    My mom's best friend is a licensed nurse practitioner. She absolutely hates me and I hate her. Always have.

    When my mom went in to the hospital after a heart attack, she went to the nurses and told them she's a nurse practitioner and my mom's power of attorney. She provided no paperwork. The nurses did not follow up, and for almost a month, I wasn't being called, followed up with, etc. concerning my mother's care. When I confronted the care staff in a called meeting about her care, the head nurse let me know they'd been calling her power of attorney. When I told her there was no POA and I'm her only child, they went back to her file and realized they don't have a signed POA, it was all word of mouth.

    I'm aware of the HIPAA violations here. I'm getting an attorney.

    My mom died yesterday in the hospital and without a will. Again, I'm an only child. This woman also has a key to my mom's house, has my mom's phone, and is refusing to give both back. I'm going to do the rational stuff like turn off the phone and change the locks, but would this all warrant a restraining order? I'm afraid she is going to clear out my mom's house before I can get the locks changed (my brain is going 100 MPH right now and I'm a wreck) or fight me over stuff and make another claim that my mother left her something or that she's her executrix.

    What recourse do I have here? I want her out of my life. What kind of trouble is the hospital in?

    (Florida) Recently fired due to discussing wages with another coworker. Employer shows me relevant, but illegal policy in employee handbook. I inform him I'm federally protected to discuss such a topic. Writes me up and fires me anyway.

    This just happened to me on Thursday and it was within my first 90 days of being there. I have been written up before for something neither serious nor pertaining to this, but a write-up nonetheless.

    Earlier this week I happened to overhear this coworker (we'll call her Susan) talking to a new hire about work-related topics and Susan mentioned her pay of $xx/hr. I chimed in and asked, "you only make $xx?". She asks me what I make I say $xx which turns out to actually be a dollar more despite being employed a month after her and being asked in my interview what pay I want. Nevertheless, another coworker asks what we're talking about, Susan tells him. That night during Susan's shift (I had already left), she explains this to the employer who is audibly irritated by this, and proceeds to say that he does not want us talking about wages and that we could be fired over this. He also claims that he was unaware that she was making a dollar-an-hour less than I was. So, logically, Susan goes home and checks the employee handbook to confirm that discussion of wages and tips is prohibited at work, as the NLR Act of 1935 has made this illegal.

    Fast-forward to Thursday after the end of my shift and I am called up to my employer's office and informed that another coworker has complained to them about me and my wage discussion with Susan. He presents the employee handbook to me with the highlighted portion of the illegal wage-discussion policy. He tells me that this is my second write-up within 90 days and that we're just going to have to part ways. I respond by telling him I am federally within my rights to discuss wages. He seems to not care by responding with "and we're within our rights to let you go within your first 90 days of your employment here."

    The next day (yesterday), I contact HR to request a copy of my write-up which I was never shown or signed by the way, only to be told that there was never a write-up and that I was simply let go because I was not a good fit. I have since typed verbatim the conversation that occurred between myself and my employer and filed a case with the NLRB.

    My reason for this post is if there is anything else be it evidence or steps I can do to bolster my case if I, in fact, do not have a write-up as HR is claiming? Surely there will be something inputted into my employee personnel file regarding conduct and/or history? HR made it quite clear that the 90 days is my probationary period to determine my suitability with the company and that I was fired because I did not meet this requirement.

    The only evidence I have is Susan to back me up, the policy in the handbook, emails from HR, and my typed word-for-word account of my discussion with my employer because, as I understand it, recordings must have two-party consent in FL. But I feel that with this employer's status and money, they will find some loophole to circumvent this blatantly illegal practice.

    UPDATE: Susan has informed me that no action has been taken against her. She was neither written up nor fired.

    (PA US) Due to an automated camera, my dad got a speeding ticket in the mail for a car that’s neither his or mine. We don’t live in the city where this took place.

    The Philadelphia parking authority/Philly police sent my dad a speeding ticket for a car that isn't his. It was from a photo of an automated camera in the city of Philadelphia. From the looks of it the officer misread the license plate on the vehicle in question, pulled up my dad and sent it to him on accident but we have real consequences from it.

    The ticket is only $100, and were I in a better financial position I would just pay it, however in this instance I really do not feel like paying for another persons mistake.

