Posted: 30 Nov 2021 05:29 AM PST [Submitting a second time because I just saw this was killed by a spam filter yesterday] So for some context, I work(ed) at a small community hospital in Ohio. We have a 5-member IT team that takes care of almost everything in the building. Top to bottom, from fixing phones and fax machines to making sure the medical software works correctly. Anyway, we had a situation where a physician wasn't happy that an issue couldn't be resolved instantly (Data loss, said Doc was storing patient data on their personal laptop HD and it died. We couldn't recover it and so she called the hospital admin to make sure the tech in question was instantly terminated). Management complied and terminated. Two others walked out on the spot without alerting anyone, they just picked up their things and left. I attempted to finish the shift (was only a couple of hours) but called up after and said that I'd be seeking alternate employment effective immediately. The final team member we were down anyway; we'd been having trouble sourcing staff recently. Anyway, this all happened immediately prior to thanksgiving. I get the call this morning from my manager saying the hospital intends to have me sued if I didn't return to work. The hospital stated that they are willing to "drop criminal charges for endangering patient safety" if I return to work. I still have some contacts and friends inside the hospital, and it seems that the rubber band and glue solutions that ran the place managed to completely collapse in two days and the ED was forced to start turning away patients. I know they had some temperamental servers that required someone to push a button and hard reset after every power blip (like a daily event it seemed) so I wouldn't be surprised if they've lost several systems already. I gave my statement, I have written by version of what happened including all names and times best I can remember, but ultimately told them it's something I'd need to consider and talk over with a lawyer. There was no involvement from us or sabotage or anything like that, it's just all ageing hardware and software that requires intense and quite specific familiarity. It's very possible that all our accounts still work because… there's no one left to administrate IT systems otherwise. Even if they did get a team in I'm not sure they'd even know how to get in anything without our personal account passwords. So, question is… what should I expect? Can they legit force me back to work or otherwise impact my ability to get employment elsewhere? Based on responses, we decided not to pursue a small claims case. Instead, we created flyers and canvassed the neighborhood for anyone who could have seen the event, a new witness to the shooting was found. He was with the shooter at the time. The county dog warden filed charges against the shooter, but due to a miscommunication, filed charges against the wrong person (same name), and had to drop the charges. A number of odd political events transpired (dog warden resigned, county prosecuting attorney changed due to election) and my wife and I were convinced that the case would never move forward. But, thanks to the sympathy of the new prosecuting attorney and the efforts of the former deputy dog warden, charges (ORC 959.131 https://codes.ohio.gov/ohio-revised-code/section-959.131) were finally refiled in March of this year, against the correct individual this time. The case moved slowly through the system, lots of hearings, a motion to dismiss, etc. Finally today, the jury trial took place, and they asked my wife and I to testify our recollection of the events of the day, along with the witnesses I mentioned in the earlier post. The jury was out for around fifteen minutes, and found the defendant guilty. He was remanded to county jail pending a pre-sentencing investigation, the prosecutor thinks that we'll have that hearing in January. Maximum sentence is 180 days. Paragard IUD stuck inside my cervix!!!! Posted: 30 Nov 2021 09:38 AM PST About Me: 30 year old female I would like to know if I have a case to sue: I got the Paragard IUD put in on May 2013 and got it taken out today Nov 30, 2021. I have always had problems with the paragard, really bad cramps and in summer 2018 a 3 month period of heavy bleeding every day (didn't seem to be normal blood, not "period" blood since it smelled and looked different). For the last 3 years, my Significant Other told me that he can literally feel the IUD during sex and it sometimes scraped him. (My previous Significant Other did not mention this, but also he was smaller down there). In early Oct. 2021, during my pap smear, my family doctor told me the string was missing and got me an ultrasound. The results said that it was in the wrong location and stabbing into my right cervix. I went to a gynecologist mid Oct. 2021 and she said that the IUD being in the wrong location was due to incorrect insertion back in May 2013. I told her that I was told at insertion it could move around if I gained or lost 10 or more pounds (I've gained 20 since then). She told me that weight gain could never move it to this position. She removed the IUD that day and the right arm of the IUD broke off, remaining in my cervix. She scheduled a surgery date to take out the arm. Today I had the surgery and it failed. The arm is completely