This is what happened: in my job we often take the clients to lunch/dinner to finalize deals. My colleague and I were having dinner with a client and he saw I was not drinking wine, so he asked why and if I'm a recovering alcoholic. I said that I am. Suppose I could just have lied but I don't like to lie. What happened next is he called my boss and said he wants someone else to be in charge of his account. Boss asked why and he says doesn't want an addict to be in charge of his account. My boss told me this so I believe it. (On a side note I'm 22 years sober so and my past addiction is not interfering with my work at all. The client was quite happy with me until he knew about this). At first my boss refused his request but the client escalated it to one of the partners and I was told I'm not to handle any of this client's business with our firm. He's one of our big clients so it's clearly a problem for me, I would be losing money over this, and it's a career setback. I was not happy with this so I protested but they said that as I can't seem to work with the client I'm being demoted to my former position. Which means a monetary loss of at least $20000/year, not counting bonuses and other perks. So I was wondering if I have a case here, is there a chance this could be discrimination for reasons linked to a health issue? [link] [comments] |

I also don't want this to get back to my employer. So here is all the information I think you'll need. I'm located in Georgia, United States. I am currently paid a few dollars over minimum wage + tips and the tips are split evenly from a pool. I work for a small family owned business. The tips generally range from $20 to $60+ on any given day. I generally work 25-30 hours a week and sometimes depending on scheduling I can potentially work some overtime. Just recently they have had meetings with all of us and they are asking to us to sign a paper saying that if we work any overtime we will be forfeiting tips to pay for the overtime. Only the employees that accrued overtime will be penalized so it's not a group punishment or anything. My question is: is this legal? Am I liable for neighbor's negligent keeping of foul (IN) Posted: 06 Jan 2021 06:50 AM PST So I live in a semi rural area where we live on 2 acres of land and as do both of our neighbors but the land is mostly in front and behind the house with the property line 25 feet from the side of the house and their abouts to the neighbors' house (I say this to say I don't know if this area is zoned for livestock but I think it is) Anyway they moved in summer of 19 and brought ~10 chickens when they moved in and placed them right next to the property line and the chicken walk all around their property most of the time which is just fine up until they get on our property which at least 3 have done this month and I only know this because they have been brought by my hunting dog to the front door I know that my dog isn't leaving our property because she has an invisible fence that shocks her when she gets close and she is 7 years so she definitely understands this pretty well. Help! Landlord notified me on January 2021 that they did not receive April 2020 rent. Posted: 06 Jan 2021 06:57 AM PST If I were to dispute this would I win the case? Situation: Houston, Texas. I received a notification from my landlord today Jan 6, 2021 that they did not receive payment for April 2020. However, they require a cashier's check and so the money is already out of my bank which is proven in the bank statements. They do not issue receipts or sign of anything as their social distancing policies. We drop off the payments through a deposit chamber in the resident center. I only have a bank statement from that month and a receipt/purchaser copy from the money service center but there's no way for me to prove that I dropped of the cashier's check nor can they prove that they did not receive it. I called the leasing office to check that I had read it right, where I was notified I had, and that they had a no firearms policy. While looking into it I found out about HB 302, which if I'm reading it correctly states that they are not allowed to prohibit a tenant from possessing firearms. What I'm really trying to find out here is (a) did I read the bill right, and what they are saying is illegal, and (b) if so, what do I do about it? [link] [comments] |
[California]I took some things from work, best course of action. Posted: 05 Jan 2021 06:25 PM PST So I work in a service place that sells a couple retail items. At work we use this point of sale program and over time I found that it was easy to manipulate things ring up items for a discount etc. Anyways, I was able to ring up some retail items with a large discount and I mainly did this in order to boost up with retail sales since over a certain amount we would get a bonus. I found out that I was only 200 or so dollars off this mark. So I would ring up items at full price and apply the discount. I would still get credited for the full amount even with the discount applied. For example a $20 item with an $18 discount I would only pay $2 and taxes for it, but still get credited for $20. I won't say what the items were, but I can say that they're of no use to me, I just wanted to get the bonus that came with the "sale" of the item. At the end of the day the inventory amount would still be equal and the system would show as accurate. Except that my retail sales amount we up and I had several of these useless to me items. Fast forward to last week when