[NC] I got diagnosed with cancer in December 2020, today I started receiving cemetery brochures.

    Posted: 27 Jan 2021 03:40 PM PST

As title says, I believe the hospital at the oncology department has been leaking information to the local cemetery and now I'm receiving advertisements for cemetery arrangements.

I never told anyone that I was diagnosed or entered any of this information online, so I am 100% confident that someone within the oncology or hospital has leaked my information.

How can I go about resolving this, what legal right do I have?

Check was short 10 hours of OT, company told me to "kick rocks"

    Posted: 28 Jan 2021 06:38 AM PST

I worked for a construction company as a contract worker, working 7 days a week, 12 hours a day, overtime after 40 hours. The job ended, and on my last paystub it showed it being 10 hours shorter than it should be. I reached out to the person in payroll, and they said they needed to get in touch with my foreman to confirm the hours... I tried getting in touch with him, she says she can't, and they told me that they can't pay me the missing hours until I get in touch with him, so he can call her to confirm them. He said he would call, but it's been a week and he's ghosting all my texts and phone calls. Do I have any legal actions here? It's not just $50 bucks or so, it's short nearly $500

Company is based out of Ohio, we were working in Indiana

Edit: By contract I mean I get a w2 from the company and I'm hired by the company, but it is just a temporary job where I with until that job site is completed

[Michigan] Seller Wishes to Remain Tenant in Home

    Posted: 28 Jan 2021 04:14 AM PST

    Hello all,

I am under contract to purchase a home in Michigan. The process is nearly complete and I am expecting to close next week. Yesterday I was notified of the Seller's desire to remain a tenant in the home until February 19th due to a family emergency. I am very concerned about accommodating this request for several reasons:

    1. Due to COVID, evictions are not currently possible in the state of Michigan. My opinion is that this makes the request to become a tenant unreasonable. A few weeks can easily become more and I have no desire to become a landlord regardless of the current pandemic situation, let alone over the house I intend to live in. If I go this route, I am not sure what I need to do to ensure they are out of the home by the agreed upon date.
    2. I have previously been willing to accommodate seller requests such as moving the closing date forward by 1 week (after an initial request to move it ahead by 2 weeks) and removing contingency from my offer. Obviously I understand that things happen, but based upon the seller's previous request to pull closing forward, I am less interested in agreeing to this.
    3. IF this issue causes the deal to fall through, any potential financial damages the seller has done to me due to multiple hard credit checks during mortgage rate shopping. In today's market I do not expect to find another desirable home quickly. This is the only home I have even looked at.

I have reached out to my lender about extending the closing date (because I do have a desire to accommodate a family emergency), however I am not sure what options are available here since it has already been through underwriting.

Any advice would be appreciated. Thanks.

Can I file a civil suit against someone who crashed their vehicle into mine, if insurance found them 50% liable? [CO]

    Posted: 28 Jan 2021 11:32 AM PST

In December a man texting while driving rammed his truck into my car. He admitted texting at scene to police, but wouldn't admit it to the insurance company. As it was on private property the police refused to file a report. Because the only evidence we have are photos of my car at the scene afterwards (not his), and the word of my driver and passenger, insurance deemed it 50/50 in liability. My car is totaled. It is over 2x the worth of the car to begin fixing it, while his only has scratches on the bumper.

Is it possible to sue him in civil court for the cost of the car when insurance has deemed him 50% liable, or am I stuck with insurance's payment of 1/2 the worth of my car that they've deemed 'irreparable' and totaled out?

My ex ran off with all of our house money - legally how do I get it back?

    Posted: 28 Jan 2021 07:05 AM PST

UK - this post is on behalf of my step dad :

I (50M) my ex (50F) had a long term relationship and broke up a few years ago. I worked full time as oil and gas manager and made 16k a month. My ex did not work and she was in charge of paying bills etc for our house.

I transferred my wages into her account each month and she dealt with the mortgage/bills for us and saved the rest. When we split up, the house was sold for 350k (with 150k paid off). I moved out whilst the house was selling and then when it sold, she disappeared without a trace.

I have had no contact with her since and gave up looking. We have found her on the electoral roll and my fiancée and I want to be able start our life together. Is there any point in perusing this legally as I have walked away with no money after working for years and having nothing to show for it.

