Motorcyclist awarded $21 million-plus after video shows mechanic striking him on 405 Freeway

How does this work regarding insurance? This motorcyclist won $21 million but the insurance cap is $250,000 so who covers the rest?

This is a mechanic from KIA who was on the clock, test driving a customer's vehicle (alone) on the carpool lane. He didn't signal while he attempted to move out of the carpool lane (double yellow) and stuck the motorcycle.

My Dad's Life Insurance Agent Told Him To Lie

    Posted: 05 Dec 2019 08:38 AM PST

My parents recently have been looking into life insurance and their agent (my aunt) told my dad to lie and say he is a non smoker on the application. This seems like a complete red flag right? Surely the reduced premiums don't outweigh the chances of being caught and getting any claims denied right? He's looking to get a 250k policy and is paying about 800 a month.

I know companies vary, but how much are you guys paying per month so I can get an idea of what the fuck is going on. This seems shady af.

edit: I'm speaking to both my parents when they get home from work. Blood is starting to boil because my AUNT is the one who arranged all of this.

Edit 2: parents are going to review other options for life insurance because as you would guess, the company they went with was the only one they had looked at. Thanks for all of your guys input.

Approached by public adjuster in Florida to fix roof

    Posted: 05 Dec 2019 06:39 PM PST

I just want to know if everything so far is normal. I haven't paid anything, they take a cut from what the insurance pays, if they pay.

So I accepted his services and he sent a guy to my house to make holes in the guest room, which shows some water damage, to check for active humidity. He left a fan in there, which is insanely loud, to try to get rid of the humidity and says I have to leave it on for 2 days. I have guests so they are going to have to sleep elsewhere.

He says the actual people from my property insurance will come in later and repeat the process (oof). I don't quite understand what the public adjuster gains by sending someone to try to clear up the humidity. If it IS humidity caused by the hurricane, shouldn't it be left there as some proof of damage? My roof did get pretty banged up by hurricanes, the guy took pics of it and there's tons of broken tiles.

Can you file an E&O claim against an insurance agent/company without an attorney?

    Posted: 06 Dec 2019 01:01 AM PST

And are there good chances of winning the claim?

the story: the insurance agent basically sold my family a contract that they will never benefit from due to the length and also another contract that they cannot pay because they are on welfare.

I think the agent took advantage of their low education and just had them sign the dotted line. The copy of the contract doesn't have any of the "initial here" places an important contract would normally have. Additionally, they were told there's no penalty for cancelling yet they are losing a solid 10% of their money.

Are there some tips I should know about?

Also, who should I ask to talk to?

    Insurance Adjuster still hasn’t looked

    Posted: 05 Dec 2019 08:46 PM PST

Car was wrecked 4 days ago and it's still sitting at the lot where the tow truck took it after the wreck. Apparently someone is supposed to come take it away soon and then an adjuster will look at it and make a valuation. My progressive rep says he knows nothing and has no control over anything. Does a car normally sit there this long completely untouched? Do they just like paying rental car and tow yard storage fees?

Can I switch car insurance coverage day to day

    Posted: 05 Dec 2019 03:14 PM PST

I don't drive much, but when I do, it's often a long trip or road trip. I know I can add or remove coverage from my policy anytime, and I am just charged a rate proportional to the 6 month policy. If I'm planning a cross country road trip, can I just enhance my coverage for the few weeks on the road trip, and then return it back to my current policy?

    Are commercial lines pro-rated?

    Posted: 05 Dec 2019 06:34 PM PST

As the title says. Currently looking to renew my commercial lines with another company, but deadline is coming up and might not close out on this deal so I was planning on putting down 1 months worth of insurance coverage, but the sketchy brokerage that I'm recently signed with told me over the phone says that if I pay them, they keep the rest instead of pro-rating what's left over that month.

I know in normal PNC insurance, premiums get pro-rated if you switch carriers, but is this normal practice for commercial lines as well? I reside in NYC.

My insurance adjuster file door dings as collision.

    Posted: 05 Dec 2019 10:02 PM PST

So I got rear ended and took the car in to the insurance prefer shop for repair. There person that took pictures of the car started that the door dings would be a comprehensive coverage.

