Posted: 30 Mar 2020 06:29 AM PDT We live in Western New York and while the backstory to why is a bit long and drawn out, though not pertinent to the situation at hand, according to our divorce agreement that was signed in 2014 I get to claim our children (there are four children) on my taxes each year even though I'm the non-custodial parent. Her financial situation as far as I know is that she doesn't work and only gets my child support and disability checks as she has epilepsy. This week with the Covid-19 stimulus going on she apparently started looking into tax return law and found out about form 8332 and is now wanting me to re-file my last 5 years tax returns so she can file and claim our children. I was vaguely aware of the form, but mostly in that when filing (on TurboTax) it would mention either needing that or an agreement, written or oral, thus I figured I was okay with just the divorce agreement. She says that that isn't so and that she intends to force me to refile, etc. so, I guess the question is am I basically screwed? Or is it possible I'm in the right on this? Thanks. Posted: 30 Mar 2020 12:53 AM PDT We have video evidence of the husband keeping watch while the wife goes to a blind spot (installed new camera at the blind spot) to put things into her bag, she always leaves first while the husband either puts things back that were in the cart or buys 2-3 dollars worth of items. Don't really want the police involved and they are apparently not responding to certain calls. I dont want them to sue us or something for defamation.. Thanks! Edit: Thank you all for your inputs! I will go ahead and make a police report on this matter. The reason why I didn't want the police involved in the first place is because of "culture" and I'll just keep it at that to keep our store anonymous lol because anymore description I think the locals here would know.. (not that it matters too much, but still would like to keep the anonymity) But after reading your posts and messages I think the best thing to do here is just getting the police involved! Posted: 30 Mar 2020 02:59 AM PDT Own a small art business in a large building and the building owner has shut the building down due to COVID19, but is charging everyone full price rent during this time. This doesnt lass the "sniff check" for me, and I wanted to ask if I had any grounds to insist on lowered or prorated rent. [link] [comments] |
Posted: 30 Mar 2020 07:52 AM PDT The company that I work for has been lucky to be on the list of businesses allowed to remain open in PA. It's a small business, about 20 employees in total. Due to this whole shut down, we are falling behind on our payments to our suppliers, and the owner is trying to get caught up on that by taking our stimulus checks when they come. He is saying we are all still working and getting a paycheck, so we "don't need" the extra money and instead he wants us to turn them into him. Is this legal or something that he can do? I obviously do not want to give up the money! [link] [comments] |
Posted: 29 Mar 2020 07:53 PM PDT Location: NYC Hi All! If this does not go here, I would greatly appreciate being pointed out in the right direction. I'm an ICU Nurse in at a major NYC hospital. I love my job and am very grateful to be doing my part in this time of need. I am going to spare you how awful it is in the hospital systems right now as that will be a post for another subreddit. What you see on TV is a very watered down version of what's really happening. However, it is getting so bad where I feel like the hospitals are pulling some illegal moves. Like I said, I work at a major NYC hospital that stretches across all the boroughs. Let's call it "City Hospital." I work at the Main Campus. They have "City Hospital of Brooklyn," "City Hospital of Queens," "Downtown City Hospital," etc. They are all associated with each other. As a nurse, I signed up to work in the ICU Main Campus. We are unionized. Per Union Contract, our float district consist of different units within "City Hospital Main Campus." Well today we found out that one of the affiliated hospitals outside of our borough has 30-40% of their staff out sick and now they are "floating" us to that hospital to staff them. They are not reimbursing for travel and we are getting paid the same amount. No one is happy about this. Yes, we all need to come together and help out but we literally did not sign up for this. Yes, there is a lack of PPE and this hospital has none. My question is: Can they legally send us to work at another hospital that is affiliated with us even though we do not have a signed contract with them? Can we demand Hazard Pay since we don't work there? I'm more concerned with the legality of sending us over pay. More info: The Union is aware and says that the hospital already told them they were going to do this and "our hands are tied." Each hospital has their own, separate contract with the union. No where in the contract does it say we can be floated to another hospital in the system. There is also note that you can't float a nurse with greater than 15 years of service but that rule is terminated once there's an emergency. I don't have 15 years of service. State of Emergency is in place so they can mandate OT now (per contract, they can't mandate OT) meaning they can force us to work beyond our 12 hour shift. At the moment, they can't force us to come in on our days off. The hospitals all over the city are offering travel nurses (contract nurses) outside the system to work at all these hospitals at rates like $3500-$4000/week. Unfortunately, for the hospitals, money is not motivating people to put their health at risk. I don't need any information/comments on lack of PPE. I am more than aware. I'm so frustrated reading "Well you signed up for this" because No, we did not. We