    Good morning r/legaladvice!

    I recently moved into my own place and have been looking to adopt a cat. The public shelter in my county in Florida has zero cats available, and while that's a good thing because it means there aren't any abandoned cats in the area, it also means I have to try private shelters as I don't want to buy from a breeder.

    So far, this has been challenging for many reasons. One shelter in particular, after filling out their application, e-mailed me to ask what my gender is and if I had a wife. I explained to them that I am male and single. They replied by informing me that they will not be accepting my application, and will be sharing my name with other shelters in the area to prevent me from adopting one.

    Is it legal for a private animal shelter that solicits donations and funding from the community to discriminate against who they will adopt out to because of gender and marital status if there is a woman in the home? There is, as far as I can tell, no other reason why my application was denied and I was only denied after they found out I am a single man.

    I'm not looking to sue. I just want to adopt a cat. I will follow the advice below and file a complaint with the Florida Commission on Human Relations, as this does appear to be illegal discrimination. Not just gender, but Florida apparently does actually protect marital status as well.

    Many of you suggested that I check Craigslist, which I did about an hour ago. There are six posts today of people in my city desperate to get rid of healthy kittens because it was an unexpected litter. I've reached out to several of them and will wait for a response rather than continue to try and jump through hoops to please these private shelters. Shame about the cats stuck in them, but if they won't adopt them out, nothing I can do. I don't care what kind of cat I get, so picking up any regular kitten is fine with me.

    To those suggesting there was something else odd about my application or that I "left something out": I haven't. I filled out their application which does not ask for gender and I told the truth on all questions. Afterwards, they e-mailed me to check my gender, and after finding out I was male, then they denied me. If you don't see why that certainly comes across as discriminatory, I don't know what to tell you.

    I have received over 15 PMs informing me that I should really adopt two kittens rather than one cat. If possible I will be doing that, but it really isn't up to me; it's whatever is available on Craigslist.

    My dad passed away in January and I just got a letter in the mail saying his insulin pump is being recalled.

    My dad passed away in January and his cause of death was low blood sugar. Today I got a letter in the mail from Medtronic stating that there was an urgent recall on his pump retainer ring. I'm only 21 and my parents are divorced so i'm the executor of my dads estate. Can I and should I file a wrongful death lawsuit and how do I do it. I'm so lost.

    [CA] Mom’s boyfriend wants to infect her with COVID-19, is there anything we can do?

    We live with him at a house we rent together (all three of our names on the lease) can't afford to move or get hotel room long term.

    Mom found out today that he is purposely going to the house of a woman with coronavirus and when mom freaked out he told her it was like chicken pox and she should just get it now to get it over. (He is a hardcore Trump fan and believes the disease is essentially a political thing).

    My mom is immune compromised and has an autoimmune disorder. She's actively taking steroids.

    We are terrified, is there anyway we can make him stop legally? Like making him quarantine somewhere else?

    School used child's picture on billboard without notice or permission

    Last year my children attended a Catholic School. We pulled them out after the school year because of concerns about the education they were receiving. The school was given notice that the kids were not attending this year over the summer break.

    Today I saw a billboard for the school which is a picture of my child and her friend. My daughter had to have surgery to correct a medical issue last year and was in a wheel chair for the picture. Her best friend is African American. It's pretty obvious this is some sort of attempt to promote the school's diversity. I was given no notice nor asked permission. I did sign a photo form last year but that was only for that school year. Any advice on how to go about having it removed?

    (MI) ex and her husband are nearing divorce, he is now threatening to "dump all her stuff" at my house.

    So the mother of my children and I are on good terms. She and her husband, not so much at this point. She called me this morning saying that he messaged her stating he will be getting a truck and dumping all of her, and her kids' belongings at my house. Background: her and I have two sons together, she has two daughters by other fathers but neither one her husband. I have custody of our sons, she has custody of her daughters.

    Her husband and I have never really gotten along, but we also have hardly ever spoken to each other (another story for another day perhaps).