I didn't much of it but I decided to call my local agent which she confirmed door dings are covered under comprehensive.

So I figure since my car is already in for the other repair I might as well file to get the dings out.

To my surprise the adjuster filed it under collision.

Is this accurate or am I being screwed by my insurance adjuster?

First car accident was out of state.

    Posted: 05 Dec 2019 09:39 PM PST

The car i drive is insured by my mother and I'm on the insurance.

What i know is that there is a 1,000$ deductible.

I pulled out of a parking spot and backed into a parked car. I caved in the corner of the bumper and thats it as far as i know.

    I am 100% at fault.

My insurance is Allstate and its from MI, i currently reside in Washington state and have a washington drivers license. The two states are different. MI has no fault, washington is comparative.

I just need to know am i gonna have to suck it up and pay the 1,000 deductible or any part of it for that matter? I'd rather prepare myself for this before the allstate agent calls me tomorrow.

Thanks, if u need any more information leave a comment.

Help filing renter's insurance claim with Lemonade after neighbor's house fire

    Posted: 05 Dec 2019 11:42 AM PST

A few days ago, my next door neighbor's house caught on fire. Our houses are attached. My house didn't suffer any permanent damage, but it was completely filled with smoke. My landlord was able to get industrial-sized air purifiers in the house, as covered by his homeowner's insurance. A few days later, the smoke smell is lessened, but still there.

My landlord's insurance adjuster, who also has Lemonade renter's insurance himself, advised me to file a claim with Lemonade. His reasoning was that beyond many of my personal possessions smelling like smoke, the smoke and CO could have long term impacts on my belongings, especially electronics and books, even if they aren't showing any damage currently. He said that I should claim every single item I own, and note the value I paid or current sale value.

So I started the process of filing a claim with the Lemonade app. As the app instructed, I took a video of myself describing the situation as well as a video showing my neighbor's house that burned and my house right next door. When it came to entering in my belongings into the app, though, it required each item to be entered individually, with a description, price, when and where I bought it, photo, and receipt. Obviously, this process won't work for entering hundreds of items.

I made a spreadsheet of everything that I own that I have a receipt for, then also added things I don't have a receipt for, like things I bought many many years ago or things purchased from places like thrift stores or Craigslist. I emailed Lemonade (twice) asking if, instead of entering each item into the app individually, I could instead email them an itemized spreadsheet of everything I own that I want to claim, as well as a photo album of all of the items. I would include a column in the spreadsheet for photo number, so they could correspond photos with items in the spreadsheet, then also attach to the email any receipts that I have.

It's been 2 days and Lemonade hasn't responded. I've finished the spreadsheet, and I'm considering just going for it - taking photos of everything in the spreadsheet and emailing all of it to Lemonade.

Does anyone have experience making a similar claim or with Lemonade particularly? Do you have any advice for my situation? Thanks!

    Property damage liability?

Going through new car insurance policies. It starts me out at $5k then recommends I up it to $25k. The difference is like 10 bucks , then the difference between $25k & $50k is $2 bucks. Is this needed more than $5k? (State officials California).

    Damaged RIm

    Posted: 05 Dec 2019 03:52 PM PST

I got pushed pushed off the road by a driver not handling snow on the road very well. I of course damaged my car. The insurance company is fixing most of the car minus deductible. However i have aftermarket rims that are not available anymore. They didn't even include a rim in the estimate. How do i get my rims to match? They said they would do a supplement for a similar rim.. What does that even mean I get a random rim?? Discount tire has a handful in the US none of course near me and shipping is as much a just buying 4 new styles. Any ideas of how to get insurance company to fix my entire car would be great!!

Question about who should be liable for condo water damage

    Posted: 05 Dec 2019 07:23 PM PST

    Hi everyone,

I've never posted before and just found this sub and am hopeful someone can give me some perspective.

I live in Illinois if that matters with regards to relevant laws/regulations. Here is the scenario. My condo is on the third floor and there was a leak from our condensate pipe for our A/C unit that caused some water damage in the unit below. When it happened the owner of the until below reached out to me and we immediately called both a plumber and our insurance agent. The issue was quickly fixed and our insurance agent told us to file a claim but that the other until holder should do the same.