signed up to protect and care for our patients with the proper tools needed and to be treated with dignity and respect from our employers. You don't send the military into war with water guns and t-shirts for protection, so why send us to fight this like this? We kept working when they told us our ICU was turning into COVID ICU. We kept working when they started to ration our PPE. We kept working when they mandated OT. We kept working when they gave us 3-4 ICU patients for a whole shift (unheard of, the ration is 1:2 across the country b/c of how sick patients are). We kept working as our own staff contracted COVID and now dropping like flies. But there is a line and it's being crossed. We need to know our workers' rights and I have no idea where to turn to. It doesn't seem right. The more of us that fall ill to this, the less HCPs there will be for the public. That being said, Thank you so much in advance for helping us out and any support you have given. [link] [comments] |
Thought I lost my phone, turns out someone has it and won't return it. Posted: 30 Mar 2020 05:58 AM PDT So a few weeks go I was drinking with friends, woke up the next day and couldn't find my phone. I assumed I lost it in my idiotic escapades the night before, and contacted my phone company who is still making me pay for the phone and plan because I didn't have insurance. I recently found out from a mutual friend that a girl who was with us that night has my phone, and despite multiple attempts to contact her, she won't return my or my mutual friends messages or phone calls. Normally I'd rather not involve the law in my life, buy the phone itself is 900+ and the bill is 90 a month. We live in Tennessee, what legal actions could I take? [link] [comments] |
Can I legally move out at 18 even if I’m still in high school? Posted: 30 Mar 2020 05:02 AM PDT Location: Utah, USA Hey there. So, the title basically says it all. I'm not happy living at home and my mental health is currently drained by my parents. I've been suffering from mental health issues and I constantly feel like I'm a failure to them, a financial burden, and that they wish I succeeded in my attempt. They adamantly deny this, but the way they treat me speaks differently. I'm slowly healing but they're setting me back. I'm 17F, currently doing my schoolwork online and I'm graduating in 2021 (so I'll be a senior this upcoming fall). This might be important, so I'm adding it. My mom has said that since I'm still in high school, even if I turn 18, she and my father have legal control over me and she forbids me to move out before I graduate high school. My question is, is there any truth to her claim? Am I legally allowed to move out when I turn 18? [link] [comments] |
“Owner” is threatening to call police or “even better take it the way I want” for lost pet. Posted: 30 Mar 2020 07:14 AM PDT Last week I found a pet bird that landed on my shoulder, I took it in. I asked neighbors, I made posts on several Facebook groups and called different exotic pet shops that sell birds. First, everywhere is closed due to covid-19, including the humane society. Second, I have cats, so after a few days I had no choice but to give it away to a good home. Then I received messages from a lovely gentleman that said "So I heard that you have my kids bird and now aren't going to open are replie to messages you been getting sent... You have been giving my number to get in touch with me have chose not to. So this way I see it either I get a call or I can call the police are even better take it the way I want. That's your to choices!!! Have to girls that love that bird and want it back. I'm not one play with I tryed go nice route and people just think they can keep what's not there's well not way it works. So either I get my kids bird back or I come take back my fucking self you choose!!!" I did receive one message from a random person but couldn't prove that it was their bird. So now I'm waiting for this guy to get off work to send me pictures of the bird.. Not to mention I've gotten several messages of people claiming the bird as their own and I saw the pictures and it's not even close. So I'm a little weary. Any advice? [link] [comments] |
Posted: 29 Mar 2020 09:27 PM PDT I have lived in my apartment, a house with 5 sub-units, for 2 years. About a month ago a woman with 4 dogs and a cat moved in. I had no idea someone moved in that apartment until it started stinking so badly of dog pee in the whole house i couldn't ignore it. I called the landlord and found out she moved in. I informed him, and about a week later the inspector came in for a routine inspection. I was informed the landlord had failed the inspection, as mine was the last apartment, and there were 13 points against him. The inspector also informed me that the other apartment with the dogs, the woman had the dogs caged in the bathroom and bathtub, and there was feces and urine everywhere. He deemed the apartment unlivable. That was 2 weeks ago. Just now, a dog was scratching at my door, and I walked out into the hallway to find he had peed in the hallway. I had to knock on the lady's door to let her know that her dog was out. She said she had no idea, but this is the second time. I believe she is letting her dogs out into the hallway to do their business. What do I do????????????? Edit:I currently don't have a job, and no source if income due to the virus. Pretty much my only option at this point is to stay here. Is there someone I could call about this issue if my landlord is aware and not addressing it? Edit 2: I just received a call back from animal control, they're going to come out and check the living conditions tomorrow!!! Edit 3: humane society came out and she answered the door. He says because the animals themselves look healthy it's an odd situation, but he's going to refer adult protective services and have them come take a look. He went in the apartment and says the living conditions are deplorable, shit and piss everywhere. The apartment itself is deemed unlivable and my landlord still doesn't have a C of O. Can't believe they responded so quickly!!!! I'm so grateful to the humane society they really came out within a couple hours. [link] [comments] |

