    We're in the US, in Oregon.

    We were renting a house for two years. The lease term was one year, we renewed once, and a month before the lease was due to renew again, the landlord asked us to let them move back into their house.

    We really didn't want to move. This house was perfect, our kids made best friends on our block, and we became friends with neighbors. We have moved almost a dozen times in our marriage and were hoping we could stay in that house until we were able to buy.

    We were pretty dang ideal tenants, honestly. Hardly bothered the landlord (except for one or two necessary repairs), kept up the house really nicely, paid rent on time every month, etc.

    I have a couple disabling conditions and it was extremely hard on me to move. We spent thousands in between hiring movers, paying higher deposits on the new place (my credit score was lower than average because my business was affected by the pandemic), and first/last months rent. The owners of the house did pay us a relocation fee of one months rent, but that barely covered our costs. It was a really bad time to ask us to move - our credit is usually great and we have definitely been in a better financial spot before. My husband lost his full time job late last year and we have been catching up.

    We were renting through a property management company, who advised us we needed to move due to the owners moving back in. We tried to get them to convince the owners not to kick us out but they gave us a 90 day notice.

    Since we're such good friends with the neighbors, we are in the neighborhood several times a week. We noticed a lockbox still on the front door and checked rental listings - lo and behold, the house is back up for rent for $1,000 more a month than we were paying. Our last day was at the beginning of this month and only a few weeks had passed before they posted it for rent again.

    Is there any recourse here? It took us an entire month to completely move because I wasn't able to lift boxes, pack, or clean, and we couldn't afford to hire any more help than we did. My husband missed out on gigs because he spent so many countless hours cleaning out the old house and doing everything on the move out checklist (re-seeding the lawn, pulling weeds, changing filters, cleaning the fireplaces, we even pressure washed the driveway and back patio).

    I know it's probably a dead end, but I just thought I'd ask. I'm so frustrated. Thanks for your time.

    (GA) HOA selling access to common areas to non-residents

    My HOA is selling access to the pool, tennis courts, and gym facilities to the general public. However, the bylaws specifically state that these facilities are for residents only and not the general public. I've read over the bylaws and covenants and can see no section or carve out allowing them to do this. Am I missing something? Can they do this? What is my recourse?

    My general manager (retail) was caught editing employee clock-in hours for the last 6 months. How should I deal with this fraud?

    [Indiana, US] After the last few paychecks, many of my coworkers complained that their hours were cut short. Without the clock-in slips to prove it, they just dropped the topic. This last paycheck, I told everyone to keep their clock-out slips and they did. On top of that, I searched through the timekeeping database to find a report: It listed every edit that was made to our hours, from

    I brought this up with my boss. I gave him a list of all the hours that were missing from all my fellow employees for the last paycheck. He told me he would "fix it", but he just took the paper and left. My friend got in contact with the Department of Labor, so I guess we will start from there.

    Most of my coworkers are upset and refuse to put any effort into their work now. They think that if the boss stays, they'll find another way to rip us off. How should I proceed to ensure 1. We get our money back, and 2. This never happens again? I've heard that it's best to file a complaint in small-claims court, now that I've already talked to him. Is this necessary now that the DOL is getting involved?

    (AZ) Abusive LL renovating property on my dime! Not listing property! Broke lease & LL has had keys for 10 weeks. Still hasn’t returned security deposit either. Should I go to court?

    Help please! We returned the keys in March, clean and empty unit, and the LL is now saying the unit won't be available to rent until August. Turns out he totally removed carpet from three rooms to replace with tile, repaired fencing that was broken before we moved in, etc. I'm particularly upset because this guy didn't have the place in good condition when we arrived the first time (the only toilet wasn't even bolted down). Now, he has the audacity to renovate on our payment time.

    Also he's saying that even though we haven't been in the property for 10 weeks that he doesn't have to return our security deposit or a letter explaining damages yet because technically our lease was through July—even though we're gone. But our lease reads that he must do so upon termination of tenancy.

    Is this legal? Do you think I could sue for my security deposit or unfairly being charged rent while he's renovating?

    UPDATE: just checked and this guy is actually suggesting now that the property won't be available for rent until 8/1/21, a full 4.5 months after returning the keys

    Unknown Crew chopped down a front yard tree with no notice

    We live across the street from a school that is about to be demolished. I was gone an hour and I was told a tree removal crew chopped down our tree without any notice to us. We were planning on landscaping that area around shade and now we have to rethink things. I'm guessing they need the room to move the mobiles but they didn't communicate that at all. I'm wondering what kind of options I have to pursue legal action.

    edit: It was a city crew, and they can do this with city-owned street trees, but this was not a street-tree as indicated by the city website.

