Posted: 28 Oct 2020 04:41 AM PDT This is all in Coldspring, TX in the US The lady I bought the house and land from said that the mobile home was not included in the purchase. She said we could rent it for $500 a month. The property is 3.97 acres. The house supposedly sits on 2.97 of that and the mobile home on the other 1, we were told. I just got some tax letters in the mail that say the house sits on 3.97 acres. And then another tax letter talking about the mobile home. Says it has no attached land. Both letters say I'm owner of both properties. Did the lady lie to me in saying that the mobile home wasn't included? If I don't own the mobile home but own the land, what can I do? If the tax documents for the mobile home are in my name, doesn't that make it my property? What can I do about all this to make it clear? [link] [comments] |
Live in mental health clinic for minors forcing patients to become Christian? Posted: 27 Oct 2020 08:51 PM PDT Location: Missouri I recently started working with a live in mental health clinic for minors. It's run by a hospital which is non-religious and not-for-profit. The mental health center is basically for really troubled youths between like 7-18. They can be checked in by their parents, or forced to go by the state. Anyway, right away I noticed that the staff essentially makes the kids follow religious practices. The staff leads prayer, they allow only Christian music to be played, the kids are made to watch faith-based movies, and they make the kids watch streamed church services on Sundays. I am not a Christian and found this to be extremely off-putting considering a lot of the kids are not there voluntarily. The hospital that owns it also claims to be non-religious, but then this is happening in their facility. I'm not really sure if there's an agency to report this to other than the board of trustees for the hospital? Are there any legal avenues for bringing attention to this? Edit: I put nondenominational, but I should've put non-religious. The hospital has several facilities off its main hospital. There are two hospitals in this city, the other one is Christian. Edit 2: I should add that it doesn't say anywhere on their website or in their information that they are religious. Currently I am a minor, and this situation happened December 7th, 2018 in Riverside County, California. Step mom (SM) was a therapist at a corrections facility before getting a kid taken away from her after several abuse allegations and is currently licensed as a marriage and family therapist running her own business. Our abuse case was settled already about a month before this happened (as far as my end goes, I was adopted elsewhere and haven't made contact since) so I don't understand her motive behind catfishing me. But anyway, it started off with some random account following me and trying to convince and guilt me into sending nudes (even claimed they already had my nudes). I blocked that random account, a little later unblocked and the account username + profile picture changed into SM's name, face, and the username was her company's name. I took a screen recording of it all, its somewhere in my gallery. I looked again today and the account is disabled, but she has another company account that's still active under the same name with a few changed digits. Could anything be done? Posted: 28 Oct 2020 01:15 AM PDT I reached out to my health insurance for an estimate for the surgery and stated what hospital it was being held at along with who my dr was. My Dr is covered and they failed to notify me that the hospital was out of next work and gave me an estimate that ended up being for just my dr and not the surgery as a whole. I'm now stuck with a $40k bill from the hospital. Do I have any leg to stand on to fight this? Posted: 28 Oct 2020 07:35 AM PDT She has the original contract, for $1400, a receipt for $300 because she had to pay for the machine to be brought to her house, and a receipt for $300 in stone that was delivered-- that had to be taken up and discarded in order for her driveway to be paved by the other(legit) company. The machine has been at her house since May, and she tried many times to get a refund and have it picked up by the owner-who then ended up in jail. She has a police report stating everything that happened between her and the owner. Then hasn't heard from anyone in months. Now all of a sudden since the man died(OD a few days after being released), someone claiming to be his business partner wants "his" machine back. My friend said bring proof that it is yours, the $2,000 that I am owed, and you can take it. A few weeks have gone by and now he is threatening to "call the cops" because she won't let him take the machine. I tried advising going to small claims a while ago and filing for possession of this machine that has been on her property without communication from anyone in months.. I haven't done my ballot yet but my dad told me that he would drop our family's ballots off all at once, and that he wants to see mine before I seal it up. The reason for this is to make sure I'm voting "correctly" he says, and he says he's not going to