University will find drugs in my room Posted: 29 Mar 2020 04:18 PM PDT I am a student at George Washington University. Due to the pandemic, students were notified that classes would be moving online until April 2nd, a few days before spring break. During spring break, students were notified that all on-campus activities, including housing and boarding, would be terminated for the remainder of the semester and that students would not be allowed to re-enter their dorms. The university and a third-party moving company intend to enter my dorm, gather my belongings, and store them until fall semester. In spite of the already clear violation of my privacy, the university is now asking students to report any prohibited items. I have a dab pen, empty bottle of alcohol, Vyvanse, and fake IDs in a locked drawer. It is not in a container, so the persons collecting my possessions would see it. I am not sure whether I should report and what the legal implications could be if I report/don't report. I could use any advice. If you have been found to be in possession of similar things while you were in university I would be curious to learn of what repercussions you faced. tl;dr: My university kicked me out without letting me gather all my stuff. Now they intend to pack it and store it themselves and will undoubtably find banned items. Not sure if I should self-report or not. *posted this to r/advice and many said to consult here. Looking to see what I should do and what the possible repercussions could be for me. This would all be in Washington D.C. [link] [comments] |
I'm really freaked out about a recent job scam I unintentionally took part in. Posted: 30 Mar 2020 01:14 AM PDT Location: Los Angeles, CA, USA I received a gmail from a recruiter using a redirected CareerBuilder address (betterchoiceag.com), asking me to apply for a quality control inspector job that basically involves opening packages, checking for quality measures, and reship them to another address. Pay was ok and I had nothing else going on for me after 10 months of job searching so I immediately accepted the offer and basically told them I was interested in an interview. They gave me a 7 minute phone interview and told me they would send another email confirming if I had gotten the job or not and a video explaining what the job is like. Another gmail address, this time from a company called SGS Post sent me a 10 minute video that shows a professionally animated cartoon explaining what the job will be like. Found absolutely nothing sketchy in it. Then they gave me a link to a docusign form which is basically a 12 page employee's contract that asks me to fill in general job application questions like home address, references, tele, and a photograph of my drivers license. Ok so now after that, they told me I got the job. I was thrilled but then after doing some digging, I found out that jobs requiring reshipping packages are all scams. So now I'm left with having given my personal info to some random scam company and my home address being used to potentially launder stolen/counterfeit/unlawful goods. What do I do if I receive them? I have already told them I will call the police if they send any packages to my address so what would be the best action to take now that my information is in someone else's hands? Thankfully I didn't give them any sensitive info like bank account numbers or SSN but I'm really freaked out that they know who I am and could possibly exploit my info... [link] [comments] |
(Boston, MA) Can I quit or be fired and still get unemployment benefits? Posted: 30 Mar 2020 10:50 AM PDT I'm an outpatient physical therapist working in Boston, MA. I work for a large company which I believe is acting extremely unethically by not taking enough precautions in treating patients. We have been encouraged to keep all patients coming in, taking no considerations for those at higher risk. It is a recipe for disaster: young healthy clinicians treating an older populace. Many patients are poorly educated and English is their second language - I feel my company is taking advantage of these people by providing reassurance when the message should be caution. I've made my stance on this known through an email to HR and regional manager and was pretty much shot down - they are playing the essential business card and how we need to take care of people. In my professional opinion, I firmly believe that in the midst of COVID-19, the risk of harm with furnishing outpatient physical therapy outweighs the benefit for the overwhelming majority of patients. Is PT essential? Yes, perhaps for some patients and perhaps some settings more than others. I would love to continue to take care of those who need it via tele-health, but we don't have a platform ready for roll out anytime soon. At this point in time, I feel completely uncomfortable keeping things as they are. When I'm back at work tomorrow, I plan to educate each and every patient on their risks and urge many of them to stay home with an exercise program. I'm worried I may be fired but I feel this is the right thing to do. I am also considering just resigning immediately. My fear is losing unemployment benefits. If I either resign or make a stand and get fired, I'm concerned I won't qualify for unemployment assistance. Does anyone know of this process would play out in MA? Or should I play it safe and try to hide the risks? [link] [comments] |
