[New York] after cheating and leaving me, my wife wants to take the dog too

    Posted: 24 Sep 2020 05:11 AM PDT

    \all names have been changed*

After having an affair, my wife Anna decided she needed to spend some extended time with her family in Ohio by herself, and we agreed that I would take care of our dog Oliver while she was away.

A few weeks ago, Anna informed me that she was coming back that weekend to pick up some things and take Oliver to her parents house with her. I was traveling and had Oliver with me, so I told her that we wouldn't be there, but more importantly, that we needed to have an actual conversation about this. She never followed up.

The following weekend, I was going on a trip with some friends and asked my parents to watch Oliver, as they have done many times before. I mentioned to Anna on Friday where I was going and that my parents would be taking care of Oliver over the weekend. The next day, without telling me, Anna made a 12-hour round trip to my parents house to try to take Oliver while I was gone. Anna waited several hours into the drive before contacting my parents and led them to believe that she was visiting friends in the area and had coordinated this with me. Luckily, my parents mentioned something to me, and when I told them that I knew nothing about this, they told Anna that they were not comfortable with this happening behind my back. Anna showed up anyway and ended up sitting in my parents driveway for hours demanding that they relinquish her property, despite being asked to leave multiple times. She eventually left without the dog.

I've since been contacted by her attorney who is claiming that, because Anna was the one who signed the adoption papers and we adopted Oliver while we were engaged, our dog is considered her separate personal property, which I am obligated to relinquish to her... and that, by the way, Anna wants a divorce.

I love this dog like a child. I was the one who named him. I was the one who contacted the foster program about adopting him. I work from home (even pre-covid), so I am definitely the one who has spent the most time with him. Anna's parents have two other dogs that are very territorial and bully Oliver whenever we have visited with him, and even if Anna were to get her own place, Oliver gets very anxious when he's by himself and I worry about him being alone for so much time while she's at work.

Is her lawyer bluffing, or do I really have no choice but to just hand over our dog and risk never seeing him again?

Edit: I'm told it might be relevant that I am listed as a co-owner with Oliver's vet. Anna took all of Oliver's papers and medical records from our apartment while I was gone, but I was able to have them email me new ones because I am already on file with them.

    Lock bar on a dumpster

    Posted: 24 Sep 2020 04:21 AM PDT

    Location: Salina kansas

    Situation:

I've been renting from a real estate company in a building that has a dumpster with a lock bar on it.

Recently, the landlord came in and reminded everyone that this building is a non smoker building because someone was smoking in our laundry room, no big deal, but she then added that now all the tenants will pay a fee for the dumpster being unlocked of $17.25 each time she finds it. This isn't in the lease agreement.

I didn't think she'd actually charge us for it, but I've always kept the bar locked and pretty much have to every time I leave the building because people are always leaving it unlocked. I have a statement that proves she charged it to my account and want to know if this is legal whatsoever.

There are 2 charges on my account for 17.25. From research, I know that a lock bar costs anywhere from 15-25 a month, my landlord is obviously capitalizing off of this, and I feel as if there's nothing I can do.

Thanks in advance, if any more general info is needed, let me know and I'll add it to the post.

MA school districts instructing parents to install browser monitoring extensions on Chrome (goguardian) on PERSONAL devices. Issuing FOI request for policies. Need advice.

    Posted: 23 Sep 2020 08:57 PM PDT

First, I want to clarify this is not for school assigned hardware, the schools are asking parents to install goguardian on personal devices for learn at home. I've searched through the District policies and Massachusetts Department of Education and can't not find any policies regarding this software for non-managed devices. Or even much regarding managed devices such as chromebooks...

My wife was the one to initially email the school with her concerns on installing this extension on her personal computer. They assured her it was fine and a "great tool for teachers". However, when I emailed them back asking: "Who is the admin for GoGuardian. Who is overseeing this program. What are the terms and polices, data retention, ect for the GoGuardian extension for non-managed devices? By what authority, rule or law are students forced to use monitoring tools for their education with non-managed devices at home?"

