    Hello r/legaladvice,

    I'm stuck between a rock and a hard place today and I'm being told a lot of things by people who shouldn't be giving legal advice. Here's the situation:

    I hired a mobile groomer through a new, but popular and well-reviewed, grooming app. I am located in Brooklyn, NY. This man came out to groom my cat and I paid more for him to bring a mobile grooming van instead of completing the groom in my own home. My cat is a tiny five pound cat who just needed a coat shave and a sanitary cleaning. The man arrived, I brought the cat to the van, everything seemed normal. About twenty minutes later he's done (which is a crazy short amount of time) he calls my partner over to the van and tells him that he cut my cats ear off accidentally. He's apologetic but immediately gets defensive blaming my cat saying that she bit at him. He showed my partner a superficial cut on his finger and offered a lame "my bad." I was at work so it took me a few hours to see the extent of the damage but when I got off it's not like he nicked my cats ear a little. Half of her ear is now just gone and her whiskers (which shouldn't be cut) are cut down. At this point I was furious called support who was less than helpful but gave me an email to contact and through that email they offered me a refund and a credit for 90% off the costs of a free groom.

    At this point I call around to vets who advise me that since it's the weekend and the cat isn't actively bleeding and the ear isn't super sensitive to this sort of damage, I should wait til Monday (today) to bring her in. However since that time, yesterday I found yet another one inch long deep gash on my cats side that the groomer did not disclose during the incident and the company did not bring to my attention. The cat is going to the vet today and I am getting this all documented. When I asked to have my vet bill compensated they immediately agreed but when I asked what happened to the groomer they said they'd review their policies with him and give him a "talking to".

    It's one of those things where if it had just been the gash or just been the ear, might be more forgiving and able to move past this with just my vet and transport bills paid to get care for my cat. But at this point I believe this man was negligent and I want to make sure he can't injure a cat this severely again. My cat is normally sweet to strangers and never has an issue at the vet or groomer. It's my belief this man wounded my cat and instead of stopping the groom right then and there, he continued, resulting in the incident that lost my cat her ear. My cat is traumatized and her personality is just gone. I love her so much and can't believe this man I trusted hurt her this way.

    At this point I'm hearing a lot of conflicting advice about filing a police report and/or asking for compensation before moving to small claims court. But my priority is making sure this man can never injure another cat this bad, to maybe get my missed day from work compensated as I'm having to take off, and to get the vet bills paid. Should I be pushing for more? Should I be filing animal cruelty charges? I have no clue. I just know I can't sit by and let them get away with it.

    At this time they don't know about the additional gash (or it's placement) as I wanted to get to the vet this morning before reaching out to them again. Cause i'd wager that groomer didn't tell them the full story either and I thought it best to not give them more time to come up with another excuse.

    DUI for sleeping in car BAC of .009

    I live in Florida. The other night I had a couple of drinks and didn't want to drive home so I decided to sleep in my car. I was woken up by a cop knocking on my window and he asked me to preform a field sobriety test. I was very tired but didn't feel intoxicated but I was arrested for a dui. when I went back to the station blew a .009 bac well below the legal limit. I Was not on any drugs. Do I have any chance of fighting this off. Thank you for the advice.

    UPDATE: I think my neighbor’s roommate murdered her. What do I do?

    Massive update, I was able to reach out to her daughter and confirm that she is indeed safe and sound.

    Thank you all for the advice. Just to clarify, I came to Reddit first because I wanted to do this right. I didn't want to risk being the "crazy" neighbor who calls the cops when everything is fine. But also didn't want to risk letting harm come to my neighbor by doing nothing.

    Let's all take this as a reminder to be kind and thoughtful to those around us. You never know when someone may need your help.

    My husband got his car stolen and the cops aren’t helping. What can I do?

    Like the title says, my husband locked his car before bed and didn't realize his spare key must've been in his gym bag. So when someone came up to the car at 5 AM, the doors unlocked when he pulled on them and he pushed the button to start the car. We have GPS tracking on the car so when we woke up we were calling all the counties he was going through hoping someone would stop him, but no one did for 3 hours. We finally saw the car coming back towards our house and then got an alert that it had crashed. This was Akron, Ohio and APD was on scene in minutes but obviously they fled. Nobody looked in the car until my husband got to the tow yard. When he got there, there was a pill bottle in the car with a name on it of a very well known thief in our area, but the issue is that he resides in a different county. I took pictures of what was left in the car (a book bag, screwdrivers, the pills, other miscellaneous things) and then dropped it back off at the police department.

