They sent a form giving us the option to opt out of this. Is this legal? I would assume it would be something you had to opt-in to and that it shouldn't be held during school hours.

Wife got pregnant by another man during our separation.

    Posted: 28 Oct 2021 07:23 AM PDT

I live in Michigan, I've been separated from my wife for 10 months. No paperwork has been filed. I live in the family home with our 2 children. The wife lives with her boyfriend. She is on my insurance still thru work.

She has said she wants nothing from me upon divorce but that was prior to this pregnancy. Do I have to rush thru the divorce process now? Would I be liable for the baby if the divorce isn't finalized before birth?

Boss racked up $60k on my corporate card.

    Posted: 27 Oct 2021 10:40 PM PDT

Throwaway. Long story but here are the main points.

About two months ago my boss sent a message in Slack saying that I, and a few other workers would be getting corporate cards. Cool, I thought. If I ever needed to pay parking or buy supplies I would be covered.

That was the last I ever heard. I got a call from Amex asking if I had applied for a business platinum card and I said, oh, that must be the company credit card. I told them it was valid.

About a month goes by, I never receive the card, and just assumed that it was never activated. One day, I logged into my Amex account and had over 200k points. I knew I didn't deserve them so I called Amex, and found out that not only was the platinum business card opened, my boss had made me the PRIMARY on the account, and made himself a secondary on the account. He had two cards, my card (Primary), and his card (secondary). Both of which were under my SSN and I was liable if he didn't pay.

The combined charges totaled over $60k USD.

I went to him the next day and the first thing out of his mouth was, I don't know what you are talking about, you did those charges. I responded, no, you did them. You have the card.

After some silence I told him I want the card closed and the balance paid off. He ended up paying off the balance in full but never closed the card. I had to call and do it.

What should I do? I talked to a few lawyers and technically I don't have any damages because he paid the balance off.

It isn't technically identify theft because he told me I was getting a card. However, if he unilaterally made me the primary, is it identify theft because he filled out the application and probably signed for me? Idk. His business was definitely listed on the account but I was listed as the primary holder. It was a business account though.

Should I file a police report?

I'm still working for him, because I need the money but I froze all my credit so he can't do anything else.

I reached out to a few lawyers on NOLO and none of them took the case.

    Thanks

Edit: Already froze my credit. Thank you for all the advice guys. Some clarification, he is my boss, the sole owner of the company, and also he is HR…. Lol.

Also, he spent all the points. So the asshole didn't even let me use them. I don't know how he spent them if I was the primary on the account.

Landlord needs my WiFi to control thermostat for whole building.

    Posted: 27 Oct 2021 02:20 PM PDT

This is in NY. I recently moved into an apartment building 4-5 months ago on Long Island. It's a 9 unit building I'd assume used to be a large home at some point. Anyways, I hadn't ever messed with the thermostat in our apartment, because the weather had been fair. Anyways, today I got a knock on the door from one of my neighbors, and she asked if I could turn the heat off. Well, it turns out, our unit is the "master unit" or whatever, and my thermostat controls the whole building. This is not in the lease, and on top of that, my roommates job almost certainly will not permit this anyways. He's a Mortgage Loan Officer, and they're pretty strict about people having access to the wifi he uses from home. Even though they have some pretty severe VPNs and other such security set up. My question is, is it legal for him to ask us for our wifi? I feel bad if the other tenants are uncomfortable, but, what if we didn't even have wifi? Why can't he just hook up and pay for his own wifi somewhere in the building, the uninhabited basement maybe, and connect it through there?

Deported immigrant back in the U.S

    Posted: 28 Oct 2021 06:52 AM PDT

I have a sibling who was deported from the U.S roughly 15 years ago and is now back in the U.S illegally. A little back story, my sibling was imprisioned for a aggravated felony(rape) and went away to state prison for several years. After he served his time he was immediately deported to his country of birth since he never got his citizenship or green card here in the U.S. After many years he decided to illegally enter the US through crossing the US/Mexico border. He did not get permission to enter the U.S. He is now living at my parent's home. If I reported my sibling to I.C.E. will there be any repercussions to my parent who has taken him in? This is taking place in NY.

