    PA: Long story short before we moved our neighbors said they were interested in buying our house as a rental investment (townhouse we share a wall).

    We offered them a "friends price" and moved away during closing. Neighbors were good people, one working at the state capital & the girl a senior engineer.

    5 months of delays & it seems they're having issues securing financing. We've lost nearly 6k in mortgage payments & bills... and the place is now worth 10% more in a hot market.

    We decide to finally list with a Realtor. Tons of interest right from the start but the neighbors blast heavy metal (even at 8am) every time there's a showing. It's deliberate since it only starts when the agent opens the door & loud enough to shake the walls.

    Needless to says it freaks the hell out of potential buyers to the point of complaints and some agents refusing to show it.

    What can we do?

    Is it legal for a business to ask you to stay without compensating the wait?

    My sister (19) works at a fast food restaurant. During her shift, there was a leak and flood in the piping system and they had to shut down to get it fixed. Her manager said they had to wait for it to be fixed and couldn't go home. He wasn't allowing them to stay clocked in though. I didn't find out until right now that I picked her up. I told her that sounds highly illegal as she was waiting for a good 3 hours. She said he was told by corporate it was perfectly legal and they weren't going to compensate those hours.

    Is there something she could do?

    Neighbor is claiming they have an easement through my uncle's property.

    Hello. I was hoping that someone may be able to advise me on easement laws in Ohio.

    My great uncle has owned his property in Ohio for nearly 40 years. It was purchased from another family member.

    Recently the family who owns the large wooded property behind my Uncle's house have been approaching him saying that they have a 50 feet wide easement through his property. My uncle is very upset about this. These people have been very rude to both him and his wife. The part of his property they are claiming to be entitled to, has a large garden, well and other buildings on it.

    I've not been able to find any detail about such an easement on the deed. It just says "the tract as surveys contains X acres, more or less, and is subject to all legal highways and easements of record."

    -Where can I find these "easements of record"?

    -Also, 50 feet wide also seems oversized for an easement. I always thought easements were the width of a vehicle with a couple feet on each side???

    -The family claiming to have an easement did not own that land when my uncle purchased his property. Their property is also not landlocked, as part of it runs along the road.

    -The family member my uncle purchased the property from has no recollection of an easement.

    -My uncle had a survey done when he purchased the property. There is no easement described on the survey.

    I've already advised my uncle to find a real estate attorney. He's elderly and I'm trying to help him solve this problem. Any advice is greatly appreciated.

    [Update] In the process of refinancing, we found a judgment for ‘violent crimes’ against the house but we have no idea what this is for, never received notification, or what to do. NJ

    So thanks to everyone for replies. Decent update if anyone is interested.

    TL;DR Lender didn't explain the situation so there was no issue other than clarifying we weren't criminals.

    So we weren't exactly informed of the whole situation. There was no judgment or lien at all. In fact, the house is clear as we would have expected. The issue wasn't even the house but that the title company did a search on my girlfriend for any arrests and judgments against her. She has none as mentioned before but she does have a very common name. Well, the title company pulls court records for any name that is remotely close and provides that to the lender. We called someone else at the lender to assist since we weren't exactly trusting our contact at the moment and they seemed to have contacted the right person at the title company to provide us a copy of the information we requested. We looked through it and none it it had anything to do with my girlfriend at all. Most of the names weren't even spelled exactly the same. Some weren't really that close. So we called the title agency and said none of it applied and they said 'ok'. That was all they needed. Verification that it was wrong. In fact they said it happens frequently since they don't have SNN or birthdates to verify. Just the borrower name. We just have to sign one extra document at closing that says the search results have nothing to do with my girlfriend and that everything would be fine.

    So no issue really at all other than the lender just not explaining the situation or addressing the question being asked. Had they done so, there wouldn't have been any concern or issues.

    My ex-husband is racking up tickets in my name.

    We had a lovely marriage until I caught on to his lies and extra-curricular activities. Once I saw him for who he truly is, I left him 10/2017. Luckily, there are no children between us.

    He kept the car we shared, and in 3/2018, I moved to Washington state to get away from him. He already lost me, then he was put on an involuntary sabbatical from his job a week or two later until his contract expired. He had nothing to lose so he followed me to Washington, and lived in an apartment two blocks from mine.

