Got fired for informing company owner that his son was stealing. What can I do?

    Posted: 29 Jan 2021 09:10 AM PST

This happened in Florida. Sorry for the long post. It's both for advice and to vent today's events.

So I worked at an HVAC warehouse until today. Here's what happened:

I clock into work at 8:30AM. As I'm taking inventory, at about 9:13AM, I notice on the cameras that a coworker (the owner's son) was lining his pockets with things that we've been told to not count inventory of (nuts, bolts, wires, capacitors, screws, etc). I figured maybe he was taking it to his HVAC vehicle for vehicle inventory (not my area), but instead he put it all in his backpack, and carried it to his personal vehicle. He then drove away.

Out of curiosity, I checked the schedual. He wasn't scheduled for today.

I went to my boss, who told me to tell the owner. I went to the owner's office and met with him and his brother (the co-owner). Fearing that they might ignore what I say if I told him his son was responsible, I told the owner "Hey saw someone pocketing inventory on backstorage camera 2 at 9:13." We all checked the camera together, and we see his son stealing. He paused and got quiet for a moment and said "I can't see who that is. Their hat's hiding their face." I said "okay well keep going, more happens." and he reluctantly pressed play again, and we all saw his son look almost directly at the camera, then place the shit in his backpack, and carry it out the door. The owner said "Oh he was just doing vehicle inventory." and I asked him to switch to the back-lot camera. We then watched him toss the backpack into his car and drive off. I then said "He's not even on today's schedual, and Bryan's doing inventory."

The owner stayed quiet, looked around the room for a minute or two, then told me "Turn in your keys. We no longer need your services." I laughed and asked if he was seriously about to fire me for outing his son on stealing, and he said I had 10 seconds to hand over the keys or he'd call the police for trespassing. I handed my keys over and left.

I literally lost my job because I reported a theft. Is this legal? What can I do?

Neighbors building a pool and requested access thru our yard. What has to be done to ensure no issues on our side?

    Posted: 29 Jan 2021 09:19 AM PST

Update: thanks for the replies. I will insist on a property acess agreement or indemnity agreement. I know these are all far fetched scenarios but better safe than sorry.

Update 2: issue resolved! We mentioned that we had concerns and that a written agreement would be needed and now alternative access was found; other side of their property.

Our neighbors need access thru our yard (no easement) to build a pool. We don't mind them doing so since they will fix the yard, but in thinking about this, the following questions came up:

    1. What if a worker gets injured while going thru our yard? Do we run any risks?

    2. What if the workers damage more than the agreed area? Say with a bobcat they break part of our patio because the guy lost control of the bobcat.

    3. I need internet to work, say the break the line (goes under the sod where they will work), who would be responsible for lost wages?

I understand this may be far fetched but I am trying to make sure that I don't end up with problems from a project in someone else's home.

(KY) City council where I live voting to donate public park land to local private high school for a baseball stadium.

    Posted: 28 Jan 2021 06:42 PM PST

Several months ago the city where I live in Kentucky posted a proposal from a local Catholic high school where our city park land would be leased to the school for $1 per year for 99 years. In turn, the school would pay to construct a new baseball stadium for their private use.

Next week is the council meeting where the 6 members vote whether to accept the proposal.

I, along with a number of other citizens plan on speaking in opposition to taking this public land that is well-used and turning into something that will benefit those outside of our city more than those that live here.

My specific legal question is can a municipality take this public land and essentially donate it to a Church entity for their private use? Is there precedent that this must be decided via ballot versus a council?

I just want to understand options should the council decide in favor of the plan.

Edit: A point of clarification about my intentions. This is not a personal vendetta against the school or church. My kids attend one of the feeder schools for this high school. I have personal friends, who I am at odds with now, that want this field built as their children will benefit directly from it.

[SC] A pest control company came and sprayed my house while I wasn’t home, left a $400 invoice on my front door.

    Posted: 28 Jan 2021 09:59 PM PST

Hey everyone. As the title says, a pest control company came to my house today and sprayed/inspected for termite damage on my house. I come home to a $400 invoice on my door. My fiance and I were both at work so we had no way of telling them we didn't request the service.

