Delayed divorce due to pregnancy. Posted: 29 Oct 2020 08:03 AM PDT I had what was supposed to be my final divorce hearing today. My ex and I are extremely amicable and are proceeding without lawyers. We have been separated since July of 2018, we filed divorce papers in January of 2020. We have one son together. Well we had a phone hearing today and when they asked me if I was pregnant I answered yes because I am. I have been engaged for about eight months now. Then the judge proceeds to put us on hold because they need to discuss if we are allowed to finalized the divorce now. Since the filings stated I wasn't pregnant. If I was pregnant in January I wouldn't be now. I wish I would have just lied. He comes back on saying the court is just uncomfortable granting the divorce until it is proven that my ex is not the father. He has been sterile since 2012 and we have not lived nor slept together in almost three years. Is there anything I can do aside from waiting until April for dna testing. Is it really against all court rules or is it just the judge's biased opinion? Can I request another hearing with a different judge? I live in Wisconsin. Edit: for clarification. My ex even tried to advocate for the finalization of the divorce saying that there is absolutely no way the child is his and I am in a healthy, happy relationship with the baby's father. I wish there was just something all three of us could sign establishing that the baby in fact is mine and my fiancé's and in no way my ex's. My ex would never be so vindictive as to try to claim paternity just to make life difficult. We both just want to move on. I'm not trying to say I'm being treated unfairly either I was just hoping for a faster resolution that won't cost an arm and a leg. Thank you for all the advice! [link] [comments] |

The disagreement that resulted in my resignation was due to a lack of Covid19 precautions and concern. I feel like this is disingenuous. Posted: 29 Oct 2020 06:09 AM PDT ETA location: KY Second ETA: someone was kind enough to link me a source stating that Psychotherapy notes are not protected rights under HIPPA. On a secondary note, it states that I am allowed to see notes that are about the diagnoses (or maybe I misunderstood, please correct me if I'm wrong). As she doesn't keep such records, I will still be finding a new therapist who does. Thanks for the speedy responses!! I recently applied for STD for severe bipolar depression. My STD people wanted medical records from my PCP, Psychiatric APRN, and Therapist. The PCP and APRN submitted it no issues. My therapist however told me she's against doing it and will not participate in such things. After some discussion she said she'd write me a letter. She says she does not keep clinical notes, only notes for her own personal use as a means to remind her of what we've discussed and where we are in treatment. Her argument was good, as in she explained to me that the notes she keeps are a transcript of our sessions and may actually hurt any chance I have to get STD. She claims that some of the things I say in our sessions may actually hurt my job even because the STD people work, first and foremost, for the company's benefit. I can see that, and honestly, if that's true I'm glad she won't submit records without my insistence. The main problem I have is that I asked her what she'd do in the event that I decide to see a new therapist. She said she still would not release my information to ANYONE. I asked her if I myself could receive my medical records. She again refused. As far as I know, here in the US, I am allowed my medical records and no medical provider can refuse. Am I wrong? Does she truly have the right to deny me, for personal use, my medical records? I'm not willing to take this any further than having the knowledge to allow me to argue the fact I am entitled to my medical records. Her husband is a lawyer, not sure what he practices, but I imagine he would be willing to fight for her if it came to something of that nature. So I just want to be able to advocate for myself, as I am intending to see a new therapist who does keep clinical records for things such as STD, to receive my records because they may be helpful to avoid having to rehash issues that I've previously worked through. Last year (2019) I managed to buy a house, there was a lot of expense and taxes paid because of that and I speculated that maybe I should file taxes. My realtor informed me that she does taxes as well and told me to come to her. So in January 2020 I did, she filed my taxes and I got a $5k return. (For the record, I also have 3 children and she told me that I get a Tax Credit for them even though my income isn't taxable, so the refund wasn't a red flag.) ⏭ FF to Sept I'm getting a letter from Social Security asking about my $14,500 of earned income for 2019. I look into it and realize that she completely pulled that number out of her ass to get a $6k refund- had the refund sent to herself and pocketed $900 before forwarding the remainder to me. So. Now I'm dealing with SS, the IRS, and the police. The police closed the case saying this isn't a criminal matter- I'm pulling a Karen and blowing up their phone and demanding to speak to a supervisor to find out how TF they came to that conclusion. SS is thankfully off my back. I filed an Amendment with the IRS and will probably have to pay the entire refund back. I also filed 3 different complaint