    The license plates expired 12/2017 (after separation), and to this day he has not renewed the registration in our old state or re-registered the car in WA. Our divorce was final almost two years later (11/2019), and I signed the title over to him the day our divorce was final. By that time, unbeknownst to me, he racked up 12 parking tickets in the car that was still jointly in our names. Since I am the first named owner, I assume I am the first party responsible for anything that happens with it. I'm afraid I won't be able to renew the registration of my own car due to his tickets because they were all received after our separation but before our divorce. In addition, the parking tickets are all within two blocks of my apartment, so it'll look like I was still owner and had easy access to it.

    Here are my questions:

    1) Do I have any recourse to require my ex to pay these tickets or get them out of my name? 2) This car is now 4.5 years overdue for registration. How can I force him to register the car out of my name? 3) How do I find out if there is anything else out there with him and this car that might affect me?

    Won 45k in online gambling, company locked my account

    Hi,

    So I ended up getting extremely lucky on what seems like a well known online casino (versus extremely no name ones) based out of Curacao and won $45,000 in blackjack. I attempted to withdraw the weekly max of $2,000 and emailed customer service to let them know of my attempt. No responses after following up a few times.

    I then contacted their customer service team, which ostensibly is based out of India and operates multiple online casinos, as the representative asked me what website I was using, in addition to my username. She put me on hold for a couple minutes and let me know I had a "negative mark" on my account and cannot withdraw money, which is obviously bullshit. After some back and forth, she hung up on me. I attempted to call them back and they blocked my number. My account online is also blocked.

    I have screenshots of my $45,000 winnings at the blackjack table, screenshots of the withdraw attempts, and even a short video I took showing my winnings.

    I understand the online casino industry is shady to the core. What would you guys recommend for how I should deal with this situation? I am more than ready to appoint a lawyer (even one located in the country of of their "headquarters" - Curacao) as this is a lot of money.

    Narcissistic mother fraudulently changed my name

    tl/dr: Mother fraudulently changed my birth surname to her new husband's surname and neither one are my dad.

    This is a complicated story that has bewildered two attorneys. I am looking for advice on how to sort this mess out. This happened in Utah.

    My mother was married to Mr. B and had my older sister. She then had me. My birth certificate lists Mr. B as my father. They divorced and I do not know if it took place before or after me. My mom then married Mr. H and had my two younger sisters. When I started kindergarten, my mom changed my name and registered me as Ms. H to be like my sisters. She also changed my older sister's name to Ms. H. I went throughout life as Ms. H and do not remember a time when I was Ms. B.

    I grew up in the Mormon church and my name was listed as Ms. B on the church records, not Ms. H. I hated this. Everyone knew me as Ms. H because that is what I was at school and it was so confusing to have everything say Ms. B. When I pressed the church about it, they told me that my name was never legally changed to Ms. H and they were unwilling to change the church records. I confronted my mother who told me that when she registered me for school she wrote Ms. H on all the paperwork. She showed them my birth certificate but they only paid attention to the birth date to be sure I was 5 years old. This was back before the rules for identification weren't as stringent as they are today. From then on I was known as Ms. H.

    To add even more to the confusion, when I was 12 years old my mother told my older sister and I that we did not have the same father. My sister's father is Mr. B but my father is actually Mr. C. So now you take all the hurt and teasing from being called 2 separate last names and add a different father in the mix. I was upset and felt very rejected.

    When I was 16 years old I got a drivers license with the name Ms. H. I took my learners permit which had the name Ms. H (it was issued by my high school), my birth certificate with the name Ms. B, and my social security card which said Ms. H to the DMV and got a license. I do not know how my mom was able to get my social security card changed to Ms. H if, and in her own admission, my name was never legally changed. I also suspect it was never legally changed because I'm sure it was embarrassing for my mom that my older sister and I had different last names on church records. If she could have changed that, I believe she would have done it in a heartbeat to save face. I have been estranged from my mom for over 3 years so asking her for any additional information won't happen.

    At 19 years old, I used my drivers license and got a marriage license. I then married my husband and took his last name. I was now Mrs. X. I have gone by that name for 30 years now.

    Since that time, Mr. X and I have moved states frequently. He is in the military and with each move I have needed a new drivers license. This has been insanely difficult because I cannot prove with legal documentation how I went from Ms. B, to Ms. H, to Mrs. X. The last time I got a drivers license I was able to get it with my passport instead of using my birth certificate. Since all documentation had the same last name (Mrs. X), I was able to get a license. My passport has since expired and we moved to a new state. I could not get a REAL license the other day at the DMV because, again, I cannot prove how I went from Ms. B to Ms. H to Mrs. X. I am so tired of this haunting me since I was 5 years old.

