Posted: 23 Aug 2020 04:11 PM PDT https://www.youtube.com/watch?v=eFLkGavkgPY This tow truck with no phone numbers was driving on the freeway with lots of rocks on its rock bed. Got hit by multiple pieces, and in the video you can see a huge piece hitting the bottom left and cracking the windshield I tried to give my insurance company (geico) the video and the license plate number (visible in the video, and I say it aloud during the video also as I was not sure if dashcam will capture it). They are asking me to use my own insurance policy with 250$ glass deductible, or track down their insurance from license plate myself. What are my options. How do I make my insurance company go after theirs. Do I need to file a report with California highway patrol [link] [comments] |
Other driver "stole" gf's car and hit me during turn, insurance wont cover anything Posted: 23 Aug 2020 03:32 PM PDT Hey everyone, this might be a little long so bear with me while I try to explain everything. Keep in mind, I didn't have full coverage, and now know that is a huge mistake. Also to clarify, I live in Pennsylvania. I was driving home at night a couple months ago, and was turning left at an intersection. I saw that I had the green arrow so I start to turn, as I'm 70%-80% done with my turn, my car gets absolutely smashed from the right rear, and spins about a full rotation and a half, before coming to a stop. I was literally in shock for about 10 seconds after my car stopped spinning, but luckily I wasnt hurt at all somehow. I get out of my car and try to spot the vehicle that hit me, it was literally 250-300 yards down the road, (about 5 houses down). The first thing that comes mind was that this guy was obviously drunk and was doing double the speed limit, then ran the red light. There were multiple people (from the houses) checking if everyone was okay, but only a small group of kids saw the actual crash. I go to check on the other driver, and there was 5 of them in the vehicle, all yelling at eachother and panicking. I asked one of them if they were alright, and without even turning to look at me, he just screams "NOOO!". All 5 were moving around just fine, so I didnt even bother speaking to them anymore, I just walked back to my car and called the police. I didnt really register the damage until I was walking back to my car. There was debris and glass EVERYWHERE on the street, and it was a pretty large intersection. My car's back bumper was off, and the right rear was completely caved in. There was also a couple of parts that fell off the frame. The right rear wheel was completely missing, but we later found it on the other side of the intersection, in the grass. The car was no doubt totalled, as it costed $4000 when I first bought it a couple months ago with 190k miles. Eventually after about 3 mins, a firetruck and about 5 police cars came. They closed off the intersection and part of the road to get rid of all of the debris. The officers took both of our statements, and a towing company came and towed both cars. I asked the officer nicely to test the other driver's alcohol levels, as the nature of the accident was completely absurd, but they declined. I made a claim with my insurance company, (which denied liability the next day), but couldnt make a claim with the other driver's insurance since we didnt have the police report yet. Fast forward a few weeks later, the insurance companies finally have the police report. I made a claim with the other insurance, and was told that they were waiting for a THEFT report now, since apparently the driver "stole" the car from his gf, that lives at the same address as him, and the actual driver wasnt on the insurance... A week after that, I get a call from my insurance company saying they changed the liability decision to 60% my fault and 40% his fault. I asked why and was told that my case wouldnt hold up in court?? Because the only thing the witnesses (group of kids) saw, was the other driver speeding (about 70mph on a 35mph road). The other driver and all of his friends obviously lied, so I asked why the hell his word is being taken against mine, and was basically told that there was nothing they could do about it. Fast foward a few weeks after that (now), the other insurance company says they finally have the theft report, and make a liability decision, saying im 100% liable, and that even if I wasnt liable, I wouldnt get anything anyway because they dont cover "stolen" cars. This whole thing has been driving me nuts the past couple months, as I lost a $4000 car that i only got to drive for a couple months, not to mention the towing and storage fees that I havent even paid yet (about $1000). My question is, if I sue the driver that "stole" the vehicle, would I have a good case? Should I take it to a small claims court, or find a lawyer? Thanks to everyone who read until the end, any advice or comments will be greatly appreciated. [link] [comments] |
Sold my car last week, Got a voicemail regarding to an accident associated with the car Posted: 23 Aug 2020 10:52 PM PDT Sold my personal vehicle last week, it was in great condition, passed smog 2 weeks prior to the sale date... I got a voicemail 4-5 days after selling the car from an insurance company saying that: this is —— case manager of the case number—— this is in regards to the car you sold to —— please call me back... I called the guy back but he was on leave.. probably he is going to call me back sometime this week. I am wondering why the insurance company called me since I have already sold the car?! + I am in California [link] [comments] |