forms through them, so hopefully she gets audited hard and tax preparer license yanked. Question: If I take her to small claims court (which probably won't even get me money, just a judgement against her) can I only sue her for the $900 that she stole? Not for the purpose of financial gut he is committing crimes under my name. I went to court back in 2018 to clear my name and at that time the judge told me that the matter has been taken care of and he would not be able to continue to do this. Unfortunately this has not happened. I once again have 4 misdemeanor counts against me and an active warrant. Also according to my (his) rap sheet I have committed over 20 crimes in the last 24 months. I am once again going to court on Monday with my attorney to clear the warrants and hopefully my name but is there anything I can do to prevent this from happening again? I often have to travel and I am afraid that I m going to end up in some foreign jail over crimes I did not commit or getting pulled over with my young children in the car and them having to experience traumatic experience of me getting arrested. Now it's been two weeks since the first room check now they are doing a "random quick inspection" Monday. My smoke alarm was faulty so I took it out and left a note for the room check. It was no problem, I've just been busy and need to make a maintenance request to get it fixed. I'm pretty sure they want to look in the apartment because of weed or the smoke alarms. I'm going to hide my stuff in depth. They can't like look in my suitcases and other concealed places I hide my bongs and shit can they? Would they need the police to get a warrant to find that stuff? Posted: 29 Oct 2020 09:11 AM PDT Tldr; Renting a house, I saw sparks in the electrical panel, Landlord wants his cheap guy to look at it later, and I don't want to die in a fire so I want it looked at now. My SO and I started renting a house in August. It was in pretty bad shape and required many things to be replaced because the landlord didn't know they were broken. This includes the dishwasher, dryer, washing machine, fridge, and a single circuit breaker. Two days ago, I was in the basement and heard popping / cracking noises coming from my electrical panel. I took a video and could visibly see sparks and arcs jumping around between breakers. I told my landlord, who came over the next day to see it. He said he was going to call an electrician. I called my landlord again today and he said that he's having an electrician (his "guy") come over "at his earliest convenience". This is what he said about the other repairs, which actually means like a week. I said that this was a huge fire hazard and it needed to be addressed right now, but LL started complaining that all the repairs were so expensive and that electricians cost $300 to even come look at it, and then he hung up. I want to call an electrician to fix this issue asap, but I don't know if I'm allowed to do that because I'm not the owner. I can figure out costs and who foots the bill later, when I'm not worried about burning up in my sleep. I'm also concerned about any legal fallout from a professional electrician looking at the house because the landlord's "guy" who has been fixing everything is definitely not doing it up to code. A report like that could really fuck up this living situation. Other than the repairs, we like the house and plan on renting it for at least 2 years. (Texas) Posted: 29 Oct 2020 09:02 AM PDT I live next door to an assisted living residence that houses 3-4 people with intellectual and behavioral disabilities. (Forgive me if my terminology is not correct). Over the last couple years of living here, I have had to call Adult Protective Services and the police probably about 30 times because of the lack of patient care and violent incidents I've witnessed at this house. The care takers constantly scream at the residents, sometimes so loudly that I can hear them from inside my house. One of the residents has knocked on my door, sometimes in the middle of the night, asking for help because she is getting hit or yelled at by someone. Every time I witness this I call APS or the police. There has been an increasing frequency of violence occurring, mostly from one particular resident, and I now feel that my family's safety is at risk. I have a toddler and I don't feel like I can have her outside if any of them are also outside. This evening I had to rush my daughter inside because I heard furniture crashing followed by screaming from inside the house. Shortly afterwards the woman came over and asked me to call the police, which I already had done at that point. On several occasions this same person has come up to my open garage door while I had my daughter with me screaming about something going on next door. I have had to tell her to get off my property several times. I don't feel like calling APS and the police are sufficient to mitigate the situation next door. I finally was able to find out the name of the company that runs the house; other than calling their director and demanding that they do something about this, what other legal recourse do I have? I have absolutely zero interest in financial compensation from this, but I am tempted to have an attorney send the company a letter demanding that they do something about the residence. Im not convinced she has Healthcare and since she is an adult, newly so, she doesn't have