They responded with basically we'll get back to you and blew it off. My first grade child has been remotely attending classes without the extension and they have not got back to me. This leads me to believe that the extension is not required and they have no policies regarding this software.

I've been in touch with both the EFF and ACLUM regarding my concern. ACLUM was interested but are short staffed and suggest I issue a FOI request to the school. EFF responded calling the situation "troubling" and is reviewing the material I've supplied them and forwarded to a team working on this issue.

I'm going to use SPLC's generator to write the FOI request but what polices should I specifically be asking for? How vague can they be?

    Thank you,

EDIT: Thank you everyone for the replies. I'm going to email the school some more and hopefully they will give me some answers that will be the first step. Then if they refuse or don't have any policy regarding this I will move up to the state dept of education.

UPDATE: Stolen car in Virginia and nobody cared

    Posted: 24 Sep 2020 10:09 AM PDT

So Original TLDR: I left country for a year and half and left my car with a friend of a friend that was a mechanic to do some work on it and he knew he could take his time because I wouldn't be back for a long time. Halfway through that time period he files the car as abandoned and tries to take possession. I had to fly back home to try to straighten things out and nobody will do anything.

    **Update**

I kept bugging anyone and everyone at the DMV, Police Station, and Insurance company for a week straight until someone at the Police finally notified me that the car had actually already been picked up and impounded in November of 2018. They found it completely stripped, missing engine, the works... it had been dumped in a neighboring city behind an abandoned house that had been boarded up since at least 2012 (based on the google street views of the house).

Equipped with that new information I was able to get the insurance company to do their thing and they wrote me a check for a fair amount. I filed some more paperwork with the police since obviously a crime took place but they didn't really care and nothing more came of it.

Sorry it took so long to update, I forgot all about this post.

Would this be considered sexual harassment?

    Posted: 24 Sep 2020 06:53 AM PDT

So I recently transferred to a different area in the company (same facility but different location) and a former coworker of mine began messaging me on Facebook the other day. At first it seemed harmless, him asking how the transfer went and how things were going with the move. I assumed he was just being friendly at first, until he decided to ask me inappropriate questions. Ultimately, it resulted in him showing me a dreaded dick pic and I immediately blocked him from my account.

Could this be considered harassment seeing as we both still work for the same company? Our corporate office is in the same state and both facilities are sister companies. Could I report this and have him reprimanded for it? Or should I just let it go and not worry about it?

HoA threatens to enter my apartment using a locksmith if I’m not home when they come with Insurance Adjusters to inspect for damage from a Hurricane that hit 3 years ago. Is this legal?

    Posted: 24 Sep 2020 06:08 AM PDT

This is in South Florida, by the way.

Hey all. I originally posted a rant to another subreddit but the comments it received there made me wonder.

So some context: The community I live in is primarily renters who live in investment properties. The HoA is/has a management company running it. For the most part it's a lovely place to live: quiet, maintained, comfortable. I'm renting, and the owner of the unit is an investor from out of the country. He has a property management company (that isn't the same as the HoA's management company) that deals with collecting payments, maintenance requests, and all that. The HoA's office is also housed at least a 45 minute drive away and only open between 9 am to 4:30 pm M-F. I work 8-4:45 so Its not possible for me to speak to them in person.

Anyway, on 9/22, I come home to a letter posted on my apartment door that says that they are going unit to unit inspecting the interiors for Hurricane Irma damage (which, for those who don't know, hit in 2017) starting at 9 AM on Friday 9/25. And here is where I'm asking the legality: They then proceeded to say that if they could not access the unit, they'd be using a locksmith to enter and we'd have to grab the new key from the clubhouse. I do not know if I'd have to pay for this replacement because the HoA has been dodging my calls entirely after yesterday.