Any advise is greatly appreciated! :)

Can I be held liable for my grandmother if I have power of attorney? I'm very scared and worried. Please help.

    Posted: 28 Jan 2021 11:19 AM PST

I love my grandmother and we have always taken care of our own BUT in this situation I can not take my grandmother in due to I am already taking care of my mother. They HATE each other and will possibly kill one another. My grandmother also needs more medical attention that would be given by the nursing home.

The hospital is telling me I have to take power of attorney but I have never done any thing like this before. If she owns a debt can I be held responsible? I ask because both my mom and grandma are both hoarders and will do even possibly illegal things to get money so fund their spending problems.

I'm very stressed and scared because i feel like I'm choosing my mother over my grandmother. But I dont want to be held responsible for the illegal things she may come to light. What can I do ? What should I do ? I have worked very hard in my life to distance myself from this family problem and now I feel like I'm drowning in it and don't know what to do.

    I live in hammond, la.

(MS) My sibling is renting our condo out to people, but claiming that because 'she' pays the bills, it will belong to her.

    Posted: 28 Jan 2021 12:09 PM PST

My sister and I inherited a condo worth maybe $40k-$50k. It's on the other side of the country so I can't get there without fling and quarantining.

Initially we were both responsible for the cost, but then she moved into it and took over most of the bills because I couldn't use it while she occupied it full-time. I still paid my half of the property taxes and we had a verbal agreement that she would buy me out when more of our properties sold. (We had a written one but she backed out of it as soon as she moved into the condo)

She eventually got married and moved into her husband's house. We talked about the condo and she said she let her in-laws live there temporarily, so I couldn't use it, but that they were covering the expenses. She later asked if we could rent it out to someone else her husband knew. I agreed and asked for a rental agreement. She cut contact and wouldn't ever put in writing who was living there and how much they were paying in rent.

I had my lawyer write a letter to her lawyer asking about this, but it was ignored.

She's been bragging about how she's going to take it from me to other relatives because she paid the bills. But I haven;t been able to use the property, and the renter was covering both of our expenses. She tried to tell me that all the checks for the bills have her name on them, and how she got the money wasn't relevant.

Although he doesn't work in MS, I asked my attorney if she could do something like adversely posses the property if she was paying all the bills, he said no, because she had sole use of it and it couldn't be shared with my family while she lived there.

Are there any laws someone can point me to in Mississippi that indicate this?

Also: We both have lawyers, neither lawyer is in the state where she currently lives. My lawyer wrote her lawyer a number of times asking about this but they have never answered in writing.

Landlord didn't conduct background check, now someone crazy is in my apartment.

    Posted: 28 Jan 2021 01:49 PM PST

    Wasn't really sure what to put as the title but;

Yesterday my new roommate (well call em Bob) moved into me and my other roommate's (Mike) 3 bd 3 bath apartment. Before he moved in he came to look around the place and meet the old roommate and Mike, it was my birthday and I wasn't given notice of him coming so I didn't get the chance to meet him. Mike said he seemed fine and said these nice things about him so I took his word for it, Bob paid deposit and first months rent and moved in yesterday. Last night I was playing a video game and then I heard Bob and Mike screaming at each other and Bob was acting erratic, manic, just outright crazy and so Mike goes back to his room and the next morning (This morning) and he act's the same exact way and even insulting us, so me and Mike are sure we want this guy gone and we talk to the landlord via call and we talk to the landlord and turns out he didn't do a background check on him, but the guarantor, his grandmother. So me and Mike did some investigation of our own, and came to find out this person was charged with counts of stalking, harassing's messaging and terroristic threats. The charges on Bob were dropped. But this person has obviously not changed at all. I honestly cannot sleep, I'm scared and anxious about this person being in the same house as me. I'm disabled, I have enough shit on my mind and already deal with enough but now I have to deal with this. Is there anything legally I can do against my landlord?? I finally got my life going and now this happens. I'm going to have to go back to my parents and there's no way I'm paying rent while I'm gone because of a fuckup by my landlord. Am I fucked? I'm in Colorado.

