    I've been working for a couple of weeks on several pieces of furniture and am not asking for more than what was originally agreed on. He started texting me this weekend, and long story short, says he's picking it up first thing tomorrow and that since my prices are a scam, he will pay a "reasonable" fee. He says he is legally entitled to his furniture back without paying for them. I've never dealt with this in 17 years of doing business. Do I have to just hand over his furniture with no compensation? Also, my door says I'm closed on Monday even though I'm always unofficially open, so that might buy me time. I did take pictures of before, during and after of the process, if that helps. I'd just like to say I'm very skilled and only average about ten bucks an hour in profit. This guy is being a greedy asshole. Help,please!

    An anonymous neighbor has been leaving notes on our car and it's starting to scare my mother.

    Ever since the election cycle started to gain steam, I've put Biden Harris stickers on my car and my parent's. One of our neighbors has been leaving anonymous notes on the car telling us why Biden and Harris are evil and how Trump is a fighter against the media. The notes at first were copied via printer and obviously meant for multiple people but slowly they involved more and more writing that was only meant for us.

    Today was the first note since the election started and it was warning us not to celebrate the results. It was also all written for us as non of it was printed. This really scared my parents and I'm wondering if I have any legal grounds to involve the police or if I'd just be brushed off.

    Edit: I live in Florida.

    Update: Convinced parents to get security cameras. If we catch the neighbor on tape we will contact the police. For now I'll put an "under surveillance" sticker on the cars to try to deter the person from posting more notes. Thanks for the help!

    Our elderly neighbor ran her car into our house. It doesn't appear she will lose her license or any other safety measures. This is the second time in two years she accidentally drove her car onto our property and caused damage (PA)

    Last week, our neighbor (whose driveway and our yard share a boundary) accidentally drove her car into our house, took a chunk out of it, hitting our gas line. Luckily, we were home at the time. She appeared very confused so I am not sure if she would have called 911 had we not been here. I can only hope, had she not, someone would have smelled the gas leak and called 911. We had to evacuate the house with our dogs and could not go back in until the gas line was capped.

    We have had contractors out to make repairs and our insurance will be pursuing their insurance to cover the damage.

    About two years ago, something similar happened. She did not veer as far to the right with her car and did not hit our house, but hit a wall on her property and plowed over some of our bushes and dented our trash cans. We did not file any reports, which in hindsight may have been a mistake.

    Her adult children have been around. Her car is no longer in the driveway. It likely is just out for repairs. But she is still living alone. And, frankly, we are scared this could happen again and to a scarier degree (hitting one of us? more house damage? another gas leak, when our dogs are home alone?) And also, I worry she may hurt someone else out on the road, not just in her own driveway. When the cops were here, we let them know something similar happened before and another time she left the house with eggs on the stove and alarms started to go off.

    Is there anything we can do? Any options? I feel like we are at the mercy of her children. The first time, she claimed it was because, in her new car, she had a hard time determining if she is in reverse or drive. She offered little explanation this time and barely an apology.

    My husband spoke with neighbor and daughter after it happened, and daughter was a bit hostile and resistant initially to providing insurance information. So, I doubt a discussion about her mother's driving will go better.

    Fired from job after not accepting promotion-- now they want to hire me back at 40% salary

    The company I work for wanted to promote me. They were willing to offer a 50% salary increase for about 300-400% more work-- Running the entire marketing/internet department. I said no, and that I was perfectly content in my current position. This is not a company that is known for taking care of its employees and having the increase in responsibility would have gone along with substantial stress that I am not equipped to handle.

    I would have accepted the promotion for an increase in compensation that reflected the increase in work, but am not willing to make less than 6 figures to run a whole dept. and run marketing (with no help) for a 50-person company with millions in annual profits. I have done great work in my current position and like what I'm doing.

    Last week, they fired me. They tried to hire someone to do my work, but the quality was horrible and they realize they want me back.

    They offered to re-hire me, but at 40% of my normal salary. They would not decrease any of my responsibilities.

    Question:

    Do I have any legal recourse here?

    Can I file for unemployment even though I have a job offer? (I also make about $500 a month from a side business).

    Radiation oncologist canceled my cancer treatment after seeking second opinion

    I guess I should start by saying I'm 27M in Pennsylvania and diagnosed with myxoid round cell liposarcoma 2 months ago. 2 months ago I had the original tumor removed by a general surgeon and then started the hundreds of fights with insurance. I had to fill out a network deficiency report just to get a sarcoma specialist in network.

