We had a relationship then, but now I am 30-years-old and we no longer speak. I never found out any information about the policy, but I continued to pay her with monthly checks towards it. Now that my loans are a lot lower, I want to reach out to to have it transferred to me as the policy holder. However, my fear is that she will decline doing this and I have discovered that a policy holder does not have to give me any information or pass the policy to me. Is there any possible legal action I can take if she withholds this from me since I have been giving her checks towards it all this time? If I can do that, what is the likelihood of me getting the policy? [link] [comments] |

Posted: 29 Dec 2020 11:15 AM PST Just received a voicemail from Geico (not my auto insurance provider) following up about an accident I allegedly reported a few weeks ago. I haven't reported any such accident. My first thought was that it was a spam call, so I called the claims department from the number on Geico's website, and they confirmed the claim number I was given. I looked up the claim details on Geico's website, and there is indeed an open claim. I can also see from the claim details that the claim includes my Name, Phone Number, DOB, and Home Address. The location of the accident is across the state (6+ hours away in Long Island, I'm in Western, NY) in a town I have never been to, nor through. The vehicles involved in the claim are not vehicles that I have ever owned. The vehicle that the claim says I own is a Honda - I've never owned a Honda. The other vehicle is a Toyota. And the Honda's VIN number listed on the claim is actually registered to a Nissan Altima - also never owned a Nissan. So that's a strange mismatch... I would say this is just someone who got in an accident and gave a random name that happened to be mine... but the claim includes lots of my personal information - Name, Phone Number, DOB, Home Address... That's concerning. The only solace is that the vehicles involved are not vehicles I have ever owned... And the fact that I don't even have auto insurance with Geico. (I'm currently waiting for a callback from the Geico Adjuster who is assigned to the Honda. The original call was from the Geico Adjuster assigned to the Toyota.) Anyone have any thoughts on the situation? Should I be worried about identity theft, or is it possible that Geico auto-populated my information from my name/phone number? (I haven't had Geico insurance before, I got a Geico quote not too long ago, so Geico had all that information from the quote.) UPDATE: Just heard back from Geico. Apparently, the accident was reported citing my license plate. Geico then pulled my Home Address, and DOB from DMV records, and pulled my phone number from some other online service. Since my license plate is registered to a car that doesn't match the make/model of the cars involved in the accident, (and since it happened 400+ miles away) the adjuster said it's most likely just that the claim was reported with an misread/incorrect license plate. TL; DR - My personal information was not reported by person making the claim - it was filled in by Geico in response to a (mistaken/fraudulent) claim tied to my license plate number. I am sure she is at fault because my dashcam footage shows my car wasn't moving when I was hit. I informed the other lady I will file a claim with my insurance and she threatened me that she will tell her insurance company that it is my fault. Pretty sure the other lady told a completely different story than what I told in my claim. I already filed a claim with my insurance company but haven't personally heard from my adjuster. The other lady's insurance company has called me 3 times today but I haven't picked up. I had been reading/researching and many have advised against talking with other insurance company because what I say may be used against me. I have a feeling they will bomb me with calls so I'll feel forced to pick up anyway. Should I pick up or just ignore? I'm now being sued/dishwasher damage/pending insurance Posted: 29 Dec 2020 09:52 PM PST Hi. I own a condo in Montreal, Quebec, Canada. My downstairs neighbors recently complained of water behind closet doors and a crooked wall. Turns out it was my old dishwasher that was seeping, which I immediately upgraded. My unit has no damages and I have nothing to claim. I posted the details in a previous post which you can see in my history. Fast forward a few months later, my HOA President sends me a bill of the repairs done to the damage caused by my appliance (supposedly - no estimate or breakdown of costs were submitted. Also is this handyman a certified journeyman? No). I did open a claim with my insurance company, sent all the bills to them, and the case is still opened and in process. I was told I am unlikely to be found negligent, although no formal decision has been made yet. HOA director called me a few weeks later to inquire what's going on. I explained that I submitted a claim with my insurance company and am waiting for a decision. It hadn't even been a month by then. He hung up and within a few days I got a notice saying I am going to be sued in small claims court because they haven't heard any news from me ...? I find this untruthful since the HOA president did contact me by phone a few days sending me their bills and I informed him verbally that I had opened a claim with my insurer and it was in process. Therefore to state on the formal notice that they haven't gotten "any news from me" is fallacious. So their formal notice is voided and nul. My insurance company is slow in taking action. I did let them know I'm being sued and sent them the formal notice as soon as I received it but no response yet to my inquiries. I did my due diligence but I cannot be held liable nor penalized for my insurance companies processing delays especially within the covid pandemic context and Christmas holidays when staff is off. I'm driving around with the bumper being held by tape and scraping the ground and my lights keep flickering. That was on the 9th. I called my insurance and they said they were gonna be looking at the other persons insurance but I havent heard anything since. What do I do here? Do I just spam my insurance person asking when my car will be fixed? Do I track down the Nissan person and tell them to pay? Do I fix the car myself? I am comparing two quotes, and there