GA, Wedding venue sold critical decor and we are asking for a credit in return, now they are holding wedding gift hostage.

    Posted: 28 Oct 2021 12:03 PM PDT

We recently got married. The venue has been sold and we are the last wedding to happen here. When they notified us and all the other bride about this, they told us numerous times over the phone that this would have no impact on our weddings. In the meantime, they would need to know what items we planned to rent from them so that they did not sell them. About 3 weeks before the wedding we re-toured the facility to go over everything and confirm the items we wanted to use.

The venue has two rooms set up, each with a big beautiful bar with a large 10ft wine rack behind it. When we showed up for the rehearsal, we immediately noticed that both bars were missing their wine racks. Not only were they visually important to the room in terms of aesthetics. The one in the ceremony room hid the beer fridge. So the new set-up now has a huge fridge showing. While this normally would matter, the entrance for the bride(me) and my father is right next to the fridge. Half of our photos would now have a fridge in the background.

When we confronted the venue about it, the manager said that the owner considered them to not be functionally needed and decided to sell them early. We were obviously upset about the space looking worse than how it looked when we signed the contract and about them not telling the truth about "no impact" to our wedding day. We asked for the owners contact info and planned to ask for a partial credit towards the remaining balance ($664) of the rentals as a reflection in the degradation of space and photos.

We got married and are now a few days out from when this all happened and the owner finally reached out saying that we signed a contract and we need to pay the remaining balance, that they fulfilled everything promised and that the removal of the racks was just a decoration change. What's worse is I accidentally left a Tiffany & Co box behind at the venue with a gift valued at $400 that he will not return to us until we pay.

I've looked over the contract and it has an As-IS clause that says we "accept the venue "as-is" and all faults" and it has a decorations clause that says "venue decorations remain unless request to have it removed. $150 removal/installation fee will be charged".

I don't know if this is false advertising, breech of contract, or if we are SOL.

TLDR: Venue sold critical decoration that hid ugly fridge and claimed they redecorated, they won't try and settle with us and are now holding a wedding gift hostage.

Dr's office has charged me for care they haven't provided and keep moving the apt date

    Posted: 28 Oct 2021 06:03 AM PDT

I'm currently in a situation where my pulmonary care specialist has charged me for a sleep study, but the front office has continuously moved the appointment, now 6 months past the original date. Whether malicious or incompetent, at this point, I have gone to the doctor's office 3 times only to keep being told the appointment was made for the wrong doctor or for the wrong location. The person I speak to at the front desk is the same every time.

The billing department has sent me multiple letters attempting to collect on the home sleep study, but never picks up the phone or returns messages I've left. So far the best I've gotten is a 1 month hold on my account. I'm unwilling to pay since I still haven't gotten my results in any form and the office is unwilling to give them to me without an appointment with the doctor.

At this point, I just want my money back, so I can go to a different office. Is there anything that could qualify this for a small claims court suit? Part of me even wants to ask for gas money, but at this point I'd rather just put this office behind me.

    Edit: Location Virginia, US

Boss asked me to extend my notice

    Posted: 27 Oct 2021 06:13 PM PDT

I tried to give my notice today, and my boss replied "I'm gonna need at least a month, if not longer, to find a replacement." I checked my contract, employee handbook, and policy manual and everything says I just need to give two weeks. She's trying to make me feel guilty and threatening me for trying to leave before November 30th. What do I do? Is this legal?