let my choices cancel his out, so if I put anything different than what he put down he will likely argue with me and force me to change me vote. He is quite adamant about doing this considering I have differing views than him on some of our state's propositions. I understand that him interfering with my ballot would be illegal (a federal offense), but if argue this and seal mine up before he has a chance to look at mine, I worry that he may still threaten to kick me out of the house or cut me off financially (at least partially). We are currently in the process of closing on our house in just the next week. Sounds great? No. I've recently found out that my wife is cheating on me with another individual, and is somewhat planning to, or is okay with the thought of leaving me for that person. It is not hearsay, as I have seen the proof and my wife doesn't know I know. The way she acts around me also tells me something is up. So legally, what can I do? I dont want to put almost all of our combined savings into this house, just for me to lose it to her. What are my options? What happens if I question her about it and she admits to it and I want out? Can we be sued by the sellers? I'm just lost and don't know what to do in what seems like a limited time to do so. EDIT: Just answering some questions that have been asked. We live in Indiana. We sign and close on the house THIS Friday. We only paid 2k down for earnest money. We have since talked and it looks like things are heading toward a divorce. There's been a lot of different issues in the past, this is just the worst one. We just don't know what to do. Posted: 28 Oct 2020 06:35 AM PDT Update: I had my mother call my landlord and when they finally spoke, she was told that I had "entered my information wrong" on the confirmation screen. When they emailed me back this afternoon (!!), they told me I had attempted to use a defunct/closed bank account. I have only one other bank account that was closed over a year ago - and that is not the account I used. As well, now that the payment is available they removed almost $100 in late fees they weren't supposed to have charged me!!! Location is Nevada So due to being late on rent in September and October , I had to pay two months worth of rent late on 10/23. My landlord stopped allowing partial payments or payment plans as of July of this year, so I was not able to pay as I went, it was either a lump sum or nothing, so we worked out that I could pay both on Friday 10/23. Friday evening I made sure i had the appropriate funds after being paid from work (I get paid in cash and deposited it right away - per my banks policy the money is available for use right away that way), waited an hour, and electronically placed a payment via ACH check through the online portal. It was accepted for processing and I received an email confirming so. At 6:15 yesterday 10/27, 15 minutes after my landlords office closed for the day, I received my email stating the following: "Your payment, Chk # :ACH-WEB in the amount of $2323.85 was returned to us on 10/27/2020 12:00:00 AM as non-sufficient funds. Your account balance as of 10/27/2020 is 2423.85 This amount includes the $100.00 NSF fee and any other applicable fees outlined in your lease. Please contact the office for questions relating to this amount. To avoid any further charges, please submit the full amount owed to the leasing office today. If payment is not made today, please contact the office for the full balance due." So, I checked my bank account and I had $2440 sitting in my account. No pending amounts, I had an ACH check taken out for $50 yesterday morning from a completely different matter unrelated, so I know I can still make an ACH check from this account. I called my bank and upon talking to a banker, I am told that they have to evidence of any check for that amount, I have no pending transactions, my account is indeed at $2440, and that if I had an ACH check rejected, they would have emailed me and fined me as well, which has not happened. My bank basically absolved themselves of responsibility. I did not pay the extra $100, as I feel something is wrong here and I think this may be retaliatory in some degree. My AC unit broke during the summer and it took them two days to even come out and see it with no repair, another four days to bring me a swamp cooler for one bedroom, and another week to replace the unit. I had threatened to file the paperwork for my apartment being uninhabitable about halfway through this mess as I had been advised to, but didn't go through with it because I wanted to avoid the drama and they finally came and fixed it after so long. But ever since then I have had an issue arise since I've tried to pay my rent. Even in August I had to ask them if I could split my payment between two accounts (mine and a family members) to pay it in full, they accepted it on the condition I made them a cashiers check immediately for my amount so they could remove it from my total bill and my family member could pay the rest online, and I bring my check to them 30 minutes later and my landlord tells me they do not process checks the same