I don't expect her to ever repay the loan. The collateral doesn't cover the value of the loan and I'm not giving it to her until the loan is repaid.

Is there anything recourse to force her to give up the packages that were sent to my name but at her address?

Can she legally open the packages and potentially keep the items intended for me? Items were delivered by UPS & the USPS equally.

    Help! Thank you.

Upstairs neighbors keep dumping lighter fluid on my furniture. Do I have any recourse? Lake Elsinore, CA, USA.

    Posted: 27 Jun 2020 09:44 AM PDT

Writing for my fiance's sister and brother in law.

As stated, the upstairs neighbors periodically dump lighter fluid on my patio furniture. They have done a good job of avoiding me when I am outside but today I was out of view when they were pouring it. I peaked my head out and saw her holding a can of lighter fluid, and emptying it onto the couch, which she apparently had to lean over the railing to do. I asked why she was doing that and she quickly stopped and went inside her apartment. I have spoken with the management office and they document the occurances but i want this to stop, not just get written down every time it happens. They haven't stated whether they've spoken to the neighbors but if they have it hasn't motivated any change in behavior. In addition to the lighter fluid, they smoke on their balcony, which is overhead to my patio, and sometimes dump their ashes and cigarette butts, which have landed on the same furniture they're saturating with lighter fluid.

Are they violating any codes or laws by dumping lighter fluid on my furniture? Legally speaking, is there something the management office is obligated to do but is failing to? Is there something else I can do to help prevent future dumping?

    Thank you for your advice.

Update 1: Called the police and was informed that the property must be permanently damaged to file a report. They also were not concerned that it lighter fluid. They did open a file and stated they'd put notes in it so there was a record if we wanted to go to small claims court.

Registered Sex Offender wanting off registration list.... but is it possible??

    Posted: 27 Jun 2020 03:45 AM PDT

(Long-short version) When i was 18 years old i met a girl off a website (black planet.com). We met, hung out a couple times, met her parents etc. In the 3-4 months hanging out had sex twice.

I came over her house one night and hung out. Her parents were out of town. We got into a argument that night. I left and basically told her I didn't want to talk to her again.

Time passed. About a full 13+ months. I was driving and got a call from a detective. He asked about the girl. I had no clue because it had been so long. Eventually i remembered who she was. I agreed to come in and speak with him, in reference to the girl.

The detective asks me a bunch of questions about me and the girl. How did y'all meet, how long did y'all date, did you guys have sex etc etc. I had no reason to lie about anything, plus i was unaware of any issues between me and the girl. I let him know how we broke up and that she was mad. At the end of the conversation he informed me that the girl i had been "dating" was 14 years old and she is saying i raped her! (Never have I ever felt my stomach and heart drop at the same time!) Our whole conversation was recorded.

They didn't take me to jail or anything at that moment. I went home and was scheduled a court date some months later. After speaking to my lawyer he explained that the girl was underage. She had me over her house and got in trouble by her parents for having company. The girl got scared of her parents so made a story up that i came over and raped her, in order to prevent her getting a butt whooping for having company. But what makes it so bad is that she's underage!

After court and the findings the prosecutors realize there was no rape. It was consensual, but not really because she was underage. I was at fault for having sex with a girl whose age and ID i failed to confirm. The case would of been dropped but I basically incriminated myself by telling the detective we had intercourse in our meeting that was recorded.

My punishment was "Misdemeanor 4th Degree Sexual Assult of a Child" I got no jail time, 1 year probation and did not have to register as a sex offender..... is what i was told.

I later moved back home to Texas where I'm originally from. Smh. I was unaware of the "different" laws in each state and the fact that I have to register. I now have (2) Failure to comply with registration requirements - both felonies, i also have to register for a lifetime as a sex offender. This is because my address wasn't updated in a timely manner on two separate occasions in the 19 years of dealing with this. I am now 37 years old! !

Life is extremely tough as a sex offender!! I do take responsibility for my actions at that age. The girl did not act or look 14 years old. At 18 I never thought to ask girls for ID.... shoot i was nervous even catching eye contact with girls!!! I was young myself! Smh... I don't want to get into the depression part of things, but this whole living as a offender thing isn't fair. I don't think mistakes as a kid should hinder your whole life, for eternity! But I want to have this revisited with a lawyer and get off this registry!! It's ruining my life and i don't know what to do. Do you think i have a chance?