    Obviously I don't want a bunch of stuff dumped at my house, and I'm trying to limit my involvement in their relationship as much as possible, to the extent I can without being ignorant of what is going on in order to shield my own kids from the drama/BS. I care for my ex, and am sympathetic to her situation, but not enough to want to disrupt my kids' lives and store her belongings for who knows how long.

    My question is, what legal standing do I have to stop him, or what would/should I report to the police if he actually follows through on his threats? Trespassing? Illegal dumping?

    How to stop a package from being delivered to my house once I realized it was illegal??

    Hello everyone, I recently had a manic episode and impulsively ordered a snail off landsnails.org. I later learned that it was an extremely illegal type of snail called a Giant African Land Snail (GALS). I'm 17 and am going through some legal stuff regarding my dad's arrest a few weeks ago, so it wouldn't be in my best interest to get fined a few thousand dollars to bring this dangerous animal to my house. It's already been shipped, so there's a few questions I wanted to ask:

    1) (main priority) Is there ANY way I can contact USPS, fess up to what I did, and get them to seize the package on their own without getting legally involved? My mom has no idea what I've done and I don't want her to be mad as our relationship is already tense.

    2) If there isn't (and only if there's no way of the above happening), what are the chances of the drug sniffer dogs alerting customs that the package contains this snail? If it's delivered with no issues, I'll have to take it to an animal shelter somehow, or kill it, as releasing it is not an option.

    3) If it's too late and the package is seized, what will happen? I need a response detailing the process. Would they just send me a "love letter" and never mention it again? Would my mom have to get involved?

    I've had multiple panic attacks regarding this situation and would appreciate any comments on my situation, thank you!

    (TX) "Dog visitation" causing problems with my ex husband. is it worth the trouble to get the agreement modified?

    I originally posted this in relationship_advice but I was advised to post here as well.

    my first husband and I separated in 2016 and our divorce was finalized in 2017. we had no children together, and few assets. almost everything was settled fairly easily.

    we had two dogs that we adopted during the course of our relationship. when we separated, he took one dog and I took the other dog. shortly after this, he decided that the dog was too much work and sent her (without asking me first, but that's only relevant because I absolutely would have taken her) to live with his parents. he ended up regretting that and wanted me to let him see our other dog.

    it ended up where, in the divorce finalization, a provision was made that one weekend per month he was allowed to see the dog. obviously, the dog being a dog, it's not a custody agreement but it's a provision of the divorce, similar to if, say, we had a beach house and we wanted to continue both using it.

    I generally just meet him at a dog park and he spends a few hours with the dog and then gives her back. no problem, except that he has gone off the deep end upon learning that I am pregnant with my new fiance's child. He made a nasty comment about it in person, and then started sending harassing messages on burner phone numbers and burner social media accounts (I have since deactivated social media).

    harassment wise I'm going to deal with that as its own separate issue, but at this point I'm thinking it's better for everyone if I don't see him anymore, even for the purposes of dropping off the dog, and I am considering having this part of the agreement modified.

    in this situation, is it worth trying to get the agreement modified? or is there some option I'm not thinking of? (rehoming the dog is not an option, she's 13 years old and has never, ever been away from me since she was adopted at 8 weeks).

    Someone has taken all of my mother's possessions out of her safe in her bank

    My mother and father has joint bank account, and they have a safe where my dad stored gold and money over the many years. The gold was primarily to help me getting married, according to my father.

    My father has dementia and he's not mobile anymore.

    Today (20th August) my mother went into the bank to check the safe and she found if be to absolutely empty! The last she went with my father was almost a month ago.

    She asked for the records, and the last time a person checked the safe was on the 4th of August and it wasn't my parents.

    What can we do regarding this?