day, I will be charged a late fee the next day... after literally telling me they will accept the exact method of payment we just discussed that day. As well, my landlord does not return written correspondence to me or call, nor do they email me personally (they send daily/weekly letters to everyone in general) but are continuously leaving notes in my door telling me they will "enter [my] apartment in the next 24 hours to make sure you are still a resident" because "we are unable to get ahold of you!". One of these letters came a few days after I paid my rent. This is not making any sense to me, I do not know what to do, if this is just a case of a bad/irresponsible company, etc. I'm just very frustrated and stressed. Deceased mother’s storage units Posted: 27 Oct 2020 08:40 PM PDT My homeless mother was found dead on Saturday. Today myself and family drove 7 hours and crossed state lines to settle her affairs. We learned she has 8 storage units. I've have been trying since Sunday to get in touch with the manager of the storage units. I was able to speak with her briefly, but she was mostly dismissive and couldn't recall which units were my mother's. She gave me her cell # and told me to call her whenever. Well here we are and she's not answering the business line or her cell. I called multiple times and texted, I knocked on the door of her business and home (she lives next to the office). The locals who rent from her say she's a piece of shit and lazy and worthless and never answers the phone or helps customers. I spoke with the sheriff, who is familiar with her and also said she is very difficult to work with and flakey. We are only in town for 3 days to handle her affairs. The storage manager finally texted me back, without returning my calls, and rattled off several storage units that she "thinks" were my moms. She has not provided the storage lease/contract, and she confirmed there are at least 3 units not included in the contract. How legally obligated are we here? There's no credit card on file, none of us family members here are named on any paperwork, but two of us are "next of kin". We are from CA and this mess is in OR. [link] [comments] |

The land lord came by yesterday and told us that he is converting that area into a private space for himself and his friends to hangout and that they would sometimes use our back yard. In the listing (which we have copies of) it clearly says "private back yard" and is the entire reason we moved into this apartment and also spent thousands of dollars on the yard. We also verbally confirmed with the land lord and the broker several times that the yard is private. When we brought this up, our land lord said " Yes. It will be private. No tenet from the building should have access to it. beside my self and my staff" Our lease makes no mention of the yard, but the listing clearly says "private" and, they confirmed it several times. The landlords have been very evasive and flighty with repairs, and just notified only one of the roommates (not all of us) that they are planning to sell the house in January and will be sending professional cleaners and people to look at the house in the next few days. This has obviously caught all of us off guard, on top of COVID we will have to be moving in the middle of winter and the housing market is awful right now. Since the BLM protests this summer, our team has been required to hold diversity review sessions every 4-6 weeks. These are unsolicited "candidates" for potential future work mostly found through internet search and personal network recommendations. Anyhow, the expectation is that each employee come to the table with diverse hire options for future freelance project work. The whole method of searching for potential hires via profile pictures and essentially racial profiling has made me feel a bit uncomfortable to say the least. I'm happy to go along with it because I agree with the sentiment, but am mostly nervous of potential consequences for not finding enough candidates. T moved into in an apartment complex around September 1st of this year. This takes place in Boston, Massachusetts. T has 3 roommates, K (F, 21) B (F, 21) and A (M, 21). Everything was going relatively fine for the first month, aside from minor disagreements. For a backstory, B is not on the lease. And for the month of October, did not pay anything towards the rent. K's family pays her rent as well as the rent for B. Things have gone downhill very fast. T noticed things going missing from his room, his food that was not even more than 2 days old being thrown out, money missing as well. They first tried to extort money from T a couple weeks ago. K who is in charge of the bills texted in their group chat that T owed $100 for the electric bill. His portion. T suspected that that was exaggerated and asked for a payment receipt or statement from the company. K told him there was "no possible way" she could show him either because her "bank account info would be exposed" ... clearly I told T this was bullshit. I know how payments and statements work. When he called them out and said it was not getting paid without showing a