    I found my biological father at 21 years old and about 10 years ago we did a DNA test. I wanted the peace of mind because my mother is a notorious liar and I did not trust that even he was my father. She has been married 6 times and that does not include the relationship with my biological father. There have been a lot of "fathers" in my life. The test showed that Mr. C is my biological father.

    I would like to correct my birth certificate to replace Mr. B's name with Mr. C. However, I also need some type of documentation saying that my name never should have been Ms. H so that I can get my children's birth certificates and my marriage license updated to show that I should actually have been Ms. C.

    I have contacted two separate attorneys about this in the last 4 weeks and both times I have been told that they need to do some research and then never called me back. My biological father suggested adult adoption but I really don't want to go that route. Plus, it would still be the same issue but now trying to prove how I went from Ms. C to Ms. H to Mrs. X. I am trying to put all the fraud and lies of my mother behind me and set the record straight. I shouldn't need to be adopted by my very own father. Is it really that difficult to correct my birth certificate and have a court order showing that my name never should have been Ms. H? Is this something I could do on my own since I can't seem to get an attorney interested in my case?

    I’m a subcontractor that got screwed for 10k in Texas. How do I get my money?

    I was hired by a contractor to complete a mold remediation job on a home. The contractor is going to be completing the rebuild. The contractor says that the home owner is refusing to pay the remaining balance for my services. The contractor collected half of the balance from the homeowner and paid me the day I started the job. I completed the job last week, and the contractor says that the homeowner is ignoring him, and will not return his phone calls.

    Total contract is $20,000. I was only paid $10,000.

    How do I collect the rest of my money? Do I file a lein on the homeowners house? Do I sue the contractor? (I do believe him that he hasn't been paid) but who knows.

    What can I do here?

    My wife is in the hospital after pain management.

    My wife has been seeing a pain management specialist in the same office as her primary care doctor. After several months of physical therapy they finally sent her out for an MRI. After the MRI they tell her she has arthritis in her lower back and that they can do an epidural injection with steroids and pain killers to help with the pain.

    Yesterday was the day of the injection. We were told after the injection I would be let into a recovery room to wait with her for observation. Instead they brought her out and told us we were OK to leave almost immediately after the injection and to come back if she developed a headache or felt something was wrong. We made it about a quarter mile away and she started screaming and holding her head saying it hurts. We turn around and go back and they ask me to bring her back in, I had to carry her, her legs were too weak at this point to support her.

    They finally bring a wheelchair and put her in a room for a doctor to check her out and turn off the lights and give her an ice pack to lay her head on. This asshole of a anesthesiologist comes in turns on the light and immediately starts saying there's nothing wrong with her. He started asking questions then talking over her while she was trying to answer and when he would let her answer he would just tell her either she's wrong or that he can't understand her. I got fed up and yelled at the guy getting me kicked out. By this point she is losing feeling in her arms as well and has wet herself and has no idea it happened. She can't move her arms or legs. They called an ambulance.

    An hour later we're in the E.R they decide they need to keep her overnight and do another MRI, a blood test, and make sure she hasn't suffered nerve damage. They're keeping her another night. I've now missed two days of work, so has she. We're going to be stuck with hospital bills for a visit that never should have happened. She can move all of her limbs again but says her legs still don't feel right and she has reduced sensation on the left side of her body. Is there any way we can try to get her doctor's office to at least pay the hospital bills? US/IL

    Signed a lease, landlord has not signed yet. Can I back out/will I still owe broker fee

    Hello. I am located in New Jersey

    I signed a lease under the guise that our offer for a rental was accepted. We submitted financials, background check, credit check and were told by a broker they approved us. The lease was drawn up. The broker emailed me saying the owner "asked me to sign" the lease so I did. It has now been 48 hours. I am now told the landlord is still listening to other offers and asked me to pay MORE to compete, even though I signed the lease! Can I back out of the lease? Included in the lease was a huge broker fee. Will I be on the hook for that broker fee amount even if I back out now. The landlord has not signed the lease as of right now. Thank you!

    Indiana adoption without consent

    IC 31-19-9-8 allows for adoption of a child without parental consent if parent has been absent for more than a year and failed to provide for care and support of child.

    My situation is I have had physical and legal custody of my children for 9 years. In that time my children's biological mother has not paid ordered child support or attempted any contact with children. She wasn't even present at the divorce hearing when I got custody.

    Obviously, the requirements of that code has been met in my situation to allow my wife to adopt without biological parents consent. Question though is do I have to find her current address to serve her in the case?

