Advice To Get Ex-Wife Out Of My House In North Carolina Posted: 28 Apr 2021 04:06 AM PDT Slightly confusing but any help appreciated. I'm currently stationed in the UK. Been here over three years now. Before that I was also overseas for a year. My ex moved into the house I own with my kids when I was leaving so they didn't have to move in with her and she could still be a parent as we had divorced a couple years before that. It was only supposed to be for the first year but then I was given this opportunity. Spoke with her about it at length and we both agreed to it with the understanding that she would vacate when a certain goal was met and I returned (goal still not obtained), or my youngest reached 18 and graduated high school. My youngest and my oldest have moved in with me over to the UK now and she was supposed to leave after the first of April. She's still in there. I had turned off the utilities but she just got them turned on in her name which confuses me since she has nothing that says she rents or owns. I had to provide a million and one documents showing I owned it before they'd turn utilities on. Just need to know what I can do to force her out and get her out of my house. My mom who is handicapped is supposed to move into it. I spend a fortune redoing a bathroom to be ADA compliant for her and she's stuck waiting. Thank you. Well, this trumpeter has still been coming here basically every night since my original post 9 days ago. Actually it's gotten worse, last night he was here from 2:30 - 5:30 AM blasting his trumpet. I keep calling the police on him every night (I've called about 10 times), and they still do basically nothing. The guy often just keeps playing after they leave; he still returns every night. I'm going crazy about it. I even went to the local police station last week in person to discuss this and was told they could not do anything other than ask the man to leave when it happens. My building management also called police and was told the same thing. I actually started to look into moving out and breaking my lease because of this. I have been sleeping an average of 3 hours a night for the last 2.5 weeks because of this trumpeter. I am so sleep deprived and basically unable to function at this point; it is seriously hurting my life. Well, I was talking to my dad about this issue today and he decided to contact the police department for me. He lives out of state so its not impacting him directly, but he wanted to just see if he can get any additional information. He called them and initially was told the same thing, that they can't do anything except ask the man to leave when it happens. My dad then stated to the officer on the phone that he is looking into suing the city for their non-existent response to this issue. Well, the officer then started flowing out with the information needed. The officer told him that this same issue (same trumpeter) was happening in a different area of my city (I'm in Florida), and the way they were able to get rid of him is they had to contact a special division of the police force called the "civil code enforcement office." Only the civil code enforcement office is able to issue the man a fine. The normal police are not able to do so because of stupid bureaucratic red tape bullshit. The normal police will not contact the civil code enforcement office for you either, only you can do that. The code enforcement police will respond at 3 o'clock in the morning - it may take an hour for them to arrive - but if they do arrive they will issue the trumpeter a fine and will continue to issue a worse fine every night he returns. According to the officer, this apparently already happened in a different area of the city and they were able to get rid of him, so I am hopeful I will be able to do the same. I don't know how many nights it will take of him getting fined before he stops returning, but hopefully he will stop returning soon and I'll be able to return to my regular life of not being severely sleep-deprived and not have to move. I wanted to share this because it can be really like pulling teeth with the police in order to get information. I wish I had consulted a lawyer earlier as I may have been able to find this out before today. If you are ever dealing with an issue like this, look up the specific city/state office that may be relevant and contact as many of them as possible until you get the information you need as the police will most likely not give it to you, especially in a big city. Simply annoying the police and calling every time is not enough if you want a more permanent solution to your problem, which is what I have been doing and was suggested by many people in my last post and has been completely unsuccessful. Update: Wage Discrimination Issues Posted: 28 Apr 2021 09:41 AM PDT Location: Pennsylvania I didn't get a lot of responses on my original post but I did think it deserved an update as it may be able to help some one else in my position as I received some not so accurate advice on here. My employer at the time of the original post is now trying to sue me for violating my non-compete after I left to go to a similar company six months after my resignation. I made it very clear to my employer that money and lack of job title was the reasons I was choosing to leave the company. I left on very good terms and was told if I ever wanted to come back I could. Their legal threat caused me to retain an attorney who when he found out why I left, said I have a text book wage discrimination complaint as I was doing the same job as the men in the department for an extended period of time with obviously unfair compensation. This made me do a ton of research and people should know it doesn't matter if they negotiated better or if they had more experience. We were doing the same exact job which required the same skills and I was repeatedly