    Finally I found and talked to an oncologist and she began me down the path of radiation for 6 weeks and then I was to start chemo. During all off this I found out that a far away sarcoma center I shall refer to as ABC is in network for me so I decided to reach out and set up a teleconference call with an oncologist for a second opinion.

    I finally spoke with them after my first day of radiation treatment and they said they would like to perform a second surgery for wider margins after my radiation is complete. They also planned to ask my radiologist what dose I was getting so they were prepared and as to why he was radiating my lymph nodes when my cancer does not affect the lymphatic system.

    The next day I go in for my second round of radiation and ask if ABC had reached out for the info they wanted. The radiation oncologist enters and says the words "you should not have done that" and told me that he will not treat me now. Even though ABC Wanted me to continue treatment.. I began crying heavily scared that after finally receiving treatment he kicked me out again and I'm back to square one. He did not care that I was upset and he left the room. His nursing staff are all angels and helped calm me Down and pull my pants up (I was naked waist down at the time as the tumor was on my thigh)

    People are telling me to report him to the medical board but I don't know if that's the correct thing to do. Any advice would be appreciated. I still plan on calling the oncologist who referred him Monday to discuss these events.

    TLDR: radiation oncologist said "you should not have done that" and canceled all further treatment after I got a second opinion even though the second opinion wanted him to continue current treatment.

    Edit: thank you everyone for the advice. I have told my friends before that I'm afraid of making anyone angry by reporting him and just want my treatment. They said I need to do it to stop it from happening to others after me. So as many of you have suggested, after my treatment is completed I will pursue reporting him for what happened. I don't want anyone who has to go through this diagnosis to feel how hopeless I felt that day he spoke with me.

    I also wanted to mention my oncologist that recommended him knew 100% about my second opinion and encouraged me to do so. I even spoke with the second opinions office staff with her in the room. (They called during my appt with her to inquire about when My appt with them can be and she told me to answer the phone) Thank you again for all the advice.

    [West Virginia] Paid a contractor to remove a tree and pave my driveway, now he’s ghosting me.

    Hi all,

    About a month ago I [22M] paid a contractor to remove a tree in my yard, and to install a driveway. His prices were much cheaper than other contractors around, so I thought it'd be a good idea. He required up-front payment for both projects.

    A few days after payment, he came and cut down the tree. He said he'd be back the next day to remove it, and then start on the driveway within the week. This was a month ago.

    He's ignored my phonecalls, and when I text him he says "I'll be there later today or tomorrow" then never shows up.

    I'm getting concerned that he's not going to complete these projects, and the tree that he cut down is becoming a hassle on my day-to-day.

    Do I have any options on how to proceed forward? As stated in the title, this is in West Virginia, United States.

    How can I get emergency custody ASAP!! Please I do t have much time

    Hello quick summary in Indiana

    so me (29m) and my kids mother(30f) are going through a custody battle for a little over a year now. I document every single thing she does I have the kids Tuesday,Thursday, Friday, Saturday, and Sunday until 6 pm court ordered with Friday and Saturday being the only overnights. However they usually stay and extra day or 2 every week. I do not drink or do drugs, I sign my kids up for sports to keep them active, I go to every parent teacher conference, and have them in bed asleep by 8:30 everyday. I also take pictures before she comes just in case she decides to wake them out of there sleep just so they can stay at her house.

    Moving forward this is the third time she has brought a heroin addict around our children and won't believe me about it because she's so desperate. I reached out to her boyfriend's baby mom and she confirmed and sent me documents of his addiction and told me their kids go to therapy because of him now. My kids mother's boyfriends baby mom also told me she reached out to my kids mom and told her he's not okay and to not be involved with him. I'm scared for my babies life and I do not want them to go home tomorrow what can I do??

    Please help me I'm begging!!!

    Edit: Tuesday 4:30-8:30, Thursday 4:30-8:30 unless she decides not to pick them up they stay the night. Friday and Saturday they always stay the night every weekend for the past year and a half.

    Call parent refuses to provide childcare

    In Pennsylvania. My Ex is refusing to provide childcare for my 10-year-old son. At her house she is requiring him to leave alone in the morning for school and return home alone at night, she says he is ready for this. Last year The same child was put on a 504 plan specifically for his forgetfulness, ADD and lack of focus. I told her I would compromise and be OK with the afternoon but I absolutely disagree he should have to leave an empty house in the morning. Her response was that I should get a lawyer. Can I make her provide childcare in a court of law? Btw: she makes between 80 and 100,000 a year and can easily provide financially.

    Is it legal for a company to profit off of imposing free labor on commision staff?

    I work for a pest control company in Houston that only pays commision to field workers. It's an extremely megar wage and I feel the company takes incredible advantage of me.

