Posted: 05 Mar 2021 08:01 AM PST Edit: Location United States (East coast) So when I was a teen (16), I did a lot of writing to journal my feelings. I'd create characters and diary my life through them. This resulted in PAGES of novels I would have saved on my laptop. My parents checked my computer and found the content. When they asked me what all the writing was, I lied told them I had taken to fiction writing and they were novels I had written. My super proud parents then took this material and self published it, distributing it to friends and family. Having your diary published and distributed to everyone you know is humiliating enough, and I never received any compensation or anything from this book so I figured they had just printed it to distribute and not actually published. I thought it died off and was now just a bad dream, until I decided I would start writing as an adult, and to my shock and cringe, saw I already had publications to my name with ISBN numbers assigned. The publication company closed down, and the book is no longer being printed, but I do not want this material linked to me as a new author. I never consented to the publication in the first place! I've emailed Amazon, who cannot (will not) remove the listing because a used seller could list the book. I bought all paper copies from every site I could find and destroyed them, but the fact it exists makes me uneasy, especially since I had never intended on that material being public. Are there any legal avenues I can take here to get this removed? I was 17 on the date of publication so I could not have entered any contracts with the self publishing company, but they don't exist anymore so I don't know what to do. I've reached out to sellers listing the book telling them to remove it, and emailed the folks at the ISBN distributary to see if there's anything I can do there, but I'm afraid my diary cringe is going to exist in the fabric of the internet forever. TLDR: My parents self-published and got an isbn assigned my novel-formatted diary when I was a teen, without my consent. Having spoken to support, this was acknowledged by their margin team as an error on their end, and I also learned that the "disappearing" transfers was due to being flagged for further review because apparently it exceeded some maximum number of transfers. Initially the guy seemed very confident that this could be reversed, but ended up returning after 30 mins on hold by saying his superiors couldn't do anything. Why? Because the position was too big, as though their mistake is somehow my responsibility. So first they pull from margin to "fix" their own error that should have prevented the transfer to start with. I never spent a penny of this money after seeing the mistake and further fully covered the bogus margin call in time. This didn't matter though due to yet another mistake on their system, flagging it for further review which prevented me from being able to avoid being margin called.

I won't go into detail but the job was sort of forced upon me. He has Congestive Heart Failure, Diabetes, Dementia, you name it. He was living with his daughter in South Carolina before he moved here and the CHF started us down this road shortly after. Due to insurance issues, I haven't been paid for my work and they can't find a nursing home to take him in. I can't do it anymore. My own health has declined rapidly and my mental health is the worst it's ever been. I don't want money or anything like that. I just want a chance to live my own life. I can't just leave because it's been engrained in me that you can't just abandon someone who can't take care of themselves, but I honestly don't want to live anymore. Just got called from the office and it turns out the title I have is not for the trailer I'm living in, but the trailer across the street which the man also owned at one point. They are going through the eviction process with that trailer which is how they found out. They have never dealt with this situation before so they're going to get back to me but I'm freaking out. I put so much money into fixing up the interior of the trailer, and its been our home for the last 3 years. I have no idea what I should be doing. I signed all my documents and then got a check that was lower than what I expected. So I looked at the final Closing Disclosure (CD) and there was a $750 charge that was marked as processing fee. This was not in the CD that I signed. The buyer's bank is Wells Fargo. Can they do that? I have been trying for months to get this resolved but the gaps in communication are getting longer and longer . Everyone is looking into it but not doing anything to reimburse me. Real Estate Agent has disappeared. Closing agent says they are there to help but have no money to give me. Buyer's bank is ignoring my emails. What should I do? Ex-wife scamming covid relief funds and low income free lunch and supplies programs Posted: 04 Mar 2021 08:34 PM PST My ex and I make combined about $200k a year. She gets over 50% of that through child support. We have shared custody but apparently Ohio law in our county doesn't make it 50/50, she still gets more than 50% and I make 70% of the income. Regardless, she makes $60k a year as an ESL teacher and the rest comes from child support. Which means she works with low income, non-English speaking students and their families, helping them translate forms, get extra assistance, etc. Not saying all non-native English speakers are low income, but where she works that is the case. All this is to say she