*I think* the city garbage truck hit my car. What can I do?

    Posted: 28 Jan 2021 05:56 AM PST

So I had moved my car out to the front of my house yesterday because I had some workers at the house repairing my ceilings. They're continuing to work today, so I left the car on the road. Last night was trash night. I moved the trash can out onto my driveway, but apparently not far enough away from my car. I went out this morning and saw an indent in the front corner panel and adjacent panel, right near the headlight. I don't have physical evidence that the garbage truck hit it, but it's the only logical conclusion at this point. The trash can is emptied, it's near my car, and my car has a dent in it. They probably had to angle in awkwardly to get to the trash can... instead of someone getting out to move it. I would have much prefer they just left it for another week!

Do I have any recourse against the garbage company? Should I just contact my insurance company and let them figure it out?

    This is Kissimmee, Florida

    UPDATE:

My neighbor had video coverage. It was my across the street neighbor backing out of his driveway to go to work. You can see my car move a little as he backs up. I'm fairly friendly with him, I'm hoping he comes to me after work to discuss, otherwise I'll have to go over with the video footage. Thanks for all the responses.

Update 2 I spoke with my neighbor and he was apologetic. He hit me with his work vehicle so the insurance claim is going in through his company. I'm covered 🙂

Bicyclist hit on pedestrian walk - how much at fault?

    Posted: 28 Jan 2021 06:04 PM PST

Southern California here. My friend was riding his bicycle and got hit by an old lady with her car while he was crossing the street at a pedestrian crossing. The yellow warning lights were still flashing. He was not pushing the bike but riding it.

Being a "everything is ok with me" guy he told the cop that he just wanted to go home, but the cop luckily called an ambulance. He did not fill out a big report, just gave my friend a piece of paper with some incident number (I guess). Turns out things are more severe than initially thought - broken ribs, scull, eye socket, nose and stuff. He was kept in the hospital overnight and is in a lot of pain, it will take him weeks to recover.

Question is how to approach this. As a bicyclist he is not insured and the lady certainly has some fault. There will be lots of medical expenses.
Is it recommended to talk to an attorney?

    Water damage condominium ceiling

    Posted: 29 Jan 2021 02:51 AM PST

I recently had a water damage to my condominium ceiling caused by upstairs neighbor leaking dishwasher. When the water damage event first happened, the source of the water leak had not been determined. I filed a claim with my insurance carrier(Farmers) initially, but claims adjuster suggested that I withdrawal the claim and file claim with upstairs neighbor insurance company(Liberty Mutual) based on the information I provided. I am a little confused on why I agreed with him on doing so, but at the time it seemed logical. I proceeded to file claim with upstairs neighbors insurance carrier. The water damage event occurred again 3 days later and I immediately contacted the neighbor at his work and early that evening plumber came out to eventually find the source of the water leaking down into my condo. The upstairs neighbors dishwasher water hook-up in the back of the unit had come loose or broke. Upstairs neighbor at that point had expressed to me that he would make good on this, covering the costs to restore my ceiling. During this time I had several water damage services come out to give estimates to start the process of dry out/debris removal, etc. I forwarded estimates and pictures of water damage to neighbors Insurance companies claims adjuster. It took almost 2 1/2 weeks to find out that his insurance carrier (Liberty Mutual) found upstairs neighbor "non-negligent" in the dishwasher leaking down into my unit. So I contacted the claims adjuster originally assigned to the claim I had filed with my insurance company (Farmers Insurance), that I had withdrawn at the beginning of this water damage event to my condominiums kitchen ceiling.

After another 2 weeks of waiting for a response from my insurance company, I am told that my homeowners insurance policy does not cover for "intermittent water leaks". This has left me in a state of disillusion and confusion. I have been giving the run-a-round from both insurance carriers to say the least. I feel totally abandoned by my insurance company (Farmers).

The once very cooperative upstairs neighbor has now pretty much gone silent on me, not returning my attempts to contact him.

About 2 weeks into this water-damage event, I finally had a water damage restoration company start the dry-out/debris removal process for a very reasonable $450.00 - - just to do the dry-out process & removal of the damaged ceiling drywall and insulation. This was out of my pocket costs. The technician doing this dry-out process found evidence of mold just as he was starting to remove the damaged ceiling drywall. He tells me that he will have to set-up a containment field for mold remediation and that it will now cost $2000.00. I immediately contacted the upstairs neighbor (who was aware that I starting the dry-out process from my correspondence to him the day before), and brought him downstairs to speak with the technician. I did not have the money out of pocket to cover this and ultimately had the technician stop work, which he did. Technician and his company did not charge me and was very nice to cover the hole he started in my ceiling with clear plastic.

