Rear ended on the freeway in CA Insurance

Rear ended on the freeway in CA

    Posted: 23 Oct 2020 04:52 PM PDT

So, this past Monday I was rear ended on the freeway. I noticed traffic up ahead was starting to slow down, so I started slowing down. I left ample room (about 3 car lengths) between the car in front of me but car came to an abrupt stop. I was hard on my brakes, and stopped about 2 feet away from the car in front, and then a second later, I heard tires screeching behind me and I get rear ended. I only have a front dash cam footage that shows my following distance to the car in front, me stopping before hitting the car, and the sound of tires screeching/impact behind me. I have not uploaded the video to the online claim I filed yet.

We pulled over, and exchanged information. The guy apologized for hitting me and then offered to pay my deductible to go through my insurance. I declined. CHP eventually showed up, ( neither of us called), and asks if I want a police report. The officer takes down information from the both of us and we're given the report number.

The rear passenger side of my car is smashed. The bumper took most of the damage, but the hatchback trunk and exhaust were also damaged. The other guy's car was completely smashed on the driver side and his airbags deployed. He was either following too close, was going too fast, or both.

I was able to drive my car home with the caved in bumper scraping the tire since I was only 1 mile away. When I got home and noticed that his license was just an ID card, and the insurance was under his mom's name.

It's only been 4 days but I'm pretty frustrated at this point. The only communication from Geico, is a short email saying that they're pending talking to the insured. I called yesterday and they confirmed again that they're trying to get a hold of the other party.

I've already talked to my insurance (State Farm), and they said I can use my own insurance to get my car fixed. I would just have to pay my deductible. I have comprehensive and collision on my insurance. I figured I would give it until the middle of next week until I decide to use my own insurance. Luckily I'm mostly working from home so I haven't really needed my car this week.

Does my situation sound pretty standard? Do I need to do anything different? Should I submit the video? Did I do anything wrong?

I'm only hesitant to show the video because before making a complete stop, I veered left slightly out of my lane because I thought I was going to hit the other car.

I have a 2018 Mazda 3 hatchback, and the other drivers car is a 2016 Hyundai Sonata.

    Getting contractual liability seems impossible.

    Posted: 24 Oct 2020 03:16 AM PDT

For my business I have general liability, E&O, etc, but a particular customer wants contractual liability too and the company who i do business can't find an UW who does this. Am I getting the run around? Is there someone online I can go to just for this type of coverage? I have no clue why this is so hard.

For context I do consulting and create custom software. This is in the US.

Which commercial insurance professional makes the most?

    Posted: 23 Oct 2020 08:53 PM PDT

Alright so I know this question is complicated. Who makes the most? Is it the agent, the wholesale broker, or the underwriter (carrier)? Obviously underwriters typically work on salary and bonuses, while agents and broker "eat what they kill." But who has the most prosperous life on average? Most experienced commercial underwriters can find themselves in that 6-figure range after several years of hard work, But what does your typical agent or broker do? Of course this can range dramatically, but who lives best?

I have an MRI scheduled. I called and made sure I was in network. The place (not a hospital) charges $1,600 flat with no insurance. How much does insurance usually negotiate down to? And it's usually cheaper for outside lab vs hospital, right? Plan in comments

    Subrogation question

    Posted: 23 Oct 2020 10:56 AM PDT

So I bought a home on 10/7 of this year and discovered on 10/8 a burst pex pipe in the attic that cause water damage down the kitchen wall and damaged cabinets to the point I could see water soaking in the slab from the outside of the home. Plumber came out and noticed a nail thru the hot water line from a roof repair that occurred after home inspection but before closing on the home. I've contact seller's insurance as well as mine to put in a claim and both are somewhat dragging their feet. Its been over 2 weeks now and i just want to get started removing the damage and repairing so I can get situated.

Is it okay to start repairs and hope one of the insurances cover the cost? The seller's adjuster did come out to assess the damage but can only see so much because they can not look behind the drywall.

TLDR; bought a house that had water damage that occurred after inspection and before closing. Who's homeowners insurance is responsible and can I just begin with repair before a settlement or blame is decided and hope for reimbursement?

I am located in dallas, texas area.