knows her way around the school programs that offer free assistance. Yet somehow, despite her being over double the income requirements to qualify for the free breakfast and lunch program, she has our kids enrolled in it. I found out by error in looking over their lunch balances, which I fund, and called the school because I thought there was an error and they told me all the kids were enrolled in the low income program, getting free breakfast, free lunch, free school supplies, etc. This bothered me, as I felt slimy my kids were in these programs, effectively stealing from people that actually need it, but the school said they couldn't do anything and I needed to contact the state Dept of Ed. I did and they replied months later telling me to take it up with the school. Sending me in circles. Skip to a couple days ago, and I get a VM from the state of Ohio (I guess they have my number somehow) with a recorded message telling me debit cards are in route to the address listed with the school (my ex) for low income school covid pandemic relief (ie, kids enrolled in the low income program are getting extra payments - VM was from ODJFS saying the kids were getting p-ebt debit cards sent for each of them). This is on top of all the stimulus payments she got, and got for the kids, because my child support is after tax, so it's not reported on a tax return, so she meets the income requirements to get stimulus payments for herself and all of the kids. She is clearly falsifying the forms with the school, as gross income and child support are required fields on the form (per the school when I asked), but they have no obligation to validate the info provided on the forms. So now I'm upset. I'm normally fine just staying out of her scams, but I feel super shitty knowing my kids, who have two well earning parents and are well taken care of, are taking from programs dedicated to low income citizens and those that lost their incomes due to the pandemic. But the state depth of Ed kicked me to the school already, who kicked me to the state dept of Ed (presumably because the school is in an affluent suburb and they a) get federal money for kids in the program, and b) like to feel good about themselves, like "we're all rich, but we give back and support the needy). Posted: 05 Mar 2021 07:40 AM PST I am 17 years old and I was in an abusive relationship in which my boyfriend (we were both 16), sexual coerced me many times, touched me without my consent while I was sleeping, attempted to force me to let him give me oral sex despite me saying no many times and I had to push him off me, took the condom off without my consent, and strangled me in anger twice. I decided not to press charges at first but I decided to tell my story online as part of my healing process and I named him. I called him my rapist because I believe the level of coercion was rape. His parents lawyer sent my parents a cease and desist letter saying the allegations are false and that I need to stop posting AND post a retraction or else they will sue me for harassment/libel and get a restraining order. So I went to the police and he was arrested yesterday!! My questions are: -Can he still sue me for libel? Maybe for calling him a rapist, since that term is interpreted different ways? -is it bad for my record if he gets a restraining order against me? I now have one against him, can he still get one against me? -if he's acquitted is it worse for me? Is he more likely to win a libel case? Posted: 04 Mar 2021 02:52 PM PST Some context: I live in GA, my dog did not have a tag (I was going to get a new one since he lost his), and he's a small chihuahua. The time he was impounded was some while after 4 since that was the last I saw him. My mom noticed he wasn't home when she got back at around 5:30. My father went to go check if the pound got him the following morning. To our surprise he was already euthanized!! This could have easily been avoided if the dog was kept for at least a day and not put down on the spot. Is this even legal??Thanks for the help. Edit: Thank you guys for your advice and condolences. Edit 2: For anyone wanting to know, my poor little chihuahua did arrived injured due to another dog attacking it. The owner of the other dog found my chihuahua and was diagnosed with a broken spine and a few other complications so they had to put him to sleep :(. Last August, I bought a used truck from a small dealer. I paid $5500 via my Visa card, all was fine and good. I had temp tags that expired before I could get an appointment at the DMV. I finally get into the DMV about 6 weeks later, come to find the dealer never registered the sale with our states DMV, and I couldn't get a title to the car or register it. The DMV representative advised I'd need to return to the dealer and have them file the proper paperwork. They took their sweet time, and I finally got my title 10 weeks after the sale. This posed a huge issue for me, because the car I bought was only meant to be a temporary fix for approximately 2 months. I had a buyer lined up for the car but wasn't able to sell it due to no title. Before the title came, when I had the initial DMV appointment, I contacted the dealer and offered to return the car due to not being able to register it. They refused, and I decided to file a dispute with my Visa card, citing the lack of title and ability to register it, rendering my purchase unusable. Visa reached out to merchant, but ultimately found in my favor and refunded my $5500 (Nevada state law says dealer has 30 days to provide