Was told I wasn’t vaccinated due to my vaccine choice

    Posted: 27 Oct 2021 08:45 PM PDT

I had to upload my proof of vaccination for a work trip recently, but was unable to get the card verified in their upload portal due to it not being one of the 3 FDA-approved (or EUA) vaccines in the US at the moment. I took part in the Novavax trial earlier this January and the CDC issued guidance that stage 3 trial participants were considered "fully vaccinated for the purpose of public health" - the card says I'm a trial participant, but has the CDC letterhead, regulatory items and signature boxes just like any other vaccine card does. Even though in the eyes of the CDC I'm fully vaccinated, my workplace does not see my proof as valid since it's not a Pfizer, Moderna or J&J (they stated out which ones they are). Is work allowed to force me to get one of the currently approved vaccines, despite the CDC deeming those in clinical trials are fully vaccinated two weeks after inoculation?

Landlord telling us about about HOA Fines very late.

    Posted: 28 Oct 2021 01:39 PM PDT

Received an email from landlord that we got fined for some HOA violations. I understand in the lease that we would be responsible for the Fines. However, he got the notice from HOA over a month ago but is only telling us now, and we seemed to have racked up some more fines since.

So my question is do landlords have to inform tenants about these fines in a reasonable amount of time? In theory, it seems that he could have not told us about it and just racked up a year's worth of fines.

In addition, the letter said that if you wanted to contest the violation it has to be within 7 days of the landlord receiving the letter which is way past when we saw it.

CA, USA - what can I do about a courier consistently lying about package delivery?

    Posted: 28 Oct 2021 01:52 PM PDT

This all started about 5 weeks ago when we ordered a breast pump for our newborn. On Trac (courier) marked it delivered even though it was nowhere the be found and never turned up. Customer service basically said "tough titties, the gps shows the courier was at the complex when it was marked delivered. Contact the vendor"

Luckily, the vendor shipped us another one for free, but this time with signature confirmation. On the day of delivery, a courier called us for building access (which is strange - none of the other couriers do) but we have her the code and waited. 20 minutes go by and she never comes and we see the package was marked delivered with signature. Called customer service who said we'd receive a call back but never did. We ended up finding it on the ground outside our building a few hours later.

Today, we had another shipment for our baby marked delivered but clearly wasn't. Same response about gps certifying delivery. Now I'm waiting for a call back from a "warehouse manager" who will probably also do nothing about this obvious recurring issue.

I don't have a choice in On Trac, this is stuff we're ordering so it's the vendor's choice. Is there anything we can do to stop this madness?

My work policy says I can't have earrings because I'm male.

    Posted: 28 Oct 2021 06:12 AM PDT

    Oklahoma

Are they legally allowed as a company to do something like this? It's in the policy. The exact quote of the policy says "Jewelry should be worn in moderation. Jewelry should not be extreme or conspicuous. Earrings can only be worn by women with a maximum of 2 earrings per earlobe.

I'm not going for a million dollar sue, I doubt there's even a way with something like this to get money like that. I'm asking because I enjoy earrings, gauges especially and have planned for a while to get them.

    Storage unit

    Posted: 28 Oct 2021 08:44 AM PDT

I went on Monday to pay for my storage unit that I haven't been to since August to make a payment. I was told the unit I named was now under someone else's name. There is a different lock on the unit also. I was told by the storage company that the unit I had was not auctioned off either. They have no explanation for where my stuff is or how the unit belongs to someone else now. Should I go to the police? I'm in Georgia if that helps.

Is it legal for my boss to have me sign an agreement to keep wages confidential?

    Posted: 28 Oct 2021 09:17 AM PDT

I've tried to look this up online but I can't seem to find any hard facts that I understand.
I'm not in HR or anything of the sort. Just a regular employee at an e-commerce business. I have been "talked to" several times about talking about money in group meetings but I was only asking about Per diems or commission pay.
Ive had closed door discussions with my boss(owner) that I cannot talk about wages or money or else they could be in trouble. I have read that this is illegal but I'd like to have hard facts if/when I bring this up to my boss (Hard if on that).
I just got a 1$ an hour wage increase and on the agreement document my boss had me sign it states "all salary and wage information is expected to be kept confidential". Does anyone have any information on this? In Texas.

Ex-wife’s new boyfriend saying sexual things in front of 12 year old girl.