Posted: 30 Mar 2020 11:46 AM PDT I had an amended return for 2018 that showed I owed the IRS. No biggie, I set up a payment plan and I've been paying. Except today I receive notice in the mail that I have 30 days to make a payment for this month or they will terminate my agreement. The problem is, I already paid it. I paid online to them and I have a copy of the $250 monthly payment on my bank transcript. I paid on the 16th, it hasn't showed up on my IRS account yet. The problem is I can't call the IRS because their call centers are closed due to everything going on in the world right now. I have another payment coming up for next month soon, which I also intend to pay. But now I'm not sure what to do since I can't contact them, but I know I've paid. [link] [comments] |
Confidential medical information being discussed on speaker phone in public Posted: 30 Mar 2020 12:20 PM PDT First, I'm not sure if this is the right place to ask but it seems most fitting. I live in a condominium with businesses located below. One of these businesses is a rehab facility. I'm not entirely sure what they treat but there are nurses and psychologists/therapists. Routinely, employees take phone calls outside on their speakerphone discussing confidential patient information. This is with both the patient directly or a supervisor. I am not a patient but I don't think their patients know their issues are being freely discussed in public with others (not just myself/family) to hear. Revealing confidential medical information seems like a HIPAA violation. I am wondering what advice you all have so I can approach it correctly. I also don't want to get so involved I'm suddenly on the hook. Given this is COVID, I also don't want to pull unnecessary resources or personnel. For the record, they are difficult to talk to and blow off any discussions regarding this. Location: California Thank you all in advance. [link] [comments] |
Posted: 30 Mar 2020 08:31 AM PDT Hello everyone! My employer has recently laid off about half of our company due to Covid-19. It's been labeled as a temporary layoff, we get to keep our health insurance during the layoff (that we have to pay back the premiums on when we return), and I will be rehired once business picks back up. That said, my employer told a few of us that if we choose not to return to work with them when they call us, we have to pay back our unemployment benefits. I understand that I'll need to pay my insurance premiums whether or not I return to work with them, but I don't know if I'd actually be forced into paying back the unemployment benefits I'll be receiving. I plan to look for and apply for jobs during this downtime and try to find something I can start remotely or something that will hire me once the country is in a better place. I've had other issues with this employer and I'm not super interested in returning. I would like to know if I really will have to pay back the unemployment benefits, or if this is a scare tactic to make people come back. [link] [comments] |

Can my roommate sublease her room without my permission? FL Posted: 30 Mar 2020 11:23 AM PDT hi I live with 2 other roommates and today my roommate told me that shes moving out in 2 days and subleasing her room. We are all on separate leases. During a pandemic, I am especially concerned that this literal stranger has not been social distancing. My girlfriend is type 1 diabetic, therefore we have to be espcially cautious. This new sub-leaser would be sharing a bathroom with us, and would essentially have access to all of our food and belongings which is unsettling. Do I have any options? Can we refuse my ex-roommates choice of leaser? Are we able to evict this new leaser? We are in Florida. [link] [comments] |
Gym continued to charge after cancellation Posted: 30 Mar 2020 07:26 AM PDT My wife cancelled her Cyclebar membership last last year and we have continued to be charged ever since. I finally noticed this (way too late) and contacted the studio to cease charges moving forward and get reimbursed for past charges. We do have confirmation that the membership was cancelled, however, the studio is claiming that since they just changed management they are unable to reimburse us. My thinking is that since they took over the studio they took on all liabilities. Is that correct? Do we have any recourse here? [link] [comments] |
Posted: 30 Mar 2020 09:18 AM PDT Hi everyone, I made a throwaway account for this post. I'm on mobile, apologize for formatting. Basically, I've been a huge idiot and just want to get on top of my financial situation. I am well aware that this is a ridiculously bad situation to be in an am ashamed of it, please don't lecture me I just need advice.. I live in Arizona. When I was 18 I started stripping and I never thought about paying taxes, this was at the end of 2014. I put the money in my bank accounts, spent it, and forgot about it. Over the years I've accumulated a lot of debt as the strip club industry has slowed down. As of now, I have over $130k in debt (student loans, auto loan, credit card debt, and a $30k personal loan that was recently charged off and sold to Velocity Recoveries; I will probably be getting sued soon). At this point my expenses + bills are well over $5,000+ per month. No job I'm qualified for other than stripping could cover this. Now that bars and restaurants are closed, I'm out of work and have no income. My debt is mounting and I don't know what to do. I don't think I can apply for unemployment because I haven't paid any taxes. What should I do? I'm considering getting a CPA and filing my taxes for the last five years and hoping the IRS will allow me an installment agreement or an offer in compromise. Is this likely? I'm also considering filing chapter 7, but I want to keep my car (I need it) and I don't have any tax returns to give the court. What would be my best course of action forward? I just want to get my financial situation straight so I can sleep at night again. I'm afraid of being sued for the charge-off and having legal action taken against me by the IRS for my failure to report. As of now the IRS has not contacted me but I'm constantly scared they will find me out. I know this is a mess. Thanks for any advice you can offer. [link] [comments] |