I have to work on Friday so i would have to take it off in order to let these people in, and I have a dog who likely would not allow them to go through the apartment unbothered (not aggression, just... curiosity and a desire to play). Is this at all legal? Can they change my locks just to access the unit?

Quick clarification just so people know: My actual landlord had no idea this was happening until I texted him a picture of the paper posted on my door. This is the HoA who wants access, not the landlord

[TX] Stepdad pointed a loaded gun at me and left it in my room, I took it and ran away to stay with a friend but don't know what to do

    Posted: 24 Sep 2020 08:34 AM PDT

My stepdad has has got really bad in the last year since we've been stuck inside because of corona and he's emotionally abusive to me and my stepbrother like never really physical but verbally and picking at us since my mom died in 2019. In the night came into my room while he thought I was asleep and I think he was drunk but idk and he pointed his gun at me for like half a minute then left it on my desk and walked off. I got up once I heard him and took his gun and called a friend who lives close and let me stay over. I'm 17.

I still have the gun safe in my bag at my friend's for now but I really don't know what to do, it is the only gun that I know of that either of my parents owned. I'm still stopping at my friends for now and I haven't told anyone else where I am, haven't even been outside for a few days. I don't know what to do. If I go back to my stepdad I think I will do something I may regret, should I toss the gun in a lake? I'm worried about my stepbrother too even without the gun. I really don't know where to fucking start.

edit: it's a handgun to be clear I know theres a distinction between the two

DFCS/CPS did nothing to help my girlfriend’s family

    Posted: 24 Sep 2020 07:07 AM PDT

[Georgia] The title is a tad bit misleading. But I'll explain. So here's the back story: My girlfriend's sister has 5 kids with her husband. Their home is disgusting. They have a mold problem, there's trash everywhere, animal feces everywhere, the floors aren't finished, etc. The husband also has a pattern of alcoholism and verbal abuse towards his wife and the eldest child. The kids bathe maybe once a week. The youngest child (2 years old) has been found across the roadway in front of their house several times by himself. All of this is happening while their mom is trying to homeschool them this year. There's so much obvious negligence. This has been going on for 9+ years.

Recently, the family decided to finally take action and stage a sort of "family intervention". The kids were going to live with my girlfriend's parents, the parents were going to seek counseling and work on the house. This plan worked well for a few weeks. Then the husband started to lash out. He messaged me on Facebook and threatened to punch me. He messaged my girlfriend and her mother as well (I don't know exactly what he said, but I was told it was super hurtful and mean). He admitted to impregnating his wife without her consent, and that's how the last child was born. Both of them cussed the family and blamed them for the situation they are in.

Within the last two weeks, the parents came back and took the kids for what was supposed to be the weekend, but they ended up keeping them for good. Legally, we can't argue with them. They're their kids. That's the tough part. The husband has continuously been careless about the condition of the house, the mother won't speak to anyone in the family anymore, and we're all just so concerned about the kids.

So we finally called CPS. We had non-family members report just to be safe. Apparently CPS's way of handling this was to FaceTime the kids and ask them a few questions. They've decided as of today that they won't be taking any further action. They said because there was "running water, food, and a roof over their head", they're not being neglected. There's just so much more going on and I genuinely don't understand how they feel like a FaceTime call (in front of the parents) was the appropriate way to go about this. These kids are in danger and my girlfriend and I are super worried. Legally, what's the best course of action now?

TL;DR Girlfriend's nieces and nephews are being neglected, but CPS won't do anything about it.

Employer "furloughed" me, but expects me to continue working...

    Posted: 24 Sep 2020 09:46 AM PDT

I'm a salaried employee in NYC for a small office (fewer than 10 people) with no HR.