I am threatened to have the police called on me for taking showers in the middle of the night

    Posted: 28 Jan 2021 12:21 PM PST

I live in an apartment and the neighbor above me told me that my showers are disrupting the silent hours (between 10 PM and 6 AM) and waking him up. He said next time he will call the police on me.

I never dealt with the police before so I am kind of scared. I never got complaints before for my late showers and I don't really think it's normal to not be allowed to take a shower whenever I want in my house but if there is nothing I can say against him then I just have to take showers earlier.

I am a sub-tenant who moved in with the main tenant 2 weeks ago. Two days ago she told me to move out because she has depression and cannot live with a roommate.

    Posted: 28 Jan 2021 05:52 AM PST

(Asking for a friend, as she does not use Reddit)

    -------------

To preface, this is based in Germany, so I understand rules and regulations may be different, but just want to get a more general understanding.

I signed the contract back in November, and moved in mid-month this month. The main-tenant and I haven't talked all that much, as she's mostly not around, which I originally attributed to her work schedule. Doesn't really bother me. However, she is aloof and hard to reach out to when I have questions regarding the new place, which made me feel a little bit unwelcomed.

Fast forward to two days ago...Out of nowhere she approached me and told me that I have to move out because of her depression. She told me she's been feeling under pressure ever since the day I moved in, to the point she cannot even live at home, so she's often living elsewhere (maybe explains why I didn't see her much). She told me she and her ex-roommate were living well together because, and I quote, they "shared the same hatred for humans", which kind of baffled, and frankly, scared me. I asked if it was anything that I did, whether if I was too loud, messy, etc... to which she replied the basic "no it's not you, it's me", and "I don't want to throw you out either".

I'm quite stressed out about this, especially since school just resumed again online, now I don't even feel comfortable living in the apartment I just paid rent for, so I'm temporarily staying with my mom and/or friend. I really like the place, how nicely it is decorated, and its location, but I don't know if I'd even feel comfortable living there until I find my next place.

I think it's out of the question that I'd have to move, one way another, I'm more wondering if there are legalities being breached here, and what I can do to protect myself from such a dilemma.

Radon Disclosure Form - Illinois Renter

    Posted: 28 Jan 2021 11:05 AM PST

Hello! I signed a lease last week and the agent got back to me today and said he forgot to add a radon disclosure form.

The form is titled Disclosure of Radon Hazards. It has two options for the Lessor to check, they are listed here:

    - A Lessee has provided written notice to Lessor that a radon test has indicated that a radon hazard may exist in the dwelling unit that has not been remediated by an IEMA licensed contractor.

    - Lessor has conducted a radon test in the dwelling unit and the test results indicate the existence of a radon hazard in the dwelling unit that has not been remediated by an IEMA licensed contractor.

Neither of the above are checked.

The bottom of the form says:

    - This disclosure should be provided to a new residential Lessee of a dwelling unit any time the Lessor becomes aware of a possible radon hazard in the dwelling unit and that has not been remediated by a radon contractor licensed by the IEMA. This disclosure should also be provided to an existing residential Lessee if the Lessor conducts a test of the dwelling unit which indicates a radon hazard that has not been remediated by a radon contractor licensed by IEMA.

I had previously received, within the actual lease document, all of the regular lead, radon, bed bugs warnings.

So here's my question: Nowhere on the form does it say this form is required if no evidence of radon hazard is present. I've seen other forms that have additional check boxes to note that there is nothing to disclose, but since everything on this form is left blank I'm a bit unsure. Is this normal/nothing to worry about?

This is my first time signing a lease on my own and I would appreciate the help. I've seen other posts about radon disclosure forms but nothing that was exactly this, although I apologize if I missed something and this has been answered already.

I can't bring my child to my appointment?

    Posted: 28 Jan 2021 12:49 PM PST

I gave birth 11-20-2020. Sadly, my husband had to go on deployment 2 weeks later so I've been by myself the past 7 weeks. Now, when I say by myself, I mean completely alone. I have no family, my husband has no family. We have no friends since we move around so much because of the MC. Because of that, I have nobody to watch my child. And no, I absolutely will not hand my newborn to a stranger. So I'm his sole caretaker and that's that.

My problem is I need my PP 6 weeks appointment. Except they won't let me bring my newborn. They said they'll only see me if I leave him with someone else.