Mail is being withheld from us for a “dangerous dog hold” on a dog that is no longer living.

    Posted: 27 Jun 2020 12:31 PM PDT

This may be long winded so I'll add a TLDR at the end. This has been an ongoing matter for about a year now. Initially, we got a red card in the mail saying "dangerous dog, mail withheld" on a dog that had been at our residence for 10+ years. For whatever reason, the carriers decided the dog was too vicious and asked us to move our mail box away from the door (2 inch thick wooden door WITH a security screen, just as the postal service mandates) even though there was no way of him getting out. So, we complied and moved it to the fence along side our driveway, about 5 feet from the public sidewalk. All is well and we continue to get mail. Then, about 4-5 months later, our dog dies (old age, RIP). We kept our mailbox in the same spot UNTIL we noticed mail and packages going missing. Presumably they were stolen because of how easily accessible the mailbox was at this location. So we moved the mail box back to its original spot that it had been in since this house was built in like the 1940s. Again, all is well until about a month later, we receive ANOTHER "dangerous dog" notice in our mail box with no mail. We go to the post office to speak to the post master and ask "what dog are you referring to?" and we couldn't get an answer. They just keep saying "move your mailbox". We tell them ma is being stolen but they don't care. Now the post master is being deliberately rude. We've spoken to multiple people including the post master and consumer affairs and they keep saying "we'll have to come to a decision". The dog is literally in ashes. There is no viable reason to withhold mail on a dog hold for a dog that doesn't exist. So now, we have to go to the post office multiple times a week to pick up our mail, during a pandemic I might add. Sometimes they can't even find it and we have to come back another day. But here's the part that really set me off. This morning I go in and pick up a weeks worth of mail and I'm going through the stack and I find a bright yellow card that has our address on it, in bold letters on the bottom it says "do not deliver this card" so it's obvious this is for the use of the post office only. On the back of the card, written in marker in all caps its says, "DOG HOLD FOREVER LOL". It actually says "lol" at the bottom. Someone very obviously made a mistake by letting this get lost in my stack of mail. This proves to me that this isn't a legitimate issue and they are just being petty for the hell of it. What can I do here? I refuse to move my mail box and let my mail continue to be stolen. What is my next step to get this resolved?

TLDR: Mail withheld for dangerous dog. Dog dies, mail still won't get delivered. Petty note found in mail when I l picked up the mail from the post office. Consumer affairs and post master are not solving issue.

Forced Retirement Per Company's Words - Discrimination?

    Posted: 27 Jun 2020 07:14 AM PDT

Happened in Illinois for the record...

My mother (upper 60's) worked at an office job for the last 25 years. She told me she's never been disciplined by the company and performed her job up to the company's expectations. A couple of weeks ago, she was told she was being discharged. The reason given, and the company actually wrote this on the discharge document, "Jane is retiring." However, my mother never informed her company that she was retiring.

Basically, what happened was the company interviewed another individual that was about 15 years younger and decided they wanted to hire her. Rather than be decent humans and offer my mother a few months of pay in exchange for her voluntarily leaving the company, they forced her out of the job with one week of notice. The company went on to hire that individual that they interviewed at a higher salary than that of my mother.

After catching wind that my mother wasn't happy and felt discriminated against, one of her bosses actually called her at home and began to try to appease her (which to me almost seems like an admission that they might have messed up).

Now my mother is toying with the idea of taking action against her former employer. My mother isn't vindictive and expecting $500,000, but she does feel wronged. She told me she'd drop the matter for about 6 months of her salary.

My question...is this an example of age discrimination? If so, what course of action would you recommend? Speak with her employer directly and ask for a few months of salary in exchange for dropping the matter? Going to the EEOC? Speaking with a lawyer? Thanks!

Am I Responsible For a Single Bed Bug Found In My Apartment? (Michigan if that's important)

    Posted: 27 Jun 2020 10:22 AM PDT

A few months ago I found a single bed bug in my laundry basket it was un-fed and could barely move, this made it easy to capture. I took a picture and sent it to our land-lord, he came by to verify and had an exterminator come by two days later. When the exterminator he asked us if any furniture was new, we told him our couch was new, and he proceeded to check it along with the rest of the furniture and their crevices. He found absolutely nothing; he wanted to spray so we complied. Before we left the apartment for three hours, I asked the exterminator where he thinks the bed bug came from and he said "It probably hitched a ride on someone outside and ended up in the laundry room, where it then found it's way into your clothes".

