    [California] I paid cash for a two bedroom condo in April. The condo came with two parking permits, one red, one green. The updated rules that were sent to me after closing states that an owner gets two parking permits, one for covered parking, and one for uncovered parking. However, the rules do not state which permit is for which parking. Walking around the neighborhood revealed both green and red permits under covered parking as well as about half of the vehicles showing no permit at all.

    One week ago I received a notice on my windshield that my car would be towed for not showing the proper permit even though the permit was clearly visible in the corner of the passenger side windshield. In fact, the notice was placed under the passenger wiper blade directly above the permit. I called the management company and informed them of their mistake along with a picture of the permit in the corner of the windshield.

    I thought that this would solve the problem. I was wrong.

    I am a nurse and I work the NOC shift. At about 1300 my wife came in screaming that one of our cars was being towed. I immediately got up, got dressed, and went outside to find an employee of the management company directing a tow truck to tow my car. She said that it was being towed because it had the wrong color permit. I immediately pulled up the R&R's on my phone and asked her to show me where the color codes were explained. She couldn't do that (because that explanation doesn't exist in the rules) but she refused to stop the towing company, so I had no choice but to call the police.

    Upon arrival I explained to the officers what was happening and showed them the R&R's on my phone, and both of my cars with the proper permits. They told the management employee and the tow company that they had no reason to tow my car. The rep hemmed and hawed that I was parked wrong even if the rules didn't state so. The cop ordered the tow company to release my car.

    Problem solved, right? Wrong.

    I go back to bed and just fall asleep when my wife comes in screaming that they are towing the car again. I go back outside and the same cop is there from earlier. This time the president of the management company (the one who oversees HOA board meetings) is there along with the same tow truck driver and employee from before. This time my car is already up on the flatbed. The manager told police that I still had the wrong permit to use covered parking, even though it was the right one according to this unwritten rule that I had learned of earlier in the day. The cop asked the manager if she had inspected the permit before calling for the car to be towed. She admitted that she hadn't and was just going off of what the employee had told her from earlier. The cop asked her to verify that the permit was the right color to be under covered parking and she hesitatingly admitted that it was. The cop was visibly perturbed and again ordered the tow truck to release my vehicle. He then gave a stern talking to the manager about making false claims and not verifying for herself what her employee told her.

    The cop gave me a case number and said that both reports would be available in 24 hours. I plan to use those reports to bring this to the attention of the HOA board as I know for certain that the manager will try to sweep this under the rug, or will refuse to even acknowledge this incident.

    What should my next step be?

    Lady that surrendered her dog to me is trying to get him back after two years.

    To preface, I'm located in Colorado. Two years ago, I found a dog on Facebook who was being surrendered. The previous owner had recently had a child who was allergic. I didn't pay for the dog.

    Since I've had him, he got my dads dog pregnant, and we have three of his puppies still in the family. I've gotten him fixed and paid for multiple vet visits for him.

    I've stayed in touch with the previous owner and even went to visit her with the dog a few times. After one of these visits, she sent me a photo of her son with a rash saying "see this is why I gave him to you".

    A few weeks ago, her boyfriend messaged me on Facebook saying that she was going to try and steal him back from me.

    Recently there was plans to let her visit him again that fell through. Now she's mad and wants him back, threatening me with a lawsuit and telling me that I need to pay for him ($6k). I've blocked her on Facebook (our only means of communication) and she keeps making fake accounts trying to talk to me and find out where I live. One of these accounts even sent me a link to an IP logger. I'm also getting emails that someone is trying to log into my Facebook.

    Today, animal control showed up to my house. She's posting online that he was stolen from her 10 days ago.

    I've kept records of all our conversations proving that she gave him to me, and all his vet records. I'm also keeping records of all her attempts to reach me.

    What can I do to protect myself and my dog?

    My +60 father died after being left for dead. The woman who failed to get him necessary help was given everything in his will.

    What are our options? Were based in Canada. The local police have been ignoring our request to investigate this further.

    I've been no contact with my father for some time. He was a bit of a drunk. The coroner report indicates he was living in squalor. The reports to the police indicate my father was left laying on his side outside for four days. The lady who was given the entire estate in his will apparently spoke to him on day 1 of him being on his side then left to leave him be. On day 2 she saw him in same position laying down and didn't check on him. Assumed he was sleeping. Day 4 she found him dead in same position. She never contacted ambulance or his own family who live just down the road from him. After seeing him violently ill on day 1 vomiting and in pain nor on day 2 when he was in same position and still outside in same clothes.