    Shared driveway concerns

    In Tioga county NY. I'm in the process of purchasing a house from my girlfriends' mother. I'm living there now, and everything is great except our neighbors. 20 years ago or so the neighbors, then an elderly couple looking to not use their ¼ mile or longer driveway asked to use the driveway in order to shorten their drive home; which was verbally agreed to by my SO mother. 15 years ago the property was sold and the current owner kept using our driveway; which still isn't a big deal. Until he turned his one bedroom house into a two bedroom house; and now turned his shed into another house; he plans to rent these three apartments (and is renting two currently and I'm not sure he even has the permits?). I have little interest in sharing a driveway with three unknown families; and as he lets them have dirt bikes and quads those as well. I'm not sure whether the old driveway is usable, however I suspect it is at least a little because of said dirt bike trails. Should I just lawyer up? Confront the neighbor once I'm the owner? Not sure the best way to do it; because I'm worried that since they have used the driveway for so long maybe they are entitled to it.

    Mother won’t stop giving scammers money/gift cards (NC)

    Hey guys – my friend has an elderly mother who keeps getting scammed for thousands of dollars and refuses to do anything to stop it. She keeps getting phone calls and romance scam letters and is sending out incredible amounts of money because she is lonely and may have dementia. Is there anything he can do to keep her money safe? He has a revocable power of attorney and says that she will not get a dementia test (or that she is likely to pass it, I forget which). Any advice?

    My wife passed and I want to move please help me get out of my lease (NV)

    My wife passed away three weeks ago the day after our 43rd wedding anniversary. It has been very difficult for me I have never lived alone. I want to move to Montana to live near our son but I have nine months left on our apartment lease here in Reno.

    I asked the leasing office if I can break lease but the staff says though they are very sorry about my wife I am still responsible because we both signed the lease. They said they would try to find another tenant if I leave but they have a lot vacancies now because of COVID and they might not be able to rent it at all. They say if they can't find someone I'd owe for all nine months even if I don't live here anymore.

    I don't have money for a lawyer and I cannot pay two rents I live off social security and have not much savings. I don't know what to do how can I fight this I just want to leave but I feel stuck here.

    Neighbor or the pool company he used responsible for my flooded basement? Need advice!

    I do have an appointment with the attorney that did the closing on our home 9 years ago, I'm posting here to get some talking points and see if anyone has had any experience with something similar.

    Three weeks ago today our neighbor had a pool company begin work on putting an in-ground pool in. The first part included the excavation of the ground where the pool was to go. While they were excavating they came across an old clay tile pipe. It was draining water into their excavated hole so the pool company cemented it up. No one knew, and no one bothered to figure out where this water was coming from. I cannot confirm what day they plugged the pipe with cement, if it was the same day of the excavation or the next. I know the pool didn't go in until the next week. The day after the excavation I came home from work to two inches of water in my basement. Now it's not uncommon for us to get a trickle of water in the unfinished side of the basement when we get a heavy rain, but this was way beyond that. I went over to the neighbor and asked if it had rained hard that day and he said that it had rained wicked hard for like 45 minutes. I told him why I was asking and he was just like "whatever". We have never been on buddy terms with these people.

    So, I am starting to think that maybe all the heavy equipment on the lawn between our home has collapsed my drain pipe, my husband and I still didn't know what they had done with that pipe. I emailed the pool company and let them know what was going on and what I suspect happened. I get an email back stating there is no way that happened, have a good day. I emailed back that it was quite coincidental and how rude it was to blow me off without even considering it. I didn't hear back from them until that Friday which was approximately 11 days after they did the excavation. The email basically said, "We came across a drain pipe during excavation, it was draining water into our site, we cemented it up, you need to find the pipe at your foundation and re-route it." Period the end. Meanwhile, all of the wood paneling and no doubt the walls beneath it are soaked with water, the tiles on my floor are coming up, my husband and I are taking turns missing work to pump water out of the basement. We have had numerous contractors out and the cheapest estimate so far is $8k and that was to put a french drain inside my basement. I don't want to do that as a) it doesn't fix the pipe issue and b) they would have to jack up my oil tank and it would be just my luck it would break and I'd have oil everywhere magnifying my problem 100 times. We are still waiting on one estimate from the last contractor that came out last Thursday. He thinks they will be able to dig a trench and run that drain pipe to daylight and the back end of our property. They come highly recommended and very experienced, read $$$.