In finding the evidence of mold, termite droppings and drywood termite damage was discovered with the starting of the dryout process. Back to that new discovery of the termites later in my post.

Meanwhile, the long drawn out process of waiting for insurance companies decision to cover the claim was slowly marching on. It was 4 days later from the first dry-out process attempt that the water damage restoration company contacted me and mentioned that they could do the dry-out process with mold remediation for $1000.00. Wanting to get the dry-out process started once again, I agreed to that price and paid that $1000.00 cost out of my pocket. (( still waiting at that moment for the insurance company (Liberty Mutual) to cover the claim or not )). I made the decision to move ahead, partially under the premise to mitigate possible ongoing damages.

It was 5 days later after this 2nd dry-out process was started and completed, that the upstairs neighbor insurance company informed me that they would not cover the liability claim I had filed with them

During that 2nd dryout process, some very significant drywood termite damage was discovered in and around the area of the water damaged ceiling from upstairs neighbor leaking dishwasher. 2 of the big wood beams (joists) and the plywood subflooring between those 2 joists showed some serious drywood termite damage.

I must apologize for this long drawn out post of mine. I have informed my HOA of the situation from almost the beginning of the water damage event, but because of a misspelling of a E-MAIL address apparently, my contacts with keeping the HOA informed of my situation were not received until just the past few weeks here.

I would like to know how I should proceed from here. Do I have grounds to sue the upstairs neighbor if he decides to just ignore me, or balks at making any attempt to share the costs of the damage his leaking dishwasher has caused me. I would like to avoid litigation if at all possible. I have not at this point brought to my insurance company's attention about the termites. I am so fed-up with dealing with them.

During these past 2 weeks I have had termite pest control companies come out to give free termite inspection/repair estimates, ( 18 different termite pest control companies ), and almost everyone of them tell me that fumigation ( tenting the building ) is the only real way to deal with the termite infestation. My condominium is in a Quad-plex building ( 8 units to a building ) Trying to get all eight homeowners of my building on board with sharing the cost of termite fumigation of the building seems to me a almost impossible task, not to mention having to be relocated for the minimum 3 days of the tenting process of the building.

Would it be possible to file a claim with the HOA's insurance carrier about the termite damage?

Since the news of the insurance companies not covering this water damage event, and the upstairs neighbor seemingly washing his hands of this situation, I have been going this whole nightmare of a situation alone. Going about trying my best to get as many estimates from these service companies to minimize the mounting costs associated with this whole fiasco. I am of limited means, and a fixed income. Having to pay these costs out of my pocket is straining my small nest egg (savings), or soon will be.

What I had planned to do was: Doing a localized termite treatment to the ceiling area that has been opened up and exposed during the dryout process, and doing moderate wood repairs to the upstairs neighbor's plywood subflooring area of drywood termite damage. Doing wood repair to the floor joists (instead of replacing them entirely) Then eventually do the ceiling restoration - drywall / insulation replacement - with minimal painting. Then, after doing all the above repairs, go after the upstairs neighbor for at least half those costs - - which I believe is reasonable, given the circumstances. I guess that would be small claims court to settle this? Would I have a case to begin with?

This is so not fair. I am so overwhelmed with this whole ordeal. I don't mean to complain here. I just don't know how to proceed at this moment. I live here in Southern California, South Orange County area.

I don't mean to handicap myself here, but I suffer somewhat from being bi-polar and have a hard time expressing myself socially. Thus, this very lengthy post I submitted here. Again, I apologize for that.

I would greatly appreciate any insight, or information, advice on how I should proceed with this. Thank you .

    Dental insurance??? /supplemental insurance ???

    Posted: 29 Jan 2021 01:08 AM PST

Hello all, I just recently signed up with a Kaiser health insurance policy and there is a dental plan invoked but it's not quite clear on how it works. Since Kaiser does all of its health and dental work in house I can't find a private practice that takes it. I need to get a lot of work done and I was wondering what action I should take. I am not to familiar with how this all works so I apologize. What would be the best plan of action? Can I get a separate full dental policy or should I get a supplemental policy or both? And if so is there a waiting period that I have to wait to get work done? I know I need some bonding done possibly a crown and a cleaning as well as a few cavities. I'm lost in what to do. Please advise. Thank!

Does being added as a secondary driver prevent a lapse in coverage?