receipt or statement, they basically said whatever I'm done fighting just give me $50. After this all the roommates begged for him to move out. They didn't want him there and told him to get out by the end of October. And tomorrow, all his belongings will be moved out. T called me this morning and told me the roommates are now asking him to pay November rent, or else they are not signing the lease release form. Now, T has paid September and October rent in full to K via check the first month and cash app the second month. He did not pay directly to the complex. He also gave them each $700 when he moved in to cover first, last, and security deposit, which he was NOT even required to do. They spent all that money and it is now gone. They told T that he needs to pay November rent but he is not allowed to stay there. I told T he needs to reach out to his landlord ASAP and explain this... it is very obvious that B cannot pay her portion and is now trying to extort T to pay her portion of the rent. By the way, none of them have jobs, because they claim they can't go to college and work at the same time...but B just dropped out of school 3 weeks ago. Legally I'm not sure what can be done here. Not long after, he found it appropriate to run his hand down my back and say "OP, we've got to stop meeting like this" after cornering me out of view of the managers. I immediately went and made a complaint of harassment, and thought that was that as it's supposed to be anonymous. I'm not entirely sure if he found out it was me, but ever since he's made my work life absolutely horrible. I have made multiple reports of this, but nothing has changed. I'm tired of putting up with his harassment, and will be talking to the regional managers about him soon, but I'm worried that will also have no effect. I am a server and also have my real estate license, and am currently looking for an apartment. I previewed a property and decided to place my application using the landlords agents credit check service, however I don't believe a check was ever run as I didn't pay for anything. Instead the agent let me know (in text) that they decided my income source (serving for tips) was too volatile with a potential second covid wave looming. First off this wasn't really smart as A) I make okay money already in real estate and B) the restaurant will simply switch to an hourly wage plus tips for takeout. I tried and tried to get in contact with him but he's ghosting me, so I'm here to see if this is all clean or if it's discrimination based on source of income. I know he can't say boo if I was getting unemployment or alimony etc etc, but what about for regular old employment? They happened upon some guys doing donuts in an intersection, filmed a few loops, then left. They did not participate. Needing to gas up, they stopped a gas station, and began doing their thing. The guys who did the donuts pulled into the gas station a little while later, shortly followed up by several cop cars. The cops literally arrested everyone except the attendant, confiscated phones, and towed the cars. Among the 24 arrestees were a small family with a 12 year old son. Of how the cops treated my friend and his friends, I'll gloss over, with the exception of the Sargent announcing to everyone he'd be bumping all the misdemeanor chargers up to felonies because he felt like it and, apparently, the cops were trying to pin riot activity from the night prior to the arrest on the arrestees as though it happened at and was the cause the arrest. About 18 or so hours after the arrest, all charges against my friend and his friends were dropped. They are being financially charged for their personal effects, at $25 an item, and to get their car out of the impound lot. After being released, the boys found out SAPD posted on social media about the arrest, using the DMV photos of most of the arrestees, stating that all were involved in locking down the intersections, doing donuts, and participating in other riot activity. The language "alleged" was not used. My questions: This is a false arrest, isn't it? This is defamation of character, isn't it? False arrest or not, the charges were dropped, so isn't the withholding of personal property until fees are paid unlawful seizure of property, stealing property (if fees are refused to be paid)? Is this just a money grab and attempt for good press by the police department? These boys now have an arrest record for being at a gas station. Bottom line: Do these boys have a case to claim restitution from the SAPD? They are looking into consulting an attorney. TL;DR: SAPD arrested everyone at a gas station, are the arrested innocent bystanders able to claim restitutions for the numerous violated rights? [link] [comments] |