    Now here is the issue. The car got stolen from where I live in a suburb of Akron, car was crashed and found in Akron, and the guy lives in a city about an hour south now. We have the proof it was most likely him with the pill bottle and his reputation in town (and previous charges), is there anything we can do? Civil charges, etc? We're just looking to get our insurance deductible back, my husband is still unemployed from deployment and we have 3 kids to feed. Any advice is welcome.

    TX divorce lawyer got pregnant, is there recourse

    going through divorce, currently trying to settle. Mediation is soon, but the court date is quite far off. Lawyer took me on at 3 months pregnant, but didn't say anything until a month or so before she plans to go on leave which will be for 3 months which will be after my court date. I've already spent 30k with her and she doesn't have a log if details to pass off to another attorney. She claims others in her firm are aware of my case, but the micro details of this case are super important to me getting the outcome i want. knowing the contents of countless recordings, videos, event sequences and account information is critical. her replacement will cost about 50% more than she bills.

    Do I have to pay the new lawyer at her firm to get up to speed?

    Is there any reason the should have revealed her inability to complete the divorce? she must have known many months ago.

    Is there anything else I should consider or do?

    Asked landlord to test water, promptly gave an eviction notice and wouldn’t share the results.

    Hi all! The above situation gave me pause and I decided to drop $300 to get the water tested myself. There's more results coming later this week but the initial results were that it has Coliform bacteria in it.

    A little background. I live in Oregon. I've been renting this spot for days shy of a year. She has never offered to provide drinking water until she served us the eviction notice.

    I'm wondering if anyone here has any insight as to if I can get a lawyer and get money back? How much is realistic? Is it worth the trouble?

    Wife and I closed on a home, now a week before we are to move in the previous owner states she has covid and can't move out yet. What can we do? More info in post.

    My wife and I closed on Aug 16th on our home, with the stipulation that it would be 30 days before we could move in since the owner was selling the home but didn't have one to move into yet. Signed the contract, exchanged numbers, badda bing badda boom. Halfway through the 30 days we contact her just to get the utilities figured out, like who she used/preferred and whatnot, also asked if she had found a place which she had and was just about to close on it. On the 9th, we figured we werent going to be getting into the house sooner than Sept 16th so that's what we set up all our appointments and deliveries for. The very next day, she calls my wife stating that she has covid and has to quarantine so she may need to be there until about the 20th, stating the moving men can't get her stuff out of the house and into her new condo because of it.

    My wife and I don't have a home/apartment, we are currently staying in an expensive, absolutely ghetto extended stay because it's the only one that allows pets. She has had a month to get all of this in order, I know you can't help getting sick, but come the 16th that house is OURS. Why do we have to eat even more costs of staying in this extended stay while she would have two homes? What can we do? Do we have legal rights to kick her out? Make her pay for our hotel costs from the 16th to whenever she gets out?

    My mother has been seperated from my father for 30 years. Now that she just found out he is dead, she wants to alter his death certificate because his partner of 17 years said he was not married. Now she wants my ID and signature to request the death certificate. Does she need this to remarry?

    My mother left my father when I was 1. They married in FL. and had only been together a couple of years. When I was born they moved back to NY where my grandparents to lived. They worked together at my father's business until they split and we moved to the UK. Allegedly they made a deal that my mother would not seek child support if he never sought visitation. Once the deal was struck we got on a plane, they never divorced.

    Eventually we moved back to Fl. I got to see him for a couple weeks when in my early teens after he moved NY to FL in the hopes of maybe starting a relationship with me. I wanted that and we spent free time together for a couple of weeks. My mother promptly moved us out of the country again for 6 months, and then to SC. We had never been to SC before and had no reason to go there.

    We stayed loosely in touch,, and when I was 24 I was able to rekindle a relationship with him. I would visit whenever I was in the area, and I met his partner C. He and his SO started or continued the business together in FL. and remained in Fl. They were together 17 years.