We had just bought the house about two months ago. The company had left a note on the invoice saying to call their number so they could transfer me to the contract that the previous owners had. There was nothing in our closing agreements saying that we had to transfer this service over to my name. I also know it's not in the HoA because we pay an extra amount every year for a different pest control company to do inspections.

Would I get in trouble if I just didn't pay the bill? It's not that I can't afford it, I just don't want to pay for something I didn't request in the first place.

Edit: I didn't expect this to get as much attention as it did but I appreciate all of the advice. I'm going to contact them and let them know we're not in a legal binding contract so I'm not paying the bill. Again, thank you all for the great advice.

My job is threatening to take away our chairs, and force us to stand on solid concrete for 12 hours a day..

    Posted: 28 Jan 2021 06:35 PM PST

So, I (24M) am inherently not so much effected by this new rule change, that will be taking place starting Monday. BUT I am writing this post on my coworkers behalf. So I work security at a warehouse. I work with mostly old people and women. My bosses have been threatening to do this for a while, but I always considered it to be an empty threat, because what kind of heartless bastards make old people and women just stand on a pure concrete floor for 12 hour shifts? Well, they finally did it, and luckily for me I'm a supervisor so my chair won't be taken. BUT I worry for the health of my coworkers. There's multiple people over the age of 50 and 60 that work here, and even a pregnant lady. I was reading up online that standing on concrete all day leads to back, knee, and foot problems. I don't want to see my fellow coworkers get maimed for a $17/hr entry level job.

They offer us absolutely nothing. We are not allowed to bring our cell phones into the building, nor are we allowed to socialize with the employees, or even eat or drink while inside the building. We are contracted to work for this company, and technically work for two(the warehouse and the security company) but also technically work for neither. So no one has our back.

My question is, is this even legal? Surely there's has to be SOME kind of law somewhere that we would be able to use in our favor? The workers of the warehouse get away with this by having super thick padding placed down at their workstations, and they also get to walk around a lot. We get no padding, no protection, and must stand on concrete and stare at a blank wall all day, for 12 hours.

Any advice would be greatly appreciated!

    Extra:

This is all happening in Pennsylvania, if that matters.

I am a supervisor, and get to sit at a desk and do paperwork all day, so I won't be effected by the new rule.

This advice isn't for me, it's for my fellow coworkers.

Also, advising them to quit is not preferred. I will not be here for the rest of my life, but sadly they might. So I'm just trying to make their stay as comfy as possible.

(Kansas) While driving through Kansas my vehicle broke down, I moved to the side of the road. Sheriffs department claiming I was blocking the roadway, I was not. They claim I owe money for a tow I did not ask for or need according to the law.

    Posted: 29 Jan 2021 08:27 AM PST

I was driving through Kansas, my new water pump failed and blew up my engine. I move my vehicle to the side of the road right up against the snow line, turn my flashers on and try to find a tow truck. I had no service and couldn't find a tow but luckily a passerby drove me into town, he said we were about 7 miles from town. I reserve a uhaul so I can go get my vehicle with a dolly the next day. When I get to the uhaul shop my vehicle was already there on a tow truck. They ask if it was my jeep and I said yes. He then demands $195 claiming the sheriff called and said I was blocking the roadway, I made sure I wasn't before I with the passerby the previous night. I argue claiming I didn't block anything and the law states I had 48 hours to get my vehicle. He then claims he knew exactly where my vehicle was, that I blocked the roadway and also that he doesn't know if I was in the roadway in three consecutive sentences while I questioned him about the legality of the tow. I left frustrated feeling taken advantage of. I called the sheriffs office today the deputy explained he was the one that called for the tow stating it was a safety issue. His reason: I was over the line just a bit and there was a bridge 10 yards in front of my vehicle. There was no line to be seen, it would have been under several inches of snow and even if it was visible I know I wasn't over it based on the effort I made to pull off to the side of the road. There was also no bridge, 10 yards ahead, he was making that up because he realized he messed up when I questioned how he saw the line under all of the snow. I now have spent $600 getting back to my home state from renting a uhaul from a competitor an hour away (it was my only option, no rental cars or airports within 3 hours drive in any direction). I now have no vehicle, that would be repairable under warranty and still "owe money" for tow charges for a tow that I did not request or in the end need (because I found a cheaper solution via uhaul). I was not allowed to recover my things from the vehicle (by kansas law I have 48 hours to do so) so I am out an additional $300 in tools, $400 in clothing and $100-200 in misc items including the warranty info that would fix my vehicle and pay for the tow and subsequent charges to get home. All in all this has cost me over a $1200 a vehicle i just spent hundreds to repair and my sanity because a sheriff made a bad call and a tow truck driver refused to follow the law. What are my options/ likelihood of recovering my belongings and costs for their mistakes.