Scam job (US) Posted: 28 Oct 2020 09:31 AM PDT Hi I started a job last month with a company I found on indeed called Cryptofuture since I was and am a pretty broke college student when they offered me the job I took the chance like a dumbass they said their company was legit they would transfer money into my account and ask me to buy bitcoin for a specific wallet. After a while I felt uncomfortable and ask them if I could speak to the HR team they refused and never spoke to me again leaving me with 4000 dollars in my account. Today I woke up with my bank investigating my account for fraud claims I'm so sad because I really fell for such a scheme but not only that I'm already stressed about how to pay for school and I'm scared what will happen if they find me guilty. They said someone made a claim about the money. I called the bank and explained everything but I feel scared. Posted: 28 Oct 2020 10:19 AM PDT Hello! I was employed at a small non-profit in Kentucky, with a staff of 4 including myself. We are also governed by a board of directors. On October 8th, 2020, the Executive Director ended a regular staff meeting by briefly and nonchalantly, mentioning that an issue with our payroll company had been discovered, and everyone on our staff had been overpaid for over a year, without our knowledge. Our paychecks were to be adjusted on the checks that we would be receiving going forward, starting the next day. Each of our biweekly checks were lowered by a few hundred dollars. We were each provided with a phone screenshot from our Executive Director of our pay stub that we would be receiving going forward. Since March, we have all been working remotely, and have not been receiving physical pay stubs since then, though each of us on the staff had requested them on multiple occasions. When we were working from the office, we did receive physical pay stubs on occasion, but only a handful of times. We have also requested electronic pay stubs, but our boss has stated that that is not possible. I have checked my direct deposits since I started in this position on October 3rd, 2019, and I have not seen an increase or decrease in the amount I have been receiving, so it appears that I have been "overpaid" since starting in this position. Without our pay stubs, it is impossible for me to truly know the amounts I have been paying in taxes, or if I have been getting paid correctly at all. Of course, working at a nonprofit, and already receiving very low salaries, my coworkers and I were outraged. We began demanding more insight to what had caused the error, and asking for a plan to support the staff accordingly. I was leading the charge, and putting a lot of pressure on our executive direction, as well as the board, though I remained professional at all times. On Tuesday, October 27th (yesterday), I was laid off. They stated that they were eliminating my position, with the only reason given being that they want to focus more on direct fundraising, rather than the marketing efforts that I have been focused on. They offered me a severance agreement of one week's pay, on the condition that I sign a general release by Friday, October 30th. They pressured me to sign the document right then and there, but it did not feel right at all, so I took the documents with me, and left. The document makes reference to the payroll issue, and if I sign it, I am waiving my right to take any legal action. I think that the organization may be partaking in some shady practices that they were afraid I would uncover, and feel that they are offering me this (very, very) small severance so that I will back off. It has also come to my attention that the organization has not been audited by the IRS in many years. I am considering contacting the IRS to conduct an audit, but I am not sure of what steps to take/what documentation I would need. (I found the form 3949A on their website, and I assume that should be filled out as a first step.) The main question I want to ask is whether or not I should sign the document, or whether or not I could do more with this case. Apartment flooded with 4+ inches of water and property company wants to keep us in it Posted: 28 Oct 2020 11:06 AM PDT Hey all, currently writing this from a hotel across the street from my apartment, as I am being left high and dry (wet) by our leasing agent and property management company. I live in Colorado, moved here from Michigan in June. Yesterday around 3pm our water main burst, flooding out apartment on the ground floor and neighboring ones with 4+ inches of water. I took pictures and supposedly so did maintenance but I which I had gotten more/better ones. They were able to get the pipe shut off in about 30 minutes, and the carpet recovery/water removal people there a few hours later to suck the rest of it out. We tried to get out leasing agent to cover a hotel for us, but he said the other manager handles all of that so we would have to wait until tomorrow (today). It was wet but seemed decent when we wrapped up last night, but they couldn't get any dehumidifiers so they said they would bring them at 8am. This morning it was still soaking wet, and starting to smell off. We spoke to the manager and she said this was terrible, and they would call the higher ups to get everything paid for and figure out the next steps. Maintenance never showed at 8am, and the manager never called back. We went back into the office and only my agent was there. He said that the manager left sick (right after she said she would help us) and maintenance did