    Adjuster keeping quiet

    Posted: 23 Oct 2020 04:00 PM PDT

My car was hit while it was parked this past Saturday. I opened a claim with my insurance and was told it will be sent to the driver's insurance. The driver provided me with his adjusters contact information on Monday which I sent to my insurance to help the process along. So for the past week my adjuster and I have been trying to get ahold of her with no luck. Is this normal to not have anyone reach out after a full week? Any info would be helpful as the situation is very frustrating and seems very unprofessional coming from a fairly large insurance company.

Should I buy my car after it was declared a total loss?

    Posted: 23 Oct 2020 07:07 PM PDT

Hello everyone. So on Saturday I was involved in a pretty bad accident and today I received the call that my car was declared a total loss. My dad advised me that I should look into purchasing the car from the insurance and then try to part it out. Does anyone know how insurance companies determine how much a car is worth after its totaled? I live in Texas if that makes a difference

For example: My car's Actual Cash Value was determined to be 23,000 by my insurance company. I still owed 20,000 so I will receive 3,000 back. If i were to ask them to sell it to me, is there a formula they use to determine the price? Hopefully this makes sense lol. Appreciate any help

Subrogation in no-fault state for at-fault accident?

    Posted: 23 Oct 2020 09:53 PM PDT

I've been contacted by a debt collector seeking a balance of over $4k on an insurance loss from an insurance company in my state. I will validate, but I assume this is from an accident in summer 2019 in which I ran a red light mistakenly and was hit by someone turning with the green.

I just junked the car, paid my ticket, and took Michigan's safe driving course to wipe the points and the ticket off my record. After validation, I can either pay the balance of send it on to insurance-- but there are a few complications.

    • Overall, why would an insurance company go to a debt collector before even mentioning the debt to me? This is the first time I'm hearing about this.

    • I've switched insurance companies since then. Who would this go to?

    • After going to the trouble of clearing my record, I'd rather not be flagged as an at-fault-accident-having male in his early twenties. If I forward to insurance to deal with, do I run this risk, would they inform my current insurer, and could it impact my current premiums?

    student driver insurance questions

    Posted: 23 Oct 2020 09:38 PM PDT

I am an adult student driver, and am thinking about buying a car to practice in until I get my license because there's no other way to practice (I have people willing to help me practice, just not to use their cars). How do I insure it? When I try to get a quote, they want my driving history, and I don't officially have one. I try to find one specifically for students, and all I find is policies for teen drivers. Where do I find the information I need? What would the average monthly cost be?

Very minor traffic incident advice needed

    Posted: 23 Oct 2020 03:29 PM PDT

TL;DR 45F trying to claim excessive, previously present damage in a very minor traffic incident against a young driver (M19) What can I do?

    Hi everyone,

In July this year, I (M19 on green P's) was driving my ute (in Queensland) when a small plastic lid (weighing less than 300g) flew off the tray and hit the windscreen of the driver following me (it was a plastic lid of a very light quality 60L bin from the $2 shop). No other goods were lost.

After realising my load had moved (after maybe 10-15km), I stopped to secure my load again when the driver(~45F) pulled up and read me the right act, they did not provide me nor ask for any details regarding insurance or names ect.

After I looked at the damage to her windscreen which I rubbed with my finder and removed the majority of the 10cm white plastic mark, she got back in her car and sped off before I got a chance to take any photos. I only narrowly got a photo of her number plate as she drove off. I had a passenger who agreed that there was very, very minor damage, she did not have any passengers.

Fast forward over 4 months, I receive a letter of demand from her insurance company for $2400. She is trying to claim a complete repair of her roof and bonnet as well as 12 days of hire car use. The car was clearly previously damaged (I should have gotten photos of the rest of the car) and with the low damage that the plastic lid could have caused, this claim seems very excessive.

I could have understood if she had claimed a new windscreen (at the very most) or windscreen polish (the windscreen was only scratched) however she is trying to claim all damage to the front end of her car. She is trying to claim damage on the bonnet and roof even though after the incident she said that it only hit her windscreen.

Upon inspection of the claim receipts, she did not get the car inspected for 3 weeks after the incident and the repair invoice states "0 repair days required" so it makes me question why there are 12 days of hire car use. 1 or 2 days I might be able to understand but not 12.