title, I got my title on day 87). Once the dispute was finalized, Chase told me I could return the item. Dealer refused several times and demanded payment. At this point I had all the money, the title, and the car. I tried to work out to return it, but to no avail. Now, 7 months after the purchase, I received a demand letter from a lawyer for the purchase price. I again offered to return the vehicle and to even pay $1000 as a usage fee. Still denied. Lawyer and dealership have been incredibly unprofessional (threats, curses, etc). I'm not interested in going to court (even if served, court is backed up for 12-18 months in my state) and I'd like to move past this. How do I properly word a letter to the lawyer and offer a lesser amount as a settlement? I am one of 2 production managers of the facility of around 50 people and I handle pricing with the line of product I am over, along with production scheduling, production manager, engineering manager, and creating part numbers for anything ordered or sold. I am overwhelmed. Our salesman gets paid a certain commission and I get paid a certain commission plus an hourly rate. I handle pricing on jobs and there are no checks and balances in place to regulate what I do, but I do the best I can. In the last 5 years, we have changed the way we price 4 or 5 times and have a product line well over 300 individual parts. I have been given leeway to price parts that are not standard and not have to do a formal quote on each individual part based off that parts similari to another. With the price system I created this last time, the owner said he wanted to make a certain dollar value off a product and I had to come up percentage margins to create to get a retail price plus discounts for customers who use more of our product. When I came up with the system, I showed to the owner and got "that works". I had a conversation with the owner before I was sent home yesterday about how I should be in handcuffs right now and how I have stole money from him not charging enough for product knowingly and that the salesman and I are getting compensated, but he is not making money. If I charged more for the product like he wishes, then I make more money if the product sales. From a character standpoint, I have never had any malicious intent to steal money from him and get along great with every employee. I feel like what he said is manipulating what has actually happened. Have I made mistakes? Certainly. I have to meet again with him next week and have the feeling I will be faced with continuing to work with him to pay back the money or if I choose to quit, possibly be forced to back pay money if I leave. I was very young when this happened and my uncle was made the executor of her estate. When I turned 23 I inherited half of a condo in New Jersey that they owned and we promptly sold it. I was under the impression that since that was all I inherited that all other property that my parents owned had been sold off years ago. There were a couple of other properties that they owned that I was told were sold off when I was kid so I had assumed that the land was also sold. After 90 days they gave her another raise for stellar performance. A week later she's tells them she is pregnant while asking about maternity benefits. Employer has been freaking out about her not returning. She made one small mistake that has previously not even had anyone written up for (answered an email incorrectly, but it wasn't a detrimental error and sent a quick follow up to the client fixing her mistake) and they fired her anyways. I paid first, last, and security deposit up front. The landlord asked if he could return the last month's rent and security deposit on 3/31. He was supposed to send me the lease but never did so it is verbal agreement but I have texts of our agreement and pictures of the money orders I gave him. I also have a agreement for the security deposit he signed but I know I have to give him 15 days after move-out to get it back. My Lawyer Sucks - can I get my money back? Posted: 05 Mar 2021 10:32 AM PST I relocated last year to be closer to my kids (whom my ex has primary custody of). She seemed all for me moving but after I got there, she told me she was moving the kids across the country. I had some concerns about the kids: she was having random people in and out of her house, the kids were never bathed or had their teeth brush, both kids (12 and 8) were wetting the bed and pooping themselves during the day, and both kids said they were afraid of their step-father. I get the kids every other weekend and in the past when I have raised concerns, she took the kids from me and wouldn't return them. Because she was leaving and I wouldn't be able to investigate these problems further, I went to see a lawyer. The lawyer suggested going for full custody. He said he could get a restraining order to keep the kids here until custody was settled. I paid the lawyer a $3,000 retainer plus filing fees. The lawyer did not get the order in time and my ex left with my kids. She was not served until October and we had our first court appearance a few days later. The judge pushed the meeting back two weeks because she didn't have time to hear the case. At that time, the case was dropped because the lawyer had not filed the correct paperwork. He assured me that he would file again and get the case going but that was almost six months ago and I have only heard form him once since then. He called to ask me about getting the kids medical records - something that he told me he was going