    Unfortunately the ticket gives us two options, either pay it or show up to court to dispute it, which is where the second problem comes in, we don't live in Philly. In fact we live about 2 hours north of Philly and in time and gas costs it would be just as if not more expensive to dispute this.

    Is there any way we can get out of this without having to drive down in person?

    I can't remember an accident and my insurance thinks I lied

    A few weeks ago in Seattle Washington I recieved a call from a fishy sounding person saying I was in an accident with their client the day before. I ignored the call thinking it was a scam. The next day MY insurance provider contacted me asking about the accident that occurred. To this day I still can't recall anything happening.

    So I told them I wasn't aware of any accident. I went and looked at my car and I couldn't find any evidence of a crash. My car has a bra on the front and nothing looked wrong where they said the collision happened. So I took a bunch of photos and sent it to them. At the time I believed someone was trying to insurance scam me.

    A week later I received a call from a special investigator saying they have front and rear dash cam video of me bumping the car with audio that had a loud "thud". I still haven't seen the video but they played the audio over the phone and it did sound significant.

    They asked for an official statement and I told them the truth. I still didn't remember bumping anyone.

    I got another call a few days ago with another special investigator telling me that I misrepresented the facts and am probably going to be dropped as a customer.

    I am a disabled vet and do have quite a few medical issues which include ptsd, migraines, and a more recent thyroid problem. But so far nothing that explains a giant hole in my memory.

    Since this incident I looked more closely at my car and there are a few small streeks on the front left of the car bumper which have a bra on it.

    It scared me enough to search symptoms and I have scheduled a doctor's appointment to discuss a diabetes test because that seems like the most possible explanation as to why I have been feeling the way I have been. I am currently terrified for my health and my legal standing.

    My question is what can I do to appeal to them? What kind of legal and financial consequences am I looking at?

    Landlord forcing my cats to wear diapers

    I'm about to move into a new apartment in Illinois. This new landlord let me know about a week ago that I'm going to have to diaper my cats even though they don't have any issues with using a litter box. I've searched the internet, and I have no idea if it's legal or enforceable. My main concern is that my older cat is 18, and I don't want to cause her any more stress or discomfort because of her age.

    So I decided I was done with my boss mistreatment of me and gave her my key to the building and left. I had already told her a week before I was getting tired of how she treats people.     Client wont pay me for interstate move, chapter 11 bankruptcy.

    I own a moving company. I recently moved a doctor I got a lead through Angi's List from Louisiana to North Carolina. There was no contract but we agreed upon a flat rate of $5500 for the move. I paid for the truck, fuel, supplies and helper out of my own funds and completed the job for him over three days, no damages, super successful job. The doctor hands me a check, signs a receipt on carbon paper receipt book, wishes me well, and I fly back home. As I touch down I notice a text from him saying "please dont cash the check tomorrow my paycheck hasnt cleared yet. Thank you for the move you guys did great... etc". The job was completed the 24th of june and every day since then (a little over a week today) Ive asked if the check was good to be cashed, turns out the doctor is going through chapter 11 bankruptcy and he cannot pay. I went to his bank to ask if he had sufficient funds and they said no. He knew the price for over a month before the move began.

    I have text proof of him intending to pay, him thanking us for a job complete, penske truck receipts for pick up in louisiana and drop off in north carolina, plane receipts, photos of the pack, photos of the trip date stamped, carbon receipt with doctors signature and memo, the DIP check etc. just no official contract.

    Am I SOL due to the chapter 11 bankruptcy filing he had before enlisting my services even if he never told me? Should I do small claims in North Carolina? Louisiana small claims limit is $5000 as far as I know.

    If I’m being hit with a clear retaliatory and frivolous lawsuit, could I hold the other party responsible for my lawyer fees

    I was assaulted and attempted to be robbed awhile back, the defender in this case is trying to flip the tables and filed a complaint with the court, saying I assaulted him. Which I have evidence that shows the opposite. The officer who took the report and the witness advocate agree that this pure retaliatory, and he is likely just trying to intimidate me into not working with the district attorneys. and the officer agreed to be a witness on my behalf, but told me to lawyer up and most likely this case won't even get to a hearing. I shouldn't have to be stuck with a Bill because this asshole doesn't want to accept responsibility and is trying to intimidate me into not testifying. Do I need a lawyer? I'm in Massachusetts btw

    Storage Company Messed Up Auctioned Off My Unit

    I just received a call today from a company informing me they had a check for excess auction proceeds of my storage unit. They said they had bought the facility last year and had not received payments, so they auctioned it off.