mother received bill from life insurance loan Posted: 23 Aug 2020 01:36 PM PDT ETA: googling the phone number on the letter comes up with several hits suggesting this is a scam; and the company's actual number from their website is different - we'll be calling the legit company just to follow up. Thanks for the responses! My mother, who is in her late 70s, recently received several letters demanding payment for a loan against a life insurance policy that was apparently taken out in her name in the year she was born, presumably by her parents. She has had no knowledge of this policy for her entire life, but it seems that a loan was taken out from it in the early 1980s (yes, you read that correctly). Her father was still alive then, not her mother, but again, she's never heard of this policy until now, and her father died in the mid-80s. One of the letters thanks her for updating her address from an address she hasn't lived at since the mid-80s to her current address (she's moved 5-6 times since then, and has lived at her current location for over a decade), and is asking her to start paying back the loan on a monthly payment plan. I'd say this is some kind of scam, but it looks legit. What's the best course of action? She's requested a policy history (we don't even know who could have taken out a loan other than her father), but I'm wondering about other steps we might take. [link] [comments] |
NY: I can’t get insurance with a rebuilt title Posted: 23 Aug 2020 01:04 PM PDT I have a 2013 Subaru with a rebuilt title in the state of IL. The car works just fine - it is just with a rebuilt/savage title. I just moved to NY (note: am not insuring the car in NYC but am close to the city) and need to move my insurance however I can't get anyone to insure my car. I am getting rejected from all the major players and I need insurance ASAP. Why did underwriters in IL not have a problem with this but those in NY do? Is there anything I can do? [link] [comments] |
Filing a claim the day you get insurance Posted: 23 Aug 2020 01:03 PM PDT I was wondering if it is possible to file a claim the first day you get renters insurance. Context: Due to the California fires, it is possible I may need to evacuate. Due to this, I was wondering if I should get renters insurance just in case the belongings in my dorm room get damaged today or tomorrow. If the answer is no, then that's fine. I am moving off base in a week anyways so trying to pack up as much stuff as possible into my car will not be a problem because I'll need to pack it anyways. I just can't fit everything. Also, I'll need renters insurance anyway for the house so I'll still be paying for it in the future. Background: I'm active duty military and live in on-base dorms. UPDATE: I got my insurance:) [link] [comments] |
wired money to fraudulent account - can insurance help? Posted: 23 Aug 2020 07:50 AM PDT Hello all, The company i work for wired some money to a fraudulent supplier account. The scammer sent to us what looked like a legit invoice. The bank is unable to recover the funds and we want to know if the insurance covers such incidents. Our broker is telling me that our commercial package insurance does not cover but i found this page in our policy:
a- Electronic Vamdalism, as defined and limited below, is added as a covered cause of loss. b- We will not pay for any business income loss o rental income loss caused by electronic vandalism that you sustain during the 6 hours that immediately follow the time when you first discovered the electronic vandalism. This waiting period serves as a deductible. No other deductible applies to business income or rental income coverage. This waiting period does not apply to extra expense. c-Electronic vandalism as used in this cause of loss means: (i) the willful or malicious alteration, manipulation or destruction of electronic data whether or not there has been any physical loss or physical damage to electronic data; or (ii) The addition of a virus, malicious code or similar instruction that disrupts the normal operation of computer equipment whether of not there has been any physical loss or physical damage to computer equipment or electronic data. Do you think this could help? [link] [comments] |
Posted: 23 Aug 2020 06:43 PM PDT Hello everyone,I'm in Orange County, Florida. Hoping someone can help me out with an issue. A few weeks ago my wife and child were 1 of 2 cars involved in a hit and run. The driver of the vehicle who hit my wife's car and another's got out of the truck and just walked away. State troopers impounded the vehicle. About a week ago the trooper got back to us and provided their insurance since they could not find any on record at the time of the crash. We called their insurance to file a claim, a couple days later we get a call saying their insurance had lapsed before the crash apparently so progressive was not going to be responsible and said the claim would be closed, but they would look into if he had insurance with anyone else. We called again today for an update and was told they currently have nothing new and we would be notified formally once they are done with their investigation. Now they still have the claim as active/open even though they said it will be closed after initially speaking with the claims agent. My question is if his insurance was lapsed why are they still looking into it? I just figured since it's no longer on them they would have just moved on. Maybe someone can provide some in site as to what exactly is going on/what they are doing. Thank you! [link] [comments] |