    I texted my father recently only to get a response from C (my father's SO). C informed me that he had passed suddenly. I asked if there were any small trinquet like an old shirt or jacket or even a photo that I could have to remember him by. She seemed at first very concerned, said they really didn't have a lot and went on about how the business was in debt and she was struggling. I assured her I wanted nothing of value from them, only momentos. She sent me some photos. She seemed concerned that I would try for some of his estate, if there was one.

    I told my mother (BS) that Dad had passed. She of course made it about her, saying she was a widow now. She has been dating my brothers father for about 17 or 18 years and NEVER spoke with my father, even when I was meeting him as a kid.

    Now about a month later, BS has started harassing me about sending a photocopy of my license 200x zoomed and signed and dated so that she can get Dads death certificate. She said I have to do it because I am immediate family, and said there was an urgent deadline. I asked why, and she said that C had falsified the death certificate saying that dad was not married, and this now prevents BS from being able to remarry my brothers father.

    I was hesitant, and have been trying to look up the laws about seperation vs legal seperation and divorce/annulment. While looking this up, I start to get heavy pressure from BS to hurry up and do it because she has already filed the request for me online and needs my document. I am sure if she had a copy already she would've just forged it.

    She messages reminding me that she needs it right away repeatedly, I give her reasons why I am busy, which I have been. Finally she sent a message while I am at work. The text preview on FB says something to the effect of "Nevermind I don't need your ID. C falsified documents and now I am going to have to take the bitch to court to prove that we were married..."

    Red flags are waving and I immediately try to click the message, but she has already deleted it, leaving he last message to me an urge to hurry up and send my ID.

    I ask her what the message said, she lies and says "I was going to apologize that the insurance check I forwarded to you never made it, but then I thought better of it." I persisted and said "No, the thing about C"

    No response, 2 days go by and she sends me a screenshot about how her request is going to time out because she didn't send my documents. I responded "you didn't answer my question" and she says "what does that have to do with this?"

    TLDR; My mother is manipulative and frequently lies to get her way. My recently deceased father's SO is concerned that my mother/me might try to take my father's business. My mother has started asking me for documents to get his death certificate so she can change it.

    If my mother's end goal was to remarry her long term SO, how can I assist her in doing so without risking her trying to steal a business away from his long term partner? I don't mind helping her to be able to marry, but I do not want to be involved if she may be trying to argue that she is entitled as his wife in any way. I don't see why there would be a sudden rush to get his death certificate when they have been seperated for 30 years. And why would she need to change the death certificate? Isn't an incorrect death certificate still proof that the husband is dead?

    Any and all advise on how to handle this would be appreciated.

    18, Can't move out because of toxic parents.

    Hello reddit, I'm in a strange situation right now and I'm not sure if I should take legal action and where I should begin.

    I'm 18, and what is stopping me from moving out is the fact that they've taken my source of income: My laptop.

    Gifted to me when I was 16, I have more than 800usd worth of software that I've bought for education and portfolio work on that laptop, and only I know the password to it- it also contains important personal information and scanned documents. I can buy a new laptop of course, but this laptop has my portfolio on it and an entire year's worth of work which I just can't repeat on-time to find a job.

    Furthermore they have threatened to take away any new laptop I buy away too, saying that if I do not go to college I won't get my original and newly bought laptop(s) back.

    What do I do? I'd love to pack my things and leave, but I need the files on that laptop- at this point it's just about what's within, rather than the actual laptop.

    Bought a decorative wardrobe type of furniture a while back second hand, I just recently found a very expensive watch shoved in the back. Can I sell it legally?

    I'm in NY. Not sure flair is appropriate or not but I don't know what it would fall under. Anyways, I just recently found an Ebel watch, in a piece of furniture I bought off of Craigslist a while back. The closest thing I've found online to what this watch looks like, is worth around 12,000$ USD. I have tried to contact the old owner with no luck. And am curious, if I sell this would I be breaking any laws? I'm asking because I know high end watches, like Rolex and such have seriel numbers that are registered to buyers often, and lots of people have gotten in trouble for selling otherwise stolen goods. It's a women's watch, and I'm a male so I have not use for it, and would like to know if I can legally without worry sell it to someone? Again, I have tried to contact the previous owner, but this was over a year ago, and the generic Craigslist cover email I have seems to no longer work. So I don't know how else to go about this.

    KY - father under investigation, what should I say?

    good morning (afternoon?) everyone!