inside the right cervix and would require cutting it open to take it out. I had an x-ray done to confirm that the IUD arm is still in there. I have a followup with my gynecologist to talk about options. However, this is making me think: Is it dangerous to leave it in there? Is it worth it to go in and take it out of my cervix? I do plan to have kids. I'm afraid of infertility and the copper affecting any future babies. Side Note: My gynecologist said that my uterus and everything looked healthy and was able to insert the Kyleena in during the surgery today. ***If I were to sue for medical malpractice, would I have a case? I believe he needs to consult with a lawyer, and am curious what the legal minds of reddit think about the strength of his case. Background: He has worked for a small-ish/local heating and cooling company as a maintenance/technician in southwest Michigan for around 2 years. Up until now he has never had any problems with his boss, and liked his job. His girlfriend is currently pregnant and due in about 2 weeks with their first child. Issue: Today he was called into his bosses office and told he was being fired. His boss stated "with him having a baby soon he cant be having guys missing work". The boss did give him a letter that states he has been terminated due to absenteeism, it of course does not mention the baby in any way in writing. The friend has stated that over the 2 years he has worked at this company he has never missed a day, and is always at least 15 minutes early. He stated he has never been written up for anything while employed at this company either. Any advice you all can give on how he should move forward would really help. He's in a pretty tough spot with the baby (and costs that go with it) coming up quickly. I have so far advised him to immediately file for unemployment, and to save the letter and ANY communication he gets from the boss or other employees at the company, but so far there has been no other communication besides the verbal conversation with the boss and the letter. She was the financial manager and breadwinner, so I had nothing but a few hundred dollars in my bank account and what chattel I could fit in the back of my truck in the course of a few hours. I was completely homeless for 4 months and committed myself to an intensive mental health program instead of taking my own life. I came really close to committing suicide. Like really close. After spending months trying and failing to get legal help as a homeless and unemployed person the Vermont Bar Association found a low-bono attorney that was willing to take my case, and they provided a grant for the first 10 hours of his service. The lawyer and I had a few short conversations, and he did show up in court for a preliminary "status hearing." Outside of that, he has been generally hands-off and unhelpful. He always had an excuse for running behind the court's schedule and usually blamed "technology" on his inability to produce documents, etc. A month before the final court date I started trying to reach out to make sure that everything was in order. No response. Twelve emails and multiple calls later, still no response. Finally, I called the court to see if I could figure out what the hell was going on. I didn't even know how and when to show up for court at that point! My lawyer straight-up ghosted me. As it turns out, he also failed to submit the required financial affidavits (that I faithfully turned over to him in a timely manner), causing my wife's counsel to file multiple "Motions to Compel Discovery," and eventually a "Motion for Contempt and Enforcement and Motion in Limine." Because I am afraid of my abusive and spiteful wife, I made sure that she could not find my current residence or place of employment by insisting that all documents be sent to my lawyer, so I was never personally given notice of these actions. I figured out how to file a motion to continue on my own, and just left the status conference where I found out I will likely get granted a continuance come our actual court date on 12/1. It is unlikely that I will have no more than a month to retain counsel and start over with a new attorney. It is for certain that I do not have the financial abilities to retain counsel. Right now the only form of ID he has is his drivers license which expired 2 years ago. How would we go about getting new documentation for him? We live in Texas and his parents are in California so we really don't have any way of recovering them especially if they've been discarded/destroyed. This would require paying the hefty court fees plus attending a trial. I called my county's court (the number listed on the citation), and they instructed me to contact the officer. The person I spoke to said that they didn't have an answer to my question. After speaking to some of my coworkers, I am hesitant to speak to the officer directly as he has a reputation for being a dick, and my personal beliefs and past experiences with police give me cause to not take him at his word. I'm also not entirely sure that I even ran the stop sign in the first place. Is there any way I can view the footage for myself within the next 8 days before I submit a plea? He was kind of pushy but I overall thought nothing of it. Yesterday my boss pulls me into his office and says I was making sexual comments and