Employees are paid once a month on the 1st for work completed the month prior aka October 1st check is for labor completed in September. Since June, my boss has reduced my salary wages every month (due to COVID as she states) with little or no notice and is applying the reduction retroactively to the current pay cycle. I received an email from them stating that I was being furloughed this week and would only receive a percentage of my pay for sept. (the reduction was more severe than in previous months). I emailed to confirm if the furlough was effective immediately and began my unemployment claim when they responded yes and that there was no definite end to furlough. However, now they are saying (over a call) that I am expected to work 75% of the time for 75% of my salary this month and that if I don't perform, they will not act as a reference to help secure another job in our precarious field. I feel this is intimidation (at this point I won't rely on their referral anyway) and I have no guarantee what I will actually be paid either this month or next. I'm not sure if this is relevant but with the reductions, my salary has been reduced below NYC's limit salary threshold, according to my research. Do I have the grounds to quit my job with good cause so I can at lease receive my unemployment benefits while I look for other work? I am speaking with them in person soon and I want to be advised on how I should proceed so I can protect myself if I'm forced to accept their terms or resign. I know unemployment benefits alone are not ideal, but it will at least help during the transition to another job. The actions of my current employer have caused me a lot of stress since I never know what I will actually be paid and even before all this, my employer often paid us late and once, we nearly waited into half of the next month until we got paid and again with no notice, until someone asked.

I should add that I suspect the reduced wages are also retaliation for working remotely (which we are fully able to do to complete our tasks) since they expected us to return to the office 100% of the time as early as a few months ago and stated that salary would be revised for those that continued remote working. At that time, no information was given regarding the preparation of the office for or staggered shifts to reduce how many people were in a combined space due to COVID. so we countered and since then they always state in pay reduction notices (if given and often within a day of pay day for work already completed) that it has nothing to do with us working remotely.

Landlord using exorbitant amounts of water on yard, I would like her to pay a portion of the water bill.

    Posted: 24 Sep 2020 10:39 AM PDT

I live in a single family home in a suburb of San Diego and moved in one month ago. On the lease I am responsible for water and all other utilities, the landlord is responsible for yard maintenance.

The landlord is over often running the hose on the yard (I think she is afraid of fires and likes to keep it wet).

My first water bill came this month for $477.00. The bill said we used 43 hundred cubic feet (about 32,000 gallons) for the last 60 day billing period. I had not yet even moved in for 10 of those days. The average reported on the bill for homes in the area is 6 hundred cubic feet (about 5000 gallons). The landlord confirmed this is a normal amount for this residence. We have confirmed there is not a leak.

I feel mislead that I need to pay about $500 extra bi-monthly for her to water the yard. Do I have legal ground to hold her responsible for a portion of the bill given it is for yard maintenance (which is the landlord's responsibility).

    Thank you for your advice!

OH - Landlord claiming fake new lease to withold deposit

    Posted: 24 Sep 2020 01:46 AM PDT

I signed a 1 year lease on an apartment with month-to-month after 12 months. That was about 20 months ago. Our apartment complex was bought and sold by at least two other companies since my lease was signed.

After moving out, the current company is now claiming we violated our lease by moving out early, and the cost JUST SO HAPPENS to be exactly our rental deposit minus the carpet cleaning fee. Their story is that every tenant signed a new 12-month lease upon them buyingj the property... but surprisingly, they can't show me that lease that I supposedly signed.

My state is very clear about rental deposits. If successful, I should be entitled to reasonable legal fees, and don't need to go in this pro se, right?

At the same time, is it worth a lawyer's time for (disputed amount plus 1X damages legally allowed) $600? Even if they could still stick it to the other party and bill them for defending their opponent?

How can I get my car title? It was sent to a bank by mistake

    Posted: 24 Sep 2020 08:17 AM PDT

So I was pre-approved by Chase for a 2.8% APR on my car, since the dealership couldn't beat it they went with my chase, and everything went smoothly in the box that day. I signed all the paperwork and officially purchased my car. However, a week later chase refused to honor the deal, so I send the dealer a cashier's check to pay off the car in cash instead.