    I found out from my mom a few days ago that my youngest sister (15f) came forward during a video call with my mom, their therapist, and my dad, and accused my dad of raping her since she was 8 years old (when my parents split, they lived together on different floors until officially divorced 2 years later [mom downstairs, dad upstairs with all the kids]) and impregnating her last summer (she lost the baby. He apparently wanting to fucking keep it).

    I personally haven't spoken to him since I left home at 18 (7 years ago) thanks to serious emotional and mental abuse I suffered from him, and almost physical (we about started punching/hitting each other the week I decided to leave) - my mom has said that there's an investigation with a Forensic Psychologist next week for my little sister but that all of us kids will probably be asked to speak with them too.

    My question for you guys is: is there anything I should/shouldn't say or do? Should I have a lawyer or anyone with me should they choose to interview me? Could I, or my family (am married with a daughter), somehow get caught in a shitstorm over this (aka should I just refuse to say anything?) I obviously want to say something to them because he deserves every punishment in the fucking book, I've just never been in a situation like this and don't know what I should do

    I know someone with a fake vaccine card that willfully puts others at risk, what should I do?

    I recently found out that someone I know (not very well) has been using a fake vaccine card to get into bars and other private businesses that require proof of vaccination. This person has a laundry list of other morally questionable behaviors and doesn't seem to care about the well-being of others. Is there anything I should do/someone I should talk to about this? This person is also a federal employee that lives in DC.

    Cops called blocking my own driveway

    I'll try to keep this short. I live in queens NYC. For alternate side parking sometimes we have to block our driveway as well as my neighbors (we lived in the same house for 30 years and we have an understanding we can block one another's driveway and call each other to move if need be) everytime we park there this one neighbor calls and reports it pretending to be my neighbor. The cops knock on my neighbors door to ask if they called it in and they don't even speak English only Chinese and had to call their son to translate and say they never call the police. I'm sure he reports it anonymously. How can I prove he's doing it and file harassment charges??

    TL;DR can cops track who calls and reports vehicles and how do I report for harrasment?

    Archive website ignores my take-down requests of my blog

    Hi, /r/legaladvice

    I been blogging for some time and made guides how to deploy own VPN, use TOR and bypass government restriction in my country. Right now my country is witch hunting people like me and put us in the jail, because we help normal folks to have free access to the internet.

    So, I had to erase everything and found out that two websites are making copies of my website. One is Wayback Machine and another one is archive.md. I did mail them both and requested to remove the snapshots.

    Wayback Machine did it without any problem in several weeks, but archive,md is not responding to my requests and keep's all the snapshots live. I have tried to mail them twice already and it's been over 2 months.

    Any advice? Thanks in advance.

    Can we legally keep this diamond?

    My brother ordered a diamond for his girlfriend's engagement ring and had it shipped to me so she didn't see it delivered. The retailer sent the wrong diamond in the shipment (2 carat vs the 1 carat he ordered).

    They sent an email with a shipping label asking for it back, which we will do since it's the right thing to do (and it's not the cut she wanted, lol), but I was wondered what would have happened if we had refused to return it? Does the seller have any recourse to bill or sue us for the price difference?

    Not too worried about the ethics of the situation since we will return it, but was curious on the legal aspect! We're in Orange County, CA.

    [MA] City clerk rejected name change approved by Social Security Office and RMV

    My wife wasn't sure that she was going to take my name after we were married, so on our Marriage Certificate she decided to leave her maiden name under the "Name After Marriage" section. After marriage, she decided to take my name, and she followed the steps laid out by the RMV and Social Security Office to get her name changed. They looked at the marriage certificate and issued her a new drivers license and Social Security Card with her new last name.

    Next was the bank. The bank saw that the "Name After Marriage," portion was her maiden name and directed her to the City Clerk. The City Clerk declared that both the Social Security Office and RMV were in error and gave her a rejection letter for her new name. The the only recourse we have is to petition the court to changer her name, which will require another reissuing of her drivers license and Social Security Card.

    Is this really the final word on this? Is the City Clerk of our small town really in a position to tell the State and Federal Government that the name they chose to recognize is invalid? Do we have any option besides petitioning a court to change her name?

    [Tennessee] Small contractor backed out of renovation project without completing work, and is now threatening unspecified legal action because I stopped the final payment. Copies of communications and contract available on request.