It definitely feels like she (who is old enough to know how to pull this sort of thing) is taking advantage of me because I am young and inexperienced.

Is there anything that I can do to argue the amount claimed? Thank you in advance

What kind of insurance is available for people who travel for work to protect their property and for emergencies?

    Posted: 23 Oct 2020 05:06 PM PDT

I was told an "inland marine" policy would cover my valuables but have yet to find an agent who actually offered one. They seem to think this type of policy is only available for commercial property, when companies like Chubb state they have personal coverage.

I've also looked into renter's insurance and travel insurance but they both have stipulations about how often you travel. I don't actually rent anywhere since I'm a truckdriver and live at work.

Aside from property, is there anything available as a standalone product to cover things like emergency expenses, lost wages, credit, accidents, etc., that would put cash in my pocket and not go straight to medical bills? I am in contact with State Farm about their accident and disability insurance, but again there's stipulations where I might not get covered or be considered a "double dipper" with the occupational accident coverage I already have. I'd also like to see if there's something that would cover me without me being injured, like in a job loss situation. I don't get unemployment as I'm a contractor and am considered self-employed.

I'm a truck driver as I said before and have a boatload of commercial insurance already. I can't modify my insurance to cover personal property or emergencies and the company I work for is apparently too large to have those riders on their policy. I am in Texas.

    Should I be worried?

    Posted: 23 Oct 2020 07:38 PM PDT

Earlier tonight, there was a man arguing with some woman right next to me. I was backed out of the parking lot spot very carefully and slowly, but apparently this woman (different one) drove too fast out of the parking lot. She was in my blind spot like maybe behind me 2 spots to my right? This man screamed at me with a hand up "stop" and he distracted me.

I could feel a very weak impact. There was no damage to her car, but I got a one-inch scrap in my rear. That's it. This woman who was arguing with that man gave that woman (driver) I apparently hit her phone number as a witness or whatever.

A driver asked me for my insurance, and I gave it to her. I asked for hers and she refused to give me hers because she said I hit her. I didn't have her name either. There was no cops involved. I'm deaf and seems like she was very unwilling to communicate with me. She then drove away.

I already called my insurance to inform them what happened just in case this driver files a claim against me.

    Edited: I live in Maryland.

Liability protection for 2 Week Hospital trip with elderly parents?

    Posted: 23 Oct 2020 05:25 PM PDT

My s/o needs to drive my parents, in their 90s, on a 7hr drive, each way, (East Coast) for hospital procedures. Because of their age and COVID they can't fly. It should be a 2-week trip total. My s/o will need a car for very limited local driving, to get them around

My s/o would have to rent a car in their name. (Uber would be 2K? and I can't think of any other ideas.) I am fearful of liability issues in the horrible but unlikely event that something happens to my s/o, my parents, and/or drivers that results in us being liable for injury or property damage.

We have good auto insurance w Amica but because of COVID, our car is not registered at this time. It has an average usage of 12 miles/day on the policy (because we don't drive much).

We have liability 250/500 property 100 UMI 250/500 and PIP maxed out to limit we can 100/300. Personally, not the business which is an LLC, we have no other coverage (no umbrella) save for homeowners insurance.

My father has bad dementia which can make him very aggressive. My s/o would not be able to control him if he started acting up in the back seat or tried to jump out of the car or whatever. My mother's health is extremely fragile and I'm worried that any on-the-highway emergency could cause an accident.

My wife is an excellent driver but the drive will be extremely stressful for her which could make her panic and I've been in enough horrible accidents (vic of hit and run) to know how quickly things can happen.

What should I do? Try to get extra coverage through Enterprise or ask our auto insurance for a 2-week rider of some kind/ Try to find a 3rd party or think of another way to get them out there? If they could fly (which they can't) the cost for the 3 would be about 1.5K. Right now, it looks like just a stripped-down car rental would be about 500. So that's what I'm shooting for, cost-wise.

As the average dumb consumer looking at neverending insurance caveats in policies I don't trust insurance companies or agents. I will say Amica treated us well in the few instances we've used them. I can't say anything negative about them.