    Couple of things to know:

They don't allow anyone to wait in the waiting room or even the parking lot.

I literally can't go to another doctor. If I do, the payment is 100% on me because my insurance won't pay for another doctor. I have 1 assigned doc and I can only change it once a year and that was back in July.

Are they allowed to do this? Can they really deny to see me because I refuse to leave my newborn with a stranger? I'm so frustrated.

    I'm in Oceanside, CA.

    House builders threatening to sue

    Posted: 27 Jan 2021 04:55 PM PST

I was in the process of buying a house for about 6 months but it didn't work out. The house was supposed to be finished by October originally. It was disappointing but the builder said they would have it done by Christmas. Well, come Christmas, it wasn't done. We were getting frustrated but we really liked the house so we gave them until this month to finish. They finished it and the home inspector basically said it was one of the most unprofessionally built houses he'd inspected. They laid the concrete too dense so it was cracking. The concrete was also laid an inch and a half too low. Because of that, the garages foundation was literally shims. The basement was sloped downwards and several walls were bowed. Our realtor told us that we didn't have to buy the house and that we could get our earnest money back. Now the builder is threatening to sue even though they are in the wrong. This is all in North Dakota, by the way.

Is it breaking and entering if my roommate breaks the lock to my bedroom door or kicks in the door?

    Posted: 28 Jan 2021 01:17 AM PST

My roommate and I are at our differences, she has came in my room and done some really gross stuff, like throw feces on my bed. So I bought and lock and put it on my bedroom door. Now, if she breaks this lock and enters my room, is that B&E? I live in California, if it makes a difference. Lol

USPS delivered my package to the wrong address and they can’t get it back

    Posted: 28 Jan 2021 01:00 PM PST

(Texas, USA) I had a package that was supposed to be delivered to my apartment last Saturday and I got an email confirming delivery however I received no package. I double checked that the address and apartment number were correct, which they were. I emailed USPS to start a claim for a missing package, then they called me saying they would try to have it resolved by Tuesday morning, didn't get any update so Wednesday I played phone tag back and forth with the supervisor. Come to find out they delivered my package to the apartment complex across the street and "they're trying to find it and get it back". When I asked the supervisor about when the package is officially declared gone and how I go about getting it replaced he said they aren't liable because it was only shipped priority mail. In my opinion they are 100% liable because they misdelivered it even though the mailing address was correct on the package. I'm just not sure how to go about getting my stuff replaced because I feel like they should reimburse me since it's their fault the package is lost.

A seamstress butchered my wedding dress and made me pay!

    Posted: 28 Jan 2021 09:27 AM PST

So here's the story! I buy a beautiful 1,200 dress for my wedding its absolutely everything I wanted. It was too big for me so I take to a seamstress who specializes in wedding dresses. I picked up my dress yesterday and tried it on....I look absolutely ridiculous and the dress is ruined in eyes. Its 4 inches short in the short, there is a large crease right under my boobs from the stress of the fabric, it's a messy pile of junk. Its horrible and I'm devastated. The best part is she made me pay her to get my dress!!!!! I paid her 330$ to ruin my $1,200 dress. I sent her an email being very kind saying I would like my money back but shes been ignoring me. Can I threaten her with small claims court for the money of my dress, repair, and the new dress I'll have to get? I cant afford another one so I'm not sure what to do. Someone help me write an email that's a believable threat to her of legal action. I'm crushed.

Landlord giving me 5 days notice that he's turning off internet (CA)

    Posted: 28 Jan 2021 12:06 PM PST

My landlord is trying to intimidate me to get me to move out. there are many instances of him creating a hostile living situation.

A little background: When I moved in internet was on the lease. It was so slow (10Mbps) that I told him I would pay the difference to upgrade the speed. For the last 3 years I have paid for the higher speed of internet by including it with my rent payment. The current lease does not say internet is included.

Is our agreement binding even though it's not in writing anymore?