my manager questioned me about said discount on 2 of those items. I apologized and offered to return them. He said to not worry about, but I returned them anyways ultimately confessing to applying the discount and getting the items for a cheaper price, however I did not tell him being that the reason why I did it was to get the bonus. The next couple of days I just see him digging further and further into the pile of invoices and pulling up invoices from a week ago when I started doing this and highlighting the amounts that seemed suspicious to him. Today, his boss came to visit in town and I suspect that he told him, since he was acting very secretly the entire day. After I clocked him, he proceeded to stay back a little longer to chit chat with him. Anything that I can do other than deny? I snuck back some items already without him knowing and even if I kept them the inventory would show accurate. I'm not sure what they can do, accuse me of theft? This is my first inspection ticket and the last ticket I'd gotten was nearly 7 years ago for speeding. Covid or no covid, I have never been a fan of sitting around in a courtroom if I can avoid it. I am finding out now that there are problems with the previous tenant that could cause a potential delay in occupancy. There is a delay of occupancy clause in the lease that basically states "If the apartment isn't available on the specified start date, the lease is still in effect and lessor is not liable for damages related to unavailability, except reducing the rent in accordance with the time related to the delay of occupancy." I know this clause puts me in a bad spot, but my question is just how long this delay can last until I have some sort of grounds for breaking the lease. So where does this leave me and my brother? I've begged them to explain to me what I should do about this because I am ignorant of everything to do with big finance or law. The options basically require me to be rich enough to be friends with judges or just be able to have lawyers on tap, and they said there are no other legal options for me other than the following, which I will just copy+paste out of the emails they've sent me.
So what on earth do I do here? Talking to him is not an option because even if I knew where the hell he is, I'm painfully aware of how dangerous and violent he is plus if he's refusing to do the thing for Fidelity then he's sure as heck not going to do it for me if I just show up in front of him one day. I can't just wait around for him to pass away because I have to do my taxes in a few months and I can't afford the taxes on this!! If admit to knowing about it, I loose and then have to pay back all the aid I got from my university when I entered higher education and I loose and then have to pay back all the aid I got from the hospital I was treated for cancer at. When my brother has to have his taxes done for him then he'll just loose everything and I'm not able to take care of him, it's just not really possible to take care of him without a team of medical specialist caretakers. I can't "just go get a ask a judge" because I don't know any judges. I'm not rich enough to be chummy with random judges. I've never met a judge in my life. The only other option is to have an attorney person on tap, so that's out. I have no way to get any sort of order to force Fidelity to force my father to keep the money. Can Fidelity really do this to me and my brother? Just randomly decide to tell the IRS me and my brother have money we don't want or ever knew about and then tell us they won't do anything to stop doing this to us without a court order that we can't afford to buy? There's no legal means by which citizens can just say "I don't consent to receiving your goods and+or services" and be left alone? It was on a security camera that he has access to, is visible right above the TV in the living room, knows it records audio / video and has recorded me in the past just playing with the kids or other silly stuff, and knows it records 24/7 to an SD card as well. After I find this out, I immediately kick out my husband. This was December 12th or 13th, I don't remember. I made the report on December 16th, the same day I met with my lawyer to draft up the divorce and child custody documents. A day or so later the officer I made the report with submitted it to the district attorney for review. Same day, I get a call from CYS (Children and Youth Services) for "general concerns." CYS worker comes over to my home and does an inspection, found no concerns. Husband comes back for supervised visits on December 19th. He is never left alone with the children, but he claims he was. A few days later, CYS calls him and lets him know what's going on. He's furious. CYS makes him schedule an appointment with his doctor to get back on mental health meds. He does. He fills the Rx. He doesn't take the medications. After that, CYS closes the case because they said the children are safe with me and because he is no longer living with the kids and is only having supervised visits. They didn't say it was unfounded just closed. January 3rd, he tells me he'd rather "kill [me] before [he] loses custody of the kids" ad that I would regret filing for custody. I obtained a PFA. It was granted until January 15th, when there will be a hearing to potentially extend it to 3 years. As of today, January 5th, it's been in review at the DA's office waiting for a medical professional to review the footage to see if his actions could have caused harm to the baby. If the answer is yes, that medical professional would testify in court against him. What I am asking -