turned down for asking to be brought to their level despite my performance. It also has come to light that all 4 women in my department made less than the 2 men in the department, including the female supervisor. We are now counter suing and challenging the non-compete. He'd express his attraction to me and talk about how amazing he was for most of our meetings. I work for a company that are refusing to pay me my overtime this month as I missed submitting my electronic claims form by one day. I had no idea that I would not be paid as I normally submit it on that date and get my normal pay. But apparently as this is overtime, it needs to be submitted on another date that I missed. I was doing the overtime as I am pregnant and in my pay window for my maternity calculations. The extra overtime was meant to boost my pay so I would get slightly more for my maternity. It's a well known thing and many others have done this no problems. The payroll department have told me this now going to be paid next month and will not count towards my maternity. I've explained to them how important it was for me to have that money paid in and appealed their decision, they have stated no as they can't legally change my payslip as it benefits me. Is this correct? I feel that surely if I worked those hours in that month I should be entitled to them on my payslip. Well-intentioned, high-functioning, but in serious need of all kinds of help. This relative made a series of horrible, irrational decisions and, against all odds, ended up getting a visa to emigrate to an EU country. Upon arrival, unsurprisingly (to the rest of us, who warned them), they learned that this was a fraud scheme -- there is no "job" waiting for them, as they had been led to believe. The supposed "employers" have blackmailed them out of thousands of dollars to secure their employment visa and state benefits, and they have cooperated. If this relative were in the U.S., I would be looking into conservatorship because the situation is so extreme and, simply, insane. No rational person would behave how this relative has behaved. So. I'm on the verge of calling the U.S. State Department and seeking emergency assistance on their behalf. Could anyone advise me on what this process looks like, once started? I don't want my relative to end up in prison, and I feel like a POS for even thinking about essentially turning them in, but honestly they just need to be saved from themselves at this point. False allegations to gain custody Posted: 28 Apr 2021 07:32 AM PDT My husband (40) has shared custody of his son (11) with his ex-wife (46). They have been divorced for six years, and it has been extremely contentious, especially now that her alimony has ended. She has continually tried to mess with the court-ordered custody agreement outlined in their divorce settlement, and has recently ramped up this battle, for what reasons, we're not certain. She seems to be unhappy that their son is disciplined at our house by losing his PlayStation privileges, which makes the son really miserable. Last week, she filed a motion to have the custody arrangement changed to sole custody (for her) with only "therapeutic visitation" for my husband, citing that the punishment their son was receiving was some sort of traumatic stepping stone to violence. The motion had an unnotarized statement from the son's mental health counselor, saying the son is "scared" of his father. All kinds of allegations were made that were very vague, about how the son has said his father is just moody sometimes, "but that language is what you would expect from an abused child, " and "(Child's name) is already the father's whipping boy; we don't want to see him become his punching bag, as well." My husband is not a violent person. He has never threatened or intimidated his son at all. The mother has consistently brought him to our house during our visitation times, and we have returned him. We were allowed (last month) to take him out of state for a week's vacation. We have no idea where this is coming from. As of the day she filed the motion, she has refused to let us see their son. She won't return messages or phone calls, and we ended up having to call the police to enforce the order. She wasn't home when they arrived to speak with her, and they told us we need to deal with this in the courts. The motion she filed (through her attorney) was on the docket for this past Monday, and now is completely gone, not heard, withdrawn totally. We were never served or informed of any legal proceedings, except for an unsigned copy of the unfiled motion. Please offer some guidance here. Her lawyer is VERY aggressive and unwavering (and expensive), and destroyed my husband's divorce lawyer during their proceedings six years ago. We now haven't seen his son for a full week. Neighbor hired a property surveyor Posted: 27 Apr 2021 05:19 PM PDT They pounded a hole in my driveway looking for a property line marker. It took them an hour and a half to find it and the whole time they were very loud. We asked them a few questions about what they were doing and they told us the neighbors asked them to come out and find the "monument" We asked why they did not give us notice (or perhaps even just knock on the door). We asked them what company they worked for or if they worked for the city. They would not identify themselves. the one guy who seemed to be in charge started shouting at us "as surveyors we enjoy our right to trespass", which, I know right of trespass is a legit thing but that just seemed like a weird way to say it? And screaming in my face no less.. so I went inside. He kept trying to go to the opposite end of my house from the line he claimed to be surveying. So i put on MY fluorescent construction vest and stood there with them asking for proof that he was who he said he was and also that he was supposed to be