    This seems an awfully lot like someone benefiting from neglecting an elder person in need. This woman was supposedly a friend of his fwiw and stored two of her vehicles in his garage and regularly came and went on the property hence why she saw him.

    Are there laws in Canada that require someone to come to someone's aide when they're in a seriously bad state and laying on the ground outside? Can we press charges? How do I get the local law enforcement to investigate this more? What options are available legally?

    My special needs sister is unable to get a passport

    My sister is special needs. She is 35 years old, however mentally she is about 1 years old. She is non-verbal. She is able to walk, she is able to use the bathroom herself and perform home tasks such as putting dishes in the dishwasher but that's about it.

    My parents have been attempting to get a passport for my sister since April so that she can go with her caretaker on a trip. With my sister's disability it is near if not impossible to get a photo of her that is within their specifications. She will not look face forward for a photo on command. The one photo we got of her looking face forward she had an obviously pissed off look because she was tired of having her picture taken for so long.

    When my mother attempted to speak with the passport hotline it took several weeks for her to be able to get through to a person. When she did she was told that they would have to speak with my sister in order to release any information about her passport despite that she cannot speak and my mother is her legal guardian.

    The trip is coming up and it is unlikely we will receive her passport at this point. My question is – is there a way for a person with a disability like my sister's to get a passport when she is unable to meet the photo requirements? To me this seems like an ADA violation. Is there a way to get things moving where we can get things done with her passport? Should we contact a lawyer?

    My apologies if this is not the right place for this question – I'm a little lost on where to look. My sister is in Atlanta, my mother and father who are attempting to get this done live in Florida. Thanks

    Edit: I forgot to mention we have attempted to schedule a physical appointment at an office where we can bring my sister in and have them see her. There are no appointments available within the next few weeks.

    HOA holding our water hostage (CO)

    Title is a little dramatic, but that's what it feels like. I own a townhome within an HOA controlled community in a small town north of Denver, Colorado. We purchased the townhome and moved in the week it was finished being built, approximately 3 years ago.

    Some time last year, my SO and I noticed the water pressure was getting bad. It would usually be worst during the mornings and evenings (so demand hours). Several of our neighbors in our same building noticed as well. At least three homes contacted the HOA (our water bill is paid in our $270 HOA dues.) They sent out a plumber who looked and couldn't find anything wrong with any of our units. At that time, we suspected the sprinkler lines for the community were connected to our water main and we're hogging the water. (Which still hasn't been completely ruled out.) SO shuts off the sprinklers, water seems fine for a little bit, but gets bad again.

    Couple months go by, with no changes. We ask for an update, and they send out a different plumber. Same thing, plumber doesn't see any issue in our units. Suggests the issue is with the main.

    Now it's been an entire year. The water pressure has gotten so bad all day/night that at least once a day, I can turn on a water fixture and have no water come out. (I have taken video of this). I have had instances where I would lose all water during a shower, and had to stand there and wait for enough to come back so I could rinse soap from my hair. There is no rhyme or reason for when the water pressure will be okay (which is more and more rare) or if it will completely stop.

    We have heard from at least two other buildings that they're having water pressure issues as well. The HOA president (seems like just an honorary position, since the HOA management company does everything) has told us to keep putting complaints in.

    So last month, I sent an email asking for an update from the HOA, and included the video of me turning the water faucet on with no water coming out. I suggested in my email for the HOA to contact the water company (which I thought was Denver Water, but they don't service this far north) so they can check their main. I have still not received any response. I'm getting more and more frustrated because it sucks having a trickle of water to wash myself in, I don't know who even services our water, and due to the very hard water in our area, I'm sure our pipes and appliances (which we can't even use) are calcifying faster from the lack of pressure.

    I've been searching google trying to figure out who services our area, but most of the water companies near us don't have service maps. I plan on hunting for the water meter when I get home today to see if I can find out that way. Worst comes to worst, I can try calling them all to find out, but without the account, I'm not sure what I'll be able to do.

    Is there anything we can do to force the HOA to do their jobs? Or are we just going to be trapped with little to no water until we can finally move?

    Other info: The HOA is run by a management company. They have been useless since we moved in, and if the Denver area wasn't so expensive, we'd have moved the first year. I cannot wait to move out, but we're looking at at least two-three more years here unless we move out of state. And will will do everything in our power to not live in an HOA again.