Can you as an agent be sued for NOT writing an insurance policy? Posted: 23 Aug 2020 01:51 PM PDT Can you be sued as an insurance agent for not binding a policy whether a client asks you to or not? At the end of the day, if you've never issued the policy or provided any sort of binder is it your fault if they sustain a loss and had no coverage? Especially, if they never asked the agent for a policy to be bound? I know the answer to this question but I would like to have a few agents input on this. Edit: This is in TX [link] [comments] |
Posted: 23 Aug 2020 05:34 PM PDT I know that personal policies generally exclude any type of "work" use include gig work. Though it appears due to the pandemic they are making some sort of exemption as many lose their jobs or their jobs change their role i.e from waiting tables to making deliveries. Not to mention they are overflowing with money due to less claims. I be curious does it mean that they now cover any incidents that happen during a delivery as long as a state of emergency is in effect? Thus are deliveries California still covered today? Does it only apply to deliveries on behalf of an employer or are independent gig working contractors such as Ubereats/Instacart included as well? Apparently this is only revealed in certain news sources. Such as Though Safeco/Liberty Mutual seem to be the stingy one that cut off this exemption on May 22/June 1st even though many states were still shut down. [link] [comments] |
Parked car hit by uninsured driver Posted: 23 Aug 2020 05:21 PM PDT California San Diego area. So my truck was parked in a pretty open street. Not too sure if the details matter but 4 lane wide street directly under a street lamp. Not a lot of other cars near either. Driver hit my truck at 330am Saturday morning and was nice enough to not hit and run and called the police. Damaged the entire front end. Took out the fender on driver side, driver and passenger door are both smashed in. Front tires are turned in and the center console popped out of the dash. It is not drivable. I live in a very tight nit area where pretty much all the neighbors know whose car is whose and they went and got me. Well so the driver told police and me that he left his phone at home and his wallet was lost so he had no identification and no insurance info. So obviously the only thing I could get from his was license and his full name. He did tell me he had geico insurance but he wasn't sure if it was this car or his other car and reassured me that at 8am he would send me is contact info So I call geico and there is not record of him in the system. I filed with my own insurance but unfortunately I only have the basic liability. I go out to my car at 9am and guy is still there. He said he's waiting for his friend to come get him. It's past 5 here on Sunday and guy is still there. I walked by and it looks like he is actually living in his car. My question is...if he has no insurance and obviously he has little to no money since he is living out of his car am I screwed when it comes to getting my truck fixed? It's a lot of damage to my truck that is definitely not going to be a cheap fix for me. What are my options? [link] [comments] |
Posted: 23 Aug 2020 04:54 PM PDT My car was rear ended by another car in NYC (Enterprise). I filed a claim through his insurance company (Elco), and they are taking 100% responsibility for the accident. My plan was to have the appraiser come see the car, can write me a check for the repairs, and then I will have a friend of mine repair the damages (for cheaper) at another time. Or am I better off just giving my car to a decent autobody shop, have them deal with the insurance directly without getting involved with the appraiser (NYC)? [link] [comments] |
Looking for guidance on relatively minor but unwarranted subrogation claim Posted: 23 Aug 2020 03:37 PM PDT Hi all. 11 months ago my bathroom plumbing failed in the middle of the night, causing flooding in my bathroom and bedroom. This was no fault of my own. My neighbor was also affected by this flood and had to have his carpet removed. He made a claim with her renters insurance and received x in damages for the issue. I do not have renters insurance. I did not make a claim for the flooding with my building, instead of cleaned it up myself and returned the apartment to normal condition. 11 months later I receive a letter from a subrogation agency demanding that I pay them (x times 3) in damages to their agency. The letter is addressed to my apartment unit, but my name is nowhere on the letter. The agency does not know who I am, just where I live. I am open to settling this claim for an amount equal or smaller to what was paid to my neighbor. But NOT for the (x times 3) amount. I have not spoken to the subrogation agency yet.