Wife's former employer sold part of her 401k at the bottom of the market due to ADP/ACP compliance Posted: 30 Mar 2020 12:15 PM PDT Location: US - North Carolina My wife received a letter in the mail today along with a refund check due to her former employer failing to meet ADP/ACP regulation requirements in 2019. They sold her stock on March 13th without permission or notification after the market tanked, gutting a large chunk in her savings after coming close to her contribution max last year. The check she received is several thousand which is nice to have, but it is now taxable income and more importantly, was sold at the bottom of the current market situation. We're pretty furious. Is there any legal action that can be taken against her former employer for selling stock, without permission, for their own failure to comply with regulation requirements? [link] [comments] |
Dog was attack by neighbor's service dog. Posted: 30 Mar 2020 01:34 PM PDT About ten days ago while my mom was walking our bichon poodle, our dog was attacked by our neighbor's Labrador retriever service dog that was off leash while the owner was out for a quick smoke. Our dog was on a leash as required of the state of Arizona and the HOA. The attack left several deep wounds in her back and her stomach, and she had to be operated on several times with the possibility of euthanization on the table. The neighbor claims our dog bit her, although we believe that her own dog bit her as it aggressively tried to keep pursuit of my mother and dog which I saw firsthand. She says she wants to sue us for her finger and for pain and suffering, which we would also do to her if she actually goes through with it. She also says her dog is allowed to be off leash and that she has papers for that although I'm not sure how we were supposed to know that or why it really matters. I'm only adding this because it is something she often repeats in case it has any significance. Now our problem is that we know she doesn't have a lot of money since she told that to us herself that she doesnt have a job (prior to corona). We told her via phonecall we would sue her if she didnt agree to a settlement offer. We also sent another settlement offer to her via email. She has a home that her daughter purchased with earnings in a lawsuit along with two cars. We were planning to put a lean on her home but expect her to just declare bankruptcy once we do that and wipe it out. She claims she has several lawyers in her family and what we are worried about is that she expects them to work for free so her expenses if this goes to court are a wash, while we would be buried in legal fees. If it helps, she has been a known nightmare neighbor in the neighborhood, and has already had several complaints against her before this event even occurred. We dont want to harm her dog, all we want is for her to pay for almost killing our dog due to her recurring irresponsibility. Additionally - She has four dogs, although she lied to animal control claiming she has two and we have evidence of this if that matters. Having more than two dogs is also a violation of the neighborhood agreement. [link] [comments] |
New abusive landlord doesn’t honor existing lease. Posted: 30 Mar 2020 10:45 AM PDT As my spouse and I are first generation and they didn't have an SSN until their legal status was changed, we had to sign a Resident Lease Agreement Addendum at our apartment (in AZ) for Residents without a US guarantor for signing the lease. This means that we had to pay the last two month installments of rent upfront upon signing the lease. Our lease is due to end in the summer time and the management company for the apartment switched a few months back, and is absolutely horrible. They claim not to have access to any old documents that we saved, and we emailed a copy of the addendum to the apartment community manager per her request. She is attempting to not recognize our document which is attached to the lease itself and charge us for June and July when we already paid for these months. Rent is almost $2k each month but the area we live in is catered for student and all student housing abusive management in this city. What can we legally do, and is this addendum protected? Any advice is needed as we are being ridiculed and undermined by Management and we have no idea about our legal rights regarding this matter. Can we threaten to sue? My spouse and I do not want our rental record or credit ruined by a false report from this Management if they try to say that we didn't pay, or refuse to acknowledge our addendum. Since they charge all payments onto the resident portal, I worry they will just charge us for the summer months automatically, and then report us as unpaid, and use it for possible eviction. Please help and thank you kindly. [link] [comments] |
Posted: 30 Mar 2020 01:14 PM PDT She's a full time hourly employee of an ethnic grocery store in California. She's willing and able to work (I've advised her against this, but that's besides the point). It's been 2 weeks and got the notice that they're going to extend another 2 weeks at this point. Are they allowed to force her to use up her PTO? She would rather not have to use her PTO and collect unemployment instead. She's already applied for unemployment btw. Thanks for the help and I hope everyone stays safe and healthy [link] [comments] |