are plenty of similarities. One glaring difference is their approach to linking the two policies. Company A is selling a policy that offers $100, 000 in coverage for both my wife and myself. These policies are linked, so we have $200,000 in coverage that we share between us. Company B is selling a policy that offers $145,000 in coverage for both of us, but the policies are NOT linked—and so we each have $145K in coverage. Is one of these substantially better than the other, based on risk & reward? I can imagine that either one might be better, based on what happens in the future. She had multiple insurance policies, some with her current husband listed as the primary beneficiary and some that were never changed from her other husbands name who died before her. Is there a way for her children to be able to claim those since the primary beneficiary is already dead? Would they have to be written as the second beneficiary? I'm in like the bracket where I'm preemptively fucked. I've been shopping around and I can't get any quotes lower than $350. That's a week's paycheck for me. An entire week's fucking paycheck. That's asinine. My friends (who, to be fair, have a more extensive driving history and have cars more than a decade old) pay only around $130 a month. Is there any way I can get it at least under $200? I don't have much of a choice but to drive in the area I live, but I'd rather pay my $400 rent than pay nearly the same for car insurance. However, I've had to file a few claims this year, all not at fault (NAF), but I still worry about them not renewing coverage. I wanted to try and get more information or insight from those of you who have dealt with insurers in California. I did speak to my broker today (through AIS), and he didn't seem concerned at all due to my policy. I have five cars, two drivers, and very high limits. My policy is also quite expensive. I think the most likely loss I will suffer in my 7th floor unit is water damage (either through sewage backup or escape of water). I've been trying to get quotes through Surex. All my quotes provide sewer backup coverage. I noticed they are providing many different options but almost all of them don't have a combination of Escape of Water Coverage and Loss Assessment Coverage. Some provide contingency coverage but I don't know what that is.. I created a flowchart (I love my flowcharts) of different scenarios and how coverages/claims would work. The first scenario is the best case scenario and shows the process when an insured has loss assessment and escape of water coverage. The second scenario shows the scenario when the insured only gets loss assessment coverage as the insurer wouldn't provide escape of water coverage. If you were diagnosed with cancer that wasn't yet terminal and you refused chemo etc and then you later became terminal, would the insurance company use your treatment refusal as a reason not to honour their advance payout? Strange situation with Metlife dental insurance Posted: 29 Dec 2020 07:09 PM PST I went for a routine appointment at a new dentist in October, and despite giving them my insurance info they billed me $397 for the procedures (Exam, x-rays, cleaning). I guess they forgot to submit the insurance claim, I called them after getting the bill and they sent it over to Metlife. A couple weeks later I got the EOB saying that the claim was fully covered and the dentist was sent the negotiated in-network rate of $144, I figured it was settled. But now I got a letter saying that the dentist was overpaid $144, and they sent a letter to the dentist asking them to pay them back. And now they've sent a check of $144 made out to me instead. According to Metlife this claim was supposed to be paid out to the insured, not the provider (why?). This all seems very backwards and inefficient to me. First of all, am I correct that since the dentist is part of the insurance's network, if they tell me I owe them $397, I can tell them to pound sand, right? If the dentist wants more than $144 could they send it over to collections or screw me over some other way? Second, what happens if the dentist never sends the money back to metlife and I cash the check. Is metlife gonna come after me now? I pulled out of my garage with my tailgate up, and damaged the door and shattered the window. Body shop came back with an estimate at $3,000. My deductible is $500 with Geico. COVID-19 rapid testing not covered by insurance Posted: 29 Dec 2020 06:36 PM PST Hi all, So here is my situation. I would like to get a COVID-19 rapid test to receive the results within 24 hours. However, the insurer that I have does not cover the rapid testing and you are not allowed to pay out of pocket for the rapid test if you have this insurer; I have confirmed this. However, most testing centers I've looked at say that if you are NOT insured, you can pay out of pocket the price of the COVID rapid test. If I was to go to a testing center and simply say that I am not insured and pay the price of the test, are there any consequences to this? My first thought would be it could be related to insurance fraud, but if I'm paying for this specific test for the full amount that it costs, I'm not sure if it there are any actual ramifications from this? Drove car into flooded area, need advice, afraid insurance is gonna screw me over. Posted: 29 Dec 2020 02:24 PM PST Hi all, some backstory so get the full picture, I currently live in NJ.
This happened 11/30 on a very rainy day, there were no indications of a flood area and there were no lights (rural area) going downhill on a road so by the time I saw the flooded road it was too late. I got in pretty deep, car flickered but i managed so back out but ended up in a ditch.
Called police over, we verified the information, engine bay looked dry but couldn't tell because of how dark it was. Exhaust was shooting out white smoke and water (verified with officer after the accident on call, says he has footage). Area was flooding and insurance was taking forever collecting information from me and actually get a tow truck out to help. Cops ended calling their own tow and getting me out of the ditch. From a glance after I was out Power steering was failing on and off, engine started making ticking noises. I have videos of these happening after the accident and uploaded it, but they seem to be ignored. Police report only went over the cosmetic damage.