    Also, our building is only 3 years old, but the first several townhomes were built around 20 years ago. There have been several builders, with the first several going bankrupt after a couple buildings, thus the large difference in age between buildings. (The last few were only finished this year.) According to a neighbor who has been there much longer, our building's foundation sat for years before they got back to work. The road was in place when we moved in (and in rough shape), so the water main was likely already in place for while. With the very hard water, I'd be surprised if the water main wasn't calcified, especially after sitting for years.

    Edit 1: I put in another complaint (with a little tugging on the heart strings action), and much to my surprise, I got a response within an hour. They are trying to gain access to the unit with the main water shut off valve to do... Something. They didn't elaborate.

    This is their response: "We are working with the unit owner in G for access. He had an emergency. We have asked for entrance early next week."

    So I'm waiting again. I'll be asking for an update again next week, including what a response said below about water getting sucked back in the wrong direction = health issue. If anything big happens, I'll be back to update.

    Gas company on recently bought property not paying/refusing to negotiate with me

The guy operating told me that they're not going to be paying rent/stay money as they made a previous arrangement with the previous owner of the land (who's deceased). Is there any legal option I can pursue in order to make them pay (if so what type of lawyer should I contact)?

    Monthly Health Insurance Opt Out Fee

    We live in Birmingham, Alabama. My wife just received an email from her HR about an increase in their "opt out fee" for not using the company health insurance. It was apparently about $50 a month and will be increasing to over $100 a month. She already uses their insurance, so it doesn't affect her, but I just thought it was incredibly shady. I've never even heard of an employer charging you a monthly fee if you don't use their insurance before. I question the legality of this practice and am just curious if they are legally allowed to do it.

    Sold vape pen to 18 year old; question and advice

    I had someone in my store this morning that I mistook for a regular; turns out she was 18. Her mom called and was pissed off, I gave her my name, offered to reimburse her, apologized, etc. She asked what would happen if she got the cops involved so I told her basically I could go to jail and lose my student aid. Practically begged for her not to do that, for that reason. She said she would talk to her husband about it and call back. If she decides to file a report, what would likely happen, meaning would the police really even go out of their way to investigate this? To my knowledge, the daughter would also be charged with possession of a nicotine product, is this correct? Should I go ahead and find a lawyer now? A part of me wants to think she is only trying to scare me, but how would something like this typically be handled, and what should I do now? MY location is in PEARLAND TX

    Purchased equipment in good faith and now I owe money to a landlord?

    I recently received a letter in the mail saying that my business owes several thousand dollars to a lien holder of some equipment I bought from another business several years ago. This is all in Michigan. The lien holder is the owner of the building which the other business preciously rented space (they were an LLC that has since gone out of business).

    I had no idea the equipment was a attached to a lien and spent $5000 on the equipment in good faith. Now the property owner is after me for the $5000 or demanding I return the equipment. I'm a small business and both of these options are potentially devastating for me. Is this allowed? How can someone take something from me I purchased in good faith years ago leaving me with nothing? Do I have any legal footing in this situation?

    California law regarding misleading advertisement of apartment rental rate

    Hello!

    I figure I am up poop creek without a paddle on this one- but,

    My girlfriend and I were checking out apartments when planning to move to Fresno, CA and eventually found one with a vacancy in our time, with a listed rent range on their website of $1,175 - $1,395 for the model we ended up applying for. It's already higher than what we were hoping for- but oh well. Used to more reasonable rates on the East Coast.

    (Note for later: My understanding was that when ranges were listed they tended to reflect the monthly price based on lease length. If you did a shorter lease (under a year) you typically paid somewhere on the higher end of the advertised range.)

    - There is an additional pet rent of $35. Expected. Not at all complaining here.

    - Also, an additional $55 of utilities (water, gas, sewer) not mentioned anywhere- but whatever that's fine too not a big deal that's sometimes also rolled up into a final price. It does only say "rent" for that range, so also not complaining here.

    This means we should expect to have a grand total of $1,265 on the low end to $1485 on the high end. We applied and were eventually approved. They sent us a document saying it's going to run $1,570 for rent + $35 + $55 for a total of $1660! $175 more a month on the max end for the rent than listed. The most expensive unit listed on the site is $1,200-$1,400.