    Quit my telemarketing job, was told I’d receive all my monthly bonuses on the final pay cheque. Now I’ve received an email stating I won’t get ANY of it because I am no longer employed there.

    Worked for a TERRIBLE data company in Toronto, was told by the operations manager I'd receive all my bonuses on my last pay cheque (~$700). They sent back an email with something I apparently signed stating I don't receive any of my bonus if I'm not employed there.

    What bothers me is that the operations manager told me over the phone I'd be receiving everything. Also the bonus structure is as follows : you get $8 for every sale but it's not paid out until the end of the following month. By their logic, you will ALWAYS end up working a full month and not receive the sales for that month because you no longer work there.

    Do I have a case or am I screwed?

    Landlord advertised 4 bedrooms now only wants to let us use 3 (WI)

    Hey all! We were all set to move into our new apartment in Wisconsin, and the landlord seems to have decided to use one of our bedrooms as a storage facility and filled it with appliances. It was advertised as 4 bedrooms, and agreed that we would have the use of all 4 upon signing the lease. What can we do? Any help would be greatly appreciated.

    I live in North Carolina. My landlord is telling us to leave Thursday. He cut the water off today. Today is the first I'm hearing about having to leave. He has not filed an eviction. He's been getting payments from us for about 2 years. I let him know that my ex moved out and I would be taking over payments. There was never any lease signed, but he's been taking payments for about 2 years. He is now saying I'm trespassing and need to leave. I own the house, and I only pay lot rent to him. The trailer was made in 1979, and from my googling it seems like no companies will move something this old. He told me at first that I need to pay him more money than usual, and I've been trying to get that money together. Well now he is saying he wants me out, and is refusing to even let me sign a lease at this point. Rent was late this month since he decided to charge more. Besides that's there have been no problems between us. We now have no water and he's saying we have to be out Thursday. I'm under the impression that he still has to evict us. What can I do?

    My siblings are split up into two foster homes. I’ve been trying for a week to have them placed with me, but they’re working hard against it. Now the girls’ foster ‘parent’ is having them moved because one of the girls is bisexual.

    I (20F, living in TN) am the oldest of eight. DCS took my six younger siblings little over a week ago because the house was in a bad state. Basically, most of my family has fallen down the hole of addiction and the ones who aren't are enablers. It's sad to say, but I knew they were better off somewhere else... But I have always been protective of my siblings and planned to open my home to them in a situation like this.

    However, DCS has been working from the start to keep the kids in state custody. It's supposed to be a priority to place the kids with family, and I was the only option. Their first reason for not placing the kids with me was the fact that I'm 20 with a kid (and another on the way) - they said it'd be too much for me to handle. When I insisted I could handle it, they said I couldn't take the kids because I've been involved with DCS with my kid - which isn't true. I was pregnant and living with my mom when a DCS case was going on for my siblings. (The case worker later cleared that up.) The third excuse was that my boyfriend has a criminal background - He has a juvenile background; the worst thing on his adult record is a speeding ticket. As a kid, he was one of those hoodlums who broke into cars, stole and vandalized, but he is nothing like that anymore. He's a responsible adult and father now, and they can see that. So now their fourth excuse is that they don't trust me because when I asked them about the lies they produced to keep the kids from family, I wasn't polite enough. I definitely wasn't rude, but I wasn't afraid to show I wasn't okay with them lying about me and my boyfriend (without checking backgrounds) to ensure the kids were ripped from all familiarity.

    I've shown up to every meeting and court date, and the DCS workers say they can see I care about the kids and am willing to work with them. They say that by continuing to show up, I'll build their trust for me, and someday they'll possibly decide they trust me enough to take the kids in. But during the last meeting, the girls' foster "mom" dropped what felt to me like a bombshell. The middle sister (11) had an "incident" at school. Apparently she was dating one of the girls in her class, and two girls told the teacher, who told the foster parent. She said my sister admitted she was bisexual (but didn't have a girlfriend)... which the foster woman isn't comfortable with due to her religious beliefs. She isn't comfortable with my sister being around her or her family, so she's having them moved.

    I've been devastated since I realized they really were doing everything they could to keep the kids from me - they also think I won't comply with court orders to keep our parents away when they shouldn't be around. They don't have a valid reason to do this, but that doesn't matter. I just can't believe they're going to such lengths to keep the kids from their family, but can arrange to have them placed in another foster home without a problem. They've also admitted they don't learn much about the foster parents, that they just "go with it." And I could be wrong, but it seems like a pretty big problem that my sisters are being moved after only a week because my sister likes boys and girls. If she had a boyfriend at school, NO ONE would see an issue. They'd flip their wigs if they knew the oldest of the three (16) is lesbian.