TL;DR Sheriff deputy lied about vehicle position and circumstances after breaking down and had my vehicle towed. Tow truck driver refused to let me get my belongings which included the warranty info for the part that ruined my vehicle and would have paid for the tow. I am now out a lot of money a vehicle and want someone to answer to it.

Edit: I have recordings of interactions with the tow company and the deputy.

(KY) Construction crew put metal signage poles in my front yard without permission. Already caused a minor injury. Liability?

    Posted: 29 Jan 2021 11:57 AM PST

I rent a house owned by my parents on a busy residential street in KY. Across the street is a very wealthy homeowner that also owns an empty lot of land that is directly across the street from us. The owners of the house and the lot across the street from us are having some landscaping? or construction done involving the removal of small trees and other things near the sidewalk. The construction crew at some point laid a large metal traffic sign in my front yard. Like a giant metal easel to hold a big plastic sign, along with said signage and some broken bits of plastic that I think are to hold it closed for transport. It is not set up, in fact it was partially buried by snow and with the snow I didn't notice it until today .... wait for it.... when the Uber Eats driver told me that a protruding piece of metal cut his ankle a bit as he was walking up to my house and he stumbled a bit from it and the slush. It isn't a bad cut and he wasn't angry, or planning to seek medical at this time, but wanted to let me know since it obviously wasn't my property.

When I took my dog out, I observed it and that there are a lot of sharp edges. Also, where it is laying in the grass it is going to kill the grass. I tried to approach the construction crew but they told me it wasn't their problem, and as none of them were wearing masks and were trying to very much get in my space I am concerned about approaching again. My dad is my landlord and when I expressed concern, he said to move it onto the public sidewalk.

What is my liability here if it is in my yard? Does the lack of consent to placement keep me from liability if the Uber Eats driver needs medical attention later? My dog stays supervised and on a leash at all times, but I'm concerned about any sharp pieces breaking off in the grass or it's risk to passerby. If I move it to the sidewalk, I don't know if it would make them then feel they had to move it. I'm worried that by moving it to a public space to try and force their hand, I'd be liable then for damage to their property or others.

TLDR: Private construction hired by across the street neighbors in KY have laid down unused metal and plastic construction signs without permission in my yard, which before I knew of their presence caused a minor injury to Uber Eats driver. Landlord very concerned about damage to grass beneath signs. Construction crew thinks I'm being bitchy. What is my risk of liability for the injury or possible future ones?

I just got fired from my flight school. I was an independent contractor.

    Posted: 29 Jan 2021 07:59 AM PST

Hello! I was terminated this morning from my flight school in Wisconsin. I was an independent contractor.

The flight school is about 3 years old and I am instructor #5 to be fired. None of us made it over a year.

This morning the school owner wanted a meeting and wanted to discuss a few things.

#1. He said he noticed a ding on the door on the airplane and he was confident that this was after my flight. I denied that it was me. And I am sure it wasn't me.

#2 He said I was cancelling flights. When I defended my answer (due to bad weather) he then agreed that weather cancellation was fine but said that I need to type a detailed paragraph on Flight Schedule Pro explaining the reason for the cancellation. There was a disagreement here because Flight Schedule Pro normally lets me change reservation if it is more than 12 hours in advance - it does not require comments. He said for any and all cancellations, even 12 hrs in advance, I needed to write a detailed report (which I wasn't clear about)

He then gave me a 'letter of correction' for me to sign. Apparently it was to leave a document trail that we had this discussion and I acknowledge that I was disciplined.