there. And why he kept going to the other side of my house if he's there to do the neighbors lot. He stormed off and his buddy stayed there and took some pictures but wouldn't talk to me when I tried asking him the same questions. Then out of nowhere he asked if he could go in my back yard. Through my house.. because that's where the other corner of the lot should be. But he could've walked around the fence just fine. We told him no and to try again with written notice. And they left. I have since done some googling and I guess it n my state (ca) they're not really required to give notice and I could be charged with a misdemeanor for obstructing them? That can't be right if he never identified himself? Like.. any jackoff with a vest (or at least that was the point I was attempting to prove)and a metal detector could just go around digging holes wherever they wanted if there's no way to prove that you are who you say you are. Resturant charged me for other people’s meal! Posted: 27 Apr 2021 09:26 PM PDT This happened in Connecticut. Last week my employer fired two of my coworkers. This leaves me as the only full time employee. I am the office manager of a warehouse and no longer have any full time warehouse employees. So today my boss decides to pick up and hire two immigrant day laborers to help us out with a massive incoming delivery. Everything is ok until we decide to break for lunch. The two guys I am over seeing tell me that they usually are provided lunch by those who hire them. I ask my boss if I am able to use the corporate credit card to purchase lunch for these guys. My boss tells me no, he is unwilling to pay for their lunches. So I offer to take these two men in my car to get something to eat on our lunch hour seeing as they were picked up by my boss and driven to our warehouse from a few towns away. I inform the guys that my boss is not willing to pay for lunch and that I can drive them to any number of restaurants on the same road as our warehouse. I suggest going to Subway in a plaza a few miles down the road. On arrival to the plaza one of the laborers asks if we can go to a Latin deli in the same plaza instead. I tell them that is fine with me and proceed to enter the deli. Once I get in the deli/convenient store the two men order ahead of me and speak with the server behind the counter in Spanish. My Spanish is very poor and I do not understand their conversation. Then it is my turn to order food. I am a vegetarian I decided to go with rice, beans and a tiny salad. I am given my plate of food and I ask if I pay for it now and the woman behind the counter tells me I can pay before I leave. I sit down and begin to eat my food. I share a table with one of the guys I am with while the other sits off on his own. After about 20 minutes of eating and looking at Instagram on my phone I tell the guys we should get going. I get up, put my dish away and head to the cash register. When I get there the teenager behind the counter tells me my total is $44. I tell him all I ordered was rice, beans and veggies. He says "Oh so your not paying together?" I tell him that each meal should be separate. He then beckons the woman who served us the food, who I now assume is the owner or manager. She adjusts the total for me and I hand her my debit card to pay for my meal. She puts it in her credit card machine, processes it and hands me the receipt to sign. I sign it for a little over $8 and I add a $1 tip. Now that I have paid my bill I look around for the guys I came in with. I didn't see them inside at all so I head outside to my parked car and there they are. I ask them if they are ready to go and they say yes. They pile in and we drive back to my job. At this point I figured they either paid while I was on my phone watching videos or thought that I had paid for them, even though I told them my boss would not pay and I was unable to do so. I really need to get back to the warehouse at this point because a business neighbor called me and said they were there to pick something up so I didn't really think much of who paid what. The story should end there, but before I laid down for the night I decided to check my Chase banking app to see how much was in my checking account. That is when I noticed not only my $8 charge but and additional charge made for $21 from the same deli. I think they tried to charge me for the day laborers food. Now I have a few legal questions. [PA] Posted: 28 Apr 2021 11:50 AM PDT Had a family of 2 call to schedule routine health exams, they are deaf and want reasonable accommodations to help during the exam. We have other deaf patients, so we understand that and are happy to oblige, but instead of asking us about accommodations they went straight to the ADA office who called and e-mailed us about how we legally have to provide that for them. We already knew that, I just thought it was weird they immediately went the threatening legal route first when asking for an appointment instead of asking us first. We hired an interpreter who was taking time off of her other job to come help us. The day comes and they both cancel their appointment. Sometimes life happens, we understand that. I'm a pretty accommodating person so we reschedule the patients, reschedule the interpreter, then the new day comes and they once again cancel right before their scheduled time. Now we've lost four slots for other patients that could have been filled as well as the staffs time and the interpreters time. They have called again to schedule, can we tell them we will not schedule them because of their prior cancellations without fear of them trying to go a legal route? I normally wouldn't think twice about that but with them going to the ADA office before, I want to make sure I don't do anything that would open us up to a discrimination lawsuit. My grandfather passed twelve years ago, and my two brothers