the independence that is afforded with being more established. Is there anything that can be done to help her go to a real doctor and get real treatment options? She is starting to not feel well. The girl training me cleaned bathrooms. I noticed she was sticking her bare hands into dirty toilets with a rag. Second day they wanted me to clean bathrooms and beds. I brought my own gloves. They said the gloves are making me slow because I'm taking them on and off. They also said they usually only use one rag for an entire bathroom? They trained me to step into the shower to clean it with both doors closed, dowsing it with chemicals while the main bathroom door is closed. This makes me feel very faint. Also, two rooms had to be closed off because of severe mold on the ceilings, but they still made us deep clean them first. I'm a very shy person with social anxiety and I can tell that the whole management team/group of young girls see me as weak and easy to manipulate. Apparently they think that I think I'm better than them because of my questions about health hazards. They're really getting onto me for being slow but by the end of these long days with no breaks, I feel weak. They are condo style rooms with three beds and we are given under 30 minutes to clean them. I'm also the only one wearing a mask in general. I took this job because I'm trying to pay for college and there aren't many jobs right now, and I lost my previous job because of Covid. I do not want to accidentally touch blood or other fluids and catch some condition. I'm still going but actively trying to find somewhere else to work. I refused to be transported because my wife had arrived at that point and I wanted to have her transport me to the hospital. I was treated at the ER (x-ray, a tetanus shot, flushing, antibiotics, etc) and released. The dog was seized as a dangerous animal and will likely be put down by animal control. At first, the dog owner was not very helpful but last night she gave me her homeowner's information. I'm curious if anyone here has ever dealt with this type of situation and what I should or should not say to the insurance company. Here's what I have as evidence: - ER Report, Pictures, Sheriff's Report, Paramedic Report, Witness her dog chased me once before What additional information should I gather? Assaulted by step father for defending my little brother. Posted: 29 Oct 2020 05:40 AM PDT Location: Toronto, Ontario CA My stepfather (49) hit my little brother (8) because he spent more money than he told him in a videogame. My brother told him he'd spend 5 dollars and he ended up spending 75. Everything started when my Stepfather hit my brother with a belt to the point he peed himself of how scared he was, my mom heard him and started arguing with my stepfather about how he should never hit a kid like that, my little brother came to me room and as I was trying to calm him down my step dad comes by and I (21M) confronted him about it pretty much letting him know that he should never hit a kid and that it'll have a big impact in his adulthood as he could get traumatized. After that my Mother (49) took my little brother to the bathroom to change his clothes and clean him up and my stepfather walked in and started being obnoxious calling my little brother a liar and asking my mom to pay him back for the money that my brother spent, after that my mom closed the bathroom door on him and told him to go away. I walked to the hallway and told him in the calmest way possible "Give me my brother's Nintendo so I can refund the purchase" to which he responded "No fuck off your mom's gotta pay me" then closed his door on my face, I got really heated and punched the door saying "she's not gonna pay you shit" after that he opens the door ultra fast comes storming towards me, grabs me by the neck pushing me against the wall and starts choking me as he is talking shit to me saying "Who the fuck do you think you are" I responded desperately punching him in the head and pushing him away in self defense so he'd let me go, after that my wife and step sister came to split us up and he started saying that he'd kick me out of the house and that I had to go. As soon as they split us up I walked to the living room and called the police letting them know of the situation. He left the house even after knowing police was coming. Police came and I decided to press charges against him, he left two big scratches on my neck along with some bruises. He was arrested and let know of his charges (which I think are assault and child abuse). I have a voice recording that I started 10 seconds before everything happened could this be used as evidence? Or would it be illegal because he wasn't aware that I was recording? Also, Would I get in trouble for posting this all in social media along with the pictures of my neck and a video of him pretty much agreeing that he choked me? (He was aware that he was being recorded by my wife) Edit: Context; me and my wife were stranded in Chile for 9 months recently got back because my flight kept getting cancelled and had to quarantine for 2 weeks before being able to work or do anything. At the time of the quit claim the house was owned free and clear with no liens or mortgage. Today I found out my parent has about $15k in credit card debt they are being sued for. They still live in the house. My parent has stated they intend to declare bankruptcy, but I am concerned that the