Landlord demanding we return his expensive items from our apartment. We threw them out. He wants us to pay for them

    Posted: 31 May 2021 04:26 AM PDT

We moved into our current place a few months ago. When we were moving in, we noticed a few items left in our medicine cabinet. We assumed they were from the previous tenant and threw them out. Last week we got a text from our landlord asking about the stuff. We were honest and said we threw them out. He called us and explained that they were expensive perfumes, lotions etc. and we should replace them. I asked how much and he said $800. I was taken back and said that I feel we shouldn't have to pay it. We had no way of knowing they were his or that we should keep them. He said we should pay or he "might" take us to small claims court. Should we pay? Would this even go to court?

TX - Cable company cut off service unless I pay several hundred thousand on their mistake.

    Posted: 30 May 2021 06:01 PM PDT

I had my house built on the edge of my property roughly 15 years ago. 6 years ago a small cable company moved into the area. I inquired about having them hook up my house on the same line, but was told that I would need to pay a large sum of money for this. Roughly half the cost of the house itself.

Fast forward till last year and a builder started building homes on my street. Before the builder moved in, you had a line of homes, about half a mile of empty land, and my fence line. My house is right up on the street. They built right up to the edge of my property so my house looks like its right up on the street along with the rest.

When the small cable company came in to hook up all of these houses, the workers connected my house. Without me asking them to, or even noticing as I was gone when they did, they hooked up my house. I came home as they were walking to their truck from the side of my house. They said they just finished hooking up my house. I mentioned I did not have an account with them, but that I would like to. They just shrugged and said they were ordered to do all of the houses on this line.

After being hooked up, I called the cable company to get an account. The sales rep was more than happy to earn the commission for my account. A week later I was online and could drop crappy sat net.

Few months later and my cable internet and TV are turned off. I call cable company and was told that my house was "out or range" of their service area. The lady hung up on me. I called back and the person I got turned my account back on. Two days later it is turned off again. I called in and was immediately transferred to a supervisor.

I was told that my house was hooked up on accident. Long and short of it is they refuse to turn it back on unless I pay the original quote I was given 6 years ago. Thing is, that quote was for them to expand their service to my house. Kind of stupid to ask for several hundred thousand when they already have service for my house.

To top it off. WHen I tried to cancel my account, they want me to pay a 250 early term fee.

Kind of do not know what I should do here? Do I have a leg to stand on to sue for continued service without paying that ridiculous sum of money?

36ft of Tree Line on Parents' Property Knocked Down by Neighbor

    Posted: 31 May 2021 06:55 AM PDT

TL;DR neighbor moved their septic drain field and knocked out 36ft of tree line on my parents' property in the process.

For full context, I had my parents summarize their exchanges with the neighbor:

*Neighbor emailed asking if they could "mirror" our septic field on their property as they were remodeling their lakehouse and needed a new field. Attached to this email was a consent form from their builder asking us to consent to "adjoining" the fields and making one field.

We responded with NO. We do not consent.

Neighbor then emailed stating Our septic drain field will still be on the pole barn side of our property-but completely on our side of property line. Just trying to be as least intrusive as possible - but still meet our septic requirements.

12 days later - the contractor for the neighbor began installing the septic field and removed OUR TREES along the property line which were clearly on our property. (See my treelaw post for pics below) We immediately contacted neighbor who said - Our septic drain field is completely independent & on our side of property line. The excavator did recommend that the trees/shrubs on the property line in the drain field area be removed so they don't interfere with the fields.

We did not approve the removal of our trees (approx 36 feet of them) nor was there any discussion that he felt they should be removed. When we spoke with the company that actually removed the trees, he shared that the lead contractor told him that we gave them the OK - we never did.

These trees were not shrubs but more poplar trees that were approx 30-40 feet tall and had been there for some time before even our field was installed.*

So, I'm looking for advice on what we should do.

My parents want to avoid court if at all possible and the neighbor has said that she's fine doing whatever we feel is right to fix things, but aside from her planting 5 saplings elsewhere on the property line (something she already planned to do), I don't know if she'll be true to her word.