    Hello all. I apologize in advance for the lengthy narrative.

    My girlfriend and I hired a "Licensed and Insured" small contractor to scrape and refinish popcorn ceilings in our home. We signed a very basic contract prior to commencement of work, and paid $900 of the total quote ($1700) up front (too much up front, I know, but this was our first contracted work and we've learned some hard lessons). At the end of the first day, they had scraped about a third of the total square footage, and did almost no cleanup. We had to do hours of cleanup just to have a usable bedroom and a clean pathway through the house. We expressed our frustration with the lack of cleanup prior to work on day two. At the end of day two, they had essentially finish scraping and cleaning up edges of a third of the square footage, and had roughly scraped all but the remaining third of the ceilings.

    It was during day two that the contractor (who was one of the two people working this project) expressed that he would have difficulty cashing the final check ($800), as his bank would be closed by the end of his working day. I was busy with work, and unwisely cut the final check, knowing that it was unlikely to clear my account until after the work was done, giving me a window to stop the check if needed. Shortly after receiving the check, he went and made a deposit during lunch, which was sooner than I had anticipated. When I discovered this, I informed him that I may have to stop the check, as I was waiting on a balance transfer to come in to cover the check, and that I would rather write a new check and cover any cancelled deposit fees rather than let the check bounce. Ultimately, I moved money from savings to cover it, making the my concerns moot, and I let the check ride.

    Early on day three, the contractor informed me that he would have to reschedule, as he had a house full of sick children. I informed him that I intended to (but had not yet) stopped the final check (as I was uncomfortable paying for work that definitely wasn't going to be complete at the time of the check-clearing). It was at this point that he informed me that he would not be returning to compelete the work, because of our "unreasonable expectations", because he felt that we were a financial liability who would be unable to pay, stated that as of 9/9/2021 (that day) the contract was void, and that I could "Feel free to cancel the checks, as you have stated before. " So, I placed a stop-payment request for the final check, stated that I would not pursue the initial $900, as we felt that was fair payment for work already performed. And that was it. Until this morning (Sep 13).

    I received a text from the contractor stating that he had seen that his bank had rescinded the deposit based on my stop-payment order, which had overdrawn his account. He said his lawyer had some documents that would be sent over to my bank, and "What that means is you'll have to reimburse. It'll be done the easy way or the hard way. I suggest you get to fixing it before you turn 1700$ into about 10k with my lawyer. You have until Wednesday to fix it. You caused the void of the contract."

    I asked him to put his lawyer in contact with me, which has not happened, so I don't even know if this lawyer exists. As I mentioned earlier, the contractor stated in a text that he would not be finishing the work, stated that the contract was void, and that I could cancel the check. I have reviewed all texts and the contract, and found many items that nullify his claims and threats, but I'm still a bit shaken by all this. I'll admit, it was unwise to offer final payment before completion of work and revoking it was clearly frustrating for all parties, but per the contract, final payment was not due until completion of services, which the contractor stated would not be completed as outlined.

    Have any of you seen anything similar to this, and can you offer any advice? Am I in the wrong here? We have not yet contacted anyone for legal representation, but we have begun asking friends and coworkers for recommendations. I have screenshots of all communications between myself and the contractor (all text), as well as photos of the contract (we each retained a signed copy) if anyone is interested.

    Quick edit: we found this contractor through a neighborhood FB post. They have no online presence beyond a FB page, which is managed by the contractor's wife (whose account is linked to multiple names or aliases) and are not an LLC or anything else from what we can tell. The state licensing board has no record of any license held by the company or the individual, though I have not comfirmed that with his county of his business address/residence (Sumner) or with my county where the work was done (Davidson). I belive we're being bullied by a self-glorified handiman.

    T-mobile lied to me and my rate went up

    I joined T-mobile two years ago and part of the deal was they gave you a new I phone and each month you got a credit for it - so basically if you stayed a customer for 2 years the phone was "free".

    After two years I got an email saying I was eligible for a new phone. I went into the store and asked about it, and made it very clear that I was happy with my 77 dollar a month bill - and I did not want it to change.

    The person helping me said I would be getting the same deal as before - I would get the phone for free if I stayed a customer for 2 years.

    I signed up, a month later I got my first bill for 114 dollars.