*x = the amount my neighbor claimed. (x times 3) is three times that amount [link] [comments] |
[US] [MA] Old car likely totaled, not at fault - options to get insurance to pay out and make whole? Posted: 23 Aug 2020 07:11 PM PDT Parents were in a 4 car accident recently. The car behind them was at fault, as they slammed into my parents, who then hit the 2 cars in front of them. My parents' car is likely totaled, and it is an older 2009 car with above average miles on the car. My parents do not have collision insurance, not sure about the at-fault person. They all have the same insurance though: cheap-ass Geico. I looked up similar cases of "car likely totaled, what next," and it seems like the only option is to wait and see what the payout that Geico gives, and try to negotiate. Given the age of the car and the miles driven, I fear there won't be much leverage on my parents' side. I just want to know if there is anything else I can do in this case? It's hard to sit around and watch my parents get ass-fucked by insurance companies. It is also frustrating for them because they just paid for major repairs to their car, so that they could continue to use it for the foreseeable future. Now they think they'll get the lowest possible payout, and will have to spend triple that to replace their car, for being in a situation that wasn't their fault. [link] [comments] |
What is my liability as a tenant? Posted: 23 Aug 2020 03:23 PM PDT I have always rented and kept renters insurance. What I have not been clear on is if I cause extensive damage to the home I'm renting (for example it burns down in a fire) would I be subject to litigation by the homeowner? Does it matter if they have insurance cover the damages or not? I know I typically put down a security deposit but if damages go beyond the deposit what would happen [link] [comments] |
Posted: 23 Aug 2020 03:04 PM PDT So I went and negotiated a car sale over the weekend. As we were going over the sales amount, the salesman ran through what each of the numbers on the sheet were and pointed at each one so I could follow along. I double checked the sheet afterwards, but I didn't notice the "Vehicle Theft Prevention" charge of $299 that he conveniently didn't mention until i got home, as it was somewhat hidden away from the rest of the numbers. I intend to call them on Monday to tell them that I don't want it and that I refuse to pay for it. In the instance that there's nothing I can do to get them to remove that charge, I was wondering if anyone knew if State Farm (specifically in New Jersey) offers a car insurance discount if you have VIN etching? I plan to call my agent on Monday morning to see, but I was hoping to get an answer ahead of time as it's been making me pretty anxious. [link] [comments] |
Homeowners insurance and daycare Posted: 23 Aug 2020 02:50 PM PDT My wife is going to run a small 3 day a week, daycare/structured learning environment for 3 kids along with our son starting in the fall. She is planning on getting families to sign a covid waiver that parents won't sue and won't put anyone else in danger and disclose risks, however we wondered if we needed to get any language or conditions added with our homeowners to make sure we are protected. I took out a renters policy when one of the CA wildfires was about a mile from my apartment. Posted: 23 Aug 2020 04:05 AM PDT If the building is destroyed (still don't know if its standing), will the company pay the claim? I am definitely covered for wildfires, lighting strikes. I don't see anything about a waiting period in the policy. I'm guessing the fire came through 8-24 hours after I bought the policy. [link] [comments] |
Is USAA really worth the price of admission? Posted: 23 Aug 2020 01:45 PM PDT I was just taken off my policy and can re-up this year but I pay WAY to much for not really anything worth while. I pay total $357ish for renters, 1 car (2013 volt) and some basic equipment coverage (for 1 DSLR). Farmers quoted me $237 and Ameica is quote $167. I do not want geico, but at this point I am more then willing to save the extra $200 per/mo. I have had 1 true at-fault accident in my life, no DUI, 1 cracked windshield and that's it. All that being said - is USAA really worth it? I have never had issues with them. They are fast, accommodating, and provide a decent customer service experience. Past that, it's all just "good enough" in my opinion, I have never really been blown away. Should I just bite the bullet and save an extra $200ish a month for this? [link] [comments] |
can I join a healthcare plan that's NYC based while living upstate at college? Posted: 23 Aug 2020 11:20 AM PDT So for context, I (18) live in NYC but am starting my freshman year of college upstate. I don't have health insurance but I found an insurance plan (Medicare's Amida plan) that I really like. It says I have to live in New York City. Can I still apply for this or nah? Also, if I can, will I still be covered by the plan while I'm upstate at school? Thanks! [link] [comments] |