    I have heard that it is illegal to redirect the flow of water onto someone's property. I can say that drain pipe of ours was on their land, but at the time it was put in (1958) their house hadn't even been built yet and what is now their yard was probably the same parcel as our home. Their home was built 4 years after ours. I think there should be some liability on the pool company for just plugging up a drain with cement without bothering to find out who it would affect. Like, who does that? That had severe consequences for us. I do have my deed, I am lacking a current survey to show my property lines and I will be getting one, but can't really afford to do that right now. We have already spent about $2k with pumps and hoses and RotoRooter (that first night we thought we just had a plugged up drain), tons of topsoil to level out the yard, new bigger downspouts and various other things to try to keep the water away from the house.

    To say that I am stressed is the understatement of the year. Every morning I wake up I wonder how much water is down there, when I come home from work the same feeling of dread washes over me. We had remnants of that tropical storm Isais last week and that was a hell of a day. I pumped and vacuumed for 7 hours straight before my husband got home to take over. He pumped all morning before going to work then I came home to take over. We now have two submersible pumps on the floor and drain plugs in the drains but they only slow the water down.

    Does anyone have any advise or experience with something like this? Help!

    I let a friend crash in my apartment during covid, and after breaking some boundaries she WILL NOT LEAVE. Can I do anything?

    At the end of May I told a friend and coworker she can crash in my guest room as covid resulted in a massive pay cut for us both and her old roommate kicked her out. Since then, I have not asked her for rent, utilities, etc. She gave me grocery money once and takes my dog out sometimes when I'm not home. She doesn't pay anything, never cleans up after herself, and invites her boyfriend over whenever she pleases (which is where the real issue is). Her boyfriend freaks me out, they fight all of the time, he has comes and goes through all hours of the night, and as a 130 pound girl who's boyfriend isn't here during the day, having him in my house genuinely makes me uncomfortable and I told her I don't want him here. It is the one boundary I have given her since she started staying here, and she agreed to it. I had to work at 6 AM this morning, and we noticed his car in the parking lot. We found him asleep in her room. Turns out this has been a regular thing, he sneaks in after we fall asleep and leaves before we wake up. Long story short my boyfriend kicked the guy out and told my friend she needed to figure out something else. My issue is that I do not own my house-it's a rented townhouse with a leasing office and everything. In my lease it states I can't have anyone stay with me for more than 5 consecutive days or else I can be evicted (I didn't know this until I went back and read the lease, stupid of me I know). I want to call the leasing office, but I fear I can be evicted in the process. Same goes for calling the cops. She is currently locked in the guest bedroom and is refusing to speak to either me or my boyfriend. My boyfriend wants to deadlock our door and put her stuff in a storage unit, but I know that is of course illegal. Do I have any standing here? What can I do? EDIT: I am in SC. This happened today.

    The Post Office Is Threatening To Cancel My Mail Service Over My Upstairs Neighbor's Dog

    I live in Massachusetts in a four family apartment building, it's a four story house with a basement apartment and three floors, each floor has a different apartment. I live in the bottom floor, a walkout basement with the front door facing the street and our mailbox is right next to our door. The rest of the tenants have a common entrance on the side of the building via a porch and all the tenants except myself have their mailboxes on the side of the house next to their main entrance. About 9 months ago my upstairs neighbor (the one right above me) got a pitbull puppy. Now I had assumed she had gotten permission from our landlord or had extra apartment insurance or something because I didn't think our landlord would let a tenant have a pitbull because of the liability. The landlord had told me that if I wanted another dog then I would have to run it by him and try to get a dog around the same size as my dog that has passed away (<20lbs). In addition the person who own's the pitbull refuses to walk her on a leash and just lets her roam free around the neighborhood then she goes out on the porch screaming the dog's name and I mean screaming. I know she is probably abusing the dog or at the very least is mistreating it.