Am I being paranoid or is pet insurance worth it

Am Being Paranoid or is Pet insurance worth it

I have a 2 year old Saint Bernard and a 3 year old border collie boxer mix. For the most part both are healthy dogs. I'm taking the border collie to the vet in the next couple days because of an weird eye issue. I have a friend who's German Shepard passed away, the dog got hit by a car and the bill was $13,000(no pet insurance). My sister in law dog tore it's ACL 3 months ago, she had pet insurance and it saved her $7000. Our dogs have a good fenced in backyard and play pretty rough with each other, but other than that we don't do any crazy activities with them. I started to get a little paranoid and looked into pet insurance, I have about a $3000 emergency fund and can tap into 10k+ in terms of usable line of credit through my credit cards

I've been looking into pet insurance from USAA got quoted with 25% discounts at

$8000 max claim Reimbursement 80% 1000 deductible on the Saint Bernard $500 deductible on the border collie mix $98 monthly payment

Also got a quote from progressive with a 5% discount

Annual coverage: unlimited Reimbursement 80% for St.Bernard and 90% for border collie $500 deductible on the Saint Bernard $250 deductible on the border collie mix

Is this worth it? I don't know if I'm just being paranoid or if pet insurance is a good investment, especially with a Saint Bernard weighing 100lbs, vet bills are more expensive with her.

    Thank you!

Personal health insurance or workers comp?

    Posted: 23 Oct 2020 08:00 AM PDT

I was in a car accident at work recently, I was the passenger in the van not the driver. Long story short there was a front end collision, I went to get checked out at the hospital after we got towed since I was in an accident a year ago and wanted to make sure I was ok. The hospital is trying to bill my employers workers comp insurance and my employer is telling me I need to put it through my own insurance and they will pay the difference in cash after. I'm not trying to rock the boat at work but I want to make sure I'm not left holding the bag on anything or stick with raised rates. Does the way my company want to handle this sound normal? As long as nothing changes on my policy and I don't have to pay anything I'm ok with it.

I'm in NJ and was the front seat passenger of a cargo van at the time of the accident

I got billed nearly $2000 for bloodwork that my doctor claimed I wouldn't be charged for (crossposted to /r/legaladvice)

    Posted: 23 Oct 2020 07:11 AM PDT

I received a bill yesterday for $1996.96 for bloodwork at my doctor's office.

    So here is what happened.

I had a medical problem going on, and went to get it checked. Doctor #1 said I could get bloodwork done just to make sure nothing is wrong, but that my insurance will likely not cover it because it is technically unnecessary. I refused the test.

Went back for a follow-up. Doctor #2 brought up the bloodwork, stating it was to "make sure nothing else is going on with me". I told her that the other doctor said I would be charged for it because it might be deemed unnecessary. Doc #2 laughed, shook her head, and said, "You won't be charged. It'll be noted as necessary." So I sighed with relief, figuring it would be better to be safe than sorry, and agreed to the bloodwork.

Fast forward to today. I called the number on the bill, and they told me they had billed my previous insurance not my current one, which I found super weird. I then called the office of the doctor(s) I went to, and they told me they had my updated/current insurance information.

I called my insurance, and confirmed it. They said they received the claim, but that if I did owe for an unnecessary blood test, I would be charged that amount for it.

At this point, what do I do? Am I stuck with this bill? I honestly can't afford 2k (got laid off), and I feel it isn't fair since my doctor assured me it was a necessary test.

Need help on some advice from a concussion car accident claim

    Posted: 23 Oct 2020 05:43 AM PDT

So around February I was involved in a rear end car crash which does not have a lot of visible damage to the vehicle. I was riding in the back seat of my Uber when we got rear-ended. After the impact I felt fine but a day later I started experience symptoms of whiplash and concussion. After 2 months of seeing the doctor, the CT scans has no apparent results, but I was sensitive to light unable to concentrate and have frequent headaches. After 2 months I finally able to schedule for a DTI scan, they discover I do have decrease amount of white matter density compared to people of my age. Which can be resulted from concussional injury or minor brain traumatic injury.

The first settlement offer was $10,000 however I do not think it is fair and it actually cost my job and I was not able to work for a few months.

What is a amount I should settle for? The medical bill itself is around 12,000.

