Is it Legal to Keep Excess Claim money? Insurance

Is it Legal to Keep Excess Claim money?

    Posted: 20 Nov 2021 04:57 AM PST

TLDR: Can I keep excess money for an insurance claim where I don't want to get repairs done?

If this is the wrong sub to ask this I apologize

Basically, I got in an car accident and found out my insurance wouldn't cover the costs, so I did the repairs myself (body only) and didn't paint any of it. I found out a few weeks later that the other person involved in the accident's insurance would cover the cost of repairs.

I thought "Great, now I can just get it painted for free and maybe get reimbursed for the parts I bought," so I took it in to the collision center recommended by Geico (their insurance) and got an estimate, which was way way way too high, and included replacing the parts I already put on myself.

I texted the agent attached to my claim that I though the amount was too high and that I only needed to get stuff painted, I didn't need to get the full repairs listed. The agent never responded to me, and I just received a check in the mail for the full amount of the estimate I was given at the collision center.

Finally, my question: If I don't want to get the rest of the repairs done, can I instead just pocket the money because my car is completely fine besides a couple unpainted parts?

    Homeowners Insurance increase

    Posted: 20 Nov 2021 09:29 AM PST

So I had an increase in my premiums this year from last year, it's possible there was some notification of this but I missed it. Should I be shopping around for a new quote? Or should I ask for the same company to give me a new quote? I go through a broker for all my insurance and am located in South Carolina, if that makes a difference.

Any Cell Phone Insurance for Theft w/ International Coverage??

    Posted: 20 Nov 2021 09:17 AM PST

I am trying to find my best option for insurance for my new iphone 11. I need damage protection AND theft/loss. My phone was recently pickpocketed, and it's very common throughout Europe, so I'm scared it could happen again despite my best efforts.

I am living in Spain (phone bought here as well), but Apple does not include theft coverage for Spain! Can anyone recommend something that will cover my phone for theft internationally wherever I am traveling? Thanks!!

    Car damage

    Posted: 20 Nov 2021 10:07 AM PST

My wife's suv was hit by a guy with no insurance. Our insurance claims the damage is only about 1k worth of work but I think that is too low? The rear bumper was bent in at one corner including pinchweld, the drivers door was pushed in so it won't open and the left passenger door in damaged as well. Do I go after the guy now or am I S.O.L?

Do credit card Auto Rental Collision Damage Waivers cover scratches?

    Posted: 20 Nov 2021 09:39 AM PST

If I rent a car and scratch it against a concrete pillar or something does the Visa Rental coverage (Barclays Visa card) pay for it? Or is it only for road accidents? Also if I crash someone else, do I need to pay out of pocket to cover their damages if I don't have personal auto insurance or will the Visa rental thing cover that too?

What do I do to make sure I don't get ripped off.

    Posted: 20 Nov 2021 09:15 AM PST

I was in a car accident yesterday and this is all very new to me. I have decent insurance, but I was not at fault. There was a pretty quick slowdown on the interstate and athough braking was heavy it wasn't anything that I would consider crazy or unreasonable. I checked my mirrors and the car behind me was in full control slowing well, I checked in front again had plenty of room, then in the rear view I see all hell breaking loose. I knew what was about to happen and we got rear-ended pretty hard. I hit a trailer in front of me. There seemed to be a total of 6 cars involved me being 2nd to the front. A GMC/Silverado style truck with a trailer creamed everyone. I doubt they even slowed down tbh. It was either them or the car in front of them because apparently she was eating green beans because they were all over her windshield. I think the reason I hit the trailer in front of me was because the impact was so hard it threw me back and I couldn't stay on the brakes, but also the inertia from behind was really hard.

Nobody was severely injured and needed a medic. But, I plan to go to the doctor first of the week because my neck and middle back are super sore. I know so many people who have brushed it off without treatment or PT and regretted it. I need to take care of myself for work as I'm self employed.

I also had to cancel a job that was 1k+ in lost revenue. I was 4 hours from home headed to that job.

I think my car is totalled but we will see. It's a older honda element and the rear is crumpled hard, my roof top tent on top went flying off and destroyed it because the impact seared off all the mounts, my doors don't shut right up front. It's not in great shape now.

I got the link to get an accident report and plan to file today.

What do I need to do to ensure that I'm compensated for all the stuff those peoples negligence took away from me. I won't feel satisfied unless they cover my loss of revenue, a check to cover my vehicle at replacement value with inflated prices. It's also a rare model so it's more expensive and hard to find anymore :( My tent costs around 2k and it's absolutely ruined, I lost over a grand in revenue, and I feel that it's necessary to get checked out by a medical professional to protect my health and livelihood as a SE person.

Is this a;ll reasonable asks and what should I do to protect myself and make sure the insurance companies don't rip me off?

Hit a parked car, consequences if I lie about which car I was driving?

    Posted: 20 Nov 2021 08:52 AM PST

I hit a parked car while parallel parking into a tight spot and ripped the other guy's bumper off. There was no real damage to my car.

I waited for 20 minutes then left my name and number and have been in contact with the owner of the car. He is nice and understanding. The car I was driving is insured for liability only. How screwed could I be if I claim that I was driving my husband's car? It is insured for collision on the same insurance plan.

This is in the northwest US. Thanks for the help!

Contractor got hurt in my house

    Posted: 19 Nov 2021 05:36 PM PST

A contractor who did some work tried to do three people's work alone and hurt himself. I wasn't in the house I didn't instruct him to do what he did. He continued working for a couple more weeks in my house. He will go after my insurance. What kind of lawyer do I need? What is his play here? I never dealt with this before.