    I had not received any notice of the sale, missing payments nor the auction. They had an old address from my previous home three years ago. I had continued to make payments each month to the previous company, which have been cashing the checks each month. My name, current address and storage unit number were on the checks.

    Who is at fault here and what can I do about getting compensated? This is in the state of Minnesota, if that matters.

    Being forced to pay a move in fee for an apartment we already live in.

    IN: We renewed our lease on an apartment, but the management has changed since. The new management has charged us for a new security deposit and a move in fee of over $500. We spoke to them about getting rid of the security deposit charge, but they have left the move in fee. Are we legally required to pay a move in fee for a place we already live in?

    The new management also shut off the hallway lights. It's harmless besides being a danger to drunk people at night since the stairwell is also not lit, maybe I'm just looking for something to be mad about.

    Do I have grounds for suit against my realtor?

    When presenting me with a buyer's offer to purchase my home, my real estate agent in Illinois very clearly represented that the buyer made an "as is" offer. I accepted the offer largely due to this. I was later surprised by a list of costly repairs and was stunned to learn that the offer wasn't truly as is and that I would need to pay for the repairs or risk the sale. Do I have legal recourse against the realtor?

    Dog bite laws

    I'm in Texas, I'm aware the laws on it vary by state.

    Last night my brothers dog attacked me for the second time. The first time was a lot worse but it's still bad. Last time I had to fill out some paperwork at urgent care for animal control, or else they couldn't treat me. They showed up and he got a ticket and had to quarantine the dog for 2 weeks. I'm worried I need to go to the doctor for antibiotics again, but idk how the laws are with a second bite. If he's reported again he would the state seize the dog and put him down? I feel like the dog should be put down (he's attacked other people but I'm the only one that was bad enough for medical treatment), but I don't want to take that choice away from my brother either.

    (Delaware, US) Private company arranged stock sale to 3rd party, then threatened to block it unless I sell to company for a small fraction

    I own shares in a private company and tried to sell them. I found a buyer but the company arranged with another buyer that they preferred instead.

    We got to the point where the company drafted the stock transfer documents, myself and the buyer agreed to them, but before these were signed the company told me the board would block the sale unless I sold it to them instead for a small fraction (less than a third) of the original sale value.

    The company tells me they can block the sale due to the company bylaws, but these were never provided to me in the initial stock grant documents and so far have not been provided after I asked for them. The company is in Delaware, US, and I am a EU citizen living in the EU.

    Is any of this illegal, and if I should seek legal counsel should I do it in the US or the EU?

    Property management company screwing up my rental and unsure how to proceed

    I've owned a 9 bedroom rental house (in Washington) for 7 years, that I self managed for the first four and have had a property management company run for the past 3. The house is rented out on a per room basis (typically college students and young professionals), although the three bedroom basement does have its own second kitchen. Rooms are very easy to fill, and I never had any tenant issues or long vacancies when I managed the place.

    On the other hand, the management company has performed far worse, and I honestly should have fired them a while ago. The assigned manager has poor communication with me and the tenants, and shows a total lack of effort in addressing maintenance requests and finding new tenants. She's done things like lie about having a listing live (we were unable to find it on any website and she put it up after being called out), shown the house without giving tenants notice, and had her father perform maintenance without disclosing a potential conflict of interest.

    The final straw is that she's taken 6 months to fill a few rooms (without clearly communicating this), and has recently notified us that she's moved a mom and two teeangers (12 and 16) into the house to rent three bedrooms. We have reason to believe she knows this family (thanks to facebook investigation), and suspect they didn't receive the same level of due diligence as other tenants. I just got the credit report, and it's terrible with a score of 570 and 3 open collections. This situation is also a serious outlier, as all other tenants have been students or young working professionals, yet we weren't notified until after the family had already moved in.

    The other complication is that the family is spread out in the house, where they have two bedrooms in the basement and one on the main floor. This means that there are teenage girls cohabitating with a bunch of young people who they do not know. This just feels so weird to me and just feels like a terrible idea, and everyone else in the house feels very uncomfortable about it. Of course, none of the other tenants were really kept in the loop, as the family was shown the rooms without tenant notice, and then they just moved in a couple weeks later to everyone's surprise.