I reside in Illinois around Chicago area. Thanks

    80/20 Split?

    Posted: 23 Oct 2020 02:24 PM PDT

So, I was in an auto accident back in August. A buddy and myself was driving on a state Route at 9pm at night. I was doing 60 on cruise control, yes 5 over. Well I live out in the country, the fields were very high. I get up to this intersection, other driver had a stop sign (I didn't have a stop, I had ROW). She blew threw it cooking. Easily doing 50 or more. I in result plowed into her car in my 2010 corvette. I slammed on the brakes and my car underrode her car the officer said. She rolled a few times. Well luckily everyone walked away. That was on a Saturday. That Monday I hired an attorney to handle it all for me. She was cited by the way, not me. My attorneys told me on the property damage geico was only willing to do an "80/20 split" and I should contact my insurance and have them subrogate her and her insurance. So I did. Well I called for an update on my injuries settlement because I went to ER and had ct scans done and a bunch of other stuff, chiro visits. Etc. and I'm not trying to have stuff go to collections. They said they're still working on it and they said they still have me "20% at fault because they believe I was excessively sleeping due to the damages of her car how it rolled." I think it's because I'm 24 and had a corvette is what they're trying to pull. My car was already sold at auction. So no way to have my attorneys pull the data recorder to shut them down on me "excessively speeding"? I'm just irritated and over this all already. I want my medical bills paid ASAP, my lost wages reimbursed to me, and them to cut the 20% at fault on me crap down. Last time I checked too, my insurance says they had her 100% at fault.

What insurance type: Liability and extended coverage for renting "home office" outside of the home?

    Posted: 23 Oct 2020 08:24 AM PDT

Curious if anyone can help me determine what kind of insurance I would need for the following scenario:

I am going to rent a tiny space (~100 ft²) in an office building to "work-from-home" for a new job. The office building requires: 1) liability of $1,000,000 mutual benefit Landlord/Tenant and 2) fire/extended coverage for personal property, equipment, etc.

...when I called an insurance agent they said I didn't fit their offerings as it wasn't renters insurance (in that the rental isn't my place of residence) nor commercial leasing insurance (as I won't be hanging under a business license, nor doing any client work).

Anyone able to help determine what type of insurance I should be seeking out and where the most affordable option to look for such a thing would be? It seems this might be a more common scenario in the age of COVID-19 but I am feeling a little stumped.

NOTE: I am a dummy when it comes to insurance types and options. Forgive me if I have phrased improperly or otherwise.

Progressive requires proof of garaging address

    Posted: 23 Oct 2020 01:45 PM PDT

I had State Farm for almost year but decided to switch to Progressive due to considerable amount of saving for similar coverage. I recently moved, so my paperwork and records are still under previous address. I can't provide the type of documents needed except changing my drivers license, which is 1 of 2 proofs needed. My utility bills are under my parents name, except bank statements. This is a problem because even if I use my previous address as garage address, I still don't have the specific proofs that Progressive listed. I get paid through company direct deposit that doesn't list my physical address.

State Farm did ask this question but did not this type of strict proofs when I signed up. I live in Maryland with clean record. Are there insurance companies with good rates that does not have this kind of bs? I don't understand it

Emergency room visited coded as office visit

    Posted: 23 Oct 2020 01:38 PM PDT

I had an ER visit a while back; I spent the night there, and now I'm looking at my claim. There was a claim for the emergency procedures and other lab works and testing done. But there is also a code for an office visit for the day I went in and the day that I left. It's coded as 99217. would that be the claim for the admission for the two days? I don't see why it says "office visit" and why it's separate from the emergency services claim. It also applies to my deductible. I'm not really familiar with how insurance works and would like some clarification before I call. (They are closed for the weekend) thank you. this is USA, Georgia

i had a lot of roof damage that wet most of inside of my home. i'm working on the Proof of loss form.

The questions i'm not sure about:

Am I making a claim for replacement costs for the damaged property under the policy?

am i disregarding the replacement cost provision and making a claim under the policy for loss or damage on an actual cash value basis?

If i pick replacement cost do i submit receipts? if i pick actual cash value basis, will they just send me a check?

Any recommendations? As a DIYer i can do some of the work.