to do in July. I am so frustrated. I've paid close to $4,000 at this point and feel that he has done nothing. He said that the retainer was nonrefundable, but he hasn't earned the money! Is there any way to get the money back? Condo HOA constant rule changes (US-Iowa) Posted: 05 Mar 2021 10:13 AM PST Greetings! Coming here looking to see if anyone has any experience with this or help me out with my situation. I am a fresh college grad, my girlfriend still in college, and we live in Iowa. We recently rented a condo that is pet friendly (but slowly becoming much less pet friendly). We signed a lease last May and moved in shortly after, we then re-sign our lease for the next year (August 2021-July 2022) at the end of December 2020 which we did out of fear of not being able to find a place as affordable as this away from the downtown college scene as the landlord scheduled our first apartment showing January 5th prior to us re-signing the lease. Now for the issue. When we first moved in all was good, the HOA was accepting of our pet and all was good. As time went on they started to implement some new changes to the pet rules through the board. These were fine, nothing big and it doesn't apply to us—we pick up after every time we go potty outside, she is always on a leash, she is friendly, very minimal, if any barking, etc. Well we re-signed our lease in December and now the HOA at the end of February implemented some ridiculous new rules. Dogs cannot go to the restroom beside walk ways in the grass, they must go 30 ft. away from the building (hardly 30 ft of space between the building and sidewalks/parking lot), dogs may not enter through the parking lot door anymore, only through around the back and if observed entering or exiting through parking lot door, owners will be assessed escalating $50 fines. They also plan to bill units $500 if they are seen not picking up after their pet immediately after going to the restroom (not a big deal for us, we always have bags for clean up right away so we know this will never apply) and just a few other ridiculous rules. Had these rules been put in place prior to us signing our lease, we never would have re-signed. We often take our dog places and not using the front door to simply walk inside is ridiculous, her not being able to go to the bathroom beside the sidewalks we walk on is ridiculous, and the threat to DNA test dog poop to see which dog they think is pooping out back will not give them answers as it will only tell them the breed of dog it comes from and there are at least 7 different kinds of "doodle" dogs in the two 12 plex units I live in and next to. I guess what I am asking is if there is a way to get out of this lease or contest some of these policy changes and fines that have been added? I know I signed a lease and everything so I don't need people in the comments telling me i shouldn't sign a contract if I don't want to follow the rules or whatever—I get that and will live out our lease here if there are no other options. I refused the the test and in court it was brought down to "reckless driving" and probabtion for 6 months and I thought I would be cleared. Well my mugshot is online and I am a school teacher and it is pretty embarrasing when students google my name and they find my arrest record and mugshot. I was reading that these websites require you to provide documentation from the court that the case has been "sealed". Can someone assist me on the proper documentation / forms I need to provide to the court to begin this process? I have been quoted $1000 - 2500 to have this done by an attorney but if it is possible to do this myself, I would rather pay the document and court fees. I'd like to leave a very honest review of this complex on a couple of review sites to warn others. I'm pretty sure the owner or manager will know it was me based on the exchanges we've had and the kinds of things that I will mention in my review. How much legal risk will I be exposed to? It is not in an area where it hasn't done any damage, there is nothing there but a dirt floor, which is 6 inches of mud now and totally separate from everything else (different room/different part of the built house/limestone and dirt vs the rest concrete etc) The landlord is only authorizing the plumber to come turn the water off (which still works in the house) not fix anything. The pipe is leaking because he didn't take care of them the 2 other winters they froze and was told to by the plumber (both previous winters). I am disabled, what do I do? Posted: 05 Mar 2021 01:47 PM PST This is in Michigan, U.S. Yes I know, lazy on my part. I was given a verbal confirmation one time paying my rent in person, asking "This isn't late, right?" I was told verbally that my rent was not late if it was paid on the 5th of the month. This was back in October of 2020. In fact, I dealt with a late fee issue before that was resolved in which they charged me a 10th day late fee when they received a check on the 5th, which they then told me I did not owe. I even had a credit around this time, and i'd paid on or before the 5th every time before that. Now the complex manager is telling me I owe $700 in late fees because i've always paid on the 5th, when my understanding was a solid "It's not late if we receive it on the 5th". They don't even cash my check until a week after they receive it. The whole thing is sketchy. The only documentation I have is a few rent receipts and maybe the original lease, i'm terrible with keeping records. Do they have the grounds to do this?