    I refused to sign it.

He got visibly worked up, raised his voice, and said if I don't sign this he will need my keys.

I gave him my keys and walked out.

    Sooooo.....

As an independent contractor we both signed a contract. It says "Either party may terminate the agreement at any time by giving sixty (60) days' written notice to the other."

Would this be a breach of contract or is this a common drama in flight school (flight school - independent contractor) and I should just move on?

Any advice from the experienced aviators would be greatly appreciated !

Police found my stolen letters and parcels and didnt return them, and now my housing association refuse to facilitate its return

    Posted: 29 Jan 2021 06:01 AM PST

For context, I live in England.

A neighbour of mine was discovered dead in her property with letters and parcels that had been stolen from myself, my partner and my neighbours - these were taken from the communual area where post is delivered to.

The police identified the stolen post but made no effort to reunite any of us with our property. They left it in the house of the deceased and told my partner she would have to arrange for its collection with the housing association.

I later complained about it and their sargeant agreed that this was mishandled. The police then backpedalled completely claiming that they had no idea the post was stolen (despite acknowledging an opened parcel and a collection of neighbours letters). Presumably this was to avoid accountability for not collecting the stolen mail. They also said this case is no longer in their hands as the thief is dead and cannot be held accountable in court. They said that this is now a civil matter.

The housing association have made clear that they do not intend on returning our property, quoting their policy to remove the owner's possessions from households once vacant - completely disregarding that this property is not theirs nor the previous occupants. They said if we want our property back, we need to take them to court.

This brings about many questions. When the housing team come to my neighbours flat and remove my property, do i not have the legal right to use force to prevent them in doing so? They are aware this is my property and the police have confirmed this with them. As far as im concerned, once their hands is on my property and theyve left the flat with intent to remove and destroy my property, this is theft.

I called the police asking them if I can call them when the housing team remove my property and they said it's a civil matter. I dont understand how theft is a civil matter..

It's extremely contradictory that if I was holding stolen police property at my home, they'd kick my door down. But if i kick down my neighbour's door - vacant home, remember she's dead - to retrieve my belongings, id be done for criminal damage.

My property rights are being violated so bad and there seems to be nothing I can legally do that I should be able to do. Do i really have to fork out 100s, maybe 1000s, on legal proceedings just to get some letters and parcels back?

Reporter reported all of my personal details as a witness - concerned for safety.

    Posted: 29 Jan 2021 04:58 AM PST

I do not know whether I have any legs to stand on here but thought I'd ask for a bit of advice! A crime magazine published an article this week about a crime I witnessed. This was not from a court hearing or anything as the case hasn't gone to court yet, and likely won't. They have named my whole name, stated my age and my place of work, without my consent to publish this. Is this allowed? As its a crime magazine and the crime was only last year, this could potentially put me in danger by outing my identity as a witness. I know there are grey areas as to what reporters are allowed to write or not, so just looking for any advice on this. Do I have any rights to sue or demand compensation considering it could be a safety issue for me?

Thank for any advice guys! I've got a 8 month old baby girl so taking this quite seriously!

NYC - ConEd Shut Off Gas For A Year

    Posted: 29 Jan 2021 10:26 AM PST

    Hi all,

ConEd has shut gas off to our building for a year. I live in a rent stabilized building I just moved into 3 weeks ago. Apparently there are major issues behind the walls of the building due to years of violation, disrepair, and neglect, and ConEd deemed it too unsafe to keep it on.

We were given a hot plate (apparently the legal minimum for what's required) but that will drive electricity up and still doesn't solve the issue of being without an oven. Do I have any recourse for requesting a rent reduction?

    Any advice would be welcome.

Contesting Excessive Charges from Relocation Company

    Posted: 29 Jan 2021 03:39 AM PST

Hi all! I'll get straight to it...

I recently moved to a new city for a job and was offered a relocation package. I'm young and single and didn't need to move much (myself and clothes). In my work contract it states that if I leave before my probationary period ends (1 year), then I am obliged to repay the relocation package. This is totally understandable and I wouldn't think to contest this.

Anyway I was offered another job (in the same city) which is a massive step up and basically impossible to refuse so I've taken it.