Fast forward and Insurance claims adjuster reaches out to me a few days later, checks out my car, says its flood damage (fresh water) there's nothing for him to see and ghosts me for about 2 weeks. I call Geico and they set me up with a different claims adjuster to help me out. New guy goes over the car with me, takes a picture of a damaged bumper and checks for water in the air filter and inside the car. I tell him its been sitting for 2 weeks its probably dry so its obviously gonna be dry by now and he says "oh ok no one told me that". Says we need to get it to a shop for flood damage assessment. I told him i uploaded dozens of pictures online of exhaust damage, with rocks going into the resonator and videos of my issues, didnt seem like he really cared.The damage report so far only shows cost of replacement for my bumper so far.
After its taken to the body shop I get a call back saying they found nothing wrong with the car besides cosmetic damage, and everything that happened with the power steering and engine is probably manufacturer related. They scanned everything and everything was fine there were no errors coming up. But there are no issues or recalls or tsb's for any of those things. When I brought up the under body damage, exhaust, etc they said they have not been told anything except to check power steering and check the computer. And they can't do anything else until they start repairs. So i'm already getting red flags about this place.
Feels like insurance is trying to shaft me hard over my claim, not sure what i can do. They dragged their ass on my flood damage claim and it seems like I'm the one whose gonna get screwed because of it because a shop cant reproduce my problems. Any have suggestions as to what I should do? For all i know entire under body is shit and it's a matter of time for water to show the damage. Things like control arms, power steering rack, bellows and boots, drive line, i have no clue how they're handling any of it and im gonna get stuck with a big ass bill later.

Neighbor's Uhaul truck hit my parked car yesterday ... what can I do? Posted: 29 Dec 2020 12:04 PM PST Hi there. Yesterday my neighbor drove a Uhaul truck into our shared driveway. The truck was at an odd angle so as a precaution, I took a photo of it next to my vehicle in case anything happened. Just my luck. I come to check on my car this morning and there's a scratch on the left bottom corner of the rear bumper, consistent with the white paint of the Uhaul truck. There's multiple scratches, maybe 8 inches in diameter total. Most are surface but some I are a few milimeters deep. Although I didn't see the driver hit my car, I have photos of how close the truck was to my parked vehicle and a photo of the damage today. Both are time-stamped. Before I go knock on the neighbor's door, what are my options? If they refuse to admit that they did it, can I go to Uhaul with my evidence? I'm in Ontario. EDIT: Confronted neighbors. Posted: 29 Dec 2020 05:53 PM PST My long-term partner and I are definitely in need of some couples counseling but we are very broke, and my partner doesn't have health insurance (I think, he may or may not I have medical) and I am barely still covered by my mother's insurance. Is there a way to get my health insurance to cover couples counseling? Would it help if I got my own counseling? I have anxiety and bipolar tendencies so I probably should do that anyways. If couples counseling cannot be covered by health insurance in any way then is there some way to pay for that through other means? Sorry if this is a basic question, we are both in our early twenties and very unfamiliar with handling insurance. Long story short, I had an accident last year (I'm at fault). After more than a year, I decide to switch from GEICO to AAA after a friend told me about lower rates. Innocently, I called GEICO to cancel, and made the switch to AAA. A week after the switch, I then get a letter from GEICO saying they are continuing the investigation and evaluation of the loss, pending all vehicle property damage supports in order to submit the pro rata offers to parties. Odd how they let me cancel then will send me this afterwards. Has anyone received a letter like this before, and what does it mean for me? I'm a young adult living on my own and I'll wholeheartedly admit I'm a bit naive to these things. For reference, I am in Orange County in California. Any insight is greatly appreciated! Question about auto insurance in Michigan Posted: 29 Dec 2020 05:03 PM PST I currently have State Farm insurance for my home and auto and I had a question about making a claim. Someone scratched part of my door while parked in the parking lot. It was enough to scratch the clear coat and base coat of the door. It is a nice (to me) car and the damage is big enough where touch-up paint would be noticeable. I want to know if filling a claim with the insurance to repaint would increase my rates or if they don't get impacted by these kinds of claims. The insurance covered only 8k of a my toyota Prius 2012 but i just had bankruptcy a month before the accident and couldn't buy another car with the insurance offer. I was only able to get another car at high interest 300$ m /72m because of previous bankruptcy. Should i sue them for special damages claim in small complaints court or should i sue the driver ? My current lawyer said i can't include special damages except body injury although i read on internet that insurances should cover special damages too. Any advice would be greatly appreciated! Posted: 29 Dec 2020 03:49 PM PST My fridge was leaking and I had it checked with 2 different companies while I still had home warranty, they found no issues but moved a few things here and there. The fridge kept leaking, but at the back so I didn't notice. I moved the fridge to clean and found out it was still leaking and the cabinet next to it is full of what looks like black mold. I checked my insurance policy and I have a cap of $10k for mold, I haven't filed a claim yet because I have heard many stories of people getting dropped for filing a single claim. I have a friend that does mold remediation and he said removing the mold only would be a $5k job (because they need to test the whole kitchen). I seriously doubt insurance will give the full 10k for a single cabinet. I am in FL. Anyone has any experience with filing the claim or any recommendations?