    Can a landlord prevent the mother of a child who the estate was left to from getting the deceased belongings?

    My child's father has passed and my daughter is now the sole recipient of his estate. However the landlord that owns the property is raising many red flags.

    1. His mother and sister went to collect his belongings, but they couldn't enter the house because they do not have a key and the landlord will not provide one for them to use. My daughter is underaged, and we live out of state. Why can't she let them enter the home with my permission?

    2. She claims there's no current or previous lease documents that she can send to us as proof that we still have rights and time to claim his things

    3. Her feelings are personally involved and she's mentioned wanting to give an unauthorized party access to the house just because she wanted to. Also, that she was offended that she didn't get invited to the funeral.

    4. She is now saying the house is sold and if we want to claim anything we have to contact the new owners but she will not provide a name or contact information. Also, that since it's sold we have to claim his belongings by next week before it's disposed of (which we can't do, because we have NO access) Even though she told us to take as much time as we need when he died.

    My daughter is 5 and I want her to have some of her fathers belongings so she can remember him but this landlord is making it virtually impossible.

    We've reached out to a few lawyers, and are waiting to hear back from them. Just wanted to see if anyone here had any advice on how to go about this.

    Can My Boss Make Demands That Have to Be Met Before I Quit?

    I am a salary employee in Missouri and I just put in a notice of resignation. My boss then made a list of demands that he wanted met before I am allowed to leave, mostly just documenting and training how to do a bunch of stuff that I was the only person with the wherewith-all to figure out how to do it; the scope of which is pretty large. He is really sue-happy and made it sound like if i didn't get all of this done before I quit, we are going to have legal problems. Should I be worried?

    My landlord wrote a provision into my lease making me pay for repairs to my apartment, including regular wear and tear and issues not of my doing. Is this legal?

    So I'm a first time tenant in GA. Lived here all my life, first time renting. I found a pretty great place with a chill landlord- so I thought. Recently, things have been starting to go wrong here, and I have questions about how to handle them.

    The first thing that happened was the roof leaking- and I mean, heavy drips, holes in the ceiling, brown dirty water from the roof type leaking. I contacted the landlord and he said he'd get someone out here eventually (he has a crew who does maintenance but they've not come in weeks now) but that per my lease, "tenant is responsible for up to the first $100 of any wear and tear or repair required." He wrote it into the special stipulations section of my lease.

    Is this legal? I've been reading the tenant's rights brochure, and it says "landlord cannot make a tenant pay for repairs, unless that tenant causes the damages." I clearly didn't make the roof leak, but since he wrote this provision in and I signed it (rookie mistake, I didn't understand/anticipate repairs ever being an issue), does that mean I'm beholden to it?

    My second question is about appliance repair. When signing the lease, he referred to the fridge when saying that if it died, I'd have to pay $100 towards his repair/replacement costs. The fridge is fine, but the unit's dehumidifier (the apartment is up in the trees with no central air and gets so humid- 70%+ average and mold spots everywhere) just died and when I emailed, he told me that if he had to replace/repair it, it would again cost me $100. Is this legal? And if not, what part of the GA law can I show him to make my case without him talking circles around me? Advice about legality regarding the appliances or the mold would be appreciated- I'm severely asthmatic and have a parrot, so clean air is a must.

    Thanks in advance for any help! My lease is up in October and theoretically I can end at any point with no penalty except the next month's rent, but I'm a student who needs a quiet, safe place- this is why I got this apartment in the first place. My family home isn't conducive to my education and I really don't want to go back- but with the roof leak and the high humidity, my health is starting to suffer. I just want to know if I have any legal ground to stand on here or if I just have to silently do what I can to stay healthy till October when I'm done with the lease.

    Granny left us a house now sibling sold it without paying me.

    I'll try and make this as brief as possible. My granny passed and left my sibling and I a house. Both our names where on the deed. She contacted me a couple months ago saying she wants to sell the house. We agreed I would get a third. 2 weeks ago she texts me saying she has a buyer. She said she'll do a quit claim deed because she's trying to move States and needs quick money. She told me the price and I asked so I'll get a third of that right? She says yes, (I have screenshots of all of this) so she has some document place send the paper over as I'm reading it, it says only $5k on the sale. I then texted her and asked even though it says $5k on the paper you're getting X amount and I'm getting X amount right? She says yes. I still don't trust it. I get in touch with the buyer and ask him, he says he's doing it this way to avoid taxes so I ask him to pay us both separately. He agrees verbally. I sign the document and over night it. I don't hear from anyone. I finally get an email from the paralegal lady at the document place with the finalized document. So I call the buyer and asked him what's going on? He says the finance company wouldn't let him pay us with two checks. He says he gave my sister the entire check. This is exactly what I didn't want to happen. I called my sister and I'm blocked. I can't get ahold of her. She got her check Tuesday, and it's Friday and I haven't heard a thing. I'm being told to go to small claims court I'd rather avoid that if possible but if that's my only option I'll do what I have to do.     Losing thousands in benefits - please help

    Pennsylvania HR/Benefits question:

    I am 36 weeks pregnant and obviously going on out leave (12wk FMLA) soon.