and I were named beneficiaries. The executor of the estate was to control everything until we each turned 35, then hand over the deed and any money in the trust. My older brother sold his piece the second it was in his hands. I'm up next, about to turn 35 in a couple months, and due to some issues with the executive of the estate I have requested a copy of the will. The executor of the estate wants to all of a sudden do a lot of work before everything is legally turned over to me (he has also spent twelve years doing things here and there and charging the estate). I told him I don't want any of that work done, and he insisted he HAS to have the property fenced in and the driveway done before it can be turned over to me, in accordance with the will. I asked for a copy and he told me I don't need to see it. Note: I have never, in twelve years, seen the will. Secondary note: I have been living on the piece I am to inherit for about a year and a half. The well was dug in July 2019 and still is not complete. Now I cannot get a hold of him, and my younger brother and I cannot get a hold of the attorney and neither of us have gotten a call or email or text back. Every time my brother calls the attorney's office he is always out of the office for the day. Is there anything I can do? I emailed the attorney myself this morning and plan in stopping into his office tomorrow if I don't hear back. Working Saturdays has always been apart of the routine, but certain people are exempt, like her, for having a daughter who she has to watch on Saturdays. They're now stating that working Saturdays is mandatory for all employees and they will no longer be hiring anyone who won't work Saturdays. They havent flat out said they're firing my girlfriend but they said that she needs to "find a solution for her daughter so she can work on Saturdays." This doesn't seem entirely legal to me. She's been employed for 3 years and works Monday through Friday full time, but they're willing to dismiss all of that because she can't work Saturdays from 8am-12pm. He told me he had the money deposited into a bank account, and he opened another bank account. He plans to transfer the money in small portions to this second account in order to make it seem he is spending 60% on payroll (in order to meet the forgiveness qualifications) I recently learned about the False Claims Act and about Qui Tam actions. Posted: 28 Apr 2021 10:54 AM PDT We signed an agreement to build a new house back in August of 2020. The builder apparently had some serious issues with the grade and drainage plan as our lot has a right to left slope they had to navigate. They did not speak to us or return any requests for comment from August to early December. They cleared the lot in late November which immediately caused issues for the neighbor on the lower side. Come to find out, the neighbor was not able to use their front entrance or garage through the holiday season as it was covered in mud and runoff from our lot and probably the one above us too. (also being built) The builder met with us at the lot in early December and explained how they were going to build the house. They didnt speak or communicate with us again until early March when the building process began. In that time, We found from talking to the neighbor that builder had fired their grading crew and the surveyor and found new ones. We also discovered that our neighbor has filed a civil suit against the builder and involved the county code board as the drainage issues have caused damage to their flooring and destroyed some shoes and clothing. Due to the builder sitting on their hands for several months, the economics of building the home have changed. In fact, the price of the house they are building next to ours (which is not under contract to anyone) was just pulled off the market and repriced 27k higher. We know the builder is most likely under water on our house build but we cannot back out and lose our construction deposit. Therefore, knowing they are in cost cutting mode, we are concerned they wont fix the final grading correctly and there will be ongoing issues with the neighbor. Am I crazy to think that as soon as we close the builder will claim that they are no longer the owner and that the lawsuit will then be directed at me? I have already reached out to a couple of lawyers in the county that list building code as part of their expertise. What should I be asking and aware of to protect myself and my family? I confronted her and said if she doesn't start pulling her wait I'm kicking her out of the band, she immediately said she doesn't care about the band anymore and will gladly leave. BUT, she is under the impression the band can't go on without her because she has written all the lyrics for our songs over the last 3 years (roughly 12 songs) and that she owns 50% of everything we have made (I should probably state at this point that we are a fairly successful band) which of course she does, legally. But my counter is that she has absolutely no interest in the band anymore, and hasn't shown any sign of interest for over a year now and hasn't contributed anything, financially or otherwise.Is there anyone i can legally keep this band going without her, even if it means removing all songs she has had a part in? The organization in question stated they would be able to sell expensive equipment to us at a fraction of the cost and since our equipment is expensive, I signed up thinking it would be a good deal. When it came time to cash in on the promises they made, the organization had closed their doors for business due to covid. They were not taking online orders and did not make themselves available for service. They also closed the gym facility and yet still charged me for a service they did not provide for well over the majority of the year. When I asked them to cancel my fees, they declined despite my bringing to their attention they did not uphold their obligations to me as a purchaser of their service. What can I do about this? I used the service weekly from May through July when my nephew asked if he could start cleaning my house for me to raise money for collage. I canceled the service, and never thought anything else about it. Suddenly, last week the company I was previously doing business with decided to show up and clean my house while I was at work. Despite trying to come to some sort of resolution with them, they are continually telling me that they cannot refund me, because they contacted me three times within the past few months to confirm service (through the aforementioned no-longer-used email). *Again, I don't need a refund, they don't have my current card info.