    Posted: 29 Jan 2021 12:48 AM PST

Just sold my car recently. I barely drive anywhere nowadays and have considered not getting a new car for at least a few months for that reason.

If I get added as a secondary driver to another household member & their car insurance, will that allow me to cancel my current policy and have it not count as a lapse in coverage for when I eventually do get another car? We both have GEICO if that matters, in Ohio.

    Thank you!

Is this Long Term Disability Insurance a Scam or is it a Good Value?

    Posted: 28 Jan 2021 09:00 PM PST

I'm a 28 Male in California, USA and have started to think about protecting myself on long term disability insurance, but I wasn't sure if this was a good deal. I saw over at the Boglehead's suggestion on disability insurance and asked all the right questions, but I'm not sure if this is a good deal.

Can you help a confused soul out and tell me if this is a good deal? I'm thinking Select is fine enough, but Premier isn't that much more expensive?

Bodily injury claim vs property damage

    Posted: 28 Jan 2021 03:32 PM PST

Hi. Thanks for taking the time to read this. I've never been in an accident so I don't know how this works.

I'm in Arkansas, USA The other day I was sitting at a traffic light and a vehicle rear ended the car behind me, which in turn rear ended me. I got pretty severe whiplash. I got my vehicle estimate and it is $6000 to fix.

I went to the ER later that day because my neck was killing me, but they just said I had a sprained neck and a strained back.

The next day I got a call from a chiropractor who said they would file a claim with the at fault drivers insurance. So I went in and got X-rays, and the next day I got adjusted. They said if his insurance refuses to pay, they will consider it a write off.

Now my question is this— Aren't injury and property damage claims dealt with separately? I would like to get my vehicle fixed as soon as possible, and I didn't know if I could do that with an injury case open. I have not heard from the other guys insurance company yet, but I'm expecting a call soon.

Will his insurance cover my ER bill, chiropractor visits, and pay for a rental while mine is getting fixed? I haven't gotten the ER bill yet, but I'm sure it will be pretty steep. When the guy calls, do I tell him I am still waiting on that bill?

    Thanks for the help!

is accepting a 90% payout accepting 10% fault?

    Posted: 28 Jan 2021 10:30 PM PST

About a year ago a lady drove into my lane on a intersection and hit me. I was able to turn and break, but it wasnt enough and we both had some minor damage. Mine was around 900 bucks. She was charged with "failed to yield right of way at intersection" I wasnt charged with anything

Started shopping around for insurance because my premiums went up today(geico says it's just normal price increases for everyone. Bullshit imo) and now this accident is showing up on all my quotes for new policy.

I accepted the 90% payout becuase they were dicking me around for weeks and it was the difference of maybe 100 bucks. I wasnt injured so no lawyer would give me the time of day. It wasnt worth the time (at the time) to fight for that 100whatever dollars. The type of insurance I have with my geico only pays to others if i screw up. I didnt have collision so the lady at geico said they wouldnt talk with the ladys insurance on my behalf.

How fucked am I and is there anything I can do?

    Edit: I'm in Florida.

Good advice to avoid filing second claim in just over a year?

    Posted: 28 Jan 2021 08:55 PM PST

    EDIT: Location is Washington, U.S.

My parents made a claim on their homeowners insurance in November 2019 when the washing machine on the second story overflowed through a missing filter and flooded several areas in their house. Because of COVID, the repairs still are not complete (wood floors still need to be repaired and refinished), but the total damage will be around $40k–50k once everything is done.

About a week ago, heavy rainfall leaked around the sewer vent in their roof. The water remediation cost about $5,000 and the roof repair another $1,000. The repairs to put everything back to how it was are estimated at another $5,000. I advised them that since they made a claim just over a year ago, they should not make another claim now because they risk being dropped by their insurer and having to find another, likely much more expensive, insurance provider. They can afford to pay for these repairs (out of savings originally planned for other things), but have asked me "what's the point of having insurance if you can't use it?"

Am I giving my parents bad advice? Should they go ahead and make a claim?

    Hertz Car Accident

    Posted: 28 Jan 2021 01:35 PM PST

Back in Summer 2020, I got into a car accident with a car I rented from Hertz. Unfortunately the only protection coverage I opted in for was 'PERS' which is Premium Emergency Roadside Service. This does not include car damages. It covers roadside assistance such as towing. In November 2020, a Hertz staff member reached out to me telling that I owe about $11,000. I asked them to send a breakdown of the charges. Couple of days later they reached back to me with a full break down of charges. Based on the breakdown, the 11k also includes towing expenses which was roughly 2.5k. I responded back to the staff member saying that as they can see on my receipt, I opted in for PERS that day which covers towing so I requested them to send an updated bill to me with the towing charges waived off. However, they never got back to me since November.