    I have paid into voluntary STD (on top of their group plan) at my work since I started there in 2018 (Though I know this changes every year). I had a baby in 2019 while working for them and had significant difficulties getting my STD payment in a timely manner. (At that time we had a 3-4 month lapse in payments because they switched companies and it caused a 6 week delay in my STD payments. So I was already on guard).

    When we had open enrollment for 2020, I again selected, as I usually do, for voluntary STD, and paid the premiums for 60% of my pay. I informed my direct superiors of my pregnancy in October, so management has been aware up my upcoming leave. Anyway, during open enrollment for 2021, they only enrolled for health insurances, not benefits like STD. I sent numerous emails regarding my concerns and was told that benefits would be addressed at a later date. Once we started receiving paychecks for this year my premium was no longer deducted and only $2 DIS was withdrawn instead.

    I again emailed referencing this and repeating my concern about lack of coverage and affect on my STD payments come time for my maternity leave. I was told they were working on it.

    I emailed again a month later with no reply. (It's not unusual for things like this to take months with my ridiculous HR department). I had submitted all of my FMLA and STD paperwork about 2 months ago. I emailed today just to confirm everything was good to go and follow up on my concerns about STD.

    I just received an email stating that I would receive only $300/wk as there were no buy-ups this year. I was anticipating receiving 60% of my pay for 6wks and now just weeks before my leave I'm informed it will be THOUSANDS of dollars less. I was never informed or told that there were no buy-ups or that were was a change in coverage.

    Can they just make these changes and not inform employees? I realize that for 2021 I have not had the higher premiums deducted (but last time there was a lapse, they deducted them after the fact), but I was paying into the voluntary 60% plan prior to and during my pregnancy last year. I wasn't even given the option for a personal buy-up (if that's even a thing). There was absolutely no communication about this at all. I don't even know if this is potentially a legal issue or just an ethical issue.

    Do I have any recourse here?

    Undoing a prenuptial agreement

    I've been married to my wife for 15 years. I had gone through a nasty divorce five years earlier. I was traumatized by the divorce and the amount of money spent on lawyers, etc. so we both agreed to a prenuptial agreement. We live in California. The prenup process involved two attorneys, one for me, one for my wife to be. They together cost about $10,000 or a little more.

    After being married for 15 years, I decided that I no longer want the prenuptial agreement in effect. I've known this for at least 10 years, and have been meaning to do something about it. We have been through a great deal together, I love and trust her in a way I had never experienced. I want her to be well taken care of. I also don't like that there is this document which feels selfish and unloving. In short, even if she had a radical change in character, divorced me, I would want all property to be considered common property. She essentially is the mother of my two daughters from my first marriage. We also have a nine year old son together.

    We are currently working on estate planning, trust, etc. I asked the attorney working with us on these matters if she could assist us with reversing the prenup. She essentially said she wasn't comfortable with it, and suggested I speak with a family attorney. In an email, the family attorney mentioned that he recommends that both my wife and I have separate attorneys for the process. So, it seems like it would be a bit expensive.

    I understand there are boiler plate documents, which can be purchased for a nominal fee, to properly do away with the prenup. I was wondering how people with experience in these matters think about such an approach.

    For context, currently I am the sole owner of our house. I have a thriving service business. I guess it would be accurate that we are in the top 5% in US in dollar amounts, as cringe worthy such classifications are. My wife is an RN, but she works one day a week to keep her mind busy and to get away from the day-to-day household routine.

    Of course, I'd rather not spend a large of amount of money on this if it is not necessary. If there are good reasons to approach it with hiring lawyers, then of course I will do so.

    Fiance cheated on me and now wants back half of profit from selling my home

    The house, everything is under my name, he and i have no rental contract or anything

    I told him id pay him back for what he put towards the roof and the hvac and the 1k downpayment (totaling about 4k)

    I was told that I didn't fulfill my "contract" obligations as a minor.