* Part of me feels bad for not paying, but at the same time, they provided a service I did not ask for, and tout on their website specifically that they are a no-contract service you can "cancel any time". Need Help With Creating a Nonprofit as a Minor Posted: 28 Apr 2021 11:21 AM PDT Hi, I am a 16-year-old who lives in Florida and I want to create a nonprofit 501(c)(3) corporation. However, due to my age, I can't be on the board of directors. I was wondering what the process would look like or if it's even possible to register the organization in a state such as New York that has laws allowing for youth board members and operate in Flordia as a foreign Non-profit. Posted: 28 Apr 2021 09:01 AM PDT I'm in CA and am feeling stupid and and worried that I may have done something to get myself in trouble. My husband passed away recently and, with a huge tax bill coming due, I went into his personal account and transferred the money he had been saving for taxes to our joint account. It seemed reasonable at the time, but I haven't been thinking very clearly, and now it seems obvious to me that I should have waited until I contacted the bank. Real estate, pulling out within condition of inspection allotted time Posted: 28 Apr 2021 11:55 AM PDT In Ontario Canada if someone placed an offer on a house under condition of inspection and then pulled out before the allotted time was up without doing an inspection is that technically illegal.? Posted: 28 Apr 2021 01:01 PM PDT This happened Monday in Asheville, North Carolina, while I was driving home from the beach. I live in Maryville TN. The 71 yr old man, a NC resident was driving for a local company. It was estimated to be about 30,000 lbs. We're pretty sure he wasn't properly licensed for that amount of weight, and I BELIEVE he had no CDL license as the info exchange sheet said he didn't. I haven't obtained a copy of the police report yet. I dont know how DOT operates but in pretty sure you have to have a CDL above 10k or 20k lbs. While I was driving along Interstate 26 the lanes began narrowing and there were cones set up to lessen the number of lanes as we approached a busy junction in Asheville. We had already slowed down to about 60 before we came upon the cones. Before I know it the car ahead of me was stopped. So I slam on my brakes and lock up, swerving into the empty lanes that were cordoned off by the cones, ending up about 5 feet shy of being side-by-side to the stopped vehicle I missed. Pretty at a complete stop by this point, a Chevy 2500 or 3500 with a gator step trailer behind it with cinder blocks on it, smashes into my little Toyota Corolla. I mean it SLAMS into us. It was like MechaGodzilla hit us. It was instantaneous and with my foot still on the brake, about 1 second later he hits us a 2nd time. I take my foot off and drive about 100 or maybe 200 ft because I dont what's behind me or what's gonna pile up, but I have to get us safe before I can get them out. In the backseat is my girlfriend, my 3 yr old son in the middle, and my girlfriend's other son who is 8 yrs old. In the passenger seat next to me is her sister. Thank god there's no major injuries. The 2 girls are pretty beat up, with my gf in the back right getting most of the impact because of the swerve I had to do. The kids are completely fine, the older one has a small bruise on his back but that's it. And I'm completely fine too besides not being able to stop thinking about it and how scared I was when I thought my girlfriend was dead. My vehicle on the other hand, is not fine. These are the pictures. As you can see, it definitely looks like its been stepped on by a mecha. Here's where I'll be called stupid. I owe on that car, about 9 grand. I dont have the gap insurance. And I only had liability through Geico. I've been told I was supposed to or was required to have full coverage since I am financing it from DriveTime. But nobody ever said nothing.. not Geico, not the dealership and not any government body. So yesterday, I dropped a thousand dollars on a rental for a week and a half. And I'm insure of what to do until I get a lawyer, IF I get a settlement. It could be months and months. Really I want to figure out what the best course of action is in regards to filing a claim with his insurance. Is that what I should do? Geico hasn't been very helpful seeing as I only had liability. When I get a lawyer who are they going to sue? The man driving or the company he worked for? Where does his full coverage insurance come into play? He had Nationwide General. I'm really stuck and I'm going to see a lawyer next week but thought I'd turn to Reddit with my story. Edit: I know I screwed up and I didnt take any pictures of his truck. It was just so much in the moment. Just the one is there that my sister-in-law took. You can see the difference when the car was on the interstate and after we pried it open to get our stuff out. We're pretty sure the packed full duffle bags and back packs right behind the seats in trunk, saved the 3 people's lives in the back seat. Maybe all of us. [link] [comments] |
