[Advice] How to handle bad faith with our homeowners policy? Posted: 16 May 2020 12:53 PM PDT My boyfriend bound with an insurance company in January of 2019. On a call afterwards with his agent, he asked the agent to add a sump pump and sewage backup endorsement ($30,000 limit) to the policy, and the agent said he would add it, no problem. So, here we are, with a flooded basement due to sewage backup. We're going to need a new washer and dryer, furnace, and possibly a water heater. We cleaned everything else out in a hurry to avoid further damage but the water came in fast and reached about a foot and a half. I will also add that we were told that there was a blockage in the sewer system in our city and this has happened to many others. Our neighbors house flooded too. So, I looked over the policy last night and didn't see the endorsement. He called his agent today, who also looked at the policy and didn't see it. My boyfriend thought he had been paying for it (because the agent said he would add it) but he hadn't been. The agent doesn't remember the conversation ever happening. He told my boyfriend to tell the adjusters what happened and that when they called them, he would tell them that he didn't remember saying he would add it. I specifically remember my boyfriend telling me that he added it for $30,000. Do we need a lawyer? I work in insurance, but I'm new to the business and don't work in homeowners. Any advice would be appreciated. TIA. Edit: We are located in Ohio Edit 2: We really like this agent. He's a great guy and he's honest, and we think it was an honest mistake. It's most likely that he got off the phone and just forgot about it Edit 3: I have been corrected that this is E&O, not bad faith. My apologies [link] [comments] |
Posted: 16 May 2020 03:27 PM PDT Hello, Every few weeks I have to make a trip to discount tire, due to there being so many nails being dropped in the residential area of my new community. This occasionally leads to having to purchase a tire, which adds-up, along with my neighbors having to do the same. The builder argued it is just a "way of life" until they complete the last phase. On an email thread, the builder acknowledged, "The nails that end up in the streets away from the active construction sites are a by-product of our cleaning process. Our workers scoop up trash and material in the buckets of their bobcats(a construction vehicle) and then have to transport them to the dumpsters around the community for disposal. Unfortunately, nails can fall out during this transit process. I would imagine that is the cause of any nails you see in the street on Mimi because we completed construction on that street over a month ago." My long winded question: With this acknowledgement that the nails are being dropped by them, is this sufficient evidence to make a claim with my insurance, to go after the builder for costs of tire replacement? Thanks for your time! [link] [comments] |
My landlord is requiring me to add them as Additional Insured on my renters insurance. Posted: 16 May 2020 05:30 PM PDT I'm currently renting in VIrginia. We've already been renting for a year and signed a new year lease a month ago. I've already seen a few posts with this scenario and still fail to understand why I'm being asked to add them onto my renters insurance. She is not asking to be added as an "additional interest". She is specifically asking to be "additional insured". She mentioned that HER new insurance requires me to have her LLC listed on my policy. This is not a requirement specified in our past lease or new lease. Furthermore my renters insurance advises against it. What do I do? [link] [comments] |
Shopping for car insurance for a friend; prices seem outrageous, details in post Posted: 16 May 2020 11:58 PM PDT -97 Mitsubishi Eclipse Base non-convertible -1 year old license -no accidents -no prior insurance (first car) -19 y/o male -parent policy out of the question Prices seem to be hovering around 3.6k/6 months for minimal coverage required by law in Louisiana (priced through progressive, liberty mutual, Allstate, and Geico) Now I know it's gonna be expensive, but holy hell $604 a month is insane, right? He's gonna end up paying in 3 months nearly double what he paid for the car. Anyone got any suggestions on how to move forward? [link] [comments] |