as well. They are obviously avoiding us, and now our apartment is still wet and some things and furniture that were easily save-able and are now being ruined as we have nowhere to put them. We're really at a loss for what to do here. We've been told we should contact the Colorado Attorney General's Office by a few friends and family. There's not obvious proof of mold yet, but we were wondering if where we are at now we would be covered by Colo. Rev. Stat. § 38-12-507. and could break our lease without paying the fees? I heard something inside that sounded like a muffled yell. Like a sock was in thier mouth or something. I knocked again and it stopped. The man eventually came to the door, watched me and my partner sample and then watched us walk all the way down the driveway until we left. Posted: 28 Oct 2020 08:01 AM PDT Howdy All My company doesn't let you roll vacation hours year to year, but this doesn't apply to CA based employees due to state law. I earned 3 weeks vacation while working in CA but my lease ended and now my legal address is in another state (ID) at my parents house since we're all working remote due to COVID. To note - my official work address is now also listed as remote in ID in the company system with an effective date of October 12. Now, HR is telling me that I lose those hours at the end of the year. Is this legal? I suspect the answer is yes, but Im wondering since I earned the hours in CA, can they legally revoke them now? All my paystubs were to a CA address and CA taxes were deducted. How bad can my old apartment complex hurt my credit? (California) Posted: 28 Oct 2020 11:29 AM PDT I just moved out of an apartment complex that wants to charge me $1,300.00+ in damages. I have told them I am disputing many of the charges due to the fact the damage was not caused by me. My apartment flooded due to faulty plumbing a few months after I moved in and not only was it difficult to get them to fix it and make it livable again, but I asked them at least three times to provide me with written documentation stating that I would not be held responsible for the damage upon move out and their only response was that it is noted on my account so I don't need that. Well low and behold, now I do need it. My question is, how bad can they hurt my credit if I don't pay. Also, is there something I can do to stop them from sending the account to collections until we come to an agreement on the balance? [link] [comments] |
Landlord Asked For $1000 Guarantee Fee And Has Not Paid It Back Posted: 28 Oct 2020 09:33 AM PDT CONTEXT: My friends and I decided we might want to move into a house in Berkeley, California (Alameda County). The landlord (who we'll refer to as Bob from here on out) said there were several applicants and that to ensure our spot we should pay a $1000 deposit so that we are guaranteed to the house (the deposit would go towards our security deposit or rent once we actually signed the lease). However the next morning, approximately 12 hours after I Venmoed him the money, we decided for personal reasons to drop out and not go through with the lease (which we had never signed). I apologized to Bob and told him that I'd like the deposit returned. He responded that the deposit was non-refundable (which he never actually told me) and that he would not be returning it. This was exactly 1 month ago. Here are the following emails that ensued: From ME: "Sorry Bob, I don't remember you ever saying the deposit was non-refundable and no where in our email exchange was that ever clarified. Every landlord I've interacted with has defined a deposit as refundable and during these COVID times $1000 is not a small amount for all of us, we are really sorry for the inconvenience, but we really need this money back." From BOB: "I mentioned it to both of your friends that I showed the house to as well as every person I showed the house to. In fact, this has always been my policy for decades now and I was told yesterday during another showing that this is what all landlords do.What would be the point of the deposit if it was refundable?After I receive a deposit, I process all of the applications. I delist the ad and let the other candidates know that the place has been rented. i prepare the lease and other documents that need to be signed. And normally move forward with the signing…I'm sorry it worked out this way for us both. As you know, with my flexibility in lowering the price and setting up zoom videos and two separate showings for your group, I did everything I could to make this work.Take care, Bob" --At this point I was annoyed because he said that after receiving a deposit, he delists the ad, and lets other candidates know that the place has been rented. But in fact the ad was not delisted (and I have proof), and how can I even make sure he let other candidates know that he told them the place was rented? On top of that, the Craigslist post where he listed the ad for the house advertised it as being a 4 bedroom house (I also have proof), but through some digging I found a Rent Stabilization Board Meeting in which it was agreed that he was not allowed to rent that place for 4 bedrooms as one room could not be legally considered a bedroom.