5 days notice. That doesn't seem like proper notice to get new service setup in my name

[NJ] City Street Parking Sign Fell Over and Damaged my Vehicle

    Posted: 28 Jan 2021 11:50 AM PST

    Hi,

So im in NJ (with a township thats a pain to contact). A street parking sign fell over (looks to be old rusted sign) and damaged my fiance's vehicle's quarter panel as well as banged up the hood on my vehicle parked behind her. I took photos and called police to file damage reports to both vehicles.

I also contacted my insurance to do a claim (though i do not want them to fulfill the claim and impact my premium unless absolutely needed). Waiting for the actual adjuster to call to discuss options.

Has anyone had luck or info on how to get the township to pay for this? I have a friend who works in personal injury that provided me with the insurance that the township uses so i'm not sure if its wise to contact them directly. Report should be ready in about 3-5 days.

The bumper got scuffed as well, so i'm calculating a repaint there. The hood was dented and damaged, and for my vehicle they only make OEM hoods (no aftermarket options) so i can see this damage cost going over the deductible for sure.

My fiance's vehicle has a dented quarter panel now, and that is surely going to go over the deductible as well.

Thanks for the help in advance.

    Ex-Fiancé Furniture Split

    Posted: 28 Jan 2021 08:00 AM PST

So I got engaged to a girl. She moved in with me and, of course, since things are going well in life I get diagnosed with MS. I stay home from work because it's effecting me. I become depressed and anxious and she can't deal and moves out. Thing is when we were together, she insisted on buying a new bed and a new couch. I said we didn't need to as I already had a bed and couch but she kept pushing. And eventually I agreed to throw away my bed and couch and she bought the new ones she wanted. Now she's been gone for 4 months and I'm about to start some pretty serious drugs for my MS and BAM she wants to take the bed and couch back. I wish I could just focus on getting better but now I gotta worry about buying a new bed and couch, scheduling movers, having my ex pick stuff up, etc?

Anyway my questions are these; Even though she paid for them, can they be considered a marital purchase as I threw mine away and it was agreed we'd both be using them. I'm not some scum that wouldn't help, I paid 100% of the rent and bills. It's just how we divided things. Now I have no claim on the bed I use because I chose to pay rent rather than split everything 50/50? Does the furniture I got rid of count for anything at all? Does being engaged mean anything more than just being roommates? Does my paying of her rent and bills count for ANYTHING?! Thanks!

    Divorce and fundraisers

    Posted: 28 Jan 2021 01:55 PM PST

My wife and I filed for divorce a month ago. I moved out but we are both on the lease. We have only filed for divorce, we have not gone through the assets division yet. She just burned the house down with a careless cigarette. She started a fundraiser and has raised 7K. It won't take her more than 3k to move into a new place. Since we had not divided our assets (furniture mostly) and then she burned them all up, what do I do and am I entitled to any of the fundraiser money?

Crazy neighborhood man killing roaming chickens [FL]

    Posted: 28 Jan 2021 11:39 AM PST

In my neighborhood, there's groups of chickens that roam the streets. They don't belong to anyone and many different people feed them. There's a neighborhood man who usually goes running with his dog unleashed (and apparently wearing a shock collar), who encourages his dog to attack and kill the chickens. They actually look for wherever the chickens are and he'll watch as his dog chases the chicks, hens, and roosters. Many people in the neighborhood have fought with this man already and the police have been called, however they told us there was nothing they could do and our best bet was to contact Animal Cruelty. The chickens aside, I feel like this is really strange behavior (kinda serial killer in the making behavior) for a person and feel like his dog might attack some of the smaller stray dogs and cats that also roam around. I was just wondering if there's anything else we can do to legally make this guy stop. Is this not against Florida state anti-cruelty laws? Or it legal because the chickens aren't property to anybody?

    Reopening estate - FL

    Posted: 28 Jan 2021 11:38 AM PST

My father's estate was closed in 2014 after his wife of three months petitioned against his will and left his children with nothing. Having also petitioned for life estate she currently resides in his home. Last year she started harassing me about roof repairs and tried scaring me into paying for it even though she is supposed to be maintaining the property. Now she is harassing me again claiming to reopen my dad's estate to claim these repairs as a part of it..? Is that even possible? If so, is it possible to fight for my father's dying wishes? According to my father's will she shouldn't be there in the first place. She chose to petition against my father's will to live there why should I have to maintain the home for her? Any information is appreciated.