    My landlord came by 2 months ago to check on the progress of some repairs in our unit when he asked who in the building had a pitbull. I told him who the dog belonged to and he got very angry. I know he talked to the tenant with the dog. The dog magically disappeared for 2-3 weeks before the tenant brought the dog back to their apartment. Today I got a letter from the Post Office saying they are going to "temporarily suspend" my mail delivery because our letter carrier has concerns about the dog being loose when he tries to deliver our mail. The letter is addressed to my landlord and I don't know if all tenants received the letter or just me. I left a voicemail and email for the person listed on the letter and tried to get a hold of my landlord but no luck.

    It know it sounds kind of dumb but I need the mail service because I fill many of my family's and my own prescriptions through the mail, all my bills come in the mail, all health insurance and medical stuff comes to me through the mail so I cannot afford to have it suspended or cancelled in 10 days if the dog situation isn't remedied. I live in the inner city, we have a leash law ordinance in our City but there are no laws pertaining to pitbulls or other bully breeds. The dog seems friendly but that is not the point, this irresponsible woman is a liability to our property and now possibly will effect my mail service that I depend on for medication as I'm disabled. What are my legal options if the landlord won't take care of the problem and/or she refuses to get rid of the dog?

    Recently hired to work in an accounting office as a 1099, but my responsibilities and workload quickly changed. Would greatly appreciate some input from those more knowledgeable on the topic.

    I recently started working in an accounting office for a car dealership (part-time job just to save up some money until I graduate). I came on as a 1099, because my responsibilities at first were simply scanning documents into the system (which I would assume is outside of the ordinary course of business of the office.)

    A week after I started, a full-time employee quit, and management saw me fit to be the replacement due to my ability to work 30+ hours a week. For about a couple of weeks now, I haven't been doing any of the scanning documents, which is what the other 1099's are now doing. Instead, I am now doing just about all of the work which were the responsibilities of the employee who quit.

    To my understanding, now that I am essentially performing tasks which are considered part of the ordinary business of the accounting department, I shouldn't be labeled as an independent contractor. I brought this to the attention of the management and eventually had a meeting with them all; the outcome of that meeting resulted in them stating they're keeping me on as a 1099 because I don't plan on staying longer than a year.

    I understand where they're coming from in regards to how they want to keep people who intend on staying; however, they have no plans to hire someone else to take the position of the employee who I am now covering for since I am capable of doing all of the work.

    In summary, am I being taken advantage of by being kept on as a 1099? I'm sure they're saving quite a bit of money by not paying the salaried employee anymore and leaving me to pay the extra taxes.

    Wheelchair bound mother was just told her building’s elevator will be out of service for three months.

    Thanks in advance. I searched a bunch but couldn't really come up with anything solid. Basically, my parents live on an upper floor of a 6 floor condo in Maryland. They were just told that the elevator will be out of service for 3 months, effectively holding my mom hostage in her own home for the duration. Is there anything they should know as far as legal accommodations or anything like that? They're already worried about doctor appointments or emergencies, so I'm just trying to see what we should be aware of. Thanks again!

    Sellers threatening to back out 5 days before close

    Hey there my boyfriend and I just bought our first home, but as these things go there has been a lot of bumps in the road. For a little context the closing date has moved about 4 times, and we had to wait until they found a new home but we have been very patient with it and finally got a permanent closing date, we scheduled the moving date, I work from home so we had to call ahead to make sure we would have internet. It was all fine until the sellers requested to stay an extra week so they can get some cables, they let us know very last minute but we compromised told them they can stay an extra 3 days since we already have things scheduled, have work requested off and everything so we can get things set up. Now they have emailed our agent threatening to back out if we don't let them stay a full seven days after close, this is 5 days before close and contracts are already signed, are they allowed to do this?

    I’m at my end and need to make sure my wife and daughter are okay when I’m gone

    Without going into details I'm in pain, my daughters mom breaks the parental plan constantly, and I keep having bad experiences. This pandemic has not helped. I have tried to no avail to get help from the VA for over 10 years and things have just gotten much worse. I can't even get the medication I need and I'm tired of fighting.