talking about having an open relationship at the show, which is absolutely not true. He said it was verified by other staff, and asked me to pack up and leave. Once I got home, I sent an email requesting a meeting with everyone involved to address the issue head on. I gave him a play-by-play of the whole show, including my most personal comments (about having a tattoo. Absolutely nothing innappropriate.) Now here's the issue. I've been with the company for less than the three months probation period, so he says he can let me go for any reason. He says my performance wasn't up to standard anyway, and this was the nail in the coffin. He also says he "really had to drag it (confirmation of what I'd "said") out of the other employees." I'd never been told before this my job was in jeopardy. I feel my character has been falsely attacked and I don't know what to do. I'm more than fine parting ways with the company based on performance, but there's no way I'd jeopardize my job talking about something so innapropriate on my first work trip. And now I'm left with people in my field thinking I'm some sexual deviant who can't separate work from home. Do I have any rights here? Posted: 29 Nov 2021 11:30 AM PST Exactly as the post title says. My parents live in New Jersey and fell behind on rent this past year. The landlord couldn't evict them for non-payment of rent because of NJ's eviction moratorium. In order to get my parents out, she sold the house. That's not a claim we're baselessly making, she's acknowledged in hearings that she's selling the house because she can't profit off of it while my parents live there so it's easier to take the profits from the sale and let my parents be forced out that way. There's been a whole host of issues from the beginning (landlord inflating the amount my parents owe her, the court garnishing my moms SSDI check to pay pack the rent owed), but the newest one is that the new homeowner plans on renting the place out immediately. My mom has spoken to legal aid, and they're assuring her this is an illegal eviction but her own research has turned up nothing. Their current landlord and the new homeowner have both stated in court that the new homeowner intends on inhabiting the property, but the new owner came to examine the property while my mom was there. She brought a woman with her, and very candidly spoke about renting the place to her in front of my mother. According to the person my mom spoke to, my parents are being ordered to leave the house under the assumption that the new owner is going to move in. If they do rent it out, it's illegal. We just want to know if that's true, and what our options are legally. Edit: I really appreciate the responses so far. We're flying blind over here so any clarification is very helpful. Just want to make it clear that my parents don't intend on illegally residing on the property. They're going to move in with my cousin temporarily while they look for an apartment. He's actually the reason they got this apartment, and has helped to facilitate what my parents assumed was a good relationship with the landlord. He spoke to his sister, and she freely admitted that this is not a monetary issue. She suffered little because of this, she has other sources of revenue and only opted to sell the house because it was more convenient than brokering out a payment plan with my parents. Again, maybe I should've left her finances out of this. They're not pertinent here, but they are causing us a lot of frustration. I admit that I'm personally bothered by the thought of someone worth a great deal of money not being willing to wait a few months for rent owed that amounts to 0.00004 of their net worth. Today we got the same call, but this time it was "The laws have changed and the state is now monitoring you." I can't find anything about any sort of law like this online. When we moved in, we were dismayed to find out the landlord had used pictures of much nicer, renovated, and updated unit to advertise the property. After discussing our discontent with the landlord, she agreed to let us move out and refunded our first month's rent. The landlord did a walkthrough inspection while we were moving out and returned our security deposit with a check. The next day, the landlord texted us about water damage in the bathroom from a leaking toilet. Now, we have been notified that the security deposit check bounced due to not sufficient funds. After attempting to contact the landlord for two days, she responded to us via email citing "extensive water damage" to the unit and that we would be receiving an estimate of the cost of repair. My question is, can the landlord legally withhold our security deposit after issuing us a refund though a bad check? Long story short, I moved out on October 31st because I bought a house. I was month to month after being at my duplex for a long time. During the month of October my landlord said I did not pay for August and September's rent. Then he claims he never received my October's rent check either. I never had an issue paying. It has now been 30 days and WI law is 21 days for the landlord to either return security deposit or send me a itemized list which I assume would have included the months that he "didn't" receive my checks. Was told it was difficult to find the motor but didn't bother me since