Possible solution would be for her to pay for trees to be planted elsewhere on our property since my parents want to create more privacy, but they obviously won't be of the same size as those the neighbor took from us.

Thoughts? Ideas? (This occurred in Michigan if it matters)

Am I responsible if my alcoholic brother ends ep in the ER because I cut off his alcohol?

    Posted: 31 May 2021 10:11 AM PDT

Every month he runs out of money and ends up at my house with the shakes begging for alcohol to calm him down and I give him some to hold him over cause I don't want him in the ER or dead. But I'm tired of his shit he finally crossed the line yesterday and I dont want to help him out anymore.

Do I have any responsibility if he ends up in the ER if I suddenly cut him off after giving him alcohol every month for the past few years?

Im in California if it matters.

Just signed a lease for a new apartment, went to move our stuff in and it’s infested with roaches

    Posted: 31 May 2021 04:54 AM PDT

    Port Saint Lucie, FL

I love the apartment and want to make it work mainly because this is the only place I could get approved. I lived in the same complex for a year in a one bedroom, which when I moved in was clean.

Now we signed a lease to upgrade to a 3 bedroom. The day we were suppose to move in there is baby roaches and adults everywhere. The drawers in the bathroom were filthy, pubes on the sink, rusted washer and dryer, patio is rusty and green and disgusting.

They're telling me they will send an exterminator Tuesday but I don't want to move in after they sprayed the whole place, there's going to be dead bodies and also I will have to put in like 20 work orders to fix all the problems, in which they also told me they only have 1 maintenance man because they all quit.

I already gave they $1400 in security deposits because I trusted that I could get a clean apartment in the middle of a pandemic, I just had a new born baby.

My 1 bedroom I'm still staying in now is cleaner than that, and I haven't even begun cleaning. I want to know my options as I really have no choice but to stay here because I can't get approved anywhere else. I've tried.

When I was 20 my daughter was born, child support was law then. They have since updated it to 50/50.

    Posted: 31 May 2021 03:20 AM PDT

This is in Kentucky. I was wondering what legal process I need to take to get 50/50 from child support. I currently have joint custody and it's written in paperwork that I am supposed to get her every day I am off. They only want me to have her on weekends that her mother is off (rotating weekends). I work retail and rarely get weekends off and we are short handed so I rarely see my child these days. They also take frequent vacations (5 a year) and that is often an excuse. I have given up asking for her on my days off. I am wondering if there is another process that is cheaper than going back to court with a lawyer. The last time it took me about $5,000 and close to 2 years. It's a long story as to why but the short of it is that my first lawyer died on the case and no one told us. It was bad, left me in limbo. Any information is appreciated. Thank you for your time.

Kids running rampant on a high traffic street. Parents don't care. Ohio.

    Posted: 31 May 2021 10:49 AM PDT

The parents have "slow down, kids playing" signs that they purchased, as well as the orange fencing. But the kids (all under age 10) have no regard for the traffic that comes on the road. The older kids ride their bikes in the middle of the road when traffic is coming.

Many of my neighbors have asked the children to get out of the road but they claim their parents allow them to. I'm just worried about someone coming down the road at high speeds and hitting a child. Is there anything I can do? Talk to the cops or something? The parents don't care when talked to about the kids in the road.

    Neighbors Cow Pasture

    Posted: 30 May 2021 06:36 PM PDT

Pennsylvania -- Several years ago, my neighbors built a cow pasture right next to my house (literally 10 feet from my house). Our house was here for 13 years before they built the cow pasture. There was no barrier between, so we had to build a fence to block the view. There are approximately 12-15 cows on one acre. From what I can tell, there is no waste management. Only a huge pile of manure stacked in the back. The fly population has overtaken the ability to go outside in our yard. Once a week, we have to powerwash our entire house to get rid of the fly poop. The cows moo throughout the whole night keeping us awake. Now, we have begun to have problems with our well water. It has an awful smell (even with a conditioning unit) that we have never had before. I have a suspicion it is because the lack of waste management. I am desperately seeking some advice as what to do legally to rid myself of the problem. I appreciate any and all advice!