So should I reach out to them again? Or do I wait it out until they reach back to me?

I got into a collision, and need some advice on how to go about negotiations.

    Posted: 28 Jan 2021 06:32 PM PST

Ok, so long story short. Someone hit me 2-3 weeks ago and insurance has decided to write my car off however they're being what I think is unreasonable by not factoring other costs associated with the car and I'm starting to lose my patience with them.

I live in Canada, and the car I owned was only made for the US market and only 5000 were made, as a result my car was freighted over to Canada when it was new from private seller. And now in estimating the value of the car, they're only considering the cash value of the car in the US and not the additional freight/taxes associated with importing back a similar mileage one from the US.

I would have accepted their offer in a heartbeat if I didn't have to deal with freight/taxes. There's only one for sale in my province and it's going for $1500 less than what they offered however it has more than a 100,000 KM more than the car I lost.

How do I go about getting them to go up a bit in price? I asked them if they could cover the freight or taxes and I'd eat the cost on the other, but they declined that too.

    Thanks in Advance.

Edit: It was a ruled a no-fault if that matters.

Owe $650 to Louisiana State for letting my insurance lapse, is there anything I can do to lessen this?

    Posted: 28 Jan 2021 04:42 PM PST

Long story, I was 19 with my first car and it gave me nothing but issues. Threw a rod my first month owning it, got the engine replaced, got dicked around by a mechanic because he thought he could take advantage of me, the whole shebang. After I realized this was the car from hell I decided to just say fuck it and cancel the insurance and leave the car sitting until I could actually financially get around to fixing it. Called my insurance and told them to cancel since there is no point paying insurance on a car that doesnt do anything but sit there. They cancelled it for me and I thought it was all said and done. I found out a little over 3 months later that I now owed $650 and some change to the state because I "let my insurance lapse." Like I said, I was a first time car owner with very little help from any kind of adult figure since I had been on my own since I was 16. I found out that turning your plates in is kind of a requirement if you are going to cancel your insurance. My insurance(State Farm) did not let me know this at all. I have sat on these fees for the past few years since I have never been in a good enough financial state to get another car, let alone pay for something that I deem is a little ridiculous and not my fault to a point. Is there anything I can do or an office that actually listens to my issues without saying that there is nothing they can do? I want to pay it at this point but I want to know if I even need to or if there is another route I can go to save myself this money? Any advice would be very helpful, thank you.

TL:DR Cancelled my insurance, was not informed that it was a requirement to turn my plates in, now owe around $650 to the State of Louisiana for letting my insurance lapse. Requesting advice. Help please.

    Claim help Contd.

    (TEXAS)

As I feared in my previous post (https://www.reddit.com/r/Insurance/comments/l3mizf/is_this_a_clearcut_liability_case/) GEICO has determined that this is a 50/50 liability case. The other driver claims he was already in his lane when the contact occurred. Yet, in the video you can clearly see that I'm barely over the first lane divider line when the impact happens. Given the length of my car (2002 M3) compared to the length of these lines (10 feet on, 30 feet off- per my research), there is no physically possible way his car could've been behind mine in the lane. I disputed this with my adjuster and she discards this reasoning with remarks like "I'm not a mathematician." However, its basic facts that should be taken into account. I feel like I'm taking crazy pills. How do I navigate this situation to get them to think about this a little more critically?

I got in a car accident [CA]

    Posted: 28 Jan 2021 02:34 PM PST

I got in an auto accident a couple of days ago. I making an unprotected left turn from a stop sign onto a road. I've made this turn hundreds of times as it's down the block from my house. I know it's a tough turn as cars on the intersecting road are often speeding. I take extra time to stop and make sure I have enough time to turn onto the street. I begin making my turn right as I pop out a car that was out of my field of view came racing down the street. The driver hits the front end of my car and my car spins about 100 degrees almost parallel to the lane the other driver was coming from. I understand the rules of the road. I know that I was supposed to yield there. Both the tow truck driver and my insurance company is telling me that although the other driver may have been speeding it would be hard to prove so and that I must accept fault.

I'm here to ask if anyone has been in a similar situation and have tried to argue for some sort of balance of fault or finding evidence from the damages of the car (or other means) that the person who hit me was in fact speeding. I'm just bummed because I was extra careful and his car was not visible until it was too late. If there is a better subreddit for this question, please let me know.