I have just been given the bill for my relocation and am bewildered. For a couple weeks accommodation, visa assistance (not an issue in my case) and moving 3 suitcases they are charging me $15k. I received a breakdown and for the 3 bags (travelling via the cheapest mode of travel -overland in a truck) they are charging $5k. I've moved a lot before and that's 10x the normal cost.

What legal avenues do I have to contest this bill? Its completely out of sync with the services provided. Particularly the bag shipment. Can I provide market prices for equivalent services or contact some sort of regulator or even just outright refuse to pay or am I stuck?

    Any advice much appreciated!

Scramento County, CA - Tenants will not leave at the end of the lease

    Posted: 29 Jan 2021 03:29 AM PST

I have a rental outside the city limits, and I wish to move back into the house (single family house). The lease has been month to month for almost 2 years, and have not been late or short on rent in that time.

The tenants are refusing to leave the property after a proper 30 day notice period per the lease sighting a lack of other available rentals.

My question is, really, what protections do they have under the eviction moratorium? They intend to continue to pay rent as of they haven't been notified of the end of the lease.

I suspect I will have to go through an eviction (or at least start the process) but I cannot tell if they would be protected under the moritorium in these circumstances.

(MT) Can I drop a small claims case if it is removed to justice court?

    Posted: 29 Jan 2021 07:56 AM PST

I'm considering filing a small claims case against a large financial corporation. I am located in Montana and the corporation is located outside of the state. I am comfortable with the idea of settling this is small claims court but I am concerned that the defendant will have this moved to justice court so that they can have an attorney present. If that happens it's not really worth me pursuing the matter as attorney fees would exceed what I am looking to collect.

My question is: If this is moved to justice court, can I just arbitrarily drop my complaint or would I be somehow obligated to see it through to the end? I am afraid of starting this process and not being able to stop it from progressing to justice court where I could not afford attorney fees.

    Thanks!

GA - Neighborhood full of sinkholes

    Posted: 29 Jan 2021 11:17 AM PST

I've lived in my fiancé's home for 5 years. The entire neighborhood (HOA) is rotting, not from neglect but utter crap construction.

There are sinkhole issues with our home, but I noticed another hole in the yard between our's and our neighbor's, closer to their house. It developed pretty fast-there's a garden box the tenant before built and used 2 summers ago that's now cracked and half-sunk.

I took a tour and we're not alone. It's like they built this subdivision on a landfill (or a cemetery but did move the bodies with the gravestones).

Our homeowners' doesnt cover damage from sinkholes. What, if anything, can we do?

Former job Owner withheld over $20,000 from employees in credit card tips over span of 7 months

    Posted: 29 Jan 2021 01:04 PM PST

(Kansas City, Missouri) - Hello all, looking for some advice (clearly). I just left a job where the owner has been withholding credit card tips from their 3 employees during 2020 without consent. Any question to it came with intimidation or threat to cut pay to waiter wages (we are all hourly). Upon my decision to leave due to differences I decided to look up on the terminal that I used daily and was allowed access to, to look up how much in CC tips that were received. The total from June 2020 to Jan 14th 2021 was over $22,000. To cut to the chase, it was extremely frustrating to see such a number. I see reports that this sort of thing is illegal and I'm wondering what sort of actual steps can be taken if any at all. I did take a screenshot of the totals and dates and have paycheck summaries to show I have never received any credit card tips. If you need more info I can provide anything I know. Thanks!

Someone used my chipotle account (likely bought my login credentials somewhere) and ordered food to their house- anything to do here?

    Posted: 29 Jan 2021 12:52 PM PST

Already changed all my passwords. I'm usually better about that but it's an old account. Also usually use two step authentication payment types but I guess my debit card was still on there.

Caught it before the charge went through- but I have his name, address, and phone number because he ordered it through delivery. I'm in OH he's in NY.

Anything to do here? Or just change my password and not bother because it's not worth the effort?

    Anyone with similar experience ?