    Need some advice

    Posted: 20 Nov 2021 06:49 AM PST

Essentially I was involved in a pretty bad accident. I was coming towards a disabled intersection on the flashing yellow, while the second driver failed to yield my right of way on his side (which was red) tboned me and destroyed the car. Police report indicated he was at fault for failing to yield my right of way, however his insurance decided to only cover 75% of damages.. I'm no expert on insurance claims, but that just doesn't seem right whatsoever. Can anybody offer my some sort of advice on the matter? It's Geico for reference and I live in Florida.

    Comprehensive claims in Maryland

    Posted: 20 Nov 2021 05:56 AM PST

    Hello r/Insurance,

I recently finished up a claim involving a deer collision. My insurer, GEICO, deemed it as comprehensive and paid out of pocket to get all repairs done. They paid 18k to repair the car with a 1k deductible. I've been searching everywhere regarding comprehensive claim rate hikes in Maryland and I've been getting discrete answers. If anyone could give their opinion on this matter, that'd be great. Would my insurance go up like crazy after an outrageous comprehensive claim like that in Maryland? Thank you.

Does extended insurance cover couples therapy?

    Posted: 20 Nov 2021 05:53 AM PST

My insurance covers registered psychotherapists, however doesn't specify if they cover both individual and couples counselling. Does anyone have experience claiming couples therapy and insurance paying them out for it?

What is the purpose of insuring yourself bodily in car insurance, if you already have medical insurance?

    Posted: 20 Nov 2021 05:52 AM PST

    I am reading:

    • Additional Personal Injury Protection
    • Residual Medical Payments
    • Uninsured Motorist Bodily Injury..

All of these seem to be for insuring yourself for bodily harm using your car insurance.

I don't understand, if you already have good medical insurance, why should you care for the car insurance to contribute to this?

Is it assuming that you don't have good medical insurance?

Hit and Run stolen plates no collision insurance

    Posted: 19 Nov 2021 11:50 PM PST

I know there's probably nothing I can do but just wanted to ask here for confirmation.

Insurance can't find the guy after I gave them the dashcam footage and plate number.

Officer said he wasn't allowed to run the plates because no one was injured but he did anyway off the record and he told me the plates were stolen.

I don't have collision insurance just bare minimum. So am I fucked?

Dr sent to low a dose to pharmacy now need refill but insurance says already refilled this month.

    Posted: 19 Nov 2021 08:31 PM PST

This is California, Medicare Part D (Humana)

My dad has Alzheimer's. He was on 25 mg of a drug 2x a day. (30 day supply would be 60 pills.).

His dose was upped to 50mg twice a day (4 pills) so a 30 day supply would be 120 pills.

The Dr office sent the original prescription in as 25mg pills twice a day but only put 30 pills in the bottle. So that would last 15 days. Now that the dose was upped the prescription only will last 7(ish) days.

Now when we went to pickup the corrected perscription they say it's been to soon since our last refill for them to cover it. Who do we need to deal with it what do we need to ask (and who Dr or insurance) to make it so this new bottle would be covered?

    Appealing a denied health claim?

    Posted: 19 Nov 2021 11:46 PM PST

I had an initial doctors visit at a practice under my plan (Cigna) with a covered doctor. However, they sent out lab tests to a lab not covered, which I was not aware they would even be doing until it was happening, and had no reason to assume the lab wouldn't also at least mostly be covered. It's nearly $400, and i just can't wrap my head around that much for 3 simple lab tests required as a new patient.

From what I understand, I need the EOB of the denied claim, and then I have an EOB of the actual doctor's claim to show that was fully covered. Should I contact my doctor/practice for a personal note stating this was required for new patients? Or any other supporting docs that may help? I'm just a little confused on what all I need, and how to write my appeal as sounding anything other than "this makes no sense and is dumb, please resolve".

Someone hit my car at the parking lot and left.

    Posted: 19 Nov 2021 11:09 PM PST

Im driving Ford Mustang 2002 and some hit it pretty nasty at the rear quarter panel. I have a progressive insurance, not sure how much is my deductible is, but let's say it's 500. Is it even worth it to report it to the insurance? I called the police and they filed the case, but im not sure what to do at this point.

    Car insurance claim

    Posted: 19 Nov 2021 04:27 PM PST

I live in Michigan. My truck was parked in a parking lot of a Walgreens. It was backed into while no one was in my truck. I have all their info and started a claim. My question: since Michigan is a no fault state, and because no one was in my vehicle at the time of impact, does their insurance pay for the repairs or will I have to pay for it through my insurance?

Help understanding medical cost summary (HMO vs PPO)

    Posted: 19 Nov 2021 09:16 PM PST

First full time job with benefits. I already understand the functional differences between HMO and PPO but wanted confirmation on a specific cost summary image.

Does the company's monthly contribution go toward the premium? If so does that mean i'm basically paying a very similar amount for PPO as HMO if i'm only getting insurance for myself?

Will insurance cut deal to avoid rental car fees?

    Posted: 19 Nov 2021 11:53 PM PST

A valet service damaged got my car in an accident.

The car is going to need around $4000 in work done but could be more damage once they get door off. The wrinkle is I'm being told supply chain so backed up the door is back ordered for 3-4 months.

Sure insurance will get discount on rental but rental cars are not cheap and it took them a day to even find an Enterprise that HAD a car and it was 50 minutes away.

If we are taking maybe till spring for parts I'm thinking of going to the insurance and proposing a deal. Like give me 10 more days on rental and cut me a check for $7500 and I'll be done with it.

Will an insurance do that? Would it make financial sense for them to just stick to their guns and possibly pay for a rental car till April?