    We questioned it and they said they "tell everyone" that it is this price (most assuredly after the fact) and you apply online, so they actively use their website- which means they most definitely know their website is misleading. As of now, the website still reflects the $1,175 - $1,395 range for "rent" so they don't seem to care about correcting the "error" either.

    This feels like a legit scam to get you to apply thinking you're getting a decent rate- and then get railroaded after already having sunk your application fee and time.

    We really don't have another option for renting unfortunately at this point. We basically have to go with this one for a year. We haven't signed the lease, but already paid the "hold deposit".

    - Is what they're doing legal?

    - Are they obligated to offer us a price within their advertised range?

    - If they are not obligated to rent for an advertised rate- if for whatever reason we were wanting to back out, could we have a case to demand the application fee back due to a major price discrepancy from what was advertised?

    Got denied a job because of my skin color.

    Hi. Ive been applying to jobs for a couple months now, and recently got called by a company i applied at. The lady on the phone told me that i had been denied the position because they were only accepting minorities at the moment. (My application specified i was white.)

    My question is, how is this legal? Doesn't this violate the Civil Rights Act of 1964? Shouldn't i be protected from things like this happening? What can I do from here? What do i stand to gain if I fight? Thanks.

    Do I need to exclude my mother from my will?

    Hi everyone, I posted here yesterday, and received advice that I need to make a will. I plan to, and in just researching it a bit now.

    One thing I've seen mentioned is stating that you are excluding someone. I want my boyfriend to get all of my stuff. In terms of blood relatives, my mother is abusive, dad is dead, I have 2 half siblings but we have not spoken in many years and I do not intend to reconcile with them, and I have no children.

    If my boyfriend is listed as the sole beneficiary, does my mom need to be directly excluded?

    CA riverside probate question

    In probate currently. I'm not the executor. Executor has stated that there is no money left in the account from $700k+ from the valuation of a business. We have a bond on that amount. Do I need to wait till probate closes to file a claim on the bond? What happens is the executor stops paying on the bond before probate closes?

    Upstairs apartment is used as a business rather than a residential apartment

    So shortly after moving to a "luxury" apartment complex (Los Angeles, CA), we found out that the apartment directly above us is used solely as a business. No one lives there; it's just used as a photography studio. When we toured the apartment, the property manager said that the people above us aren't home very often. We thought "oh cool, that's nice!" No mention at all of it actually being a business.

    About a week after we moved in, we started hearing a ton of furniture being moved around and dropped, things being rolled around, and lots of footsteps with shoes on. We thought maybe someone was moving in/out above us, but it continued for 3 or 4 days out of the week, every week. We went to talk to them, and they told us "this is a photography studio". We asked them to try to keep it down since we work from home, and we've complained to our property manager several times over the past 2 months, but we still just constantly hear tons of noise from above us. The people above us even told us that "we don't fucking care".

    Obviously, we're super pissed and frustrated at the situation. First off, if we had known a photography studio was above us, we wouldn't have moved in, because we know that that would involve moving equipment/furniture/etc all the time. Second, we decided to extend our budget for an apartment to get a nice place since our last place was super shitty and cheap, so the fact that we're spending SO MUCH to live in a noisy apartment is incredibly frustrating. We contacted the owner of the property to see if we can break our lease to move out, but we haven't heard anything back yet.

    I guess I'm wondering if there's anything else we can do since the building is very much supposed to be a residential only apartment complex? Or if we do end up breaking the lease, do we have any leverage against the situation? Thanks in advance!

    TL;DR - A business-only photography studio is in the apartment above ours, and they are super noisy & constantly move furniture and equipment around all week. The apartment complex is supposed to be a residential only building.

    SIL in coma after falling at work, job won't release footage.

    My SIL fell at work and went into cardiac arrest. She was without oxygen for an unknown amount of time. She has been in a coma for 6 days and we are without answers as to what happened.

    Our family took the police to her job (walmart) and they said we needed a court order for us to view the footage. What can we do? Is this legal?

    Roommate kicked down my door and trashed my room

    The landlord is kicking us out because it's a joint lease. My roommate wants to stay but I can't imagine he can. Can I withhold rent because he broke my thing?