Should I prepare the postnup or should I let my wife arrange the divorce papers?

    Posted: 31 May 2021 12:32 PM PDT

    Hi,

Have been married for half a decade. Been dating my current wife (let's call her Jane) even longer than that before marrying. Currently, we reside in NV. Yesterday, Jane asked that we prepare a postnup and notarize it. Our relationship has been rocky recently. She says this might help our relationship. I am willing to work to improve our relationship, be it therapy, communication, or ...

I don't know about postnups much. How would it affect a probable divorce in the future? Does a judge use the agreements in the postnup as a base for a divorce agreement? Jane wants me to add IRA and 401K, my payslips from my employer, and any other similar things. She also wants me to mention in the postnup that I am willing to provide for her, and that I do not and will not claim the savings.

My wife has been responsible to keep our savings and expenses. We planned to use the saving and get a loan to buy a house, but it seems that plan is halted. My wife has an adult teen son (let's call him David from his previous marriage and she says he cannot be independent due to his disability (I am no psychology expert, but based on the counselor's comments, David has one or some of these: ADHD, autism, borderline personality. I think Jane will be able to prove those. During his school years, she always asked for extra treatment for David, e.g. unlimited exam time and HW deadline extension, ... ).

I told her that I'm Ok if she wants to keep the saving, but I don't see any point in mentioning that in postnup. Also, I told her that I will share my income with her while we're married and work on our marriage, but I don't want to make any commitments after that.

Jane kind of got mad and threatened to transfer the saving to his brother, file for divorce, resign from her job, and request high alimony because of herself and David. She also threatened to close my immigration case (green card via marriage).

I have to say I have a good relationship with David, but I was never a legal guardian, and Jane didn't even allow me to do much parenting. I know his biological dad has been married and has kids, but he's not around much and never provided any money.

So, what should we do? Should we arrange a postnup? Should I listen to her or should I allow her to file for divorce? Am I gonna be in big trouble? Frankly, if I will be a big loser here, I'm willing to forget about the green card and leave the US. I mainly filed for a green card, because my work authorization was ending, and wanted to stay with her.

Weeks after I quit, my old boss is conducting business using my name and pretending to be me via email. Is there anything I can do to stop him?

My old co-workers have sent me email threads from clients and suppliers where the President of the company is introducing himself as me, using my name and email signature. He just sent another email YESTERDAY masquerading as me.

I know my email address is company property, but my identity is not. I'm not sure how to handle this, because his behavior can be erratic and dangerous based on my previous experience.

Is there anyway I can stop him from doing this? Is there a cease and desist template I can use?

Is it big enough of a deal to go to the police? Would they track down this person? I live in Wisconsin.

Is it a S—- storm or poop spray?

    Posted: 31 May 2021 07:41 AM PDT

I need help desperately. My neighbor has a aerobic septic system that is spraying in the daytime into my yard, over the fence and on to the yard right by the street. It's raining here now which makes their system spray nonstop and it stinks. When it's spraying, I can't go out in my backyard because the smell is overwhelming. I called DEQ (state) and filed several complaints (over the past few months but totally ineffective). I noticed the spray going over my fence last week so I've called DEQ again and filed another complaint. Today is a holiday and I'm afraid it's going to rain all day which will make it spray and stink. I don't think I can do anything today but what does a person do in this kind of situation? I'm in Oklahoma, in a residential area.

How should I approach obtaining an easement for my driveway? (Weird situation)

    Posted: 31 May 2021 01:37 PM PDT

This question is pertaining to a property in the State of Maine.

Context: Back in December, my wife and I purchased a house. The house fit our needs well, the only issue with it was the driveway enchroached about 8ft onto the neighboring property line. We knew about this from disclosures, and from the home inspection. After conversations between our agent, title company, title insurance, and bank, this was deemed not a big deal. The Title Insurance company even told us directly that if any issues were to arise, they would cover any incurring expenses (You better believe I have that email tucked away, too). I'm not really sure how this flew, considering we are financing using a USDA Rural Development loan, but there is currently no easement for this driveway.