    Is there anything I can (or should) do to fight this? Is this not discrimination? Or is the foster woman (who wasn't even approved to be a foster parent until the day after she took them) within her rights? Either way, I'm sure the girls are better off away from her at this point. My family and I are Christian too, and I would never turn them away or judge them because of who they are.

    My psychiatrist has put me on ADHD medication for well over a year now. During the course of the past week, I've tried to make an appointment with her - she and her office have said she isn't available until June 16th, well after two weeks have passed since my medication has run out.

    Just as a side note: she's usually available within one week of my attempts to schedule, which wouldn't be a problem, as I have enough meds to get me there and then to actually receiving the refill.

    However, she did not communicate to me that she was taking fewer clients, hence the longer wait. Then, she said that she will not give me a refill until the appointment as a way of "teaching me a lesson about waiting until the last minute."

    It'd be one thing if she were unable to send in the prescription. It's a whole different thing when she's making it clear that she is just unwilling to help.

    Another note: I am also on other medications for depression and anxiety. She was more than willing to refill those pills on Tuesday. But when I pressed her on the ADHD pills, she pushed back and said that this was to teach me a lesson for "waiting until the last minute."

    Again, under normal circumstances I would've scheduled on time - she didn't communicate that she was not operating under normal circumstances.

    Is there anything I can do?

    Insurance company suing me as the owner of my old car that I traded in

    I just got handed off a notice for an insurance company suing me for someone else causing an accident in July 2020 in my old car that I traded in with a dealership in June 2020. It says that I was the owner of the vehicle and that the driver was driving it with my permission. I looked up the VIN on DMV website and it says the new title was issued in August 2020. Wtf? What do I do? Where do I even start?

    I have a form HSMV 82995 (Florida) from the trade in that transfers my power of attorney over my old car to the dealership. Does that put the blame on the dealership? Can I sue them if they have messed up the paperwork?

    Edit: Should I let my old insurance handle this? I switched from Progressive to State Farm on July 11, 2020 and the accident occured on July 17, 2020, but State Farm never insured my old car. So which insurance information should I give to the insurance company suing me? I'm confused.

    Edit2: I just noticed that the POA I have is a copy with only the Seller's (my) signature on it. There is no signature from the Purchaser (dealer). Is it even valid?

    (CA): Got Fired and Company Pressuring Me to Send Letter of Resignation in order to get Severance

    I found out today that my company is terminating my employment. They said at the end of day today I will lose all access to software, but the company will still employ me for 2 weeks, during which they expect me to just apply for jobs and not do any work. An HR member told me how much my severance would be, and told me that in order to receive it, I must send my manager and HR an email saying that I'm resigning today. I was told that the company is a No Contest company and wouldn't contest my unemployment. I was told that if I used the word termination or made it sound like the company was severing me, that I would not get my severence. HR used the term "mutual termination" as opposed to involuntary termination. Is this legal? Should I talk to a lawyer, or sign?

    FedEx refuses to refund Priority Overnight shipping due to their screw up.

    Edit - I am located in San Francisco, Calfornia.

    I sold an item on eBay (1000 USD+) on May 20th and my customer needed it urgently. He paid me extra money to use FedEx Priority Overnight (96.87 USD) and the item was delivered the next day on May 21st.

    Unfortunately, the FedEx driver delivered it to the incorrect address. I called FedEx on that day, and they confirmed (GPS) that it was delivered to the wrong address.

    I called FedEx many, many times every day until it was finally delivered to my customer on May 25th. The tracking number shows that the item was delivered on May 25th AND May 21st.

    Luckily for me, the customer was understanding and kept the package. I refunded him the shipping fee as he did not get it on time.

    I am now chasing FedEx for a refund. Today I've called them 3 times and each customer rep said that tracking shows it was delivered on May 21st, and according to them my FedEx account is not eligible for a refund since they technically delivered on time according to the tracking.

    I have called my bank to file a dispute. However I have no confidence in FedEx at all, and I am worried they'll fight back. What else can I do to make sure FedEx returns my shipping cost for a service they did not provide?

    Sibling Passed Away, Estranged Mother Is Next of Kin - NY State

    My brother passed away last week, no will or other such documents. He did have a life insurance policy through his job and he named me the beneficiary. He had virtually nothing else in terms of assets. He was living with me when he passed away and has been living with me off and on since ~2009.