A few weeks later the building manager sent me a text saying that the exterminator would be coming back in a couple of days for a second inspection. When he arrived he was not alone, he was with our land lord. After the exterminator re-checked our furniture and found nothing, the exterminator said he wanted to spray again and the land-lord not the tenant gave him the go ahead to spray again.

Fast Forwarding to the beginning of June, I get a bill for seven-hundred and five dollars. Five Hundred for the pest treatment (the two treatment sprays, one forced by the land lord after nothing was found), two-hundred dollar service fee to the apartment , and a five dollar late fee for every day late even though this was my first time seeing this bill (its much higher now).

Now this is where my lease comes in. Under the section titled PEST CONTROL it says:

" The community is being treated on a regular basis. You are asked to assist pest control efforts by maintaining a high standard of good housekeeping. Residents with pets must pay an additional charge for de-fleaing. Bed bugs, fleas, cockroaches that are found in the unit or surrounding units and/or common elements of the property are to be treated at the resident's expense. "

If I'm responsible for treatment then can the land-lord request the exterminator to spray at my expense if nothing was found? The building manager has also told me that I'm required to pay because the exterminator determined the cause was my couch (even though he found nothing twice and previously said the cause was the laundry room). Also the lease says nothing about a $200.00 service fee (the apartment company literally did nothing). The property is also not treated on a regular basis. Can I fight any of this? I had a hard time finding what Michigan State Law says about this issue.

Also thank you in advance for answering my questions.

Less than a month ago I got a security system from a company well know that starts with V. Last night around 1 AM - 3 AM, my truck was broken into and tools were stolen. I call to get the footage but they can’t since they can only send me clips when someone is detected. The Rep told me otherwise.

    Posted: 27 Jun 2020 12:20 PM PDT

    I'm located in Texas

Going to the beginning of the day I get the system.

A Door to Door rep comes to my house and give me info. I told him that I was looking into a system that records not only through clips but if something happens that isn't caught , that I can go back and look it up and retrieve of the cameras don't detect something. The rep assured me that I can talk to a rep on the phone and they will send me the times requested to my email. I said that's great and I signed up.

Everything went well with the installation and has been great until a couple of minutes ago.

I talked to customer service through a chat and asked for the footage from 1 AM to 3AM and I was told to check on my system for clips, I told them that nothing was recorded during that time and that I need to get those hours retrieved. I was told that that would be impossible since the cameras only record when they detect someone nearby. I told her what the rep told me and she straight up told me he lied about that. I asked her if she can give me a number to end my contract over false pretenses and she gave me a "loyalty number".

I call the number and I getting offered a life alert type device and auto repair insurance. I told them that I need to talk to someone who can help me cancel my contract and they would hang up. I called multiple times and the same shit happens. On my last call, I demanded to talk to someone or I will file a complaint to the FCC and they hung up on my and blocked my number! I call and a voice message tells me that the number I am calling is not available in my area?! How?

So other than actually filing a complaint to the FCC, what else can I do?

Police officer contacting me on Facebook.

    Posted: 26 Jun 2020 09:58 PM PDT

So, today I was walking my dog and a police officer drove up beside me and asked for my ID and questioned me, because he said "I was walking near the tree line". I was, but it was a public area and I didn't do anything wrong (as far as I know/knew). As I was walking back home I made a Facebook post expressing my irritation. It was pretty mild but rather sarcastic (the sarcastic part read "thank you for your service, heros"). The officer, must have looked me up less then an hour after I posted this, and said it was private property (I don't think that's true but he never mentioned it to me in person). And ended his comment calling himself "your hero". I called him a moron in the comments but I don't know if he read that before I blocked him but he probably did. It was dumb to post this on Facebook but am I going to be in trouble for it? ((Super-sorry about all the spelling and grammatical errors I hope this is legible)). EDIT: I called my local police department. The officer who answered said that because he committed on my post he didn't directly contact me. He refused to agree that it was odd (just saying "I haven't done it myself but"...) and basically because I was complaining, the officer was fine to look me up and contact me.