-- So I sent him a return response: I completely understand that this is the system you have been operating on for some time. That makes sense that a lot of landlords would want to do that in order to cover costs associated with re-posting the space, etc. Unfortunately for tenants, what landlords get away with often stands because tenants can't afford to go to court, and that doesn't make it right or legal. The reason that a deposit would be refundable is because it would not be fair for a landlord to claim $1000 for not being able to look for a new renter for only 12 hours (the time between us making our deposit to the time we told you we wouldn't be renting the next morning). I looked into the actual legal provisions just to be sure and holding deposits like the one you requested are governed by § 1950.5 of the California Civil Code. 1950.5 states "No lease or rental agreement may contain a provision characterizing any security as "nonrefundable." Even if having a nonrefundable security wasn't illegal (which it is), while you did inform my other housemates of the nonrefundable nature verbally, you did not inform me (the person who paid the deposit) and in the receipt for the holding deposit, you did not specify that it was nonrefundable. Your email only said "Just received deposit. Will be in touch tomorrow." I'm not sure how I would be expected to know that you had this policy without you specifically informing me. That said, landlords are only allowed to retain a "reasonable" amount of the holding deposit that is equivalent to actual damages caused by a potential tenant not signing the lease. For example, documented fees that you incurred to re-advertise the place. Given that the hold was only just over 12 hours (8 of which were overnight) and that the listing was posted on a free site (Craigslist), I'm not sure what those fees might be. I also took a look online and saw that the posting had not been removed from Craigslist in those 12 hours. I don't think it would be that difficult for you to inform another candidate within 24 hours that the place you originally said was unavailable is now available. It seems unlikely that you would have lost very many potential tenants in a 12 hour period (that is, if you informed them that the place had been rented). A landlord setting up viewings or zoom showings is part of your role and the inconvenience of being a landlord in general. You had to advertise the place and I don't feel that we should be penalized for the normal course of business that is involved when someone is trying to rent a unit they own. To remedy this situation, 1950.5 says that the landlord should provide the tenant with "a copy of an itemized statement indicating the basis for, and the amount of, any security received and the disposition of the security, and shall return any remaining portion of the security to the tenant." Under Civ.C § 1950.5, it is the landlord's burden to show the reasonableness of the security amounts retained, and bad faith claims of retention by a landlord can result in a court awarding damages up to twice the amount of the security. 1950.5. If you would like to dispute this, I'm happy to take this matter to a mediation clinic or California small claims court as is my right under the California Civil Code. However, we can end this matter now if you simply return our deposit. I look forward to hearing from you soon." From BOB: "you have made many allegations in your email and I can assure you they are totally baseless. Non-refundable holding deposits are legal in California and are common practice. I explained the nature of putting down a $1000 non-refundable holding deposit very clearly to both of the women whom I showed the house to. They both represented your group. I never told you nor anyone else different information. If you received different information then you should discuss this with the person(s) who gave it to you. That definitely was not me. As you know, I accepted your group and had already done all of the work to move forward. Nothing on my end changed therefore I had nothing to do with your reneging on our agreement. I am very sorry this happened as I was looking forward to renting to you. The house is still unrented so there are no winners here…" My question is, is there any thing I can do to get my money back and is what he is doing legal in Alameda County, Berkeley, California. Posted: 28 Oct 2020 12:34 PM PDT My home has frontage on a street corner, and a political campaign has been placing large signs (4'x6' with wood frames) on my property. I've been removing them because they are an eyesore and I don't particularly agree with the candidate they are for. I haven't been destroying it, just placing it on the ground or at the side of my house. Campaign workers have been trespassing to retrieve the sign and to replace it. Yesterday, they sent a deputy to my house to tell me that if I touch it again, I will be arrested for vandalism and for interfering in the election. Do I have any recourse about this or do I have to let it stay up? [link] [comments] |