    No pay for time or travel, only light commision. In addition to this, the company profits off of a no additional charge re-service if it feels needed. This is a big selling point for them, the problem for people like me is simply awful.

    Feild crew doesn't get any kind of payment for the time and labor involved with the work needed for a re-service. My boss says we'll get paid for time involved if we have five or more re-services in a day, the incredible problem I have with this is that in the months I've been with the company, I've never had five a day.

    I've been assigned to four a day many times, but conveniently never enough to compensate. I'd understand more if it were 1099 work but it isn't. I'm w4 with them.

    It's especially infuriating because I have to work six days a week and for less than $500 a week. Insult to injury is that I'm forced to work every Saturday because I'm new.

    But is profiting off of a service imposed by free labor legal? If so, how?

    Can a contract that wasnt signed be enforced?

    I know this sounds rediculous

    I'm in marketing and I have a client who is a lawyer

    We're in month one and I'd like to terminate this engagement

    I just noticed he never even signed our contract

    I plan to tell him we're terminating and refund him tomorrow

    I know he's checking the contract regularly and will likely know it better than I do at this point

    If he points to something in the contract that corners me, can i basically just say "it was never even signed" and be off? Is that safe?

    [California] Leasing office charging for painting + cleaning regardless of condition?

    Hey guys,

    I live in the LA area. Basically, I'm about to move in a week and had a pre-move out inspection where the inspector found 0 issues but told me that there will be a flat charge of $150 for cleaning + $75 for carpet cleaning + $70-$240 for painting regardless of the condition it was in. The inspector said that he doesn't have time to go over every square inch of the place to determine where exactly there are scuffs/etc. and it can't just be a "touch up" because the paint will never be an exact match. All these costs would be deducted from my security deposit. The inspector took it even a step further and advised me to not care in terms of cleaning + painting as these charges would be deducted from my deposit regardless of the condition it was in.

    I was pretty concerned by these blanket statements because I have made an effort to keep my apartment in perfect condition. For instance, it is significantly cleaner than the day I moved in. This was easily noticeable as I walk barefoot only (no shoes are allowed and I forced the inspector to remove his shoes as well due to him not bringing booties); my feet turned black on the day I moved in (this is most likely due to apartment showings which is understandable mind you) as opposed to now, where it is spotlessly clean. I also do not have any pets and have been very diligent about keeping everything in tip-top shape (extra careful during moving) and choose to not hang anything up so as to not create any need for patching, etc.

    I emailed the leasing office/manager explaining all this.

    They responded with an email stating that these are the charges I agreed to in my lease and that I could hire my own "certified" cleaning service and send them the invoices for it but that it generally runs more than their own cleaning service.

    I looked up my lease and specifically the page she was referring to and it states that as long as the "residence is returned at the same level of cleanliness as received" then I am entitled to a full refund of my security deposit. It indicates that if cleaning is required, I have to pay 100% of it and that if painting is required, I have to cover 75% of the costs. So, I followed up with an email responding to all of this and pointing this out.

    Now I'm waiting for a response (I got an automated email that the manager is out of town until tomorrow). While I am waiting, I figured I'd make a post and get an help figuring out my options assuming they don't back down and get general advise on what I should do. Can I report them for doing this? It feels wrong but maybe I'm crazy... thanks in advance!

    My daughter’s father is evading child support, what can I do?

    Our daughter was born last fall and her father did sign the birth certificate.

    He resided in North Carolina, Me and our daughter reside in Tennessee. Our daughter was born in Tennessee.

    He was scheduled to go to court in North Carolina in March. It got pushed back to June due to Covid. I asked my child support office if I could attend and they said it was being held via webex due to Covid. I asked North Carolina if I could sit in on it and they said no, that they had my testimony and application and i didn't need to attend.

    Well, he swore under oath that he resides in Maine. He owns a piece of hunting property there (the land has no dwelling and no mail receptacle). He visited there and got a Maine drivers license with his hunting property address on it. North Carolina said they have no jurisdiction over him and dismissed the case.

    He has since ran off to Maine. His family tells me they have no idea where he is living but they don't ever give me any info. He won't respond to me. I've opened a new support case in Maine but they just say they are "still trying to locate him".

    What can I do? Should I hire an attorney? If so, should I get one in Maine? I really don't have a ton of money but I really need the child support. I'm so frustrated. Any advice is so so appreciated.

    Canadian employment law, I want to sue the pants off my former employer.

    I would love some advice from anyone who is familiar with Canadian employment laws.