Victim of a Hit & Run

    Posted: 28 Jan 2021 10:43 AM PST

I bought a car from a private party several states away and attempted to drive it home last week.

Literally only 10 miles from home, I got rammed by a truck that proceeded to run away.

Long story short, I have a title in hand signed by both parties. Before I picked the car up though, I put it on my insurance policy and paid the premium.

I'm a little worried about saying anything to my adjuster as I'm terrified my claim will be denied.

I'm in the state of Kentucky which I believe requires out-of-state vehicles be inspected prior to issuing a new title. DMVs are by appointment only (several weeks out) and I can't get ahold of anybody by phone to confirm this.

    Any suggestions?

    Thanks in advance!

    Claim offer advice

    Posted: 28 Jan 2021 01:41 PM PST

A week or so ago I asked for advice on how to get ahold of the opposing parties adjuster and just overall what to expect. I finally found out that the guy who hit my car never filed a claim with his insurance so they didn't know about the accident until my insurance called them. The guy has been avoid any calls from his insurance and have now gone ahead and even asked me for any proof he was there and hit my car. I do have a piece of his bumper with his VIN number on it and the police report that took all his information. They said they would be in contact with my insurance to get a statement that he was the one who hit my car. Thank you to everyone who helped me get ahold of the adjuster. Now I'm having a little bit of a problem deciding what my next step should be. They gave me two offers from the pictures they have seen. Please keep in mind that they still are working on sending someone to evaluate the damage in person and for now just have pictures and videos of my cars damage to work with. The two offers they gave me were:

    1. Sell my car to progressive ( more money I get they claimed)

    2. Keep my car but it will have a salvage title but they will still give me money (less money with this offer since I still have my car)

Like I said I have no knowledge of how insurances work or what can be the best way to go. If anyone has any suggestions on which offer I should take or what should be my overall next steps please leave a detailed comment on how it can benefit me. I know what a salvage title is and how it can affect my insurance I just don't know what is best. I personally lean more towards selling my car to progressive but I'm not sure what will come of it.

Thank you in advanced for any advice.

Best insurance for young driver? (20F)

    Posted: 28 Jan 2021 01:37 PM PST

Does anyone have a recommendation for car insurance for a 20 year old female driver in Nevada? I have good credit (730-750) and no accidents or tickets since I was 16.

My last car I had under my mom's name because I paid for it in full but she has terrible credit. The next car I'm expecting to get a loan, but which company and method would be cheapest for insurance?

If I co-sign the car with my mom and the insurance will it be cheaper or should everything be in my name with the best credit even though my age might make the insurance rates sky rocket?

TL;DR: Cheaper to co-sign with someone with bad credit or have the car and insurance in my name despite my young age?

I am in a loop with medical bill (az)

    Posted: 28 Jan 2021 12:47 PM PST

I have state healthcare. Healthcare has a provision that states i am covered for out of state medical care if it meets certain criteria. The criteria i met was needing emergency care.

I received care in another state with the assumption i was going to be covered due to the above clause. I received a medical bill for the care and called my state insurance. It has been going back and forth for a while now but the problem is

My healthcare wants to pay for it but the hospital is not wanting to work with them because that would require them to register their hospital to work with our state, which they seem unwilling to do. (Something about tax paperwork) I have talked to the hospital. The insurance has tried (albeit isn't putting much of an effort) contacting the hospital. They have sent a letter to them but they have not responded. The hospital doesn't seem to care to contact my insurance. What do I do other than start paying the bill because I don't want it to go to collections.

Is there a chance of Additional Living Expenses (ALE) being denied?

Hi all, my only bathroom flooded so our insurance (Allstate) is putting my husband & I up in a hotel for a week or two until the bathroom can be fixed. They told us that any additional money we spend on food beyond our weekly average (which we estimated is $100), they will reimburse. Obviously this leads us to the temptation to just eat at restaurants we wouldn't normally eat at because it would be "free". Nothing too fancy—the same types of restaurants we would normally eat at, but more often, and also maybe throwing in a drink or dessert when wouldn't normally splurge. However, we are also concerned about insurance declining to pay us back if we go too far over our $100 estimate. The hotel has a kitchen (sort of—it has two tiny hot plates, no microwave, no oven, no toaster), so we don't know if that will give them justification to not pay for restaurants.

Does anyone have a similar experience? Did your insurance give you any grief for meal expenses? Thanks