The other unit holder did just that and the result was that the other damaged unit's insurance ended up paying because it was not negligence on our part. (We agreed with the other owner to file a claim for goodwill to have our insurance company pay $500 of the other unit's $1000 deductible as a gesture of goodwill).

Now about a month later the condo board sent me a letter signed by the builing manager and with a 4 page opinion from the lawyer that our unit is liable because of our bylaws. He called my insurance agent an idiot and said that it's crazy that the damaged unit should have to pay. However, both insurance companies had access to the bylaws and didn't agree with him. In addition, they denied the request to send the master insurance information to our respective insurance companies.

My insurance agent basically said that the standard in the industry is unless negligence is involved, the insurance of teh damaged unit pays. Is that right and if so, is there anything that can be done? I agreed to pay the extra $500 of the $1000 deductible to avoid a nasty situation but I want to know if I was wrong or what I could have done or can do differently.

I greatly appreciate anyone who reads this and especially appreciate any thoughtful responses.

Insurance denying damage to car is from previous accident, where to next?

    Posted: 05 Dec 2019 03:33 PM PST

Hey everyone, quick question on where i can go next

My car in june was hit by someone in a parking lot as i was driving looking for a spot. they ruled it was the other persons fault and fixed my car for cosmetic damages and that was that.

Now 6,000 miles later, i realize my R front tire is bald from a bad strut and bearings. My mechanic stated this is most definitely from the accident and i contacted my insurance to place a supplement.

I requested someone be sent in person to take a look at the car and they denied fixing the struts, but would replace the bearings on the L side where i was hit.

I believe they are trying to get out of this without paying because my mechanic said there was no way to align the car, due to the bent struts. Adjuster states i can submit another claim and pay the 1k deductible.

Where to next? what can i do? Thanks so much, im not willing to go down without a fight as i know there has been no other damage to this car since that one and only accident.

    Thanks in advance.

[Help] Was involved in car accident August 27th (5 cars involved)

    Posted: 05 Dec 2019 03:30 PM PST

So I was involved in a car accident with 5 cars involved. I was in the exact middle and the last car pushed the car behind me into me which pushed me into the car in front of me. I called the car's insurance company directly behind me (the one that was propelled into me) and they told me go to call the last car's insurance because they found them to be at fault. In October I called USAA (last car's insurance company) to get things started. Few weeks went by and I called again November first to see what was taking so long. They were able to finalize it and accept fault saying they would pay for damages. They set me up with a car repair shop and gave me all the information to call. So I made an appointment for this Monday. But today I received a call from the company saying "they are not at fault and everything would be canceled." Their reasoning was that another person not working directly on the case went into the file and finalized everything. They want me to file with my own insurance company.

My question is what are my options. Do I still bring the car in and have it repaired? Or do I have talk to my insurance now? This happened in Oklahoma by the way.

    Question from new agent

    Posted: 05 Dec 2019 02:59 PM PST

Sorry that the flair doesn't fit really. So I'm a new agent. I'm licensed in P&C life and health (the health is mostly a formality for my company, Nodak Insurance Company). I started hot because of my warm market and I've slowed since then. I'm just wondering what the best tool you all use to prospect and get leads that eventually lead to sit downs and sales. Whether that is online leads, direct mailers or other strategies that would be amazing. Thanks!

Health Insurance If Wife Leaves Job After Baby

    Posted: 05 Dec 2019 06:17 PM PST

    Hi everyone!

My wife and I are expecting our first child mid 2020. I am self employed and my wife works as a therapist for a school district. We are currently insured through her employer and, because it's a government entity, we have pretty great health insurance at a relatively minimal cost.

We are considering having my wife stay home for a full year after the baby is born. She is allowed 3 of maternity leave, so the extended leave will likely cause her to have to take a leave of absence or quit. Either way, we will be without her health insurance.

In the past, as a self employed individual I have always bought insurance directly or through the healthcare exchange. I am a young, healthy individual so I would always just buy catastrophe level insurance. With a baby, I would certainly want better insurance for my wife, the baby, and (maybe) me.

Does anyone have any suggestions on how to approach this in the most economical way possible? Any experience with a similar situation?