its not my daily driver. So I drive past on a semi regular basis and always see it so don't check up with them that often but I stopped seeing it recently. So decided to stop in and ask and was told since it was about 2 years they got rid of it and didn't contact me because they lost my phone number. Apartment complex trying to increase our rent despite a signed lease agreement (FL). Posted: 30 Nov 2021 09:52 AM PST Back in June we were up for renewal on our apartment lease. Wife and I are building a house and weren't sure when the house would be ready so we were trying to decide between month to month and a 7 month lease. Someone in our leasing office provided us two options written out in an email. In the first option, we would be month-to-month and our rent would be variable and subject to changes based on market rate, but we would require no notice to vacate. The second option was that we sign a 6 month and 1 day lease for a flat rate plus a $200 monthly fee for a lease less than 7 months but would not be subject to rate increases. They would then provide us a "month-to-month addendum" that states we would only need to provide 30 days notice to vacate (as opposed to 60 days and 2 months rent in a 7 month lease term). We of course opted for the second option. The lease nor the month to month addendum have any information about variable rates and our 6 month and 1 day lease specifies a $200 monthly fee. The month-to-month addendum, outside of the names, contains only the following verbiage: "Resident shall notify management monthly of intended notice to vacant. A 30-day notice is required, and resident is rent responsible through the notice. If resident chooses to vacate the above-mentioned premises prior to the lease expiration date, the resident is not penalized for any additional month's unit is not occupied." We only opted for the second option in lieu of the 7 month lease based on the information provided in their email. We sent them the original email and they just responded with "Sorry you were given incorrect information. We have the right to increase your rent as you are currently month-to-month. They're stating that our rent increased last month and that we now have an unpaid balance and I'm worried that they're going to continue to price gouge us over the next few months of our remaining lease term. Can someone walk me through the process that someone I know is facing for this arrest? It is not his first arrest but I believe it is his first DV arrest. He does have a history of abuse but to my knowledge no arrests related to it. My questions are: Will the court seek out previous victims? Is MA stricter than other states? Photographer Falsely Sold Image of Her Ex-Best Friend to a Publishing Company for a Book Cover Posted: 30 Nov 2021 12:00 PM PST I'm aware of a photographer who had taken photos of their best friend (now ex-best friend) for posting shots on Instagram. I was with this photographer some months ago when they were offered a book cover for a photo in exchange for at least $1,000 (it may have been up to $2,000). The photographer falsely told the publishing company they had the appropriate release form signed from the model/ex-best friend. Of course, the photographer disclosed to me they didn't, that it's likely this former friend would never find out, and even if this ex-best friend did, she'd "never win" (something I felt was really off to state). This photographer also felt it was ok to do this because she and her ex-best friend had a bad falling out, and the photographer deserved to make money on this photo because she took it, and therefore, it was hers. I'm aware this falls under Appropriation of Name and Likeness, and that all actions on this photographer's part was wrong and unjustified. The book is out now, and I don't know how many copies have been sold, but I've been feeling stuck with this dilemma for a while of how to notify the publishing company and/or the ex-best friend that this photographer profited off her image without any release form. That's fine. Everyone knew and agreed to this. Last pay period(Two Weeks), however, she worked 105 hours, 78 of which were cooking and the remaining 27 serving tables. When her check showed zero overtime paid she asked her manager about it who informed her that payroll said no overtime was paid because the hours were divided into two jobs. Employer is located in Kansas and I live in Arkansas. No where in anything I signed did it say I would be responsible for these costs, and to the contrary it says these would be paid by the employer. My boss is deducting the entirety of these costs and the costs to recover assets from my pay and saying I owe him $366. I've looked into Missouri labor garnishment laws and saw they could only be garnished down to minimum wage. Needing help. Am i required to transport large amounts of cash off the clock? Posted: 29 Nov 2021 06:32 AM PST I am in Michigan. My current employer requires i clock out when we close the store, yet makes me drive the cash deposits to the bank after every day, usually over 1000 dollars, Off the clock, on my own dime. Is this legal? Im concerned about the potential liability if i were to say get robbed, or get into an accident on the way to make said deposit, and im getting kinda sick of paying out of my pocket to deliver their money for them.
