing with it was to say they "accept my resignation" which I did not offer one so basically got fired. I want credit for what I wrote bc I am considering trying to move into journalism or even work for another similar blog. But now all my articles don't say they were written by me.

I submitted the complaint to my county's court in late October and received notice a week later of the summons being mailed to the landlord. I woke up today to an email from the court system saying the summons was "unserved". From what I understand, this means either she wasn't home or she's just ignoring it - I wouldn't be surprised if it's the latter What steps do I need to take to ensure she is served? So basically, if it's super busy they have to either wait until all of the customers clear out to leave the cafe and go get their water from their locker, or leave while it's busy leaving the other coworker by themselves. [California] Road rage turned assault, im not sure what i should do next. Posted: 20 Nov 2021 07:12 AM PST I (21m)was driving my brother to school when a bmw i3 was swerving around lanes, and cut around us forcing us to brake, then ran a red, etc. And i allowed myself to get a little too angry because my brother got scared and I was just in a bad mood. So when i ended up behind him turning onto the school street, I opened my door and stood up and said, "what the fuck are you doing driving like that, youre by a school" and got back into my car. At this point he then got out of his car and walked over to me and said "what the fuck did you say to me" and punched me in the face through my open door while i was sitting down. Afterwards i told my brother to call 911 and my face was soaked in blood and i couldnt see well. It seemed like the guy was trying to leave and in my haste i sideswiped his car at around 5 mph leaving paint transfer and some dents. I then waited in my car for police to arrive and he did as well. Both City Police and CHP took statements and i pressed charges with PD against him for assault, they then let him go and let myself go. I went to urgent care after and it turns out i have a broken orbital and need surgery. The guy later started to try to turn it into a race thing, yelling that the police are siding with me because im white and hes black, despite me not even being white. Im not sure what sort of lawyer i should look for if any? Will one be appointed to me, should i try to sue for restitution? How should i handle it with insurance, i only have liability and i dont know if i should open a claim or just wait for him to open one against me? Any help is appreciated. Tldr: i got angry at a guy for bad driving and yelled at him, he then punched me in the face and broke my orbital, and while trying to tell him not to leave because i had 911 on the line i accidently sideswiped his car. Posted: 20 Nov 2021 12:20 PM PST I work in a hospital and 3 months ago a newly homeless woman came into our ER and long story short I adopted her cat because she was threatening to release her onto the street because she could not care for her. The unofficial agreement was that I would foster her kitty until she got back on her feet. We've kept in touch and I've taken the cat to the vet for checkup, paid her bills, paid for her food, etc. It's been 3 months and this woman still does not have a place to live. The cat is elderly, about 14 years old, and over the past ~week she has new onset jaundice, weight loss, and lethargy. It's hard for me to stomach paying even more $$$ to get testing done on a cat that, in my medical opinion, probably has cancer and should be put down. I want the lady to just cede ownership to me so I can make the decision that's best for this cat but idk if she will. If I give her back, I'm worried the woman will just release her and the cat will die alone and scared. Is there a legal precedent for putting down a cat that I adopted without any official paperwork? From the very beginning, we have been reinvesting most of my pay, and he agreed that while we were doing this, he would make sure that our bills were being paid and I wouldn't be living like I was actually working 42 hours a week for only $800 a month. I have added things up and from what I can tell, over the past 6 years, I've contributed at least 80k back into the business. And that would be if I was accepting the same kind of pay that someone with far far far less experience than I have. Now we are about to get married and he wants a prenup that will exclude me entirely from any rights to the business, and he's saying that him making sure both of our bills were paid was enough compensation even though we live a very frugal lifestyle and he often tells me not to spend any money. I feel as though I have rights here because without my financial support, the business would have failed a long time ago. I brought this up because he's admitted to me that my efforts literally kept us open, and he said that he could have done my job himself, but he didn't, he had me do it while he did other things for the business and didn't fairly compensate me for my work and I don't think he can do that and also deny me rights for the future. My mother's friend of a friend was looking to give their dog up. Their child has autism and Sophie (not sure why anyone would name a dog Sophie) is a small chihuahua Shih tzu mix, so they were concerned that he was a bit too aggressive with her. My mum offered to take her off their hands and she was staying with us. At this point the family were still in ownership of Sophie. Sophie has extreme seperation anxiety, she is a lockdown pup so this isn't surprising but from the background information my mum gave, they left her in a cage when she was indoors, and outside (still don't understand why this isn't illegal) for several hours a day. She hadn't learned how to play with toys, or just play in general and the slightest noise would make her jump and shake. A week with us, and despite my best efforts to get that tail wagging with all the time and love and walks I could give her, she still seemed like she was sad. That something was troubling her. I took her to the vets at the end of the first week and the vet discovered she had a severe UTI that was possibly there before we knew her and we were lucky to catch it before it got worse. At the time of taking her to the vet, the current owners (my mums friend of a friend) were in ownership of Sophie. The vets called him and he handed ownership to me. So I ended up paying for the vet bills and treatment. Not a problem, do not care about the costs. That same day, my mum called the owners (who at this point, aren't the owners) and told them of the situation. They called back the following day and asked for Sophie back. I obviously didn't want to do that. Literally nothing more important to me in life than the wellbeing of animals and I gave Sophie the best week I could possibly give her, but I needed to put her needs before mine. So I agreed. She spent two years in that house and I thought it was in her best interest. Plus he reassured me that his kid would be monitored and played the "everyone misses her" card. I thought I was doing the right thing. I had Sophie with me for an extra week because I wanted to see her course through and make sure she was okay. She seemed much more happier and her tail was wagging more. Despite my strong attachment I still thought I was doing the right thing and dropped her off. I wish I saw the signs and didn't stupidly believe the owners words. Sophie looked terrified. I dropped a few things I bought for her a few days later and she was cowering under the sofa, and scared to move. You can tell a lot by a dogs body language and I knew something wasn't right. Even though I didn't have concrete proof, I called the RSPCA cruelty line and they said they couldn't do anything. I called a dog lawyer (a lawyer that deals with canine cases, not a dog that is a lawyer, although they'd be someone I'd trust more..). She said the dogs only been mine for two weeks and he's had her for two yrs, so I don't really have a case. I even went back to him and asked if I could pay for Sophie and he said no. I don't understand why you'd want a dog you just cage! She deserves the week she had with me every day of her life and its making me feel so helpless not being able to do anything for her. I genuinely led with my heart rather than my head on this one. I wanted to believe him for her benefit, but he's been lying about everything. He even told me he'd booked her vaccination with the vet but when I called in, nothing was booked. I have no legal right to her. The vet and microchip details are in his name. I guess I'm looking for any kind of advice. I've made a mistake that I'll have to live with for the rest of my life and I feel like I've let her down. I worked so hard to get her to a place where she didn't have to feel scared to be alone and walk freely to only go back to a place that caused that. Do I have any options? Or do I just need to move on and accept what I've done? Tldr; I really hope you read the essay above but this doesn't compare, but I had a dog in my name from an owner who was willing to give her up, only to want her back. Except now I believe I've made a mistake after seeing her in that house. I fear she may be neglected. Expecting get over it responses tbh. But its very difficult for me when I'm a huge animal lover that can't bare to even see one abused on screen, let alone one that I know. [link] [comments] |