Coparent not using her custody time

    Posted: 27 Jun 2020 11:25 AM PDT

I am a stepparent of 2 girls. I'm a stay at home mom to 2 of my own biological children as well. Because I'm at home, my stepchildren's mother often wants to use me for child care. She does not offer to pay me. Parenting plan states that custody is to be split 50/50 between her and my husband, with alternating weeks.

She wants me to watch the children on her "weeks." Because of her work schedule, this results in her dropping the kids off at 6am in the morning and picking them up at 6:30-7pm. So basically even on her "weeks," it is still the responsibility of my husband and I to get them ready for school, take them to school, feed them breakfast and pack them lunch, pick them up from school and feed them dinner. She comes and picks them up as late as 7pm sometimes and just puts them to bed, after all feeding and childcare responsibilities are taken care of by my husband and I.

In my view, when we have them from 6am - 7pm on her "weeks," then we are the ones with full custody, not split custody. What should we do here? Im happy to have the kids but I believe she owes child support because we have an astronomical food bill.

To sum up: stepkid's mom actually drops them off with us for 12+ hours on her custody weeks, but claims to be doing 50/50 and therefore doesn't pay any child support.

    Edited for spelling.

My Uncle Raised Funds for my cousin and brother using gofundme and has not distributed funds

    Posted: 27 Jun 2020 10:11 AM PDT

    Good morning all,

A few months ago, my grandparents passed away. My grandmother's son promptly set up a gofund me account for the "education expenses of the grandchilden". 4/6 of us have attended college, I have a 20 year old cousin and a 21 year old brother who are currently enrolled in Summer school.

I had kind of forgotten about the funds until a few days ago, when it occured to me that I should ask my uncle about them. I was told there was 4k in the fund and to send receipts so they could reimburse us for whatever was spent. He said he needs receipts to "keep things transparent".

This kinda seemed off to me. I thought that gofundme funds are treated as a donation, and that money is distributed to the intended recipients with the assumption that the funds will be used appropriately. When I brought this up, he stopped responding. I sent him a receipt for my brother's Summer school tuition for $1200 and still nothing.

Should we report this with gofundme? Is it legal for him to hold onto this money and just distribute as he sees fit?

    Thanks for any input.

PA - is our eviction legal?

    Posted: 27 Jun 2020 06:16 AM PDT

    Location: Pennsylvania

I am a working adult living in a college town with two roommates: another working adult and a doctoral student at the local university. The town we live in only allows students to live in off-campus housing specifically zoned for them. Our landlord assured us (in writing) that he can have grad students on his property, and her application also said that she was a grad student. Well, long story short, it turns out he cannot have any students as tenants. The university found out, reported it, and he was levied a fine of $400, but it was a one-time fine and the town did not say he had to evict us. We are not in any sort of violation of our lease. However, he posted a notice of eviction on our front door. We've been model tenants and it was his mistake/flat-out lie, plus he said he plans to keep the security deposit to cover the fine (the deposit was $2400, fine was $400) and since we've already paid July's rent, he's keeping that too even though he's trying to kick us out ASAP.

So the answers I'd like responses to are

    1) Can he evict us?

    2) Can he keep our security deposit and July's rent?

Upstairs neighbor evicted, flies from their apartment coming through my vents.

    Posted: 27 Jun 2020 06:01 AM PDT

After coming home from work yesterday I noticed I had about 25-30 large flies spread between two windows in my apartment. I called the maintenance guy to look at it, he knew right away it was from upstairs. He showed me their empty apartment that reeked and had probably 100 flies in it. He opened the windows so they could escape but didn't help me with my issue. I had to kill and clean the mess. It didn't stop though, I woke up this morning to find another set of flies in my apartment. I don't leave food out, and clean every other day. I don't know what to do, it's disgusting having this many flies in my apartment. Is there anything they should be doing about this? I live in central FL

Collecting a money judgement in divorce - how can this be collected? Washington State ex lives.