    Posted: 27 Oct 2021 03:41 PM PDT

My ex-wife and I have been divorced for 10 years. Her boyfriend of two years just moved in with her. Over the pasar month my daughter has complained to me about them having loud sex while her and her sisters were awake. When I confronted my ex about it she says I should of bought her a tv so she could raise the volume or for her to turn up her headphones. She said she had to deal with it growing up and it's just what happens when you have sexually active parents. Most recently my daughter told me that the boyfriend walks up to her mom and says sexually suggestive things while looking at my daughter and smiling. My daughter told them that it makes her uncomfortable and her mom told her that she should be happy that they're not fighting and should stop being rude.

Around the same time, my daughter had an attitude and the bf took some stuff out of her room and mad through it outside and told her she wasn't allowed to sleep in her room. I'm about to talk with a lawyer tomorrow but would also like some advice. Also, the boyfriend is a cop. Can I take action through his job?

Child in need of mental health care/evaluation but parent with primary custody refuses

    Posted: 28 Oct 2021 08:18 AM PDT

My friend has basic dad custody in Texas. Every other weekend and extended time in the summer. The custody orders made the mother the decision maker on medical stuff. The young child (8 years old) has been acting out a lot and has been making statements about wanting to self harm. The mother is refusing to take him for an evaluation or even just to therapy. She's also refusing to allow the father to do this.

What can the father do, short or going to court to have the child evaluated. He's very worried about the child's emotional state of mind and a court battle could take a long time. The behaviors and statements about self harm are documented with video and there are texts from the mom acknowledging the self harm comments as well as refusing treatment. Can he take the child for evaluation without her approval?

Someone falsely claimed that I was planning a mass shooting.

    Posted: 28 Oct 2021 01:11 PM PDT

    New York, USA

I'm a high schooler who was called to the main office earlier today. There were police there when I arrived.

Someone had emailed the school administration, claiming that I was planning to shoot up the school. The emailer claimed to be a classmate of mine, however, they remained anonymous.

According to their email, I told this "classmate" that I was planning a school shooting. They claimed that I had a note on my phone full of people who I wanted to target. They claimed that I might already have a gun. They claimed that I was seriously threatening to commit mass murder.

None of that is true. Whoever wrote that email completely lied. I told them that I wasn't planning on harming anyone. After a long while, I was allowed to go back to class. The police said that there would be a report filed with the police station, because they needed to document this incident.

I'm worried that I might get in actual trouble for this. Threatening a mass shooting is considered a terroristic threat, something that you can go to jail for. However, there was no actual evidence of me doing this; only an anonymous email that claimed so. What should I do next?

Contractor ghosted me looking for advice

    Posted: 28 Oct 2021 09:53 AM PDT

Back in August I hired a contractor to install a pvc vinyl privacy fence in my backyard. At the time I paid for half and was told 10-12 weeks due to material shortages from the manufacturer. Fast forward to 13 weeks later still no fence. A couple weeks ago I called to get an update, they said they would contact the manufacturer and get back to me in the morning. They never called. The last week I have called 4 days in a row and left 3 messages saying I just want to cancel the job, as I have waited more than the estimated time and now we're getting into the winter season. They never called me back or acknowledged my communication in any way. I checked the companies reviews again, and while they were great when I initially set up the job there are now a slew of reviews complaining about lack of communication, half ass jobs and wait times far greater than mine, so at this point I don't trust these people to install my fence even when they get the materials.

Since they haven't attempted to speak to me at all, I went ahead and contacted my credit card company and disputed the charge. Lo and behold the day my credit card company contacted them I suddenly started receiving texts and phone calls from them. They are now saying that the manufacturer promised the materials in the next 2 weeks ( completely ignoring my 4 voicemails saying I don't want it anymore). They also said it's very difficult to get refunds from the manufacturer, which is why their contract states there are no cancellations after 3 days. Three days is insanity to me, they have held my money hostage for 3 months.