If we just have to suck it up and pay for good insurance for a year, that's okay. We can save for it. But I'd love to hear everyone's thoughts on the matter.

    Thank you so much.

Advice for making claim related to damage caused by power utility? Hidden damage concerns.

    Posted: 05 Dec 2019 05:50 PM PST

Questions regarding future claim with major utility company in the Pacific Northwest.

Due to the failure of the line supplying power to my home, my house experienced surging power over several hours.

The power issues resulted in several electronic devices/appliances failing. I contacted the claims department and they wouldn't go past, "You'll need to tell us everything damaged. I can't guarantee you'll be covered for anything." Power company has been on-site the last three days fixing their lines. Cause of damage is clearly established.

    1. What should I be thinking about/inspecting that people overlook?

    2. I fixed my own furnace to get the heat on quickly for my family and because I didn't want a $1,000 repair bill. Was that a mistake? $250 furnace part (have receipt), $200 smart thermostat (not yet replaced because I had an old thermostat around).

    3. Is claim compensation for shortened life of appliances a thing? They are still functioning. We purchased some high-end appliances this summer, and we're nervous about their lifespan being diminished. Do I have to prove something was damaged if it still turns on? If so, any tips?

    4. If they agree they are at fault, any idea if items will be covered close to replacement costs?

No questions below, just context for the curious: It was like a poltergeist movie with lights flickering, appliances making odd clicking noises, and light bulbs making crackling sounds. The anxiety filled dog now lives under our bed.

The issue mostly damaged high energy consumption appliances with circuit boards. My losses so far are inconvenient, but nothing that forced a hotel stay.

    • furnace (we made due with some electric heaters and lots of blankets.)
    • oven (older range, my new range was not installed)
    • ice maker in nearly new fridge (<120 days)
    • treadmill
    • coffee maker
    • aquarium heater
    • outdoor motion-sensing lights
    • multiple surge protectors
    • more once I get time to survey this weekend

Thanks for reading. It's been a stressful week.

TL;DR: Buzz, zap, crackle, F@$#!, brrrrr. Now what?

Car Totaled at $2400, Insurance wants to Salvage it to us for $1400

    Posted: 05 Dec 2019 02:04 PM PST

Wife was rear-ended into another car on the highway. Other guy's insurance accepted full responsibility.

Initial estimate from their insurance was about $500 to repaint bumper. Took it to the body shop and showed them where my trunk is now smaller than it was pre-accident (hard to see in pictures). Car is now totaled for $2400.

The trunk still works and seals, and we'd like to keep the car, but when we asked the insurance about keeping the car, they said they'd value it at $1400.

My question is: how are they saying this car is not worth repairing the body damage, but it's still worth $1400? Can we negotiate with the insurance to keep it for less money?

What are the chances that this will go my way? (car accident)

    Posted: 05 Dec 2019 04:42 PM PST

This past Saturday I was in a pretty minor fender bender.

The road has one lane either direction, with a single lane median for turns. The guy in front of me slowed down and moved into the median (no blinker), so I naturally assumed he was making a left turn and continued driving. Apparently, him moving ALL THE WAY into the median was his version of "swinging out" to make a right turn. Guy goes to make his right turn FROM THE CENTER MEDIAN when I'm pretty much right next to him and sideswipes me.

The damage was fairly minor, but he got out of his car and immediately starts asking me why *I* hit *him.* Thing is, the lanes on this road are SUPER narrow, with no shoulder, and there is no possible way that the damage could have occurred where it did if he had not been entirely in the center median. I physically would not been able to squeeze my car right next to his if ANY part of his car had remained in the travel lane.

I decided to try to file directly with his insurance company (State Farm) since I thought it was a pretty clear case. Well, they just called me back and said that they've determined that I'm 80% at fault for- get this- "improper lane usage."

I politely told them that it was bullcrap, and will not be accepting that decision as I'm now having my insurance company (Geico) fight on my behalf.

Now, I'm not totally surprised that State Farm ruled in his favor since I know they don't want to have to pay out, but I was wondering if anyone had any idea how likely things would actually go my way through all this.

Sorry this is lengthy, but I've been driving for a decade and this is my first accident, so I'm not totally sure on how all this he said/she said crap will pan out and it's got my anxiety through the roof.