Limit on payout for stolen bikes Posted: 23 Aug 2020 06:31 AM PDT I'm in Quebec, Canada. We purchased renter's insurance before moving into our apartment and had a long (recorded for training purposes) conversation with the insurance agent. He asked about the value of our stuff, but because we mostly own 2nd hand furniture and okay clothes, we went with basic coverage. However, we asked many questions about our road bikes in our locked storage locker and whether or not they would be covered, which the agent said they were as long as the value of our cycling gear was under $5000 (it's close to $4000) for both. The insurance company guy kept asking about jewelry, dresses, a fancy TV, etc. but we only cared about our bikes and he said that, as long as we're below 5 grand, they're covered. 5 days after moving in, someone cut open the grates of the storage locker and stole our bikes. Thankfully we had receipts, serial numbers and everything we needed to file a police report and report them stolen on every registration platform available to us. The condo board also pulled the security camera footage and changed the locks on the building doors. We filed a claim and the person on the phone told us that we had replacement value coverage, but our policy covers up to $1000 per bicycle. She also said that, because our bikes were worth more, they would waive the $500 deductible and we could possibly get $2000. We argued with her as our initial policy purchase discussion was mostly about covering our expensive bikes and her colleague told us that since we didn't have any expensive jewelry or a 6000$ bike, we were fine with the basic coverage. She did say that she would listen to our recorded conversation at the time of purchasing the policy to see if we were misinformed at the time. We sent the original receipts to the claim department as well as a quote from a bike shop confirming replacement value. We feel really upset that we purchased a policy asking specifically about covering our bikes to learn later that our bikes are not entirely covered. We just think that it's the insurance company's fault for not telling us over the phone when we asked several questions about covering our bikes. The lady we spoke with yesterday seemed quite reasonable and willing to work with us, but realistically, what are our chances of getting replacement value? Thanks! [link] [comments] |
How can i get health insurance for two states? Posted: 23 Aug 2020 06:30 AM PDT With everything that happened I will be dividing my time between Florida and Ohio. Right now I currently live in Florida but I do freelance work in Ohio so I am frequently there. I'm not quite familiar with the term out of network coverage. Is that just in the state or does it apply to a different state as well? I am looking for an insurance that allows you to see out of state doctors. Mainly Ohio. I heard Aetna PPO allows you to but I am still researching. Do not know how true that is. I don't want to pay for two health insurances. I just need a solid one. I'm more than likely going to need PPO. It's extremely hard trying to navigate through this during pandemic [link] [comments] |
Posted: 23 Aug 2020 06:15 AM PDT I previously posted question about when carrier would allow client to pick their own attorney, just to confirm this would be unusual. Here's more of the story: Client is threatened with a lawsuit against his covered business entity - but also against him personally - for libel. Against my advice (I'm a retail agent), client calls in claim directly to carrier before anything is actually filed in court. Carrier issues reservation of rights letter and hires counsel in anticipation of said lawsuit. Client then gets into squabble with hired counsel and causes big commotion about receiving service of lawsuit. Carrier says fine - we'll terminate counsel we hired, you go pick your own, we'll reimburse you $150/hr. To me, this sounds golden... since carrier will only respond to claim against business entity... not against individual in personal capacity.... but client could now potentially go find one lawyer to represent both business and personal interests, and offset or pay for legal fees from $150/hr carrier will pay. But client is still upset, wants to know why he has to pick an attorney himself now! Just doesn't make sense to me, seems like he just wants to argue, writes long long emails with irrelevant questions to claims dept and my office, expects fast replies, generally seems unreasonable. I feel like we (carrier/agent) are the injured party! haha. Any suggestions? Should I refrain from any additional claims related interaction with client and simply, repeatedly, advise he needs to contact claims dept? [link] [comments] |