Now I'm thinking I'm probably screwed because of the cancellation clause they put in there. The one thing that may be advantageous is there is no clause stating that failure to meet estimated delivery dates is not grounds for cancellation. A lot of other fence companies I looked up had clauses like that in their contract, however mine does not. I am hoping I can use that to my advantage to still have grounds for cancellation.

I'm just wondering if anyone had any thoughts on the matter or ways to communicate to them that I have the right to cancel. Or does the cancellation policy mean I'm about to have a fence installed in 2 weeks right before winter lol.

    Edit: this is in MI

(NJ) roommate not paying their portion of bills

    Posted: 28 Oct 2021 08:54 AM PDT

I share a house with 3 others, so 4 people in the apartment in total. Our lease clearly states we are responsible for all utilities. The electric bill is in all of our names. For about a year and a half, we agreed to give one roommate the money for the month and they would pay the bill.

Recently, we found out that the one roommate who we were giving money to to pay the bills was not paying them. For the past 6 months he has been sporadically paying g here and there, and has not paid AT ALL for the last three months. Yet every month like clockwork he asks us for our share.

Once we found out we asked that he returns all the money we gave him to pay the bill, as well as his shares of the bill so that the remaining 3 roommates can handle the bills from now on. He is refusing to return the money we gave him, and is refusing to give us his share of the bills.

What is the next step to take to ensure that he 1. Returns the money we gave him in good faith to pay the bills, 2. Give us his portion of the bills, 3. Ensure that he continues to pay his share of the bill for the remainder of the lease?

Fl high rise lowest unit's sinks back up due to stacked plumbing vs Insurance

    Posted: 28 Oct 2021 06:01 AM PDT

Hi. I live in a 30 floor high rise in Florida. 17 thru 30 are residential. Our plumbing is stacked. I stack for bathroom and a stack for regular plumbing. About 3 times since I've lived there our kitchen sinks semi-filled with backwash from the stacks above because of clogs, I'm guessing. There's nothing we can do as the bottom unit to prevent this. We had maintenance snake our lines 3 times and have been told a few other times not to run our water because they were working on a clog. My question has to do with the insurance section of our lease. It says the complex is not responsible for damage from "water and pipe leaks". Does that mean we're liable as tenants? Also, what action should I take against the complex regarding the biohazard of the sinks backfilling even when we're at work?

My job has been reporting my income under the wrong SSN for a YEAR and it's affecting every facet of my life

    Posted: 27 Oct 2021 04:56 PM PDT

I work at private resort for the super wealthy in rural Montana. It's a seasonal job, so we are at work from June through September, and then come back December through April. This means that twice a year I go on to job attached unemployment. I have worked for my current employer for 3 years now. They have changed payroll companies more times than I can count, and I think that's how this error got started.

Somehow, in October of 2020, my job started reporting my income under the wrong social security number. Nobody caught it. HR and payroll didn't catch it, I didn't catch it, H&R block didn't catch it when I did my taxes, etc.

When I applied for unemployment at the end of September this year 2021, I got denied for not having a history of wages in the last year in my state. Obviously I had worked the whole year so I was really confused. I got to the bottom of it and found out the SSN was wrong. I thought it was just going to be a matter of my job getting a hold of unemployment and letting them know that all was good. I was wrong.

The last two offseasons, from October 17th 2020 to November 28th 2020 and then again from April 24th 2021 to June 12th 2021, I had been collecting unemployment. I didn't realize that there was a problem already during those dates, because the federal government had pushed through unemployment benefits for people even if they weren't eligible through job attachment or through state wages (because of the pandemic). So the Feds just used my previous financial data and continued my benefits through those periods for the same amount that I've always received. I never got any kind of notification that I was being switched from regular job attached state unemployment to this federal coronavirus pandemic unemployment fund. But that's why the money kept coming. And because the money kept coming, I had no reason to think that there was any problem at all.