    Posted: 27 Jun 2020 09:18 AM PDT

My daughter received a money judgement in her divorce back in Dec 2019. She didn't ask for maintenance (she could have, but didn't want to deal with his lying, cheating, and other issues). Property was divided. No kids. Non contested. He gets disability from the military (if you saw videos of him at the gym, you'd wonder why he gets it) - I know you can't touch this ... I'm former military too ... and would never consider it. He was working but got fired just before COVID hit. He moved recently; we were able to track down the new address by requesting mail to be returned and not forwarded. He is in Washington state, she moved closer to us in a different state. How do we get the money judgement payments started? There is a 12% interest written in the divorce paperwork. It doesn't state APR, etc. I'm guessing APR. I also figure this money judgement expires is 5-10 years depending on the state. Thanks for any advice!

    Medical Debt Collection Question

    Posted: 27 Jun 2020 10:29 AM PDT

I found a collection on my credit report that appeared suddenly that hadn't been there before. They state that the account was placed in collection in February of this year but it was reported only on June 15th of this year on my credit report (as to why I didn't recognize it). It was a medical collection but it was listed as belonging to someone (the creditor)and for an amount I did not recognize. When I contacted them by phone, they refused to give me information at first as to what the collection was for. When pressed, they told me it belonged to a hospital, which upon research, that has been shut down for two years. They state the debt is from 2014, but I have no way of contacting the hospital to verify. There is supposed to be an email system that you contact to receive your past medical information but I haven't had any success with reaching anyone related to the hospital. What should I do next? Should I send them a request or something of that sort for verification on the debt and what it is for? (An itemized list of what I had apparently been charged for, what date the account became delinquent, when the last contact was made with me, etc). They offered me a settlement on the debt but I told them I can't make a decision without verification or the settlement offer in writing.

Any advice? My location is in Ohio (edited because I forgot to mention that).

401k loan defaulted by HR, now I got tax document as an early withdrawal, what do I do?

    Posted: 27 Jun 2020 12:01 PM PDT

Asking to see what can be done on my end. Located in Southern California

Been with the company for 4 years and I had an internal transfer between sister companies, let's call company A and B. I took a loan in 2017 to purchase a home against my 401k from company A. In 2018, I got a promotion for a role with company B. I was told all my benefits/ 401k/ seniority/ stock options will transfer with me.

Fast forward, I recently left the company and called the 401k plan to pay off my loan balance to find out, my company defaulted on payment in 2019, they tried to reach out but did not receive any communication, therefore, issued a 1099 as an early withdrawal of 401k.

Is there anything that can be done? I want to see if it is possible to get the money back into my 401K and I pay off the loan balance. If there isn't anything, what actions can I take for my previous company to not properly administer the plan?

    Thank you!!

Can you talk to a criminal attorney if the crime was committed against you and the police won’t do anything?

    Posted: 27 Jun 2020 11:58 AM PDT

    MA is the state.

So my father found out that his wife of only one month over a year ago pretended to be him to get the DMV to give her his driving records. She used a fake email which is directly connected to her email and left it up on my dad's laptop a few days ago. She also is monitoring his credit and has been since 2018 when they first got together. He saw the credit monitoring and that's when he started to snoop and forwarded all this stuff to himself. He went to make a police report and they said that the detective is out and theyd call him later. He never gets in contact with him.

I guess that she has a squashed case that this would effect too in another place.

There's also stuff about using PayPal to pay drug dealers for Aderall but that's another story.

Can he contact a criminal lawyer to ask how to proceed or do criminal lawyers only protect others in criminal cases?

Sorry if this is a dumb question

Middle Age Man Harasses and Tries to Run Me (16) Off the Road

    Posted: 27 Jun 2020 01:28 PM PDT

I am still very shaken after this encounter and my mind is absolutely racing. I have no idea who this man was and this was my first experience with a person harrassing me on a bike. It's common for bicyclist and motorcyclist to be harassed but this just went too far.

I am doing a summer online course for gym, we have to do 2.5 miles, 45 minutes, 18 minutes per mile at the bare minimum for all workouts. So I have been going on bike rides and I usually get huge support, I stay to the side of the road, people honk and give me a thumbs up out of their window and it's a great interaction all around. Sometimes ... People are not so wonderful ...

How my city is constructed is a little tricky, there are a lot of new places being built so many sidewalks are blocked off so, as a technically legal vehicle, I drive my bike on the road as fast as I can. I had been biking for over 6 miles and was less then half a mile away from my home where I see (if I'm remembering correctly) hey beige Honda Accord, maybe from 2012, roll down his window and yell at me.