Here comes the problem, the dealership didn't update their record when they are registering my car at the DMV. So my title is actually getting processed at my DMV with a lien from Chase. What can I do now to get my title? Can Chase even take the title since they never finalized the deal with me?

Involved in a car accident, other person's insurance contacted an attorney and they are threatening to revoke my license if I don't pay.

    Posted: 24 Sep 2020 06:58 AM PDT

Back in July I rear-ended someone while it was raining. Totaled my car but his was pretty alright. I find out after that my insurance had lapsed by 3 days, and they refuse to cover it. I get a call this morning from a law office that the other person's insurance has contacted stating that if I dont set up a payment plan and pay the down payment as soon as possible, theyre going to have my driving privileges revoked. Are they able to do this or do they need to take me to court first?

Edit: I live in Ohio for clarification

(North Carolina)Can a school refuse to take a student?

    Posted: 24 Sep 2020 11:14 AM PDT

I'm not sure that title is really accurate.

When the school year started parents had to make a choice between "Plan B" which was the student going in person 1 day a week doing the other 4 days virtually. Or "Plan D" which was completely virtual with no in person instruction. Parents were told if they chose Plan D they could reevaluate at the end of the first semester and either keep going virtually or change to whatever in person schedule will be at that time.

Well now the governor says Elementary schools can open back up completely and the school board is saying parents have to either commit to doing the entire year virtually or go back to in person classes.

I have twins in 2nd grade. I chose plan D. Which has been working well for us so far because I have been able and allowed to work from home so I am here if they need anything (their dad/ my husband is useless for anything other than being able to say that there is an adult in the house). I don't know how long me working from home will last I am currently approved through November 15th and we might go longer but it all depends on management, but there will come a time that I have to go back to the office and when that happens there won't be anyone here to keep the twins on task and make sure school work gets done.

I was really counting on being able to reevaluate things in January and see where we are with me being home and how the kids have handled virtual school. I am not comfortable committing to the entire year of virtual learning because circumstances may change to a point where they have to go back in person.

So my question is if I choose to keep my kids in virtual learning for now, can the school district refuse to allow them back to in person classes if that becomes necessary for us? It doesn't seem right that they could do that.

Should I be nervous about handing my signature over to a debt collector? (MI)

    Posted: 24 Sep 2020 08:09 AM PDT

I'm from Michigan and I have an upcoming court date regarding a lawsuit from a debt collector representing a former bank I used to bank at. The original amount they were suing me for is around $700. I called and got a written agreement to settle the debt for around $600. They assured me they would get the case dismissed once I paid it. Fast forward to the last day for me to give a response to the court and the debt collection agency still hadn't cancelled the suit. So I submitted an official response to the court showcasing our agreement and that I had paid to settle the debt. Days later the court responded giving us a court date and right after that the debt collection office called me asking me to basically hurry up and sign a Stipulation to Dismiss so the case can be closed. They told me the Stipulation to Dismiss is with prejudice to prevent them from suing me again for the same debt.

My worry is: The debt collector wants me to sign and scan the Stipulation to Dismiss and send it to them, but I'm worried about sending my signature to a debt collector. Should I even care? Am I just paranoid?

    Barn destruction

    Posted: 24 Sep 2020 11:29 AM PDT

    I'm in MN

So last year I hired a guy to tear down a barn. Contract says he'll keep what wood he finds, it also doesn't give an actual "completed" date. He pulled down the barn, separated the wood he wants, and now has to remove/burn the rest. Problem is, it's been over a year. The barn still sits there, and his piles of wood. If there was no complete date, do I have an argument for a refund? I paid over 7k for his service.

Being Accused of Hitting Kid with Car?

    Posted: 23 Sep 2020 08:58 PM PDT

I live in Wisconsin (Dane County) in an apartment complex and around 7pm tonight there was tapping on my window. I opened the door to 3 kids (around ages 8 - 14) and the main kid tells me I hit him on his bike with my car Monday afternoon. He points at my car and asks if it was mine and I confirmed it was.