Flash forward to the present. I call my job, my job calls unemployment, they told me that everything is taken care of. But it's not. Now that my job has gone in and retroactively added wage information for the last year, it has negated my eligibility for the receipt of the pandemic funds from The above stated dates. So now the federal government thinks that I owe them $9,235, which they are expecting me to pay back, And will garnish any unemployment wages I receive in the future until it is fulfilled.

They're saying that because I am making more money now than I used to, my benefit amount has increased from $457 a week to $618, but because I have such a big debt, they're going to confiscate 50% of that money each week, bringing my benefit amount down to $388 until the $9,235 is paid back.

But I don't owe this money. I was gainfully employed the entire time. And I can't live off of $388 a week. Additionally, now it looks like I committed wage fraud. This could affect my eligibility in the future. I have an unemployment fund that my money is pulled from, based on the wages that I earned throughout the season, and I have never fully depleted it. I have always enjoyed a good cushion of about $3k in that fund. So due to this clerical error on someone else's part, my unemployment fund has been completely depleted and no longer has that healthy cushion, additionally I look like a criminal, I'm going to lose half of my wages for the entire offseason, and -I didn't realize this until recently- I got declined for two credit cards because they couldn't verify my income, which tanked my score by almost 50 points.

Without income, my credit is all I have right now. Unemployment keeps telling me that I'm going to start getting paid every week, but every week No payment comes. Payday was supposed to be today again. No money, again.

No one at my job seems to be taking this seriously. I live in a very expensive place, usually only super wealthy people live here. But I live here because of work. So I'm bleeding money out of pocket from my savings just trying to stay afloat right now waiting for anybody to figure this out. Juggling credit cards. And my credit score has suffered. I want to buy a house, that's what I've been saving for, and now I have these marks against me that even if my job sorts out my financial situation, are going to stay on my credit for like 2 years. I don't think that's fair. I haven't done anything wrong here, but I'm the only one who is facing consequences. Not to mention that the government thinks that I owe them almost all of my savings!

I don't know if my taxes are correct. I don't even know how to figure that out. And if they're not correct I don't even know what to do about it.

The place that I live is super duper rural. We don't even have postal service here, which has exacerbated this issue because I'm not receiving my mail in a timely fashion. I have a PO box in the next county over, but it's like a 72 mile round trip. My car needs to go in the shop, it has a check engine light on and it's guzzling gas. But of course, I can't bring my car to the shop because I don't have any income right now. So I can't afford to drive out and check my mail every single day, I've been checking it once a week. But honestly I haven't received any helpful correspondence from my state unemployment or my job.

Please help, I'm so lost, I don't know what to do and my money is running out. I'm sorry if this is flared incorrectly; I Don't even know how to categorize this ridiculous problem.

ETA: This problem has been ongoing now for almost a month without resolution

My bf’s ex stole his cat

    Posted: 28 Oct 2021 11:55 AM PDT

(Reno, Nevada, US) This is my first ever post and I have a good feeling I can get lots of help from this community.

My bf and his ex split up a few months ago. In that time she's blocked him on everything, despite having quite a few of his belongings still, but most importantly his cat. She wouldn't allow visiting, help with medical bills, vaccinations, or any of that. He couldn't try either because he was/is still blocked. She's holding this over him and says if he takes her to court she'll win on that alone. He has the adoption papers and the microchip all in HIS name, and is worried he won't win because he couldn't help with medical records. But he was forced out of it. Please tell me if we take her to court, we'll win his cat back? He also has tons of screenshot evidence of how she is and her saying in one text "I wouldn't steal your cat" and then in another how he isn't getting his cat back.

    Car extended warranty denial

    Posted: 28 Oct 2021 08:41 AM PDT

The Toyota dealer noticed my water pump was leaking. I have 68k miles but my extended warranty covers water pumps. They are denying the claim saying because I skipped the air filter replacement at 33k miles or whatever that I didn't properly maintain the vehicle and are denying to cover the water pump.

The air filter has nothing to do with the water pump. Is there anything I can do?

    I'm in NC, USA