The neighboring property is an office building for a property rental company, and they haven't given us any grief about the driveway. They are probably aware that an issue exists, because the previous owner of our house had tried to obtain an easement, but it was a challenge to get ahold of the owner, as they own multiple rental businesses across the state.

Now I'm conflicted about how I should handle this. I'm not so worried about if they were to come after us, but more how it impacts the value of our property, if at some point down the road we were to want to sell it. Moving the driveway is difficult to impossible, and would remove access to our garage. This driveway has, however, existed for years, at least since the 80's.

So far, I've considered approaching the owner myself to try and obtain an easement, but a coworker of mine who has a bit of real estate experience has advised against it, claiming they might try and ask for an exorbitant amount of money, where land is at a premium in my city and they know I need this for access. They claim I should try and have it handled in court, where the title insurance company is going to cover incurred costs anyway, and because I likely have a case for an implied easement.

Now, I know a few people right now might be saying "well, you shouldn't have bought it to begin with", and if it wasn't due to necessity, we might not have. But we kind of had to, for stuff going on otherwise in our lives.

We're first time home owners, with no real experience with this sort of thing. If anyone has any suggestions or can shed a little light on this situation, I'd love to hear it.

How can I establish guardianship of my brother? (US/VA)

    Posted: 31 May 2021 12:26 PM PDT

Obligatory apologies for formatting as I am posting on mobile.

We live in Virginia, my brother (13) lives with me (m27) and is under my care. Our mother lives in California and is trying to get on her feet but until then he is staying with me.

A little backstory that might be relevant, our mother used to live with me but she grew homesick and left back to California and has the intentions of bringing him with her once she has her own place etc. but she was able to enroll him in school while she was here..

I don't need to adopt him or legally be his parent but I need guardianship to make medical/dental/optometry appointments for him.

Everywhere is denying me because his legal guardian needs to be there and provide identification.. is there a simple process that would allow me to make these appointments on her behalf to get him the preventative care that he needs?

    Thanks for all the advice.

Moving company scam, my stuff is being held hostage.

    Posted: 30 May 2021 11:55 PM PDT

So basically i hired a moving company that lied the f out of everything, i did some research, Google of course, and tried my best to hire a good moving company. It's my first time moving to another state, long story short i needed to move out by april 25 i hired the company told them to pick up my stuff on that day which they did, but it wasn't the company i originally hired. They originally quoted me $2100 i accepted but when the second company arrived they charge me for stairs which I asked about and they said don't worry about it it's included in the quote but then i have the driver charging me $400 extra oh and for the "long haul." Which was supposed to be the first 50ft free i wanted to cancel but i had already paid a deposit of $1000 and they said I'd lose it if i cancelled. now for delivery they asked me when i needed my stuff delivered and i told them i was moving in to my new place may 15 so that day would be fine, around the 10th i call and they tell me that the driver gave me incorrect info and that the 15 was just the first available delivery date. it is now may 30th and they haven't been able to give me an update about when i get my stuff it was always I'll let a manager know we'll get back to you and they didn't, I've called a million times, that is until tonight, they said I'd get my stuff to me tomorrow but guess what yes yet again another company and this company says they are a moving company but they don't deliver to apartments so they have to charge me an extra $500 on top of the $1100 I'm supposed to pay them and if i don't pay they won't give me my stuff. Sorry for the spelling grammar and punctuation I'm drinking myself to sleep. I don't know what to do i literally have no more money to pay them and other than what was quoted in being robbed!!!

The creepy neighbor is going above and beyond to spy on us.

    Posted: 31 May 2021 12:03 PM PDT

Just some info, the man across the street from us (know to my family only as "smoking man") moved in ~2 years ago. He would always stand in his garage and pretend to be doing something while looking at us out of the corner of his eye, but now he has gotten comfortable enough to just blatantly watch us. He set up a security camera facing our house, and every time we go outside or come home in the car, he opens up his garage and watches us. He also goes out of his way to stand so that he can look between the houses and into the backyard when we are in it.
Well, just last night, I went outside to go for a walk. As soon as I left the house, I saw that he had set up a camping chair in front of his house and was just staring into our front windows! This is very concerning for us all, as the house has several underage girls in it. Is there anything we can do?