    How the heck do I proceed? I'm furious about this situation and would have turned it down immediately if they notified me ahead of time, but it's unclear if the management company has legally done anything wrong. They want to fix it by making the one person in the basement swap rooms to the main floor so the family is all in the basement, but I'm unhappy with this as it screws over this tenant to fix their mistake. The room he'd have to switch to on the main floor is literally 1/3 the size! I'm really worried about tenant turnover now, as everyone in the house is pissed off about this situation.

    I spoke with the owner of the management company, and he was semi sympathetic, but basically pushed back on everything saying they're within the law and what not. The fact is though they've been doing a terrible job, and this last incident is just the straw that broke the camel's back. I'm planning to talk to a lawyer ASAP, but figured I'd see if any fine redditors have advice.

    Landlord gave keys to my apartment to future tenant 3 weeks prior to move in (MD)

    I informed my landlord at the end of March of my intention to move out at the end of the current lease (6/30/2021). He found a new tenant and asked numerous times if I could move out before the end of the lease. I finally agreed to move out Sunday 6/27. There was a bit of argument over when the inspection would take place as he wasn't available Sunday and wasn't willing to do Monday, Tuesday or Wednesday evening. He said he would need to do it Monday between 11am and 1pm. I work during the day and would have moved by then so I wouldn't be able to do that time. He stated to leave the keys on the kitchen counter when I leave on Sunday. I cleaned and left Sunday evening.

    Monday comes around and the new tenant texts me about stuff like trash pick up, parking tips, cable set up, etc. she said she moved in at 1pm. I ask if she did the walkthrough with the landlord and she said she hadn't met him yet and the landlord mailed her the keys 3 weeks ago. So for the passed 3 weeks she has had full access to my apartment. Is it legal for him to have sent the keys to her so far in advance? I feel he put me and my property at risk by giving access to my apartment to someone I do not know and is not on the current lease.

    From what I gather, he didn't do an inspection prior to the new tenant moving. I left at 10pm on Sunday and she moved in Monday at 1pm so only 15 hours between tenants. I still haven't received my security deposit back so I'll be following up on that

    I'm shocked he gave the keys to another person while I was still leasing the place. Is that normal or would providing keys 3 weeks in advance be within the law?

    Bought a computer from a major retailer, it came with the wrong graphics card and everyone is saying tough. [US - CA]

    I bought a prebuilt gaming computer from a big retailer (think Walmart or Bestbuy). The computer itself was made by one of the big computer manufacturers (think Cyberpower or Ibuypower). The computer was spec'd as coming with an RTX 3060 graphics card. When I turned it on the drivers said it was an RTX 2060. The 2060 is the previous generation version of the 3060 - because of thats its a $300 - $400 card while the 3060 is a >$1000 card if you can even find one. Thats at least a $600 difference in price.

    All of the other components were correct as far as I can tell.

    I immediately took it back to the store to return it but the manager said that because of the graphics card shortage they've had a lot of people replacing the cards in the systems and returning them so they don't accept returns or exhanges anymore. There is nothing about this posted anywhere in the store. The manager suggested I call the company that made the computer but was insistent that the store would not help me.

    I called that company, they basically said its the store's problem and I have to deal with them and hung up on me.

    I called my bank to do a chargeback. The person I talked to didn't understand that a computer with an RTX 2060 is not "substantially the same" as the same computer with an RTX 3060. I explained it to them and told them to file the chargeback anyway. A week later that was rejected because they say the two computers are "substantially the same."

    Is there anyone I can file a complaint with about this and can I sue? If yes, who do I sue and what do I allege? Fraud or something else?

    Roommate broke our lease and took the tv that we had both paid for. What can I do?

    I am from Lenexa Kansas

    I moved out to my first apartment at the beginning of June with one of my good friends from school. After only 3 weeks he decided he didn't want to live on his own and wanted to move back in with his parents. This was really shocking to me but after I had found someone to replace him on the lease I was just waiting for him to move out.

    When we moved in we had split the purchase on a few items that we had discussed would just be split up after the lease was over and we moved out, which I thought would be in 12 months not 1.

    We had split the cost of kitchen knives, cutlery, pots and pans, and of course the big tv for the living room.