    I'm a 17 software developer freelancer. I like to take jobs from Discord servers from time to time. One of my old clients contacted me about a new offer, a mobile and web app for a city. I was paid in weekly amounts of $100 until it hit the budget cap. I kept working for "free" for a while after that. I later expressed my desire to leave and was told that would be discussed at the end of the project. I pressed and told them I was leaving and that was that. I was then told that I had to fix the bugs that were still present in the app until a new developer was found. I agreed and went on to fix the issues that were pointed out to me. I figured that was the end until they reached out around a month later with more issues that were in the app. I don't know if a new developer was found in between but the issue seemed pretty obvious and not something that would be discovered weeks later. During this time I had many other higher-paying contracts so this wasn't my highest priority. They then threatened me with a lawsuit saying that I didn't complete the work in the "contract." Nothing was signed and I know that there are verbal contracts even though we mostly talked over Discord DMs.

    My question is, is this "contract" enforceable, and am I able to void this contract without repercussions (paying back the money that was given, though it is spent)? I completed what was originally told of me, completing the base version of the web app and mobile app. Heck, they even did a TV interview showing off the app on a local station. Looking at the Git commit history, I see that another developer has been contributing to the project since I left as well.

    Can anything be done for an auto repair shop that charged someone $1200, said the car was safe to drive, but didn't actually do what they said?

    My girlfriend started her car after work and it was lurching and smoking, so she drove it over to the mechanic across the street. They charged her for a diagnostic service, and ended up replacing a bunch of parts (fuel injector, spark plugs, coils etc). They also said they gave it an oil change. The total cost was $1246. They warned her she would need a new motor asap.

    When she picked up the car, she asked them if it was safe to drive and they said yes. At this time, at least one of the workers made her uncomfortable by making suggestive comments about the fact that the car's a manual, her hair color, etc. My girlfriend also had a bag of her friend's clothes tucked neatly in the backseat of the car. The bag of women's clothes had been rummaged through!

    When my girlfriend started the car, the check engine light was still on and the car was still lurching. She made it back to the parking lot across the street and had to pay to have it towed to her usual mechanic 40 min away. This mechanic told her that, not only had they not even bothered to change the oil (or the windshield sticker to pretend they had!), the issue was electrical and had nothing to do with the parts they charged her for. In addition, the motor is fine and they lied to her about that part.

    I want to lawyer up and take these bastards down. Is there a case?

    Employee wants to take money out of my tips to pay other employees

    I'm in Texas and I work as a waitress at a restaurant. Usually we will have a couple of waitresses serving on the floor, and one person answering phones and handling to-go orders. Servers make $2.13/hour plus tips, and to-go person makes minimum wage of $7.25/hour plus the tips they get from to-go orders.

    Yesterday, this changed. The employer now says that the to-go person will receive server's wage of $2.13 an hour, then at the end of the night, servers will give to-go person a portion of our tips. Is this allowed? It seems wrong to pay server's wage to someone that is not a server and not receiving tips from serving, a loophole to paying slave labor wages and avoiding the state implemented minimum wage. And in order to make up for this, he is taking money straight out of other employees pockets in order to pay the employee, when this should be coming out of the restaurant's bank. I am quite frustrated with this and not sure if this is allowed.

    Another experience that I have had with this restaurant is that the owner once held a fundraiser at the restaurant for his kid's school. We were instructed to put all of our tips in a jar, and at the end of the night, the owner took 15% of our total tips to donate to the school, then redistributing the rest among us evenly. Tip pool is never something this restaurant has done in the first place (every waiter/waitress keeps the tips that they earn), and I'm fairly certain that it is illegal to take money from us for a forced donation to a program that benefits the owner and his family.

    While I'm ranting about this place: the employer also required me to pay for the meal of a party who dined and dashed. The manager threatened to withhold the tips that I had earned that night if I did not pay it, so I had no choice but to pay. Is this legal?

    Work-related phone calls

    Is it acceptable for a manager to conduct a work related phone call with an hourly employee during undocumented hours?

    For example, an hourly employee is at home or outside of the workplace either on a day off or before or after a scheduled shift. The employees manager calls the employee from a personal phone number to discuss the productivity that employee displayed during that day. Is the company required to compensate that employee for the time spent on the call?

    If a coworker calls an hourly employee while they are off the clock and asks them to talk them through a work related process, must the company compensate for that time as well?

    Does anyone of a specific labor law that outlines what would be qualified as "work" for an hourly employee?