    My Ex's Attorney is Suing me for court costs

    I'm going to try and condense this as much as possible. The state alerted me that my ex had started a new job and still owed child support, they offered to go after him on my behalf and I said yes because my son was going to college and we could use the funds. After a few paychecks and his tax return being seized he sued me arguing that we had a verbal agreement (we didn't) where if he left town I wouldn't come after him for child support. The case goes on for a few years with multiple extensions by his atty. We lose the case on a technicality about a deposition not being signed. My atty had 30 days to appeal, but waited 10 mos. We won the appeal, but then my ex's atty went to the appellate court and got the decision overturned on another technicality. I dropped the case, but now my ex's atty is coming after me for costs because of the late appeal. It looks like I'm going to lose this case too and get a lien on my home. Is there anything I can do? I don't think this is my fault, but rather my atty since they filed late and they caused me to lose the original case due to an error on my attys part. Please help. I'm in Illinois

    A lawyer might be suing me in Missouri over a borrowed book and is definitely demanding money.

    8 months ago I went on a date with a lawyer and during that date he let me borrow a book that we were discussing. We sort of faded and I thought it was mutual but he reached out four months ago and wanted another date. I mentioned I needed to find his book and return it and he tried to push for another date. He did this pretty aggressively over the last two months. I eventually told him I wasn't interested. He did not take this well. I found the book but it did sustain some water damage from a burst pipe in my very old apartment. I disclosed it to him immediately, mailed the damaged copy to his address and offered to pay for the cost of replacement. He first told me it wasn't necessary but now that I am asking him not to contact me about any more dates he is saying that the book is worth thousands of dollars and is basically irreplaceable because it was given to him by the man who wrote it. And it is signed. Why would he loan it to me? If I had known I would have declined. I didn't even want to borrow the book. I was being polite. I was basically a stranger. It was his grandfathers. Why give it to some woman you just met for temporary safe keeping? Do not let tipsy women you met at a bar borrow family heirlooms. The book is valued online new at $45. Sometimes $65.

    I asked for a number and he said he could let it go if we went on another date. He still asks for a date even now.

    Today I got a letter from him demanding the sum of $1600. I don't know enough about books to debate him. It may be the true value and I will pay if it he will leave me alone. I am worried I will pay it and it won't be the end of it though. He keeps mentioning how priceless it is. I feel awful about the damage. I want to pay it and be done with it. No more borrowing books from handsome lawyers met in bars. Lesson learned. I will just buy it on Amazon myself and we can circle back when I have given it a read.

    A few questions -

    Since the damage was done by a burst pipe might my renters cover it?

    I am assuming he would need to give me proof of the cost for that.

    Can he later come back and demand more after I pay this because it is an important family heirloom signed by a dead guy that his dead grandfather gifted to him when he graduated college because he was so proud of him? (I feel bad okay)

    Let's say I pay it and years pass and I run into him in a bar and we are smitten (no books- I learned) and fall in love and get married in Italy but he dies in a tragic cave diving accident and his family is suspicious on account the book thing and think this is all an elaborate plan I made to get my $1600 back. Would it be a good idea to get a lawyer now and ask about drafting a letter saying here is your money, I agree this is fair, now leave me alone and never speak to me again but in lawyerese.

    Should I ask for a receipt?

    Driveway and garage on neighbors lot

    We just listed our house today and our neighbor called our realtor and told her our driveway and garage are on her lot. Our neighbor said 8 feet. We have reached out to the surveyor to see the official survey.

    Apparently our neighbor had the survey done this year and found out about this issue.

    We live in MN. Bought the house in 2016 (we were never told the about the issue).

    Our house had been here since 1954. I'd imagine our neighbors is the same.

    Winning a custody battle for my niece?

    (USA, issues started back in June when I visited my niece and nephew in Florida)

    Is there a way to win a custody battle for an 8-year-old niece in a different state?

    Some background: I was told that being on drugs (hardcore drugs like crack or cocaine) along with a long history of DIUs, multiple open-cases, and being taken to prison multiple times isn't enough to show that someone is unfit to have their children taken away again. Unless the drugs and such physically show evidence of it affecting the children's performance. I live in a different state and am awaiting the results of an open case, but was told basically there's nothing else I can do but support my sister (41F) to do her best...

    I think given the way these children are being raised they are doomed to repeat the same things my nephew (whose in prison) are going to make and I really don't want that to happen... can I win custody somehow of at least my youngest niece? Some of her kids have been placed under the custody of their fathers or grandmas.

    I don't know if this is enough information or if I should talk more about my financial situation as an aunt in another state? My niece has such a bright future ahead if someone can help her in school and give her the time she needs to succeed or even a different scenery where she has the opportunity to grow.

    tldr; I (northern state) love my sister (southern state), objectively not a very good mom tho, Im hoping to make a difference with this child...