    I was terminated a couple weeks ago, and they claimed it was just cause, but I have proof to dispute it. They say I didn't reply to an important email about my police check, I have a screenshot of my reply to it. After I showed my former boss the sent email, they disabled my account so I could no longer access it (within 10 minutes of sending her the photo)

    They also claimed gross negligence towards one of the people I support, but I wasn't even at work the day the "alleged complaint" was filed against me. Again I have the schedule as proof.

    I spoke with a few lawyers and the government. The government told me the most they could get me was termination pay, since I was there for 10 years it would be 8 weeks of my salary.

    One lawyer didn't even let me get through the initial conversation with her assistant before she jumped on the phone and said she wanted to represent me, however she was very expensive. I spoke to another firm, and they felt they couldn't represent me because it was too intricate.

    I wonder if I should, or would even be legally allowed to take the government option to get my severance, then use that money to hire a lawyer and sue,

    Or if I should just accept the 8weeks pay and move on.

    Health insurance still has my ex wife covered

    Help. I recently realized that my employer never removed my ex and her two kids from my health insurance plan. I live in Indiana but it is a Federal plan. We've been divorced 9 years. I have a biological son who I've always covered so I never changed my policy and we aren't required to do yearly updates with my plan.

    I have no reason to believe that she's used the insurance since our divorce. I just don't know if I have any liability for this issue. I contacted my HR to rectify the problem and they basically said they didn't get my divorce decree years ago but they would send me a packet to fix the error. Im a little freaked out, I hate my ex and definitely didn't keep her or her kids on my insurance on purpose.

    Are we actually married? (Orange County, CA)

    Sorry -- not an interesting post about court cases or suing or illegal stuff -- just a boring legal paperwork question.

    So my husband (husband?) and I got married in a private ceremony 10/24/20 with a marriage license issued in Orange County, CA. We dropped the completed and signed license in a post office box on the next day, 10/25. Well, yesterday, I go get the mail and our marriage license is there, no envelope, crumpled into a little plastic bag with a note that the post office destroyed our mail and they hope this doesn't inconvenience us (thanks a lot post office). Our license says we only had 10 days to return it to the county, and it's now back in our hands past that deadline. Is it invalid now? I'm going to call the county registrar tomorrow, but is there anything I should expect or someone specific I should ask to talk to? Are we going to have to get married again?

    [Georgia] PayPal refusing to reverse unauthorized transactions

    Early in the morning on Nov. 3rd while I was asleep, someone used a TeamViewer exploit to gain access to my desktop. They bought around $1500 worth of gift cards to various places, from various websites. About $300 of that was from a website I've never used or heard of, and they paid with a PayPal bank transfer from my checking account.

    PayPal is refusing to reverse those charges, stating that they were authorized charges that do not appear suspicious based on my previous account activity.

    What's the best way to get my money back? Should I call my bank and ask if they can reverse it?

    [Colorado] Can I legally not renew a lease over children?

    I own a mortgaged home. Several months ago, I let friends know that I was interested in renting out a room, and was connected with a friend of a friend who was having problems with his wife. My friend said this guy and his wife would every couple of years have a fight, he moves out for a couple of months, then they work it out and he moves back in, so he wasn't looking for a long term lease, and the guy confirmed that. We both agreed that a month to month lease would be fine. He also warned me that he would rarely have his kids over to spend time with, saying that he prefers to spend time with them at his home to make these instances easier on the kids. I informed him that I don't have kids, and aren't the most kid friendly of people, but that if it was rare, I could live with it.

    Fast forward to the present day, and my renter is finalizing his divorce with his ex, and is arguing for half custody. The kids stay over several days a week, and he has taken over a second bedroom for the kids to sleep in. I realize at the time, I should have amended the lease or told him no, but he's actually a pretty good roommate, and I figured the kids wouldn't be bad. I was wrong, they are terrible. I know that as part of a month to month, I could tell him with 30 days notice that I won't be renewing the lease for a specific month. However, I have stupidly complained to our mutual friend that I hate when his kids are over and was considering kicking him out over it, and have to figure that the mutual friend will let him know. Can I legally not renew this lease because he has moved his children in part time?

    P.S. I realize that my username makes me out to be a child hater, and while I never plan on having kids of my own, I'm really not; it's actually a programming reference (https://en.wikipedia.org/wiki/Fork_(system_call)) ).

    California Legal Advice Regarding Educational Decisions under 50/50 Custodial Agreement

    I have never posted here before, so I am happy to edit my post in any way necessary to ensure I am following the rules. Please have patience and understanding in this regard, I read the rules and hope I am following them as intended. I am happy to provide more contextual information if it would help provide a better understanding, but am attempting to keep it short and concise:

    My ex-spouse and I currently have a custodial agreement where we share 50/50 custody over our elementary aged child in the state of California, and we must agree on any educational choices for said child. At the beginning of the school year, we chose our school district's option to have our child attend virtually, and that we would discuss in-person options come January. The discussion I mention was promised, not something written in the custodial agreement or in the school's paperwork - and thus hard to prove.