I had to pause and think because I so infrequently drive at this point (work from home) that it took me a minute to even recall if I drove Monday. I asked what time this supposedly occurred, as I would be pretty sure if I hit a kid with a car, my parking lot has sharp curves with blind spots and kids are always playing in the lot, so I always go slow. He said 4ish, I checked my timesheet on my phone and I took my lunch at 2:10 - 2:46 as I ran to my sisters to pick up something.

I asked what the delay was in contacting me if I did hit him 2 days ago? He claimed he went to my leasing office to get my license plate from the lot cameras and my apartment number. He inferred he was coming to me as I wouldn't like it if his mother came by. They claimed there was a scuff on the front of the car "from me hitting them", which there is a light blue scuff like if you rubbed a sneaker on a gym floor, right under my front plate.

At this point I called my dad for his opinion while I went back in my apartment. They continued to knock on my door and I cracked the window open and my dad directed me to ask what they wanted if I supposedly hit them. They answered, "Bread". At this point, I told them I would call the cops.

I did call the cops who said they will call me back about the issue, I just wanted to know, how should I talk to them? I've never talked to cops before and am not sure of the correct way in which to do so, advice would be appreciated.

(I did call and left a message with the office, asking if this was true, and if it was, why wouldn't they call the police if someone had hit a child with a car? I also wanted them to know that there are kids going around potentially conducting scams. I also circled my car and took pictures in case of any surprise sudden damage, and have ordered dash cams so this isn't an issue in the future.)

Desperate college grad accepted a virtual personal assistant job offer. Ended up becoming a victim of interstate mail fraud.

    Posted: 24 Sep 2020 11:51 AM PDT

As a recent college grad entering the world during covid-19, I was pretty much desperate for a job, especially after 500+ applications/interviews/rejections in a 9 month time period. My mental health was pretty bad and I just wanted any type of work I could get. I recently applied for a job as a front desk receptionist at a manufacturer company on indeed.com and was contacted by someone from their HR that the position has been closed, but their President/CEO is in need of a personal assistant. I ended up expressing my interest in the position, answered a bunch of interview questions he gave me to detail my qualifications for the job, and was hired in the same week. Here's where the mail fraud happens.

I, being a sheltered asian child with an anxiety-driven work ethic, received a check for a large sum of money in the mail ($4,910) and directions to deposit it, which I quickly did. I was directed to purchase money orders ($2950) and two One Vanilla gift cards ($500 each). I mailed out the money orders as directed to an address he provided. His explanation for that payment was that he was on a business trip in Ontario, Canada and that he wouldn't be able to get his bills paid on time, so I had to use the funds he mailed me to issue a money order. I was also told to get the two $500 gift cards so he could make a charitable donation to local foster homes for coronavirus reasons.

His exact words were: " I have a few tasks for you to carry out for me this week, I have some of my due bills that I need you to pay and I also need to make donations to some foster homes for them to get sanitizers and hand gloves and an immune booster to protect the kids from contacting coronavirus."

The second week, I received a check for $7910.11 from the same company, told to deposit it immediately, and wait for details on my weekly tasks. However, the check from the first week bounced, which alerted me to that something might be wrong. I reached out to my "boss" to let him know that last week's check that included task expense funds + my weekly wages had been returned and asked for a reimbursement. I called the company on the check (they are an oil engineering company), asked them what is going with these checks, was alerted by their accounts person that they've been contacted with similar claims and are in contact with the FBI about it. It is not "a case" in the account guy's words because the company has not lost any of their money over this, so they pretty much don't care. I've filled a fraud report with the USPIS online and left them a voicemail about it as well. I called my bank to let them know that they should expect the $7910 check to bounce. I'm not sure what to do about the gift cards (I didn't know that giftcard fraud was a thing until this morning). I tried to contact the FBI branch in the company's state (at this point, it's interstate mail fraud) and redirected to the FTC. I have all the receipts from when I made the purchases, the mail order stubs, deposit receipts, two email addresses, one phone number, three names (HR man, Scammer Boss man, and Money order recipient), and one physical address. The money I was scammed out of was money meant for my brother's college education. I'm helping him pay his rent and cover some tuition fees, so I am feeling very helpless right now because all I wanted was a job to be able to support my family and get through Rona times, but I ended up putting my family in harm's way when they scammed me. Can someone please give me some advice on what to next/recoup my losses?