As it turns out, there are several unclaimed amounts listed, adding up to over $14,000. The amounts are listed under "Bob and Sue Jones Family LLC" (names changed obvs), with my grandfathers old address. My grandfather passed away 3 years ago, leaving behind three daughters, including my mother. She was originally named as the executor of his estate, though this was changed to her sister before my grandfather passed, due to her developing Alzheimer's disease. My problem here is that the sister, "Jill," listed as executor is completely incompetent and quite a difficult person. The third sister is even worse. What I'd like to do is claim the amounts on behalf of my mother as one of Bob's legal heirs, and just present the sisters with their shares once it's done. Is this possible? What are rights of people living in extended stay hotels in the state of Florida Posted: 05 Jan 2021 08:47 PM PST I(F25) have been living at an Extended Stay America property since February last year up until today. I paid my rent monthly and on time each month. I woke up today as normal and went about my routine(feed and walk dog, shower, get dressed, etc) Apparently, a new manager started today. She kept calling the room(while I was in the middle of showering) demanding I come down and make a payment. Now money wasn't the issue. I had the rent money, but my relationship with the other manager was that I just come in at whatever point on the day I'm ready and pay my rent. I told the new manager I would be at the front office as soon as I dressed and brush my hair. I politely hung up. She calls right back and said since I hung up on her she wants me gone from the property. I go into the front office ready to pay and she is livid, saying how dare I talk to her that way and I need to be out by 4pm. It was after 12pm at that point. Now, I wasn't to sure on the law and procedures regarding removing long term tenants from an extended stay hotel, so I searched it right there and found something vague that said I did have to receive at least three days notice. I even called the sheriffs office to confirm this and the officer said she would need to serve me a notice and give me time to organize my belongings. The manager called the police and when they show up I inform them of what I was told by the sheriffs office and the Florida Statute I found online. The cop says I have no legal protection and they could really only give me 30min to leave instead of giving me until 4pm. At that point I break down crying because I have so many items of clothing, dog bed, and refrigerated food to try and get into my car in a few hours and I have no other arrangement than going back to my parent's house so I can figure out my next move. Even though the cop said I have no legal rights or recourse I don't believe that fully. I think they were just banking on me being a young woman who doesn't really know any better and just go along with what they they said whether I had been clear on the laws that or not. Doggo and I are now safe at the parent's, but I'm laying awake wondering if what the hotel did was right and you I have any recourse I can take. I had told him about my situation, and he said I could find a replacement tenant. He said that, once I found someone to take over, he'd send me paperwork to close my lease officially. I asked if he needed the written notice, and he said no (probably my fault for not sending it in anyway). I found one to take over immediately, so I don't believe I have any dues moving forward (in terms of rent). It's been over two weeks since the new tenant moved in. Of course, I understand we just had the holidays and everything, but I've sent several texts and tried to call several times to no avail. I'm wondering how I can go about ensuring I get a response, especially because I'd like my deposit back. In CA, the landlord is required to return the deposit or send an invoice within 21 days of the lease closing. Would the best thing be to send my 30-day notice via writing now, and then wait for the 21-day period from then (basically, expect all of this to be sorted out within two months from now)? Or, legally speaking, is there no need for a written notice since there's a new tenant with a signed lease in the space, and should the 21 days have started from the new tenant's move-in date (for example, if the new tenant moved in December 24, then my landlord would be required to respond by January 12 or so)? While we all lived together I got a dog (I paid for her and the bill of sale is in my name). About a month before I got my dog, my roommate moved in his gf without asking anyone and she lived with all us until they all left in November with ever having paid any rent or utilities. The gf (who moved in without asking) is the one causing issues. When they first moved out she kept texting asking to have the dog or take the dog out. I would not let her because I could not trust her. The last day I saw her she screamed at me that the dog was hers while locking the doors and not letting me leave my house. My other roommates had to come home to diffuse the situation. She believes the dog is hers because one day (without asking me) she took the dog to banfield animal hospital and put her on a wellness plans because she didn't think I was vaccinating the dog fast enough. When confronted, she said she'd pay for this instead of any paying rent or utilities. Sunday night she showed up uninvited