    I have two rental properties, I'm a 100% disabled veteran, and collect SSDI. My wife has a terminal illness but has been unsuccessful in obtaining SSDI. She's been waiting for over a year after being initially denied.

    I'm tired of being miserable and in pain. I don't enjoy life. What paperwork can I do to make sure she has what she needs and isn't empty handed when I pass? Florida

    (CA) Property Manager has gone silent since promising to pay me to break the lease early

    This scenario began when I started my lease back in October of 2019. When I initially viewed the unit, the property manager, we'll call her Stacy, mentioned that the owners were interested in a nine month lease because a family member of theirs may move into the property. I said I would prefer twelve, but nine could work as a last result. One week later Stacy sent me the lease with a twelve month term. I signed this lease and moved into the property.

    Stacy messaged me on July 30th asking when I would like to schedule a walk through as my lease expired in one month. I politely sent her a screenshot of our lease, which clearly stated I had the premises until October 31, 2020. She went silent after this. She messaged me again one week later with pictures of another unit she was trying to occupy, saying she would help me with moving fees associated with the move. I politely declined as I was looking for something bigger. Another week went by with no contact, before I messaged Stacy requesting one month's worth of rent ($1,495) as consideration for breaking the lease. She accepted.

    An amendment that I drafted was signed that clearly states the following:

    1. The lease is amended to accommodate a August 31, 2020 expiration.

    2. Stacy acting on behalf of Owner will pay $1,495 within seven days of the full execution of the amendment.

    It has now been ten days since signature and it appears Stacy has no intention of paying. She has dodged my texts and my calls. I requested this money because I needed it to assist with an early move out. What should I do from here?

    Sold stock with my company, they didn't send me my money

    I'm wondering worst case scenario, what legal steps I can take outside of escalating within my company, to rectify this?

    So my company uses digital paystubs that we get threw a app and on my previous stub the first week said I worked 41 hrs and the second 47 and I made a report and notified the manager that overtime was not paid out on, the next paycheck comes and there are no compensations for overtime, and I check the paystub again now it says only 43 hrs worked instead of 47 I was not notified of any changes and have not brought it up with management. Also I took a screen shot of the original pay stub what should I do. Location Ontario Canada

    CO, US - got a notice from the courts about health insurance for the stepkids

    Hi, So, my company provided health insurance was cheaper and better than my husband's company provided health insurance, so once we got married I put my husband and step kids on my health insurance (allowed by my company.) Ever since then, his ex wife (mom to the step kids) has been bitching about it, even though our co-pays are similar ($25 vs $30) and our out of pocket expenses are lower and my husband and her split them as decreed by the divorce decree. We just got a notice that my husband is being taken to court over "not providing adequate health insurance" to his kids. To be clear, the health insurance I have had them signed up for for 2 years is comprehensive and includes all medical issues plus dental and eye care. It's the same insurance I am on and my own kids are on, and everything is covered albeit with a $2000 a year deductible for the whole family (6 of us now) which he splits with her if the boys need something. Does she have a case?

    I filmed a short film 4 years ago, and one of the friend who acted in it wanted everything deleted.

    Hello.

    Background:

    I'm from Arizona. I had a concept 4 years ago about a short film. So I asked a couple of acting friends to be in it. I was new to filmmaking at a time, so I didn't really know what I was doing. We made some mistakes along the day.

    Issue: It took me four years battling with procrastination and trying to fix the sounds issue. I finally finished the short film.

    So I decided to upload to YouTube as a private video so I can be sent it to everyone who helped me with the project. I sent to one of my actor friend who actually quitting acting. He sent me a long msg saying that he never agreed for it to be shared publicly. I'm not legally allowed to keep all the footage I had of him and demanded me to delete everything I have of it, all the scenes I have.

    So my question is, even I'm not planning to release any of them, do I have the right and legal right to keep all those footages?