    Advice on getting a subpoena NYS

    So, the other day at my work, my parked car was a victim of a hit and run (driver hit vehicle then moved to another parking spot)

    I mentioned the damage to a security guard and he took my information down to investigate. A few hours later in the day I decided to talk to the head of security in regards to this. She could not give me a yes or no answer that it did happen on camera but said HR will contact me (that gave me the assumption that they did find something)

    I finally received an email the next say mentioning that I should let my insurance know what happened as well as getting a subpoena. She did mention they will fully comply with said subpoena. I also made a police report.

    Now my next step is getting a subpoena. I have absolutely no knowledge of how to find out about going through with this the cheapest route possible in NYS?

    Do I need a lawyer for something like this which will end up costing me significantly more than my deductible. I have tried googling about this but again with no knowledge I have no idea what I'm even looking for. Thanks you for any help!

    Future College Fellowship Abruptly Revoked

    Hey there you wonderful people, hope this message all finds you well.

    I'm a musician who just recently got her degree in performance at a University and decided to immediately move from my undergraduate program into a graduate program in Oklahoma at another school. I was given offers from several different universities, but in the end I chose one particular school ultimately because of full tuition waiver, generous monthly stipend, and health benefits as well as a wealth of opportunities with a local major performing group of musicians.

    I made this choice and signed my contracts, intent of attendance, and lease all to prepare for this wonderful opportunity. As of this morning, with little over a month until classes started, I was informed by someone at the school that the major performance group that I was slated to perform with and receiving the endowment from this fellowship program abruptly decided to reject the contract offer that everyone in the music school fully expected them to sign -- effectively terminating the fellowship. I was told that they would never have offered me this fellowship if there was even a thought that this group would have done that, and now my entire financial future, including where my medicine and housing are going to come from are in a state of peril.

    I really want to avoid legal action, and am still working to get information and try to renegotiate with the group, but do I potentially have a suit here should push come to shove? The legal team of the school in question told the person informing me of the news that they were not legally binded to the contract that I signed. I have reviewed these contracts, and from what I've looked at I don't see anything that indicated that they could pull out at the last minute like this, but also admittedly am way out of my depth here.

    PLEASE HELP! T-Boned Auto Collision with Liability Insurance. Legal Advice Needed.

    I was involved in an auto collision when a vehicle T-boned my vehicle as I was driving to work. The other party was clearly at fault. Their insurance has accepted responsibility and declared my vehicle as a total loss (inoperable, damage to passenger-side outer body and sub-frame, airbags deployed). Both parties have liability only insurance. My reasoning for liability only is that I drive only 7 miles one way to work 5 days per week at odd hours of the day with minimal traffic. The problem is their insurance limit for property damage is $10,000 and my vehicle is worth >$20,000 current market value. The settlement offered to me by their claims adjuster is for $10,000 signed release and to retake possession of the totaled vehicle with salvage title. I refused and asked if they were able to sell/auction my totaled vehicle to add another $10,000 on top of the $10,000 settlement for a total of $20,000 at which I would be willing to settle for. They replied that normally that is what they would do however due to the insured's policy and limits they would not be able to do so in this case.

    After seeking legal advice, I understand these are my options moving forward:

    1. Accept the $10k and sell/auction the whole vehicle or part it out myself (investing time and work) and be done with it
    2. Don't accept the $10k (because they won't give it to me without a signed release) and sue the insured for the whole amount. If I win my case, I get the $10k settlement from their insurance for property damage and a judgement against the insured for the rest. If I lose, I get nothing.

    I will not have legal representation and I will need to represent myself. The questions I have are the following:

    1. If I decide to sue the insured would I need to sue for the WHOLE amount (this case for >$20,000)? I am attempting to avoid litigation in civil superior court (any cases worth >$10,000) since I have read that it is a slower, more tedious, and expensive process than small claims and less forgiving for those legally-challenged like myself hence hiring a lawyer is recommended.
    2. If I decide to sue the insured would it be possible to do so for $10,000 in small claims court (maximum allowed in California), collect on that judgment, and then sign the release from their property damage settlement for the remaining $10,000? This is a total of $20,000 at which I would be willing to settle for. Reason for keeping litigation in small claims court is that it is easier, quicker, and less hassle because I need to represent myself.