    WTF? So I go back into the store and the district manager happened to be there. I told him what happened and he said he had some bad employees (the one that helped me quit/got fired) and that there was nothing he could do for me.

    Now I am locked into a 2 year contract and I am being forced to buy a new I phone that I was guaranteed would be free.

    Is there anything I can do??

    Car was sold and never registered, now it was in an accident. What to do?

    My friend sold his car to an old coworker last year sometime. The person never registered the vehicle in their name. There was no bill of sale. Now the car has been in an accident. Police have the driver and everything on file but it's all coming back to my friend who is the vehicle owner. The wrecker company that towed it is claiming he owes them storage fees and etc. I advised him to get some legal advice. What does reddit say? How should he rectify this? What type of attorney does he need?

    [KS]Guy attacked me 5 years ago and broke his hand knocking me out and punching me in the head after I was knocked out. Just now discovered how brutal the attack was and I believe I had a seizure.

    Completely unprovoked. Guy posted fb photos of his trip to hospital. I dropped out of school months after this and my teachers noted something was wrong with me after visiting them years later. I need to know if I just need to live with possible brain damage or what. Feeling shitty that I never pursued a case. Please help.

    Company refuses to reimburse for a lost package, FedEx says that company has to initiate for them to do anything about it

    I ordered an army surplus backpack from a company based in Texas, having it shipped to Idaho. It was shipped to an apartment complex which has the front desk hold large packages received and notify the recipient to come pick it up. No notification was ever sent if it's arrival, but I was emailed by the company asking to leave a review for the product. Upon contacting the front desk, they say they have no record of a package being received. I contacted the company asking for a reimbursement, and they are saying that since it was signed for they will not reimburse the package. It was signed by a name that was not mine, and I never received the package. However, they are saying that it's not their problem and if I want my money back to contact FedEx Doing so resulted in FedEx saying they can't so anything without the company filing a claim, but they are refusing to do so. I tried making contact with the front desk, but they are refusing to do anything about the missing package since they say that they never received it in the first place. Is there anything I can do?

    How to get Pretrial Intervention? Misdemeanor/ 21 F/ Florida

    I was just issued my court date for the 27th of this month. I was told by the courthouse I can't have a public defender until the day of my appearance in court. I just want to apply for diversion/PTI. I feel like there must be a way to get in touch with a public defender before my court date, and I really don't want to go into court without any legal advice from an actual professional. This is my first offense and I have no idea what I am doing or what to expect. I'm scared as hell and I want to do whatever I can to up my chances of having my charges dropped. I feel like if I take matters into my own hands I can talk to a public defender before court, I just don't know how. I'm being charged with petit theft but was let go on Notice To Appear. Never went to jail, never got a mugshot, never saw the judge. Any advice on PTI, going to court without a public defender, what to expect, or what to do in general? I'm so desperate for help.

    Colorado - Intestate when date of death uncertain

    Players: long divorced father died several years ago so he is out of the picture, mom, one son, one daughter. All adults. No spouses or children.

    Mother had an attended death (not in CO).

    Son had cut contact with everyone months earlier. Police sent to last known address to make a wellness check and inform him of mother's death. Police found enough probable cause to force entry and found his body in advanced state of decomp/mummification. Best estimates he had been dead for 4-6 months. His body was found less than 48 hours after his mother died. He had no will.

    Question: Will the probate court use "date found" (which is what is listed on the death certificate) as the date of death?

    We are hoping so. The 120 hour rule would keep the succession simple in that his estate would go straight to his sister rather than being routed through his mom's estate.

    Marriage certificate was forged at 16 to 29yr old man by his family in South Carolina( 2006)

    When I was 15, I thought I was very much in love with a 28yr old. I fell pregnant and my legal guardian allowed me to apply for a marriage license at 16 so I could be emancipated and to avoid legal issues for him.

    I did sign for the license, but I never had any ceremony or anything. His mother was a notary and officiant with many friends in the same field, and they all agreed to my mother in law forging my signature while I was home with morning sickness. I do not have proof that I was not there, but our handwriting styles are vastly different.

    I am now 31 and am unsure if the marriage is legal. We do file taxes together, but I have never done it any other way, as I had never worked prior to meeting. He is on birth certificate for all three of our children.

    If marriage is void, does common law take effect? I do not want to be in the relationship any longer and need to know if this is even worth mentioning. Thank you!