TLDR: I, a desperate college grad, accepted an offer to work as a personal assistant. Was sent two fraudulent checks for a total of $12,820. Didn't realize it was fraud until one check bounced and "boss" ghosted me. I was scammed out of $4,600 that was meant for my brother's education. Any advice on what to do?

Drunk driver arrested for DWI alcohol after hitting my car while I was stopped at a red light. His insurance is offering less than $700.

I was hit last Friday by a drunk driver while at a red light. The other driver drove into my vehicle and it was a hard hit. The driver didn't want to share ANY info at the scene and stayed in his vehicle until the cops arrived. The police were able to get his info. He was arrested and taken away after the police talked to him for a while. I had a headache for 2 days and neck pain for about 4 days afterwards and missed the rest of my shift that day and 3 days of work after. I haven't seen a doctor because the EMT who arrived on scene, who only checked the other driver before hopping back in the ambulance and I had to tell them I needed to be checked out too, told me I can take headache meds and I just have whiplash. My car is in the process of being accessed by his insurance to see if it can be repaired or if it's totaled. His insurance offered me $307 for missed wages and $350 for pain/inconvenience. It seems like such little money especially if I will have to go through a whole process to get a new car. My car was paid in part with a loan so if my car is totaled the money I'll get for it will go to the bank to pay it off. Then I have to put a down payment on a new car after all the work I'll have to put in to find one. Possibly taking out another loan again.

    My questions:

    1. Can I get more money out of this?
    2. Is it worth the hassle?
    3. What else can I do besides accepting the offer(emailed to me and needs a signature)?
    4. Is the offer reasonable and should I take it?

If I'm missing details/information please ask. Thanks in advance.

How to handle a deposit on a car if the buyer backs out?

    Posted: 24 Sep 2020 10:29 AM PDT

I'm selling a car. I have a potential buyer who gave me a $1500 deposit so I'd not show it to anyone while he gets a pre-purchase inspection done. I'm unsure about how to handle the deposit should he back out.

There was no contract written up for the deposit, he simply Venmo'd me the money. It may not matter, but I didn't tell him how much to send, $1500 is more than I'd have suggested.

Are Highschool names Trademarked? Can a T-shirt fall under Fair use or Parody?

Hello, Right now the High-school in my area is the center of a sort of controversy regarding the use of native American imagery at the behest of Natives who are asking the school to make amendments to the way Natives are depicted.(older) People in the area are in a frenzied outrage about this. I want to make a T-shirt making fun of the Karens and Old people who are mad that reads "-School name- Screeching Mayosapiens" in the school's Colours. Would this land me in hot water or is that sufficient parody? or to be more broad can a T-shirt be considered Parody?

"Troubled" neighbor is obsessed with my six year old nephew and I'm afraid it will soon be, or it is, getting out of control

Hi legaladvice, I have an issue I need serious help with. My mom and I moved to our home two years ago and a few months later, my sister and her son moved here with us. Ever since then, our neighbor John has been, quite frankly, an issue. My 6 year-old nephew Daniel has come home saying John gave him the middle finger, and has told him to "shut the fuck up" on several occasions, one of which I've actually heard.