    I want to take care of his arrangements, but in NYS, the next of kin pecking order puts our mother ahead of me. I haven't spoken to her since 2012 and I think he's only spoken to her once or twice over that time, probably not since at least 2016. We didn't even know that she moved some time ago from Long Island to upstate (I just purchased a new house and we actively avoided the area that we thought she was still living in).

    If she does not relinquish her right as next of kin, is there any legal action I can take?

    My father passed away and after being divorced from my mother almost 40 years I found out she has signed his death certificate as still being legally married. What can I do?

    I'm 41 years old my parents divorced when I was just a baby. My mother since has remarried twice and is still married to her 3rd husband. My father never remarried or never had any more children. On May 14 2021 early Friday morning he passed away. Wednesday morning he was already put in the ground I was never even told about the service. Today I called the mortuary to find out what was going on and was told his death certificate was signed by my mother who was never legally divorced to him. I couldn't believe it. I told them that was a lie she's married to somebody else. What do I do next?

    Building won't let us move out on Lease end date

    Our Lease ends on a Saturday but our high rise won't let us move out on the weekends. Is there a precedent for how this is handled? In a position where our landlord is likely going to push back on a Monday move out and am trying to prepare my response.

    Miscommunication with employer, now out of work due to pregnancy bed rest

    Im currently 12 weeks pregnant and I had some early complications around week 9 that lead to me being put on bed rest by my doctor. I received a doctors note for two weeks and my employer was understanding on allowing me to stay home.

    After having two weeks off work, I had a phone conversation with my boss following an appointment with my doctors. I let her know I was able to come back to work on a limited movement basis. She kindly offered to continue my insurance for another month and allow me more time to rest and I hung up feeling like I could take the time I needed to get back to work. However a few days later I received an email from our HR manager requesting a written letter of resignation and to come collect my belongings from the office at my earliest convenience. I called my boss immediately letting her know it was not my intention to resign and that it was never said I wouldn't be returning to work explicitly in our conversation.

    However according to her, we come to an agreement I would not return and it was for my best interest and my future baby that I stay home and look after myself. She went on to explain that me being off for 3 weeks now, she needed to hire for my position to help ease the workload between the other staff, which I completely understand, however I was never under the intention on not returning.

    Will writing this letter for resignation affect my chances of being able to apply for unemployment? Im not really sure what to do! I'm located in Los Angeles and any advice would be greatly appreciated!

    Can my employer force me to quit?

    Long story short, someone in my department quit, so they want me to take over the position, but in a different office 2 hours away.

    Pre-covid we had an office in a major city where I live and that's why I took the job, because I was close to work. When covid hit and we all started working from home, management closed our city office location and moved all of our equipment to our other office 2 hours away.

    HR wants me to come into this office 3x week for this position and I am not willing to due to the commute. I explained I started working for this company because it was close to home and was under the impression we'd be reopening the city office once safe to do so.

    That being said, HR said I would be "voluntarily quitting" if I don't come into the office. Is this legal? Can my employer force me to quit?

    For context this is in PA. Any advice is helpful!

    [TX] Dog rescued off the street. Severely sunburnt, severe dental disease, grade IV heart murmur, badly healed leg fracture, dehydrated, malnourished. $1000 in vet bills. Officer came and took the dog back to its owner. Picture included.

    Hi, someone I know rescued a chihuahua after it was posted online by someone who saw it wandering outside in poor conditions, barely able to walk. Three hours later another person still saw the dog on the sidewalk, gave it some food and water, then too it to a vet. It had no tags and no chip. The vet recommended an emergency clinic because the dog was in such poor condition. They surrendered the dog to the clinic. The lady I know took responsibility of the dog so she'd have someone to care for her and a home to go to. She was billed $1000 so far in tests and treatments. She said the dog was so hungry, but had periodontal disease (which was why her tongue was hanging out all the time) and the vet said eating was likely very painful for her.

    The owners began posting online claiming their dog was let out for a few minutes and some people lured her away and stole her. They claim the dog is "just old" and has nothing wrong with her other than a bit of hair loss on her ears and no appetite, which was why she was so malnourished. Her ears are almost black from how burned and scabby they are, and she has a great appetite but just can't eat much because of her mouth.

    The lady who has the dog repeatedly told them to contact her. They eventually did and were given her address, and next thing she knows a cop is at her door demanding she give him the dog. She handed the dog over.

    I've known people have their dogs straight up stolen and cops have said they cannot get involved as it is a civil matter that needs to go through a court. I also saw someone comment that the owner legally has to reimburse the vet fees to the rescuers before they can claim their dog back. Is this true? Can anyone point me to the penal codes that cover issues like this? Thanks!