"GET OFF THE ROAD! YOU'RE NOT ALLOWED ON HERE! GO ON THE SIDEWALK!"

I peak into this man's car and see a little girl in his passenger seat absolutely red in the face. He is driving right next to me slow and glaring for I yell back, "WHAT I'M DOING IS LEGAL, LEAVE ME ALONE!"

I speed up to the stoplight hoping I could make it and leave him at the light, I did not. This guy drive next to me again, "GET ON THE SIDEWALK!"

I was so scared at this point, I am definitely more a fight than a flight when I'm scared, "F*** OFF!" I keep peddling. The one thing racing through my mind is go faster, go faster, he'll need to get off eventually. He starts weaving in and out of my lane and his and if he's trying to freak me out it is working. I really and trying at this point to pedal FAST.

This dude starts speeding up and so I think, "Oh thank God, he got bored." Nope.

He starts hanging his phone out of the car and is recording me. When he passes I flip my good old friend the bird and he gets excited and turns the phone towards me. I put my hand back on the handle bars and pedal very hard up an incline at this point. There are other drivers going the opposite direction that see me flip him off and his phone. I even saw one guys eyes widen but that might have just been my tired eyes.

Finally the guy gets off at the exit and I keep going straight. I already and I plan if he started to follow me home there's a giant church near it so I'd go to the church and go inside and hopefully then he'd leave me alone. Thankfully that didn't happen.

I really do never want to meet this guy again unless it is in court. I couldn't get his license plate but if anyone finds a video online of a young girl (16), short brown curly hair, yellow shirt, blue jean shorts, white tennis shoes on a blue & black bike, PLEASE comment down below the link so I can get this man's name. I want to press charges for him driving below the speed limit, harrassing a minor, on his phone while driving, and video taping a minor without parental permission. I truly don't want him getting away with scaring the living hell out of me & putting other drivers in danger.

Do I even have a case here???

Am I facing legal troubles if a client lies to me about owning a site/account they want tested?

    Posted: 27 Jun 2020 11:50 AM PDT

I'm talking about vulnerability testing and account recovery primarily.

There's one job where I get my work from that is obviously an attempt to steal somebody else's FB account. The thing is, I do perform legitimate vulnerability assessments and fix website security.

That obvious job has me thinking about jobs that look legit. Some clients are not keen on paperwork. It's an inconvenience in some cases for them to have to run to a fax and such.

So this has me thinking, are messages enough to cover me legally? Say a potential client reaches out to me and the site we use saves all messages .. Say the client seems honest and wants me to assess "their" site but after performing the job they use the information gathered from "their" site to do something malicious to the real owner. Can I then get in trouble for that?

I'd imagine (or hope) there's some sort of protection. In the modern world a lot is done online and without ever meeting so you're just stuck taking their word.

I've never had any issues. A lot of the time I can verify an owner (unless they are just pretending to be them and knows some personal information) but others certain things are hidden like even a site owners name from WHOIS and such.

Personally this has me thinking that no matter how a potential client reaches me, I reach back out through the website to double-check the site owner actually wanted their site checked or hacked and updated to prevent actual hacking. Even that however doesn't have me feeling completely safe, hence this post.

    I'm in Colorado, USA.

Thank you if you have time to answer. Thanks anyway for looking.

    Landlord Tenant Law help

    Posted: 27 Jun 2020 01:23 PM PDT

I had physically vacated my apartment and moved elsewhere. My landlord did not allow me to break my lease, but instead said if he found someone then I could. He allegedly found someone for the month of June so the last time I paid him rent was for May, but like I said I had physically moved at this point and my landlord was aware of that. I am convinced that someone moved in on May 15 because during this time I was still responsible for the utilities and my utility companies informed me that on May 15 they had been moved over to someone else. I was not going to mention it to my landlord because he did allow me to move out a month early, even though he makes more money now, however, when I asked for my security deposit back that was $1100 plus $300 for pet, I only received $180 back.

I want to make a small claims against him for the half of the month's rent, but I am unsure of what my legal rights are to the apartment if I physically moved out but legally was still paying the rent.

This was located in Philadelphia. I am not currently located in PA anymore.