    Yesterday he moved out while I was at work and when I got back I found he had taken the tv that we had both paid for. I politely asked him to pay me back for my half of the tv but he refused and was unwilling to cooperate with me.

    If he is unwilling to pay me back my portion of the tv what is my next step? Do I file a police report for a stolen item, go to small claims court, or is there nothing more to do since we had split the purchase.

    Any advice would be greatly appreciated. I just want all this mess to be over with so I can stop being so stressed out and angry.

    IL: I was the victim of a DUI hit & run, & the defendant was arrested for both charges. I received a letter from Kane County State’s Attorney asking about my losses. Can someone help explain what these could potentially be?

    The States Attorney letter stated I can have the court require the defendant to pay back my losses/out of pocket charges. I am not sure what this may entail & would hope for some information as to what I can expect to be relevant 'losses/charges' to this event.

    Thankfully no physical harm was done to my person or anyone & the vehicles took the brunt of the damage.

    I went with my insurance agent to survey the damage to my car & it is totaled out.

    This has been a huge burden since my insurance only covered 3 days of a rental, & I need one for several more days as I have not purchased a new vehicle yet.

    I will not have contact back from my adjuster until the 11th apparently as he is on vacation, & now I am very unsure of what comes next for me until I find a car, as well as what to inform the SA about my losses. I will of course have to provide bills/statements for reimbursement, but do not know what qualifies reimbursement to me?

    I wish he could buy my new car I loved my old VW, but oh well I am trying to take it in stride to make this a positive(almost fatal) change.

    Proxy Executor?

    My estranged father has terminal cancer and has named my estranged sister and I beneficiaries. He named me as executor, since sis can't be trusted. I don't believe a secondary was named.

    There is a history of trauma and interacting with my sister or going to his house (Connecticut) are very triggering for me.

    Is it possible for a lawyer or other qualified individual to perform probate duties on my behalf?

    TX - Landlord charging us for repairs which have not been performed

    Hello,

    We placed our 60 day notice to our apartment in line with the lease terms and the following week, maintenance came to do an inspection. After the inspection, several hundred dollars were charged to our autopay on rent. I requested the inspection report and it said that repairs were needed and scheduled to be done a week later. They never came and did the repairs. In fact, at the time of the inspection he told me there was holes in the walls (no major actual holes, he was referring to the fact that we had hung a couple paintings up and the holes from the screws needed repair) that needed to be patched and the carpet needed to be cleaned so we did that the week we moved out.

    Furthermore, the landlord damaged our property (patio furniture) and verbally promised to repair or reimburse for replacement but never has done so.

    They are witholding the money from us and refusing to refund the charges. Is there anything we can do? Is this even legal?

    My landlord is selling the house

    I'm in Texas. My lease is up Aug 31. She is putting the house on the market next week with a lock box. I had planned on renewing and now I have to scramble to find a place in this terrible market. While I'm pregnant. She wants me and my husband to sign something saying she's not reponsible for anything stolen and to secure it. But we still have a few weeks here. She also wants us to clean and make it view ready. We already paid rent for July and will have to for august. I don't understand why she can't wait until we move and why do we have to make our house available for others when we are still paying money to her. We pay the lights she will use to show people around. What are my rights.

    My good friend’s mom is threatening to file a court order to seek custody of his first-born all because she’s been sent to her room for the day after getting deliberately ruining her little sister’s birthday cake. Can anything actually come of this?

    To provide context: his mom lives halfway across the country and has criticized the raising of his daughter from afar for quite some time. This appeared to be the last straw as she is incensed, and threatened to seek a court order to either remove her granddaughter from the house or seek pure custody for herself (all of this while halfway across the country). Mind you there is no abuse whatsoever, the grandmother in question is hardly ever in the home environment in question and, to be frank, hardly knows her granddaughter. I laughed quite hard at the audacity of this, but did want to know, could anything actually come of this? This is occurring in New Jersey

    Dad is deceased and his girlfriend won't leave his house.

    Hello, my father passed away a few months ago and his Girlfriend will not leave the property and changed the locks on me. I am the Administrator of the Estate and she has caused me nothing but problems during this process. I do still have a way into the house that she does not know about. I gave her plenty of time to leave the property with a date and time. What options do I have here? She is also trying to contest the estate. I want her out of the house so she is out of my life. My plan is to change the locks on the house while she is working or out somewhere so she no longer has access. Does this sound like a solid plan?