    Posted: 29 Jan 2021 12:38 PM PST

    Hi all,

We received visit from officers last month who claimed they received a call that there are kids screaming in our home. We told them we don't have kids. They left. Didn't make a big deal out of it because it was obviously bogus. 2days later cps arrived at out door with details name birthday that were given to the officer upon their arrival. We refused to let cps in and requested a copy of their report which they refused to give us because its from a "very credible" source, therefore they'll actually have to searched our home. I'm very upset and in no mean shape on form will I want someone in my home especially during this time and the fact that it might be from the officer is appalling. Cps is called on people with kids and I'm not sure why someone will do this to two young adults. I tried contacting an officer regarding this but no progress. This might not be a big deal, but it's obviously concerning and adding unnecessary stress, anxiety and discomfort. There are people out there that can actually use their help. What I can I do?

Mother fucked my transcripts when homeschooling me

    Posted: 29 Jan 2021 10:57 AM PST

Long story short I(in Kentucky, still dependent on my parents financially and graduated at 19) discovered that my parents have neglected me educationally (I can barley do 4th grade math at 19 for example) and has put incorrect stuff on my high-school transcripts. My mom who did all the education in the house put courses I didn't complete (such as French on dulingo or geometry) and at least one course (computer science on khan academy) I outright didn't do to my knowledge. She has put faith based stuff on it as well. She has put me cutting grass for someone as a business under the employment, community service etc tab. When I did not do it as a legal business. She put stuff like physical education and drievers education as courses i did for school. Basically my High-school transcripts are filled wil incorrect information. What do I do? I can not go to a lawyer for a free consultation because I can't let my parents find out what I'm doing(scared of what happens if they find out). Is it legal to use my highschool diploma for a job when my transcripts have incorrect information? Can I just get my mother to change the transcripts to get the wrong information pulled out and my transcripts be perfectly legal if then? I don't know what to do in regards to my transcripts so any advice would be appreciated. I also have posted here before on a different account so if the story sounds familiar this is why

(DC) Does landlord have to give notification every time he accesses unit?

    Posted: 29 Jan 2021 10:53 AM PST

I'm moving out of my unit in DC March 31st, and I gave my 60 days notice. Landlord replied through email that he was notifying me that the unit would be accessed Feb 1st - March 31st for showings and other things.

Can he block off two months of time to access the unit whenever with no notice per visit?

    Thank you!

[CA] I'm Having Work Struggles from an Injury

    Posted: 29 Jan 2021 11:38 AM PST

I feel stuck. I hurt myself again (previous injury) while on the job. It's been a few months, nobody has offered me workman's comp.

They keep asking me if I'm using my own insurance. They ask you to log in and out during down time when there is never down time. We get messages until 9/10pm after work is over. They text and call outside of work. They ask me to have unpaid meetings or phone calls on my days off.

I was offered a remote position but was harassed by the HR manager to pay for an Uber out of my pocket ($140 round trip). I rely on a nee scooter and the clinic is small. I'm in pain and my surgeries have been postponed. It makes no sense logistically.

They feel like they are doing me a favor. I have copies of the doctor's notes, I never have phone convos and if I do I send a follow up email and BCC myself.

The HR manager has stopped talking to me directly and always adds random people to the texts, emails, Slack, etc." she sends me. In the chat app we use for work, which we always have to be on, she will never answer my questions. She will say "hey Sam teach @Jen to do blah blah."

I sent a text to her and asked if something was wrong and didn't hear back. Now I email her and the owner. He's great. I just want to do my job and be a contributing member to society.

Got hit by a company truck while on my bike and can't remember the name on it.

    Posted: 29 Jan 2021 01:11 PM PST

Florida. Literally title. Was on my home from work after not feeling well. I ride my bike to work, as it's only a couple of miles. I was on the phone with my daughter in law before crossing the street, which is a major highway. The light for pedestatrians was white, which means go, yet the truck was still until I went for it, as I usually do 3-4 times week. I thought we made eye contact until I noticed his truck moving last second, and hit me, knocking me off my bike and hitting my head on the street. I guess I was in shock when he talked to me because all I remember is the guy getting out, saying "he was so fucking sorry", and that if I needed to call anyone, or "need me to buy you something." He left, without me getting any info. What can I do? I feel like an idiot for not taking pictures, as this happened almost 2 hours ago. Can I still file a police report?