    Our school informed us that our child's class was selected as a "Pilot Program" and would be expected to return in-person before the end of the month.

    My ex-spouse indicates that they have every intention of sending our child forward with the Pilot Program, and will not compromise. The school district will not answer me in regards to what my child's "default education" will be while we pursue a decision through a judge.

    My current spouse and I are both at extreme risk for covid complications and my ex-spouse refuses to acknowledge these risks in the decision making process. These complications are documented through diagnoses from various doctors throughout our lives.

    Question: how can I prevent my child from "defaulting" into this Pilot Program while we are waiting to appear in front of a judge for a modified/emergency custody order?

    My lawyer is not available until tomorrow and I am having a hard time staying calm about this.

    Should I try to pursue legal action against Education Union or Board?

    I am a transgender teacher that is on the supply lists for 2 boards in Ontario Canada. Every time I go into interviews I feel like right away I am not taken seriously as a candidate because I am visibly queer despite dressing professionally and not super high femme. I am told I interview well usually but rarely will my union support me in getting interview feedback for professional development. I feel like I am being discriminated against and thinking of going to college for another career because I'm tired of making pennies and not having job security as I can't break through to a permanent role.

    I once lost out on 2 job interviews to a white cisgender heterosexual man who had just graduated teacher's college compared to my 3 years of teaching experience. It's been beyond frustrating but when I talk to my union they say there is no evidence of being discriminated against despite less experienced and qualified candidates getting jobs over me.

    On top of this I was told over the phone by my union that my time off to recover from surgery would be paid for. They said I was entitled to 27 days of paid leave at 90% of my rate. 2 days after the surgery the board called to say my claim was denied which means I go 3 months with no pay while I recover. I called my union about this and they apologized and said they were unaware of the clause the board brought up but that there was nothing to be done. I'm really frustrated as it feels like negligence on the board and union, a handful of members who I talked to, all to ensure I had everything I needed before the surgery, only to be told I was denied the claim because I didn't work the first day of the contract. I have worked the contract for the same class 4 times before. I have looked at the contracts and don't see anywhere in the papers that is says I had to work the first day to be entitled to the pay.

    Any advice? I could really use some help in what my next steps should be.

    Dealing with a contractor without a written agreement

    This is a long story, so I will try to summarize.

    We live in upstate NY. 8 years ago, a friend recommended a contractor to us. We were very close to this friend and trusted their word about the contractor (I know this was a huge mistake). We met with him, discussed the work we needed done and he said (a) it'll get done in a few months (b) it'll cost $60,000 and any amount for subcontractors and things like doors, etc we would have to pay, and (c) we can pay whatever we can afford until it's paid off after the work is done.

    Obviously, it wasn't done in a few months. We have 8 years of text and Facebook messages showing that they would show up for a week or two, then disappear for months at a time and ghost us.

    Secondly, we've paid well over $60,000 to subcontractors and whoever else, and about $10,000 towards their $60,000, so there's a balance of our $50,000 left. We have no contract or written agreement at the moment, just what we had originally discussed.

    The work is probably about 60-65% done. Some stuff is left, some of the stuff they installed hasn't been functional in 8 years.

    I got a call from him last week saying that they wanted to discuss "the remaining balance." I told them frankly I don't even know if I want them to finish the job or go with someone else, let alone talk about money with them.

    They said that they will not allow us to go with anyone else and we have to let them finish. So they said they will come over in a couple days and have an attorney draft a contract stating that we have to let them complete the work, but if they don't complete the work by a certain date next year, they forfeit the remainder of the money.

    I'm just looking for any kind of legal advice on how to deal with this situation. Thank you.

    My grandparents died and didn't leave a will, so is there anything that can be done with their land?

    My grandparents owned and lived on a pretty good amount of land, but for whatever reason, they never left wills to divide up what they left behind among their surviving family members. At the time they lived there, they had several of their children and their families living on the same lot in their own homes. Now that they've passed away, some of their children have remained there, but because there are no wills, they don't believe they're able to sell it. This is in the state of Tennessee, if that helps.

    My question is, is there anything that can still be done so that my father and his siblings can legally sell the property and divide the proceeds among them? Thank you for reading, and I'll be happy to answer any additional questions you need! I'm just trying to help my family figure out what to do about this because they're not sure where to start.