CANADA: Auto Insurance Premium took a massive jump. Need help with a few questions Posted: 16 May 2020 10:59 PM PDT So my car premium has just recently been increased by a good $1300 amount. I called Desjardins and told me the reason is my driving record. Tickets were issued in 2018 but they didn't increase my premium in 2019 and idk why. I think I drive decently and the record of my driving of 3 years with above 125k KMs isn't that bad. So far, in these 3 years of my Canadian Licence I had only 2 traffic tickets. One for speeding on 55 at a 40 zone, Second for Disobeying Sign. And btw my "Disobeying no-uturn sign" ticket is reflected on my record as "failed to proceed on green light." I still have the ticket so clearly it's a mistake on City's end, is there any way to get it corrected? Also I wanted to ask, Did anyone else faced same kinda premium increase because of tickets??? Due to both offences on tickets, am I considered as dangerous driver by insurance?? Is the amount increased justified? [link] [comments] |
Can I receive compensation for clean up and trees that may die later? Posted: 16 May 2020 06:51 AM PDT Intoxicated driver slammed into two mature trees, mailbox and damaged a fence. The force of impact cast glass and plastic debris 100+ feet from impact. I've spent the past two days shop vacuuming my lawn and calling arborists. Can my time in orchestrating repairs be compensated by driver's insurance? This happened in WI. Any advice on how to pursue compensation if the tree dies years after the incident? Thanks everyone! Body Shop taking too long... wanting to bring car to another shop Posted: 16 May 2020 04:28 PM PDT Hello before I begin this may be a long one but right now I am in a bit of a pickle when it comes to options for my car. I will try to keep this as short as possible. - Accident occured 03-31-20 - Tow truck driver I insisted I take vehicle to their body shop (big mistake) - Shop has not performed repairs since car has been there Basically I am regretting my decision because my car has been there for over a month and no work has been done on it yet as far as I know. The car has been sitting on a lift for the time being and they said they can't get it off the lift unless it has the wheels which makes sense (how did they get it up there in the first place?). They tried ordering the wheels and tires 4 times and each time they canceled. However, I've been trying to work with them saying I can bring my stock wheels that came with the car since I crashed with aftermarkets on, but they never called to let me know it kept getting canceled, so I could bring my wheels to help make the process faster. On top of that I got 1 update over the course of a month and a half at where they were at since I am self-conscious about being "annoying" and calling so I just texted. I only found out the info above when I went during work (5/15) and went in person before they told me everything. I want to know what action I could take to take the car out of this shop and send the work over to another. Insurance already sent an estimate(check) to the body shop and I'm not sure if it's too late. I do doubt they have all the parts ready such as the panels that need replaced, suspension, and wheels & tires (obviously). This is my first every accident so I didn't know what to expect and when a tow truck driver recommends their shop it's a big no, but I had no clue what to do. I was already shocked from the accident and this situation puts big stress on me. Would I have to call my insurance agent (State Farm) to tell the shop to stop performing repairs and do another estimate for another shop? What options do I have? At this point I doubt I would trust their repairs either and I would much rather have it taken to another more reputable body shop. Edit: Location Houston, TX [link] [comments] |
Posted: 16 May 2020 05:44 PM PDT My vehicle was stolen and after a month I settled with USAA on the final value. They cut a check a week ago to the lender who has not received it. USAA says 5-10 days for the check to arrive and the lender is saying 5-10 days to process. If the vehicle is found in this almost month after settlement are they going to void the check and elect to repair? Thanks! [link] [comments] |

Car accident insurance question... Posted: 16 May 2020 11:53 AM PDT Hey guys/gals, hoping you can help me out with my question. My SO recently got into an alleged at-fault accident where she rear ended the person in front of her (bumper to bumper traffic) and that person hit the person infront of them. Unfortunately, my SO had terrible insurance with only $10k personal property coverage. Her insurance company had covered their part, but the other party's insurance company is now asking my SO for the remaining $12k. My SO doesn't have a job, or any assets. Is it possible to not have pay that bill especially because she can prove insolvency? What is her liability looking like? Can she be sued? Thanks in advance for your help. EDIT: We're in California, USA. Thanks for the replies folks, I appreciate the feedback on her situation. [link] [comments] |