Hoping to make a call for photos of skin conditions for use in educational videos and material. Best way to make a release form?

    Posted: 31 May 2021 10:20 AM PDT

Hi all! I am hoping to make a series of videos on common skin conditions in brown and black skin compared to white skin. There are very few available under creative commons and I was thinking of putting out a message to my followers to submit their own. I would have the sign a release on Google forms and submit their photo, and of course would use a disclaimer that I have not independently verified their reported diagnosis, etc. I am wondering if there are any big issues I should worry about. I am a fourth year medical student and want to do this to spread awareness on how skin conditions look different on different skin tones.

Edit: I am located in the US.

Paid for a hotel on Expedia that does not exist

    Posted: 31 May 2021 02:53 PM PDT

Hello, everyone. For reference, I am located in Nevada, and this situation happened in California.

For Memorial Day weekend I booked a non-refundable suite on Expedia that I paid in full up front. I got an e-mail stating that it was booked through Expedia, to Vrbo, and then got a confirmation number with an itinerary number that my reservation was confirmed.

When I got to the hotel, I came to find out that it did not exist/was bought out by another hotel company. I verified that I was in fact at the right address because I just put the hotel name in google maps at first. After confirming that I was at the right address, the clerk stated that this was no longer that hotel and they were not honoring reservations made under that hotel name. They even had a sign up stating something along the lines of "reservations for XYZ hotel will not be honored and no refunds will be given".

When I called the phone number in my e-mailed itinerary, the one with the confirmation for my reservation, the same woman I just spoke to in person answered the phone and gave me the same speech.

I attempted to contact Vrbo with no luck, waited on hold for an hour. Then I attempted to contact Expedia. I stated that this was incredibly inconvenient because I had traveled here with my entire family and now not only didn't have the hotel room I should have, but no other hotels had availability in the entire area. Expedia's customer service rep asked if I would like a refund, and I replied that I would like more than a refund, I would also like some sort of compensation for my family's now ruined vacation. He stated that he understood and that we would get Vrbo on the line to try and get to the bottom of this.

We again waited almost an hour on hold and no one representing Vrbo answered the phone. Then he hung up on me.

After this fiasco I contacted my credit card company. They issued an immediate refund after I filed my claim of no service provided. Then I got an e-mail from Expedia asking me to leave a review about my stay at this non-existent hotel. So I typed up a review stating along the lines of "buyer beware, this hotel does not exist, no one will answer the phone and you'll have to fight to get your money back". This review got taken down 3 times.

Expedia has been made aware of this fraudulent listing and has taken no steps to rectify the scenario. No one from customer support has reached back out to me after hanging up on me. I would've been happy with a refund, them taking down that phony listing, and a little something towards a future trip. I don't thank that's unreasonable after what we went through this weekend.

Do I have a leg to stand on, and would it even be worth attempting to take them to small claims?

Look I know I should have stopped, I really wish I had but it happened so quickly and I was less than a mile from my house where my parents were expecting me. I haven't said anything to anyone about it.

I got home and cried and spent the night feeling horrible. I love cats and I hate seeing any animal in pain and I would never hurt one intentionally.

The story is last night I was driving home from picking up takeout for my family. As I was on the last stretch of roads to my house I was driving through a small area with houses on either side and I saw something on the right side of the road (very close to it) and figured it was an animal. I checked for cars around and didn't see any, so I went into the oncoming lane to avoid getting too close and slowed down some. As I went left the cat suddenly ran straight across the road and I slammed on the brakes but I definitely felt a bump as it went right into my path. My anxiety and shock set in immediately and I just drove off as I was already close to home and I knew my parents were expecting me home. I have't told anyone but I've looked online and only seen that you have to report hitting large animals like dogs, cattle, and deer. Morally I know I messed up but am I in legal trouble? There's a county sheriff's SUV parked in my neighbor's yard across from my house and I don't know if it's just me being paranoid or they're watching my car.