We were told by local authorities John is on medication, but lately hasn't been taking it. Around the time my sister Sarah moved in, John has tried to convince her that the neighbors behind his home were witches and meant to do harm to Daniel. Turns out it was an elderly woman taking care of her disabled granddaughter. IIRC, it was the older woman who had called the police when John was on her front porch, and that's when we discovered the police are well aware of him.

On July 14, 2020, Sarah had her second son, so we remember just about everything that happened that week. Daniel found a can of spray paint and mistook it for spray chalk and sprays a sign in John's yard, the road, and a tree in our yard. Sarah goes to knock on the door to apologize and offer to pay to replace the sign, but no answer. An hour later an officer arrives and talks to us.

We recently discovered John had placed cameras on his property, one of which is facing Daniel's clubhouse which is situated between a small group of trees in our backyard. We don't know if the cameras are actually on, however. Sarah also came home on the 19th of this month from grocery shopping and told us John was at the same store, and was talking to the cashier about Daniel, but immediately stopped and hurried out the door once he saw Sarah.

These next few events is where the trouble started:

We have a small drive that goes through the southwest of our neighborhood. Unless you knew it was a road, you'd think it was a driveway so no cars really use it. Daniel tends to ride his skateboard or bike on this road but doesnt go to the top of the hill/road as he goes too close to John's house. He also doesnt pass the electric pole on our property since it marks when the small road stops and turns to the two main roads (think of the roads like a capital K).

Daniel has a friend who lives down the road. He knows not to cross the street unless someone is on the porch and one of us would watch to make sure he makes it safely. Daniel also knows to stop/look/listen before crossing.

Daniel would often check our mail in the morning or in the evenings. Our mailbox is close to and faces the road but knows to look both ways before getting to the mailbox.

Daniel is fond of this young man who lives across from us, Louis. Louis is currently flipping his grandfather's home and Daniel often goes across the road to help him. We absolutely love Louis and often invite him into our home for dinner or for a drink on hot days. He built the clubhouse for Daniel with my mom's (the homeowner) permission, and I think I heard my mom say that John was complaining about it but I don't remember what was said.

Because of these, cops were called because whoever called had considered this to be "playing in the street". A woman from CPS had come by while I was making dinner on September 21st and asked for my sister. The woman tells us a report was made on or near July 14th about Daniel playing in the street and asked to see Daniel's bedroom and to see if we had food/water. My mom asked the woman if officers were actually dispatched to our home since the report and she said no cops actually came by.

A cop did come by, however, about an hour after the CPS woman left, as John walks up and down the road every couple of hours with a tablet in hand and my sister caught him pointing the tablets camera at Daniel. Sarah dialed 911 and the officer spoke to John, but the officer said he couldn't do anything about it.

Today, however, when Sarah came home from work, she recorded John from our kitchen window standing on the road with the camera on his tablet aimed at Daniel, and following Daniel with the camera as he ran across our yard. John proceeded to talk with another neighbor, showing them whatever was on his tablet, and Sarah flies off the handle and expects the worse, that he's showing whatever he recorded to the neighbor. Despite Daniel not having a shirt on as it was nice and sunny, again the officer said they couldn't do anything because he wasn't violating anyone's rights.

Beyond setting up cameras, which we plan to do when we can afford it, I'm not sure what to do. He seems eerily obsessed with documenting a 6 year old's actions day to day. The police won't help us, as they can't really force someone to take medication, but between what happened today, and the camera John has set up that faces our property where Daniel frequently plays, this situation is getting really out of hand and we don't know what to do anymore. Sarah has been "recommended" by the woman from CPS to take parenting classes and it may end up being court ordered depending on what happens on the 29th. Sarah is also anxious about something her father told her, in that because the woman went in our house to check the living situation, the woman can make up just about anything to take Daniel from her.

So, legally, what are our options? We've considered moving to a new area, and never would have moved to this house if we knew what we'd be dealing with. Thank you for taking the time to read this, and I hope you're having a safe night.

Edited to add location, as the entire post was copied and pasted from a .txt rough draft.