banks will find a way to go after me / foreclose the house, as the CC debt was owed at the time of the quit claim. He is a retiree from the military, so we don't believe she can touch his beneficiaries. We can't get the date on the POA, they've refused to give it to us, and we don't really know how to go about fighting this or even if it is worth fighting for how much the legal costs could be. I was recently told that they also did this to their parents and that's how they got the current house they live in. Since then, there have been additions to my chart from another doctor, which I would like to now obtain. But my primary physician won't allow it. Any ideas on what I should do? The cost of going to court for a few pages of medical records is a bit out of the question, right now, but I'm pretty sure it's my legal right to obtain my medical records. I'm the director for the before and after school child care program. If my school shuts down due to COVID my child care will stay open. My principal wants me to change the rate we charge parents from a flat $10 per DAY rate to an $5.00 per HOUR rate and also get rid of all other discounted pay rates we currently offer for ONLY THE CLOSURE. I would have to make a whole new contract and have current paying parents sign it and agree to the pay change. However the current contact doesn't have a clause add anywhere saying that the current rates are subject to change or that the current conttact can change. Would it be legal to change this contract? He is currently in prison and her legal team sent the documents to his about 6 weeks ago. Her legal team is now stating it looks like he doesn't want to sign and there's not much they can do. Is this the case? The divorce decree is already signed off and has been through mediation and signed by a court and everything. All we are waiting for is his signature. Posted: 29 Oct 2020 07:30 AM PDT Yesterday morning my boyfriend and I got into a verbal argument. I was laying on the bed with our 6 month old baby on my chest and he decided to come forcefully grab her from me. I put my hand on his chest to push him away because he was literally on top of me trying to yank my baby from me. He then grabbed my arm, thr baby was now laying in the bed unharmed and he put both his hands on my neck and choked me for a good couple seconds. Then he grabbed the baby away. I then took his glasses off the bed and snapped them in half. We have a baby camera in the room and I no longer have access too because he changed the password and it kicked me out. So he claimed to have video evidence that I attacked him. When in reality he attacked me so I told him to please send the video if he has it then. Conviniently, it was "out of storage" even tho we never saved any videos on there and it was a live cam. I knew the camera wasnt on becaise the red light wasnt on so I knew it would be his word against mine. The police came and I filled out a witness form, so did he and his mom? I'm not sure why his mom got to fill out a witness form considering she wasnt even there??? But the police wouldnt let me take my baby to a safe place away from him so I decided I'm going to stay as well because I'm not letting my baby stay alone with him. I did not have much contact or interaction with him during the final years of his life due to his drug addiction. He left behind a mountain of credit card debt, an unkept condominium (complete with squatters), and an upside-down mortgage. He had one of his brothers listed as the executor of his will and myself/sibling as the main beneficiaries. My uncle (who is also very sketchy) expressed an interest to keep the property, which was fine. I had zero interest in any of his possessions or dilapidated home. I never signed any papers for his mortgage while he was living or assumed any of debts. A few months ago Pennymac and his condo association had me served at my job for his loan. I initially brushed it off as I thought this was an intimidation tactic but now I am receiving weekly letters from their attorneys (still to my job) stating that I need to appear in court. Is this really a thing ? Am I really liable for my dead fathers loans even if I was never a co-signer on his mortgage? Do I need to get a lawyer ? Breaking a Lease in PA - Murder Edition! Posted: 29 Oct 2020 03:25 PM PDT Just in time for halloween I have a murder related legal question. I am a renter in Pennsylvania; I live in a converted mansion with 7 units. ~2 months ago my landlord informed me (and the other tenants in the building) that one of the tenants had been murdered in his apartment. She shared that she spoke to the police who reassured her that this was a "targeted killing" and was related to "shady business." One of my neighbors was really freaked out and tried to break her lease but the landlord wouldn't let her and then changed the story, saying it wasn't a murder after all and it was a suicide. My neighbor tried talking to the police but they wouldn't give any info related to the incident. She ended up just getting a subletter and moved out. I want to break my lease but feel ethically icky not informing a subletter of the backstory of why I was leaving. I cannot afford to pay two rents at the same time. Do I have any legal standing to use this murder as a reason to break my lease? Does the landlord have a legal obligation to disclose the murder to potential tenants? Would appreciate any advice.