and unannounced and left a letter saying I need to pay her back or give her my dog or else she's going to take me court. The letter was written by her, so no lawyer is actually involved. I am wondering if I actually have to pay her back for it (again, I did not ask her to put my dog on plan, she later admitted to a mutual friend she did it so her name would on file as the dogs owners). Question about Pet Insurance Policy Terms Posted: 06 Jan 2021 02:16 PM PST TLDR; My pet insurance is trying to deny me coverage for my dogs behavioral medications, but I think the way they've written their policy means they can't. Hi guys, kind of an odd request here involving a pet insurance policy. For backstory - my dog developed severe generalized anxiety for which she is on 3 different medications, all of which are quite expensive. We got pet insurance immediately when she was a puppy so I wasn't worried about the cost. Her medications were being reimbursed fine until my last claim a week ago which was reimbursed at $0.62. They claimed that my plan had a separate $1,000 annual limit for Behavioral Disorders which we had hit. Now to be fair, up until this point I did not read every line of the insurance policy as I foolishly assumed that all the coverages and limits would be listed on my account online under the tab that says "View Full Protection". But then when I did go through the policy and read the terms they were referring to, I'm convinced that the way they wrote their terms and conditions means that the medication should be covered and they don't have a legal basis to deny my claim. Here's the relevant section of the policy: POLICY COVERAGE
We will reimburse you for: a. the reasonable cost(s) of any medically necessary treatment administered by a veterinarian within Canada or the United States that your pet has received during the policy period for a covered illness or injury; b. the medically necessary reasonable cost of pharmaceuticals that can only be obtained by means of a veterinarian prescription to treat an illness, injury or behavioural disorder in the quantity of ninety (90) days or less; c. the medically necessary reasonable cost of supplements. The most we will pay for this coverage is the maximum annual policy coverage shown on your declarations page. (My maximum annual policy coverage is $10,000)
The following coverages do not increase the maximum annual policy coverage on your declarations page and are not subject to and not considered in applying co-pay when co-pay conditions otherwise apply. The special coverages are not subject to the applicable deductible. (This implies that these special coverages are separate from the main policy... the person I was speaking with even used the term 'Extra Policy Benefits') a) BEHAVIOURAL FEES AND TELEHEALTH We will reimburse you for:

Other categories in the SPECIAL COVERAGES & LIMITS section include: b) ADVERTISING AND REWARD c) BOARDING FEES d) LOSS DUE TO THEFT OR STRAYING e) DEATH FROM INJURY OR ILLNESS f) VACATION CANCELLATION (None of these are listed anywhere in the initial VETERINARY FEES, PRESCRIBED DRUGS AND SUPPLEMENTS section, as they are considered separate 'Extra Policy Benefits'. If prescription pharmaceuticals for behavioral disorders were meant to be an extra policy benefit/special coverage as well, then it shouldn't have been listed in the first section either. But it is listed as part of the first section's coverage, and isn't referred to in the SPECIAL COVERAGES AND LIMITS section) They kept saying to me that "I'm incorrectly interpreting how the terms and conditions are meant to be applied", but how they meant the policy to be interpreted doesn't matter and isn't my fault - write your terms and conditions more clearly then. I'm taking the literal interpretation of exactly what they wrote in the policy I agreed to (if I had actually read all of it lol). I signed a lease for an apartment complex in October of 2020 and am noticing that the neighborhood it's in is pretty unsafe for a woman who is living alone. I reside in Colorado with two dogs, and started noticing that men would stare me down when I would leave the building to walk my pups. Either in the hallways or walking around in the courtyard area. It has progressed to men that didn't live in the building being present in the building somehow, and following me from the lobby area up into my second floor hallway, trying to "holler" at me. Going as far as following me to my doorway, so now they know where I live. I had reached out one evening vis email to my complex about feeling unsafe and described in detail things that have happened, and a few hours later, around midnight, there was someone banging on my door, kicking my door and jiggling the handle to get inside. Screaming "let me the fuck in!" And pounding on my door. He then went to my neighbors house and was screaming and pounding on his door, saying "give me my shit! I want my shit!" Over and over. This was going on between his apartment and mine for an hour and a half. And when I tell you this happened for an hour and a half straight, I'm not exaggerating. I didn't know this man and I have videos of sound of him pounding on my neighbors door and I have video of him through my peep hole in my door. I called the police and no officer ever showed up, and I'm not sure if I am legally able to break my lease. I'm sorry for the extensive backstory but I needed to give some context. My lease says absolutely nothing about a lease buyout. I can attach photos of my lease if needed.