    (TX) How do I get a copy of a deed?

    My uncle had the deed but it was damaged during harvey but I can make out some of the info like it was filed in 1952. The county clerks site says they don't have files before 1962, where else would I get a copy?

    I worked an 8-hour day at a McDonald's and I am not employed by McDonald's

    I got invited to interview several times at a McDonald's, then the interviews gradually turned into hands-on demonstrations, then lunch rushes happened, and the managers who interviewed me never stopped asking me to do things. I kinda got caught up with that energy and ended up working a full 8 hour day.

    I still haven't been offered a position, but I have definitely spent hours cooking food and such. I don't even know what pay they would offer me if I do end up accepting.

    How do I handle this surreal situation?

    Figuring out who should pay for retaining wall fixes after a tree complicates it

    TL;DR: Retaining wall between my neighbor and I is making my neighbor nervous, they are wanting me to pay the entirety of the cost to replace it.

    I've got an issue with the retaining wall between my property and my neighbors that I'm trying to figure out who needs to pay for repairs to it. So here's the story that lead up to this. For what follows, assume verbal communication unless stated otherwise. Also, I've owned my house 2 years and this is in New Mexico.

    Last year in late spring, my neighbor came over and said that there was a tree next to the retaining wall between our properties that he was concerned was causing damage to the retaining wall. The tree was about 7-8 feet tall with a trunk diameter of about 6 inches and the trunk was about 2 inches from the wall. The wall section stands about 6 feet high above ground and runs for 7 feet and is original to both houses (about 30 years old). My side of the wall is at the higher ground level, while my neighbors yard is below grade on the lower side of the retaining wall.

    The neighbor said he had seen this earlier but hadn't had a chance to speak with the previous homeowner about it. He thought that the tree would need to be removed to prevent further damage. He asked if he could trim it back, which I said was fine. When I went to look at the tree later, he had removed all the branches from the tree and it was just the trunk left. I hadn't expected this but assumed that the tree would die since it didn't have any branches. Sometime after, a month or two he came back with a google search print out listing tree removal services I could use to remove it. I assumed it was dead and he didn't say anything else so I just put it aside. About 4 months after he trimmed the tree, he came back and said the tree had further damaged the wall because it was growing back. He showed me the wall and it was bowed a bit into his back yard and the tree was sprouting branches again. I removed the tree and watched to make sure it was dead. This was in August of 2020.

    He emailed me in March this year and asked what I was going to do to fix the wall. A few searches led me to a mason in town that specialized in retaining walls and I asked them to come give a quote. I coordinated with my neighbor to let him know when the mason would be over. When he looked at the wall, both I and my neighbor were present. The mason said that the wall was holding and a buttress would be the cheapest option that would reinforce the wall and last "until the both of you are long dead". My neighbor pointed out the cracks in the wall and said he thought that the wall was failing and should be replaced. The mason didn't seem concerned and said that the wall was still holding. I asked the mason if the wall was still structurally sound and he said he couldn't say without digging into the dirt from the other side, at which point it would start costing money. I got the sense he didn't want to put his word on this which I understand.

    The mason left and a day later texted me the costs for replacement of the wall or adding a buttress, 4k and 2k respectively. I passed these along to my neighbor via email and said I would be willing to pay half the cost of the buttress since the structural integrity of the wall was my only real concern. I did not hear from him until a month later when he sent me a long email saying that the responsibility was mine since the wall was built to hold back the topography of my property and the tree that caused the damage was on my side of the wall. He said "case law" states the property owner has the duty to maintain the retaining wall to protect subservient property and that duty carries over to land and all successive owners. He said there might be a solution we could come to to migitage my costs and he was willing to discuss them, also mentioning I should check with my homeowner's insurance. Lastly he would like to get it fixed soon before our monsoon season to prevent it failing and damaging his property.

    I did a cursory google search, and came to the opposite conclusion. My neighbors land is below natural grade, so if anything, he needs to pay for the wall to keep my land intact. That said, I'm guessing the tree complicates things.

    So that's where we are now. My concern here is that he didn't fix this over the many years the tree was there and did not speak to the previous owner about the tree and now this has become my problem. The inspection when I bought the house said nothing of this issue or that the tree was planted that close to the wall. At the least I would expect him to pay half of the repairs since the wall is shared by our properties but it feels like he is unwilling given how he responded in the last email. I'd rather not make a claim to my insurance to face higher costs.

    So does this seem like I should be paying to replace the whole wall / add a buttress or should I seek legal counsel?
